		<official-title>To promote and enhance the operation of local building
		  code enforcement administration across the country by establishing a
		  competitive Federal matching grant program.</official-title>

		<section id="HCEF0F474804F4A0981B80EA738889FCB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community Building Code Administration
			 Grant Act of 2009</short-title></quote>.</text>
		</section><section id="H65A60D43AA1348749D4EB8583C46F188"><enum>2.</enum><header>Grant program
			 authorized</header>
			<subsection id="H9B2DA5F357B74A8CB2A39D5124EAC215"><enum>(a)</enum><header>Grant
			 authorization</header><text>The Secretary of Housing and Urban Development
			 shall to the extent amounts are made available for grants under this Act
			 provide grants to local building code enforcement departments.</text>
			</subsection><subsection id="H4AD1F70B16264F3B98A52812E7E54C9A"><enum>(b)</enum><header>Competitive
			 awards</header><text>The Secretary shall award grants under subsection (a) on a
			 competitive basis pursuant to the criteria set forth in section 6, but also
			 taking into consideration the following:</text>
				<paragraph id="HAFB95871E7C845068435D7E339D0DAA4"><enum>(1)</enum><text>The financial need
			 of each building code enforcement department.</text>
				</paragraph><paragraph id="HD3E952D5E86C473FB1BE7A8E3D50A305"><enum>(2)</enum><text>The benefit to the
			 jurisdiction of having an adequately funded building code enforcement
			 department.</text>
				</paragraph><paragraph id="H8E8EF70BFC184661833F85CE0FD5AD44"><enum>(3)</enum><text>The demonstrated
			 ability of each building code enforcement department to work cooperatively with
			 other local code enforcement offices, health departments, and local
			 prosecutorial agencies.</text>
				</paragraph></subsection><subsection id="H606D9C2B8C4D4904B9ADC3A4F3F698AA"><enum>(c)</enum><header>Maximum
			 amount</header><text>The maximum amount of any grant awarded under this section
			 shall not exceed $1,000,000.</text>
			</subsection></section><section id="HF4AE1AF7FC904BB78938E7F896FAF6A8"><enum>3.</enum><header>Required elements
			 in grant proposals</header><text display-inline="no-display-inline">In order to
			 be eligible for a grant under section 2, a building code enforcement department
			 of a jurisdiction shall submit to the Secretary the following:</text>
			<paragraph id="HFC2D6796EFB64114AE1EFA64DF0A7D3C"><enum>(1)</enum><text>A
			 demonstration of the jurisdiction’s needs in executing building code
			 enforcement administration.</text>
			</paragraph><paragraph id="H4DCFA5A90B8F44D8B73BF254236CD3FA"><enum>(2)</enum><text>A
			 plan for the use of any funds received from a grant under this Act that
			 addresses the needs discussed in paragraph (1) and that is consistent with the
			 authorized uses established in section 4.</text>
			</paragraph><paragraph id="H3EC0B973B29443FB9B9242A31CAFA8FA"><enum>(3)</enum><text>A
			 plan for local governmental actions to be taken to establish and sustain local
			 building code enforcement administration functions, without continuing Federal
			 support, at a level at least equivalent to that proposed in the grant
			 application.</text>
			</paragraph><paragraph id="HCD35B6CC910F45959296E44F7ED9D402"><enum>(4)</enum><text>A
			 plan to create and maintain a program of public outreach that includes a
			 regularly updated and readily accessible means of public communication,
			 interaction, and reporting regarding the services and work of the building code
			 enforcement department to be supported by the grant.</text>
			</paragraph><paragraph id="HF6FAEEF6454D42569B099C34FAE54954"><enum>(5)</enum><text>A
			 plan for ensuring the timely and effective administrative enforcement of
			 building safety and fire prevention violations.</text>
			</paragraph></section><section id="H4E13D7FB9C904B2789944C36D1D95AA3"><enum>4.</enum><header>Use of funds;
			 matching funds</header>
			<subsection id="H6D4036EA7D3F4C8F98198851012E8111"><enum>(a)</enum><header>Authorized
			 uses</header><text>Amounts from grants awarded under section 2 may be used by
			 the grant recipient to supplement existing State or local funding for
			 administration of building code enforcement. Such amounts may be used to
			 increase staffing, provide staff training, increase staff competence and
			 professional qualifications, or support individual certification or
			 departmental accreditation, or for capital expenditures specifically dedicated
			 to the administration of the building code enforcement department.</text>
			</subsection><subsection id="H07D80B79B06C4F5D80DB4353EAE5364B"><enum>(b)</enum><header>Additional
			 requirement</header><text>Each building code enforcement department receiving a
			 grant under section 2 shall empanel a code administration and enforcement team
			 consisting of at least 1 full-time building code enforcement officer, a city
			 planner, and a health planner or similar officer.</text>
			</subsection><subsection id="H30D2D8F185084AB6B47BB8E51BB36BF6"><enum>(c)</enum><header>Matching funds
			 required</header>
				<paragraph id="HCDA31E1C6F89480CAFD5DB401298409E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">To be eligible to
			 receive a grant under this Act, a building code enforcement department shall
			 provide matching, non-Federal funds in the following amount:</text>
					<subparagraph id="HC6F46094C7F643DCB0774E67E0BCD4D8"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a building code enforcement
			 department serving an area with a population of more than 50,000, an amount
			 equal to not less than 50 percent of the total amount of any grant to be
			 awarded under this Act.</text>
					</subparagraph><subparagraph id="H9CA8C2C08E444A2D99FEEA08002ECA12"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of a building code enforcement
			 department serving an area with a population of between 20,001 and 50,000, an
			 amount equal to not less than 25 percent of the total amount of any grant to be
			 awarded under this Act.</text>
					</subparagraph><subparagraph id="HB8D82D50A66848D19C3580E3BA678DDC"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a building code enforcement
			 department serving an area with a population of less than 20,000, an amount
			 equal to not less than 12.5 percent of the total amount of any grant to be
			 awarded under this Act.</text>
					</subparagraph></paragraph><paragraph id="H6FB5277BF92542AD950D0A63F0A3789E"><enum>(2)</enum><header>Economic
			 distress</header>
					<subparagraph id="HAF7D6A2D1FDE496EA0B92559695609DA"><enum>(A)</enum><header>In
			 general</header><text>The Secretary may waive the matching fund requirements
			 under paragraph (1), and institute, by regulation, new matching fund
			 requirements based upon the level of economic distress of the jurisdiction in
			 which the local building code enforcement department seeking such grant is
			 located.</text>
					</subparagraph><subparagraph id="H260ABDFF51DB46C88D367995DC01D572"><enum>(B)</enum><header>Content of
			 regulations</header><text>Any regulations instituted under subparagraph (A)
			 shall include—</text>
						<clause id="HECCDBBAB1E4B471BAFB5B3681992827C"><enum>(i)</enum><text>a
			 method that allows for a comparison of the degree of economic distress among
			 the local jurisdictions of grant applicants, as measured by the differences in
			 the extent of growth lag, the extent of poverty, and the adjusted age of
			 housing in such jurisdiction; and</text>
						</clause><clause id="HBFE492E3BD2342CA95505A9B4A36B6C2"><enum>(ii)</enum><text>any
			 other factor determined to be relevant by the Secretary in assessing the
			 comparative degree of economic distress among such jurisdictions.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H34E5C55FA9C4473292A3587F81704D22"><enum>(d)</enum><header>In-kind
			 contributions</header><text>In determining the non-Federal share required to be
			 provided under subsection (c), the Secretary shall consider in-kind
			 contributions, not to exceed 50 percent of the amount that the department
			 contributes in non-Federal funds.</text>
			</subsection><subsection id="HA58CE99C3EA044BBA85F54834D74CEDD"><enum>(e)</enum><header>Waiver of
			 matching requirement</header><text>The Secretary shall waive the matching fund
			 requirements under subsection (c) for any recipient jurisdiction that has
			 dedicated all building code permitting fees to the conduct of local building
			 code enforcement.</text>
			</subsection></section><section id="H891AAD10830E43B29DF9F6F56DC8C9CE"><enum>5.</enum><header>Rating and
			 ranking of applications</header><text display-inline="no-display-inline">Eligible applications will be rated and
			 ranked according to the criteria under section 6. All complete applications
			 shall be compared to one another and points shall be assigned on a continuum
			 within each criteria with the maximum points awarded to the application that
			 best meets the criteria.</text>
		</section><section id="HCD9EC8FDF8C94BF1ACDFDF592143EE28"><enum>6.</enum><header>Criteria</header><text display-inline="no-display-inline">The criteria under this section are as
			 follows:</text>
			<paragraph id="H2F8DBFCAE6CD4DDC998EB39A115DB7CE"><enum>(1)</enum><header>Need and
			 community benefit from code enforcement grant funds</header><text display-inline="yes-display-inline">The degree to which the application
			 demonstrates the intent and means to ensure cooperative and effective working
			 relationships between local building code enforcement officials and other local
			 agencies, as well as a community-oriented approach to building code
			 enforcement, with points awarded as follows:</text>

					 proposed expenditure for the following groups or activities. Provide a brief
					 explanation of the benefit. (1 point will be awarded for each response, 5

					 Community or jurisdiction.<linebreak></linebreak> 3. Interdisciplinary code enforcement

			 enforcement and housing conservation plan</header><text>Whether the local
			 legislative body in which the applicant resides has adopted a plan that
			 addresses residential structure conservation and building code enforcement.
			 Points shall be awarded, based on which of the descriptions from the following
			 list best reflects such jurisdiction’s plan for building code enforcement
			 activities, as follows:</text>

			 code enforcement program, which shall include points awarded as follows for any

					 specific dates to dispose of household debris, inoperable vehicles, tires,
					 toxic materials, etc.</entry><entry colname="column2" leader-modify="clr-ldr" rowsep="0">0–5</entry>
							</row>
							<row><entry align="left" colname="column1" leader-modify="clr-ldr" stub-definition="txt-ldr" stub-hierarchy="1">Resource or referral programs for
					 Federal, State, local, and private funds and other resources available in your
					 jurisdiction that can assist with housing rehabilitation and repairs to rectify
					 code violations.</entry><entry colname="column2" leader-modify="clr-ldr" rowsep="0">0–5</entry>

					 housing issues. These could include community housing meetings dealing with
					 homeownership, tenant/landlord issues, housing code enforcement, school age
					 children's programs with coloring books or handouts, housing safety pamphlets,

			 jurisdiction’s financial and technical capacity to properly use and
			 successfully support the proposed capital expenditure during the term of the
			 grant, with points awarded as follows:</text>

			</paragraph></section><section id="H7F2F0FD418D34AECBD20ADFCA5EDEF18"><enum>7.</enum><header>Evaluation and
			 report</header>
			<subsection id="H279492BBBDF8460CB8ED9C459A664CD7"><enum>(a)</enum><header>In
			 general</header><text>Grant recipients shall—</text>
				<paragraph id="HDA10F1624D544BC28657CE454FB01D25"><enum>(1)</enum><text>be obligated to
			 fully account and report for the use of all grants funds; and</text>
				</paragraph><paragraph id="H379E7CE2A4FC46AEBC2085961C1A82A1"><enum>(2)</enum><text>provide a report
			 to the Secretary on the effectiveness of the program undertaken by the grantee
			 and any other criteria requested by the Secretary for the purpose of indicating
			 the effectiveness of, and ideas for, refinement of the grant program.</text>
				</paragraph></subsection><subsection id="HA4D11CFF96A447A8B987EBD41D8E15E1"><enum>(b)</enum><header>Report</header><text>The
			 report required under subsection (a)(2) shall include a discussion of—</text>
				<paragraph id="HF05612B1D61A4AE29B1F9A800DA1EDAE"><enum>(1)</enum><text>the specific
			 capabilities and functions in local building code enforcement administration
			 that were addressed using funds received under this Act;</text>
				</paragraph><paragraph id="H0551C72553D242F3B006D4526B3D7FD9"><enum>(2)</enum><text>the lessons
			 learned in carrying out the plans supported by the grant; and</text>
				</paragraph><paragraph id="H2485D095BB7048FF9E7828D2D8E99274"><enum>(3)</enum><text>the manner in
			 which the programs supported by the grant are to be maintained by the
			 grantee.</text>
				</paragraph></subsection><subsection id="HEDFDF474743D4F81B7AB800B6B66E454"><enum>(c)</enum><header>Content of
			 reports</header><text>The Secretary shall—</text>
				<paragraph id="HAB669F02B2A946CAAA8DCDF9190736D4"><enum>(1)</enum><text>require each
			 recipient of a grant under this Act to file interim and final reports under
			 subsection (b) to ensure that grant funds are being used as intended and to
			 measure the effectiveness and benefits of the grant program; and</text>
				</paragraph><paragraph id="HE3AB1DCAC6B94408A6BB794DDC32DD39"><enum>(2)</enum><text>develop and
			 maintain a means whereby the public can access such reports, at no cost, via
			 the Internet.</text>
				</paragraph></subsection></section><section id="H70B723CE059F4AB48E19B7D76814A574"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following
			 definitions shall apply:</text>
			<paragraph id="H5A28A72728A84678AE1E8B755D93DC6E"><enum>(1)</enum><header>Building code
			 enforcement</header><text display-inline="yes-display-inline">The term
			 <term>building code enforcement</term> means the enforcement of any code,
			 adopted by a State or local government, that regulates the construction of
			 buildings and facilities to mitigate hazards to life or property. Such term
			 includes building codes, electrical codes, energy codes, fire codes, fuel gas
			 codes, mechanical codes, and plumbing codes.</text>
			</paragraph><paragraph id="HEE45E53D9AA34840925ABBC4076C08D5"><enum>(2)</enum><header>Building code
			 enforcement department</header><text display-inline="yes-display-inline">The
			 term <term>building code enforcement department</term> means an inspection or
			 enforcement agency of a jurisdiction that is responsible for conducting
			 building code enforcement.</text>
			</paragraph><paragraph id="HCC9FF6662853470687CB782FC6552F5F"><enum>(3)</enum><header>Jurisdiction</header><text>The
			 term <term>jurisdiction</term> means a city, county, parish, city and county
			 authority, or city and parish authority having local authority to enforce
			 building codes and regulations and to collect fees for building permits.</text>
			</paragraph><paragraph id="H1E146ABEC3E043A09A26C4483E7AF4DE"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Housing and Urban
			 Development.</text>
			</paragraph></section><section id="H7A4127957B434EA097893850FAA7DF6A"><enum>9.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H409D16EFB7634620BB4DA9F937E2A547"><enum>(a)</enum><header>In
			 general</header><text>There are authorized to be appropriated $20,000,000 for
			 each of fiscal years 2010 through 2014 to the Secretary of Housing and Urban
			 Development to carry out the provisions of this Act.</text>
			</subsection><subsection id="H17363AF171DC4FA28BF5249847D23BB2"><enum>(b)</enum><header>Reservation</header><text>From
			 the amount made available under subsection (a), the Secretary may reserve not
			 more than 5 percent for administrative costs.</text>
			</subsection><subsection id="H5F2EBF6694D6429BA4EBDC6B71B594C2"><enum>(c)</enum><header>Availability</header><text>Any
			 funds appropriated pursuant to subsection (a) shall remain available until
			 expended.</text>
