		<official-title>To amend title 38, United States Code, to clarify the
		  responsibility of the Secretary of Veterans Affairs to verify the veteran
		  status of the owners of small business concerns listed in the database
		  maintained by the Secretary.</official-title>

		<section id="H22DA74A63556460983F5657DC2A0517C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Small Business Verification
			 Act</short-title></quote>.</text>
		</section><section id="H9495A3CB19E14648A1C902FE83C48918"><enum>2.</enum><header>Clarification of
			 responsibility of Secretary of Veterans Affairs to verify small business
			 ownership</header>
			<subsection id="H89A7BFFCDE37414EAA57008B2C11984E"><enum>(a)</enum><header>Clarification</header><text display-inline="yes-display-inline">Subsection (f) of section 8127 of title 38,
			 United States Code, is amended—</text>
				<paragraph id="H390375AD925C40CB887167D61D0C92B6"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H0885388F2870451A9C708D2895B06E7F"><enum>(A)</enum><text>by inserting
			 <quote>(A)</quote> before <quote>To be eligible</quote>;</text>
					</subparagraph><subparagraph id="H4125FCB60D3E4021A8EB0DBC3C16518F"><enum>(B)</enum><text>by inserting after
			 <quote>or the veteran.</quote> the following new sentence: <quote>Application
			 for inclusion in the database shall constitute permission under section 552a of
			 title 5 (commonly referred to as the Privacy Act) for the Secretary to access
			 such personal information maintained by the Secretary as may be necessary to
			 verify the information contained in the application.</quote>; and</text>
					</subparagraph><subparagraph id="H148612E4119C4A2B97215F950C56EA11"><enum>(C)</enum><text>by inserting after
			 the sentence added by subparagraph (B) the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H0BECFA9600724AB88469A6B9E7D6E475" style="USC">
							<subparagraph id="HC8D01B1542CB4149B79648FAE0BA027D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If
				the Secretary receives an application for inclusion in the database from an
				individual whose status as a veteran cannot be verified because the Secretary
				does not maintain information with respect to the veteran status of the
				individual, the Secretary may not include the small business concern owned or
				controlled by the individual in the database maintained by the Secretary until
				the Secretary receives such information as may be necessary to verify that the
				individual is a veteran.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H06445DE4716042489E328C5E0AD3CF2A"><enum>(2)</enum><text>by amending
			 paragraph (4) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H224F36423037426BB3C2ED00CFFB072E" style="USC">
						<paragraph id="H4AD45A8A62C84101815B31894CECA514" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">No small business concern may be listed in
				the database until the Secretary has verified that—</text>
							<subparagraph id="HCCCF4B3B4D9D10DCEF0CF8A9816FD4E"><enum>(A)</enum><text>the small business concern is owned
				and controlled by veterans; and</text>
							</subparagraph><subparagraph id="HF54DAC7A4587B1D2E779599CF600F00"><enum>(B)</enum><text>in the case of a small business
				concern for which the person who owns or controls the concern indicates that
				the person is a veteran with a service-connected disability, that the person is
				a veteran with a service-connected
				disability.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0A70F3AE5BC849D9903C8EEECC464CC8"><enum>(b)</enum><header>Applicability</header><text>In
			 the case of a small business concern included in the database as of the date of
			 the enactment of this Act for which, as of such date, the Secretary of Veterans
			 Affairs has not verified the status of such concern in accordance with
			 paragraph (4) of subsection (f) of section 8127 of title 38, United States
			 Code, as amended by subsection (a), not later than 60 days after the date of
			 the enactment of this Act, the Secretary shall notify the person who owns or
			 controls the concern that—</text>
				<paragraph id="HC4C2F53D732142D9AAF14AC69C7AE945"><enum>(1)</enum><text>the Secretary is
			 required to verify the status of the concern in accordance with such
			 paragraph;</text>
				</paragraph><paragraph id="HC26AABC8C7E44B72AE5AEE0FB5B34495"><enum>(2)</enum><text>verification of
			 such status shall require that the person who owns or controls the concern
			 apply for inclusion in the database in accordance with such subsection, as so
			 amended;</text>
				</paragraph><paragraph id="H4F5EADE735024CFFBFFBD91A276C4617"><enum>(3)</enum><text display-inline="yes-display-inline">application for inclusion in the database
			 shall constitute permission under section 552a of title 5, United States Code
			 (commonly referred to as the Privacy Act), for the Secretary to access such
			 personal information maintained by the Secretary as may be necessary to verify
			 the information contained in the application; and</text>
				</paragraph><paragraph id="H28D7C12647874B51A66B1114B896C0DC"><enum>(4)</enum><text>the person who
			 owns or controls the concern must submit to the Secretary an affirmative
			 acknowledgment of the requirement under paragraph (3) within 90 days of
			 receiving the Secretary’s notice of such requirement or the concern shall be
			 removed from the database.</text>
				</paragraph></subsection></section></legis-body>
