		<official-title>To establish a temporary program in the Small Business
		  Administration to assist small business concerns by decreasing interest
		  payments for certain loans, and for other purposes.</official-title>

		<section id="H31F37B7E659C4103BDCCB1B982675AF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Opportunity Act of
			 2009</short-title></quote>.</text>
		</section><section id="HE4B2D46CB57546C983A166C9FB002752"><enum>2.</enum><header>Interest payment
			 assistance for small business concerns with eligible loans</header>
			<subsection id="HB1FBBDCF30D64B36957FD8606938F2BD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">To the extent of the
			 funding made available under subsection (g), the Administrator of the Small
			 Business Administration shall establish and implement a program under which the
			 Administrator shall make, for each eligible loan of a small business
			 concern—</text>
				<paragraph id="HEA2C732B2CA14A33BFA3704FC2D97E1A"><enum>(1)</enum><text>100 percent of the
			 payment of interest due each billing cycle with respect to such loan, during
			 the period beginning on the effective date of this Act and ending at the
			 conclusion of the first full fiscal year following such date;</text>
				</paragraph><paragraph id="HC3E8101766B4408CA4DE5D581FC5D0B5"><enum>(2)</enum><text display-inline="yes-display-inline">75 percent of the payment of interest due
			 each billing cycle with respect to such loan, during the second full fiscal
			 year following such date; and</text>
				</paragraph><paragraph id="HFCC7B8ADD6F344A0BDD56D597DCF77D3"><enum>(3)</enum><text display-inline="yes-display-inline">50 percent of the payment of interest due
			 each billing cycle with respect to such loan, during the third full fiscal year
			 following such date.</text>
				</paragraph></subsection><subsection id="H97B1A90357574FE9BBC6A46AA77917EB"><enum>(b)</enum><header>Termination of
			 program</header><text>The authority of the Administrator to make payments under
			 subsection (a) terminates at the conclusion of the third full fiscal year
			 following the effective date of this Act.</text>
			</subsection><subsection id="H77DB50C019FC445AA5C2BACC5CB0C0F6"><enum>(c)</enum><header>Payments made to
			 lender</header><text>The Administrator shall make the payments under subsection
			 (a) directly to the financial institution to which such payments are
			 due.</text>
			</subsection><subsection id="H84E31399705C41B0953DE049FC1A9ED5"><enum>(d)</enum><header>No forced
			 reimbursement</header><text>The Administrator may not require a small business
			 concern to reimburse a payment appropriately made for such concern under
			 subsection (a).</text>
			</subsection><subsection id="H9575660F65E7435D8C179EF36666EB1B"><enum>(e)</enum><header>Interest rates
			 during program</header><text display-inline="yes-display-inline">If the
			 interest rate for an eligible loan is negotiated subject to a maximum allowable
			 rate imposed by the Small Business Administration, the financial institution
			 making such loan may treat the interest rate of such loan as the maximum
			 allowable rate during the period that the Administrator makes payments under
			 subsection (a) with respect to such loan. On the date that the Administrator
			 makes the final payment under subsection (a) with respect to such loan, the
			 interest rate of such loan shall return to the rate originally
			 negotiated.</text>
			</subsection><subsection id="HA333B155063E447AA3BA6D192597F835"><enum>(f)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H6A10C4BDEE8E4BF4BDCB156A31568516"><enum>(1)</enum><header>Eligible
			 loan</header><text display-inline="yes-display-inline">The term <term>eligible
			 loan</term> means a loan guaranteed by the Small Business Administration and
			 entered into after the effective date of this Act.</text>
				</paragraph><paragraph id="HD84C17A453B5483C8FB5F4D5B10FA662"><enum>(2)</enum><header>Small business
			 concern</header><text>The term <term>small business concern</term> has the
			 meaning given such term in section 3 of the Small Business Act (15 U.S.C.
			 632).</text>
				</paragraph></subsection><subsection id="H0782A211252C497EB55F235870B8C955"><enum>(g)</enum><header>Funding</header><text>Of
			 the amounts made available under title I of the Emergency Economic
			 Stabilization Act of 2008 (Public Law 110–343; 12 U.S.C. 5201 et seq.), the
			 Secretary of the Treasury shall make available to the Administrator of the
			 Small Business Administration the amount requested by the Administrator to
			 carry out this section, but not to exceed $3,375,000,000, and such amount shall
			 be treated as having been made available for activities authorized by such
			 Act.</text>
			</subsection><subsection id="H9996515DE39E4AB9AF98B3CE84B2B5B8"><enum>(h)</enum><header>Effective
			 date</header><text>This Act takes effect on the date that is 60 days after the
			 date of the enactment of this Act.</text>
