<enum>I</enum><header>Establishment of
Veterans Business Center program</header>
<section id="H41021E09222E48C983E73DB4A55EA286"><enum>101.</enum><header>Veterans
Business Center program</header><text display-inline="no-display-inline">Section 32 of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/657b">15 U.S.C.
657b</external-xref>) is amended—</text>
<paragraph id="HA399FE7A0F8C4749A1DDC9CDFC114291"><enum>(1)</enum><text>in subsection (f),
by inserting <quote>(other than subsections (g), (h), and (i))</quote> after
<quote>this section</quote>; and</text>
</paragraph><paragraph id="HB9B345D84C3847A59ED6DB16295BDC3D"><enum>(2)</enum><text>by adding at the
end the following:</text>

<subsection id="HB7CA5EFA85B04DAA8EDA8BA969AEDCB8"><enum>(g)</enum><header>Veterans
Business Center program</header>
<paragraph id="H79EB0D1EC133443295B1697CD3A5BC13"><enum>(1)</enum><header>In
general</header><text>The Administrator shall establish a Veterans Business
Center program within the Administration to provide entrepreneurial training
and counseling to veterans in accordance with this subsection.</text>
</paragraph><paragraph id="H5E0BA86E357248C9B068BAC5B64B149C"><enum>(2)</enum><header>Director</header><text>The
Administrator shall appoint a Director of the Veterans Business Center program,
who shall implement and oversee such program and who shall report directly to
the Associate Administrator for Veterans Business Development.</text>
</paragraph><paragraph id="H302C75F7CA3148EFB35868F582D4F82C"><enum>(3)</enum><header>Designation of
Veterans Business Centers</header><text>The Director shall establish by
regulation an application, review, and notification process to designate
entities as veterans business centers for purposes of this section. The
Director shall make publicly known the designation of an entity as a veterans
business center and the award of a grant to such center under this
subsection.</text>
</paragraph><paragraph id="H40DB0F818CD64E209EF1C5C23CB61464"><enum>(4)</enum><header>Funding for
veterans business centers</header>
<subparagraph id="H243CD55B7DF742D1BB26C6CA044DC5E3"><enum>(A)</enum><header>Initial
grants</header><text display-inline="yes-display-inline">The Director is
authorized to make a grant (hereinafter in this subsection referred to as an
<quote>initial grant</quote>) to each veterans business center each year for
not more than 5 years in the amount of $200,000.</text>
</subparagraph><subparagraph id="HF0520931A9544CD284E9341C6D9BC5EF"><enum>(B)</enum><header>Growth funding
grants</header><text display-inline="yes-display-inline">After a veterans
business center has received 5 years of initial grants under subparagraph (A),
the Director is authorized to make a grant (hereinafter in this subsection
referred to as a <quote>growth funding grant</quote>) to such center each year
for not more than 3 years in the amount of $150,000. After such center has
received 3 years of growth funding grants, the Director shall require such
center to meet performance benchmarks established by the Director to be
eligible for growth funding grants in subsequent years.</text>
</subparagraph></paragraph><paragraph id="H256F6B59B877415E9AD5B9BFE60B5E6C"><enum>(5)</enum><header>Center
responsibilities</header><text>Each veterans business center receiving a grant
under this subsection shall use the funds primarily on veteran entrepreneurial
development, counseling of veteran-owned small businesses through one-on-one
instruction and classes, and providing government procurement assistance to
veterans.</text>
</paragraph><paragraph id="HFEF20D0B11164CFAA47AA5B148A83BA9"><enum>(6)</enum><header>Matching
funds</header><text display-inline="yes-display-inline">Each veterans business
center receiving a grant under this subsection shall be required to provide a
non-Federal match of 50 percent of the Federal funds such center receives under
this subsection. The Director may issue to a veterans business center, upon
request, a waiver from all or a portion of such matching requirement upon a
determination of hardship. The Director may waive the matching funds
requirement under this paragraph with respect to veterans business centers that
serve communities with a per capita income less than 75 percent of the national
per capita income and an unemployment rate at least 150 percent higher than the
national average.</text>
</paragraph><paragraph id="HED934A420D87467BAFB473D21CB2AAB9"><enum>(7)</enum><header>Targeted
areas</header><text display-inline="yes-display-inline">The Director shall give
priority to applications for designations and grants under this subsection that
will establish a veterans business center in a geographic area, as determined
by the Director, that is not currently served by a veterans business center and
in which—</text>
<subparagraph id="H51230697586742D3AAE7AA9626002FA3"><enum>(A)</enum><text>the population of
veterans exceeds the national median of such measure; or</text>
</subparagraph><subparagraph id="HCF2905A3F24C4DE29DCCF169A22A1DC3"><enum>(B)</enum><text display-inline="yes-display-inline">the population of veterans of Operation
Iraqi Freedom or Operation Enduring Freedom exceeds the national median of such
measure.</text>
</subparagraph></paragraph><paragraph id="HD69B325953F74F5FA20A0BC689BD9B0D"><enum>(8)</enum><header>Training
program</header><text display-inline="yes-display-inline">The Director shall
develop and implement, directly or by contract, an annual training program for
the staff and personnel of designated veterans business centers to provide
education, support, and information on best practices with respect to the
establishment and operation of such centers. The Director shall develop such
training program in consultation with veterans business centers, the
interagency task force established under subsection (c), and veterans service
organizations.</text>
</paragraph><paragraph id="H35D5DE52042F4A23A948929D1B590C9C"><enum>(9)</enum><header>Inclusion of
other organizations in program</header><text>Upon the date of the enactment of
this subsection, each Veterans Business Outreach Center established by the
Administrator under the authority of section 8(b)(17) and each center that
received funds during fiscal year 2006 from the National Veterans Business
Development Corporation established under section 33 and that remains in
operation shall be treated as designated as a veterans business center for
purposes of this subsection and shall be eligible for grants under this
subsection.</text>
</paragraph><paragraph display-inline="no-display-inline" id="H28F3BD5274904C218E1FDCD63BDFC67A"><enum>(10)</enum><header>Rural
areas</header><text display-inline="yes-display-inline">The Director shall
submit annually to the Administrator a report on whether a sufficient
percentage, as determined by the Director, of veterans in rural areas have
adequate access to a veterans business center. If the Director submits a report
under this paragraph that does not demonstrate that a sufficient percentage of
veterans in rural areas have adequate access to a veterans business center, the
Director shall give priority during the 1-year period following the date of the
submission of such report to applications for designations and grants under
this subsection that will establish veterans business centers in rural
areas.</text>
</paragraph><paragraph id="H3433EC3152EB46E6A8C48CE54EF08A6A"><enum>(11)</enum><header>Authorization
of appropriations</header><text display-inline="yes-display-inline">There is
authorized to be appropriated to carry out this subsection $12,000,000 for
fiscal year 2010 and $14,000,000 for fiscal year 2011.</text>
</paragraph></subsection><subsection id="HAA4D4053A244447A8C24CFA1591CAF58"><enum>(h)</enum><header>Additional
grants available to veterans business centers</header>
<paragraph id="H913CDDA91FB042A3B6C7435F93C90076"><enum>(1)</enum><header>Access to
capital grant program</header>
<subparagraph id="H7BE6FC4CCD514710B42099DD216347FD"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">The Director of the
Veterans Business Center program shall establish a grant program under which
the Director is authorized to make, to veterans business centers designated
under subsection (g), grants for the following:</text>
<clause id="H84EFFC7C3A124E2789F1B177598F91D0"><enum>(i)</enum><text>Developing
specialized programs to assist veteran-owned small businesses to secure capital
and repair damaged credit.</text>
</clause><clause id="H19F58D165B884BFAA7A30F797E5E8C9B"><enum>(ii)</enum><text display-inline="yes-display-inline">Providing informational seminars on
securing loans to veteran-owned small businesses.</text>
</clause><clause id="H8660A94EAC2B44C48FAC4344010F5F04"><enum>(iii)</enum><text>Providing
one-on-one counseling to veteran-owned small businesses to improve the
financial presentations of such businesses to lenders.</text>
</clause><clause id="HA3EB5D75CC704DBBB2ACE7ECA99F34DD"><enum>(iv)</enum><text>Facilitating the
access of veteran-owned small businesses to both traditional and
non-traditional financing sources.</text>
</clause><clause id="HEA2AE48CC2184B7190D305ADBEF9AAC2"><enum>(v)</enum><text display-inline="yes-display-inline">Providing one-on-one or group counseling to
owners of small business concerns who are members of the reserve components of
the armed forces, as specified in
<external-xref legal-doc="usc" parsable-cite="usc/10/10101">section
10101</external-xref> of title 10, United States Code, to assist such owners to
effectively prepare their small businesses for periods when such owners are
deployed in support of a contingency operation.</text>
</clause><clause id="H8E0BFEB66B3245C6A19229E59D51A09A"><enum>(vi)</enum><text display-inline="yes-display-inline">Developing specialized programs to assist
unemployed veterans to become entrepreneurs.</text>
</clause></subparagraph><subparagraph id="H005B40EABC4B49608782B1F625D5F290"><enum>(B)</enum><header>Award
size</header><text display-inline="yes-display-inline">The Director may not
award a veterans business center more than $75,000 in grants under this
paragraph.</text>
</subparagraph><subparagraph id="HD897E0C567724D67A112F8528A521089"><enum>(C)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to carry
out this paragraph $1,500,000 for each of fiscal years 2010 and 2011.</text>
</subparagraph></paragraph><paragraph id="HF02D413AC8CE427793CAAED1E0413B53"><enum>(2)</enum><header>Procurement
assistance grant program</header>
<subparagraph id="H98FECDCF454B483DB8666A8F94F446FD"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">The Director shall
establish a grant program under which the Director is authorized to make, to
veterans business centers designated under subsection (g), grants for the
following:</text>
<clause id="HDE50EB2D286E4790B943CB5DCA7CAB90"><enum>(i)</enum><text>Assisting
veteran-owned small businesses to identify contracts that are suitable to such
businesses.</text>
</clause><clause id="H09A321D8AEDC4104BF5D5DD9CDDAE50E"><enum>(ii)</enum><text display-inline="yes-display-inline">Preparing veteran-owned small businesses to
be ready as subcontractors and prime contractors for contracts made available
through the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law
111–5</external-xref>) through training and business advisement, particularly
with respect to the construction trades.</text>
</clause><clause id="HB44092433C15450CBB79F26B7F57B346"><enum>(iii)</enum><text>Providing
veteran-owned small businesses technical assistance with respect to the Federal
procurement process, including assisting such businesses to comply with Federal
regulations and bonding requirements.</text>
</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HCBA671988BE9461BBBA2F72EA9F43DF2"><enum>(B)</enum><header>Award
size</header><text display-inline="yes-display-inline">The Director may not
award a veterans business center more than $75,000 in grants under this
paragraph.</text>
</subparagraph><subparagraph id="H09DC1518272142D88773AD10D86EAF63"><enum>(C)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to carry
out this paragraph $1,500,000 for each of fiscal years 2010 and 2011.</text>
</subparagraph></paragraph><paragraph id="H5DBEC001D2384977B63CC7E52EB94540"><enum>(3)</enum><header>Service-disabled
veteran-owned small business grant program</header>
<subparagraph id="H4866874414C44D72ABE8425CF02787BF"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">The Director shall
establish a grant program under which the Director is authorized to make, to
veterans business centers designated under subsection (g), grants for the
following:</text>
<clause id="H32B24B88566B4992AE9D0D6F6726912D"><enum>(i)</enum><text display-inline="yes-display-inline">Developing outreach programs for
service-disabled veterans to promote self-employment opportunities.</text>
</clause><clause id="HDCC5737AA46F4BFEBC1958714E4EEA44"><enum>(ii)</enum><text display-inline="yes-display-inline">Providing training to service-disabled
veterans with respect to business plan development, marketing, budgeting,
accounting, and merchandising.</text>
</clause><clause id="H5D37847AF0EB4D5FB414813051EFE0E8"><enum>(iii)</enum><text display-inline="yes-display-inline">Assisting service-disabled veteran-owned
small businesses to locate and secure business opportunities.</text>
</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HF1488D08D59140A7937AE3DA02C31134"><enum>(B)</enum><header>Award
size</header><text display-inline="yes-display-inline">The Director may not
award a veterans business center more than $75,000 in grants under this
paragraph.</text>
</subparagraph><subparagraph id="H786FB542FD3F4EFCA99CDDEE4FF85BDA"><enum>(C)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to carry
out this paragraph $1,500,000 for each of fiscal years 2010 and 2011.</text>
</subparagraph></paragraph></subsection><subsection id="H96B4B3F829CB4DA4A3D09AD34F4704DE"><enum>(i)</enum><header>Veterans
entrepreneurial development summit</header>
<paragraph id="H5164F95F0BCA4011BC3A80FF35C5DE57"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Director of the
Veterans Business Center program is authorized to carry out an event, once
every two years, for the purpose of providing networking opportunities,
outreach, education, training, and support to veterans business centers funded
under this section, veteran-owned small businesses, veterans service
organizations, and other entities as determined appropriate for inclusion by
the Director. Such event shall include education and training with respect to
improving outreach to veterans in areas of high unemployment.</text>
</paragraph><paragraph id="HEE9CD2B230CA4CF98603D98553863C78"><enum>(2)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There is
authorized to be appropriated to carry out this subsection $450,000 for fiscal
years 2010 and 2011.</text>
</paragraph></subsection><subsection id="H5CD5DFA05CC344DE81968A2E159C8BEC"><enum>(j)</enum><header>Inclusion of
surviving spouses</header><text display-inline="yes-display-inline">For
purposes of subsections (g), (h), and (i) the following apply:</text>
<paragraph id="HBF4D19B3997E45ABAC7E26BCBDA678E2"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>veteran</quote> includes a
surviving spouse of the following:</text>
<subparagraph id="HABE09219B52D42C28B541ABA3CAAE221"><enum>(A)</enum><text>A member of the
Armed Forces, including a reserve component thereof.</text>
</subparagraph><subparagraph id="H5C7C2C1CD24D41CA8E71F0DCA37A9B3B"><enum>(B)</enum><text>A veteran.</text>
</subparagraph></paragraph><paragraph id="H6C7C1C9B6E344A5B890C24179A9CC54A"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>veteran-owned small
business</quote> includes a small business owned by a surviving spouse of the
following:</text>
<subparagraph id="HC3720AD6A04B4C09804A748885F5D5E8"><enum>(A)</enum><text>A member of the
Armed Forces, including a reserve component thereof.</text>
</subparagraph><subparagraph id="HC5AC5E9E79DC431292020D4A766F6089"><enum>(B)</enum><text>A veteran.</text>
</subparagraph></paragraph></subsection><subsection id="H8016B90AE76F41608500EE67671429F8"><enum>(k)</enum><header>Inclusion of
reserve components</header><text display-inline="yes-display-inline">For
purposes of subsections (g), (h), and (i) the following apply:</text>

requirement for interagency task force</header><text display-inline="no-display-inline">Section 32(c) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/657b">15 U.S.C.
657b(c)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HB48A345155F44319A6DB47A3D8CF8932" style="OLC">
<paragraph id="H5389BB425918492CBE8217680E497668"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">The Administrator shall submit to Congress
biannually a report on the appointments made to and activities of the task
force.</text>
</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H723CCDFE46E545E2BD1E2644F5D49803"><enum>103.</enum><header>Comptroller
General study of small business concerns owned and controlled by
veterans</header><text display-inline="no-display-inline">The Comptroller
General shall carry out a study on the effects of this Act and the amendments
made by this Act on small business concerns owned and controlled by veterans
and submit to Congress a report on the results of such study. Such report shall
include the recommendations of the Comptroller General with respect to how this
Act and the amendments made by this Act may be implemented to more effectively
serve small business concerns owned and controlled by veterans.</text>
</section><enum>II</enum><header>Educating and
networking entrepreneurs through today’s technology</header>
<section id="H904658C8D9AE46C6A9C84DB69C60D7E8"><enum>201.</enum><header>Educating
entrepreneurs through technology</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et
seq.</external-xref>) is amended by redesignating section 44 as section 47 and
by inserting the following new section after section 43:</text>
<quoted-block display-inline="no-display-inline" id="H51542CE3EE614FC2B005819CF842783B" style="OLC">
<section id="HC4A8CC72905D404981302682E27A80D3"><enum>44.</enum><header>Educating and
networking entrepreneurs through technology</header>
<subsection id="H1F5B73E6CC744FA0B3C9EE1425A379E1"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to provide
distance learning and opportunities for the exchange of peer-to-peer technical
assistance through online networking to potential and existing entrepreneurs
through the use of technology.</text>
</subsection><subsection id="H7C72E0971B794279B3CD497C56C39CF8"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">As used in this section, the term
<term>qualified third-party vendor</term> means an entity with experience in
distance learning content or communications technology, or both, with the
ability to utilize on-line, satellite, video-on-demand, and connected
community-based organizations to distribute and conduct distance learning and
establish an online network for use by potential and existing entrepreneurs to
facilitate the exchange of peer-to-peer technical assistance related to
entrepreneurship, credit management, financial literacy, and Federal small
business development programs.</text>
</subsection><subsection id="HB586295A3F374768B17BB7D437BA00D7"><enum>(c)</enum><header>Authority</header><text display-inline="yes-display-inline">The Administrator shall contract with
qualified third-party vendors for entrepreneurial training content, the
development of communications technology that can distribute content under this
section throughout the United States, and the establishment of a nationwide,
online network for the exchange of peer-to-peer technical assistance. The
Administrator shall contract with at least two qualified third-party vendors to
develop content.</text>
</subsection><subsection id="H6A52B1D6B66441CBABA55EF5172E09BF"><enum>(d)</enum><header>Content</header><text display-inline="yes-display-inline">The Administrator shall ensure that the
content referred to in subsection (c) is timely and relevant to entrepreneurial
development and can be successfully communicated remotely to an audience
through the use of technology. The Administrator shall, to the maximum extent
practicable, promote content that makes use of technologies that allow for
remote interaction by the content provider with an audience. The Administrator
shall ensure that the content is catalogued and accessible to small businesses
on-line or through other remote technologies.</text>
</subsection><subsection id="HC748B6E6F6E74516961705AA1D6B00A2"><enum>(e)</enum><header>Communications
technology</header><text display-inline="yes-display-inline">The Administrator
shall ensure that the communications technology referred to in subsection (c)
is able to distribute content throughout all 50 States and the territories of
the United States to small business concerns, home-based businesses, Small
Business Development Centers, Women’s Business Centers, Veterans Business
Centers, SCORE chapters, and the Small Business Administration and network
entrepreneurs throughout all 50 States and the territories of the United States
to allow for peer-to-peer learning through the creation of a location online
that allows entrepreneurs and small business owners the opportunity to exchange
technical assistance through the sharing of information. To the extent
possible, the qualified third-party vendor should deliver the content and
facilitate the networking using broadband technology.</text>
</subsection><subsection id="H4BD94B5807314CBF946A3AA056A25F16"><enum>(f)</enum><header>Reports to
Congress</header><text display-inline="yes-display-inline">The Administrator
shall submit a report to Congress 6 months after the date of the enactment of
this section containing an analysis of the Small Business Administration’s
progress in implementing this section. The Administrator shall submit a report
to Congress 1 year after the date of the enactment of this section and annually
thereafter containing the number of presentations made under this section, the
number of small businesses served under this section, the extent to which this
section resulted in the establishment of new businesses, and feedback on the
usefulness of this medium in presenting entrepreneurial education and
facilitating the exchange of peer-to-peer technical assistance throughout the
United States.</text>
</subsection><subsection id="H131112A10A6048E5A3E242FB65A6056C"><enum>(g)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated to carry
out this section $2,000,000 for each of the fiscal years 2010 and
2011.</text>

Native American Affairs; Tribal Business Information Centers program</header>
<subsection id="HA60FACA6866E44F78195F46592E45C2E"><enum>(a)</enum><header>Associate
Administrator</header><text display-inline="yes-display-inline">Section 4(b)(1)
of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/633">15 U.S.C. 633(b)(1)</external-xref>) is
amended—</text>
<paragraph id="H57D07F37E50D455B997CD5F7789FD898"><enum>(1)</enum><text>by striking
<quote>five Associate Administrators</quote> and inserting <quote>six Associate
Administrators</quote>; and</text>
</paragraph><paragraph id="HFE6EA473BB764FD78AD5A835FA9EE115"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after <quote>vested in the
Administration.</quote> the following: <quote>One such Associate Administrator
shall be the Associate Administrator for Native American Affairs, who shall
administer the Office of Native American Affairs established under section
45.</quote>.</text>
</paragraph></subsection><subsection id="H20B861F86D3641CEAB650D9C3FE2F270"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et
seq.</external-xref>) is amended by inserting after section 44, as added by
section 201 of this Act, the following:</text>

<section id="HD5414ECF9CA440FEB96BF92651030F5F"><enum>45.</enum><header>Office of Native
American Affairs and Tribal Business Information Centers Program</header>
<subsection id="HE7373C1697D0440FB5169D4D788C0C22"><enum>(a)</enum><header>Office of Native
American Affairs</header>
<paragraph id="HF80BAC819BD645328A65E664C157CBA8"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Administration
an Office of Native American Affairs (hereinafter referred to in this
subsection as the <quote>Office</quote>).</text>
</paragraph><paragraph id="H4916A3FD06994100BE6C0A4946DB85CC"><enum>(2)</enum><header>Associate
Administrator</header><text display-inline="yes-display-inline">The Office
shall be administered by an Associate Administrator appointed under section
4(b)(1).</text>
</paragraph><paragraph id="H07B9697D131440EA81C609E51A5AB37B"><enum>(3)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Office shall have the following
responsibilities:</text>
<subparagraph id="HD46B30CF78314C7283C901008172B0D4"><enum>(A)</enum><text>Developing and
implementing tools and strategies to increase Native American
entrepreneurship.</text>
</subparagraph><subparagraph id="H1ED066DC5B704B388554DE321AEEAA80"><enum>(B)</enum><text display-inline="yes-display-inline">Expanding the access of Native American
entrepreneurs to business training, financing, and Federal small business
contracts.</text>
</subparagraph><subparagraph id="H249992A25E8644D0B181C36F5F22F603"><enum>(C)</enum><text>Expanding outreach
to Native American communities and marketing entrepreneurial development
services to such communities.</text>
</subparagraph><subparagraph id="H31D65B7265004AF480642D812AF91FF7"><enum>(D)</enum><text>Representing the
Administration with respect to Native American economic development
matters.</text>
</subparagraph></paragraph><paragraph id="HBA168AF5937E4293ABB9B89F79500DBC"><enum>(4)</enum><header>Coordination and
oversight function</header><text>The Office shall provide oversight with
respect to and assist the implementation of all Administration initiatives
relating to Native American entrepreneurial development.</text>
</paragraph><paragraph id="HCDC540BA198A4F76A9E113921C14A13F"><enum>(5)</enum><header>Authorization of
appropriations</header><text>To carry out this subsection, there is authorized
to be appropriated to the Administrator $2,000,000 for each of fiscal years
2010 and 2011.</text>
</paragraph></subsection><subsection id="H186A0F08EAF24234930DBA9CCFB68204"><enum>(b)</enum><header>Tribal Business
Information Centers Program</header>
<paragraph id="H9DEBD89E9FC447CB8925A6E759E49FF2"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator is authorized to operate,
alone or in coordination with other Federal departments and agencies, a Tribal
Business Information Centers program that provides Native American populations
with business training and entrepreneurial development assistance.</text>
</paragraph><paragraph id="H64633229C0E4466BA3B96EAFDF814D3B"><enum>(2)</enum><header>Designation of
centers</header><text display-inline="yes-display-inline">The Administrator
shall designate entities as centers under the Tribal Business Information
Centers program.</text>
</paragraph><paragraph id="HA4F2DDEB5804478BB025E1864BB8607B"><enum>(3)</enum><header>Administration
support</header><text>The Administrator may contribute agency personnel and
resources to the centers designated under paragraph (2) to carry out this
subsection.</text>
</paragraph><paragraph id="HB956FCCD0C9E4E08BA7877FB12DC058A"><enum>(4)</enum><header>Grant
program</header><text>The Administrator is authorized to make grants of not
more than $300,000 to centers designated under paragraph (2) for the purpose of
providing Native Americans the following:</text>
<subparagraph id="HEB18A0DF80944B0495415EDB9DC8208F"><enum>(A)</enum><text display-inline="yes-display-inline">Business workshops.</text>
</subparagraph><subparagraph id="HB03C656426A84EE7A80F3C51E54404B7"><enum>(B)</enum><text>Individualized
business counseling.</text>
</subparagraph><subparagraph id="HD615B2D5338D46F4964B19866555F5F2"><enum>(C)</enum><text>Entrepreneurial
development training.</text>
</subparagraph><subparagraph id="HD08F4A42D6E44B3EB2303A41EF4904FA"><enum>(D)</enum><text>Access to computer
technology and other resources to start or expand a business.</text>
</subparagraph></paragraph><paragraph id="H726C08ED26354FD69245CAD407BF75CA"><enum>(5)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator shall by regulation
establish a process for designating centers under paragraph (2) and making the
grants authorized under paragraph (4).</text>
</paragraph><paragraph id="HFB49720ECEF5437BB40A5E715E88F35B"><enum>(6)</enum><header>Definition of
Administrator</header><text display-inline="yes-display-inline">In this
subsection, the term <term>Administrator</term> means the Administrator, acting
through the Associate Administrator administering the Office of Native American
Affairs.</text>
</paragraph><paragraph id="HC5080A2175954A158DA9B64462B8478E"><enum>(7)</enum><header>Authorization of
appropriations</header><text>To carry out this subsection, there is authorized
to be appropriated to the Administrator $15,000,000 for fiscal year 2010 and
$17,000,000 for fiscal year 2011.</text>
</paragraph></subsection><subsection id="H3354ECEF71EC4F39B10126AFB0912776"><enum>(c)</enum><header>Definition of
Native American</header><text>The term <term>Native American</term> means an
Indian tribe member, Alaska Native, or Native Hawaiian as such are defined in
section 21(a)(8) of this
Act.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><section id="HF3E41E5494604294AECF392A2CF1E119"><enum>302.</enum><header>Small Business
Development Center assistance to Indian tribe members, Alaska Natives, and
Native Hawaiians</header>
<subsection id="HD2EDB858FF0F47C5AE89D980F61B07DD"><enum>(a)</enum><header>In
general</header><text>Section 21(a) of the <act-name parsable-cite="SBA">Small
Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(a)</external-xref>) is amended by
adding at the end the following:</text>
<quoted-block act-name="Small Business Act" id="H6EF6C9711A9D44E4A025051D2C8A2D31">
<paragraph id="H674E3CD185944B9EAA6C4AC8B253FD5D"><enum>(8)</enum><header>Additional grant
to assist Indian tribe members, Alaska Natives, and Native Hawaiians</header>
<subparagraph id="H3BBFD55D694846D99E5B8168608FBF19"><enum>(A)</enum><header>In
general</header><text>Any applicant in an eligible State that is funded by the
Administration as a Small Business Development Center may apply for an
additional grant to be used solely to provide services described in subsection
(c)(3) to assist with outreach, development, and enhancement on Indian lands of
small business startups and expansions owned by Indian tribe members, Alaska
Natives, and Native Hawaiians.</text>
</subparagraph><subparagraph id="H58827F8F8EC4462FBF4A6F2214971BAB"><enum>(B)</enum><header>Eligible
States</header><text>For purposes of subparagraph (A), an eligible State is a
State that has a combined population of Indian tribe members, Alaska Natives,
and Native Hawaiians that comprises at least 1 percent of the State’s total
population, as shown by the latest available census.</text>
</subparagraph><subparagraph id="H860438EE81F94160A00A9DDE214D016E"><enum>(C)</enum><header>Grant
applications</header><text>An applicant for a grant under subparagraph (A)
shall submit to the Administration an application that is in such form as the
Administration may require. The application shall include information regarding
the applicant’s goals and objectives for the services to be provided using the
grant, including—</text>
<clause id="H929BEC730F3E4AAB91590D91771426A4"><enum>(i)</enum><text>the capability of
the applicant to provide training and services to a representative number of
Indian tribe members, Alaska Natives, and Native Hawaiians;</text>
</clause><clause id="H68C1EB835A3A4100AAFB6AEA3E5DBF62"><enum>(ii)</enum><text>the location of
the Small Business Development Center site proposed by the applicant;</text>
</clause><clause id="H3D5E699D368740168E76D51B80EED296"><enum>(iii)</enum><text>the required
amount of grant funding needed by the applicant to implement the program;
and</text>
</clause><clause id="H99C7FE64975A48B78E582D45DBC685F9"><enum>(iv)</enum><text>the extent to
which the applicant has consulted with local tribal councils.</text>
</clause></subparagraph><subparagraph id="H663B61BA0C1E4681ADB214EF15CEF1D0"><enum>(D)</enum><header>Applicability of
grant requirements</header><text>An applicant for a grant under subparagraph
(A) shall comply with all of the requirements of this section, except that the
matching funds requirements under paragraph (4)(A) shall not apply.</text>
</subparagraph><subparagraph id="HDA6976180743419BB0118E710F614941"><enum>(E)</enum><header>Maximum amount
of grants</header><text>No applicant may receive more than $300,000 in grants
under this paragraph for any fiscal year.</text>
</subparagraph><subparagraph id="HA0CB280CEAF245C3A72BEE2C4A55FB2A"><enum>(F)</enum><header>Regulations</header><text>After
providing notice and an opportunity for comment and after consulting with the
Association recognized by the Administration pursuant to paragraph (3)(A) (but
not later than 180 days after the date of enactment of this paragraph), the
Administration shall issue final regulations to carry out this paragraph,
including regulations that establish—</text>
<clause id="H2DC6C12439B648D0B9A49E50C317638C"><enum>(i)</enum><text>standards relating
to educational, technical, and support services to be provided by Small
Business Development Centers receiving assistance under this paragraph;
and</text>
</clause><clause id="H0D8B0535B4CB49BC8ECBFE864761D2E4"><enum>(ii)</enum><text>standards
relating to any work plan that the Administration may require a Small Business
Development Center receiving assistance under this paragraph to develop.</text>
</clause></subparagraph><subparagraph id="H5E71CF10B6D24EA8887732C137EF26E7"><enum>(G)</enum><header>Advice of local
tribal organizations</header><text>A Small Business Development Center
receiving a grant under this paragraph shall request the advice of a tribal
organization on how best to provide assistance to Indian tribe members, Alaska
Natives, and Native Hawaiians and where to locate satellite centers to provide
such assistance.</text>
</subparagraph><subparagraph id="H242F07F9AA7E47058EF2609243F17A74"><enum>(H)</enum><header>Definitions</header><text>In
this paragraph, the following definitions apply:</text>
<clause id="HE4256235D870444E83DD61AAA1B9C560"><enum>(i)</enum><header>Indian
lands</header><text>The term <term>Indian lands</term> has the meaning given
the term <term>Indian country</term> in
<external-xref legal-doc="usc" parsable-cite="usc/18/1151">section
1151</external-xref> of title 18, United States Code, the meaning given the
term <term>Indian reservation</term> in
<external-xref legal-doc="regulation" parsable-cite="cfr/25/151.2">section
151.2</external-xref> of title 25, Code of Federal Regulations (as in effect on
the date of enactment of this paragraph), and the meaning given the term
<term>reservation</term> in section 4 of the Indian Child Welfare Act of 1978
(<external-xref legal-doc="usc" parsable-cite="usc/25/1903">25 U.S.C.
1903</external-xref>).</text>
</clause><clause id="H66D9ACAD4DA54450882EFA0A9B942085"><enum>(ii)</enum><header>Indian
tribe</header><text>The term <term>Indian tribe</term> means any band, nation,
or organized group or community of Indians located in the contiguous United
States, and the Metlakatla Indian Community, whose members are recognized as
eligible for the services provided to Indians by the Secretary of the Interior
because of their status as Indians.</text>
</clause><clause id="HF0A227CF6CF147BCBC9EF6069DE7AA5C"><enum>(iii)</enum><header>Indian tribe
member</header><text>The term <term>Indian tribe member</term> means a member
of an Indian tribe (other than an Alaska Native).</text>
</clause><clause id="HD6472DF8648C4898A502238580EAE233"><enum>(iv)</enum><header>Alaska
Native</header><text>The term <term>Alaska Native</term> has the meaning given
the term <term>Native</term> in section 3(b) of the Alaska Native Claims
Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43
U.S.C. 1602(b)</external-xref>).</text>
</clause><clause id="HD39862CF08EA4CABAA37A3608B01E27E"><enum>(v)</enum><header>Native
Hawaiian</header><text display-inline="yes-display-inline">The term
<term>Native Hawaiian</term> means any individual who is—</text>
<subclause id="H6352AF756B5343B3A2808913435184AE"><enum>(I)</enum><text>a citizen of the
United States; and</text>
</subclause><subclause id="H1C8827B751EB43E8A32D1E40D772E25A"><enum>(II)</enum><text>a descendant of
the aboriginal people, who prior to 1778, occupied and exercised sovereignty in
the area that now constitutes the State of Hawaii.</text>
</subclause></clause><clause id="H37E2B779AE1843B0A93FAFF0271451FD"><enum>(vi)</enum><header>Tribal
organization</header><text display-inline="yes-display-inline">The term
<term>tribal organization</term> has the meaning given that term in section
4(l) of the Indian Self-Determination and Education Assistance Act
(<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C.
450b(l)</external-xref>).</text>
</clause></subparagraph><subparagraph id="H41DCCFE7A1154C24899D7A3E4FD96D0B"><enum>(I)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to carry
out this paragraph $7,000,000 for each of fiscal years 2010 and 2011.</text>
</subparagraph><subparagraph id="H4AB848B9B22449BBB1311C7216EA6292"><enum>(J)</enum><header>Funding
limitations</header>
<clause id="H3C3ED181FB2D427B935F5C7016980F26"><enum>(i)</enum><header>Nonapplicability
of certain limitations</header><text>Funding under this paragraph shall be in
addition to the dollar program limitations specified in paragraph (4).</text>
</clause><clause id="H80E75B26EFD84B43BCB49B2B6D51DF9A"><enum>(ii)</enum><header>Limitation on
use of funds</header><text>The Administration may carry out this paragraph only
with amounts appropriated in advance specifically to carry out this
paragraph.</text>
</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><enum>IV</enum><header>Broadening the
Women’s Business Center program</header>
<section id="H9974FCABAE554CE5AE086C2A0F821CF8" section-type="subsequent-section"><enum>401.</enum><header>Notification of
grants; publication of grant amounts</header><text display-inline="no-display-inline">Section 29 of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C.
656</external-xref>) is amended by adding at the end the following new
subsection:</text>
<quoted-block display-inline="no-display-inline" id="H2080562D9E9E423E905CBBDD398C6908" style="OLC">
<subsection id="H1D671DB598484387AA0A49D5765FF8AA"><enum>(o)</enum><header>Notification of
grants; publication of grant amounts</header><text display-inline="yes-display-inline">The Administrator shall disburse funds to a
women’s business center not later than 1 month after the center’s application
is approved under this section. At the end of each fiscal year the
Administrator (acting through the Office of Women’s Business ownership) shall
publish on the Administration’s website a report setting forth the total amount
of the grants made under this Act to each women’s business center in the fiscal
year for which the report is issued, the total amount of such grants made in
each prior fiscal year to each such center, and the total amount of private
matching funds provided by each such center over the lifetime of the
center.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="HE2A3896117EB43E193EF41A7524159C6"><enum>402.</enum><header>Communications</header><text display-inline="no-display-inline">Section 29 of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C.
656</external-xref>), as amended, is further amended by adding at the end the
following new subsection:</text>
<quoted-block display-inline="no-display-inline" id="HFA38166C8E9545EEAFEDC179C614103C" style="OLC">
<subsection id="H0B7BB162C4B74FA4BC2737E26A9A0F5B"><enum>(p)</enum><header>Communications</header><text display-inline="yes-display-inline">The Administrator shall establish, by rule,
a standardized process to communicate with women’s business centers regarding
program administration matters, including reimbursement, regulatory matters,
and programmatic changes. The Administrator shall notify each women’s business
center of the opportunity for notice and comment on the proposed
rule.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H4AAF587651994DD9BAC0C34D5B495042"><enum>403.</enum><header>Funding</header>
<subsection id="H504A701F5C914545BE46D81EA7BC3DA4"><enum>(a)</enum><header>Formula</header><text display-inline="yes-display-inline">Section 29(b) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C.
656(b)</external-xref>) is amended to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="H4BF0083A4D0441FAA00A0CA7E6496524" style="OLC">
<subsection id="HCE7719982C6C496488B33C1924788CDB"><enum>(b)</enum><header>Authority</header>
<paragraph id="HD41B33CEBCBA4141AB228A51CC991BC6"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Administrator may
provide financial assistance to private nonprofit organizations to conduct
projects for the benefit of small business concerns owned and controlled by
women. The projects shall provide—</text>
<subparagraph id="H10641646F9644A9FBF4C850F25802FD0"><enum>(A)</enum><text display-inline="yes-display-inline">financial assistance, including training
and counseling in how to apply for and secure business credit and investment
capital, preparing and presenting financial statements, and managing cash flow
and other financial operations of a business concern;</text>
</subparagraph><subparagraph id="HFFC427B9A7EA4AF48CB1FDDFB2EF1148"><enum>(B)</enum><text display-inline="yes-display-inline">management assistance, including training
and counseling in how to plan, organize, staff, direct, and control each major
activity and function of a small business concern, including implementing
cost-saving energy techniques; and</text>
</subparagraph><subparagraph id="H9FC53EA05EBA4C34A71A5D9EB08776DD"><enum>(C)</enum><text>marketing
assistance, including training and counseling in identifying and segmenting
domestic and international market opportunities, preparing and executing
marketing plans, developing pricing strategies, locating contract
opportunities, negotiating contracts, and utilizing varying public relations
and advertising techniques.</text>
</subparagraph></paragraph><paragraph id="H457FD0AAE32C45DFAA6C10A21C0728B4"><enum>(2)</enum><header>Tiers</header><text display-inline="yes-display-inline">The Administrator shall provide assistance
under paragraph (1) in 3 tiers of assistance as follows:</text>
<subparagraph id="H8E3A9C0DB53B4BD08DEDAA4FDF4E0B82"><enum>(A)</enum><text display-inline="yes-display-inline">The first tier shall be to conduct a 5-year
project in a situation where a project has not previously been conducted. Such
a project shall be in a total amount of not more than $150,000 per year.
Projects receiving assistance under this subparagraph that possess the capacity
to train existing or potential business owners in the fields of green
technology, clean technology, or energy efficiency shall receive the maximum
award under this subparagraph.</text>
</subparagraph><subparagraph id="H055476AE9B7644BD884DD6B98C372363"><enum>(B)</enum><text>The second tier
shall be to conduct a 3-year project in a situation where a first-tier project
is being completed. Such a project shall be in a total amount of not more than
$100,000 per year.</text>
</subparagraph><subparagraph id="HF7CBF610FA3D4371B43C78D3E5B0DF6B"><enum>(C)</enum><text>The third tier
shall be to conduct a 3-year project in a situation where a second-tier project
is being completed. Such a project shall be in a total amount of not more than
$100,000 per year. Third-tier grants shall be renewable subject to established
eligibility criteria as well as criteria in subsection (b)(4).</text>
</subparagraph></paragraph><paragraph id="H7286DD9D7A2E48A0B87D9BD9EB7239FC"><enum>(3)</enum><header>Allocation of
funds</header><text>Of the amounts made available for assistance under this
subsection, the Administrator shall allocate—</text>
<subparagraph id="H0C800C4B2BEC47F3AF8B5AFFE0CDE79E"><enum>(A)</enum><text>at least 40
percent for first-tier projects under paragraph (2)(A);</text>
</subparagraph><subparagraph id="HB60A7D583F994C8A8672E6233A04714D"><enum>(B)</enum><text>20 percent for
second-tier projects under paragraph (2)(B); and</text>
</subparagraph><subparagraph id="H8DC9C84CC08C45C9AACBCC2668BBCC51"><enum>(C)</enum><text>the remainder for
third-tier projects under paragraph (2)(C).</text>
</subparagraph></paragraph><paragraph id="HC46781798C5E49A8BE4E5677B3A45AB3"><enum>(4)</enum><header> Benchmarks for
third-tier projects</header><text>In awarding third-tier projects under
paragraph (2)(C), the Administrator shall use benchmarks based on
socio-economic factors in the community and on the performance of the
applicant. The benchmarks shall include—</text>
<subparagraph id="H6318C8EE410346E183F66E7D4E7C1A03"><enum>(A)</enum><text>the total number
of women served by the project;</text>
</subparagraph><subparagraph id="HDDE1AF298A974E8395C84A63D98D8809"><enum>(B)</enum><text>the proportion of
low income women and socio-economic distribution of clients served by the
project;</text>
</subparagraph><subparagraph id="HC540B979ACB6467E9D8C507FAAAFD2EA"><enum>(C)</enum><text>the proportion of
individuals in the community that are socially or economically disadvantaged
(based on median income);</text>
</subparagraph><subparagraph id="H022FC8F6EE754FE09DEFE357B6B3BBD7"><enum>(D)</enum><text>the future
fund-raising and service coordination plans;</text>
</subparagraph><subparagraph display-inline="no-display-inline" id="H56F84984F353484E8800413D674AA1B5"><enum>(E)</enum><text display-inline="yes-display-inline">the capacity of the project to train
existing or potential business owners in the fields of green technology, clean
technology, or energy efficiency;</text>
</subparagraph><subparagraph id="H754A510A56944BE0AA1E6E5D8A375761"><enum>(F)</enum><text>the diversity of
services provided; and</text>
</subparagraph><subparagraph id="H272642F2BF044B3F894CAE71A6D7A5DE"><enum>(G)</enum><text>geographic
distribution within and across the 10 regions of the Small Business
Administration.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

entrepreneurship</header><text display-inline="no-display-inline">Section 4 of
the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/633">15 U.S.C. 633</external-xref>) is amended by adding
at the end the following:</text>

direction</header>
<paragraph id="HE1676BA7C6E94B42A9CD9AA9E49078DA"><enum>(1)</enum><header>Plan for
entrepreneurial development and job creation strategy</header><text display-inline="yes-display-inline">The Administrator shall develop and submit
to Congress a plan, in consultation with a representative from each of the
agency's entrepreneurial development programs, for using the Small Business
Administration’s entrepreneurial development programs to create jobs during
fiscal years 2010 and 2011. The plan shall include the Administration’s plan
for drawing on existing programs, including Small Business Development Centers,
Women’s Business Centers, SCORE, Veterans Business Centers, Native American
Outreach, and other appropriate programs. The Administrator shall identify a
strategy for each Administration region to create or retain jobs through
Administration programs. The Administrator shall identify, in consultation with
appropriate personnel from entrepreneurial development programs, performance
measures and criteria, including job creation, job retention, and job
retraining goals, to evaluate the success of the Administration’s actions
regarding these efforts.</text>
</paragraph><paragraph id="HEB4E46758A244270A2B84B15E9758339"><enum>(2)</enum><header>Data collection
process</header><text display-inline="yes-display-inline">The Administrator
shall, after notice and opportunity for comment, promulgate a rule to develop
and implement a consistent data collection process to cover all entrepreneurial
development programs. Such data collection process shall include data relating
to job creation, performance, and any other data determined appropriate by the
Administrator with respect to the Administration’s entrepreneurial development
programs.</text>
</paragraph><paragraph id="HF6C25C322A2246A8BDA23BA32821299D"><enum>(3)</enum><header>Coordination and
Alignment of SBA Entrepreneurial Development Programs</header><text>The
Administrator shall submit annually to Congress, in consultation with other
Federal departments and agencies as appropriate, a report on opportunities to
foster coordination, limit duplication, and improve program delivery for
Federal entrepreneurial development programs.</text>
</paragraph><paragraph id="H9EDE54F2F3FD41BD8F87D01F49CB3CE9"><enum>(4)</enum><header>Database of
Entrepreneurial Development Service Providers</header><text>The Administrator
shall, after a period of 60 days for public comment, establish a database of
providers of entrepreneurial development services and, make such database
available through the Administration’s Web site. The database shall be
searchable by industry, geography, and service required.</text>
</paragraph><paragraph id="H8EC9A294C6F74BBDABDA54C4BCC35116"><enum>(5)</enum><header>Community
Specialist</header><text display-inline="yes-display-inline">The Administrator
shall designate not less than one staff member in each Administration district
office as a community specialist who has as their full-time responsibility
working with local entrepreneurial development service providers to increase
coordination with Federal resources. The Administrator shall develop benchmarks
for measuring the performance of community specialists under this
subsection.</text>
</paragraph><paragraph id="H036DD5C79BC842509D170083695DE377"><enum>(6)</enum><header>Entrepreneurial
Development Portal</header><text>The Administrator shall publish a design for a
Web-based portal to provide comprehensive information on the Administration’s
entrepreneurial development programs. After a period of 60 days for public
comment, the Administrator shall establish such portal and—</text>
<subparagraph id="HB3F6322679674933B34F9B9532972671"><enum>(A)</enum><text>integrate under
one Web portal, Small Business Development Centers, Women's Business Centers,
SCORE, Veterans Business Centers, the Administration’s distance learning
program, and other programs as appropriate;</text>
</subparagraph><subparagraph id="H85C5350752144BBD806F199EE638CB1F"><enum>(B)</enum><text display-inline="yes-display-inline">revise the Administration’s primary Web
site so that the Web portal described in subparagraph (A) is available as a
link on the main Web page of the Web site;</text>
</subparagraph><subparagraph id="H15533D1E8DCC47EE9640B6310319AC52"><enum>(C)</enum><text>increase
consumer-oriented content on the Administration’s Web site and focus on
promoting access to business solutions, including marketing, financing, and
human resources planning;</text>
</subparagraph><subparagraph id="HA8AE3987AEE14214AFBDA9BC0C52E787"><enum>(D)</enum><text>establish relevant
Web content aggregated by industry segment, stage of business development,
level of need, and include referral links to appropriate Administration
services, including financing, training and counseling, and procurement
assistance; and</text>
</subparagraph><subparagraph id="H15BC338E965D4D35A0C86F2DCACCF205"><enum>(E)</enum><text>provide style
guidelines and links for visitors to the Administration’s Web site to be able
to comment on and evaluate the materials in terms of their usefulness.</text>
</subparagraph></paragraph><paragraph id="H9F73C5C9081648C4B3B47E57063FCD22"><enum>(7)</enum><header>Pilot
programs</header><text display-inline="yes-display-inline">The Administrator
may not conduct any pilot program for a period of greater than 3 years if the
program conflicts with, or uses the resources of, any of the entrepreneurial
development programs authorized under section 8(b)(1)(B), 21, 29, 32, or any
other provision of this

limitations in this paragraph shall not apply to any State in which more than

purposes of this paragraph, the term <term>Small Business Development
Center</term> means the entity selected by the Administration to receive funds

to the number of sites for service delivery such entity establishes or

specialized programs to assist local small business concerns in securing
capital and repairing damaged credit;</text>
</subparagraph><subparagraph id="HA66A8BDD6D15480C8444719656264233"><enum>(B)</enum><text>provide
informational seminars on securing credit and loans;</text>
</subparagraph><subparagraph id="H8279804909F14C18B57F57ABD13D309F"><enum>(C)</enum><text>provide one-on-one
counseling with potential borrowers to improve financial presentations to
lenders; and</text>
</subparagraph><subparagraph id="HE70FC411F3344BADB7A49537C15164FF"><enum>(D)</enum><text>facilitate
borrowers’ access to non-traditional financing sources, as well as traditional
lending sources.</text>
</subparagraph></paragraph><paragraph id="HECEA7ACC5C7A4BDDA0CF8EC3FD5C242F"><enum>(2)</enum><header>Award size
limit</header><text>The Administration may not award an entity more than
$300,000 in grant funds under this subsection.</text>

<subparagraph id="H5DED3D2808824AD1B141DB72576E90F5"><enum>(A)</enum><text>work with local
agencies to identify contracts that are suitable for local small business
concerns;</text>
</subparagraph><subparagraph id="H285BC7027450418797428CA566F6B16E"><enum>(B)</enum><text>prepare small
businesses to be ready as subcontractors and prime contractors for contracts
made available under the American Recovery and Reinvestment Act of 2009
(<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law
111–5</external-xref>) through training and business advisement, particularly
in the construction trades; and</text>
</subparagraph><subparagraph id="HBBF8D59FED944BB59C0FFEA5C84F663B"><enum>(C)</enum><text>provide technical
assistance regarding the Federal procurement process, including assisting small
business concerns to comply with federal regulations and bonding
requirements.</text>
</subparagraph></paragraph><paragraph id="HFEDE59D069CF4BC1B1F71C4AB0A3EF7E"><enum>(2)</enum><header>Award size
limit</header><text>The Administration may not award an entity more than
$300,000 in grant funds under this subsection.</text>

<subparagraph display-inline="no-display-inline" id="H8C55D8ED25034CE6A7583507D34293CB"><enum>(A)</enum><text display-inline="yes-display-inline">provide education classes and one-on-one
instruction in starting a business in the fields of energy efficiency, green
technology, or clean technology and in adapting a business to include such
fields;</text>
</subparagraph><subparagraph id="H16E9A85E804D4B469F1F77718E7299B0"><enum>(B)</enum><text>coordinate such
classes and instruction, to the extent practicable, with local community
colleges and local professional trade associations;</text>
</subparagraph><subparagraph id="H62390E6B7E8443508B1DCFDA3F1DA61B"><enum>(C)</enum><text display-inline="yes-display-inline">assist and provide technical counseling to
individuals seeking to start a business in the fields of energy efficiency,
green technology, or clean technology and to individuals seeking to adapt a
business to include such fields; and</text>
</subparagraph><subparagraph id="H246657BC266144F0A39376594410C35E"><enum>(D)</enum><text display-inline="yes-display-inline">provide services that assist low-income or

used to—</text>
<subparagraph id="H7AF5AE184E3A40F9BAB318027BF10964"><enum>(A)</enum><text>establish a
statewide small business helpline within every State and United States
territory to provide immediate expert information and assistance to small
business concerns;</text>
</subparagraph><subparagraph id="H16993A7DE470401893D63C5A1D2EFE9A"><enum>(B)</enum><text>develop a
portfolio of online survival and growth tools and resources that struggling
small business concerns can utilize through the Internet;</text>
</subparagraph><subparagraph id="H736378DB1C9E4EB9A5E9F4E07130A1D5"><enum>(C)</enum><text>develop business
advisory capacity to provide expert consulting and education to assist small
businesses at-risk of failure and to, in areas of high demand, shorten the
response time of small business development centers, and, in rural areas,
support added outreach in remote communities;</text>
</subparagraph><subparagraph id="H1448FB3CF7574117ACCECED454C1E8B9"><enum>(D)</enum><text>deploy additional
resources to help specific industry sectors with a high presence of small
business concerns, which shall be targeted toward clusters of small businesses
with similar needs and build upon best practices from earlier
assistance;</text>
</subparagraph><subparagraph id="HE4F67FA805FB475C9461245FBB8311B9"><enum>(E)</enum><text>develop a formal
listing of financing options for small business capital access; and</text>
</subparagraph><subparagraph id="H6BBA312AADAB4909A58359D3F2A5D5EB"><enum>(F)</enum><text>deliver services
that help dislocated workers start new businesses.</text>
</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H1BB8ED0752EA4ACBA765DCB49580A661"><enum>(2)</enum><header>Award size
limit</header><text>The Administration may not award an entity more than
$250,000 in grant funds under this subsection.</text>

648(a)(4)(B)</external-xref>) is amended by inserting after <quote>Federal
program</quote> the following: <quote>and shall not include any funds obtained
through the assessment of fees to small business clients</quote>.</text>
</section><section id="H0D680BCE1B4C458192C286221BE3539B"><enum>707.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">Section 20
of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note), as amended by
sections 403(c) and 504 of this Act, is further amended by inserting after
subsection (g) the following new subsection:</text>

648</external-xref>), as amended, is further amended by adding at the end the
following new subsection:</text>

to small manufacturers with respect to changing operations to another industry
sector or reorganizing operations to increase efficiency and
profitability;</text>
</subparagraph><subparagraph id="HCD03173CBF934A1EB9950FBF3742B360"><enum>(B)</enum><text display-inline="yes-display-inline">assist marketing of the capabilities of
small manufacturers outside the principal area of operations of such
manufacturers;</text>
</subparagraph><subparagraph id="HC1A1E03806F246A28F6CFBE645D17020"><enum>(C)</enum><text>facilitate
peer-to-peer and mentor-protege relationships between small manufacturers and
corporations and Federal agencies; and</text>
</subparagraph><subparagraph id="H119493242038427991CC047AA6221005"><enum>(D)</enum><text>conduct outreach
activities to local small manufacturers with respect to the availability of the
services described in subparagraphs (A), (B), and (C).</text>
</subparagraph></paragraph><paragraph id="H23F53320084A4D089283E0796A8CC9D3"><enum>(2)</enum><header>Definition of
small manufacturer</header><text>In this subsection, the term <quote>small
manufacturer</quote> means a small business concern engaged in an industry

</section><enum>VIII</enum><header>Microenterprise
training center program</header>
<section id="H5C290C1A8D8D42C7BC875F5BC6BADEB6"><enum>801.</enum><header>Microenterprise
training center program</header><text display-inline="no-display-inline">The
Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended by
inserting after section 45, as added by section 301(b) of this Act, the
following:</text>

<section id="H94BAE3BAA4C5477E87087402F381E235"><enum>46.</enum><header>Microenterprise
training center program</header>
<subsection id="HB5A45CDCB1D84643869BEFA1B1A36A24"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish and carry
out a microenterprise training center program for the purpose of providing
low-income and unemployed individuals with training and counseling with respect
to starting a microenterprise.</text>
</subsection><subsection id="H96FC76DBE2A64F1C97118265AACD03E1"><enum>(b)</enum><header>Number and
location of centers</header><text display-inline="yes-display-inline">In
carrying out the program under subsection (a), the Administrator shall
establish 10 microenterprise training centers, which, to the extent
practicable, shall be located in a manner that promotes the geographic
diversity of such centers. The Administrator shall give priority in locating
such centers to areas with high proportions of low-income and unemployed
individuals.</text>
</subsection><subsection id="H1760F5CDA15A40C881F65CFECB593243"><enum>(c)</enum><header>Function</header><text display-inline="yes-display-inline">In carrying out the program under
subsection (a), the Administrator shall ensure that microenterprise training
centers provide training and resources to individuals seeking to start a new
microenterprise, including through the provision of classes, one-on-one
instruction, and other services the Administrator determines
appropriate.</text>
</subsection><subsection id="H9C44FEC81C3343BD809525E402D6D6A0"><enum>(d)</enum><header>Coordination</header><text>The
Administrator shall coordinate the program established under subsection (a)
with other programs of the Administration that may provide support to
microenterprises.</text>
</subsection><subsection id="H28A26C19237F419981F10DE67AC3E95A"><enum>(e)</enum><header>Definition of
microenterprise</header><text>In this section, the term
<quote>microenterprise</quote> means a business with not more than 6 employees
and begun with an initial investment of not more than
$40,000.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>IX</enum><header>Military
entrepreneurs program</header>
<section id="H50745261F1784AD5ABED749037E3462F"><enum>901.</enum><header>Military
entrepreneurs program</header><text display-inline="no-display-inline">The
Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended by
inserting after section 45, as added by section 301(b) of this Act, the
following:</text>

<section id="H9528991A59CB49179F07DE8DFA2CBC3B"><enum>47.</enum><header>Military
entrepreneurs program</header>
<subsection id="HEE0BF4FBAE4E4BFAB2E73C4C52BB96D9"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish and carry
out a program to provide business counseling and entrepreneurial development
assistance to members of the Armed Forces to facilitate the development of
small business concerns.</text>
</subsection><subsection id="HBBD3759B3A52498891E6EA712986F27F"><enum>(b)</enum><header>Liaison</header><text>In
carrying out the program described in subsection (a), the Administrator shall
establish a liaison to facilitate outreach to members of the Armed Forces with
respect to business counseling and entrepreneurial development
assistance.</text>
</subsection><subsection id="HB8710A5A904540CB95B4C26FBA2E7E6F"><enum>(c)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to the
Administrator to carry out this section $1,000,000 for fiscal years 2010 and
2011.</text>

</section><enum>X</enum><header>Rural
Entrepreneurship Advisory Council</header>
<section id="HBB0FDDDCC85D4043A09C2B7A1F373CA0"><enum>1001.</enum><header>Rural
Entrepreneurship Advisory Council<editorial></editorial></header><text display-inline="no-display-inline">The Small Business Act (15 U.S.C. 631 et.
seq.) is amended by inserting after section 45, as added by section 301(b) of
this Act, the following:</text>

<section id="H920404C4EFF043DF910D54327910F58F"><enum>48.</enum><header>Rural
Entrepreneurship Advisory Council</header>
<subsection id="H1F8C2DDE41F4486FAA43D0A176C3472F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a rural
entrepreneurship advisory council (hereinafter referred to in this section as
the <quote>council</quote>).</text>
</subsection><subsection id="H9611DEE9B7AB429E9C91C353000FBF6B"><enum>(b)</enum><header>Composition</header><text display-inline="yes-display-inline">The Administrator shall ensure that the
council is composed of appropriate officials from the Administration, the rural
development programs of the Department of Agriculture, and the Department of
Commerce and of representatives, who volunteer for the council, from the
academic, small business, agriculture, and high-tech communities.</text>
</subsection><subsection id="HB236FD798DE54211AB7B75B4896EE33D"><enum>(c)</enum><header>Functions</header>
<paragraph id="HEBF6A8DF838045C3A04FA53400FFD5AB"><enum>(1)</enum><header>Initial
report</header><text display-inline="yes-display-inline">Not later than 90 days
after the date of the enactment of this section, the council shall submit to
the Administrator and to Congress a report on the following:</text>
<subparagraph id="H2918B01947224FEB998D19B2E69B31EE"><enum>(A)</enum><text>Entrepreneurship
in rural communities compared to urban communities.</text>
</subparagraph><subparagraph id="H17FB80538D1044F0ADF44CBEC3DA385E"><enum>(B)</enum><text>Potential barriers
to entrepreneurship for individuals in rural communities.</text>
</subparagraph><subparagraph id="H0C06FF3ECD3F4D24A6AB346702C8129B"><enum>(C)</enum><text>Effective Federal
policies that are expanding entrepreneurship in rural communities.</text>
</subparagraph><subparagraph id="H7B246EE18A954AF1A37CE253A83E4A1A"><enum>(D)</enum><text>Recommendations
for Federal policies to foster entrepreneurship in rural communities and to
ensure that rural entrepreneurs have equal access to technical assistance,
entrepreneurial opportunities, and educational outreach.</text>
</subparagraph></paragraph><paragraph id="H607C934ED40E4A74B2EB5E423C13BB1E"><enum>(2)</enum><header>Advice</header><text>The
council shall provide ongoing advice to the Administrator with respect to rural
entrepreneurship and make recommendations to foster rural entrepreneurs,
including through the effective use of broadband
technology.</text>
</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>XI</enum><header>Assistance
related to carbon emission tax</header>
<section id="HD59E1860DC0340A685DB37A2F5724049"><enum>1101.</enum><header>Assistance
related to carbon emission tax</header><text display-inline="no-display-inline">Section 21(c)(3) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C.
648(c)(3)</external-xref>) is amended—</text>
<paragraph id="HBE397231C3734222B992E1ED27603BF2"><enum>(1)</enum><text>in subparagraph
(S), by striking the final “and”;</text>
</paragraph><paragraph id="HA49E95D3D20A43B5B62267F4D5D503CB"><enum>(2)</enum><text>in subparagraph
(T), by striking the period and inserting <quote>; and</quote>; and</text>
</paragraph><paragraph id="HE8697E6FD08C4D70BBFAF563E7D0F9D5"><enum>(3)</enum><text>by adding at the
end the following new subparagraph:</text>

<subparagraph id="H8622770FF51C4EB6BB24F6207B570292"><enum>(U)</enum><text display-inline="yes-display-inline">providing information and technical
assistance to any small business owner that faces an increase in costs as a
result of the enactment of any program to impose a tax on carbon emissions,
either directly or through the operation of a cap and trade system on such
emission
limits.</text>
