<official-title>To amend the Safe and Drug-Free Schools and Communities Act to include bullying and harassment prevention programs.</official-title>

<section display-inline="no-display-inline" id="H0AF7C003A6374D7C87A2D75C1CD732B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Schools Improvement Act of 2009</short-title></quote>.</text></section> 
<section id="H5D5C8C2058C2437E897229E5DBC29CBD"><enum>2.</enum><header>Bullying and harassment prevention policies, programs, and statistics</header> 
<subsection id="H05EF95A82D3643489BD2AC4BD0A2BD8F"><enum>(a)</enum><header>State Reporting Requirements</header><text>Section 4112(c)(3)(B)(iv) of the Safe and Drug-Free Schools and Communities Act (20 U.S.C. 7112(c)(3)(B)(iv)) is amended by inserting <quote>, including bullying and harassment,</quote> after <quote>violence</quote>.</text></subsection> 
<subsection id="HE5CF6E4DEC4248BA932994D979905FB0"><enum>(b)</enum><header>State Application</header><text>Section 4113(a) of such Act (20 U.S.C. 7113(a)) is amended—</text> 
<paragraph id="H9F368497D5504ACEBAFD082C613C4EC"><enum>(1)</enum><text>in paragraph (9)—</text> 
<subparagraph id="H1DD7FE30E66B46809DB1B487F27189F"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text></subparagraph> 
<subparagraph id="HE4F92CF15F6541F7A31B78A73212869E"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H89ACE6FCDA7D45A2BE25005D869EB747" style="OLC"> 
<subparagraph id="H8DD90ACC1966434CB327BCE89CCAFDAE"><enum>(E)</enum><text>the incidence and prevalence of reported incidents of bullying and harassment; and</text></subparagraph> 
<subparagraph id="H296BC2DD13E1470D8B738CF37E4F34A7"><enum>(F)</enum><text>the perception of students regarding their school environment, including with respect to the prevalence and seriousness of incidents of bullying and harassment and the responsiveness of the school to those incidents;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H04D92650AEEB4FF2B413D8142599F3CB"><enum>(2)</enum><text>in paragraph (18), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H1AA39E3C8F3A407E89756FE133C84179"><enum>(3)</enum><text>in paragraph (19), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HDAB41C5A7398432A9BBB332BCF511811"><enum>(4)</enum><text>by adding at the end the following:</text>

<paragraph id="H3B086127B7664BEA9F3B34DC57A845D3"><enum>(20)</enum><text>provides an assurance that the State educational agency will provide assistance to districts and schools in their efforts to prevent and appropriately respond to incidents of bullying and harassment and describes how the agency will meet this requirement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H57DFBD856D774D5FB4C83300E5D373F4"><enum>(c)</enum><header>Local Educational Agency Program Application</header><text>Section 4114(d) of such Act (20 U.S.C. 7114(d)) is amended—</text> 
<paragraph id="H79639D3E10224A4488352F5187EFCE50"><enum>(1)</enum><text>in paragraph (2)(B)(i)—</text> 
<subparagraph id="HD3F233F7B4084E0985FB23B236000303"><enum>(A)</enum><text>in subclause (I), by striking <quote>and</quote> at the end; and</text></subparagraph> 
<subparagraph id="H3098CD8509834014AA172FD8F55055DB"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3AC94A10D8EA41018CE262AAE8292135" style="OLC"> 
<subclause id="H9945447B75744EBB9BF6DE00E0B500E4"><enum>(III)</enum><text>performance indicators for bullying and harassment prevention programs and activities; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3B20EF0509C3465CA9119F8C0000AC6"><enum>(2)</enum><text>in paragraph (7)—</text> 
<subparagraph id="HE76632C8B6B24E278D79F3646F7D16E1"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>, including bullying and harassment</quote> after <quote>disorderly conduct</quote>;</text></subparagraph> 
<subparagraph id="HA22F3D71491E4764AE3B8290D530C07E"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end; and</text></subparagraph> 
<subparagraph id="HD343F0F85BF74F61AFE42D168DFB3B58"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDAA676802BB144B8B58746EF0196E9CB" style="OLC"> 
<subparagraph id="H5F689964CF634BD7A399FD0890DDA461"><enum>(F)</enum><text>annual notice to parents and students describing the full range of prohibited conduct contained in the discipline policies described in subparagraph (A); and</text></subparagraph> 
<subparagraph id="H5B375613E0384F62949DF740A1958917"><enum>(G)</enum><text>grievance procedures for students or parents that seek to register complaints regarding the prohibited conduct contained in the discipline policies described in subparagraph (A), including—</text> 
<clause id="HDEE8C3AC97D14A8F9C003F762C665174"><enum>(i)</enum><text>the name of the school district officials who are designated as responsible for receiving such complaints; and</text></clause> 
<clause id="H9AC7FD8A9490468AA7547EC5DA857297"><enum>(ii)</enum><text>timelines that the school district will follow in the resolution of such complaints;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H1077639E7A9D4BF1AD33F2B91847FFA3"><enum>(d)</enum><header>Authorized Activities</header><text>Section 4115(b)(2) of such Act (20 U.S.C. 7115(b)(2)) is amended—</text> 
<paragraph id="H54CE81EB52AA406285FC33E5B462BB3C"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="H46631A99E90F41B782BAED133693B822"><enum>(A)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HC8C472D384974056837DBDC623DD24E2"><enum>(B)</enum><text>in clause (vii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H4D250FDC4CB643B2A7EE099320B4DC7F"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H483C7E0B7FD341C5AB4F718D30FF88B0"><enum>(2)</enum><text>in subparagraph (E), by adding at the end the following:</text>

<clause id="H1B3D6B7967DA42DABB2F99C11579399E"><enum>(xxiii)</enum><text>Programs that address the causes of bullying and harassment and that train teachers, administrators, pupil services personnel, and other school personnel regarding strategies to prevent bullying and harassment and to effectively intervene when such incidents occur.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD25B0E648BB44069AF99992CB4032079"><enum>(e)</enum><header>Reporting</header><text>Section 4116(a)(2)(B) of such Act (20 U.S.C. 7116(a)(2)(B)) is amended by inserting <quote>, including bullying and harassment,</quote> after <quote>drug use and violence</quote>.</text></subsection> 
<subsection id="H6C9B677A2DC9421BA53F46527CDCDF5"><enum>(f)</enum><header>Impact Evaluation</header><text>Section 4122 of such Act (20 U.S.C. 7132) is amended—</text> 
<paragraph id="H5A98E544735C4DA8AB802148C5A347CA"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>and school violence</quote> and inserting <quote>school violence, including bullying and harassment,</quote>; and</text></paragraph> 
<paragraph id="H4BA6C0DDED0E47B784907780394B74EE"><enum>(2)</enum><text>in the first sentence of subsection (b), by inserting <quote>, including bullying and harassment,</quote> after <quote>drug use and violence</quote>.</text></paragraph></subsection> 
<subsection id="H616B1D9E6D5B4B4BBFF0FD6D61B0058B"><enum>(g)</enum><header>Definitions</header> 
<paragraph id="HB741E122331041ADBB5BB82DD282DDA"><enum>(1)</enum><header>Drug and Violence Prevention</header><text>Paragraph (3)(B) of section 4151 of such Act (20 U.S.C. 7151) is amended by inserting <quote>, bullying, and other harassment</quote> after <quote>sexual harassment and abuse</quote>.</text></paragraph> 
<paragraph id="HCCE9850ED0B24952B6016B786B002843"><enum>(2)</enum><header>Protective Factor, Buffer, or Asset</header><text>Paragraph (6) of such section is amended by inserting <quote>, including bullying and harassment</quote> after <quote>violent behavior</quote>.</text></paragraph> 
<paragraph id="H37232FD994224A98AF97ADB628D0671B"><enum>(3)</enum><header>Risk Factor</header><text>Paragraph (7) of such section is amended by inserting <quote>, including bullying and harassment</quote> after <quote>violent behavior</quote>.</text></paragraph> 
<paragraph id="HF8AB7955D7D54EC98688C8F4F59423F"><enum>(4)</enum><header>Bullying, Harassment, and Violence</header><text>Such section is further amended by adding at the end the following:</text>

<paragraph id="H8BEB92A7CDC849CB00CD0094E3902105"><enum>(12)</enum><header>Bullying</header><text>The term <term>bullying</term> means conduct that—</text> 
<subparagraph id="H8E7CD4F4E79B4FFA8C073B8FCDF7700"><enum>(A)</enum><text>adversely affects the ability of one or more students to participate in or benefit from the school’s educational programs or activities by placing the student (or students) in reasonable fear of physical harm; and</text></subparagraph> 
<subparagraph id="H40EEB5EDF84045038BBBB776359C31F2"><enum>(B)</enum><text>includes conduct that is based on—</text> 
<clause id="HC560E3DE14F3410DB6152BBB2FF3478D"><enum>(i)</enum><text>a student’s actual or perceived—</text> 
<subclause id="H0BACEDE1E0744AADAAD16D73140D83C"><enum>(I)</enum><text>race;</text></subclause> 
<subclause id="HD17516CA86264FAE92A84F37D7D6C1FA"><enum>(II)</enum><text>color;</text></subclause> 
<subclause id="H03E9DA11DCA444EA831D75DDF08B002E"><enum>(III)</enum><text>national origin;</text></subclause> 
<subclause id="H1A05AD83B1814D0691AC269640110099"><enum>(IV)</enum><text>sex;</text></subclause> 
<subclause id="HDAF987A185674A6E8EA202D2B1F68A"><enum>(V)</enum><text>disability;</text></subclause> 
<subclause id="HD2A1302BB90C4C51AB8878BF31CB4399"><enum>(VI)</enum><text display-inline="yes-display-inline">sexual orientation;</text></subclause> 
<subclause id="HB6441CF41D204BBEB77E866F54C7EA76"><enum>(VII)</enum><text display-inline="yes-display-inline">gender identity; or</text></subclause> 
<subclause id="H9A60B91140E94737A1B055A9BB88453E"><enum>(VIII)</enum><text display-inline="yes-display-inline">religion;</text></subclause></clause> 
<clause id="H094DBA55605045E9B801BA70E5F48E1"><enum>(ii)</enum><text>any other distinguishing characteristics that may be defined by a State or local educational agency; or</text></clause>
<clause id="HFF34E407CCF94890AF7013FC061CA3B1"><enum>(iii)</enum><text>association with a person or group with one or more of the actual or perceived characteristics listed in clause (i) or (ii).</text></clause> </subparagraph></paragraph> 
<paragraph id="H500E5723A9F940E78200A787E64B79C7"><enum>(13)</enum><header>Harassment</header><text>The term <term>harassment</term> means conduct that—</text> 
<subparagraph id="HA93CC4AFD065410492E6127EB36243DB"><enum>(A)</enum><text>adversely affects the ability of one or more students to participate in or benefit from the school’s educational programs or activities because the conduct, as reasonably perceived by the student (or students), is so severe, persistent, or pervasive; and</text></subparagraph> 
<subparagraph id="HA97CECFEA2FE4F219B4F58F51DB3308C" display-inline="no-display-inline"><enum>(B)</enum><text>includes conduct that is based on—</text> 
<clause id="H4685ECE3695D414FB08A6FA3306FC0AD"><enum>(i)</enum><text>a student’s actual or perceived—</text> 
<subclause id="H3623981B6CB844F3A820E1E4CAA98D54"><enum>(I)</enum><text>race;</text></subclause>

<subsection id="H34D5F2A01AB148A10039CABC1C3C06EC"><enum>(h)</enum><header>Effect on Other Laws</header> 
<paragraph id="H52BA9FD13D5C426F81E664BFE76CC3B"><enum>(1)</enum><header>Amendment</header><text>The Safe and Drug-Free Schools and Communities Act (20 U.S.C. 7101 et seq.) is amended by adding at the end the following:</text>

<section id="H05AEB69051AC4B1B90102035F18E598F"><enum>4156.</enum><header>Effect on Other Laws</header> 
<subsection id="H34930D5E4924498BB781C68BDC018291"><enum>(a)</enum><header>Federal and State Nondiscrimination Laws</header><text>Nothing in this part shall be construed to invalidate or limit rights, remedies, procedures, or legal standards available to victims of discrimination under any other Federal law or law of a State or political subdivision of a State, including title VI of the <act-name>Civil Rights Act of 1964</act-name> (42 U.S.C. 2000d et seq.), title IX of the <act-name>Education Amendments of 1972</act-name> (20 U.S.C. 1681 et seq.), section 504 of the <act-name>Rehabilitation Act of 1973</act-name> (29 U.S.C. 794), or the <act-name>Americans with Disabilities Act of 1990</act-name> (42 U.S.C. 12101 et seq.). The obligations imposed by this part are in addition to those imposed by title IX of the <act-name>Education Amendments of 1972</act-name> (20 U.S.C. 1681 et seq.), title VI of the <act-name>Civil Rights Act of 1964</act-name> (42 U.S.C. 2000d et seq.), and the <act-name>Americans with Disabilities Act of 1990</act-name> (42 U.S.C. 12101 et seq.).</text></subsection> 
<subsection id="HFC594E697B644E30BB385CE27DB76CEC"><enum>(b)</enum><header>Free Speech and Expression Laws</header><text>Nothing in this part shall be construed to alter legal standards regarding, or affect the rights available to individuals under, other Federal laws that establish protections for freedom of speech and expression.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD0A4169C2B8A4D55A60700F121189B1E"><enum>(2)</enum><header>Clerical Amendment</header><text>The table of contents of the <act-name>Elementary and Secondary Education Act of 1965</act-name> (20 U.S.C. 6301 et seq.) is amended by adding after the item relating to section 4155 the following:</text>
