		<official-title>To amend part B of title XVIII of the Social Security Act
		  to limit the penalty for late enrollment under part B of the Medicare Program
		  to 10 percent and twice the period of no enrollment, and to exclude periods of
		  COBRA and retiree coverage from such late enrollment penalty.</official-title>

		<section id="H6469B53FE249436489A6D601F3B878F7" section-type="section-one"><enum>1.</enum><header>Limiting Medicare part B late
			 enrollment penalty to 10 percent and twice the period of no enrollment</header>
			<subsection id="H9C303F0D10CA480B9B9126929FEF90F0"><enum>(a)</enum><header>In
			 general</header><text>The first sentence of section 1839(b) of the Social
			 Security Act (42 U.S.C. 1395r(b)) is amended by striking <quote>10 percent of
			 the monthly premium so determined for each full 12 months</quote> and inserting
			 <quote>10 percent of the monthly premium so determined for premiums paid during
			 a period equal to twice the number of months in each of the full periods of 12
			 months</quote>.</text>
			</subsection><subsection id="H670B8B2FB0964D9B9F80D40BAD530ACE"><enum>(b)</enum><header>Conforming
			 amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="HD9DFC13473C249EC8DC1EAE9A9D28BAD"><enum>(1)</enum><text>Section 1818(c)(6) of
			 such Act (42 U.S.C. 1395i–2(c)(6)) is amended by striking <quote>may not exceed
			 10 percent and shall only apply to premiums paid during a period equal to twice
			 the number of months in the full 12-month periods described in that section
			 and</quote>.</text>
				</paragraph><paragraph id="H20B6EE2D0D9442198AD2160E17FCCD4C" indent="up1"><enum>(2)</enum><text>Section 1818(g)(2)(B) of such Act (42
			 U.S.C. 1395i–2(g)(2)(B)) is amended by striking <quote>by substituting</quote>
			 and all that follows and inserting the following: <quote>by substituting
			 <quote>section 1818 (without any increase resulting from the application of
			 section 1839(b) to such section)</quote> for <quote>section 1839 (without any
			 increase under subsection (b) thereof)</quote>.</quote>.</text>
				</paragraph></subsection><subsection id="HECA6C77DAC8748EFA3684EEFF4582C70"><enum>(c)</enum><header>Effective
			 date</header><paragraph commented="no" display-inline="yes-display-inline" id="HC2A81B548F5347B899F2E98985A1EACB"><enum>(1)</enum><text>The
			 amendments made by this section shall apply to premiums paid for months
			 beginning after the end of the 90-day period beginning on the date of the
			 enactment of this Act.</text>
				</paragraph><paragraph id="HD6A77AF791FF415EA11D9498657D2C62" indent="up1"><enum>(2)</enum><text>In applying these amendments, months
			 (before, during, or after the month in which this Act is enacted) in which an
			 individual was or is required to pay an increased premium shall be taken into
			 account in determining the month in which the premium will no longer be subject
			 to an increase.</text>
				</paragraph></subsection></section><section id="HECCAFF04C41A44CEAC794A686AE7C844"><enum>2.</enum><header>Exclusion of
			 periods of COBRA and retiree coverage from Medicare part B late enrollment
			 penalty</header>
			<subsection id="HC850CC8C8194485CBE08B5FDE826CBB6"><enum>(a)</enum><header>In
			 general</header><text>The second sentence of section 1839(b) of the Social
			 Security Act (42 U.S.C. 1395r(b)) is amended by striking <quote>by reason of
			 the individual’s (or the individual’s spouse’s) current
			 employment</quote>.</text>
			</subsection><subsection id="HA2C200E3FC9C4F8090F4CFF8CAA18E07"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to premiums
			 paid for months beginning after the end of the 90-day period beginning on the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H366790729D214693A414E8A07E806678"><enum>3.</enum><header>Special
			 enrollment period for individuals whose COBRA or retiree coverage
			 terminates</header>
			<subsection id="H81470BED48C540998995F0C38CD4DEDA"><enum>(a)</enum><header>In
			 general</header><text>Section 1837(i) of the Social Security Act (42 U.S.C.
			 1395p(i)) is amended—</text>
				<paragraph id="H2FC87DA7A33740D9A8DD587787AD6223"><enum>(1)</enum><text>in the first
			 sentence of paragraph (1), by striking <quote>by reason of the individual's (or
			 the individual’s spouse’s) current employment status</quote> in subparagraph
			 (A);</text>
				</paragraph><paragraph id="H394CA55BA5D4405986C1E4A5A02C26BA"><enum>(2)</enum><text>in the first
			 sentence of paragraph (2) by striking <quote>by reason of the individual's (or
			 the individual’s spouse’s) current employment status</quote> each place it
			 appears in subparagraphs (B) and (C); and</text>
				</paragraph><paragraph id="H120D0E54B82F472680B76FD98090B75C"><enum>(3)</enum><text>in paragraph
			 (3)(A) by striking <quote>by reason of current employment
			 status</quote>.</text>
				</paragraph></subsection><subsection id="HF6935E86C2084719A8EAF20C2387BA9F"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to premiums
			 paid for months beginning after the end of the 90-day period beginning on the
			 date of the enactment of this Act.</text>
