		<section id="H6796A2EBFA0749B20000B3E51B525C97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Drug Trafficking Elimination Act of
			 2009</short-title></quote>.</text>
		</section><title id="HE56BC17BD2D94FBDA552E8E33BDBE0EF"><enum>I</enum><header>Criminal
			 Enhancements</header>
			<section id="HE609CF9926EC4E6C945DEC5FB141EAED"><enum>101.</enum><header>Criminal
			 enhancements for unlawful manufacturing, distributing, dispensing, or
			 possessing with intent to manufacture, distribute, or possess large amounts of
			 heroin, marihuana, and methamphetamine</header><text display-inline="no-display-inline">Section 401(b)(1) of the Controlled
			 Substances Act (21 U.S.C. 841(b)(1)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H853C5FB2BCB74006AB4DF864B09931A7" style="traditional">
					<subparagraph id="H86DD5CEC45F64CACB2DDCDF2FD43F1AB" indent="up2"><enum>(F)</enum><text>In the case of a violation of
				subsection (a) of this section involving—</text>
						<clause id="H5778135D8BBB4B088187F6CF5CE28800"><enum>(i)</enum><text>more than 10 kilograms of a mixture or
				substance containing a detectable amount of heroin;</text>
						</clause><clause id="HEFC1A54E16314011B284589CDD8C0081"><enum>(ii)</enum><text>more than 10,000 kilograms of a
				mixture or substance containing a detectable amount of marihuana, or more than
				10,000 marihuana plants regardless of weight; or</text>
						</clause><clause id="HA31209C38D8644E892C2D703654BEC0"><enum>(iii)</enum><text>more than 500 grams of
				methamphetamine, its salts, isomers, and salts of its isomers or more than 1.5
				kilograms of a mixture or substance containing a detectable amount of
				methamphetamine, its salts, isomers, or salts of its isomers,</text>
						</clause><continuation-text continuation-text-level="subparagraph">such
				person shall be subject to the same penalties as applicable under subparagraph
				(A) of this paragraph, except that such person shall be sentenced to a term of
				imprisonment which may not be less than 20
				years.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HF89517617E104C38AB026F8CA787FAB3"><enum>102.</enum><header>Criminal
			 enhancements for unlawful importation and exportation of large amounts of
			 heroin, marihuana, and methamphetamine</header><text display-inline="no-display-inline">Section 1010(b) of the Controlled Substances
			 Import and Export Act (21 U.S.C. 960(b)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H33AD5E9BE6524F01B197042E02774624" style="traditional">
					<paragraph id="HF86F31EB77774173BB2C54BC00EC0853" indent="up1"><enum>(8)</enum><text>In the case of a violation of
				subsection (a) of this section involving—</text>
						<subparagraph id="H4D7A9BB26DB344B8B63529DED923A1D9"><enum>(A)</enum><text>more than 10 kilograms of a mixture or
				substance containing a detectable amount of heroin;</text>
						</subparagraph><subparagraph id="HB922E3A1A0A9451E83DF5F559EEDD28C"><enum>(B)</enum><text display-inline="yes-display-inline">more than 10,000 kilograms of a mixture or
				substance containing a detectable amount of marihuana; or</text>
						</subparagraph><subparagraph id="H13AA3FD8A53246DD82062088B0931CD2"><enum>(C)</enum><text>more than 500 grams of
				methamphetamine, its salts, isomers, and salts of its isomers or more than 1.5
				kilograms of a mixture or substance containing a detectable amount of
				methamphetamine, its salts, isomers, or salts of its isomers,</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">the person
				committing such violation shall be subject to the same penalties as applicable
				under paragraph (1) of this subsection, except that such person shall be
				sentenced to a term of imprisonment which may not be less than 20
				years.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H8DF87776D52C47E198002415FBE49DC4"><enum>103.</enum><header>Manufacturing
			 controlled substances on Federal property</header><text display-inline="no-display-inline">Section 401(b)(5) of the Controlled
			 Substances Act (21 U.S.C. 841(b)(5)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1D099530515144BA906C70E0195E8700" style="traditional">
					<paragraph id="HF50BCF468C61440CB4DB633E4350BBD5" indent="up1"><enum>(5)</enum><header>Manufacture or cultivation on
				Federal property</header><text>Any person who violates subsection (a) of this
				section by manufacturing or cultivating a controlled substance on Federal
				property shall be imprisoned for a term of not more than 10 years, which shall
				be imposed consecutively and in addition to the penalty imposed under paragraph
				(1).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H309ABBDFD7D249B1A97F3C61903B1EA"><enum>104.</enum><header>Use of hazardous
			 substances on Federal land</header><text display-inline="no-display-inline">Section 401(b)(6) of the Controlled
			 Substances Act (21 U.S.C. 841(b)(6)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H5DA3BCA48C6E4531A5E2D51501000087" style="traditional">
					<paragraph id="H382928746DC74A6A973BCDB745BF50B0" indent="up1"><enum>(6)</enum><header>Use of hazardous
				substances</header><text>Any person who violates subsection (a) and knowingly
				uses a poison, chemical, or other hazardous substance on Federal land, and by
				such use—</text>
						<subparagraph id="H37B0209E5D25446CAAD31BA58EB53298"><enum>(A)</enum><text>creates a serious hazard to humans,
				wildlife, or domestic animals;</text>
						</subparagraph><subparagraph id="H1BAA6E4541F9404AB923B08E4194DEC"><enum>(B)</enum><text>degrades or harms the environment or
				natural resources; or</text>
						</subparagraph><subparagraph id="H84762AA6FB6249D79443F300D53CC1C1"><enum>(C)</enum><text>pollutes an aquifer, spring, stream,
				river, or body of water,</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">shall be
				imprisoned for a term of not more than 5 years, which shall be imposed
				consecutively and in addition to the penalty imposed under paragraphs (1) and
				(5).</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HF39370925CC14B99AC1FA6CE77E5FBA5"><enum>105.</enum><header>Listed
			 chemicals</header><text display-inline="no-display-inline">Section 401(c) of
			 the Controlled Substances Act (21 U.S.C. 841(c)) is amended by striking
			 <quote>20 years</quote> and <quote>10 years</quote> and inserting <quote>30
			 years</quote> and <quote>20 years</quote>, respectively.</text>
			</section><section id="HD28029D0146E4E02B4ED9921F1F170B3"><enum>106.</enum><header>Murder and
			 other violent crimes related to drug trafficking, and dangerous drug
			 trafficking organizations</header>
				<subsection id="H895E3DBF7FB949249E36AA0026D5A751"><enum>(a)</enum><header>Murder and other
			 violent crimes committed during and in relation to a drug trafficking
			 crime</header><text>Part D of the Controlled Substances Act (21 U.S.C. 841 et
			 seq.) is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HB79210E174934AEFA228769028DC36A6" style="traditional">
						<section id="H0A104FA9AED6426BBBCF2BF9ECED203"><enum>424.</enum><header>Murder and other violent crimes committed during and in
		  relation to a drug trafficking crime</header><subsection commented="no" display-inline="yes-display-inline" id="HDB1B40A344F54929B856278F43801BFA"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Whoever commits, or
				conspires, or attempts to commit, a crime of violence during and in relation to
				a drug trafficking crime, shall, unless the death penalty is otherwise imposed,
				in addition and consecutive to the punishment provided for the drug trafficking
				crime and in addition to being subject to a fine under title 18, United States
				Code—</text>
								<paragraph display-inline="no-display-inline" id="HE032E7B55A7B49FAA2C041CA4F1BC96D"><enum>(1)</enum><text>if the crime of
				violence results in the death of any person, be sentenced to death or life in
				prison;</text>
								</paragraph><paragraph id="H05D4A019691344BDB397FFA05700401C"><enum>(2)</enum><text>if the crime of
				violence is kidnapping, aggravated sexual abuse, or maiming, be imprisoned for
				life or any term of years not less than 30;</text>
								</paragraph><paragraph id="HE1549E027CD248A5921B2161047044CE"><enum>(3)</enum><text display-inline="yes-display-inline">if the crime of violence is assault
				resulting in serious bodily injury, be imprisoned for life or any term of years
				not less than 20; and</text>
								</paragraph><paragraph id="HEFC8729D943B44F587614F9001D44D04"><enum>(4)</enum><text>in any other case,
				be imprisoned for life or for any term of years not less than 10.</text>
								</paragraph></subsection><subsection id="H94C8E338B76F4C7C875E1CC4005DA882"><enum>(b)</enum><header>Venue</header><text>A
				prosecution for a violation of this section may be brought in—</text>
								<paragraph id="H486C1E8DDB9D4CCB860000F38626D138"><enum>(1)</enum><text>the judicial
				district in which the murder or other crime of violence occurred; or</text>
								</paragraph><paragraph id="HC81EC97DA6D643D58E5DF49C3C75B900"><enum>(2)</enum><text>any judicial
				district in which the drug trafficking crime may be prosecuted.</text>
								</paragraph></subsection><subsection id="H07C46C21AAA54627A5215086A6407DB0"><enum>(c)</enum><header>Definitions</header><text>As
				used in this section—</text>
								<paragraph id="HA1256204F88C4977BEED790766507852"><enum>(1)</enum><text>the term
				<term>aggravated sexual abuse</term> means an offense that, if committed in the
				special maritime and territorial jurisdiction would be an offense under section
				2241(a) of title 18, United States Code;</text>
								</paragraph><paragraph id="HEFAFA6522A904BE28C15A9139B93D900"><enum>(2)</enum><text>the term
				<term>crime of violence</term> has the meaning given that term in section 16 of
				title 18, United States Code;</text>
								</paragraph><paragraph id="H75036E113C8E4F0781DD346840DE0023"><enum>(3)</enum><text>the term
				<term>drug trafficking crime</term> has the meaning given that term in section
				924(c)(2) of title 18, United States Code; and</text>
								</paragraph><paragraph id="H10CB4293B34743B0B4D7217FC5B766F2"><enum>(4)</enum><text>the term
				<term>serious bodily injury</term> has the meaning given that term in section
				1365 of title 18, United States
				Code.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H57F363F1619F4860B300A7449F6860F0"><enum>(b)</enum><header>Dangerous drug
			 trafficking organizations</header><text>Part D of such Act is further amended
			 by adding after section 424, as added by subsection (a) of this section, the
			 following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H2FB6EFB088F2429EB1865665811DB5B6" style="traditional">
						<section id="HE4C2060DF6344A9AB21001878D564E92"><enum>425.</enum><header>Dangerous drug trafficking organizations</header><subsection commented="no" display-inline="yes-display-inline" id="H4B157A287CEF40F581E3BDFC7006185"><enum>(a)</enum><header>In
				general</header><text>Any person who knowingly engages in a dangerous drug
				trafficking organization, as defined in subsection (b), shall be imprisoned for
				not less than 20 years nor more than life, fined in accordance with the
				provisions of title 18, United States Code, or both.</text>
							</subsection><subsection id="HA6CE17827A42415DBDF800F368EA777F"><enum>(b)</enum><header>Dangerous drug
				trafficking organization defined</header><text>For purposes of this section,
				the term <term>dangerous drug trafficking organization</term> means a formal or
				informal group, organization, or association of 5 or more individuals—</text>
								<paragraph commented="no" id="HECAEBAADD3594D47BA8EA208A47E7572"><enum>(1)</enum><text>that has as one of
				its purposes the commission of one or more drug trafficking crimes (as defined
				in section 924(c)(2) of title 18, United States Code);</text>
								</paragraph><paragraph id="H9581853673314678B304D2C51509BC6C"><enum>(2)</enum><text>one or more of the
				members of which commit or have committed, in furtherance of such
				purpose—</text>
									<subparagraph id="H65B721D065E84A82A1C5264E4B200042"><enum>(A)</enum><text>more than one
				violation of this part the punishment of which is a felony; and</text>
									</subparagraph><subparagraph id="HA9A7397091AC4712AF9E5B752F574969"><enum>(B)</enum><text>2 or more
				violations, in 2 or more separate criminal episodes, of section 424; and</text>
									</subparagraph></paragraph><paragraph id="H762E2954856C4D99AD06BD77A48AF17"><enum>(3)</enum><text>the activities of
				which involve at least 50 times the quantity of a substance described in
				section 401(b)(1)(B).</text>
								</paragraph></subsection><subsection id="HC83186B4561943DEA507452E07B930A5"><enum>(c)</enum><header>Extraterritorial
				jurisdiction</header><text>There is jurisdiction over an offense under this
				section committed outside the United States if the individual committing the
				offense is a citizen of the United States or an alien lawfully admitted to the
				United States for permanent residence (as defined in section 101(a)(20) of the
				Immigration and Nationality Act (8 U.S.C.
				1101(a)(20))).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H32596E5076B342F08BE7A7FE5BAED8E4"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents for the Comprehensive Drug Abuse
			 Prevention and Control Act of 1970 is amended by inserting after the item
			 relating to section 423 the following:</text>

							<toc-entry level="section">Sec. 424. Murder and other violent crimes
				committed during and in relation to a drug trafficking crime.</toc-entry>

				organizations.</toc-entry>

				</subsection></section></title><title id="H42048593DFE94F2B8CEBDE39C8042A"><enum>II</enum><header>Protecting Children
			 From Drug Traffickers</header>
			<section id="HC84895F01C5F41EDB9A3CA83061C5D28"><enum>201.</enum><header>Distribution to
			 persons under age 21 and pregnant persons</header>
				<subsection id="HA75C843D28214314B9C5004B6F28A625"><enum>(a)</enum><header>In
			 general</header><text>Section 418 of the Controlled Substances Act (21 U.S.C.
			 859) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H3BEE5C79ACAF40618CED873991AA63B2" style="traditional">
						<section id="H3A9D23864A5F4F5689FB80B4C5FA2888"><enum>418.</enum><header>Distribution to persons under age 21 and pregnant
		  persons</header><subsection commented="no" display-inline="yes-display-inline" id="H00C2F19EA773443EB3BA596B19241F7F"><enum>(a)</enum><header>Distribution to
				persons under 21</header><text>Except as provided in subsection (b), any person
				at least 18 years of age who violates section 401(a)(1) by distributing a
				controlled substance to a person under 21 years of age shall be sentenced to a
				term of imprisonment of not less than 3 years nor more than 10 years in
				addition and consecutive to any punishment under section 401(b). The mandatory
				minimum sentencing provisions of this subsection shall not apply to offenses
				involving 5 grams or less of marihuana.</text>
							</subsection><subsection id="HDC4808BF92724507B48CE09BC15EB090"><enum>(b)</enum><header>Distribution to
				pregnant persons</header><text display-inline="yes-display-inline">Except as
				authorized by this title, any person who knowingly provides or distributes any
				controlled substance to a pregnant individual in violation of any provision of
				this title shall be sentenced to a term of imprisonment of not less than 3
				years nor more than 10 years in addition and consecutive to any punishment
				under section 401(b).</text>
							</subsection><subsection id="H8DFED5D53FAB436DA17840C8AA6B9B51"><enum>(c)</enum><header>Second or
				subsequent offenses</header><text display-inline="yes-display-inline">Any
				person at least 18 years of age who violates subsections (a) or (b) after a
				prior conviction under section 401(a) has become final shall be sentenced to a
				term of imprisonment of not less than 5 years nor more than 20 years in
				addition and consecutive to any punishment under section 401(b). Penalties for
				third and subsequent convictions shall be governed by section
				401(b)(1)(A).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H1A0EB0C3E3964FEFA67F7078CDB515A3"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The item relating to section 418 in the table of
			 contents for the Comprehensive Drug Abuse Prevention and Control Act of 1970 is
			 amended to read as follows:</text>

							<toc-entry level="section">Sec. 418. Distribution to persons under

				</subsection></section><section id="H534E9341C9DD49FA95007E1874825FCD"><enum>202.</enum><header>Distribution in
			 or near schools</header><text display-inline="no-display-inline">Section 419 of
			 the Controlled Substances Act (21 U.S.C. 860) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H053319DC5AD145DFACC89E7160759F81" style="traditional">
					<section id="H8FE2FBB5AF594DFA8F650259356657D"><enum>419.</enum><header>Distribution in or near schools</header><subsection commented="no" display-inline="yes-display-inline" id="H9F316A32783B4CC3BEEC24DE919614D1"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided by
				subsection (b), whoever violates section 401(a)(1) or section 416 by
				distributing, possessing with intent to distribute, or manufacturing a
				controlled substance in or on, or within one thousand feet of, the real
				property comprising a public or private elementary, vocational, or secondary
				school or a public or private college, junior college, or university, or a
				playground, or housing facility owned by a public housing authority, or within
				100 feet of a public or private youth center, public swimming pool, or video
				arcade facility, shall be sentenced to a term of imprisonment of not less than
				3 years nor more than 10 years in addition and consecutive to any punishment
				under section 401(b). The mandatory minimum sentencing provisions of this
				subsection shall not apply to offenses involving 5 grams or less of
				marihuana.</text>
						</subsection><subsection id="H6A69DBD90881418AAD7395F7A2E7931"><enum>(b)</enum><header>Second or
				subsequent offenses</header><text display-inline="yes-display-inline">Whoever
				violates subsection (a) after a prior conviction under section 401(a) has
				become final shall be sentenced to a term of imprisonment of not less than 5
				years nor more than 20 years in addition and consecutive to any punishment
				under section 401(b). Penalties for third and subsequent convictions shall be
				governed by section 401(b)(1)(A).</text>
						</subsection><subsection id="HA2552A038BA04AB39127C885F254BBF9"><enum>(c)</enum><header>Definitions</header><text>As
				used in this section—</text>
							<paragraph id="HEDD38E616F274AC28F33F73600927BB0"><enum>(1)</enum><text>the term
				<term>playground</term> means any outdoor facility (including any parking lot
				appurtenant thereto) intended for recreation, open to the public, and with any
				portion thereof containing three or more separate apparatus intended for the
				recreation of children including, but not limited to, sliding boards,
				swingsets, and teeterboards;</text>
							</paragraph><paragraph id="H7A63020C25514FAD90969147A93DCA8C"><enum>(2)</enum><text>the term
				<term>youth center</term> means any recreational facility and/or gymnasium
				(including any parking lot appurtenant thereto), intended primarily for use by
				persons under 18 years of age, which regularly provides athletic, civic, or
				cultural activities;</text>
							</paragraph><paragraph id="HC6605469D63D461682E3FA00176ED96B"><enum>(3)</enum><text>the term
				<term>video arcade facility</term> means any facility, legally accessible to
				children, intended primarily for the use of pinball and video machines for
				amusement containing a minimum of ten machines that are either pinball or video
				machines; and</text>
							</paragraph><paragraph id="H142C12033AF7415300E4FF01A2D09BCD"><enum>(4)</enum><text>the term
				<term>swimming pool</term> includes any parking lot appurtenant
				thereto.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H79BB0AB552604EF09D46DA7E5CE62622"><enum>203.</enum><header>Employment or
			 use of persons under 18 years of age in drug operations</header><text display-inline="no-display-inline">Section 420 of the Controlled Substances Act
			 (21 U.S.C. 861) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H6000EEB3E6484C6EB7602F7EAF96A8D3" style="traditional">
					<section id="HA1B12D052CA84F269E0900D037D679D0"><enum>420.</enum><header>Employment or use of persons under 18 years of age in drug
		  operations</header><subsection commented="no" display-inline="yes-display-inline" id="HC79A0456DB0D4108AF9EA5D7B4A70125"><enum>(a)</enum><text>Any person at least 18
				years of age who knowingly—</text>
							<paragraph id="HAB4B0F1BFB6445C68E3670EE759CD279"><enum>(1)</enum><text>employs, hires,
				uses, persuades, induces, entices, or coerces, a person under 18 years of age
				to violate any provision of this title or title III;</text>
							</paragraph><paragraph id="HC996BDAFFCC146C4AB9C9526F6E238D"><enum>(2)</enum><text>employs, hires,
				uses, persuades, induces, entices, or coerces a person under 18 years of age to
				assist in avoiding detection or apprehension, for any such violation, by any
				Federal, State, or local law enforcement official; or</text>
							</paragraph><paragraph id="H6092A18D8022400ABFE548CAD39B5DBC"><enum>(3)</enum><text>receives a
				controlled substance from a person under 18 years of age, other than an
				immediate family member, in violation of this title or title III,</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall be
				sentenced to a term of imprisonment of not less than 3 years nor more than 10
				years in addition and consecutive to any punishment under section
				401(b).</continuation-text></subsection><subsection id="HF53BD0A4959241D0A400D3FE2D29EB5B"><enum>(b)</enum><text display-inline="yes-display-inline">Whoever violates subsection (a) after a
				prior conviction under section 401(a) has become final shall be sentenced to a
				term of imprisonment of not less than 5 years nor more than 20 years in
				addition and consecutive to any punishment under section 401(b). Penalties for
				third and subsequent convictions shall be governed by section
				401(b)(1)(A).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0D33B1848F134479A4A2FB671E04EA11"><enum>204.</enum><header>Maintaining
			 drug-involved premises in relation to involvement of children</header><text display-inline="no-display-inline">Section 416(b) of the Controlled Substances
			 Act (21 U.S.C. 856(b)) is amended by inserting (1) before <quote>Any
			 person</quote> and by adding the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HFDD0919C70794C8F872F237700008955" style="traditional">
					<paragraph id="H830BA4C0F6A54B6D00210067DEA6A365"><enum>(2)</enum><text>Any person who
				violates subsection (a) knowing that the manufacture, distribution, storage, or
				use of any controlled substance involves a person under the age of 18 shall be
				sentenced to a term of imprisonment of not less than 5 years nor more than 20
				years.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="H87F82BDB0E8646BF8328A3001CB00009" section-type="subsequent-section"><enum>205.</enum><header>Modification of
			 safety valve provision</header><text display-inline="no-display-inline">Section
			 3553(f) of title 18, United States Code, is amended—</text>
				<paragraph id="HD169D2344D764FC9857C57AA8B607B8C"><enum>(1)</enum><text>in paragraph (4),
			 by inserting <quote>and was not engaged in a dangerous drug trafficking
			 organization (as defined in section 425 of the Controlled Substances
			 Act)</quote> after <quote>section 408 of the Controlled Substances
			 Act</quote>;</text>
				</paragraph><paragraph id="HF6E6B489C24347CB826608704673ABFA"><enum>(2)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (4);</text>
				</paragraph><paragraph id="H89B7D357A8DD486DB368145B4BC5A368"><enum>(3)</enum><text>by redesignating
			 paragraph (5) as paragraph (6); and</text>
				</paragraph><paragraph id="HF1C62C85878E44E3B2FA6FF603B7F3E"><enum>(4)</enum><text>by
			 inserting after paragraph (4) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0C26F2A575264880BD4262B5CE00AE17" style="USC">
						<paragraph id="HC59EFC338C15450385FF93188B8C0024"><enum>(5)</enum><text display-inline="yes-display-inline">no part of the offense or relevant conduct
				involved manufacturing, possessing with intent to distribute, or distributing
				any controlled substance in or near the presence of a child or conduct
				constituting an offense under section 418, 419, or 420 of the Controlled
				Substances Act (21 U.S.C. 859, 860, or 861);
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="HAF70749FADBC41A49C5CC982D7CDAEE8"><enum>III</enum><header>National Drug
			 Trafficking Enforcement Strategy</header>
			<section id="H9043A0B7B6A944B6986BCB62C4F44888"><enum>301.</enum><header>National
			 enforcement strategy</header>
				<subsection id="H712197BB44AE4247AFB9F24530B99F2E"><enum>(a)</enum><header>Development of
			 strategy</header><text>The Attorney General, in consultation with the Secretary
			 of Homeland Security, shall develop a National Drug Trafficking Enforcement
			 Strategy.</text>
				</subsection><subsection id="H88B4DEF26BD8402C93A9C06B21AA49E1"><enum>(b)</enum><header>Report</header><text>Not
			 later than February 1 of each year, the Attorney General shall submit to the
			 Committees on the Judiciary of the Senate and the House of Representatives a
			 report containing the following:</text>
					<paragraph id="H1E589427FA0B4662BC2EF77164E5577E"><enum>(1)</enum><text>A
			 description of the drug enforcement activities of the Federal Bureau of
			 Investigations, the Drug Enforcement Agency, the Department of Homeland
			 Security, and other Federal law enforcement agencies, including international
			 and domestic enforcement strategies and coordination efforts among all law
			 enforcement agencies.</text>
					</paragraph><paragraph id="HC55B5330E97741E099F270EDFBB0CA6C"><enum>(2)</enum><text>A
			 description of the allocation of the resources of the entities listed in
			 paragraph (1) for the investigation and prosecution of alleged violations of
			 the Controlled Substances Act (21 U.S.C. 801 et seq.), including violations
			 involving significant drug trafficking organizations.</text>
					</paragraph><paragraph id="H6BC81F69E5FB4E05BE51136EE5EA66AB"><enum>(3)</enum><text>A
			 description of measures being taken to give priority in the allocation of such
			 resources described in paragraph (2) to alleged violations involving—</text>
						<subparagraph id="HB670F7C2C248443AB5D1FE00068C1684"><enum>(A)</enum><text>persons who have
			 imported into the United States substantial quantities of controlled
			 substances; and</text>
						</subparagraph><subparagraph id="H5F669F5EFC364DB68F7B17E339648FF1"><enum>(B)</enum><text>persons involved
			 in violations that have endangered children.</text>
