		  Groundwater Study and Facilities Act to expand the Bay Area Regional Water
		  Recycling Program, and for other purposes.</official-title>

		<section id="H81446D5B44AC40819D1AA15702297CF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bay Area Regional Water Recycling
			 Program Expansion Act of 2009</short-title></quote>.</text>
		</section><section id="H94AA2824EB9C4A9DADC86A4E4D46ED7F"><enum>2.</enum><header>Project
			 authorizations</header>
			<subsection id="HF4CC730087B84BD2BF76258606B831EE"><enum>(a)</enum><header>In
			 general</header><text>The Reclamation Wastewater and Groundwater Study and
			 Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h">43
			 U.S.C. 390h et seq.</external-xref>) (as amended by section 512(a) of the
			 Consolidated Natural Resources Act of 2008) is amended by adding at the end the
			 following:</text>

					<section id="H82A85869EF7542C5A3945CA08E35C703"><enum>16__.</enum><header>CCCSD-concord
				recycled water project</header>
						<subsection id="HD7AF6AA645814B78BF1762B2CB3385A5"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary, in cooperation with the Central Contra Costa Sanitary District,
				California, is authorized to participate in the design, planning, and
				construction of recycled water distribution systems.</text>
						</subsection><subsection id="HE2714927B0A7468AB66D21744ED46289"><enum>(b)</enum><header>Cost
				share</header><text>The Federal share of the cost of the project authorized by
				this section shall not exceed 25 percent of the total cost of the
				project.</text>
						</subsection><subsection id="H8B713C780E424049BD82CE0584EB2C64"><enum>(c)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
						</subsection><subsection id="HF31D0749EAAA4898AB00977A88B697F8"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $1,800,000.</text>
						</subsection></section><section id="HBC45BF301CF84957A433A67AA4000C56"><enum>16__.</enum><header>Central Dublin
				recycled water distribution and retrofit project</header>
						<subsection id="H237ED0C5642948C68D40486E006956EA"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary, in cooperation with the Dublin San Ramon Services District,
				California, is authorized to participate in the design, planning, and
				construction of recycled water system facilities.</text>
						</subsection><subsection id="HAEE989DC800D41E78ACAC4A94F0FF007"><enum>(b)</enum><header>Cost
				share</header><text>The Federal share of the cost of the project authorized by
				this section shall not exceed 25 percent of the total cost of the
				project.</text>
						</subsection><subsection id="H53834882C22B4028B5A28BA96604D902"><enum>(c)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
						</subsection><subsection id="H6782E7E09BCD490C9908A3032E610A3A"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $1,150,000.</text>
						</subsection></section><section id="HD29AC1C5ACF64356AEE5869300F38DF0"><enum>16__.</enum><header>Petaluma
				recycled water project, phases 2A, 2B, and 3</header>
						<subsection id="H799766E15C3E40258F824638BB562D9B"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary, in cooperation with the City of Petaluma, California, is authorized
				to participate in the design, planning, and construction of recycled water
				system facilities.</text>
						</subsection><subsection id="HB23C87E42C66472EB0515AC6A4F31C77"><enum>(b)</enum><header>Cost
				share</header><text>The Federal share of the cost of the project authorized by
				this section shall not exceed 25 percent of the total cost of the
				project.</text>
						</subsection><subsection id="H965DEEC90A0C4634ADA9E56BBCC8D896"><enum>(c)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
						</subsection><subsection id="HB53E6C2D63F7404A931809A54D820B95"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $6,000,000.</text>
						</subsection></section><section id="H5C9B67C1B4A04D3AA5B30E16F27D4155"><enum>16__.</enum><header>Central
				Redwood City recycled water project</header>
						<subsection id="HE4374EE586624DE182340EC91C60AA4D"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary, in cooperation with the City of Redwood City, California, is
				authorized to participate in the design, planning, and construction of recycled
				water system facilities.</text>
						</subsection><subsection id="HD120E851B38240F2A8C60C25D5965BC2"><enum>(b)</enum><header>Cost
				share</header><text>The Federal share of the cost of the project authorized by
				this section shall not exceed 25 percent of the total cost of the
				project.</text>
						</subsection><subsection id="H7CD12AD63D7D4DAFAAD2119B49BA9361"><enum>(c)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
						</subsection><subsection id="H0E8950B43F3249E1AC921D82638FBD61"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $8,000,000.</text>
						</subsection></section><section id="HBCCBE29D759C4333880E9B50ADE9CB2D"><enum>16__.</enum><header>Palo Alto
				recycled water pipeline project</header>
						<subsection id="HF5D41C92D41548CBB15C8D30488A51BB"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary, in cooperation with the City of Palo Alto, California, is authorized
				to participate in the design, planning, and construction of recycled water
				system facilities.</text>
						</subsection><subsection id="H98EE7445140948A59A62BE8D51AB00DB"><enum>(b)</enum><header>Cost
				share</header><text>The Federal share of the cost of the project authorized by
				this section shall not exceed 25 percent of the total cost of the
				project.</text>
						</subsection><subsection id="HBB1D22EE763D403896079FFF964C9B90"><enum>(c)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
						</subsection><subsection id="H2F0CDE4DE6EF42A7826F2A2E0CA1C68B"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $8,250,000.</text>
						</subsection></section><section id="H0A3E774BE1A94B248B277652D9AF36B8"><enum>16__.</enum><header>Ironhouse
				Sanitary District (ISD) antioch recycled water project</header>
						<subsection id="H5C44AA30655644569638D2A54571F115"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary, in cooperation with the Ironhouse Sanitary District (ISD),
				California, is authorized to participate in the design, planning, and
				construction of recycled water distribution systems.</text>
						</subsection><subsection id="HABC8B9D25C954C6CA333D49F57A35EC9"><enum>(b)</enum><header>Cost
				share</header><text>The Federal share of the cost of the project authorized by
				this section shall not exceed 25 percent of the total cost of the
				project.</text>
						</subsection><subsection id="H9A916074FD1A42FAA8450900476C81BD"><enum>(c)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
						</subsection><subsection id="H3FF7929652A04C42888B2B9500E6CCC5"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section
				$7,000,000.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7D7881CDA1844F4189A972033BD1F51E"><enum>(b)</enum><header>Project
			 implementation</header><text display-inline="yes-display-inline">In carrying
			 out sections 1642 through 1648 of the Reclamation Wastewater and Groundwater
			 Study and Facilities Act, and the sections added to such Act by subsection (a),
			 the Secretary shall enter into individual agreements with the San Francisco Bay
			 Area Regional Water Recycling implementing agencies to fund the projects
			 through the Bay Area Clean Water Agencies (BACWA) or its successor, and
			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">shall</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic"> may</added-phrase>
			 include in such agreements a provision for the reimbursement of construction
			 costs, including those construction costs incurred prior to the enactment of
			 this Act, subject to appropriations made available for the Federal share of the
			 project under sections 1642 through 1648 of the Reclamation Wastewater and
			 Groundwater Study and Facilities Act and the sections added to such Act by
			 subsection (a).</text>
			</subsection><subsection id="H128AB9AE353D44CD93E7E6006D84F3F"><enum>(c)</enum><header>Clerical
			 amendments</header><text display-inline="yes-display-inline">The table of
			 contents of the Reclamation Projects Authorization and Adjustment Act of 1992
			 (43 U.S.C. prec. 371) (as amended by section 512(a) of the Consolidated Natural
			 Resources Act of 2008) is amended by adding at the end the following:</text>

			 of the Reclamation Wastewater and Groundwater Study and Facilities Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/390h-27">43 U.S.C.
			 390h–27</external-xref>) (as amended by section 512(a) of the Consolidated
			 Natural Resources Act of 2008) is amended by striking <quote>$2,250,000</quote>
			 and inserting <quote>$3,125,000</quote>.</text>
			</subsection><subsection id="H813E911372AD42EBA96E9903AB5D097D"><enum>(b)</enum><header>South Bay
			 advanced recycled water treatment facility</header><text display-inline="yes-display-inline">Section 1648(d) of the Reclamation
			 Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h-31">43 U.S.C.
			 390h–31</external-xref>) (as amended by section 512(a) of the Consolidated
			 Natural Resources Act of 2008) is amended by striking <quote>$8,250,000</quote>
			 and inserting <quote>$13,250,000</quote>.</text>
