		<legis-type>A BILL</legis-type>
		<official-title>To require non-Federal prisons and correctional
		  facilities holding Federal prisoners under a contract with the Federal
		  Government to make the same information available to the public that Federal
		  prisons and correctional facilities are required to make
		  available.</official-title>

	<legis-body id="H1BEDC61582964B19919DEA20D00C0A34" style="OLC">
		<section id="HA7BCE8B9B7BA4908B0FDBEB8FA4A2EE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Private Prison Information Act of
			 2009</short-title></quote>.</text>
		</section><section id="HFA51F14B792D43AF9D2FC65E46C76E4C"><enum>2.</enum><header>Freedom of
			 Information Act applicable for contract prisons</header>
			<subsection id="H3AF165B195864C22BF70A2CCEBF7F5A1"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Each applicable
			 entity shall be subject to section 552 of title 5, United States Code
			 (popularly known as the Freedom of Information Act), in the same manner as a
			 Federal agency operating a Federal prison or other Federal correctional
			 facility would be subject to such section of title 5, including—</text>
				<paragraph id="H72C1C9BFD61A4BCFA77DD92C00E8128A"><enum>(1)</enum><text>the duty to
			 release information about the operation of the non-Federal prison or
			 correctional facility; and</text>
				</paragraph><paragraph id="HAC13F01C25994FFA9619BD5C698B2D26"><enum>(2)</enum><text>the applicability
			 of the exceptions and exemptions available under such section.</text>
				</paragraph></subsection><subsection id="H61FBBC2684E64E3B8ACB47E04A9C73A6"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">A Federal agency that contracts with, or
			 provides funds to, an applicable entity to incarcerate or detain Federal
			 prisoners in a non-Federal prison or correctional facility shall promulgate
			 regulations or guidance to ensure compliance by the applicable entity with
			 <internal-xref idref="H3AF165B195864C22BF70A2CCEBF7F5A1" legis-path="2.(a)">subsection (a)</internal-xref>.</text>
			</subsection><subsection commented="no" id="H3635C51B98EA4A80B51D376A9E476E40"><enum>(c)</enum><header>No Federal funds
			 for compliance</header><text display-inline="yes-display-inline">No Federal
			 funds may be used to assist applicable entities with compliance with this
			 section or section 552 of title 5, United States Code.</text>
			</subsection><subsection id="HA29AF766367043C599FE12CE4812ACDA"><enum>(d)</enum><header>Civil
			 Action</header><text display-inline="yes-display-inline">Any party aggrieved by
			 a violation of section 552 of title 5, United States Code, by an applicable
			 entity, as such section is applicable to such an entity in accordance with
			 <internal-xref idref="H3AF165B195864C22BF70A2CCEBF7F5A1" legis-path="2.(a)">subsection (a)</internal-xref>, may, in a civil action,
			 obtain appropriate relief against the applicable entity for the
			 violation.</text>
			</subsection><subsection id="H901EA026DE9E4C08A09717455D2485B5"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="HAC8F799D0C954F7E985EDA0BE359A236"><enum>(1)</enum><header>Non-Federal
			 prison or correctional facility</header>
					<subparagraph id="HAE79A27D698D4E1DBD3E68694960B434"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>non-Federal prison or correctional facility</term> includes any
			 non-Federal facility described in
			 <internal-xref idref="HACF5DA25AC2E406BA948CA3676AC16B7" legis-path="2.(e)(1)(B)">subparagraph (B)</internal-xref> that incarcerates or
			 detains Federal prisoners pursuant to a contract or intergovernmental service
			 agreement with—</text>
						<clause id="HCC769087AC634F6C890B26A9B830E429"><enum>(i)</enum><text>the
			 Federal Bureau of Prisons;</text>
						</clause><clause id="H0923A0BFA90E4E3DBA20ED211BD878AE"><enum>(ii)</enum><text>Immigration and
			 Customs Enforcement; or</text>
						</clause><clause id="HD170D8A4BA6C4079A22023411419766C"><enum>(iii)</enum><text>any other
			 Federal agency.</text>
						</clause></subparagraph><subparagraph id="HACF5DA25AC2E406BA948CA3676AC16B7"><enum>(B)</enum><header>Non-Federal
			 facilities</header><text>A non-Federal facility is—</text>
						<clause id="H60D4EC23E9C245E2A0B2FA4DAB3C1C4B"><enum>(i)</enum><text>a
			 privately owned prison or other privately owned correctional facility;
			 or</text>
						</clause><clause id="H8E98FF3F1BB54ED2A12C841A27555F67"><enum>(ii)</enum><text>a
			 State or local prison, jail, or other correctional facility.</text>
						</clause></subparagraph></paragraph><paragraph id="HC77033F3CCF74C68843C157B9D72E1A9"><enum>(2)</enum><header>Entity</header><text>The
			 term <term>applicable entity</term> means—</text>
					<subparagraph id="HC50E19E05B1C489DA1A1D0C1C2237A97"><enum>(A)</enum><text display-inline="yes-display-inline">a nongovernmental entity contracting with,
			 or receiving funds from, the Federal Government to incarcerate or detain
			 Federal prisoners in a non-Federal prison or correctional facility; or</text>
					</subparagraph><subparagraph id="H69D0B65FCEA3456D8B2A1C724115EB18"><enum>(B)</enum><text>a State or local
			 governmental entity with an intergovernmental service agreement with the
			 Federal Government to incarcerate or detain Federal prisoners in a non-Federal
			 prison or correctional facility.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
