		<section id="H3C4427F884464F3A8036D99EF2B44F2D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Renewable Fuel Standard Improvement
			 Act</short-title></quote>.</text>
		</section><section id="idB36FB70C864E4AA0BE24DE968AEE2869" section-type="subsequent-section"><enum>2.</enum><header>Amendment</header><text display-inline="no-display-inline">Section 211(o) of the Clean Air Act is
			 amended as follows:</text>
			<paragraph id="H3EAE6867F98044BF875F205D4D83BA52"><enum>(1)</enum><text>In paragraphs
			 (1)(B)(i), (2)(A)(i), and (2)(A)(ii), the matter following paragraph
			 (2)(B)(ii)(VI), paragraphs (2)(B)(iv), (3), (4), (5), (6)(B), (7)(A)(i),
			 (7)(A)(ii), (7)(B), (7)(D), (7)(E), (7)(F), (8)(D), (9)(A)(ii)(II), (9)(B)(i),
			 (9)(B)(iii), (9)(C), (9)(D), and (11), by striking <quote>Administrator</quote>
			 and inserting <quote>Secretary of Agriculture, the Secretary of Energy, and the
			 Administrator</quote>.</text>
			</paragraph><paragraph id="HB0940794A87B4706AA74BA5C87B79547"><enum>(2)</enum><text>In paragraph
			 (1)(C)—</text>
				<subparagraph id="HCC68D713819D41C8BBDFB099FB221DD2"><enum>(A)</enum><text>by striking
			 <quote>Administrator</quote> and inserting <quote>Secretary of Energy</quote>;
			 and</text>
				</subparagraph><subparagraph id="H63CEE4608F114B20AC716CFB219CA1A9"><enum>(B)</enum><text>by striking
			 <quote>in 2005.</quote> and inserting <quote>2008. At 3 year intervals after
			 2008, the baseline shall be updated by using a date 3 years after the prior
			 baseline date.</quote>.</text>
				</subparagraph></paragraph><paragraph id="HEB612925ACCE47AFBF372AB5BFF65EB4"><enum>(3)</enum><text>In paragraph (1)
			 by amending subparagraph (D) as follows:</text>
				<subparagraph id="HF7E840A48C7C4CD9B149A2E12518ACF0"><enum>(A)</enum><text display-inline="yes-display-inline">By striking <quote>and that has</quote> and
			 inserting a period and the following: <quote>In the case of renewable fuel
			 produced from facilities that commenced construction after December 19, 2007,
			 such term only includes such biodiesel if it has</quote> .</text>
				</subparagraph><subparagraph id="HC7950BB57ADD4C70979C72BCAB1BD089"><enum>(B)</enum><text>By striking out
			 <quote>the preceding sentence</quote> and insert <quote>the preceding
			 provisions of this subparagraph</quote> .</text>
				</subparagraph></paragraph><paragraph id="HFC472D64EC954B6E85247BE884543FCE"><enum>(4)</enum><text>In subparagraph
			 (D) and (E) of paragraph (1), by striking <quote>Administrator</quote> and
			 inserting <quote>Secretary of Agriculture and the Secretary of
			 Energy</quote>.</text>
			</paragraph><paragraph id="HBAE03F1C63464210ACBEF50511DA1A1F"><enum>(5)</enum><text>In paragraph
			 (1)(G), by striking the last sentence.</text>
			</paragraph><paragraph id="H4E1DB29B3F7543CDB0CE3A821FF15B91"><enum>(6)</enum><text>By amending
			 paragraph (1)(H) to read as follows:</text>

					<subparagraph id="H2FC49E8577B54CFA860580A9B6ABBCE4"><enum>(H)</enum><header>Lifecycle
				greenhouse gas emissions</header>
						<clause id="HC167A4EA17A74B03A5FDECF862014C9A"><enum>(i)</enum><header>In
				general</header><text>The term <term>lifecycle greenhouse gas emissions</term>
				means the aggregate quantity of direct greenhouse gas emissions relating to the
				full fuel lifecycle, as determined by the Secretary of Agriculture and the
				Secretary of Energy based on—</text>
							<subclause id="HBCA626F5171F499DB482FD247999462A"><enum>(I)</enum><text>measurements taken
				using the most recent observable data; and</text>
							</subclause><subclause id="HE335B4BE8D3349D5A039DC7D0AB9C9D1"><enum>(II)</enum><text>consideration of
				regional differences of renewable fuel production.</text>
							</subclause></clause><clause id="H72E53025531D4AC4A404375D003D60AC"><enum>(ii)</enum><header>Inclusions</header><text>The
				term <term>lifecycle greenhouse gas emissions</term> includes greenhouse gas
				emissions from all stages of fuel and feedstock production and distribution,
				from feedstock generation or extraction through the distribution and delivery
				and use of the finished fuel to the ultimate consumer, where the mass values
				for all greenhouse gases are adjusted to account for the relative global
				warming potential of the greenhouse gases.</text>
						</clause><clause id="H013DCC93E220491A956C0C4A68C48F0C"><enum>(iii)</enum><header>Peer review
				and model</header><text display-inline="yes-display-inline">The Secretary of
				Agriculture and the Secretary of Energy shall carry out a peer review of any
				model used in measuring lifecycle greenhouse gas emissions and make the results
				of the peer review and model publicly available before any public comment
				period provided in connection with the determination made under this
				subparagraph.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HA652F7D28F10484FAC48A4307B11BE7B"><enum>(7)</enum><text>Amend paragraph
			 (1)(I) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H32180CAC223E4F9C8FDB1D4B3C63BACE" style="OLC">
					<subparagraph id="H93DFA27D331B4ACBB57890B43D83E862"><enum>(I)</enum><header>Renewable
				biomass</header><text>The term <term>renewable biomass</term> means—</text>
						<clause id="H03EF48687ED64E3381EE0BC31FC2E67D"><enum>(i)</enum><text>materials,
				pre-commercial thinnings, or invasive species from National Forest System land
				and public lands (as defined in section 103 of the Federal Land Policy and
				Management Act of 1976 (43 U.S.C. 1702)) that—</text>
							<subclause id="H5F27CE77AA8849A5830249D38E610FD3"><enum>(I)</enum><text>are byproducts of
				preventive treatments that are removed—</text>
								<item id="H8A89188D287A4D30AD1F83D33C070594"><enum>(aa)</enum><text>to
				reduce hazardous fuels;</text>
								</item><item id="H7FFA48183CED47ADA73DDD585C809B84"><enum>(bb)</enum><text>to
				reduce or contain disease or insect infestation; or</text>
								</item><item id="H5D359C0984714C00B593D50B5616083E"><enum>(cc)</enum><text>to
				restore ecosystem health;</text>
								</item></subclause><subclause id="H4374213AA7D24FB6B8B046BC275640A6"><enum>(II)</enum><text>would not
				otherwise be used for higher-value products; and</text>
							</subclause><subclause id="H2D68045305A9468D95B10EB97B8CE160"><enum>(III)</enum><text>are harvested in
				accordance with—</text>
								<item id="H4670A5A1512E47DF9B0C9B78BFB4D987"><enum>(aa)</enum><text>applicable law
				and land management plans; and</text>
								</item><item id="H9FB9167B08FA45E9BFA21A5535185943"><enum>(bb)</enum><text>the
				requirements for—</text>
									<subitem id="HD7F3B83CF9B7495290320961B349E63B"><enum>(AA)</enum><text>old-growth
				maintenance, restoration, and management direction of paragraphs (2), (3), and
				(4) of subsection (e) of section 102 of the Healthy Forests Restoration Act of
				2003 (16 U.S.C. 6512); and</text>
									</subitem><subitem id="H5C3784C39FAE4FC3BC70AE0B6511340D"><enum>(BB)</enum><text>large-tree
				retention of subsection (f) of that section; or</text>
									</subitem></item></subclause></clause><clause id="HA24D1627615649678033C9C8977CD4E3"><enum>(ii)</enum><text>any organic
				matter that is available on a renewable or recurring basis from non-Federal
				land or land belonging to an Indian or Indian tribe that is held in trust by
				the United States or subject to a restriction against alienation imposed by the
				United States, including—</text>
							<subclause id="HAA7DBA0861B14349B7C6C0F209B95D46"><enum>(I)</enum><text>renewable plant
				material, including—</text>
								<item id="H71441912737C43EF9710E30AA8AD7815"><enum>(aa)</enum><text>feed
				grains;</text>
								</item><item id="HD01A01ED22A048B29E2123DEF1B3AD89"><enum>(bb)</enum><text>other
				agricultural commodities;</text>
								</item><item id="H3E9DD15592314DC1B3463AC578DFC49E"><enum>(cc)</enum><text>other plants and
				trees; and</text>
								</item><item id="H590FF9FC60694AC7ABF861AA70470772"><enum>(dd)</enum><text>algae; and</text>
								</item></subclause><subclause id="HDC8656BBC4BE4339860DAA216B7122A7"><enum>(II)</enum><text>waste material,
				including—</text>
								<item id="H953B4CA1B4504FB09D837444325F368F"><enum>(aa)</enum><text>crop
				residue;</text>
								</item><item id="H846C3CF3B31C461ABFCB6C0F4C139B89"><enum>(bb)</enum><text>other vegetative
				waste material (including wood waste and wood residues);</text>
								</item><item id="HD3A1B3CD5DAE49969C72DD4A90054C35"><enum>(cc)</enum><text>animal waste and
				byproducts (including fats, oils, greases, and manure); and</text>
								</item><item id="HED07B061F4674E4CA80EA380048AC476"><enum>(dd)</enum><text>food waste and
				yard
				waste.</text>
								</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H00D5509E93CA41B9B675BF680ED22672"><enum>(8)</enum><text display-inline="yes-display-inline">In paragraph (2)(B)(ii), by striking
			 <quote>Administrator, in coordination with the Secretary of Energy and the
