		<official-title>To provide for a national biological data center, and for
		  other purposes.</official-title>

		<section id="H0E77BD91F0F94C82BE82DED563342D5" section-type="section-one"><enum>1.</enum><header>National biological data
			 center</header>
			<subsection id="HFDDC1979430849D39C985CF2B47BA7DA"><enum>(a)</enum><header>In
			 General</header><text>The Secretary, acting through the United States
			 Geological Survey, shall establish a national biological data center (in this
			 Act referred to as the <quote>center</quote>). The center may be established
			 within an existing program (such as the National Biological Information
			 Infrastructure program).</text>
			</subsection><subsection id="HFE0829D0B4604838937D8C90A508B139"><enum>(b)</enum><header>Contract</header><text>The
			 Secretary seek to enter into a contract with a small business for the purpose
			 of managing the center.</text>
			</subsection><subsection id="HDEED4A6055BA4021A6C789C633A61D15"><enum>(c)</enum><header>Contract
			 Term</header>
				<paragraph id="HE9CF07996FD6498DA6B840514CA37000"><enum>(1)</enum><header>Initial
			 contract</header><text>The contract under subsection (a) shall have an initial
			 term of 10 years.</text>
				</paragraph><paragraph id="H97BE1017E39F49BD9E526DAA23CAF73F"><enum>(2)</enum><header>Subsequent
			 contracts</header><text>The terms of subsequent contracts shall be determined
			 by the Secretary.</text>
				</paragraph></subsection><subsection id="H9682C7EB647F40FBB289BEE5E74E5360"><enum>(d)</enum><header>Entity
			 Selection</header>
				<paragraph id="H5DDA05C577C74A5B90856BD323116DB3"><enum>(1)</enum><header>Competitive
			 procedures</header><text>The Secretary shall use competitive procedures (as
			 defined in section 4(5) of the Office of Federal Procurement Policy Act (41
			 U.S.C. 403(5))) to enter into the contract under subsection (b).</text>
				</paragraph><paragraph id="HCD8D43033C2845499506DD25A7DA7DD5"><enum>(2)</enum><header>Qualification
			 requirements</header><text>To qualify to participate in the competitive
			 procedures under paragraph (1), a small business shall have—</text>
					<subparagraph id="H72882C01CBD74211A474F1A62D0000D6"><enum>(A)</enum><text>no more than 500
			 employees on the date that the initial contract is awarded to such business
			 under subsection (a);</text>
					</subparagraph><subparagraph id="H8ACCE985CE184BC98035D70876E84E01"><enum>(B)</enum><text>demonstrated
			 expertise in—</text>
						<clause id="H8CC2789CDC2747FA84FCBD89D19DBECF"><enum>(i)</enum><text>managing
			 scientific and technical information;</text>
						</clause><clause id="HFE81353B884D4EDF83455DA56DFB3C1F"><enum>(ii)</enum><text>implementing
			 scientific information projects;</text>
						</clause><clause id="H8E0426F824144A328DD4D6D16D12B1C0"><enum>(iii)</enum><text>presenting
			 scientific data in an objective manner; and</text>
						</clause><clause id="H54C282B6C3E147F8A40093D48E12CE91"><enum>(iv)</enum><text>managing
			 interagency collaborations related to scientific and technical
			 information;</text>
						</clause></subparagraph><subparagraph id="H034B9155B0224A35007647C61DF3006B"><enum>(C)</enum><text>demonstrated
			 involvement with biodiversity information programs and the National Biological
			 Information Infrastructure of the United States Geological Survey (through
			 partnership or other form of collaboration); and</text>
					</subparagraph><subparagraph id="H56CE12F954C44695B6B51BA7FA764600"><enum>(D)</enum><text>a demonstrated
			 ability and willingness to partner with a research university and a national
			 laboratory with expertise in biodiversity and computational sciences.</text>
					</subparagraph></paragraph></subsection><subsection id="H02D197748ACF43F389A72FC897F634C7"><enum>(e)</enum><header>Leadership</header><text>The
			 head of the center shall be appointed by the Secretary, acting through the
			 Director of the United States Geological Survey, in consultation with the
			 program director of the National Biological Information Infrastructure.</text>
			</subsection><subsection id="H0A2240F282CA49279FC72CE853763D1B"><enum>(f)</enum><header>Duties of the
			 National Biological Data Center</header><text>The duties of the center shall
			 be determined by the Secretary and shall include, at a minimum, the following
			 activities:</text>
				<paragraph id="H2DCB9D01C8F8407CA44B4EBDD4C5E196"><enum>(1)</enum><text>Collect nonhuman
			 biological data from Federal, public, private, and nonprofit entities,
			 including—</text>
					<subparagraph id="H1D984160F9634787986DB6106E70D09F"><enum>(A)</enum><text>the National
			 Biological Information Infrastructure; and</text>
					</subparagraph><subparagraph id="HD03884AFF8004FC1B147B5413DF279FB"><enum>(B)</enum><text>institutions and
			 organizations that partner with the National Biological Information
			 Infrastructure.</text>
					</subparagraph></paragraph><paragraph id="H78A984D615534B2498008F5D00D88F18"><enum>(2)</enum><text>Develop
			 partnerships with public and private entities that are nationally recognized
			 for computational capabilities and computer capacity to allow the center to
			 efficiently develop a digital network for the storage and retrieval of data
			 collected under paragraph (1).</text>
				</paragraph><paragraph id="H28F45DAF403C4EC2B67CC5008100A7C6"><enum>(3)</enum><text>Develop
			 partnerships with academic and scientific institutions in the United States to
			 increase the quantity of data—</text>
					<subparagraph id="H43F546E2427B417CA2AC9619E047E202"><enum>(A)</enum><text>collected under
			 paragraph (1); and</text>
					</subparagraph><subparagraph id="HB26ADEBF684547F7B0ECBCF266B469D"><enum>(B)</enum><text>made available for
			 public use under paragraph (4).</text>
					</subparagraph></paragraph><paragraph id="HB9B54E2E0F6748FD8968D4CDF7404490"><enum>(4)</enum><text>Subject to Federal
			 statutes and regulations relating to the disclosure of information collected
			 under paragraph (1), including statutes and regulations related to intellectual
			 property and section 552 of title 5, United States Code, make available for use
			 by Federal, State, and local governments and members of the public any
			 federally funded data collected under paragraph (1).</text>
				</paragraph><paragraph id="H1D11F8EB4B684AD59B167599A451C54D"><enum>(5)</enum><text>Make the data
			 described in paragraph (4) available to such governments and members of the
			 public—</text>
					<subparagraph id="H61AC6CADA65F420890499FBD83B8FA6B"><enum>(A)</enum><text>through a single
			 electronic search function; or</text>
					</subparagraph><subparagraph id="H12DDEDA76F944D1F9DFD2CB736C2DA9B"><enum>(B)</enum><text>in any case in
			 which such data is not electronically maintained, at a single location.</text>
					</subparagraph></paragraph><paragraph id="H70046DDA8DBD49249333A2DB9FB5D399"><enum>(6)</enum><text>Organize and
			 manage data collected under paragraph (1) in a manner that—</text>
					<subparagraph id="H12B963C7FAD04DFAB800B6E625D7F704"><enum>(A)</enum><text>enables efficient
			 and effective use of the data by the public;</text>
					</subparagraph><subparagraph id="HCC46F91E923B4E8FA19029006F419C51"><enum>(B)</enum><text>presents the data
			 in an objective manner; and</text>
					</subparagraph><subparagraph id="H4094032908E1482A8BEA11E291FE05A2"><enum>(C)</enum><text>is consistent with
			 efforts made by the National Biological Information Infrastructure to organize
			 and manage nonhuman biological data for public use.</text>
					</subparagraph></paragraph><paragraph id="HC99BC2BF5F9F4E4BBCBA08775F002B5D"><enum>(7)</enum><text>Prepare value
			 added compilations and analytical assessments (including models and
			 simulations) of multiple data sets that combine and analyze data from multiple
			 data sources to improve the ease of use of such data sets by Federal, State,
			 and local governments and by members of the public.</text>
				</paragraph><paragraph id="H88AA060AED6F4425B70934FA745ECF5"><enum>(8)</enum><text>Conduct public
			 awareness activities that promote the use of the data made available under
			 paragraph (4) for purposes of encouraging—</text>
					<subparagraph id="H775523B7FAA2494AA39E0303CBFD8303"><enum>(A)</enum><text>economic
			 development;</text>
					</subparagraph><subparagraph id="HB6B62DF37B7347A5A03DDA7D4344646D"><enum>(B)</enum><text>the development of
			 public policy (including policy relating to land use, economic development,
			 conservation, and preservation);</text>
					</subparagraph><subparagraph id="H637CDC76B0474DF3AC20B7BA5F45ED3"><enum>(C)</enum><text>scientific
			 research; and</text>
					</subparagraph><subparagraph id="HE345398D9DEC4279827FB0C2FAC31EEB"><enum>(D)</enum><text>science,
			 technology, engineering, and mathematics education.</text>
					</subparagraph></paragraph><paragraph id="HC6530669215044C08EE4162653A80485"><enum>(9)</enum><text>Hold an annual
			 conference on nonhuman biological data collection for the purpose of
			 encouraging experts from Federal, State, and local governments and public and
			 private entities to provide advice to the head of the center on improving the
			 center’s performance.</text>
				</paragraph><paragraph id="H4FEC0E018F934470AC2DB12C411F5FD0"><enum>(10)</enum><text>Collect fees from
			 State and local governments and members of the public for the use of—</text>
					<subparagraph id="HD65CC39A79D64686BB3CD8A7F18076C1"><enum>(A)</enum><text>compilations and
			 analytical assessments prepared under paragraph (7); and</text>
					</subparagraph><subparagraph id="H24ED01D996E647678FE4940072FDFE8B"><enum>(B)</enum><text>other products and
			 services offered by the center including but not limited to technical training
			 and consultation relating to the use or application of data products, except
			 that the center may not collect a fee solely for accessing data collected by
			 the center from another source.</text>
					</subparagraph></paragraph></subsection><subsection id="H13C50BEEF6C1486D9E6CD289001C5732"><enum>(g)</enum><header>Duties of Other
			 Entities</header>
				<paragraph id="H1C6366AD419F4C07846170FE303B3400"><enum>(1)</enum><header>In
			 general</header><text>Subject to Federal statutes and regulations relating to
			 the disclosure of information, including statutes and regulations related to
			 intellectual property and section 552 of title 5, United States Code, any
			 entity that collects or stores federally funded data on or after the end of the
			 one-year period beginning on the date of enactment of this Act shall submit or
			 make available such data to the center, in a form and manner described in
			 standards published by the center, unless such data has been submitted to the
			 National Biological Information Infrastructure.</text>
				</paragraph><paragraph id="H99DE45686B584964B3054B9D68A3E802"><enum>(2)</enum><header>National
			 biological information infrastructure</header>
					<subparagraph id="HC71DCAB901A442A5BB2E4BE9CA00AD8E"><enum>(A)</enum><header>In
			 general</header><text>The center shall serve as the data repository for the
			 National Biological Information Infrastructure. and all data shall be made
			 available in a form and manner described in standards published by the
			 center.</text>
					</subparagraph><subparagraph id="HACC5435D96984221B9090018F3DE0091"><enum>(B)</enum><header>Data to be made
			 available</header><text display-inline="yes-display-inline">Subject to Federal
			 statutes and regulations relating to the disclosure of information, including
			 statutes and regulations related to intellectual property and section 552 of
			 title 5, United States Code, the National Biological Information Infrastructure
			 shall make all data that it stores and maintains available to the center in a
			 form and manner described in standards published by the center.</text>
					</subparagraph></paragraph></subsection><subsection id="H6B538583E9A64B5995C6F9F7E64B1D1"><enum>(h)</enum><header>Availability of
			 Fees</header><text>Subject to appropriation, fees collected under subsection
			 (d)(10) shall remain available for use by the center for activities under
			 subsection (d).</text>
			</subsection><subsection id="H2BBC3F5D328245AABDC12B921DFE681E"><enum>(i)</enum><header>Reports</header>
				<paragraph id="H19162ECE8A4E48AF831000B63CFB8CE"><enum>(1)</enum><header>Annual report to
			 secretary</header><text>Not later than January 1 of each year following the
			 date of enactment of this Act, the head of the center shall submit to the
			 Secretary an annual report containing—</text>
					<subparagraph id="H6A4FE26BEDFC4814832EA54C88F6EDB6"><enum>(A)</enum><text>information on the
			 activities of the center during the preceding fiscal year and the plans of the
			 center for activities in the current fiscal year; and</text>
					</subparagraph><subparagraph id="HEF9ED689F3C84DBA848FDD3CF765F0EF"><enum>(B)</enum><text>such additional
			 information as the Secretary may require.</text>
					</subparagraph></paragraph><paragraph id="H4F97B017F27F40C99D9F46458FECC9E"><enum>(2)</enum><header>Annual report to
			 congress</header><text>Not later than April 1 of each year following the date
			 of enactment of this Act, the Secretary shall submit to Congress an annual
			 report on—</text>
					<subparagraph id="HE38CE3B59F884DA3AC839DD73687BD86"><enum>(A)</enum><text>information on the
			 activities of the center during the preceding fiscal year and the plans of the
			 center for activities in the current fiscal year; and</text>
					</subparagraph><subparagraph id="H9C020D43EFFA4E3688A15E1F1972C93C"><enum>(B)</enum><text>the administration
			 of the contract entered into under subsection (a).</text>
					</subparagraph></paragraph></subsection><subsection id="HC27E22FE52BF4A4EAC91491DD167BD00"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this Act, the following
			 definitions apply:</text>
				<paragraph id="H1F86299AC56B46DA003EE865F8C33676"><enum>(1)</enum><header>Federally Funded
			 Data</header><text display-inline="yes-display-inline">The term
			 <term>federally-funded data</term> means nonhuman biological data that is
			 collected, maintained, or stored, in whole or in part, through the use of
			 Federal funds.</text>
				</paragraph><paragraph id="H618E66C9D1E64171B9F9EDC70588AED5"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></subsection><subsection id="H0316CCD583D94D7CB7EBA1CDD89C467"><enum>(k)</enum><header>Authorization of
			 Appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $8,000,000 per fiscal year. Amounts appropriated under this
			 subsection shall remain available until expended.</text>
