Short title

This Act may be cited as the Home Oxygen Patient Protection Act of 2009.

Restoring oxygen equipment rental payment under Medicare

(a)

In General

Section 1834(a)(5) of the Social Security Act (42 U.S.C. 1395m(a)(5)) is amended— (1)in subparagraph (A), by striking (E), and (F) and inserting and (E); and (2)by striking subparagraph (F). (b)

Effective Date

The amendments made by subsection (a) shall take effect as of the date of the enactment of this Act, and shall apply to individuals receiving oxygen equipment before, on, or after December 31, 2005.
