		<official-title>To amend section 484B of Higher Education Act of 1965 to
		  provide for tuition reimbursement and loan forgiveness to students who withdraw
		  from an institution of higher education to serve in the uniformed services, and
		  for other purposes.</official-title>

		<section id="HDBC47FF5D69C43BCAE00FCF982B02300" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Education Tuition Support Act
			 of 2009</short-title></quote> or the <quote><short-title>VETS Act of 2009</short-title></quote>.</text>
		</section><section id="HBDEAF00B3F4447A3B65C5BFAD0009357"><enum>2.</enum><header>Tuition relief
			 for postsecondary students called to military service</header>
			<subsection id="HC4738F941E3344CF84635CC8867E20E9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 484B(b)(2) of
			 the Higher Education Act of 1965 (20 U.S.C. 1091b(b)(2)) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2603F30B638A4A4BA0E6F0AF93C09FC9" style="OLC">
					<subparagraph id="HB45B6E86876D4245BF633EA729E5616E"><enum>(F)</enum><header>Tuition relief
				for students called to military service</header>
						<clause id="HD6CED8AE7FCB47D48B00B4B03188EB1F"><enum>(i)</enum><header>Tuition
				relief</header>
							<subclause id="H12B90DF2A8634F38ADB4305FB514D939"><enum>(I)</enum><header>In
				general</header><text>Subject to subclause (II), whenever a student’s
				withdrawal from an institution of higher education is necessitated by reason of
				service in the uniformed services, the institution shall refund to such student
				the tuition and fees paid by, or on behalf of, such student for the payment
				period or period of enrollment for which such student did not receive academic
				credit as a result of such withdrawal.</text>
							</subclause><subclause id="H337A3C28CC534E4AA354461C44ABC8B4"><enum>(II)</enum><header>Exception</header><text display-inline="yes-display-inline">Subclause (I) shall not apply to the
				tuition or fees paid on behalf of the student—</text>
								<item id="H0DC59191202B4F328FEC87D3BE4D933"><enum>(aa)</enum><text>from
				scholarships awarded to the student by the institution of higher education;
				or</text>
								</item><item id="H3194A302648C486A85602D8C07E945E7"><enum>(bb)</enum><text>through funds
				awarded under this title.</text>
								</item></subclause></clause><clause id="HD13C462717EE44D79704A80097006617"><enum>(ii)</enum><header>Waiver of
				repayment by students called to military service</header><text display-inline="yes-display-inline">In addition to the waivers authorized by
				subparagraphs (D) and (E), the Secretary shall waive the amounts that students
				are required to return under this section if the withdrawals on which the
				returns are based are withdrawals necessitated by reason of service in the
				uniformed services.</text>
						</clause><clause id="H3DF4B21D13D746F386B8CFE00D3FA5E"><enum>(iii)</enum><header>Loan
				forgiveness authorized</header><text display-inline="yes-display-inline">Whenever a student’s withdrawal from an
				institution of higher education is necessitated by reason of service in the
				uniformed services, the Secretary shall, with respect to the payment period or
				period of enrollment for which such student did not receive academic credit as
				a result of such withdrawal, carry out a program—</text>
							<subclause id="H11A46F2FF8D942BC90978301E894A800"><enum>(I)</enum><text>through the holder
				of the loan, to assume the obligation to repay—</text>
								<item id="H200674569944446689D99950CE001F11"><enum>(aa)</enum><text>the
				outstanding principle and accrued interest on any loan assistance awarded to
				the student under part B (including to a parent on behalf of the student under
				section 428B) for such payment period or period of enrollment; minus</text>
								</item><item id="H6B32F3E8FDEE41C4888D5BAB122958CC"><enum>(bb)</enum><text>any
				amount of such loan assistance returned by the institution in accordance with
				paragraph (1) of this subsection for such payment period or period of
				enrollment; and</text>
								</item></subclause><subclause id="HDB8FBBA69AC345DD927C4305D97C2280"><enum>(II)</enum><text>to cancel—</text>
								<item id="H54331BF66DAD466DA1B5AFDF19BAD9B"><enum>(aa)</enum><text>the
				outstanding principle and accrued interest on the loan assistance awarded to
				the student under part D or E (including a Federal Direct PLUS loan awarded to
				a parent on behalf of the student) for such payment period or period of
				enrollment; minus</text>
								</item><item id="HD8864EBB7C5F4DB4AFF2DA79A9004713"><enum>(bb)</enum><text>any
				amount of such loan assistance returned by the institution in accordance with
				paragraph (1) of this subsection for such payment period or period of
				enrollment.</text>
								</item></subclause></clause><clause id="HB3AA1A8AF95F4465009E6390EE55942B"><enum>(iv)</enum><header>Reimbursement
				for cancellation of Perkins loans</header><text>The Secretary shall pay to each
				institution for each fiscal year an amount equal to the aggregate of the
				amounts of Federal Perkins loans in such institutions’s student loan fund which
				are cancelled pursuant to clause (iii)(II) for such fiscal year, minus an
				amount equal to the aggregate of the amounts of any such loans so canceled
				which were made from Federal capital contributions to its student loan fund
				provided by the Secretary under section 468. None of the funds appropriated
				pursuant to section 461(b) shall be available for payments pursuant to this
				paragraph. To the extent feasible, the Secretary shall pay the amounts for
				which any institution qualifies under this paragraph not later than 3 months
				after the institution files an institutional application for campus-based
				funds.</text>
						</clause><clause id="H9087B2B6767B400AB7F5B543EB1DA8B4"><enum>(v)</enum><header>Loan eligibility
				and limits for students</header><text display-inline="yes-display-inline">Any
				amounts that are returned by an institution in accordance with paragraph (1),
				or forgiven or waived by the Secretary under this subparagraph, with respect to
				a payment period or period of enrollment for which a student did not receive
				academic credit as a result of withdrawal necessitated by reason of service in
				the uniformed services, shall not be included in the calculation of the
				student’s annual or aggregate loan limits for assistance under this title, or
				otherwise affect the student’s eligibility for grants or loans under this
				title.</text>
						</clause><clause id="H47D2CFECE4C84E0BB5083F494680F887"><enum>(vi)</enum><header>Definition</header><text>In
				this subparagraph, the term <quote>service in the uniformed services</quote>
				has the meaning given such term in section
				484C(a).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H259B778B88EF4D62A600D19B46452013"><enum>(b)</enum><header>Effective
			 date</header>
				<paragraph commented="no" id="HAF6512DE4A44411FA3C74F49BA0083B3"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by this Act shall take effect for
			 periods of service in the uniformed services beginning after the date of the
			 enactment of this Act.</text>
				</paragraph><paragraph commented="no" id="H892F728542C24C04A893715E91D0834C"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>period
			 of service in the uniformed services</quote> means the period beginning 30 days
			 prior to the date a student is required to report to service in the uniformed
			 services (as defined in section 484C(a)) and ending when such student returns
			 from such service.</text>
				</paragraph></subsection></section></legis-body>
