		  enhance consumer disclosures.</official-title>

		<section id="HD0D8DC68DC6F4ACEA7C5403686EA4A47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protection of Consumer Credit and
			 Consumer Choice Act of 2009</short-title></quote>.</text>
		</section><section id="idA0CDD427EEAC4741A8C5611CC43FD090"><enum>2.</enum><header>Unfair acts or
			 practices rule revision</header><text display-inline="no-display-inline">The
			 Board of Governors of the Federal Reserve, the Office of Thrift Supervision,
			 and the National Credit Union Administration shall not take any action to
			 implement any rule relating to credit cards published in the Federal Register
			 on January 29, 2009, or any substantially similar rule, on the basis of a
			 determination by such agencies that practices relating to credit card practices
			 constitute an unfair act or practice in or affecting commerce.</text>
		</section><section id="idB7292B0F36D84C7FAE33262AD46BD631"><enum>3.</enum><header>Improving
			 consumer disclosures</header><text display-inline="no-display-inline">Section
			 127 of the Truth in Lending Act (15 U.S.C. 1637) is amended by adding at the
			 end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="id8BC04ACFF9024BCEA59406A8C8BD4387" style="OLC">
				<subsection id="id5F39CB78B5A6418A8D86A01D97124E90"><enum>(i)</enum><header>Advance notice
				of rate increases for certain practices</header>
					<paragraph id="id6C38EB36DAF846C1A119135B034AFAE7"><enum>(1)</enum><header>In
				general</header><text>With respect to credit card accounts under an open end
				consumer credit plan, the Board shall issue regulations under subsections (a),
				(b), and (c), as the Board may find appropriate and necessary, to require a
				card issuer to provide clear and conspicuous disclosures pertaining to:</text>
						<subparagraph id="idCE1D817ECA094FDD9D7A5A855660D21B"><enum>(A)</enum><text>the time provided
				to make timely payments;</text>
						</subparagraph><subparagraph id="idA7264A07EBF2421AA819D457B890826A"><enum>(B)</enum><text>allocation of
				payments when different annual percentage rates apply to different balances of
				such accounts;</text>
						</subparagraph><subparagraph id="idB414262FDE5B404693711EDA75C618CE"><enum>(C)</enum><text>increases in
				annual percentage rates;</text>
						</subparagraph><subparagraph id="idBACF2BA21F97498FB99265EC84A5C3E4"><enum>(D)</enum><text>two-cycle average
				daily balance method of balance calculation; and</text>
						</subparagraph><subparagraph id="idA954530814FB46EBA21160687AE78CC1"><enum>(E)</enum><text>fees that may be
				assessed at the opening of such accounts.</text>
						</subparagraph></paragraph><paragraph id="idBF0D9175A70B43B199DAA586A5978958"><enum>(2)</enum><header>Advance notice
				for certain changes</header>
						<subparagraph id="idA40A3B81196940A2A3D72AB6C2E881F4"><enum>(A)</enum><header>In
				general</header><text>A change to any term described in paragraph (1), or, in
				the case of paragraph (1)(C), an increase of an annual percentage rate, with
				respect to a credit card account under an open end consumer credit plan may not
				take effect unless the card issuer provides a written notice to the consumer no
				less than 75 days before such change is scheduled to take effect which fully
				describes the change in a clear and conspicuous manner.</text>
						</subparagraph><subparagraph id="id2AAB7B55245D40F9A413CE79803ACE49"><enum>(B)</enum><header>Exception</header><text>Any
				disclosure under subparagraph (A) shall not be required with respect to an
				increase in an annual percentage rate if:</text>
							<clause id="id02FC8F99E8A2408A98DE94DD32213C99"><enum>(i)</enum><text>the increase is
				due to the operation of an index outside the control of the card
				issuers;</text>
							</clause><clause id="idCF15798A1BB348BFBA079D2F371476B2"><enum>(ii)</enum><text>the increase is
				due to an expiration of a promotional rate; and</text>
							</clause><clause id="id6BCA1045207D4F5C802305E540AF8B20"><enum>(iii)</enum><text>the rate was
				previously disclosed pursuant to subsection
				(a).</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF7D98D85F51741699C1580BBFC94EC5F"><enum>4.</enum><header>Effective
			 date</header>
			<subsection id="id254AE332CA0F4CA0A9BEFA0A7F8AB3AF"><enum>(a)</enum><text>Section 2 of this
			 Act is effective on the date of enactment of this Act.</text>
			</subsection><subsection id="id16865466AF8248779B8E87AD6100E85F"><enum>(b)</enum><text>The Board shall
			 issue the regulations under section 3 within 12 months of the date of enactment
			 of this Act.</text>
			</subsection><subsection id="id0565D9059CF04C2EAF75A969344EB4BA"><enum>(c)</enum><text>The regulations
			 issued by the Board under section 3 shall be effective 12 months after they are
			 published in final form.</text>
