		<official-title>To amend title XXI of the Social Security Act to improve
		  access to the children’s health insurance program (CHIP) by providing
		  exemptions to CHIP eligibility waiting period requirements.</official-title>

		<section id="HBF299AE08E884BA0871D806AA8ADC691" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Children’s Health Insurance Accessibility Act of
			 2009</short-title></quote>.</text>
		</section><section id="H327965AEA8814D2F9C29B552B92403AC"><enum>2.</enum><header>Preventing the
			 application under CHIP of coverage waiting periods to children who lose health
			 insurance coverage, who are under 2 years of age, or for whom health insurance
			 coverage is unaffordable</header>
			<subsection id="H38035A5EE3064387BE8748D55D077367"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2102(b)(1) of
			 the Social Security Act (42 U.S.C. 1397bb(b)(1)) is amended—</text>
				<paragraph id="H82ABCC6C09ED407BBA3A3597F95ED4BF"><enum>(1)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="HBAF2F41A0BF748E6B95B589800EF5A5E"><enum>(A)</enum><text>in clause (iii),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HC76B86F9F1BA419092CA5529BDFE1011"><enum>(B)</enum><text>in clause (iv), by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="HD0DFDA21B52D4716819BC62031D67FB6"><enum>(C)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="HE4113D08E25F4F0482A9C29EBCA5324F" style="OLC">
							<clause commented="no" id="HD81035BAD87A4C81B6C19F87F2765BF4"><enum>(v)</enum><text display-inline="yes-display-inline">may not apply a waiting period (including a
				waiting period to carry out paragraph (3)(C)) in the case of a child described
				in subparagraph (C).</text>
							</clause><after-quoted-block>; and
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H1BEB5A27454844EFBCC4F09726739364"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H336EB0189F78445CAC085EF73C49BE47" style="OLC">
						<subparagraph id="HBCE26D6166F74D4CBAAC2926239E47A7"><enum>(C)</enum><header>Description of
				children not subject to waiting period</header><text display-inline="yes-display-inline">For purposes of this paragraph, a child
				described in this subparagraph is a child who, on the date an application is
				submitted for such child for child health assistance under this title, meets
				any of the following requirements:</text>
							<clause id="H8BB385A8A43045E7A20A12406507D72D"><enum>(i)</enum><header>Infants and
				toddlers</header><text display-inline="yes-display-inline">The child is under
				two years of age.</text>
							</clause><clause commented="no" id="HFDCF4B8CCFAB44C2A559192CE48DA6E9"><enum>(ii)</enum><header>Loss of group
				health plan coverage</header><text display-inline="yes-display-inline">The
				child previously had private health insurance coverage through a group health
				plan or health insurance coverage offered through an employer and lost such
				coverage due to—</text>
								<subclause commented="no" id="HD294BB89F4104273BB11D2952855C84E"><enum>(I)</enum><text display-inline="yes-display-inline">termination of an individual’s
				employment;</text>
								</subclause><subclause commented="no" id="H541E19C9D521465BA1F0C67C3FB26FE9"><enum>(II)</enum><text>a reduction in
				hours that an individual works for an employer;</text>
								</subclause><subclause commented="no" id="HC38DC59C4F464363BC7FEA6D8677E138"><enum>(III)</enum><text>elimination of
				an individual’s retiree health benefits; or</text>
								</subclause><subclause commented="no" id="HAA38E24869D14DF096673A4716AFABC7"><enum>(IV)</enum><text display-inline="yes-display-inline">termination of an individual’s group health
				plan or health insurance coverage offered through an employer.</text>
								</subclause></clause><clause id="H1FCF3376205C46D1A7F5657917158B57"><enum>(iii)</enum><header>Unaffordable
				private coverage</header>
								<subclause display-inline="no-display-inline" id="H88891338F9764B4B8539CE25840A4545"><enum>(I)</enum><header>In
				general</header><text>The family of the child demonstrates that the cost of
				health insurance coverage (including the cost of premiums, co-payments,
				deductibles, and other cost sharing) for such family exceeds 10 percent of the
				income of such family.</text>
								</subclause><subclause id="HB6282B8F19DA4AC1A9810CB67B3CDDE0"><enum>(II)</enum><header>Determination
				of family income</header><text>For purposes of subclause (I), family income
				shall be determined in the same manner specified by the State for purposes of
				determining a child’s eligibility for child health assistance under this title.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H416567873020405BB6689FDA80F5E99D"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as of
			 the date that is 90 days after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
