		<official-title>To amend title XVIII of the Social Security Act with
		  respect to treatment of didactic and scholarly activities and training in
		  outpatient settings for purposes of payment for graduate medical education
		  under the Medicare Program.</official-title>

		<section id="H44420148B57A44D79737651B70ECBB28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Graduate Medical Education Advancement Act of
			 2009</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HF119350FDB864ABB950448C7630770F8" section-type="subsequent-section"><enum>2.</enum><header>Rules for counting
			 resident time for didactic and scholarly activities and other
			 activities</header>
			<subsection id="HB92E9296130A4FA182671EF64B1B59D3"><enum>(a)</enum><header>Direct
			 GME</header><text>Section 1886(h) of the Social Security Act (42 U.S.C.
			 1395ww(h)) is amended—</text>
				<paragraph id="HBBE54E57358946FAB4AC3812AFFE381"><enum>(1)</enum><text>in
			 paragraph (4)(E)—</text>
					<subparagraph id="H53D0CE306EFD42E2961B6ECCD3A12930"><enum>(A)</enum><text>by designating the
			 first sentence as a clause (i) with the heading <quote><header-in-text level="clause" style="OLC">In general</header-in-text></quote> and appropriate
			 indentation and by striking <quote>Such rules</quote> and inserting
			 <quote>Subject to clause (ii), such rules</quote>; and</text>
					</subparagraph><subparagraph id="H68BDFE0DCA534D2C8FCC20F444003989"><enum>(B)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H3480E92D19A44D3CB32687C6F89E80A" style="OLC">
							<clause id="H89FF05D82BE44303B031C3151F2FD4E"><enum>(ii)</enum><header>Treatment of
				certain nonhospital and didactic activities</header><text display-inline="yes-display-inline">Such rules shall provide that all time
				spent by an intern or resident in an approved medical residency training
				program in a nonhospital setting that is primarily engaged in furnishing
				patient care (as defined in paragraph (5)(K)) in non-patient care activities,
				such as didactic conferences and seminars, but not including research not
				associated with the treatment or diagnosis of a particular patient, as such
				time and activities are defined by the Secretary, shall be counted toward the
				determination of full-time
				equivalency.</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB1408DE7BB9848B596A53EC1FBCDE020"><enum>(2)</enum><text>in paragraph (4),
			 by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H7F10C4ECC9684251AF006208AAE7F4A8" style="OLC">
						<subparagraph id="H0145C981A59842CB92AFA288BAEE6D7E"><enum>(I)</enum><header>Treatment of
				certain leave time</header><text display-inline="yes-display-inline">In
				determining the hospital’s number of full-time equivalent residents for
				purposes of this subsection, all the time that is spent by an intern or
				resident in an approved medical residency training program on vacation, sick
				leave, or other approved leave, as such time is defined by the Secretary, and
				that does not prolong the total time the resident is participating in the
				approved program beyond the normal duration of the program shall be counted
				toward the determination of full-time
				equivalency.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H209646BB42EF429EAA454079846B2612"><enum>(3)</enum><text>in paragraph (5),
			 by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HA098A6D3F1C544779C00FD9CE22877B7" style="OLC">
						<subparagraph id="HE75F941EE0F84EBAA330BE143586213E"><enum>(K)</enum><header>Nonhospital
				setting that is primarily engaged in furnishing patient care</header><text display-inline="yes-display-inline">The term <term>nonhospital setting that is
				primarily engaged in furnishing patient care</term> means a nonhospital setting
				in which the primary activity is the care and treatment of patients, as defined
				by the
				Secretary.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8C44DD49C0E84BA8AA9133489BE60023"><enum>(b)</enum><header>IME
			 determinations</header><text display-inline="yes-display-inline">Section
			 1886(d)(5)(B) of such Act (42 U.S.C. 1395ww(d)(5)(B)) is amended by adding at
			 the end the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="H47F02F504BB7496AA84F99EB57C2357" style="OLC">
					<clause id="HA927EE3A53AF469F97783B01C2D276B1" indent="up2"><enum>(x)</enum><subclause commented="no" display-inline="yes-display-inline" id="HC48CC8BE1A4F4F1099F418AE606DF600"><enum>(I)</enum><text display-inline="yes-display-inline">The provisions of subparagraph (I) of
				subsection (h)(4) shall apply under this subparagraph in the same manner as
				they apply under such subsection.</text>
						</subclause><subclause id="H879483276A0A4FEEA038A45526E7D25E" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">In determining the hospital’s number of
				full-time equivalent residents for purposes of this subparagraph, all the time
				spent by an intern or resident in an approved medical residency training
				program in non-patient care activities, such as didactic conferences and
				seminars, as such time and activities are defined by the Secretary, that occurs
				in the hospital shall be counted toward the determination of full-time
				equivalency if the hospital—</text>
							<item id="H516AAFFBB6BA448CBD5BAA4CA6B4A8AC"><enum>(aa)</enum><text>is recognized as a subsection (d)
				hospital;</text>
							</item><item id="H121E8EF0B432479E87776D4FA0099EE2"><enum>(bb)</enum><text display-inline="yes-display-inline">is recognized as a subsection (d) Puerto
				Rico hospital;</text>
							</item><item id="HED6DC3E2E74E4FD7886F89D6A0004897"><enum>(cc)</enum><text>is reimbursed under a
				reimbursement system authorized under section 1814(b)(3); or</text>
							</item><item id="H8B7219515A8B4B199ECA12745D6CC3EE"><enum>(dd)</enum><text>is a provider-based hospital
				outpatient department.</text>
							</item></subclause><subclause id="H654D162733924954998170D2DCECE145" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">In determining the hospital’s number of
				full-time equivalent residents for purposes of this subparagraph, all the time
				spent by an intern or resident in an approved medical residency training
				program in research activities that are not associated with the treatment or
				diagnosis of a particular patient, as such time and activities are defined by
				the Secretary, shall not be counted toward the determination of full-time
				equivalency.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2012D7B39C0744B2B663CC2BEF3082A1"><enum>(c)</enum><header>Effective dates;
			 application</header>
				<paragraph id="H8158AF7571FA48FC8DCD07FD83363908"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided, the Secretary of Health and Human Services shall implement the
			 amendments made by this section in a manner so as to apply to cost reporting
			 periods beginning on or after January 1, 1983.</text>
				</paragraph><paragraph id="HD81A59BD38FE4503AE655E780200E451"><enum>(2)</enum><header>Direct
			 GME</header><text>Section 1886(h)(4)(E)(ii) of the Social Security Act, as
			 added by subsection (a)(1)(B), shall apply to cost reporting periods beginning
			 on or after July 1, 2009.</text>
				</paragraph><paragraph id="H3E73460914AF459B8CA00333BB0607B"><enum>(3)</enum><header>IME</header><text display-inline="yes-display-inline">Section 1886(d)(5)(B)(x)(III) of the Social
			 Security Act, as added by subsection (b), shall apply to cost reporting periods
			 beginning on or after October 1, 2001. Such section, as so added, shall not
			 give rise to any inference on how the law in effect prior to such date should
			 be interpreted.</text>
				</paragraph><paragraph id="HFB2BC11E78FB494C8D69E086133A3B8"><enum>(4)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall
			 not be applied in a manner that requires reopening of any settled hospital cost
			 reports as to which there is not a jurisdictionally proper appeal pending as of
			 the date of the enactment of this Act on the issue of payment for indirect
			 costs of medical education under section 1886(d)(5)(B) of the Social Security
			 Act or for direct graduate medical education costs under section 1886(h) of
			 such Act.</text>
				</paragraph></subsection></section><section id="HBB51DA96A0464147BF62D0E72800AB36"><enum>3.</enum><header>Rules for
			 counting resident time in outpatient settings</header>
			<subsection id="H9B1EBEE5058247AAAB75F005DD53AF01"><enum>(a)</enum><header>Direct
			 GME</header><text>Section 1886(h)(4)(E) of the Social Security Act (42 U.S.C.
			 1395ww(h)(4)(E)) is amended—</text>
				<paragraph id="HE54F8F34D4F6455597DBB946B1CBF7A2"><enum>(1)</enum><text>by striking
			 <quote>under an approved medical residency program</quote>; and</text>
				</paragraph><paragraph id="HC555D16EBC864D9CB1FDD3F5AA675D8D"><enum>(2)</enum><text>by striking
			 <quote>if the hospital incurs all, or substantially all, of the costs for the
			 training program in that setting</quote> and inserting <quote>if the hospital
			 or hospitals continue to incur the costs of the residents’ stipends and fringe
			 benefits during the time the residents spend in that setting.</quote></text>
				</paragraph></subsection><subsection commented="no" id="HE8D08DF2A9A9411384CAD4B741433977"><enum>(b)</enum><header>IME
			 determinations</header><text display-inline="yes-display-inline">Section
			 1886(d)(5)(B)(iv) of such Act (42 U.S.C. 1395ww(d)(5)(B)(iv)) is
			 amended—</text>
				<paragraph commented="no" id="H67DD14AA70AD4AEC84B1ECF149FF947"><enum>(1)</enum><text>by striking
			 <quote>under an approved medical residency training program</quote>; and</text>
				</paragraph><paragraph commented="no" id="HE3C409323CB44947B718733500EDED56"><enum>(2)</enum><text>by striking
			 <quote>if the hospital incurs all, or substantially all, of the costs for the
			 training program in that setting</quote> and inserting <quote>if the hospital
			 or hospitals continue to incur the costs of the residents’ stipends and fringe
			 benefits during the time the residents spend in that setting.</quote></text>
				</paragraph></subsection><subsection id="H18C56E134E824F5AAE703F0005BAF947"><enum>(c)</enum><header>Effective dates;
			 application</header>
				<paragraph id="HDD6C06A10F8D44829583A221DF85F0E7"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided, the Secretary of Health and
			 Human Services shall implement the amendments made by this section in a manner
			 so as to apply to cost reporting periods beginning on or after July 1,
			 2009.</text>
				</paragraph><paragraph id="H8D86E92779C646C4B9309C67F247A0AE"><enum>(2)</enum><header>Application</header><text>The
			 amendments made by this section shall not be applied in a manner that requires
			 reopening of any settled hospital cost reports as to which there is not a
			 jurisdictionally proper appeal pending as of the date of the enactment of this
			 Act on the issue of payment for indirect costs of medical education under
			 section 1886(d)(5)(B) of the Social Security Act or for direct graduate medical
			 education costs under section 1886(h) of such Act.</text>
