<official-title>To amend the Internal Revenue Code of 1986 to exclude from gross income any enlistment, accession, reenlistment, retention, or incentive bonus paid to a member of the Armed Forces.</official-title>

<section id="H6398B1AB3F7746AA959FD1A70C66D747" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tax Relief and Fulfilling Our Obligation to Patriotic Soldiers Act of 2009</short-title></quote>.</text></section> 
<section id="H92E46C5FA4574BB9804B4416E6E8F83D"><enum>2.</enum><header>Exclusion from gross income of enlistment and reenlistment bonuses for members of the armed forces</header> 
<subsection id="H9F9C5F4CDE7E414DB025EF9558428940"><enum>(a)</enum><header>In general</header><text>Section 112 of the Internal Revenue Code of 1986 (relating to certain combat zone compensation of members of the Armed Forces) is amended by redesignating subsections (c) and (d) as subsections (d) and (e), respectively, and by inserting after subsection (b) the following new subsection:</text>

<subsection id="H6B3E96C1ED0C4141892AA01C48C974C3"><enum>(c)</enum><header>Qualified bonus</header><text>Gross income does not include a qualified bonus.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H36312383692547789ADDC639044DC7E6"><enum>(b)</enum><header>Qualified bonus defined</header><text>Subsection (d) of section 112 of such Code (relating to definitions), as redesignated by subsection (a), is amended by adding at the end the following new paragraph:</text>

<paragraph id="HF001505E643348EDB6B59B46F09415FA"><enum>(6)</enum><header>Qualified bonus</header> 
<subparagraph id="H2A2D06976BCF47F6B2F7EBD07D7EEDF8"><enum>(A)</enum><header>In general</header><text>The term <term>qualified bonus</term> means an enlistment, accession, reenlistment, retention, incentive, or other bonus paid by the Secretary concerned to a member of the Armed Forces of the United States in exchange for the agreement of the member to accept a commission as an officer, extend an active service commitment as an officer, enlist, reenlist, or extend an enlistment as an enlisted member in an active or reserve component, or enter into a reserve affiliation agreement.</text></subparagraph> 
<subparagraph id="H656628BE07EE4AF6A9F900DE7F55E663"><enum>(B)</enum><header>Other definitions</header><text>For purposes of subparagraph (A), the terms <term>active service</term>, <term>enlisted member</term>, <term>officer</term>, and <term>Secretary concerned</term> have the meanings given to such terms in section 101 of title 10, United States Code.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H43400F73DBD145268EA02CE3F962DDF7"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph id="H36C71C01BD4C4FD69341846766C0D2B4"><enum>(1)</enum><text>Section 2201 of such Code is amended by striking <quote>section 112(c)</quote> both places it appears and inserting <quote>section 112(d)</quote>.</text></paragraph> 
<paragraph id="HF70D0E7881E9460EB7CFC309E37526A0"><enum>(2)</enum><text>The heading for section 112 of such Code is amended by inserting <quote><header-in-text level="section" style="OLC">and other</header-in-text></quote> before <quote><header-in-text level="section" style="OLC">compensation</header-in-text></quote>. </text></paragraph> 
<paragraph id="H71E9D168439D4152AA8950FCE8C6526E"><enum>(3)</enum><text>Section 3401(a)(1) of such Code is amended by inserting <quote>and other</quote> before <quote>compensation</quote>.</text></paragraph> 
<paragraph id="HB577B502A4B6406BBEEBE06F817CAADA"><enum>(4)</enum><text>The table of sections for part III of subchapter B of chapter 1 of such Code is amended by striking the item relating to section 112 and inserting the following new item:</text>
