<section id="H41B9A532E87F4717A2FA422CE65953D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Government Information Transparency Act</quote>. </text></section>
<section id="H14C3EAB68C5A4557B1AE80A36CE007A9"><enum>2.</enum><header>Data standard requirements</header>
<subsection id="H741E3D2800DF4F92B6F7D78A45C3AEE9"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall adopt a single data standard for the collection, analysis, and dissemination of business and financial information for use by private sector entities in accordance with section 3 for information required to be reported to the Federal Government, and a single data standard for use by agencies within the Federal Government in accordance with section 4 for Federal financial information.</text></subsection>
<subsection id="HAB9F69F2C62C493E8E6FD813F741BA0D"><enum>(b)</enum><header>Characteristics of data standards</header><text>The single data standards required by subsection (a) shall—</text>
<paragraph id="H46C41F1850AD41048C35460B8B49C70D"><enum>(1)</enum><text>be common across all agencies, to the maximum extent practicable;</text></paragraph>
<paragraph id="H50E1CAE971E94ED4B89D1CA23F0CEFD0"><enum>(2)</enum><text>be a widely accepted, open source, non-proprietary, searchable, computer-readable format for business and financial data;</text></paragraph>
<paragraph id="HC9F416F24A4D48648614B040EBE1ACDC"><enum>(3)</enum><text>be consistent with and implement—</text>
<subparagraph id="H6D3C2DB4D0DB4193B01F4A0909DE0DF4"><enum>(A)</enum><text>United States generally accepted accounting principles or Federal financial accounting standards (as appropriate);</text></subparagraph>
<subparagraph id="H882879D93B234BFBA55FA2650F3FB27F"><enum>(B)</enum><text display-inline="yes-display-inline">industry best practices; and</text></subparagraph>
<subparagraph id="HB372DA7C74C84E80ADF8038EEC16A5DF"><enum>(C)</enum><text>Federal regulatory requirements;</text></subparagraph></paragraph>
<paragraph id="H735FE5B8FA45452FBBE5CC7C4EB42641"><enum>(4)</enum><text>improve the transparency, consistency, and usability of business and financial information; and</text></paragraph>
<paragraph id="H003F9E788C1C4E87AAA7AC98E1D8DA15"><enum>(5)</enum><text>be capable of being continually upgraded to be of maximum use as technologies and content evolve over time.</text></paragraph></subsection></section>
<section id="H278D3A2116214BC0983F140A89DC3219"><enum>3.</enum><header>Implementation of single data standard for private sector</header>
<subsection id="H135D69AC90524C7C8120DB3245E8297F"><enum>(a)</enum><header>OMB Guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall issue guidance to agencies on the use and implementation of the single data standard required by section 2 for information required to be reported to agencies by the private sector.</text></subsection>
<subsection id="HB4B65D27FF2D4E45A3BE60DED64D7EAB"><enum>(b)</enum><header>Agency requirements</header>
<paragraph id="H47E584435C0540D4AD6226AA63A1D62D" display-inline="no-display-inline"><enum>(1)</enum><header>Requirement</header><text>To the maximum extent practicable and consistent with the guidance provided by the Office of Management and Budget under subsection (a), the head of each agency shall require the use of the single data standard required by section 2 for business and financial information reported to the agency by private sector companies. </text></paragraph>
<paragraph id="HA87494BDBB4147A1B236EAD83CF62CE5"><enum>(2)</enum><header>Implementation</header><text>The head of the agency shall begin implementing the requirement of paragraph (1) within one year after the date of the enactment of this Act.</text></paragraph></subsection></section>
<section id="HF8CFB947635847039B1FEBC4F7FFB63E"><enum>4.</enum><header>Implementation of single data standard for Federal Government</header>
<subsection id="HEEF7C89E977B402B8FB16FEA332CDE28" display-inline="no-display-inline"><enum>(a)</enum><header>OMB development</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director of the Office of Management and Budget shall develop the single data standard required by section 2 for use by agencies within the Federal Government for Federal financial information.</text></subsection>
<subsection id="H2BFEC37F265C46B9B9176958FDDBFFED"><enum>(b)</enum><header>OMB guidance</header><text>Not later than 18 months after the date of the enactment of this Act, the Director shall issue guidance to agencies on the use and implementation of the single data standard developed under subsection (a).</text></subsection></section>
<section id="H287AAA4D47A94A1CBA346ABCBE154A35"><enum>5.</enum><header>Public access to data</header><text display-inline="no-display-inline">The head of each agency shall ensure that information collected using the single data standards required under this Act is accessible to the general public in that format to the extent permitted by law.</text></section>
<section id="H90CEC36FD7374A6DA77625414B212ACB"><enum>6.</enum><header>Report</header><text display-inline="no-display-inline">Within one year after the date of the enactment of this Act, the Director of the Office of Management and Budget shall submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the status of the implementation of this Act. </text></section>
<section id="H9D30F22CFEE54FD78196E00C272A1A3A"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H5D428B49D95747BE9C9EFF4D0252DAC9"><enum>(1)</enum><header>Agency</header><text>The term <quote>agency</quote> means any executive department, military department, Government corporation, Government controlled corporation, independent establishment, or other establishment in the executive branch of the Government (including the Executive Office of the President), or any independent regulatory agency, but does not include—</text>
<subparagraph id="H5B67C7CABF3D45E09E844CB0EC6C612E"><enum>(A)</enum><text>the Government Accountability Office;</text></subparagraph>
<subparagraph id="H32BE0B42DD464C279E5173B8DC2C9FC7"><enum>(B)</enum><text>the Federal Election Commission;</text></subparagraph>
<subparagraph id="H02046E186B1B49ECA1E0C4A21A8077A8"><enum>(C)</enum><text>the governments of the District of Columbia and of the territories and possessions of the United States, and their various subdivisions; or</text></subparagraph>
<subparagraph id="HDC3790A0684241AC9A822324BFBBF773"><enum>(D)</enum><text>Government-owned contractor-operated facilities, including laboratories engaged in national defense research and production activities.</text></subparagraph></paragraph>
<paragraph id="HF4159A20D51C4829B33678CE5EF15479"><enum>(2)</enum><header>Executive department, military department, government corporation, government controlled corporation, independent establishment</header><text>The terms <quote>Executive department</quote>, <quote>military department</quote>, <quote>Government corporation</quote>, <quote>Government controlled corporation</quote>, and <quote>independent establishment</quote> have the meanings given those terms by chapter 1 of title 5, United States Code.</text></paragraph>
<paragraph id="HC7F445906A274B82934299A531C3D394"><enum>(3)</enum><header>Independent regulatory agency</header><text>The term <quote>independent regulatory agency</quote> has the meaning given that term by section 3502(5) of title 44, United States Code.</text></paragraph></section>
