			 apply:</text>
			<paragraph id="H391FFC8CDC12429F811CE4E179057815"><enum>(1)</enum><header>Assistant
			 Secretary</header><text display-inline="yes-display-inline">The term
			 <quote>Assistant Secretary</quote> means Assistant Secretary of Homeland
			 Security (Transportation Security Administration).</text>
			</paragraph><paragraph id="H1B7037FD6A7E406E93BA72C5C3A51FBB"><enum>(2)</enum><header>Administration</header><text>The
			 term <quote>Administration</quote> means the Transportation Security
			 Administration.</text>
			</paragraph><paragraph id="H9F32DFA047234981B6424054C6F50CD3"><enum>(3)</enum><header>Aviation
			 Security Advisory Committee</header><text display-inline="yes-display-inline">The term <quote>Aviation Security Advisory
			 Committee</quote> means the advisory committee established by
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44946">section
			 44946</external-xref> of title 49, United States Code, as added by this
			 Act.</text>
			</paragraph><paragraph id="H4F3DB132442F4E22B93176566C8F5E65"><enum>(4)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Homeland Security.</text>
			</paragraph></section><section id="H2E8ACBFB8E8041C8A3EA36F2AEE6E77F"><enum>3.</enum><header>Authorities
			 vested in Assistant Secretary</header><text display-inline="no-display-inline">Any authority vested in the Assistant
			 Secretary under this Act shall be carried out under the direction and control
			 of the Secretary.</text>
		</section><title id="HA2E76075FA0241ECAAB9C318B65967ED"><enum>I</enum><header>Authorization of
			 Appropriations</header>
			<section id="H03E1DBBEF10F4087A0504AE0DD0C52A8"><enum>101.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Secretary $7,604,561,000 for fiscal year
			 2010 and $8,060,835,000 for fiscal year 2011 for the necessary expenses of the
			 Transportation Security Administration for such fiscal years.</text>
			</section><section id="HD00D22FB55C44DC595DD9013B5045B1A"><enum>102.</enum><header>Risk-based
			 system for allocation of resources</header>
				<subsection id="HF16259384BC94DFA93805C1D4185251B"><enum>(a)</enum><header>Report</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Assistant
			 Secretary shall submit to the appropriate congressional committees, including
			 the Committee on Homeland Security of the House of Representatives, a report on
			 the status of its implementation of recommendations from the Comptroller
			 General with respect to the use by the Transportation Security Administration
			 of a risk-based system for allocating security resources effectively.</text>
				</subsection><subsection id="H13058958B63A4306A85FB135D5B8F83D"><enum>(b)</enum><header>Assessments</header><text>The
			 report shall include assessments of the Transportation Security
			 Administration’s progress in—</text>
					<paragraph id="H7627AAA478EB41C6A94B02705BA93754"><enum>(1)</enum><text>adopting security
			 goals that define specific outcomes, conditions, end points, and performance
			 targets;</text>
					</paragraph><paragraph id="H57E1B2F2BB3141FD8849E14B8CDC586D"><enum>(2)</enum><text>conducting
			 comprehensive risk assessments for the transportation sector that meet the
			 criteria established under Homeland Security Presidential Directive-7 in effect
			 as of January 1, 2009, and combine individual assessments of threat,
			 vulnerability, and consequence;</text>
					</paragraph><paragraph id="HFFC92084883C4DA2987A459431AC7A48"><enum>(3)</enum><text>analyzing the assessments described in paragraph (2) to produce a comparative
			 analysis of risk across the entire transportation sector to guide current and
			 future investment decisions;</text>
					</paragraph><paragraph id="HFD912D8496D94F728904861A998694AB"><enum>(4)</enum><text>establishing an
			 approach for gathering data on investments by State, local, and private sector
			 security partners in transportation security;</text>
					</paragraph><paragraph id="HE920C7D258C7428597F40CE932D631EF"><enum>(5)</enum><text>establishing a
			 plan and corresponding benchmarks for conducting risk assessments for the
			 transportation sector that identify the scope of the assessments and resource
			 requirements for completing them;</text>
					</paragraph><paragraph id="H4BCEF7BE49144B4E9A8F51343FC382AA"><enum>(6)</enum><text>working with the
			 Department of Homeland Security to effectuate the Administration’s risk
			 management approach by establishing a plan and timeframe for assessing the
			 appropriateness of the Administration’s intelligence-driven risk management
			 approach for managing risk at the Administration and documenting the results of
			 the assessment once completed;</text>
					</paragraph><paragraph id="H8A55F9BC82404D42A7AC6EA812AF2048"><enum>(7)</enum><text>determining the
			 best approach for assigning uncertainty or confidence levels to analytic
			 intelligence products related to the Transportation Security Administration’s
			 security mission and applying such approach; and</text>
					</paragraph><paragraph id="HBA47691875EE4BB994C23ECCB5334B57"><enum>(8)</enum><text>establishing
			 internal controls, including—</text>
						<subparagraph id="H97FA39E64BDE4745A519538B311FC4D3"><enum>(A)</enum><text>a focal point and
			 clearly defined roles and responsibilities for ensuring that the
			 Administration’s risk management framework is implemented;</text>
						</subparagraph><subparagraph id="H9A88F813C7BF46F18CCDE1A1EAC2BD67"><enum>(B)</enum><text>policies,
			 procedures, and guidance that require the implementation of the
			 Administration’s framework and completion of related work activities;
			 and</text>
						</subparagraph><subparagraph id="HAEFCAA6E2D3A4E2D98BC4C33D206773E"><enum>(C)</enum><text>a system to
			 monitor and improve how effectively the framework is being implemented.</text>
						</subparagraph></paragraph></subsection><subsection id="HCC6DE83514A145D2BB63F2B46B8EBEAB"><enum>(c)</enum><header>Assessment and
			 prioritization of risks</header>
					<paragraph id="HA09530FCA97C4C90A61CA40B41903061"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Consistent with the
			 risk and threat assessments required under sections
			 <external-xref legal-doc="usc" parsable-cite="usc/49/114">114(s)(3)(B)</external-xref> and
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44904">44904(c)</external-xref> of title 49, United
			 States Code, the report shall include—</text>
						<subparagraph id="H64523D5A92D14373A20B75591E8D4AF4"><enum>(A)</enum><text display-inline="yes-display-inline">a summary that ranks the risks within and
			 across transportation modes, including vulnerability of a cyber attack;
			 and</text>
						</subparagraph><subparagraph id="H361ED804A3514B3AAEA1B3BC9ED45EC7"><enum>(B)</enum><text>a description of
			 the risk-based priorities for securing the transportation sector, both within
			 and across modes, in the order that the priorities should be addressed.</text>
						</subparagraph></paragraph><paragraph id="H75F6C35EBC054F8A843B5D268523F0F5"><enum>(2)</enum><header>Methods</header><text display-inline="yes-display-inline">The report also shall—</text>
						<subparagraph id="H12573CC2DBDC4F7E81C367D4F1BB06DF"><enum>(A)</enum><text>describe the
			 underlying methodologies used to assess risks across and within each
			 transportation mode and the basis for any assumptions regarding threats,
			 vulnerabilities, and consequences made in assessing and prioritizing risks
			 within and across such modes; and</text>
						</subparagraph><subparagraph id="HCE2AF2E97C194F0F8DB70087FC9B3DD7"><enum>(B)</enum><text>include the
			 Assistant Secretary’s working definition of the terms <quote>risk-based</quote>
			 and <quote>risk-informed</quote>.</text>
						</subparagraph></paragraph></subsection><subsection id="H9D94DF38E8374224A510BF8DC41EF9B1"><enum>(d)</enum><header>Format</header><text>The
			 report shall be submitted in classified or unclassified formats, as
			 appropriate.</text>
				</subsection></section></title><title id="HB0425DBCB4554E098334922630FF876F"><enum>II</enum><header>Aviation
			 Security</header>
			<subtitle id="HFAEE1AE71245420FADDD1093663E393F"><enum>A</enum><header>Amendments to
			 Chapter 449</header>
				<section id="H50A25515611948788495D653051B23B2"><enum>201.</enum><header>Screening air
			 cargo and checked baggage</header>
					<subsection id="H6BACD3C9848D4CABA2994104F80F45CE"><enum>(a)</enum><header>Inbound air
			 cargo on passenger aircraft</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44901">Section 44901(g)</external-xref> of title 49,
			 United States Code, is amended—</text>
						<paragraph id="HBB57D869BEEF4498A32B0BE6FAEDC3DF"><enum>(1)</enum><text>by redesignating
			 paragraphs (3), (4), and (5) as paragraphs (4), (5), and (6), respectively;
			 and</text>
						</paragraph><paragraph id="HCEF382CB62534977A02137F7BA7244A8"><enum>(2)</enum><text>by inserting after
			 paragraph (2) the following:</text>
							<quoted-block id="HE49F450D656049DF944C0DC391A4891B" style="OLC">
								<paragraph id="HD8174D48EEFC40D0B6ECFAFB6D0FE7C6"><enum>(3)</enum><header>Inbound air
				cargo on passenger aircraft</header><text>Not later than 2 years after the date
				of enactment of the Transportation Security Administration Authorization Act,
				the Assistant Secretary shall establish a system to verify that all cargo
				transported on passenger aircraft operated by an air carrier or foreign air
				carrier inbound to the United States be screened for explosives. The system
				shall include a risk assessment for inbound air cargo on passenger and all air
				cargo airplanes, and the Assistant Secretary shall use this assessment to
				address vulnerabilities in cargo screening. The Assistant Secretary shall
				identify redundancies in inbound cargo inspection on passenger aircraft by
				agencies and address these to ensure that all cargo is screened without
				subjecting carriers to multiple inspections by different
				agencies.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H3B4BF3CBE965464CBAE2260856F6BC45"><enum>(b)</enum><header>Mandatory
			 screening where EDS is not yet available</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44901">Section 44901(e)(1)</external-xref> of title 49,
			 United States Code, is amended to read as follows:</text>

				baggage screening where explosive detection equipment is available unless there
				are exigent circumstances as determined by the Assistant Secretary. The
				Assistant Secretary shall report to the Committee on Homeland Security of the
				House of Representatives within 90 days of the determination that bag match
				must be used as an alternate method of baggage
				screening.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section display-inline="no-display-inline" id="H3A7C51059D384617A2CC95A909D1BAE1"><enum>202.</enum><header>Prohibition of
			 advance notice of covert testing to security screeners</header>
					<subsection id="H2C819853854D4DEBB38FDDC27133356B"><enum>(a)</enum><header>Covert
			 testing</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44935">Section 44935</external-xref> of
			 title 49, United States Code, is amended—</text>
						<paragraph id="HCFC1719B09F240939ED7B19D9FF282DA"><enum>(1)</enum><text>by redesignating
			 the second subsection (i) (as redesignated by section 111(a)(1) of
			 <external-xref legal-doc="public-law" parsable-cite="pl/107/71">Public Law
			 107–71</external-xref> (115 Stat. 616), relating to accessibility of
			 computer-based training facilities) as subsection (k); and</text>
						</paragraph><paragraph id="H36F48544B46F4861B1F9EC923B30B267"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>

				advance notice to security screeners of covert testing and evaluation</header>
									<paragraph id="H2190479543C64A5FA8F54EB534DCFFA3"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall ensure that information concerning a covert test of a
				transportation security system to be conducted by a covert testing office, the
				Inspector General of the Department of Homeland Security, or the Government
				Accountability Office is not provided to any individual prior to the completion
				of the test.</text>
									</paragraph><paragraph id="HC4A9F8323DDA4B7A8C4C3A872C6E56A0"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1)—</text>
										<subparagraph id="H3CA3CF1D655B440FB70FDF356E3A787B"><enum>(A)</enum><text display-inline="yes-display-inline">an authorized individual involved in a
				covert test of a transportation security system may provide information
				concerning the covert test to—</text>
											<clause id="H59F662D2F19445A1AE57C761E762B480"><enum>(i)</enum><text>employees,
				officers, and contractors of the Federal Government (including military
				personnel);</text>
											</clause><clause id="H83CE74E8155D4D0688AB91B6E4206A2A"><enum>(ii)</enum><text>employees and
				officers of State and local governments; and</text>
											</clause><clause id="H9F58207C64DD405F887F1C129DC32DC0"><enum>(iii)</enum><text>law enforcement
				officials who are authorized to receive or directed to be provided such
				information by the Assistant Secretary, the Inspector General of the Department
				of Homeland Security, or the Comptroller General, as the case may be;
				and</text>
											</clause></subparagraph><subparagraph id="H367A40AEDECF485B8148AFF8E4FF9FC6"><enum>(B)</enum><text display-inline="yes-display-inline">for the purpose of ensuring the security of
				any individual in the vicinity of a site where a covert test of a
				transportation security system is being conducted, an individual conducting the
				test may disclose his or her status as an individual conducting the test to any
				appropriate individual if a security screener or other individual who is not a
				covered employee identifies the individual conducting the test as a potential
				threat.</text>
										</subparagraph></paragraph><paragraph id="HE0BD25418FE24F8D97B2C4B8834D66FC"><enum>(3)</enum><header>Special rules
				for TSA</header>
										<subparagraph id="HCC992372C44C4F0781FE3A79617800B4"><enum>(A)</enum><header>Monitoring and
				security of testing personnel</header><text display-inline="yes-display-inline">The head of each covert testing office
				shall ensure that a person or group of persons conducting a covert test of a
				transportation security system for the covert testing office is accompanied at
				the site of the test by a cover team composed of one or more employees of the
				covert testing office for the purpose of monitoring the test and confirming the
				identity of personnel involved in the test under subparagraph (B).</text>
										</subparagraph><subparagraph id="H4EB4E0F00CF7468D81F3FA9FA510CD6D"><enum>(B)</enum><header>Responsibility
				of cover team</header><text display-inline="yes-display-inline">Under this
				paragraph, a cover team for a covert test of a transportation security system
				shall—</text>
											<clause id="H4639755020BF4AEBAB47E21F10881241"><enum>(i)</enum><text display-inline="yes-display-inline">monitor the test; and</text>
											</clause><clause id="H77101B6CD72A4B23BE128824D174A40D"><enum>(ii)</enum><text display-inline="yes-display-inline">for the purpose of ensuring the security of
				any individual in the vicinity of a site where the test is being conducted,
				confirm, notwithstanding paragraph (1), the identity of any individual
				conducting the test to any appropriate individual if a security screener or
				other individual who is not a covered employee identifies the individual
				conducting the test as a potential threat.</text>
											</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HDDA14E172FE04AA9A7D0872C72557A6F"><enum>(C)</enum><header>Aviation
				screening</header><text display-inline="yes-display-inline">Notwithstanding
				subparagraph (A), the Transportation Security Administration is not required to
				have a cover team present during a test of the screening of persons, carry-on
				items, or checked baggage at an aviation security checkpoint at or serving an
				airport if the test—</text>
											<clause id="H2D211D2FF57540B3A279D4EEDDBED35E"><enum>(i)</enum><text>is
				approved, in coordination with the designated security official for the airport
				operator by the Federal Security Director for such airport; and</text>
											</clause><clause id="HC6312428FD17416498CA22ECF5AF3C63"><enum>(ii)</enum><text>is carried out
				under an aviation screening assessment program of the Department of Homeland
				Security.</text>
											</clause></subparagraph><subparagraph id="H20D02B2B6FE847B185F3F90171A617E9"><enum>(D)</enum><header>Use of Other
				Personnel</header><text display-inline="yes-display-inline">The Transportation
				Security Administration may use employees, officers, and contractors of the
				Federal Government (including military personnel) and employees and officers of
				State and local governments to conduct covert tests.</text>
										</subparagraph></paragraph><paragraph id="HA72ECCB6F5484C7D91BE6DD7F3ACA1E0"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection, the following
				definitions apply:</text>
										<subparagraph id="H82FB0500518F459891558E60ACD6650B"><enum>(A)</enum><header>Appropriate
				individual</header><text display-inline="yes-display-inline">The term
				<term>appropriate individual</term>, as used with respect to a covert test of a
				transportation security system, means any individual that—</text>
											<clause id="H0F9ECE4C0CD944CC88CF33A16EC57EB3"><enum>(i)</enum><text display-inline="yes-display-inline">the individual conducting the test
				determines needs to know his or her status as an individual conducting a test
				under paragraph (2)(B); or</text>
											</clause><clause id="HEF03BD02994D44DD934BFDBA40B21983"><enum>(ii)</enum><text>the cover team
				monitoring the test under paragraph (3)(B)(i) determines needs to know the
				identity of an individual conducting the test.</text>
											</clause></subparagraph><subparagraph id="H63FB51E031A4405A8B75F714AF66C4D9"><enum>(B)</enum><header>Covered
				employee</header><text display-inline="yes-display-inline">The term
				<term>covered employee</term> means any individual who receives notice of a
				covert test before the completion of a test under paragraph (2)(A).</text>
										</subparagraph><subparagraph id="H865FD6B36CBB4B4BB374E2BAC93FAEC0"><enum>(C)</enum><header>Covert
				test</header>
											<clause id="HADB26A977A38417E8EE4C06A6768E564"><enum>(i)</enum><header>In
				general</header><text>The term <term>covert test</term> means an exercise or
				activity conducted by a covert testing office, the Inspector General of the
				Department of Homeland Security, or the Government Accountability Office to
				intentionally test, compromise, or circumvent transportation security systems
				to identify vulnerabilities in such systems.</text>
											</clause><clause id="H062FE5A7EBE4448FA19A531844CDF89F"><enum>(ii)</enum><header>Limitation</header><text>Notwithstanding
				<internal-xref idref="HADB26A977A38417E8EE4C06A6768E564" legis-path="(e)(5)(C)(i)">clause (i)</internal-xref>, the term <term>covert
				test</term> does not mean an exercise or activity by an employee or contractor
				of the Transportation Security Administration to test or assess compliance with
				relevant regulations.</text>
											</clause></subparagraph><subparagraph id="HFFA1ECDB214C42D5ADEEC1C8C6736C1B"><enum>(D)</enum><header>Covert testing
				office</header><text display-inline="yes-display-inline">The term <term>covert
				testing office</term> means any office of the Transportation Security
				Administration designated by the Assistant Secretary to conduct covert tests of
				transportation security systems.</text>
										</subparagraph><subparagraph id="H4663EE0A55D84C8C88967E559C6E440F"><enum>(E)</enum><header>Employee of a
				covert testing office</header><text display-inline="yes-display-inline">The
				term <term>employee of a covert testing office</term> means an individual who
				is an employee of a covert testing office or a contractor or an employee of a
				contractor of a covert testing
				office.</text>
										</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HD23756E25D704153809FC335C4BE9A8D"><enum>(b)</enum><header>Uniforms</header><text display-inline="yes-display-inline">Section 44935(j) of such title is
			 amended—</text>

			 verification system for law enforcement officers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44917">Section 44917</external-xref> of
			 title 49, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD04604D3DFD647DC8CE906B67EFDB1C6" style="OLC">
						<subsection id="HC9BF1496DA1749D09D722E84A4709FEC"><enum>(e)</enum><header>Secure
				verification system for law enforcement officers</header>
							<paragraph id="H5DD5720A468F46278319C11BD3E95310"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall develop a plan for a system
				to securely verify the identity and status of law enforcement officers flying
				while armed. The Assistant Secretary shall ensure that the system developed
				includes a biometric component.</text>
							</paragraph><paragraph id="HA0E2FA3593D64EC4837C70CBCF3552EC"><enum>(2)</enum><header>Demonstration</header><text>The
				Assistant Secretary shall conduct a demonstration program to test the secure
				verification system described in paragraph (1) before issuing regulations for
				deployment of the system.</text>
							</paragraph><paragraph id="H6DC80411948748EA92584F9BC41B6025"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Assistant Secretary shall consult with
				the Aviation Security Advisory Committee, established under
				<external-xref legal-doc="usc" parsable-cite="usc/49/44946">section
				44946</external-xref> of title 49, United States Code, when developing the
				system and evaluating the demonstration program.</text>
							</paragraph><paragraph id="HED80EBB7DC834129BA360F13ED9632BF"><enum>(4)</enum><header>Report</header><text>The
				Assistant Secretary shall submit a report to the Committee on Homeland Security
				of the House of Representatives, evaluating the demonstration program of the
				secure verification system required by this section.</text>
							</paragraph><paragraph id="HD86CB7BB8B4244A1966659C1DCE38C13"><enum>(5)</enum><header>Authorization of
				Appropriations</header><text display-inline="yes-display-inline">From the
				amounts authorized under section 101 of the <short-title>Transportation Security Administration Authorization
				Act</short-title>, there is authorized to be appropriated to carry out this
				subsection $10,000,000, to remain available until
				expended.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HAAAE81001D3545D495A2D78A321630B6"><enum>204.</enum><header>Ombudsman for
			 Federal Air Marshal Service</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44917">Section 44917</external-xref> of
			 title 49, United States Code, as amended by section 203 of this Act, is further
			 amended by adding at the end the following:</text>

				Federal Security Director at an airport to inform, consult, and coordinate, as
				appropriate, with the airport operator in a timely manner on security matters

				protocols with airport operators to ensure coordinated responses to security
				matters.</text>

				general</header><text>The Assistant Secretary shall establish in the
				Transportation Security Administration an advisory committee, to be known as
				the Aviation Security Advisory Committee (in this chapter referred to as the
				<quote>Advisory Committee</quote>), to assist the Assistant Secretary with
				issues pertaining to aviation security, including credentialing.</text>
									</paragraph><paragraph id="HB02CB30200FB425282C23A9CDACA3C7F"><enum>(2)</enum><header>Recommendations</header><text>The
				Assistant Secretary shall require the Advisory Committee to develop
				recommendations for improvements to civil aviation security methods, equipment,
				and processes.</text>
									</paragraph><paragraph id="HE5A64288E1534B74988AC48DF9782E57"><enum>(3)</enum><header>Meetings</header><text>The
				Assistant Secretary shall require the Advisory Committee to meet at least
				semiannually and may convene additional meetings as necessary.</text>
									</paragraph><paragraph id="H603A30D20D374D69A3ABA4F549524E65"><enum>(4)</enum><header>Unpaid
				position</header><text>Advisory Committee members shall serve at their own
				expense and receive no salary, reimbursement of travel expenses, or other

				organizations</header><text>The Assistant Secretary shall ensure that the
				Advisory Committee is composed of not more than one individual representing not
				more than 27 member organizations, including representation of air carriers,
				all cargo air transportation, indirect air carriers, labor organizations
				representing air carrier employees, aircraft manufacturers, airport operators,
				general aviation, and the aviation technology security industry, including
				biometrics.</text>
									</paragraph><paragraph id="H69B488F004A94AEF8004E36921550B3A"><enum>(2)</enum><header>Appointments</header><text>Members
				shall be appointed by the Assistant Secretary, and the Assistant Secretary
				shall have the discretion to review the participation of any Advisory Committee
				member and remove for cause at any time.</text>
									</paragraph></subsection><subsection id="H095C3ABC677A4629BD15317A86E0BF46"><enum>(c)</enum><header>Nonapplicability
				of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
				not apply to the Advisory Committee under this section.</text>
								</subsection><subsection id="H5EC1CB059CFB4E4B960083FF4E3BF820"><enum>(d)</enum><header>Air cargo
				security working group</header>
									<paragraph id="H3CB7BFF6EF2F4EBFBF2EB7BD5D9EE03B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall establish within the Advisory Committee an air cargo security
				working group to provide recommendations for air cargo security issues,
				including the implementation of the air cargo screening initiatives proposed by
				the Transportation Security Administration to screen air cargo on passenger
				aircraft in accordance with established cargo screening mandates.</text>
									</paragraph><paragraph id="H758E4793CFB1439396A3DD27A075AD3F"><enum>(2)</enum><header>Meetings</header><text>The
				working group shall meet at least semiannually and provide annual reports to
				the Assistant Secretary with recommendations to improve the Administration’s
				cargo screening initiatives established to meet all cargo screening mandates
				set forth in <external-xref legal-doc="usc" parsable-cite="usc/49/44901">section 44901(g)</external-xref> of title 49,
				United States Code.</text>
									</paragraph><paragraph id="H08195539C80F43C6BF7A3F3E214FFC00"><enum>(3)</enum><header>Membership</header><text>The
				working group shall include members from the Advisory Committee with expertise
				in air cargo operations and representatives from other stakeholders as
				determined by the Assistant Secretary.</text>
									</paragraph><paragraph id="H56AAE16B346648C09477565A82EB82A1"><enum>(4)</enum><header>Reports</header>
										<subparagraph id="H185CE32C59084D05840EEED73A0D6C71"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The working group
				shall prepare and submit reports to the Assistant Secretary in accordance with
				this paragraph that provide cargo screening mandate implementation
				recommendations.</text>
										</subparagraph><subparagraph id="H4647FDC0153F4418B9763FB3682BCFF9"><enum>(B)</enum><header>Submission</header><text>Not
				later than one year after the date of enactment of this section and on an
				annual basis thereafter, the working group shall submit its first report to the
				Assistant Secretary, including any recommendations of the group—</text>
											<clause id="HA72EEA8163B9401DB4B4AF030B51FD90"><enum>(i)</enum><text>to
				reduce redundancies and increase efficiencies with the screening and inspection
				of inbound cargo; and</text>
											</clause><clause id="H1CF288DA36864AC4B4F5BE63F204E730"><enum>(ii)</enum><text>on the potential
				development of a fee structure to help sustain cargo screening
				efforts.</text>
											</clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall carry out a general aviation security grant program to enhance
				transportation security at general aviation airports by making grants to
				operators of general aviation airports for projects to enhance perimeter
				security, airfield security, and terminal security.</text>
									</paragraph><paragraph id="HBDDBAF8F965448BEB053E1D739754953"><enum>(2)</enum><header>Eligible
				projects</header><text display-inline="yes-display-inline">Not later than one
				year after the date of submission of the first report of the working group
				under subsection (b), the Assistant Secretary shall develop and make publically
				available a list of approved eligible projects for such grants under paragraph
				(1) based upon recommendations made by the working group in such report.</text>
									</paragraph><paragraph id="H9F690A0A59A342A8B0D062A367872891"><enum>(3)</enum><header>Federal
				share</header><text>The Federal share of the cost of activities for which
				grants are made under this subsection shall be 90 percent.</text>
									</paragraph><paragraph id="HFC3A23F945254D0D8203BE76AC977F00"><enum>(4)</enum><header>Presumption of
				Congress relating to competitive procedures</header>
										<subparagraph id="H1007EEAE42B74930BB48BB0F0392139D"><enum>(A)</enum><header>Presumption</header><text>It
				is the presumption of Congress that grants awarded under this section will be
				awarded using competitive procedures based on risk.</text>
										</subparagraph><subparagraph id="H2AC2ABF0D2FA4F4CA1E9977BF47BAD85"><enum>(B)</enum><header>Report to
				Congress</header><text>If grants are awarded under this section using
				procedures other than competitive procedures, the Assistant Secretary shall
				submit to Congress a report explaining why competitive procedures were not
				used.</text>
										</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H83CE5AB882B64B019FF5F8136B6AEB30"><enum>(b)</enum><header>General aviation
				security working group</header>
									<paragraph id="HD581AFE2A1844938BC61ED759D91AA24"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall establish, within the Aviation Security Advisory Committee
				established under section 44946, a general aviation working group to advise the
				Transportation Security Administration regarding transportation security issues
				for general aviation facilities, general aviation aircraft, heliports, and
				helicopter operations at general aviation and commercial service
				airports.</text>
									</paragraph><paragraph id="HFA3A2AF4842F4C369DD794349920C390"><enum>(2)</enum><header>Meetings</header><text>The
				working group shall meet at least semiannually and may convene additional
				meetings as necessary.</text>
									</paragraph><paragraph id="H581F28D268094EE5BDD1AE6768BC2042"><enum>(3)</enum><header>Membership</header><text>The
				Assistant Secretary shall appoint members from the Aviation Security Advisory
				Committee with general aviation experience.</text>
									</paragraph><paragraph id="H14F2787B7FD24FB7AD4A8355A589B962"><enum>(4)</enum><header>Reports</header>
										<subparagraph id="H48804803FD2349A4A86711B8CFE801AA"><enum>(A)</enum><header>Submission</header><text display-inline="yes-display-inline">The working group shall submit a report to
				the Assistant Secretary with recommendations on ways to improve security at
				general aviation airports.</text>
										</subparagraph><subparagraph id="HD6C9C486FBB648DF8C23CB2D5CE28737"><enum>(B)</enum><header>Contents of
				report</header><text>The report of the working group submitted to the Assistant
				Secretary under this paragraph shall include any recommendations of the working
				group for eligible security enhancement projects at general aviation airports
				to be funded by grants under subsection (a).</text>
										</subparagraph><subparagraph id="H2608D5B0FCC344ADBD805055D4FECB63"><enum>(C)</enum><header>Subsequent
				reports</header><text>After submitting the report, the working group shall
				continue to report to the Assistant Secretary on general aviation aircraft and
				airports.</text>
										</subparagraph></paragraph></subsection><subsection id="H7A190812387C4070A57EE2C290EB2016"><enum>(c)</enum><header>Authorization of
				Appropriations</header><text display-inline="yes-display-inline">From amounts
				made available under section 101 of the <short-title>Transportation Security Administration Authorization
				Act</short-title>, there is authorized to be appropriated for making grants
				under subsection (a) $10,000,000 for each of fiscal years 2010 and 2011. None
				of the funds appropriated pursuant to this subsection may be used for a
				congressional earmark as defined in clause 9d, of Rule XXI of the rules of the
				House of Representatives of the 111th
				Congress.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				period for all cabin crewmembers. The Assistant Secretary shall consult with
				the Advisory Committee, established under section 44946. and cabin crew and air
				carrier representatives in developing a plan for providing self-defense
				training in conjunction with existing recurrent training.</text>
								</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H31000C3C1F484180827C02FFCBCA5DF2"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="H7920490B7515403AA815700EF59391DE" style="OLC">

			 an oversight program for security training of cabin crewmembers that includes
			 developing performance measures and strategic goals for air carriers, and
			 standard protocols for Transportation Security Administration oversight
			 inspectors, in accordance with recommendations by the Inspector General of the
			 Department of Homeland Security and the Comptroller General.</quote>.</text>
					</subsection></section><section id="H687B49BCD6074C39B36680A814BE6CFC" section-type="subsequent-section"><enum>212.</enum><header>Security screening
			 of individuals with metal implants traveling in air transportation</header>
					<subsection id="H9528BE6BB4194F6DBE5B18D4587C1DA2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44903">Section 44903</external-xref> of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H1803B8632B4C49CE863481496D4E4ADF" style="OLC">
							<subsection id="H370196196D80427B8E624AF2404F51E1"><enum>(m)</enum><header>Security
				screening of individuals with metal implants traveling in air
				transportation</header>
								<paragraph id="HD10A93A9C96147BD8269784C039081E2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall carry out a program to ensure fair treatment in the screening
				of individuals with metal implants traveling in air transportation.</text>
								</paragraph><paragraph id="H18FBD216A48F44C5BEBC94AED92C1E02"><enum>(2)</enum><header>Plan</header><text>Not
				later than 6 months after the date of enactment of the Transportation Security
				Administration Authorization Act, the Assistant Secretary shall submit a plan
				to the Committee on Homeland Security of the House of Representatives for
				improving security screening procedures for individuals with metal implants to
				limit disruptions in the screening process while maintaining security. The plan
				shall include an analysis of approaches to limit such disruptions for
				individuals with metal implants, and benchmarks for implementing changes to the
				screening process and the establishment of a credential or system that
				incorporates biometric technology and other applicable technologies to verify
				the identity of an individual who has a metal implant.</text>
								</paragraph><paragraph id="H2CA77FF2F92E4C218B63A6F32A3ECD4B"><enum>(3)</enum><header>Program</header><text>Not
				later than 12 months after the date of enactment of the Transportation Security
				Administration Authorization Act, the Assistant Secretary shall implement a
				program to improve security screening procedures for individuals with metal
				implants to limit disruptions in the screening process while maintaining
				security, including a credential or system that incorporates biometric
				technology or other applicable technologies to verify the identity of an
				individual who has a metal implant.</text>
								</paragraph><paragraph id="H5216349DB5C7473CAC3E7E5A25BED318"><enum>(4)</enum><header>Metal implant
				defined</header><text>In this paragraph, the term ‘metal implant’ means a metal
				device or object that has been surgically implanted or otherwise placed in the
				body of an individual, including any metal device used in a hip or knee
				replacement, metal plate, metal screw, metal rod inside a bone, and other metal
				orthopedic
				implants.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H7834157EFFE84293BFDC99D3FB65A280"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Not later than 180 days
			 after the date of enactment of the Transportation Security Administration
			 Authorization Act, the Secretary of Homeland Security shall submit the plan for
			 security screening procedures for individuals with metal implants, as required
			 by <external-xref legal-doc="usc" parsable-cite="usc/49/44903">section
			 44903(m)</external-xref> of title 49, United States Code.</text>
					</subsection></section><section id="H4C664CE77B7440BF9DA52F094EF7B2C3"><enum>213.</enum><header>Prohibition on
			 outsourcing</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44903">Section
			 44903(j)(2)(C)</external-xref> of title 49, United States Code, is amended by
			 adding at the end the following new clause:</text>
					<quoted-block id="HC29E0B236DE643F09BF3F69680BB281E" style="OLC">
						<clause id="H20E8F399F03B4874A50457DA10B9493C"><enum>(v)</enum><header>Outsourcing
				prohibited</header><text>Upon implementation of the advanced passenger
				prescreening system required by this section, the Assistant Secretary shall
				prohibit any non-governmental entity from administering the function of
				comparing passenger information to the automatic selectee and no fly lists,
				consolidated and integrated terrorist watchlists, or any list or database
				derived from such watchlists for activities related to aviation security. The
				Assistant Secretary shall report to the Committee on Homeland Security of the
				House of Representatives and the Committee on Commerce, Science, and
				Transportation of the Senate when any non-governmental entity is authorized
				access to the watchlists described in this
				clause.</text>

			 traveler credential</header>
					<subsection id="HEB7822DEE15645F7A5EB32339B9AABF7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44903">Section 44903(h)</external-xref> of title 49,
			 United States Code, is amended—</text>
						<paragraph id="H076F3FB1E16244128B796B1FE1386107"><enum>(1)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text>
						</paragraph><paragraph id="H199FDEC3D7FB4363989B0397B3CF9A57"><enum>(2)</enum><text>by inserting after
			 paragraph (6) the following:</text>
							<quoted-block display-inline="no-display-inline" id="HA1314AD1DFB24F37A0F4EA82C426C970" style="OLC">
								<paragraph id="HB8DC87688D484C88B75059FC9454CE2F"><enum>(7)</enum><header>Known air
				traveler credential</header><text display-inline="yes-display-inline">Not later
				than 6 months after the date of enactment of the Transportation Security
				Administration Authorization Act, the Assistant Secretary shall—</text>
									<subparagraph id="H9F45A68C98E14F71B6B3462F06519163"><enum>(A)</enum><text>establish a known
				air traveler credential that incorporates biometric identifier
				technology;</text>
									</subparagraph><subparagraph id="H1C38E787779C4452B5DBA7D36E1FB7AA"><enum>(B)</enum><text>establish a
				process by which the credential will be used to verify the identity of known
				air travelers and allow them to bypass airport passenger and carry-on baggage
				screening;</text>
									</subparagraph><subparagraph id="H1BAF9A5EE3F04AE191E1E69C68DD1B53"><enum>(C)</enum><text>establish
				procedures—</text>
										<clause id="HFB17275D57294D9FA5A99F5F7DC3E4C0"><enum>(i)</enum><text>to
				ensure that only known air travelers are issued the known air traveler
				credential;</text>
										</clause><clause id="H98261B562E224FA2BF169C1EFC43648E"><enum>(ii)</enum><text>to resolve
				failures to enroll, false matches, and false nonmatches relating to use of the
				known air traveler credential; and</text>
										</clause><clause id="H618BF8254E184C14B3C14A26A6CD5215"><enum>(iii)</enum><text>to invalidate
				any known air traveler credential that is lost, stolen, or no longer authorized
				for use;</text>
										</clause></subparagraph><subparagraph id="H9AEB7D19AB3B4CE78EF83D02CB9D1B66"><enum>(D)</enum><text>begin issuance of
				the known air traveler credential to each known air traveler that applies for a
				credential; and</text>
									</subparagraph><subparagraph id="H24561227F8C948F5B150048A81645672"><enum>(E)</enum><text>take such other
				actions with respect to the known air traveler credential as the Assistant
				Secretary considers
				appropriate.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HF0FFC226E990455487180D690D261500"><enum>(b)</enum><header>Known air
			 traveler defined</header><text display-inline="yes-display-inline">Section
			 44903(h)(8) of such title (as redesignated by subsection (a) of this section)
			 is amended—</text>
						<paragraph id="H31477F921EF646A5860D733C21D7924D"><enum>(1)</enum><text>by redesignating
			 subparagraph (F) as subparagraph (G); and</text>
						</paragraph><paragraph id="H3C545AF0F2664D8CA9C4D19BB25D0BDC"><enum>(2)</enum><text>by inserting after
			 subparagraph (E) the following:</text>
							<quoted-block display-inline="no-display-inline" id="H47A887F2F5FB41A9B5AAEBFDFC701B78" style="OLC">
								<subparagraph id="HFA43650376604F90A1779A3BF5512E38"><enum>(F)</enum><header>Known air
				traveler</header><text display-inline="yes-display-inline">The term
				<quote>known air traveler</quote> means a United States citizen who—</text>
									<clause id="HD9D35C7411F4465181A84B28E96BF10F"><enum>(i)</enum><text>has received a
				security clearance from the Federal Government;</text>
									</clause><clause id="HF4066181A45C4578AF4715E618E1B6AC"><enum>(ii)</enum><text>is a Federal
				Aviation Administration certificated pilot, flight crew member, or cabin crew
				member;</text>
									</clause><clause id="H2F7CEF7F99704F179D00D924944E6E03"><enum>(iii)</enum><text>is a Federal,
				State, local, tribal, or territorial government law enforcement officer not
				covered by paragraph (6);</text>
									</clause><clause id="HE8B7E8F27DBA4EC39ECD310372BEB2B9"><enum>(iv)</enum><text>is a member of
				the armed forces (as defined by
				<external-xref legal-doc="usc" parsable-cite="usc/10/101">section
				101</external-xref> of title 10) who has received a security clearance from the
				Federal Government; or</text>
									</clause><clause id="H32E281F5A00E4362BF56105A9BF71974"><enum>(v)</enum><text>the Assistant
				Secretary determines has appropriate security qualifications for inclusion
				under this
				subparagraph.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HBE0AF7FB1B504FDC8950F2A4000EBA51"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as may be necessary to carry out the amendments made by this section.</text>
					</subsection></section><section id="H50CBED5B1D2C4F549EA114FA5882627E"><enum>215.</enum><header>Limitations on
			 use of whole-body imaging technology for aircraft passenger
			 screening</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44901">Section 44901</external-xref> of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H1F5CE4CBC7D14004B2CF482E95596C40" style="USC">
						<subsection id="H698085DB025C4F9C8CCEDFCACA4C1CF1"><enum>(l)</enum><header>Limitations on
				use of whole-body imaging technology for screening passengers</header>
							<paragraph id="HCD6F1B3C008F4C96AB233FC6974B5281"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary of Homeland Security (Transportation Security Administration) shall
				ensure that whole-body imaging technology is used for the screening of
				passengers under this section only in accordance with this subsection.</text>
							</paragraph><paragraph id="HA557DF7EC12D44AABB0EFAD08DF59AF4"><enum>(2)</enum><header>Prohibition on
				use for routine screening</header><text display-inline="yes-display-inline">Whole-body imaging technology may not be
				used as the sole or primary method of screening a passenger under this section.
				Whole-body imaging technology may not be used to screen a passenger under this
				section unless another method of screening, such as metal detection,
				demonstrates cause for preventing such passenger from boarding an
				aircraft.</text>
							</paragraph><paragraph id="H5C1EC4F3A6A04381A48614B92AF53790"><enum>(3)</enum><header>Provision of
				information</header><text display-inline="yes-display-inline">A passenger for
				whom screening by whole-body imaging technology is permissible under paragraph
				(2) shall be provided information on the operation of such technology, on the
				image generated by such technology, on privacy policies relating to such
				technology, and on the right to request a pat-down search under paragraph (4)
				prior to the utilization of such technology with respect to such
				passenger.</text>
							</paragraph><paragraph id="HF1CA87470A074A2AA4159B9BCCED71B5"><enum>(4)</enum><header>Pat-down search
				option</header><text display-inline="yes-display-inline">A passenger for whom
				screening by whole-body imaging technology is permissible under paragraph (2)
				shall be offered a pat-down search in lieu of such screening.</text>
							</paragraph><paragraph id="H38D7432A9ABA479CA0F8DF94E17155C6"><enum>(5)</enum><header>Prohibition on
				use of images</header><text display-inline="yes-display-inline">An image of a
				passenger generated by whole-body imaging technology may not be stored,
				transferred, shared, or copied in any form after the boarding determination
				with respect to such passenger is made.</text>
							</paragraph><paragraph id="H78C0BE293B364C5892D33FF2BED44E72"><enum>(6)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of
				enactment of this section, and annually thereafter, the Assistant Secretary
				shall submit to Congress a report containing information on the implementation
				of this subsection, on the number of passengers for whom screening by
				whole-body imaging technology was permissible under paragraph (2) as a
				percentage of all screened passengers, on the number of passengers who chose a
				pat-down search when presented the offer under paragraph (4) as a percentage of
				all passengers presented such offer, on privacy protection measures taken with
				respect to whole-body imaging technology, on privacy violations that occurred
				with respect to such technology, and on the effectiveness of such
				technology.</text>
							</paragraph><paragraph id="H6416049252AD45A8AA730E0E7725D903"><enum>(7)</enum><header>Definitions</header><text>In
				this subsection, the following definitions apply:</text>
								<subparagraph id="H952E79CF1C6A4C2CBAB694C27D30BAFF"><enum>(A)</enum><header>Pat-down
				search</header><text display-inline="yes-display-inline">The term
				<term>pat-down search</term> means a physical inspection of the body of an
				aircraft passenger conducted in accordance with the Transportation Security
				Administration’s standard operating procedure as described in the
				Transportation Security Administration’s official training manual.</text>
								</subparagraph><subparagraph id="HD1162DAB21DF415D89321A9029DFCA22"><enum>(B)</enum><header>Whole-body
				imaging technology</header><text display-inline="yes-display-inline">The term
				<term>whole-body imaging technology</term> means a device, including a device
				using backscatter x-rays or millimeter waves, used to detect objects carried on
				individuals and that creates a visual image of the individual’s full body,
				showing the surface of the skin and revealing objects that are on the
				body.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></subtitle><subtitle id="H76C93F27815C4A34B2D9B198AE9F2DD3"><enum>B</enum><header>Other
			 Matters</header>
				<section display-inline="no-display-inline" id="HC59E7E1BD9D74C0F8937E896149DC7E6" section-type="subsequent-section"><enum>221.</enum><header>Security risk
			 assessment of airport perimeter access controls</header>
					<subsection id="HD222A2CC67334957AF6372D8C47C8965"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall develop a strategic risk-based plan to improve transportation
			 security at airports that includes best practices to make airport perimeter
			 access controls more secure at all commercial service and general aviation
			 airports.</text>
					</subsection><subsection id="HF1795B7640D04666B11947DDC1FAD0FD"><enum>(b)</enum><header>Contents</header><text>The
			 plan shall—</text>
						<paragraph id="H9DB2AF73ED8A49B78187A752828FF62A"><enum>(1)</enum><text>incorporate best
			 practices for enhanced perimeter access controls;</text>
						</paragraph><paragraph id="HDCD47434F86F4CFFA7E032E5579706BF"><enum>(2)</enum><text>evaluate and
			 incorporate major findings of all relevant pilot programs of the Transportation
			 Security Administration;</text>
						</paragraph><paragraph id="HCE6DA563238A42F2AF884CC7838BD93E"><enum>(3)</enum><text>address
			 recommendations of the Comptroller General on perimeter access controls;</text>
						</paragraph><paragraph id="HF1B604359F39463DB6F6C60A2A6515DD"><enum>(4)</enum><text>include a
			 requirement that airports update their security plans to incorporate the best
			 practices, as appropriate, based on risk and adapt the best practices to meet
			 the needs specific to their facilities; and</text>
						</paragraph><paragraph id="HA72014A6E9054920A5A8999A4E6252C5"><enum>(5)</enum><text display-inline="yes-display-inline">include an assessment of the role of new
			 and emerging technologies, including unmanned and autonomous perimeter security
			 technologies, that could be utilized at both commercial and general aviation
			 facilities.</text>
						</paragraph></subsection></section><section id="HD48D6F7B2DED4F73BF3D2AEFA4E20E2F"><enum>222.</enum><header>Advanced
			 passenger prescreening system</header>
					<subsection id="H68BD9D3098824D97A2ACCC18C0C7AD12"><enum>(a)</enum><header>Initial
			 report</header><text display-inline="yes-display-inline">Not later than 90 days
			 after the date of enactment of this Act, the Comptroller General shall submit
			 to the Committee on Homeland Security of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report
			 that—</text>
						<paragraph id="H2A9589FDEAF74443A5E5C1BC41B99CC6"><enum>(1)</enum><text>describes the
			 progress made by the Department of Homeland Security in implementing the
			 advanced passenger prescreening system;</text>
						</paragraph><paragraph id="HF35F498007904122A5A034AC9AD77B5A"><enum>(2)</enum><text display-inline="yes-display-inline">compares the total number of misidentified
			 passengers who must undergo secondary screening or have been prevented from
			 boarding a plane during the 3-month period beginning 90 days before the date of
			 enactment of the Transportation Security Administration Authorization Act with
			 the 3-month period beginning 90 days after such date; and</text>
						</paragraph><paragraph id="HB995CBADDF62487CBD1A4C7CE7471FEF"><enum>(3)</enum><text>includes any other
			 relevant recommendations that the Inspector General of the Department of
			 Homeland Security or the Comptroller General determines appropriate.</text>
						</paragraph></subsection><subsection id="H12E196F76EDA480C8249CB11E469C79C"><enum>(b)</enum><header>Subsequent
			 reports</header><text>The Comptroller General shall submit subsequent reports
			 on the implementation to such Committees every 90 days thereafter until the
			 implementation is complete.</text>
					</subsection></section><section id="H7EE9E860D4DC4D149A456F45D308EFA5"><enum>223.</enum><header>Biometric
			 identifier airport access enhancement demonstration program</header>
					<subsection id="HA774AA8B9F5347B5AC2EA3439101EE10"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall carry out a demonstration program under which biometric
			 identifier access systems for individuals with unescorted access to secure or
			 sterile areas of an airport, including airport employees and flight crews, are
			 evaluated for the purposes of enhancing transportation security at airports and
			 to determine how airports can implement uniform biometric identifier and
			 interoperable security systems.</text>
					</subsection><subsection id="HFA02CA5B363D4B6E8D58F21359399CAD"><enum>(b)</enum><header>Airports
			 participating in program</header><text>The Assistant Secretary shall select at
			 least 7 airports, including at least 2 large airports, to participate in the
			 demonstration program.</text>
					</subsection><subsection id="HE0715D62FD39454B882853F3CA692357"><enum>(c)</enum><header>Initiation and
			 duration of program</header>
						<paragraph id="H4634F65B73F74A3D85A5C528A456E7FE"><enum>(1)</enum><header>Deadline for
			 initiation</header><text>The Assistant Secretary shall conduct the
			 demonstration program not later than one year after the date of enactment of
			 this Act.</text>
						</paragraph><paragraph id="HFB162CAE106D46E580C801C49293B266"><enum>(2)</enum><header>Duration</header><text>The
			 program shall have a duration of not less than 180 days and not more than one
			 year.</text>
						</paragraph></subsection><subsection id="HD4D2E502176E4E4F9AD845DFAF1A1636"><enum>(d)</enum><header>Required
			 elements</header><text display-inline="yes-display-inline">In conducting the
			 demonstration program, the Assistant Secretary shall—</text>
						<paragraph id="HB869883A51C94B558203F0A9BFF3DA7E"><enum>(1)</enum><text>assess best
			 operational, administrative, and management practices in creating uniform,
			 standards-based, and interoperable biometric identifier systems for all
			 individuals with access to secure or sterile areas of commercial service
			 airports; and</text>
						</paragraph><paragraph id="H141BEF0D2E9447F196ED84F8461E77F3"><enum>(2)</enum><text>conduct a
			 risk-based analysis of the selected airports and other airports, as the
			 Assistant Secretary determines appropriate, to identify where the
			 implementation of biometric identifier systems could benefit security.</text>
						</paragraph></subsection><subsection id="H4D0D56F76929471F8ABAF798B3FEAA03"><enum>(e)</enum><header>Considerations</header><text>In
			 conducting the demonstration program, the Assistant Secretary shall consider,
			 at a minimum, the following:</text>
						<paragraph id="H3F4478055B5B4C35BAAE8B1D8BDBAFF3"><enum>(1)</enum><header>Parallel
			 systems</header><text>Existing parallel biometric transportation security
			 systems applicable to workers with unescorted access to transportation systems,
			 including—</text>
							<subparagraph display-inline="no-display-inline" id="HAAF3764EB8CA4C2B8B9942F6CECA77B5"><enum>(A)</enum><text>transportation
			 worker identification credentials issued under
			 <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
			 70105</external-xref> of title 46, United States Code;</text>
							</subparagraph><subparagraph id="HDCC6B5699D354CB0A68CA7C7CB218223"><enum>(B)</enum><text display-inline="yes-display-inline">armed law enforcement travel credentials
			 issued under <external-xref legal-doc="usc" parsable-cite="usc/49/44903">section 44903(h)(6)</external-xref> of title 49,
			 United States Code; and</text>
							</subparagraph><subparagraph id="H9096BD4B09854D1A91BA40B317CB95FC"><enum>(C)</enum><text>other credential
			 and biometric identifier systems used by the Federal Government, as the
			 Assistant Secretary considers appropriate.</text>
							</subparagraph></paragraph><paragraph id="HA4CDF94BAAA54B3188092DE26D45193D"><enum>(2)</enum><header>Efforts by
			 Transportation Security Administration</header><text display-inline="yes-display-inline">Any biometric identifier system or
			 proposals developed by the Assistant Secretary.</text>
						</paragraph><paragraph id="H71241AB1329B46BC8BAD99CD74993457"><enum>(3)</enum><header>Infrastructure
			 and technical requirements</header><text>The architecture, modules, interfaces,
			 and transmission of data needed for airport security operations.</text>
						</paragraph><paragraph id="H779547F471074F7DBC43AF0436370D2B"><enum>(4)</enum><header>Existing airport
			 systems</header><text display-inline="yes-display-inline">Credentialing and
			 access control systems in use in secure and sterile areas of airports.</text>
						</paragraph><paragraph id="HF5877B64B8B3423BA70646FBE6543CE5"><enum>(5)</enum><header>Associated
			 costs</header><text>The costs of implementing uniform, standards-based, and
			 interoperable biometric identifier systems at airports, including—</text>
							<subparagraph id="H55DEA7ECA46C499F9A939CA8029880DB"><enum>(A)</enum><text>the costs to
			 airport operators, airport workers, air carriers, and other aviation industry
			 stakeholders; and</text>
							</subparagraph><subparagraph id="HC5063189F1404B4A8C11D0EE9D7230A5"><enum>(B)</enum><text>the costs
			 associated with ongoing operations and maintenance and modifications and
			 enhancements needed to support changes in physical and electronic
			 infrastructure.</text>
							</subparagraph></paragraph><paragraph id="H711617EFD737459D91A88324B9E43EB9"><enum>(6)</enum><header>Information from
			 other sources</header><text>Recommendations, guidance, and information from
			 other sources, including the Inspector General of the Department of Homeland
			 Security, the Comptroller General, the heads of other governmental entities,
			 organizations representing airport workers, and private individuals and
			 organizations.</text>
						</paragraph></subsection><subsection id="H49B753508DE54C689DF28B590481809A"><enum>(f)</enum><header>Identification
			 of best practices</header><text display-inline="yes-display-inline">In
			 conducting the demonstration program, the Assistant Secretary shall identify
			 best practices for the administration of biometric identifier access at
			 airports, including best practices for each of the following processes:</text>
						<paragraph id="H7719644F13F44145B1530C278BE1118A"><enum>(1)</enum><text>Registration,
			 vetting, and enrollment.</text>
						</paragraph><paragraph id="H1B23A81FCB3E4272AC744F2AD41ADDA7"><enum>(2)</enum><text>Issuance.</text>
						</paragraph><paragraph id="H7BDE8AD0A7F74AC6868B5BA59CCE484E"><enum>(3)</enum><text>Verification and
			 use.</text>
						</paragraph><paragraph id="H5D6B3288CFE9480D863115BC45958101"><enum>(4)</enum><text>Expiration and
			 revocation.</text>
						</paragraph><paragraph id="HCD5E286865AF4CD3B80B435B766B0885"><enum>(5)</enum><text>Development of a
			 cost structure for acquisition of biometric identifier credentials.</text>
						</paragraph><paragraph id="HD85AE587D2764C64A27B104F70C86A18"><enum>(6)</enum><text>Development of
			 redress processes for workers.</text>
						</paragraph></subsection><subsection id="H2C96C7B8C3824C139327331F8B43F169"><enum>(g)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the demonstration program,
			 the Assistant Secretary shall consult with the Aviation Security Advisory
			 Committee regarding how airports may transition to uniform, standards-based,
			 and interoperable biometric identifier systems for airport workers and others
			 with unescorted access to secure or sterile areas of an airport.</text>
					</subsection><subsection id="H8352EFA07F9F45FDB88688526BC6BA5A"><enum>(h)</enum><header>Evaluation</header><text>The
			 Assistant Secretary shall conduct an evaluation of the demonstration program to
			 specifically assess best operational, administrative, and management practices
			 in creating a standard, interoperable, biometric identifier access system for
			 all individuals with access to secure or sterile areas of commercial service
			 airports.</text>
					</subsection><subsection id="H2246A0EB2E2F4C0FAB1040A783A462E2"><enum>(i)</enum><header>Report to
			 Congress</header><text>Not later than 180 days after the last day of that
			 demonstration program ends, the Assistant Secretary shall submit to the
			 appropriate congressional committees, including the Committee on Homeland
			 Security of the House of Representatives, a report on the results of the
			 demonstration program. The report shall include possible incentives for
			 airports that voluntarily seek to implement uniform, standards-based, and
			 interoperable biometric identifier systems.</text>
					</subsection><subsection id="HDE066EA5BA2645FABF2371A33CFF9A10"><enum>(j)</enum><header>Biometric
			 identifier system defined</header><text>In this section, the term
			 <term>biometric identifier system</term> means a system that uses biometric
			 identifier information to match individuals and confirm identity for
			 transportation security and other purposes.</text>
					</subsection><subsection id="HD73440C0479A4246B5A465781667943C"><enum>(k)</enum><header>Authorization of
			 appropriations</header><text>From amounts authorized under section 101, there
			 is authorized to be appropriated a total of $20,000,000 to carry out this
			 section for fiscal years 2010 and 2011.</text>
					</subsection></section><section id="HDA09E23D96F744E08EBA4E0FA002340D"><enum>224.</enum><header>Transportation
			 security training programs</header><text display-inline="no-display-inline">Not
			 later than one year after the date of enactment of this Act, the Assistant
			 Secretary shall establish recurring training of transportation security
			 officers regarding updates to screening procedures and technologies in response
			 to weaknesses identified in covert tests at airports. The training shall
			 include—</text>
					<paragraph id="H1FB675A39C7A4EB3A77D4CF3F2187E41"><enum>(1)</enum><text>internal controls
			 for monitoring and documenting compliance of transportation security officers
			 with training requirements;</text>
					</paragraph><paragraph id="H9E57816C310A418490E7F5CCACF71DB0"><enum>(2)</enum><text>the availability
			 of high-speed Internet and Intranet connectivity to all airport training
			 facilities of the Administration; and</text>
					</paragraph><paragraph id="H4688330CFD23448AA074FE95B04071B4"><enum>(3)</enum><text>such other matters
			 as identified by the Assistant Secretary with regard to training.</text>
					</paragraph></section><section id="H979942BB14534C1399D500E5B01DAEB1"><enum>225.</enum><header>Deployment of
			 technology approved by science and technology directorate</header>
					<subsection id="H4F9A93316FA3440F8BE659B4B0515660"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Assistant
			 Secretary, in consultation with the Directorate of Science and Technology of
			 the Department of Homeland Security, shall develop and submit to the
			 appropriate committees of Congress, including the Committee on Homeland
			 Security of the House of Representatives, a strategic plan for the
			 certification and integration of technologies for transportation security with
			 high approval or testing results from the Directorate and the Transportation
			 Security Laboratory of the Department.</text>
					</subsection><subsection id="H731488BFF58A4DC89CB4FE5B0AFE8FEF"><enum>(b)</enum><header>Contents of
			 strategic plan</header><text display-inline="yes-display-inline">The strategic
			 plan developed under subsection (a) shall include—</text>
						<paragraph id="H0FC789FFA8894CEC88071230417F3AEA"><enum>(1)</enum><text display-inline="yes-display-inline">a cost-benefit analysis to assist in
			 prioritizing investments in new checkpoint screening technologies that compare
			 the costs and benefits of screening technologies being considered for
			 development or acquisition with the costs and benefits of other viable
			 alternatives;</text>
						</paragraph><paragraph id="HB78FA44215CD464099071DE451B0E1A7"><enum>(2)</enum><text>quantifiable
			 performance measures to assess the extent to which investments in research,
			 development, and deployment of checkpoint screening technologies achieve
			 performance goals for enhancing security at airport passenger checkpoints;
			 and</text>
						</paragraph><paragraph id="H3C2723D9520D443188BBC73831E8AAFB"><enum>(3)</enum><text>a
			 method to ensure that operational tests and evaluations have been successfully
			 completed in an operational environment before deploying checkpoint screening
			 technologies to airport checkpoints.</text>
						</paragraph></subsection><subsection id="H58EA636E19A841E9A13721D472B974C3"><enum>(c)</enum><header>Report to
			 Congress</header>
						<paragraph id="H019589C801A14838AFF5AC78D1B37754"><enum>(1)</enum><header>In
			 general</header><text>The Assistant Secretary shall submit to the appropriate
			 committees of Congress, including the Committee on Homeland Security of the
			 House of Representatives, an annual report on the status of all technologies
			 that have undergone testing and evaluation, including technologies that have
			 been certified by the Department, and any technologies used in a demonstration
			 program administered by the Administration. The report shall also specify
			 whether the technology was submitted by an academic institution, including an
			 institution of higher education eligible to receive assistance under title III
			 or V of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1051">20 U.S.C. 1051 et seq.</external-xref> and 1101 et
			 seq.)</text>
						</paragraph><paragraph id="H31CB5B08FB464A589F294DEA7B914240"><enum>(2)</enum><header>First
			 report</header><text>The first report submitted under this subsection shall
			 assess such technologies for a period of not less than 2 years.</text>
						</paragraph></subsection></section><section id="H72E5375AC33346138EB7A627F0673B3D"><enum>226.</enum><header>In-line baggage
			 screening study</header><text display-inline="no-display-inline">The Assistant
			 Secretary shall consult with the Advisory Committee and report to the
			 appropriate committees of Congress, including the Committee on Homeland
			 Security of the House of Representatives, on deploying optimal baggage
			 screening solutions and replacing baggage screening equipment nearing the end
			 of its life cycle at commercial service airports. Specifically, the report
			 shall address the Administration’s plans, estimated costs, and current
			 benchmarks for replacing explosive detection equipment that is nearing the end
			 of its life cycle.</text>
				</section><section id="H8A8E95527A844DE3A6EFA29E8C087FAC"><enum>227.</enum><header>In-line checked
			 baggage screening systems</header>
					<subsection id="H56FD072278B744D094B8EC34C6A1F726"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
						<paragraph id="H3AE1DDA2BCC04C47AC8F87E561470452"><enum>(1)</enum><text>Since its
			 inception, the Administration has procured and installed over 2,000 explosive
			 detection systems (referred to in this section as <quote>EDS</quote>) and 8,000
			 explosive trace detection (referred to in this section as <quote>ETD</quote>)
			 systems to screen checked baggage for explosives at the Nation’s commercial
			 airports.</text>
						</paragraph><paragraph id="H87807C79F4904DDC8BFED1F083AD2238"><enum>(2)</enum><text>Initial deployment
			 of stand-alone EDS machines in airport lobbies resulted in operational
			 inefficiencies and security risks as compared to using EDS machines integrated
			 in-line with airport baggage conveyor systems.</text>
						</paragraph><paragraph id="H9344D4CF1DB8421894F5F23B43DB67E7"><enum>(3)</enum><text>The Administration
			 has acknowledged the advantages of fully integrating in-line checked baggage
			 EDS systems, especially at large airports. According to the Administration,
			 in-line EDS systems have proven to be cost-effective and more accurate at
			 detecting dangerous items.</text>
						</paragraph><paragraph id="H0E6652FF125A4153A10F100B1FA73734"><enum>(4)</enum><text>As a result of the
			 large upfront capital investment required, these systems have not been deployed
			 on a wide-scale basis. The Administration estimates that installing and
			 operating the optimal checked baggage screening systems could potentially cost
			 more than $20,000,000,000 over 20 years.</text>
						</paragraph><paragraph id="H30BF8877179E46449BA60BACF6881FF7"><enum>(5)</enum><text>Nearly
			 $2,000,000,000 has been appropriated for the installation of in-line explosive
			 detection systems, including necessary baggage handling system improvements,
			 since 2007.</text>
						</paragraph><paragraph id="H5F24F4D04CED4D0182BC463B85096CCB"><enum>(6)</enum><text>Despite
			 substantial funding, the Administration has made limited progress in deploying
			 optimal screening solutions, including in-line systems, to 250 airports
			 identified in its February 2006 strategic planning framework.</text>
						</paragraph></subsection><subsection id="H38288FF2380147E8AE3FD9BB48118642"><enum>(b)</enum><header>GAO
			 report</header><text>The Comptroller General shall submit to the Committee on
			 Homeland Security of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report on the
			 Administration’s progress in deploying optimal baggage screening solutions and
			 replacing aging baggage screening equipment at the Nation’s commercial
			 airports. The report shall also include an analysis of the Administration’s
			 methodology for expending public funds to deploy in-line explosive detection
			 systems since 2007. The report shall address, at a minimum—</text>
						<paragraph id="HD22DB96AC3ED4CD7A698116B89F3DF6E"><enum>(1)</enum><text>the
			 Administration’s progress in deploying optimal screening solutions at the
			 Nation’s largest commercial airports, including resources obligated and
			 expended through fiscal year 2009;</text>
						</paragraph><paragraph id="H92257EB6303849169FC262BD2BA3637A"><enum>(2)</enum><text>the potential
			 benefits and challenges associated with the deployment of optimal screening
			 solutions at the Nation’s commercial airports; and</text>
						</paragraph><paragraph id="HB0445C27F7D64CA39FD618B994807531"><enum>(3)</enum><text>the
			 Administration’s plans, estimated costs, and current milestones for replacing
			 EDS machines that are nearing the end of their estimated useful product
			 lives.</text>
						</paragraph></subsection><subsection id="HD27D61AD203347329FAF2E7BCE34DD09"><enum>(c)</enum><header>Updates
			 required</header><text>Not later than 6 months after submitting the report
			 required in subsection (b) and every 6 months thereafter until the funds
			 appropriated for such systems are expended, the Comptroller General shall
			 provide the Committee on Homeland Security of the House of Representatives an
			 update regarding its analysis of the Administration’s expenditures for
			 explosive detection and in-line baggage systems.</text>
					</subsection></section><section id="H069C82857C6D433CB0367E753BCE938E"><enum>228.</enum><header>IG report on
			 certain policies for Federal air marshals</header><text display-inline="no-display-inline">Not later than 120 days after the date of
			 enactment of this Act, the Inspector General of the Department of Homeland
			 Security shall review the minimum standards and policies regarding rest periods
			 between deployments and any other standards or policies applicable to Federal
			 air marshals reporting to duty. After such review, the Inspector General shall
			 make any recommendations to such standards and policies the Inspector General
			 considers necessary to ensure an alert and responsible workforce of Federal air
			 marshals.</text>
				</section><section id="H6D34FAFD2A6540E7BC392FE65FB1C6E2"><enum>229.</enum><header>Explosives
			 detection canine teams minimum for aviation security</header>
					<subsection id="HE16A34F27EBC49D1956D1CCA7E5AD5AF"><enum>(a)</enum><header>Aviation
			 security</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall ensure that the number of explosives detection canine teams for
			 aviation security is not less than 250 through fiscal year 2011.</text>
					</subsection><subsection id="H2C54BFFEB36A4F98AB6F467415820384"><enum>(b)</enum><header>Cargo
			 screening</header><text display-inline="yes-display-inline">The Secretary shall
			 increase the number of canine detection teams, as of the date of enactment of
			 this Act, deployed for the purpose of meeting the 100 percent air cargo
			 screening requirement set forth in
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44901">section
			 44901(g)</external-xref> of title 49, United States Code, by not less than 100
			 canine teams through fiscal year 2011.</text>
					</subsection></section><section id="H642FE5691C074F3F96A06B3479DDC1EA"><enum>230.</enum><header>Assessments and
			 GAO Report of inbound air cargo screening</header><text display-inline="no-display-inline">Section 1602 of the Implementing
			 Recommendations of the 9/11 Commission Act of 2007 (121 Stat. 478) is amended
			 by inserting at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD6B2C08BF09F4B8BBB101D8CCAA56550" style="OLC">
						<subsection id="H7348FB6EFBCC49C2B88DE761CF02666E"><enum>(c)</enum><header>Assessment of
				inbound compliance</header><text>Upon establishment of the inbound air cargo
				screening system, the Assistant Secretary shall submit a report to the
				Committee on Homeland Security in the House of Representatives on the impact,
				rationale, and percentage of air cargo being exempted from screening under
				exemptions granted under
				<external-xref legal-doc="usc" parsable-cite="usc/49/44901">section
				44901(i)(1)</external-xref> of title 49, United States Code.</text>
						</subsection><subsection id="HE7796BACC3124F4FB31C6D90FC3215A8"><enum>(d)</enum><header>GAO
				report</header><text>Not later than 120 days after the date of enactment of
				this Act and quarterly thereafter, the Comptroller General shall review the air
				cargo screening system for inbound passenger aircraft and report to the
				Committee on Homeland Security in the House of Representatives on the status of
				implementation, including the approximate percentage of cargo being screened,
				as well as the Administration’s methods to verify the screening system’s
				implementation.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HA577BCF66A4B4663A772F93BF43785DD"><enum>231.</enum><header>Status of
			 efforts to promote air cargo shipper certification</header><text display-inline="no-display-inline">Not
			 later than 180 days after the date of enactment of this Act, the Assistant
			 Secretary shall submit to the Committee on Homeland Security of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation of
			 the Senate a report on the status of the implementation of the Administration’s
			 plan to promote a program to certify the screening methods used by shippers in
			 a timely manner, in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44901">section
			 44901(g)</external-xref> of title 49, United States Code, including
			 participation by shippers with robust and mature internal security
			 programs.</text>
				</section><section id="H0A1CB1BF304342C5AA36BB6C9CD1DF64"><enum>232.</enum><header>Full and open
			 competition in security background screening service</header><text display-inline="no-display-inline">Not later than 9 months after the date of
			 enactment of this section, the Secretary shall publish in the Federal Register
			 a notice that the selection process for security background screening services
			 for persons requiring background screening in the aviation industry is subject
			 to full and open competition. The notice shall include—</text>
					<paragraph id="H3E6A4C02A26D409F89D2C63189E3DFBA"><enum>(1)</enum><text>a
			 statement that airports and other affected entities are not required to use a
			 single service provider of background screening services and may use the
			 services of other providers approved by the Assistant Secretary;</text>
					</paragraph><paragraph id="HEB375540D3F548C7ACFFF9D14035C061"><enum>(2)</enum><text>any requirements
			 for disposal of personally identifiable information by the approved provider by
			 a date certain; and</text>
					</paragraph><paragraph id="HC0B8DF4A331947D1A3806E2B3C86F300"><enum>(3)</enum><text>information on all
			 technical specifications and other criteria required by the Assistant Secretary
			 to approve a background screening service provider.</text>
					</paragraph></section><section id="H23D21FB87FE6461FB46CE6468D33F019"><enum>233.</enum><header>Trusted
			 passenger/Registered Traveler program</header>
					<subsection id="H7EA1B25EB8A44CBB80EE47898E9D389B"><enum>(a)</enum><header>Assessments and
			 background checks</header>
						<paragraph id="H554DDA9A174C4CED808B6460FBE17926"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to paragraph
			 (2) and not later than 120 days after the date of enactment of this Act, to
			 enhance aviation security through risk management at airport checkpoints
			 through use of a trusted passenger program, commonly referred to as the
			 Registered Traveler program, established pursuant to section 109(a)(3) of the
			 Aviation Transportation Security Act (115 Stat. 597), the Assistant Secretary
			 shall—</text>
							<subparagraph id="H58E9B783C7104CE2A7D777A429A531E5"><enum>(A)</enum><text display-inline="yes-display-inline">reinstate an initial and continuous
			 security threat assessment program as part of the Registered Traveler
			 enrollment process; and</text>
							</subparagraph><subparagraph id="H9533702E2D724F27BC5229331E461996"><enum>(B)</enum><text display-inline="yes-display-inline">allow Registered Traveler providers to
			 perform private sector background checks as part of their enrollment process
			 with assurance that the program shall be undertaken in a manner consistent with
			 constitutional privacy and civil liberties protections and be subject to
			 approval and oversight by the Assistant Secretary.</text>
							</subparagraph></paragraph><paragraph id="HA02C5E64D14741EFA97C5DE75011C5A9"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The Assistant Secretary shall not reinstate
			 the threat assessment component of the Registered Traveler program or allow
			 certain background checks unless the Assistant Secretary—</text>
							<subparagraph id="H8D9A4FDD2E0445C899F4A3598155409E"><enum>(A)</enum><text display-inline="yes-display-inline">determines that the Registered Traveler
			 program, in accordance with this subsection, is integrated into risk-based
			 aviation security operations; and</text>
							</subparagraph><subparagraph id="H42CFEA705F0D4138BD0F905CAA69200C"><enum>(B)</enum><text>expedites
			 checkpoint screening, as appropriate, for Registered Traveler members who have
			 been subjected to a security threat assessment and the private sector
			 background check under this subsection.</text>
							</subparagraph></paragraph></subsection><subsection id="H8425ECCB177D4DFFAC5DA2A12A0BAA55"><enum>(b)</enum><header>Notification</header>
						<paragraph id="H958988D8A2B44A9C8508D439A5AE7CE4"><enum>(1)</enum><header>Contents</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, if the Assistant Secretary determines that the
			 Registered Traveler program can be integrated into risk-based aviation security
			 operations under subsection (a), the Assistant Secretary shall report to the
			 Committee on Homeland Security of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate
			 regarding—</text>
							<subparagraph id="H12787CBAC50540249001BB17DF224A52"><enum>(A)</enum><text display-inline="yes-display-inline">the level of risk reduction provided by
			 carrying out section (a); and</text>
							</subparagraph><subparagraph id="H8436266314B64399B73F95B062EBF0A6"><enum>(B)</enum><text>how the Registered
			 Traveler program has been integrated into risk-based aviation security
			 operations.</text>
							</subparagraph></paragraph><paragraph id="H174886A08D734B3A84C6B112494E2052"><enum>(2)</enum><header>Changes to
			 protocol</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall also set forth what changes to the program, including screening
			 protocols, have been implemented to realize the full potential of the
			 Registered Traveler program.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="H18ABBA672D1D415F80E2E8D33EA958AC"><enum>(c)</enum><header>Treatment of
			 individuals with top secret security clearances</header><text>Not later than
			 180 days after the date of enactment of this Act, the Assistant Secretary shall
			 establish protocols to—</text>
						<paragraph id="H7A1BBE0219864E549234561250A3C216"><enum>(1)</enum><text>verify the
			 identity of United States citizens who participate in the Registered Traveler
			 program and possess a valid top secret security clearance granted by the
			 Federal Government; and</text>
						</paragraph><paragraph id="H8275D358B1D24BEF96A5F4BF59D50F95"><enum>(2)</enum><text display-inline="yes-display-inline">allow alternative screening procedures for
			 individuals described in paragraph (1), including random, risk-based screening
			 determined necessary to respond to a specific threat to security identified
			 pursuant to a security threat assessment.</text>
						</paragraph></subsection><subsection id="H63CEAF79036C40F7A38DDE812E13D644"><enum>(d)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 section shall be construed to authorize any nongovernmental entity to perform
			 vetting against the terrorist screening database maintained by the
			 Administration.</text>
					</subsection></section><section id="H41348C28FBE64607977072D8235FA8EB"><enum>234.</enum><header>Report on cabin
			 crew communication</header><text display-inline="no-display-inline">Not later
			 than one year after the date of enactment of this Act, the Assistant Secretary,
			 in consultation with the Advisory Committee established under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44946">section
			 44946</external-xref> of title 49, United States Code, shall prepare a report
			 that assesses technologies and includes standards for the use of wireless
			 devices to enhance transportation security on aircraft for the purpose of
			 ensuring communication between and among cabin crew and pilot crewmembers,
			 embarked Federal air marshals, and authorized law enforcement officials, as
			 appropriate.</text>
				</section><section id="H4D2FF1C38031449E8B2AFF733641D380"><enum>235.</enum><header>Air cargo crew
			 training</header><text display-inline="no-display-inline">The Assistant
			 Secretary, in consultation with the Advisory Committee established under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44946">section
			 44946</external-xref> of title 49, United States Code, shall develop a plan for
			 security training for the all-cargo aviation threats for pilots and, as
			 appropriate, other crewmembers operating in all-cargo transportation.</text>
				</section><section id="HBC7BE8DE82A04448B172E426EA80E156"><enum>236.</enum><header>Reimbursement
			 for airports that have incurred eligible costs</header>
					<subsection id="HBF25271BF3894F838C9D833B39816D88"><enum>(a)</enum><header>Process</header><text display-inline="yes-display-inline">Section 1604(b)(2) of the Implementing
			 Recommendations of the 9/11 Commission Act of 2007 (121 Stat. 481) is amended
			 to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H8454E9D33B3646EE8DA643C6757CB34C" style="OLC">
							<paragraph id="H99F3AC7098044275996055811B8F0677"><enum>(2)</enum><header>Airports that
				have incurred eligible costs</header>
								<subparagraph id="HFF7745078C1745C09DCBCAE3B5B30F2F"><enum>(A)</enum><header>In
				general</header><text>Not later than 60 days after the date of enactment of the
				Transportation Security Administration Authorization Act, the Assistant
				Secretary of Homeland Security (Transportation Security Administration) shall
				establish a process for resolving reimbursement claims for airports that have
				incurred, before the date of enactment of this Act, eligible costs associated
				with development of partial or completed in-line baggage systems.</text>
								</subparagraph><subparagraph id="H55082FCFC69A405284E237135FC76EDA"><enum>(B)</enum><header>Process for
				receiving reimbursement</header><text>The process shall allow an
				airport—</text>
									<clause id="H1A43A59BCB124E9DBFCF313124236E44"><enum>(i)</enum><text>to
				submit a claim to the Assistant Secretary for reimbursement for eligible costs
				described in subparagraph (A); and</text>
									</clause><clause id="HEC868538914A489C8DD3C0F61921CAAD"><enum>(ii)</enum><text>not later than
				180 days after date on which the airport submits the claim, to receive a
				determination on the claim and, if the determination is positive, to be
				reimbursed.</text>
									</clause></subparagraph><subparagraph id="HC2565787C8DD4C0FA587B3D7E48AF1BB"><enum>(C)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date on
				which the Assistant Secretary establishes the process under subparagraph (B),
				the Assistant Secretary shall submit to the Committee on Homeland Security of
				the House of Representatives a report containing a description of the process,
				including a schedule for the timely reimbursement of airports for which a
				positive determination has been
				made.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HFDB0DA25361D4748A879CB4ECDE5C22B"><enum>(b)</enum><header>Reimbursements
			 of airports for eligible costs reimbursed at less than 90
			 percent</header><text>If the Secretary or Assistant Secretary reimbursed, after
			 August 3, 2007, an airport that incurred an amount for eligible costs under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/44923">section
			 44923</external-xref> of title 49, United States Code, that was less than 90
			 percent of such costs, the Secretary or Assistant Secretary shall reimburse
			 such airport under such section an amount equal to the difference for such
			 eligible costs.</text>
					</subsection></section><section id="H95D8ACE08DE646F8A663752D0DD935EB"><enum>237.</enum><header>Report on whole
			 body imaging technology</header><text display-inline="no-display-inline">Upon
			 completion of the ongoing whole body imaging technology pilot, the Assistant
			 Secretary shall submit a report to the Committee on Homeland Security of the
			 House of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate on the results of the pilot, including how privacy
			 protections were integrated.</text>
				</section><section id="H405BA7EEC1FB4E179F53FD09881AF309"><enum>238.</enum><header>Protective
			 equipment</header>
					<subsection id="H5CFD0C06A0C24C59BBB0D9BF1A121505"><enum>(a)</enum><header>Use of personal
			 protective equipment</header>
						<paragraph id="HBB4BFB7DA4D8485CBDA25C5274B4F840"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any personnel of the
			 Transportation Security Administration voluntarily may wear personal protective
			 equipment during any emergency.</text>
						</paragraph><paragraph id="H18ED9AB4F55B4B898C7733218E6063F4"><enum>(2)</enum><header>Written
			 guidance</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary of Homeland Security shall establish, coordinate, and
			 disseminate written guidance to personnel of the Transportation Security
			 Administration to allow for the voluntary usage of personal protective
			 equipment.</text>
						</paragraph><paragraph id="HA4822EC8D62144358102A2A62D78C0D8"><enum>(3)</enum><header>Definition</header><text>In
			 this subsection, the term <quote>personal protective equipment</quote> includes
			 surgical and N95 masks, gloves, and hand sanitizer.</text>

			 screening for members of the Armed Forces</header>
					<subsection id="H54836B35534A41A9AC94D7F2E6A4718B"><enum>(a)</enum><header>In

				plan to provide expedited security screening services for a member of the Armed
				Forces, and any accompanying family member, when the member of the Armed Forces
				is traveling on official orders while in uniform through a primary airport (as
				defined by section 47102).</text>
								</paragraph><paragraph id="HB78FB5D8C3324714949601DA9EE54822"><enum>(2)</enum><header>Protocols</header><text>In
				developing the plan, the Assistant Secretary shall consider—</text>
									<subparagraph id="HB873E74807204F848F9D7D21F18BD69D"><enum>(A)</enum><text>leveraging
				existing security screening models used by airports and air carriers to reduce
				passenger wait times before entering a security screening checkpoint;</text>
									</subparagraph><subparagraph id="HFA697447925A49239AC3E63B0ED05BB3"><enum>(B)</enum><text>establishing
				standard guidelines for the screening of military uniform items, including
				combat boots; and</text>
									</subparagraph><subparagraph id="HB63F6B95231148BAB5D0A0AC29784135"><enum>(C)</enum><text display-inline="yes-display-inline">incorporating any new screening protocols
				into an existing trusted passenger program, as established pursuant to section
				109(a)(3) of the Aviation and Transportation Security Act (115 Stat. 613), or
				into the development of any new credential or system that incorporates
				biometric technology and other applicable technologies to verify the identity
				of individuals traveling in air transportation.</text>
									</subparagraph></paragraph><paragraph id="H100097867D5A46B5A5E5633003D4B33B"><enum>(3)</enum><header>Report to
				Congress</header><text>The Assistant Secretary shall submit to the appropriate
				committees of Congress a report on the implementation of the
				plan.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H8AADAAE69BE6440AB0C23583E0D42B92"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Not later than one year
			 after the date of enactment of this Act, the Assistant Secretary shall
			 establish the plan required by the amendment made by subsection (a).</text>
					</subsection></section><section id="H04DFECDBDE04467F91747332DA699AA4"><enum>240.</enum><header>Report on
			 complaints and claims for loss of property from passenger baggage</header><text display-inline="no-display-inline">Not later than six months after the date of
			 enactment of this Act, the Assistant Secretary shall report to the Committee on
			 Homeland Security of the House of Representatives on complaints and claims
			 received by the Administration for loss of property with respect to passenger
			 baggage screened by the Administration, including—</text>
					<paragraph id="H17609D3EE456499E821D338B962A1BB4"><enum>(1)</enum><text>the number of such
			 claims that are outstanding;</text>
					</paragraph><paragraph id="HD7156E40EAEE4E018199C1044E376DA5"><enum>(2)</enum><text>the total value of
			 property alleged in such outstanding claims to be missing;</text>
					</paragraph><paragraph id="H3767BB192A364F68B04E0CFD3262BDD0"><enum>(3)</enum><text>an estimate of the
			 amount of time that will be required to resolve all such outstanding
			 claims;</text>
					</paragraph><paragraph id="HB0278AD8A8124F23BD7E0D522E945EC1"><enum>(4)</enum><text>the amount of
			 Administration resources that will be devoted to resolving such outstanding
			 claims, including the number of personnel and funding; and</text>
					</paragraph><paragraph id="HC74ABF676E27420A82F5AB14C39BA60B"><enum>(5)</enum><text>efforts that the
			 Administration is making or is planning to make to address passenger grievances
			 regarding such losses, enhance passenger property security, and provide
			 effective oversight of baggage screeners and other Administration personnel who
			 come in contact with passenger property.</text>
					</paragraph></section><section id="HCEC95DB8072F4366A9A7B84163064615"><enum>241.</enum><header>Report on
			 certain security plan</header><text display-inline="no-display-inline">Not
			 later than 90 days after the date of enactment of this Act, the Assistant
			 Secretary shall submit a report to the appropriate committees of Congress
			 that—</text>
					<paragraph id="H52148F0A27EC431FBF9A17D2A504F351"><enum>(1)</enum><text>reviews whether
			 the most recent security plans developed by the commercial aviation airports in
			 the United States territories meet the security concerns described in
			 guidelines and other official documents issued by the Transportation Security
			 Administration pertaining to parts 1544 and 1546 of title 49, Code of Federal
			 Regulations, particularly with regard to the commingling of passengers;</text>
					</paragraph><paragraph id="H8BABE4E9D1A442CC8397A7A9296AFC62"><enum>(2)</enum><text>makes
			 recommendations regarding best practices supported by the Transportation
			 Security Administration and any adequate alternatives that address the problems
			 or benefits of commingling passengers at such airports to satisfy the concerns
			 described in paragraph (1);</text>
					</paragraph><paragraph id="HFD825203BB874B399DAC32EDFF9BDF51"><enum>(3)</enum><text display-inline="yes-display-inline">reviews the potential costs of implementing
			 the preferred and alternative methods to address the Administration concerns
			 regarding parts 1544 and 1546 of title 49, Code of Federal Regulations,
			 particularly in regards to the commingling of passengers at the airport;
			 and</text>
					</paragraph><paragraph id="H58AC5D0BCE174F4AA1EEF489C68620C7"><enum>(4)</enum><text display-inline="yes-display-inline">identifies funding sources, including grant
			 programs, to implement improved security methods at such airports.</text>
					</paragraph></section><section id="HA5FE9F5425804914BF5A116C9CCA992E"><enum>242.</enum><header>Study on
			 combination of facial and iris recognition</header>
					<subsection id="H23ECDB26F19549608855080DA6F2E358"><enum>(a)</enum><header>Study
			 required</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall carry out a study on the use of the combination of facial and
			 iris recognition to rapidly identify individuals in security checkpoint lines.
			 Such study shall focus on—</text>
						<paragraph id="HFFB6E55DC2B6488FB40A303CE1D33CFC"><enum>(1)</enum><text>increased accuracy
			 of facial recognition;</text>
						</paragraph><paragraph id="H52F4AF2419334744A79F9AC54FFEABFB"><enum>(2)</enum><text>enhancement of
			 existing iris recognition technology; and</text>
						</paragraph><paragraph id="HC25104BACF6E434EB10E5D4CABFD1C16"><enum>(3)</enum><text>establishment of
			 integrated face and iris features for accurate identification of
			 individuals.</text>
						</paragraph></subsection><subsection id="H78FB7238C96849299930A7A19B6013B1"><enum>(b)</enum><header>Purpose of
			 study</header><text display-inline="yes-display-inline">The purpose of the
			 study required by subsection (a) is to facilitate the use of a combination of
			 facial and iris recognition to provide a higher probability of success in
			 identification than either approach on its own and to achieve transformational
			 advances in the flexibility, authenticity, and overall capability of integrated
			 biometric detectors and satisfy one of major issues with war against
			 terrorists. The operational goal of the study should be to provide the
			 capability to non-intrusively collect biometrics (face image, iris) in less
			 than ten seconds without impeding the movement of individuals.</text>
					</subsection></section><section id="H4513025824044E45ABD2F0534B1BFC0F"><enum>243.</enum><header>Issuance of
			 regulations and security directives using emergency procedures</header>
					<subsection id="HDEF183FDC1C44B329C3BEEFB0E7A6E7D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/114">Section 114(l)</external-xref> of
			 title 49, United States Code, is amended—</text>
						<paragraph id="HA37B7EB8F45E4CA69B355AD45809B06E"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
							<subparagraph id="HD81A85164B6448448D8D8F1580A2737D"><enum>(A)</enum><text>in subparagraph
			 (A) by striking <quote>immediately in order to protect transportation
			 security</quote> and inserting <quote>in order to respond to an imminent threat
			 of finite duration</quote>; and</text>
							</subparagraph><subparagraph id="HB7418F64FAAE45D387E2D32EADF03A7C"><enum>(B)</enum><text>in subparagraph
			 (B) by inserting <quote>to determine if the regulation or security directive is
			 needed to respond to an imminent threat of finite duration</quote> before the
			 period at the end of the first sentence;</text>
							</subparagraph></paragraph><paragraph id="HA36C6B012E9E45F5B78A91F7CAA5DCDA"><enum>(2)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HCFBA6AB312BB46359863E7A13FA61011" style="OLC">
								<paragraph id="H1C42B23512FA44D3851EE89A0D2B2C33"><enum>(3)</enum><header>Factors to
				consider</header>
									<subparagraph id="HF47CA78731D844DAAF4B91E7BE100DCF"><enum>(A)</enum><header>In
				general</header><text>In determining whether to issue, rescind, or revise a
				regulation or security directive under this subsection, the Under Secretary
				shall consider, as factors in the final determination—</text>
										<clause id="HB2E0879356A8437A98BF2C7E481604ED"><enum>(i)</enum><text>whether the costs
				of the regulation or security directive are excessive in relation to the
				enhancement of security the regulation or security directive will
				provide;</text>
										</clause><clause id="H22602FCAD147402E8D6313E8A72299B9"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the regulation or security
				directive will remain effective for more than a 90-day period; and</text>
										</clause><clause id="H45A9042341E34FEC9F851EEC0D49AA74"><enum>(iii)</enum><text>whether the
				regulation or security directive will require revision in the subsequent 90-day
				period.</text>
										</clause></subparagraph><subparagraph id="HB2A9805CA24F46C291CFB289CFD1BD1F"><enum>(B)</enum><header>Authority to
				waive certain requirements</header><text>For purposes of subparagraph (A)(i),
				the Under Secretary may waive requirements for an analysis that estimates the
				number of lives that will be saved by the regulation or security directive and
				the monetary value of such lives if the Under Secretary determines that it is
				not feasible to make such an estimate.</text>
									</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</paragraph><paragraph id="HB0547E49D48E4C3C9F786969D787ED1D"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H717BE8EDCA214CA59930B28604CA5A26" style="OLC">
								<paragraph id="HE9E1D72479DA47D1954D693606016592"><enum>(5)</enum><header>Rulemaking
				required</header><text display-inline="yes-display-inline">Any regulation or
				security directive issued under paragraph (2) that remains effective, with or
				without revision, for a period of more than 180 days shall be subject to a
				rulemaking pursuant to subchapter II of
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter
				5</external-xref> of title
				5.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H845B4B3E127E49B68AC9C05B7FFF1738"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a)(3) shall apply to a regulation issued under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/114">section
			 114(l)(2)</external-xref> of title 49, United States Code, before, on, or after
			 the date of enactment of this Act.</text>
					</subsection></section></subtitle></title><title id="H3A2AAA16C44A4E18BCF7CE2CA872D943"><enum>III</enum><header>Surface
			 Transportation Security</header>
			<section id="H0C849891BA2F4B718591B05066D7A7AC"><enum>301.</enum><header>Assistant
			 Secretary defined</header><text display-inline="no-display-inline">Section 1301
			 of the Implementing Recommendations of the 9/11 Commission Act of 2007

			 transportation security inspection program</header>
				<subsection id="H014860A7D8384194AF63A6F4648A5A46"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="H578B2793F6D74188AAD13E05FA61B9F7"><enum>(1)</enum><text>Surface
			 transportation security inspectors assist passenger rail stakeholders in
			 identifying security gaps through Baseline Assessment for Security Enhancement
			 (<quote>BASE</quote>) reviews, monitor freight rail stakeholder efforts to
			 reduce the risk that toxic inhalation hazard shipments pose to high threat
			 urban areas through Security Action Item (<quote>SAI</quote>) reviews, and
			 assist in strengthening chain of custody security.</text>
					</paragraph><paragraph id="HCC84A37DDA834197AC3E30055A754A4B"><enum>(2)</enum><text display-inline="yes-display-inline">Surface transportation security inspectors
			 play a critical role in building and maintaining working relationships with
			 transit agencies and acting as liaisons between such agencies and the
			 Transportation Security Operations Center, relationships which are vital to
			 effective implementation of the surface transportation security mission.</text>
					</paragraph><paragraph id="HEF3A7F0C22154BF8A0AAEA0C1D4756A8"><enum>(3)</enum><text>In December 2006,
			 the Transportation Security Administration shifted from a system in which
			 surface transportation security inspectors reported to surface-focused
			 supervisors to a system in which inspectors report to aviation-focused
			 supervisors in the field; a shift which has resulted in a strained chain of
			 command, misappropriation of inspectors to nonsurface activities, the hiring of
			 senior-level inspectors with no surface qualifications, and significant damage
			 to relationships with transit agencies and inspector morale.</text>
					</paragraph></subsection><subsection id="HDED6A1CA35F44E95BD4518326DD6A4A2"><enum>(b)</enum><header>Surface
			 Transportation Security Inspection Office</header><text display-inline="yes-display-inline">Section 1304 of the Implementing
			 Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1113">6 U.S.C. 1113</external-xref>) is
			 amended—</text>
					<paragraph id="H780D4C5171FE4765973965553D03EC26"><enum>(1)</enum><text>by redesignating
			 subsections (c) through (j) as subsections (b) through (i), respectively;
			 and</text>
					</paragraph><paragraph id="H874AA22BAD0749A1A2642B1F7D2344A4"><enum>(2)</enum><text>by striking
			 subsections (a) and (b) and inserting the following:</text>

				Transportation Security Inspection Office</header>
								<paragraph id="H4FAC9E1AB380485B8B77A402346191D3"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant
				Secretary, shall establish an office to be known as the Surface Transportation
				Security Inspection Office (in this section referred to as the
				<quote>Office</quote>).</text>
								</paragraph><paragraph id="HBF3E6DF54D4C406CB0FD6E207E19FA19"><enum>(2)</enum><header>Mission</header><text>The
				Secretary shall use the Office to train, employ, and utilize surface
				transportation security inspectors to—</text>
									<subparagraph id="HCC4F72029EBF40E1B568A208BDD6ED74"><enum>(A)</enum><text>assist surface
				transportation carriers, operators, owners, entities, and facilities to enhance
				their security against terrorist attacks and other security threats; and</text>
									</subparagraph><subparagraph id="HCE4920A2C42044C1A17BD616CE467B0F"><enum>(B)</enum><text>assist the
				Secretary in enforcing applicable surface transportation security regulations
				and directives.</text>
									</subparagraph></paragraph><paragraph id="HA34B616C10DB41BBA384F398E9D384D2"><enum>(3)</enum><header>Officers</header>
									<subparagraph id="HEDD3EB224C11443B8348D97C9371AE73"><enum>(A)</enum><header>Director</header><text display-inline="yes-display-inline">The head of the Office shall be the
				Director, who shall—</text>
										<clause id="H17789B094B894383AF806D8C0867B56B"><enum>(i)</enum><text>oversee and
				coordinate the activities of the Office, including all officers and any
				corresponding surface transportation modes in which the Office carries out such
				activities, and the surface transportation security inspectors who assist in
				such activities; and</text>
										</clause><clause id="H25BEC1DAB6D34DF0BE5DED56309FC8B2"><enum>(ii)</enum><text>act as the
				primary point of contact between the Office and other entities that support the
				Department’s surface transportation security mission to ensure efficient and
				appropriate use of surface transportation security inspectors and maintain
				strong working relationships with surface transportation security
				stakeholders.</text>
										</clause></subparagraph><subparagraph id="H48A252BC42EE40BDBF76332780B5F82F"><enum>(B)</enum><header>Deputy
				Director</header><text>There shall be a Deputy Director of the Office, who
				shall—</text>
										<clause id="H6F465F175A664D9288DFABDA554DD674"><enum>(i)</enum><text>assist the
				Director in carrying out the responsibilities of the Director under this
				subsection; and</text>
										</clause><clause id="H3491A48663A34E70B81E22EE88FD9523"><enum>(ii)</enum><text>serve as acting
				Director in the absence of the Director and during any vacancy in the office of
				Director.</text>
										</clause></subparagraph></paragraph><paragraph id="HABF24335F44B4424A2CB70357664B1D9"><enum>(4)</enum><header>Appointment</header>
									<subparagraph id="H4C504225E07A448F8F2C614B57087090"><enum>(A)</enum><header>In
				general</header><text>The Director and Deputy Director shall be responsible on
				a full-time basis for the duties and responsibilities described in this
				subsection.</text>
									</subparagraph><subparagraph id="H75C9437A98E24FA6A44208975F4BA227"><enum>(B)</enum><header>Classification</header><text>The
				position of Director shall be considered a position in the Senior Executive
				Service as defined in
				<external-xref legal-doc="usc" parsable-cite="usc/5/2101a">section
				2101a</external-xref> of title 5, United States Code, and the position of
				Deputy Director shall be considered a position classified at grade GS–15 of the
				General Schedule.</text>
									</subparagraph></paragraph><paragraph id="HC26152565F3B436B8B513A555A69CC93"><enum>(5)</enum><header>Limitation</header><text>No
				person shall serve as an officer under subsection (a)(3) while serving in any
				other position in the Federal Government.</text>
								</paragraph><paragraph id="H1590B77460384EAB90BD3088FF7FA69F"><enum>(6)</enum><header>Field
				Offices</header>
									<subparagraph id="H9B67430344CA4E17AF714A31030F9720"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish primary and
				secondary field offices in the United States to be staffed by surface
				transportation security inspectors in the course of carrying out their duties
				under this section.</text>
									</subparagraph><subparagraph id="HBD53C861F9D34178A42214AAAEE743FF"><enum>(B)</enum><header>Designation</header><text>The
				locations for, and designation as <quote>primary</quote> or
				<quote>secondary</quote> of, such field offices shall be determined in a manner
				that is consistent with the Department’s risk-based approach to carrying out
				its homeland security mission.</text>
									</subparagraph><subparagraph id="H8A0250B4030B45C9B64F681D4820E5CD"><enum>(C)</enum><header>Command
				structure</header>
										<clause id="HCF2D8AE855384E0F9D9A6E19084543E1"><enum>(i)</enum><header>Primary field
				offices</header><text>Each primary field office shall be led by a chief surface
				transportation security inspector, who has significant experience with surface
				transportation systems, facilities, and operations and shall report directly to
				the Director.</text>
										</clause><clause id="H5CFD2F76AA744A4B9D5FD730BA4417B7"><enum>(ii)</enum><header>Secondary field
				offices</header><text>Each secondary field office shall be led by a senior
				surface transportation security inspector, who shall report directly to the
				chief surface transportation security inspector of a geographically appropriate
				primary field office, as determined by the Director.</text>
										</clause></subparagraph><subparagraph id="H34F823292AD948B9922729548A524697"><enum>(D)</enum><header>Personnel</header><text>Not
				later than 18 months after the date of enactment of the
				<short-title>Transportation Security Administration
				Authorization Act</short-title>, field offices shall be staffed with—</text>
										<clause id="H8BAB88227E974F4F8A5DAE5A3146A2F7"><enum>(i)</enum><text>not fewer than 7
				surface transportation security inspectors, including one chief surface
				transportation security inspector, at every primary field office; and</text>
										</clause><clause id="HD76E35A3137E41D7AD040454D399C6F1"><enum>(ii)</enum><text>not fewer than 5
				surface transportation security inspectors, including one senior surface
				transportation security inspector, at every secondary field
				office.</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HAAAB752EC06E4922A66DD2E9EE40C5D0"><enum>(c)</enum><header>Number of
			 Inspectors</header><text>Section 1304(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1113">6 U.S.C. 1113(e)</external-xref>),
			 as redesignated by subsection (b) of this section, is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H3B0DE7CFD763431194718D23409EAEFB" style="OLC">

				surface transportation security inspectors in fiscal year 2010; and</text>

				surface transportation security inspectors in fiscal year
				2011.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="H68027B36D5ED450393DAEFD41101AAC4"><enum>(d)</enum><header>Coordination</header><text display-inline="yes-display-inline">Section 1304(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1113">6 U.S.C. 1113(f)</external-xref>),
			 as redesignated by subsection (b) of this section, is amended by striking
			 <quote>114(t)</quote> and inserting <quote>114(s)</quote>.</text>

						<subsection id="H21180C02BBB940AC868F19EAC9FD49A1"><enum>(i)</enum><header>Plan</header>
							<paragraph id="H46C8A9B6B1B544A1AB0D95450748BFF9"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				the <short-title>Transportation Security Administration
				Authorization Act</short-title>, the Secretary shall submit to the Committee on
				Homeland Security of the House of Representatives and the Committee on Homeland
				Security and Governmental Affairs of the Senate a plan for expanding the duties
				and leveraging the expertise of surface transportation security inspectors to
				further support the Department’s surface transportation security
				mission.</text>
							</paragraph><paragraph id="HB31A341513784201BB068FB49D382713"><enum>(2)</enum><header>Contents</header><text>The
				plan shall include—</text>
								<subparagraph id="HD0130770FA9F42AA93DB88711719E624"><enum>(A)</enum><text>an analysis of how
				surface transportation security inspectors could be used to conduct oversight
				activities with respect to surface transportation security projects funded by
				relevant grant programs administered by the Department;</text>
								</subparagraph><subparagraph id="HDB3D9605508846E8B6012C0676ECEFC7"><enum>(B)</enum><text>an evaluation of
				whether authorizing surface transportation security inspectors to obtain or
				possess law enforcement qualifications or status would enhance the capacity of
				the Office to take an active role in the Department’s surface transportation
				security operations; and</text>
								</subparagraph><subparagraph id="HD61E06727A304289A326FFD333500621"><enum>(C)</enum><text>any other
				potential functions relating to surface transportation security the Secretary
				determines
				appropriate.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H54393DCA042A433D8CDADD24FC886F9F"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Section 1304
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1113">6 U.S.C.
			 1113</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5A91FE78CD8648A6BA4680A8848B0D04" style="OLC">
						<subsection id="HF50E2F78DD27457A877BF9A3C65665FF"><enum>(j)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">From amounts
				made available under section 101 of the <short-title>Transportation Security Administration Authorization
				Act</short-title>, there are authorized to be appropriated such sums as may be
				necessary to the Secretary to carry out this section for fiscal years 2010 and
				2011.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6B857F04196A4D609CB686B00BD46F11"><enum>(h)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 1304(b) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1113">6 U.S.C.
			 1113(b)</external-xref>), as redesignated by subsection (b) of this section, is
			 amended by striking <quote>subsection (e)</quote> and inserting
			 <quote>subsection (d)</quote>.</text>
				</subsection></section><section id="H0E10BA4D61B042A9AFFFA823B7728166"><enum>303.</enum><header>Visible
			 intermodal prevention and response teams</header><text display-inline="no-display-inline">Section 1303 of the Implementing
			 Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1112">6 U.S.C. 1112</external-xref>) is
			 amended—</text>
				<paragraph id="HA697DFD140954571A522F9B96EB84035"><enum>(1)</enum><text>in subsection (a)
			 by striking <quote>Administrator of the Transportation Security
			 Administration,</quote> and inserting <quote>Assistant Secretary,</quote>;</text>
				</paragraph><paragraph id="H4B60427B78714E33A9851E9DE5D89DEA"><enum>(2)</enum><text>in subsection
			 (a)(4) by striking <quote>team,</quote> and inserting <quote>team as to
			 specific locations and times within their facilities at which VIPR teams should
			 be deployed to maximize the effectiveness of such deployment and other
			 matters,</quote>; and</text>
				</paragraph><paragraph id="H50F0092F4B6542AB88A1D7702599FC0E"><enum>(3)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCE55C43C73F043FFB79DA9F52D2379B9" style="OLC">
						<subsection id="HBE25025B34A347DABD7A5272BDB03D1E"><enum>(b)</enum><header>Performance
				measures</header><text display-inline="yes-display-inline">Not later than one
				year after the date of enactment of the <short-title>Transportation Security Administration Authorization
				Act</short-title>, the Secretary shall develop and implement a system of
				qualitative performance measures and objectives by which to assess the roles,
				activities, and effectiveness of VIPR team operations on an ongoing basis,
				including a mechanism through which the transportation entities listed in
				subsection (a)(4) may submit feedback on VIPR team operations involving their
				systems or facilities.</text>
						</subsection><subsection id="HA6874C5FDAFD4709B14D7C1CE265FFDA"><enum>(c)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than one year after the date of
				enactment of the <short-title>Transportation Security
				Administration Authorization Act</short-title>, the Secretary shall develop and
				implement a plan for ensuring the interoperability of communications among all
				participating VIPR team components as designated under subsection (a)(1) and
				between VIPR teams and any relevant transportation entities as designated in
				subsection (a)(4) whose systems or facilities are involved in VIPR team
				operations, including an analysis of the costs and resources required to carry
				out the plan.</text>
						</subsection><subsection id="H89B0A802BF124B5F9DCF47003FA2392B"><enum>(d)</enum><header>Authorization of
				Appropriations</header><text>From amounts made available under section 101 of
				the <short-title>Transportation Security Administration
				Authorization Act</short-title>, there are authorized to be appropriated to the
				Secretary to carry out this section such sums as may be necessary for fiscal
				years 2010 and
				2011.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section display-inline="no-display-inline" id="H9660E7C349CF46B9A9B98A7F32B8915B" section-type="subsequent-section"><enum>304.</enum><header>Surface
			 Transportation Security stakeholder participation</header>
				<subsection id="H05618266CCB04E0688CAE3DE839D79C8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title XIII of the
			 Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1111">6 U.S.C. 1111 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4099D01C547C40E187095DE7B53893A8" style="OLC">
						<section id="H20F3B982D5DB498087750CF2E8DFA367"><enum>1311.</enum><header>Transit
				Security Advisory Committee</header>
							<subsection id="HCCBAC8A628F24A608FBB2CC3D1B5BFCC"><enum>(a)</enum><header>Establishment</header>
								<paragraph id="HAAF63AE97969426E9A5E1B3E837E1D2D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Assistant
				Secretary shall establish in the Transportation Security Administration an
				advisory committee, to be known as the Transit Security Advisory Committee (in
				this section referred to as the <quote>Advisory Committee</quote>), to assist
				the Assistant Secretary with issues pertaining to surface transportation
				security.</text>
								</paragraph><paragraph id="H0631F6CA55FF4539A1B67ADF7239930F"><enum>(2)</enum><header>Recommendations</header>
									<subparagraph id="H5782172794784085AAC873135A83ABF3"><enum>(A)</enum><header>In
				general</header><text>The Assistant Secretary shall require the Advisory
				Committee to develop recommendations for improvements to surface transportation
				security planning, methods, equipment, and processes.</text>
									</subparagraph><subparagraph id="HA2038FAEB29F4F5EB156F861017C1492"><enum>(B)</enum><header>Priority
				issues</header><text>Not later than one year after the date of enactment of the
				Transportation Security Administration Authorization Act, the Advisory
				Committee shall submit to the Assistant Secretary recommendations on—</text>
										<clause id="H3DA1267F37804E15878612304E127C5C"><enum>(i)</enum><text>improving homeland
				security information sharing between components of the Department of Homeland
				Security and surface transportation security stakeholders, including those
				represented on the Advisory Committee; and</text>
										</clause><clause id="H124BA137B94A43BA8E338CF39065F35A"><enum>(ii)</enum><text>streamlining or
				consolidating redundant security background checks required by the Department
				under relevant statutes governing surface transportation security, as well as
				redundant security background checks required by States where there is no
				legitimate homeland security basis for requiring such checks.</text>
										</clause></subparagraph></paragraph><paragraph id="H2DF0BCAA0EC54C4A88D91020B743C027"><enum>(3)</enum><header>Meetings</header><text>The
				Assistant Secretary shall require the Advisory Committee to meet at least
				semiannually and may convene additional meetings as necessary.</text>
								</paragraph><paragraph id="HC00D0084263943B7BDB2EED21E252C6D"><enum>(4)</enum><header>Unpaid
				position</header><text>Advisory Committee Members shall serve at their own
				expense and receive no salary, reimbursement for travel expenses, or other
				compensation from the Federal Government.</text>
								</paragraph></subsection><subsection id="H679A105537434ECA9EEE3822AF9E1D82"><enum>(b)</enum><header>Membership</header>
								<paragraph id="HCA74BD6337F24F6CBC3A170938DF2C63"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall ensure that the Advisory
				Committee is composed of not more than one individual representing not more
				than 27 member organizations, including representatives from public
				transportation agencies, passenger rail agencies or operators, railroad
				carriers, motor carriers, owners or operators of highways, over-the-road bus
				operators and terminal owners and operators, pipeline operators, labor
				organizations representing employees of such entities, and the surface
				transportation security technology industry.</text>
								</paragraph><paragraph id="HA676EBB1385D43D8B2D239EB505A52E7"><enum>(2)</enum><header>Appointments</header><text>Members
				shall be appointed by the Assistant Secretary and the Assistant Secretary shall
				have the discretion to review the participation of any Advisory Committee
				member and remove for cause at any time.</text>
								</paragraph></subsection><subsection id="H7B1D84AD1BA7401190DC77575A52AB0E"><enum>(c)</enum><header>Nonapplicability
				of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
				not apply to the Advisory Committee under this section.</text>
							</subsection><subsection id="H8F73B28622F2444C96C600294BEF6342"><enum>(d)</enum><header>Passenger
				carrier security working group</header>
								<paragraph id="H110A5920760B4D68A302AF29B1408D92"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall establish within the
				Advisory Committee a passenger carrier security working group to provide
				recommendations for successful implementation of initiatives relating to
				passenger rail, over-the-road bus, and public transportation security proposed
				by the Transportation Security Administration in accordance with statutory
				requirements, including relevant grant programs and security training
				provisions.</text>
								</paragraph><paragraph id="H7755ACA87A1E4F9B84029096750FD049"><enum>(2)</enum><header>Meetings</header><text>The
				working group shall meet at least semiannually and provide annual reports to
				the Assistant Secretary with recommendations to improve the Transportation
				Security Administration’s initiatives relating to passenger rail, over-the-road
				bus, and public transportation security, including grant, training, inspection,
				or other relevant programs authorized in titles XIII and XIV, and subtitle C of
				title XV of this Act.</text>
								</paragraph><paragraph id="HE9AFD29034C24CC7847411A4A7FF98CA"><enum>(3)</enum><header>Membership</header><text>The
				working group shall be composed of members from the Advisory Committee with
				expertise in public transportation, over-the-road bus, or passenger rail
				systems and operations, all appointed by the Assistant Secretary.</text>
								</paragraph><paragraph id="HCF0942DC33914016B293E16C2327AF07"><enum>(4)</enum><header>Reports</header>
									<subparagraph id="H746F9D805B574AFA8CF55078F39E849A"><enum>(A)</enum><header>In
				general</header><text>The working group shall prepare and submit reports to the
				Assistant Secretary in accordance with this paragraph that provide
				recommendations as described in paragraphs (1) and (2).</text>
									</subparagraph><subparagraph id="HC8EB0C78178F49F88589288061D73346"><enum>(B)</enum><header>Submission</header><text>Not
				later than one year after the date of enactment of the Transportation Security
				Administration Authorization Act, and on an annual basis thereafter, the
				working group shall submit a report on the findings and recommendations
				developed under subparagraph (A) to the Assistant Secretary.</text>
									</subparagraph></paragraph></subsection><subsection id="H9BAB5EB09C544C29BBFD0C9D08EE680E"><enum>(e)</enum><header>Freight rail
				security working group</header>
								<paragraph id="HEE3574E832B3484D8C5CE73FB629F846"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall establish within the
				Advisory Committee a freight rail security working group to provide
				recommendations for successful implementation of initiatives relating to
				freight rail security proposed by the Transportation Security Administration in
				accordance with statutory requirements, including relevant grant programs and
				security training provisions.</text>
								</paragraph><paragraph id="H483BB3DCA34C4CA0AF981C848AA54E54"><enum>(2)</enum><header>Meetings</header><text display-inline="yes-display-inline">The working group shall meet at least
				semiannually and provide annual reports to the Assistant Secretary with
				recommendations to improve the Transportation Security Administration’s
				initiatives relating to freight rail security, including grant, training,
				inspection, or other relevant programs authorized in titles XIII and XV of this
				Act.</text>
								</paragraph><paragraph id="H41C22175107748F8BA8AC0F96DF1FA95"><enum>(3)</enum><header>Membership</header><text>The
				working group shall be composed of members from the Advisory Committee with
				expertise in freight rail systems and operations, all appointed by the
				Assistant Secretary.</text>
								</paragraph><paragraph id="HB805FF338DB04C1DBDA0D0A4B63508B5"><enum>(4)</enum><header>Reports</header>
									<subparagraph id="H159A75F2FDC8465AA7ACF1ABD0765350"><enum>(A)</enum><header>In
				general</header><text>The working group shall prepare and submit reports to the
				Assistant Secretary in accordance with this paragraph that provide
				recommendations as described in paragraphs (1) and (2).</text>
									</subparagraph><subparagraph id="H65CA715D3A764D1DA5FE174AA8B16B75"><enum>(B)</enum><header>Submission</header><text>Not
				later than one year after the date of enactment of the
				<short-title>Transportation Security Administration
				Authorization Act</short-title>, and on an annual basis thereafter, the working
				group shall submit a report on the findings and recommendations developed under
				subparagraph (A) to the Assistant
				Secretary.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4BE53C3FD2F949F3B3FE9BBE16BF47BD"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 1(b) of the Implementing Recommendations of the
			 9/11 Commission Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law 110–53</external-xref>) is amended by
			 adding at the end of title XIII (Transportation Security Enchantments) the
			 following:</text>

				</subsection></section><section id="HB5CF6B617FD94D1590AF6FC97F4EB74E"><enum>305.</enum><header>Human capital
			 plan for surface transportation security personnel</header>
				<subsection id="HBDF92F209234480DB21CF5AC39B604F5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of enactment of this Act, the Assistant Secretary shall
			 submit to the Committee on Homeland Security of the House of Representatives
			 and the Committee on Homeland Security and Governmental Affairs of the Senate a
			 human capital plan for hiring, training, managing, and compensating surface
			 transportation security personnel, including surface transportation security
			 inspectors.</text>
				</subsection><subsection id="H4AFA304C9B8F42B1979428743E9AFC99"><enum>(b)</enum><header>Consultation</header><text>In
			 developing the human capital plan, the Assistant Secretary shall consult with
			 the chief human capital officer of the Department of Homeland Security, the
			 Director of the Surface Transportation Security Inspection Office, the
			 Inspector General of the Department of Homeland Security, and the Comptroller
			 General.</text>
				</subsection><subsection id="H098CB5FF138441F482DA7CF78D5CF391"><enum>(c)</enum><header>Approval</header><text>Prior
			 to submission, the human capital plan shall be reviewed and approved by the
			 chief human capital officer of the Department of Homeland Security.</text>
				</subsection></section><section id="H9504E84FC1C44E8DB9B30A0AE67A1FEE"><enum>306.</enum><header>Surface
			 transportation security training</header>
				<subsection id="H11EDBBBEE8504B678542972B23C6CD04"><enum>(a)</enum><header>Status
			 Report</header><text display-inline="yes-display-inline">Not later than 30 days
			 after the date of enactment of this Act, the Secretary shall submit a report to
			 the Committee on Homeland Security of the House of Representatives and the
			 Committee on Homeland Security and Governmental Affairs of the Senate on the
			 status of the Department’s implementation of sections 1408, 1517, and 1534 of
			 the Implementing Recommendations of the 9/11 Commission Act of 2007
			 (<external-xref legal-doc="usc" parsable-cite="usc/6/1137">6 U.S.C.
			 1137</external-xref>, 1167, and 1184), including detailed timeframes for
			 development and issuance of the transportation security training regulations
			 required under such sections.</text>
				</subsection><subsection id="HBED4151FA2644ABCA109371BD8EACC21"><enum>(b)</enum><header>Private
			 providers</header><text>Not later than one year after the date of enactment of
			 this Act, the Assistant Secretary shall identify criteria and establish a
			 process for approving and maintaining a list of approved private third-party
			 providers of security training with whom surface transportation entities may
			 enter into contracts, as needed, for the purpose of satisfying security
			 training requirements of the Department of Homeland Security, including
			 requirements developed under sections 1408, 1517, and 1534 of the Implementing
			 Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1137">6 U.S.C. 1137</external-xref>, 1167,
			 and 1184), in accordance with section 103 of this Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="H2AE7A0324AC542CEA83D1F4033F111A5" section-type="subsequent-section"><enum>307.</enum><header>Improvement of
			 public transportation security assistance</header>
				<subsection id="H7B320669BBC94E1F9D1756EC0EF27C30"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1406 of the
			 Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1135">6 U.S.C. 1135</external-xref>;
			 <external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law
			 110–53</external-xref>) is amended—</text>
					<paragraph id="H44BEE343380642808B7D0842029C0A06"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text>
						<subparagraph id="HEC89754DE94346A49E0B91434D4244A4"><enum>(A)</enum><text>in subparagraph
			 (B), by inserting <quote>bollards,</quote> after <quote>including</quote>;
			 and</text>

						</subparagraph></paragraph><paragraph id="HF69146A25D1548CCA75F086D83E4ACB7"><enum>(2)</enum><text>by redesignating
			 subsections (e) through (k) as subsections (f) through (l),
			 respectively;</text>
					</paragraph><paragraph id="H3B66690643584059918BFBC62E046AAC"><enum>(3)</enum><text>by redesignating
			 subsections (l) and (m) as subsections (n) and (o), respectively;</text>
					</paragraph><paragraph id="H457C2477F9084981864B6FD4E7660AAF"><enum>(4)</enum><text>by inserting after
			 subsection (d) the following new subsection (e):</text>

								<paragraph id="HB3D302040F6B4B2C9DCFB9054BE8F79B"><enum>(1)</enum><header>Timeline</header>
									<subparagraph id="H300336B13B8B413FBF847C4CCE7B0111"><enum>(A)</enum><header>Availability of
				applications</header><text display-inline="yes-display-inline">Applications for
				grants under this section for a grant cycle shall be made available to eligible
				applicants not later than 30 days after the date of the enactment of the
				appropriations Act for the Department of Homeland Security for the same fiscal
				year as the grant cycle.</text>
									</subparagraph><subparagraph id="H393675F4542D4D63A404113AE3B4C1D1"><enum>(B)</enum><header>Submission of
				applications</header><text display-inline="yes-display-inline">A public
				transportation agency that is eligible for a grant under this section shall
				submit an application for a grant not later than 45 days after the applications
				are made available under subparagraph (A).</text>
									</subparagraph><subparagraph id="HA4F25934CF294816B8EEA42668905FC8"><enum>(C)</enum><header>Action</header><text>The
				Secretary shall make a determination approving or rejecting each application
				submitted under subparagraph (B), notify the applicant of the determination,
				and immediately commence any additional processes required to allow an approved
				applicant to begin to receive grant funds by not later than 60 days after date
				on which the Secretary receives the application.</text>
									</subparagraph></paragraph><paragraph id="H8051B736A5F04A2683FDBA30D71657A5"><enum>(2)</enum><header>Prohibition of
				cost-sharing requirement</header><text>No grant under this section may require
				any cost-sharing contribution from the grant recipient or from any related
				State or local agency.</text>
								</paragraph><paragraph id="HAD662756773640E0878861FE64B4B8A5"><enum>(3)</enum><header>Annual
				report</header><text display-inline="yes-display-inline">Not later than the
				date that is 180 days after the last determination made under paragraph (1)(C)
				for a grant cycle, the Secretary shall submit to the Committees on
				Appropriations and Homeland Security of the House of Representatives and the
				Committees on Appropriations and Homeland Security and Governmental Affairs of
				the Senate a report that includes a list of all grant awarded under this
				section for that grant cycle for which the grant recipient is not, as of such
				date, able to receive grant funds and an explanation of why such funds have not
				yet been released for use by the recipient.</text>
								</paragraph><paragraph id="H680FD39C5FE64139AB261ED84DF38E25"><enum>(4)</enum><header>Performance</header>
									<subparagraph display-inline="no-display-inline" id="HB5DD7FB7C44E44FD961782BE7467B40A"><enum>(A)</enum><header>Duration</header><text>The
				performance period for grants made under this section shall be a period of time
				not less than 36 months in duration.</text>
									</subparagraph><subparagraph display-inline="no-display-inline" id="H316764EEF8D44DB4B45A77135C62DCAD"><enum>(B)</enum><header>Timing</header><text>The
				performance period for any grant made under this section shall not begin to run
				until the recipient of the grant has been formally notified that funds provided
				under the terms of the grant have been released for use by the
				recipient.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H1D1CA3CB70424139902FFEC1CE9A160D"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting after subsection (l), as
			 redesignated by paragraph (2) of this section, the following new subsection
			 (m):</text>
						<quoted-block display-inline="no-display-inline" id="HA1A982B499ED40239345D5B217C7965D" style="OLC">
							<subsection id="H14F825AF039046068483E92D3A592344"><enum>(m)</enum><header>Access</header><text display-inline="yes-display-inline">The Secretary shall ensure that, for each
				grant awarded under this section, the Inspector General of the Department is
				authorized to—</text>
								<paragraph id="HE52F340D7CEC46A0A13C07224A6288C0"><enum>(1)</enum><text>examine any
				records of the grant recipient or any contractors or subcontractors with which
				the recipient enters into a contract, or any State or local agency, that
				directly pertain to and involve transactions relating to grants under this
				section; and</text>
								</paragraph><paragraph id="HFB3BC7757A8140D9AD31BED43AEF884A"><enum>(2)</enum><text>interview any
				officer or employee of the recipient, any contractors or subcontractors with
				which the recipient enters into a contract, or State or local agency regarding
				such transactions.</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H96506CA6D2E34922B2A358BF4F234377"><enum>(6)</enum><text>in subsection (o),
			 as redesignated by paragraph (3) of this section—</text>
						<subparagraph id="HCF928945B8B44D06A220E592C7314D89"><enum>(A)</enum><text>by striking
			 paragraph (1) and inserting the following new paragraph (1):</text>

				to be appropriated to the Secretary to make grants under this section—</text>
									<subparagraph id="H5C2E653B83AF4720A2DCB34BAEDFFA6E"><enum>(A)</enum><text>$900,000,000 for
				fiscal year 2010, except that not more than 30 percent of such funds may be
				used for operational costs under subsection (b)(2) of this section; and</text>

				fiscal year 2011, except that not more than 30 percent of such funds may be

						</subparagraph><subparagraph id="HD55DF315C2BA41E8B2DF6FBA24E9726F"><enum>(B)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text>
						</subparagraph><subparagraph id="H13E57F9025DA49ACB0DC8CF96FA94A8B"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the
			 following new paragraph (3):</text>
							<quoted-block display-inline="no-display-inline" id="H3B6B1C592F494C14AC5A3F04FA48F612" style="OLC">
								<paragraph id="H49F0CE6D7C2049428517BE95F3CFFE74"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">The limitation on the percentage of funds
				that may be used for operational costs under paragraph (1) shall not apply to
				any costs involved with or relating to explosives detection canine teams
				acquired or used for the purpose of securing public transportation systems or
				facilities.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="HB1FB326E95E24061B81F0E0F435DBB19"><enum>(b)</enum><header>Technical
			 assistance pilot program</header>
					<paragraph id="H766F22BF56814C8D9F4C74C76FE98AB1"><enum>(1)</enum><header>Pilot program
			 required</header>
						<subparagraph id="HCC110F791C5F47BF9F3C4DA125A01407"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Assistant Secretary shall
			 conduct and complete a pilot program to provide grants to not more than 7
			 public transportation agencies eligible for security grants under section 1406
			 of the Implementing Recommendations of the 9/11 Commission Act of 2007
			 (<external-xref legal-doc="usc" parsable-cite="usc/6/1135">6 U.S.C.
			 1135</external-xref>;
			 <external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law
			 110–53</external-xref>) for the purpose of obtaining external technical support
			 and expertise to assist such agencies in conducting comprehensive security risk
			 assessments of public transportation systems, resources, and facilities.</text>
						</subparagraph><subparagraph id="HEBB3B6061B944240BAF4CD0C82C2C76F"><enum>(B)</enum><header>Methodology</header><text>Not
			 later than 60 days after the date of the enactment of this Act, the Assistant
			 Secretary shall identify—</text>
							<clause id="H9687A2A72DEE4A5FAFDB5BDB6E1F2475"><enum>(i)</enum><text>a
			 comprehensive risk methodology for conducting comprehensive security risk
			 assessments using grants made under this subsection that accounts for all three
			 elements of risk, including threat, vulnerability, and consequence; and</text>
							</clause><clause id="H74CC86C2693F40B2A5AED2CA35CEA19C"><enum>(ii)</enum><text>an
			 approved third-party provider of technical support and expertise for the
			 purpose of providing external assistance to grantees in conducting
			 comprehensive security risk assessments.</text>
							</clause></subparagraph><subparagraph id="HA042F58A631741AD8B890F9932309962"><enum>(C)</enum><header>Participants</header>
							<clause id="HEA740FA0FCE14C50A68E7980297C6F6B"><enum>(i)</enum><header>In
			 general</header><text>In selecting public transportation agencies to
			 participate in the pilot program, the Assistant Secretary shall approve
			 eligible agencies based on a combination of factors, including risk, whether
			 the agency has completed a comprehensive security risk assessment referred to
			 in subparagraph (B)(i) within a year preceding the date of enactment of this
			 Act, and geographic representation.</text>
							</clause><clause id="HC7DF67926B4D49B3A8CE3500EF6A309F"><enum>(ii)</enum><header>Prior
			 efforts</header><text>No eligible public transportation agency may be denied
			 participation in the pilot program on the grounds that it has applied for other
			 grants administered by the Department for the purpose of conducting a
			 comprehensive security risk assessment.</text>
							</clause></subparagraph><subparagraph id="HDF307BBF1477473B92B41E9CA64ECBB1"><enum>(D)</enum><header>Prohibitions</header><text>In
			 carrying out the pilot program the Assistant Secretary shall ensure
			 that—</text>
							<clause id="HC12D76E683E84E3A98A53447985E897F"><enum>(i)</enum><text>grants awarded
			 under the pilot program shall supplement and not replace other sources of
			 Federal funding;</text>
							</clause><clause id="H73E49783CCF446CAB7DB937FED364492"><enum>(ii)</enum><text>other sources of
			 Federal funding are not taken into consideration when assistance is awarded
			 under the pilot program; and</text>
							</clause><clause id="HB358156FCDFF43B48CD7573EA3CDD45F"><enum>(iii)</enum><text>no
			 aspect of the pilot program is conducted or administered by a component of the
			 Department other than the Transportation Security Administration.</text>
							</clause></subparagraph></paragraph><paragraph id="H48D3868F775B48DFBCF4EF61437BE010"><enum>(2)</enum><header>Report</header><text>Not
			 later than 180 days after the completion of the pilot program, the Assistant
			 Secretary shall submit to the Committee on Homeland Security of the House of
			 Representatives a report on the results of the pilot program, including an
			 analysis of the feasibility and merit of expanding the pilot program to a
			 permanent program and any recommendations determined appropriate by the
			 Assistant Secretary.</text>
					</paragraph><paragraph id="HCB8A94BDD45248FC8F561340F3D047EA"><enum>(3)</enum><header>Authorization of
			 appropriations</header><text>Of amounts made available pursuant to section 101
			 for fiscal year 2010, $7,000,000 shall be available to the Assistant Secretary
			 to carry out this subsection. Any amount made available to the Assistant
			 Secretary pursuant to this paragraph shall remain available until the end of
			 fiscal year 2011.</text>
					</paragraph></subsection><subsection id="HBC84A857E2EC485AA03FF1CFA5EEF24B"><enum>(c)</enum><header>Report on
			 recommendations of Comptroller General</header>
					<paragraph id="HF87381A920F4499BADAD1707C5128BBA"><enum>(1)</enum><header>Report
			 required</header><text>Not later than 90 days after the date of the enactment
			 of this Act, the Secretary of Homeland Security shall submit to the Committee
			 on Homeland Security of the House of Representatives and the Committee on
			 Homeland Security and Governmental Affairs of the Senate a report on the status
			 of the Secretary’s implementation of the recommendations of the Comptroller
			 General with respect to the improvement of the administration of security
			 grants under section 1406 of the Implementing Recommendations of the 9/11
			 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1135">6 U.S.C. 1135</external-xref>;
			 <external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law
			 110–53</external-xref>).</text>
					</paragraph><paragraph id="H6364D48A3A464933B5D99C1ABC55FECA"><enum>(2)</enum><header>Review by
			 Inspector General</header><text>Before the Secretary submits the report
			 required under paragraph (1), the report shall be reviewed by the Inspector
			 General of the Department of Homeland Security. When the Secretary submits the
			 report to Congress under paragraph (1), the Secretary shall include with the
			 report documentation verifying that the report was reviewed by the Inspector
			 General in accordance with this paragraph.</text>
					</paragraph></subsection></section><section id="H1DDAAC5CEDCB4778824FB81A1998016C"><enum>308.</enum><header>International
			 lessons learned for securing passenger rail and public transportation
			 systems</header>
				<subsection id="H86B6B6A9A8DF4426876A7920854EAC0E"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
					<paragraph id="HA2FAFC9F6E8A4FA9B324C73727AC1744"><enum>(1)</enum><text>numerous terrorist
			 attacks since September 11, 2001, have targeted passenger rail or public
			 transportation systems;</text>
					</paragraph><paragraph id="H4E7E7E08B7AD40E8B9DD31942EAB83A6"><enum>(2)</enum><text>nearly 200 people
			 were killed and almost 2,000 more were injured when terrorists set off 10
			 simultaneous explosions on 4 commuter trains in Madrid, Spain, on March 11,
			 2004;</text>
					</paragraph><paragraph id="H9778E66E658245E88992B284ED55A57D"><enum>(3)</enum><text>50 people were
			 killed and more than 700 injured in successive bombings of 3 transit stations
			 and a public bus in London, England, on July 7, 2005, and a second attack
			 against 4 similar targets on July 21, 2005, failed because of faulty
			 detonators;</text>
					</paragraph><paragraph id="H319AA71A8ED64A0B8A8460AE1D54D16C"><enum>(4)</enum><text>more than 200
			 people were killed and more than 700 injured in simultaneous terrorist bombings
			 of commuter trains on the Western Line in the suburbs of Mamba, India, on July
			 11, 2006;</text>
					</paragraph><paragraph id="HB185D376D9F5413080544DBD92255800"><enum>(5)</enum><text>the acts of
			 terrorism in Mamba, India, on November 26, 2008, included commando-style
			 attacks on a major railway station; and</text>
					</paragraph><paragraph id="HCE84A5D30C7447EF90C8BE159B72A7C4"><enum>(6)</enum><text>a
			 disproportionately low amount of attention and resources have been devoted to
			 surface transportation security by the Department of Homeland Security,
			 including the security of passenger rail and public transportation systems, as
			 compared with aviation security, which has been the primary focus of Federal
			 transportation security efforts generally, and of the Transportation Security
			 Administration in particular.</text>
					</paragraph></subsection><subsection id="H899D7919F03E44808BC3A8D8AF0F292C"><enum>(b)</enum><header>Study</header><text>The
			 Comptroller General shall conduct a study on the efforts undertaken by the
			 Secretary and Assistant Secretary, as well as other entities determined by the
			 Comptroller General to have made significant efforts, since January 1, 2004, to
			 learn from foreign nations that have been targets of terrorist attacks on
			 passenger rail and public transportation systems in an effort to identify
			 lessons learned from the experience of such nations to improve the execution of
			 Department functions to address transportation security gaps in the United
			 States.</text>
				</subsection><subsection id="HB7377ECF122D439F87DA698366A29760"><enum>(c)</enum><header>Report</header>
					<paragraph id="H409172CBE422459E8ED67904AC01465E"><enum>(1)</enum><header>In
			 general</header><text>Not later than one year after the date of enactment of
			 this Act, the Comptroller General shall submit to the Committee on Homeland
			 Security of the House of Representatives and the Committee on Homeland Security
			 and Governmental Affairs of the Senate a report on the results of the study.
			 The report shall also include an analysis of relevant legal differences that
			 may affect the ability of the Department to apply lessons learned.</text>
					</paragraph><paragraph id="H494AF63338EC493192096C24A70B51AD"><enum>(2)</enum><header>Recommendations</header><text>The
			 Comptroller General shall include in the report recommendations on how the
			 Department and its components, including the Transportation Security
			 Administration, can expand efforts to learn from the expertise and the security
			 practices of passenger rail and public transportation systems in foreign
			 nations that have experienced terrorist attacks on such systems.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="HCD500335131B42F4BAB1255C3DC72270"><enum>309.</enum><header>Underwater
			 tunnel security demonstration project</header>
				<subsection id="HCE60795B7FFB4767BBE819409E64716A"><enum>(a)</enum><header>Demonstration
			 project</header><text>The Assistant Secretary, in consultation with the Under
			 Secretary for Science and Technology, shall conduct a full-scale demonstration
			 project to test and assess the feasibility and effectiveness of certain
			 technologies to enhance the security of underwater public transportation
			 tunnels against terrorist attacks involving the use of improvised explosive
			 devices.</text>
				</subsection><subsection id="H42AC2D73A47F4E9F9006FC0FE77DD7FD"><enum>(b)</enum><header>Inflatable
			 plugs</header>
					<paragraph id="H741AA1A4991448EE8807A348B6E9FB22"><enum>(1)</enum><header>In
			 general</header><text>At least one of the technologies tested under subsection
			 (a) shall be inflatable plugs that may be rapidly deployed to prevent flooding
			 of a tunnel.</text>
					</paragraph><paragraph id="H0B917095C8C34D3884388CC4844CED55"><enum>(2)</enum><header>First technology
			 tested</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Assistant Secretary shall carry out a demonstration project that
			 tests the effectiveness of using inflatable plugs for the purpose described in
			 paragraph (1).</text>
					</paragraph></subsection><subsection id="HD55011752D514B55AF2B131CC9AF27CC"><enum>(c)</enum><header>Report to
			 congress</header><text>Not later than 180 days after completion of the
			 demonstration project under this section, the Assistant Secretary shall submit
			 a report to the appropriate committees of Congress, including the Committee on
			 Homeland Security of the House of Representatives, on the results of the
			 demonstration project.</text>
				</subsection><subsection id="HF3E4A106E7314219876DEF47BF9DE576"><enum>(d)</enum><header>Authorization of
			 appropriation</header><text display-inline="yes-display-inline">Of the amounts
			 made available under section 101 for fiscal year 2010, $8,000,000 shall be
			 available to carry out this section.</text>
				</subsection></section><section id="H4E168D36A0F94BA8A0D643251328CC71"><enum>310.</enum><header>Passenger rail
			 security demonstration project</header>
				<subsection id="HDC4DA815AE6D40B48D9E08A3D7B2BC65"><enum>(a)</enum><header>Demonstration
			 project</header><text>The Assistant Secretary, in consultation with the Under
			 Secretary for Science and Technology, shall conduct a demonstration project in
			 a passenger rail system to test and assess the feasibility and effectiveness of
			 technologies to strengthen the security of passenger rail systems against
			 terrorist attacks involving the use of improvised explosive devices.</text>
				</subsection><subsection id="H6A8F7467070C4D3C9AA89F0712842709"><enum>(b)</enum><header>Security
			 technologies</header><text>The demonstration project under this section shall
			 test and assess technologies to—</text>
					<paragraph id="H5FDB3983389A401C9025C47DDA545F14"><enum>(1)</enum><text>detect improvised
			 explosive devices on station platforms, through the use of foreign object
			 detection programs in conjunction with cameras; and</text>
					</paragraph><paragraph id="H684FB9CB98F34FF8B412E1102AB0A99C"><enum>(2)</enum><text>defeat improvised
			 explosive devices left on rail tracks.</text>
					</paragraph></subsection><subsection id="H535F768D8F2E474488C2E8B285DF07CA"><enum>(c)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than 180
			 days after completion of the demonstration project under this section, the
			 Assistant Secretary shall submit a report to the appropriate committees of
			 Congress, including the Committee on Homeland Security of the House of
			 Representatives, on the results of the demonstration project.</text>
				</subsection></section><section id="H477FF5FEDC824625858369C872547D7C"><enum>311.</enum><header>Explosives
			 detection canine teams</header><text display-inline="no-display-inline">Section
			 1307 of the Implementing Recommendations of the 9/11 Commission Act of 2007
			 (<external-xref legal-doc="usc" parsable-cite="usc/6/1116">6 U.S.C.
			 1116</external-xref>) is amended—</text>
				<paragraph id="H232FE00BFE6C4E07BDFFCE72D3F1BF86"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HB0269B5B210442FD94177A7A77D5AAAF"><enum>(A)</enum><text>in paragraph
			 (1)(A), by striking <quote>2010</quote> and inserting <quote>2011</quote>;
			 and</text>
					</subparagraph><subparagraph id="HF71935EC728042488E39B4BCC39D55DE"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H3178173834A84BF6B2A7C5EA27CDAA00" style="OLC">
							<paragraph id="H56A5DB429FC84E68A30BBA321FA38EF1"><enum>(3)</enum><header>Allocation</header>
								<subparagraph id="H6FB6A971853C44828D2F80C52A9B4CDB"><enum>(A)</enum><header> In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				increase the number of canine teams certified by the Transportation Security
				Administration for the purpose of passenger rail and public transportation
				security activities to not less than 200 canine teams by the end of fiscal year
				2011.</text>
								</subparagraph><subparagraph id="H73E65ADF203B4EAFB4F5FD4B5A429CFC"><enum>(B)</enum><header>Cooperative
				agreements</header><text>The Secretary shall expand the use of canine teams to
				enhance passenger rail and public transportation security by entering into
				cooperative agreements with passenger rail and public transportation agencies
				eligible for security assistance under section 1406 of this Act for the purpose
				of deploying and maintaining canine teams to such agencies for use in passenger
				rail or public transportation security activities and providing for assistance
				in an amount not less than $75,000 for each canine team deployed, to be
				adjusted by the Secretary for inflation.</text>
								</subparagraph><subparagraph id="H9973206BFCD847D399758F0C90E67144"><enum>(C)</enum><header>Authorization of
				appropriations</header><text>From amounts made available under section 101 of
				the Transportation Security Administration Authorization Act, there are
				authorized to be appropriated to the Secretary such sums as may be necessary to
				carry out this paragraph for fiscal years 2010 and
				2011.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HCB833DADF71B4D3399897F4D2972F4F2"><enum>(2)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="HACF0198EAA6647CABF6F504BBB70A7B1"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>and</quote>;</text>

							<paragraph id="H12A1F9A60D0E4E0EB06AB42789960E33"><enum>(5)</enum><text display-inline="yes-display-inline">expand the use of canine teams trained to
				detect vapor wave trails in passenger rail and public transportation security
				environments, as the Secretary, in consultation with the Assistant Secretary,
				determines
				appropriate.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HFAF2E09029C74A51BF94510A630DB910"><enum>(3)</enum><text>in subsection (e),
			 by striking <quote>, if appropriate,</quote> and inserting <quote>, to the
			 extent practicable,</quote>; and</text>
				</paragraph><paragraph id="HBEEA8B018F794649ACF90A79B4BA3619"><enum>(4)</enum><text>by striking
			 subsection (f) and inserting the following new subsection (f):</text>
					<quoted-block display-inline="no-display-inline" id="H446C8EAD88FB4C4BBE210C99A0D2B1A2" style="OLC">
						<subsection id="H8D95F5A51FB44EA2A8A232775E581B2F"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of
				the enactment of the <short-title>Transportation Security
				Administration Authorization Act</short-title>, the Comptroller General shall
				submit to the appropriate congressional committees a report on—</text>
							<paragraph id="HACCE210FF757459DB587BE638E41C97C"><enum>(1)</enum><text display-inline="yes-display-inline">utilization of explosives detection canine
				teams to strengthen security in passenger rail and public transportation
				environments;</text>
							</paragraph><paragraph id="HCD1B1DA2DAFE4DD4BD782E8FA007E793"><enum>(2)</enum><text>the capacity of
				the national explosive detection canine team program as a whole; and</text>
							</paragraph><paragraph id="H4E6B0966ED2D48C39979A67588735920"><enum>(3)</enum><text>how the Assistant
				Secretary could better support State and local passenger rail and public
				transportation entities in maintaining certified canine teams for the life of
				the canine, including by providing financial
				assistance.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HAE677F5B94F842FE88D1CB7F92ADBC6B"><enum>312.</enum><header>Deputy
			 Assistant Secretary for surface transportation security</header>
				<subsection id="H1B37BB88F33644B1BF30DEB680ED5966"><enum>(a)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
					<paragraph id="HE92537AB466140D8B4C870FF9F30F3B4"><enum>(1)</enum><text display-inline="yes-display-inline">the Transportation Security
			 Administration’s capacity to address surface transportation security would be
			 enhanced significantly by establishing a position of Deputy Assistant Secretary
			 for Surface Transportation Security to lead the Transportation Security
			 Administration’s surface transportation security mission; and</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HD145DA452AB54A1690B687ED069FCC73"><enum>(2)</enum><text>a Deputy Assistant
			 Secretary for Surface Transportation Security could provide the focused
			 leadership and resource management necessary to implement the policies and
			 programs that are critical to securing surface transportation modes and ensure
			 the effectiveness of the Surface Transportation Security Inspection Office,
			 security policy and grant functions affecting surface transportation modes, and
			 the Transit Security Advisory Committee.</text>
					</paragraph></subsection><subsection id="HB5E7205CE6DB4B8A8FBF51FC86235E04"><enum>(b)</enum><header>Report</header>
					<paragraph id="H0B2613F6423840BD828EAD4E0A90A360"><enum>(1)</enum><header>In
			 general</header><text>Not later than 270 days after the date of enactment of
			 this Act, the Inspector General of the Department of Homeland Security shall
			 submit to the Committee on Homeland Security of the House of Representatives
			 and the Committee on Homeland Security and Governmental Affairs of the Senate a
			 report on the feasibility and merit of establishing a Deputy Assistant
			 Secretary for Surface Transportation Security in the Transportation Security
			 Administration to reflect the reality of security threats that are faced by all
			 modes of transportation in the United States and also whether establishing the
			 position of a Deputy Assistant Secretary for Aviation Security would more
			 effectively streamline or enhance the operational and policymaking capabilities
			 of the Transportation Security Administration for all transportation
			 modes.</text>
					</paragraph><paragraph id="H5D3C72FD785D4AB8AF781AE522CB2937"><enum>(2)</enum><header>Recommendations</header><text>The
			 Inspector General shall include in the report recommendations on—</text>
						<subparagraph id="HD558551BD7F1485EA35487B256236B24"><enum>(A)</enum><text>the most effective
			 and efficient ways to organize offices, functions, personnel, and programs of
			 the Transportation Security Administration under or among all respective Deputy
			 Assistant Secretary positions to be created;</text>
						</subparagraph><subparagraph id="HF237359D5BA245FBB8F7FFCBA7301BEA"><enum>(B)</enum><text>what offices,
			 functions, personnel, and programs of the Transportation Security
			 Administration would best remain outside of the scope of any new Deputy
			 Assistant Secretary positions in order that such offices, functions, personnel,
			 and programs maintain the status of reporting directly to the Assistant
			 Secretary; and</text>
						</subparagraph><subparagraph id="H8746950C0FD443DCA9D4EB221CE17132"><enum>(C)</enum><text>any other relevant
			 matters, as the Inspector General determines appropriate.</text>
						</subparagraph></paragraph></subsection></section><section id="H7956329546184EAEB9B4AAE878914139"><enum>313.</enum><header>Public hearings
			 on security assistance grant program and the restriction of security
			 improvement priorities</header>
				<subsection id="H30612ACCA9E34F2CBB284A43B7C50E67"><enum>(a)</enum><header>Public
			 hearings</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Assistant Secretary shall
			 conduct public hearings on the administration of the security assistance grant
			 program under section 1406 of the Implementing Recommendations of the 9/11
			 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1135">6 U.S.C. 1135</external-xref>). The Assistant
			 Secretary shall—</text>
					<paragraph id="HE57F7D4846F4467391C98BFB670FFD5A"><enum>(1)</enum><text>solicit
			 information and input from the 5 urban areas that receive the largest amount of
			 grant funds under such section, including recipients providing mass
			 transportation and passenger rail services; and</text>
					</paragraph><paragraph id="H52AFDE84593A4AC5ADDE2AD43017D907"><enum>(2)</enum><text display-inline="yes-display-inline">solicit feedback from such recipients on
			 whether current allowable uses of grant funds under the regulations or guidance
			 implementing the grant program are sufficient to address security improvement
			 priorities identified by transit agencies.</text>
					</paragraph></subsection><subsection id="HBB4016C238E84EC59DAD3C8FCAEC0AE5"><enum>(b)</enum><header>Report to
			 Congress</header><text>The Assistant Secretary shall submit to the Committees
			 on Appropriations and Homeland Security of the House of Representatives and the
			 Committees on Appropriations and Homeland Security and Governmental Affairs of
			 the Senate a report on the findings of the public hearings conducted under
			 paragraph (1). The report shall include—</text>
					<paragraph id="H913012EA9B804CA5A63D508238A184CB"><enum>(1)</enum><text display-inline="yes-display-inline">the Assistant Secretary’s determinations
			 with respect to the extent to which security improvement priorities identified
			 by transit agencies are not met by the regulations or guidance implementing the
			 grant program; and</text>
					</paragraph><paragraph id="H1F06629E9F364A7E91659C1634ABF33C"><enum>(2)</enum><text>how such
			 regulations or guidance should be changed to accommodate such priorities, or
			 the Assistant Secretary’s justification for not addressing such priorities with
			 the grant program.</text>
					</paragraph></subsection></section></title><title id="HE019A0514A834F8EADA1E125E5D2A17C"><enum>IV</enum><header>Transportation
			 Security Enhancements</header>
			<subtitle id="H11D3C5E43277450D8E6A848DA1A944EC"><enum>A</enum><header>Security
			 Enhancements</header>
				<section display-inline="no-display-inline" id="H68932A227F964DA39FCED6D6C6C41C2A" section-type="subsequent-section"><enum>401.</enum><header>Report and
			 recommendation for uniform security background checks</header><text display-inline="no-display-inline">Not later than one year after the date of
			 enactment of this Act, the Comptroller General shall submit to the Committee on
			 Homeland Security of the House of Representatives a report that
			 contains—</text>
					<paragraph id="HCAAB503F201945128FA27A014985BA60"><enum>(1)</enum><text display-inline="yes-display-inline">a review of background checks and forms of
			 identification required under State and local transportation security
			 programs;</text>
					</paragraph><paragraph id="H5295109D8A1841C78B0DF958ACD84D17"><enum>(2)</enum><text>a
			 determination as to whether the background checks and forms of identification
			 required under such programs duplicate or conflict with Federal programs;
			 and</text>
					</paragraph><paragraph id="HC9F8C20A756A414A9E970ADBE1670116"><enum>(3)</enum><text>recommendations on
			 limiting the number of background checks and forms of identification required
			 under such programs to reduce or eliminate duplication with Federal
			 programs.</text>
					</paragraph></section><section id="HCA998EFEE6F447D4863326E688879D3B"><enum>402.</enum><header>Animal-propelled
			 vessels</header><text display-inline="no-display-inline">Notwithstanding
			 <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
			 70105</external-xref> of title 46, United States Code, the Secretary shall not
			 require an individual to hold a transportation security card, or be accompanied
			 by another individual who holds such a card if—</text>
					<paragraph id="H086A9472F4FB47EA8DC3146D7EF7E5B5"><enum>(1)</enum><text>the individual has
			 been issued a license, certificate of registry, or merchant mariner’s document
			 under part E of subtitle II of title 46, United States Code;</text>
					</paragraph><paragraph id="H9D273192260749C9B1A89F56B9D5D11D"><enum>(2)</enum><text>the individual is
			 not allowed unescorted access to a secure area designated in a vessel or
			 facility security plan approved by the Secretary; and</text>
					</paragraph><paragraph id="HC05C7AD03C114ECE97DF187421B3E825"><enum>(3)</enum><text>the individual is
			 engaged in the operation of a live animal-propelled vessel.</text>
					</paragraph></section><section id="HC91146709A024F3686644E681724299B"><enum>403.</enum><header>Requirements
			 for issuance of transportation security cards; access pending issuance;
			 redundant background checks</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70105">Section 70105</external-xref> of
			 title 46, United States Code, is amended by adding at the end the following new
			 subsections:</text>
					<quoted-block id="H740094F449234AF79E6EAC302A442D5B" style="OLC">
						<subsection id="H688DF812E44A48BCA386842847B27214"><enum>(n)</enum><header>Escorting</header><text>The
				Secretary shall coordinate with owners and operators subject to this section to
				allow any individual who has a pending application for a transportation
				security card under this section or is waiting for reissuance of such card,
				including any individual whose card has been lost or stolen, and who needs to
				perform work in a secure or restricted area to have access to such area for
				that purpose through escorting of such individual in accordance with subsection
				(a)(1)(B) by another individual who holds a transportation security
				card.</text>
						</subsection><subsection id="H254AF783BF7843629C75999E7CB83AD4"><enum>(o)</enum><header>Processing
				time</header><text>The Secretary shall review an initial transportation
				security card application and respond to the applicant, as appropriate,
				including the mailing of an Initial Determination of Threat Assessment letter,
				within 30 days after receipt of the initial application. The Secretary shall,
				to the greatest extent practicable, review appeal and waiver requests submitted
				by a transportation security card applicant, and send a written decision or
				request for additional information required for the appeal or waiver
				determination, within 30 days after receipt of the applicant’s appeal or waiver
				written request. For an applicant that is required to submit additional
				information for an appeal or waiver determination, the Secretary shall send a
				written decision, to the greatest extent practicable, within 30 days after
				receipt of all requested information.</text>
						</subsection><subsection id="H956AECDA17174D7B954F6A41E48BE10C"><enum>(p)</enum><header>Receipt of
				cards</header><text>Within 180 days after the date of enactment of the
				Transportation Security Administration Authorization Act, the Secretary shall
				develop a process to permit an individual approved for a transportation
				security card under this section to receive the card at the individual’s place
				of residence.</text>
						</subsection><subsection id="HB74B38754A234470901818533F1CC0BE"><enum>(q)</enum><header>Fingerprinting</header><text>The
				Secretary shall establish procedures providing for an individual who is
				required to be fingerprinted for purposes of this section to be fingerprinted
				at facilities operated by or under contract with an agency of the Department of
				the Secretary that engages in fingerprinting the public for transportation
				security or other security purposes.</text>
						</subsection><subsection id="H3EE2425F70194EA4B028E7F72A2DA5FC"><enum>(r)</enum><header>Redundant
				background checks</header><text display-inline="yes-display-inline">The
				Secretary shall prohibit a State or political subdivision thereof from
				requiring a separate security background check for any purpose for which a
				transportation security card is issued under this section. The Secretary may
				waive the application of this subsection with respect to a State or political
				subdivision thereof if the State or political subdivision demonstrates a
				compelling homeland security reason that a separate security background check
				is necessary.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H00F87602D0804736A09635FA6F9FDCDB"><enum>404.</enum><header>Harmonizing
			 security card expirations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70105">Section 70105(b)</external-xref>
			 of title 46, United States Code, is amended by adding at the end the following
			 new paragraph:</text>
					<quoted-block id="H165EADCDCCCF4DD281E52C19AC267278" style="OLC">
						<paragraph id="HE0981029DC1F4CBEB95797F1371C514A" indent="up1"><enum>(6)</enum><text>The Secretary may extend for up to
				one year the expiration of a biometric transportation security card required by
				this section to align the expiration with the expiration of a license,
				certificate of registry, or merchant mariner document required under chapter 71
				or 73.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HF48EB807A3574A0EB80816DE1832F177"><enum>405.</enum><header>Securing
			 aviation from extreme terrorist threats</header>
					<subsection id="HFAA496AF21F546A3BE6D6C9F7342F7A4"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
						<paragraph id="H932FF79DC65B43D39E77B3191FEBFDB1"><enum>(1)</enum><text display-inline="yes-display-inline">In 2001, Congress gave the Assistant
			 Secretary, Transportation Security Administration, the task to <quote>develop
			 policies, strategies, and plans for dealing with threats to transportation
			 security</quote>. The individuals currently held at the Naval Station,
			 Guantanamo Bay, Cuba, were detained during armed conflict and pose a serious
			 and continuing threat to the transportation security interests of the United
			 States and its allies.</text>
						</paragraph><paragraph id="H8B28CCDA6ADE450AAD83DD6770DDF679"><enum>(2)</enum><text>Terrorists,
			 including Khalid Sheikh Mohammad, the admitted mastermind of the September 11,
			 2001 terrorist attacks, have clearly demonstrated their desire and intent to
			 use airplanes as weapons to kill innocent Americans. The August 2006 liquid
			 explosive plot to take down 10 commercial airliners over the United States is
			 positive proof that air transportation continues to be a target.</text>
						</paragraph><paragraph id="H5B0BACE7440B455F8E8D287BA585FA02"><enum>(3)</enum><text>In light of al
			 Qaeda’s propensity to conduct aviation-related attacks and the fact that,
			 according to the Department of Defense, at least 74 former Guantanamo Bay
			 detainees once considered <quote>non-threatening</quote> are recidivists to
			 terrorism, restrictions on the air travel of former detainees are necessary to
			 protect the public from future attacks.</text>
						</paragraph><paragraph id="H4CCB7E4F89FC45BAA1187779845E7419"><enum>(4)</enum><text>Therefore,
			 individuals who are or have been detained at Guantanamo should not be allowed
			 to fly commercially in the United States and should be added to the
			 Transportation Security Administration’s No Fly List, until the President
			 certifies that each individual detainee poses no threat to the United States,
			 its citizens, or its allies.</text>
						</paragraph></subsection><subsection id="HF4DE49561E484F42BE8E1CDE92E1A9E7"><enum>(b)</enum><header>Prohibition of
			 detainee use of commercial aviation</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/44903">Section
			 44903(j)(2)(C)</external-xref> of title 49, United States Code, as amended by
			 section 213 of the bill, is further amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H61115C9D977847F59A21898B5C99D65F" style="OLC">
							<clause id="H909F3122DDB64E3FA134795D33901CC6"><enum>(vi)</enum><header>Inclusion of
				detainees on no fly list</header><text display-inline="yes-display-inline">The
				Assistant Secretary, in coordination with the Terrorist Screening Center, shall
				include on the No Fly List any individual who was a detainee held at the Naval
				Station, Guantanamo Bay, Cuba, unless the President certifies in writing to
				Congress that the detainee poses no threat to the United States, its citizens,
				or its allies. For purposes of this clause, the term ‘detainee’ means an
				individual in the custody or under the physical control of the United States as
				a result of armed
				conflict.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H11A11E9AEB864C5E9C3A52993758E0EC"><enum>406.</enum><header>Pipeline
			 security study</header>
					<subsection id="H1AA2728D48E844E396C87FE953EDD203"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General shall conduct a study regarding the roles and
			 responsibilities of the Department of Homeland Security and the Department of
			 Transportation with respect to pipeline security. The study shall address
			 whether—</text>
						<paragraph id="H55589146724D4784B05C1A00E5246925"><enum>(1)</enum><text>the Annex to the
			 Memorandum of Understanding executed on August 9, 2006, between the Department
			 of Homeland Security and the Department of Transportation adequately delineates
			 strategic and operational responsibilities for pipeline security, including
			 whether it is clear which Department is responsible for—</text>
							<subparagraph id="HC2AE6C66EC624E66AF207D8732FDA69F"><enum>(A)</enum><text>protecting against
			 intentional pipeline breaches;</text>
							</subparagraph><subparagraph id="H437B44D160094E928D703A501CD7C3F6"><enum>(B)</enum><text>responding to
			 intentional pipeline breaches; and</text>
							</subparagraph><subparagraph id="H88CBB70C67C14871BC6E5CB2ECF6FD65"><enum>(C)</enum><text>planning to
			 recover from the effects of intentional pipeline breaches;</text>
							</subparagraph></paragraph><paragraph id="H62ADFBB921864EE3924C58B95E000239"><enum>(2)</enum><text>the respective
			 roles and responsibilities of each Department are adequately conveyed to
			 relevant stakeholders and to the public; and</text>
						</paragraph><paragraph id="HE514BCF3C9FB425BA9DF182F6EB69FD4"><enum>(3)</enum><text>the processes and
			 procedures for determining whether a particular pipeline breach is a terrorist
			 incident are clear and effective.</text>
						</paragraph></subsection><subsection id="HEA820C5CC7C44C66B24D400F954F6E3C"><enum>(b)</enum><header>Report on
			 study</header><text>Not later than 180 days after the date of enactment of this
			 section, the Comptroller General shall submit to the Committee on Homeland
			 Security in the House of Representatives a report containing the findings of
			 the study conducted under subsection (a).</text>
					</subsection><subsection id="HB765F07D5E6F4B3D858E148C621340D4"><enum>(c)</enum><header>Report to
			 congress</header><text>Not later than 90 days after the issuance of the report
			 regarding the study conducted pursuant to this section, the Secretary of
			 Homeland Security shall review and analyze the study and submit to the
			 Committee on Homeland Security of the House of Representatives a report on such
			 review and analysis, including any recommendations for—</text>
						<paragraph id="H4CAC653158974918A1BCBCB7AD2C537E"><enum>(1)</enum><text>changes to the
			 Annex to the Memorandum of Understanding described in subsection (a)(1);
			 and</text>
						</paragraph><paragraph id="H3CFB08A256B84ADCACE6BAD104678B78"><enum>(2)</enum><text>other improvements
			 to pipeline security activities at the Department of Homeland Security.</text>
						</paragraph></subsection></section><section id="H3FDAA8E02127424EACC4831C1C910ECC"><enum>407.</enum><header>Transportation
			 security administration centralized training facility</header>
					<subsection id="HF7E1FF0D33C9485F98B8A3D3AD1E74FE"><enum>(a)</enum><header>
			 Study</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security shall carry out a study on the feasibility of establishing a
			 centralized training center for advanced security training provided by the
			 Transportation Security Administration for the purpose of enhancing aviation
			 security.</text>
					</subsection><subsection id="H93DF05C977D743C9A752B28CD68359F0"><enum>(b)</enum><header>Considerations</header><text>In
			 conducting the study, the Secretary shall take into consideration the benefits,
			 costs, equipment, personnel needs, and building requirements for establishing
			 such a training center and if the benefits of establishing the center are an
			 efficient use of resources for training transportation security
			 officers.</text>
					</subsection><subsection id="HC1ECBC09119546639AD33B5BF6D9CBE7"><enum>(c)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, the Secretary
			 shall submit to the Committee on Homeland Security of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation of
			 the Senate a report regarding the results of the study.</text>
					</subsection></section></subtitle><subtitle id="H52FD9EC8BC824AA7B8F149B6401981DB"><enum>B</enum><header>SAFE Truckers Act
			 of 2009 </header>
				<section id="H19B942ECEFDB4364ACF13F7BB2E3B816"><enum>431.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This subtitle may be
			 cited as the <quote><short-title>Screening Applied Fairly
			 and Equitably to Truckers Act of 2009</short-title></quote> or the
			 <quote><short-title>SAFE Truckers Act of
			 2009</short-title></quote>.</text>
				</section><section id="HE847AFA40D0A4CAC85304A602173717E"><enum>432.</enum><header>Surface
			 transportation security</header>
					<subsection id="H52D3CB9F360A46D885F0E22E22075D72"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Homeland Security
			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C.
			 101 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>

				of security sensitive materials</header>
									<subsection id="H816235D098EA48FF88D48DC553B24C42"><enum>(a)</enum><header>Security
				sensitive materials</header><text display-inline="yes-display-inline">Not later
				than 120 days after the date of enactment of this section, the Secretary shall
				issue final regulations, after notice and comment, defining security sensitive
				materials for the purposes of this title.</text>
									</subsection><subsection id="H54CE31A44B0B4A34AE5873E3EF9F09ED"><enum>(b)</enum><header>Motor vehicle
				operators</header><text display-inline="yes-display-inline">The Secretary shall
				prohibit an individual from operating a motor vehicle in commerce while
				transporting a security sensitive material unless the individual holds a valid
				transportation security card issued by the Secretary under
				<external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
				70105</external-xref> of title 46, United States Code.</text>
									</subsection><subsection id="H1DB08A3656654352B0F57D536077694E"><enum>(c)</enum><header>Shippers</header><text display-inline="yes-display-inline">The Secretary shall prohibit a person
				from—</text>
										<paragraph id="H23B4BE12B8544219BED8759A081C7F24"><enum>(1)</enum><text>offering a
				security sensitive material for transportation by motor vehicle in commerce;
				or</text>
										</paragraph><paragraph id="HDAB6E593C29D462F8E2F77F55D18098D"><enum>(2)</enum><text display-inline="yes-display-inline">causing a security sensitive material to be
				transported by motor vehicle in commerce,</text>
										</paragraph><continuation-text continuation-text-level="subsection">unless
				the motor vehicle operator transporting the security sensitive material holds a
				valid transportation security card issued by the Secretary under
				<external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
				70105</external-xref> of title 46, United States Code.</continuation-text></subsection></section><section display-inline="no-display-inline" id="HF5B2E0969FEB43B1B5D01AAFFB3F555E" section-type="subsequent-section"><enum>2102.</enum><header>Enrollment
				locations</header>
									<subsection id="H9A97DF4703CE42F6B225F6C0B2FAB577"><enum>(a)</enum><header>Fingerprinting
				locations</header><text display-inline="yes-display-inline">The Secretary
				shall—</text>
										<paragraph id="HB6ABDF11D42A43ED8168A243A33BF7D1"><enum>(1)</enum><text display-inline="yes-display-inline">work with appropriate entities to ensure
				that fingerprinting locations for individuals applying for a transportation
				security card under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105</external-xref> of title 46, United
				States Code, have flexible operating hours; and</text>
										</paragraph><paragraph id="H9594CB0D109748F28A54FF41BC053838"><enum>(2)</enum><text>permit an
				individual applying for such transportation security card to utilize a
				fingerprinting location outside of the individual’s State of residence to the
				greatest extent practicable.</text>
										</paragraph></subsection><subsection id="HCE1DCEC10DCF45249E91325BB6B9FAAC"><enum>(b)</enum><header>Receipt and
				activation of cards</header><text>The Secretary shall develop guidelines and
				procedures to permit an individual to receive a transportation security card
				under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
				70105</external-xref> of title 46, United States Code, at the individual’s
				place of residence and to activate the card at any enrollment center.</text>
									</subsection><subsection id="H49F036D436AF44D3B631B17A64AC6087"><enum>(c)</enum><header>Number of
				Locations</header><text display-inline="yes-display-inline">The Secretary shall
				develop and implement a plan—</text>
										<paragraph id="H445C15A489634693AFC657AAD536D102"><enum>(1)</enum><text>to offer
				individuals applying for a transportation security card under
				<external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
				70105</external-xref> of title 46, United States Code, the maximum number of
				fingerprinting locations practicable across diverse geographic regions;
				and</text>
										</paragraph><paragraph id="HFD7354FEC5BC48FF8697359A8E704EF3"><enum>(2)</enum><text>to conduct
				outreach to appropriate stakeholders, including owners, operators, and relevant
				entities (and labor organizations representing employees of such owners,
				operators, and entities), to keep the stakeholders informed of the timeframe
				and locations for the opening of additional fingerprinting locations.</text>
										</paragraph></subsection><subsection id="H91E21BEE12354C3BB05B1E343F478B2F"><enum>(d)</enum><header>Authorization</header><text>There
				are authorized to be appropriated such sums as may be necessary to carry out
				this section.</text>
									</subsection></section><section id="HBDA2C6C29180412794A9418B9846D720"><enum>2103.</enum><header>Authority to
				ensure compliance</header>
									<subsection id="HCF940717C27B4AF89606A955F2AA9A9A"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary is
				authorized to ensure compliance with this title.</text>
									</subsection><subsection id="H30A007A6788F46448AB78B7FD75537BC"><enum>(b)</enum><header>Memorandum of
				understanding</header><text>The Secretary may enter into a memorandum of
				understanding with the Secretary of Transportation to ensure compliance with
				section 2101.</text>
									</subsection></section><section id="HC0193C01F90F49E8B860B5858A1AB63D"><enum>2104.</enum><header>Civil
				penalties</header><text display-inline="no-display-inline">A person that
				violates this title or a regulation or order issued under this title is liable
				to the United States Government pursuant to the Secretary’s authority under
				<external-xref legal-doc="usc" parsable-cite="usc/49/114">section
				114(v)</external-xref> of title 49, United States Code.</text>
								</section><section id="H7812F2CC6EFB48C497250C380A781790"><enum>2105.</enum><header>Commercial
				motor vehicle operators registered to operate in Mexico or Canada</header><text display-inline="no-display-inline">The Secretary shall prohibit a commercial
				motor vehicle operator licensed to operate in Mexico or Canada from operating a
				commercial motor vehicle transporting a security sensitive material in commerce
				in the United States until the operator has been subjected to, and not
				disqualified as a result of, a security background records check by a Federal
				agency that the Secretary determines is similar to the security background
				records check required for commercial motor vehicle operators in the United
				States transporting security sensitive materials in commerce.</text>
								</section><section id="HDE58BAC9EDC747B4A6D9A456FDACB797"><enum>2106.</enum><header>Other security
				background checks</header><text display-inline="no-display-inline">The
				Secretary shall determine that an individual applying for a transportation
				security card under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105</external-xref> of title 46, United
				States Code, has met the background check requirements for such card if the
				individual was subjected to, and not disqualified as a result of, a security
				background records check by a Federal agency that the Secretary determines is
				equivalent to or more stringent than the background check requirements for such
				card.</text>
								</section><section id="H3E6F23CED05A4329AF8C125E548A5693"><enum>2107.</enum><header>Redundant
				background checks</header>
									<subsection id="H303DC3BBAC704A6BBCC07515F902BBEE"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">After the date of
				enactment of this title, the Secretary shall prohibit a State or political
				subdivision thereof from requiring a separate security background check of an
				individual seeking to transport hazardous materials.</text>
									</subsection><subsection id="H367C1306B8714E4CA7E50047A363D9E5"><enum>(b)</enum><header>Waivers</header><text>The
				Secretary may waive the application of subsection (a) with respect to a State
				or political subdivision thereof if the State or political subdivision
				demonstrates a compelling homeland security reason that a separate security
				background check is necessary to ensure the secure transportation of hazardous
				materials in the State or political subdivision.</text>
									</subsection><subsection id="H688F98CEC08045A0A1AAB0C4B16E6FF6"><enum>(c)</enum><header>Limitation on
				statutory construction</header><text>Nothing in this section shall limit the
				authority of a State to ensure that an individual has the requisite knowledge
				and skills to safely transport hazardous materials in commerce.</text>
									</subsection></section><section id="HCCD7437ECB0C4329B3A4DB7B3249CA6B"><enum>2108.</enum><header>Transition</header>
									<subsection id="HD8B560D065D14F2CB81DA1BDF7B05F73"><enum>(a)</enum><header>Treatment of
				individuals receiving prior hazardous materials endorsements</header><text>The
				Secretary shall treat an individual who has obtained a hazardous materials
				endorsement in accordance with
				<external-xref legal-doc="regulation" parsable-cite="cfr/49/1572">section
				1572</external-xref> of title 49, Code of Federal Regulations, before the date
				of enactment of this title, as having met the background check requirements of
				a transportation security card under
				<external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
				70105</external-xref> of title 46, United States Code, subject to reissuance or
				expiration dates of the hazardous materials endorsement.</text>
									</subsection><subsection id="HEE5B20F5AC904475B2E18F0C63864CF3"><enum>(b)</enum><header>Reduction in
				fees</header><text>The Secretary shall reduce, to the greatest extent
				practicable, any fees associated with obtaining a transportation security card
				under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
				70105</external-xref> of title 46, United Sates Code, for any individual
				referred to in subsection (a).</text>
									</subsection></section><section id="H4728B1E1A3534464B28B7A81AA08BC9D"><enum>2109.</enum><header>Savings
				clause</header><text display-inline="no-display-inline">Nothing in this title
				shall be construed as affecting the authority of the Secretary of
				Transportation to regulate hazardous materials under
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49,
				United States Code.</text>
								</section><section id="H96FC38035C824B4E825D74F6DB55DAC8"><enum>2110.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
				apply:</text>
									<paragraph id="H7CB9A221099A4EE6A7F5B33A9A9FC3C2"><enum>(1)</enum><header>Commerce</header><text>The
				term <quote>commerce</quote> means trade or transportation in the jurisdiction
				of the United States—</text>
										<subparagraph id="H2863CC4541A5437DA2E54B68C07321B2"><enum>(A)</enum><text>between a place in
				a State and a place outside of the State; or</text>
										</subparagraph><subparagraph id="H82B59BED256543AD95373C13212B311E"><enum>(B)</enum><text>that affects trade
				or transportation between a place in a State and a place outside of the
				State.</text>
										</subparagraph></paragraph><paragraph id="H25649DC2283649A49F5F04337A64DDF4"><enum>(2)</enum><header>Hazardous
				material</header><text>The term <quote>hazardous material</quote> has the
				meaning given that term in
				<external-xref legal-doc="usc" parsable-cite="usc/49/5102">section
				5102</external-xref> of title 49, United States Code.</text>
									</paragraph><paragraph id="H3B164EDE5B35450FA313956BB7C1D9CA"><enum>(3)</enum><header>Person</header><text>The
				term <quote>person</quote>, in addition to its meaning under
				<external-xref legal-doc="usc" parsable-cite="usc/1/1">section
				1</external-xref> of title 1, United States Code—</text>
										<subparagraph id="H8EE407B157C0456C9BE657E186639206"><enum>(A)</enum><text>includes a
				government, Indian tribe, or authority of a government or tribe offering
				security sensitive material for transportation in commerce or transporting
				security sensitive material to further a commercial enterprise; but</text>
										</subparagraph><subparagraph id="H7B3EBE0B82DC45B6B9210DF0077E1186"><enum>(B)</enum><text>does not
				include—</text>
											<clause id="HD5729FB8A4174D429AC626691E8FE69E"><enum>(i)</enum><text>the United States
				Postal Service; and</text>
											</clause><clause id="H139870DCBA8D410EA6CD8D5976B3C664"><enum>(ii)</enum><text>in section 2104,
				a department, agency, or instrumentality of the Government.</text>
											</clause></subparagraph></paragraph><paragraph id="H83700330217F4BC297DD23E139A46229"><enum>(4)</enum><header>Security
				sensitive material</header><text>The term <quote>security sensitive
				material</quote> has the meaning given that term in section 1501 of the
				Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1151">6 U.S.C.
				1151</external-xref>).</text>
									</paragraph><paragraph id="H15E74F3E5B2D4A15BAE8BABB44253A86"><enum>(5)</enum><header>Transports;
				transportation</header><text>The term <quote>transports</quote> or
				<quote>transportation</quote> means the movement of property and loading,
				unloading, or storage incidental to such
				movement.</text>
									</paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H42710E1C5B9E41F6AA12E925BE51C8D2"><enum>433.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">The table of
			 contents contained in section 1(b) of the Homeland Security Act of 2002 (116
			 Stat. 2135) is amended by adding at the end the following:</text>

			 issuance of hazmat licenses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5103a">Section 5103a</external-xref> of
			 title 49, United States Code, and the item relating to that section in the
			 analysis for chapter 51 of such title, are repealed.</text>
				</section><section commented="no" id="HFB8E2C116C37432EBE219F6D11C15C3E"><enum>435.</enum><header>Deadlines and
			 effective dates</header>
					<subsection commented="no" id="HED64C04B749C43B68865891077103613"><enum>(a)</enum><header>Issuance of
			 transportation security cards</header><text>Not later than May 31, 2010, the
			 Secretary shall begin issuance of transportation security cards under
			 <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section
			 70105</external-xref> of title 46, United States Code, to individuals who seek
			 to operate a motor vehicle in commerce while transporting security sensitive
			 materials.</text>
					</subsection><subsection commented="no" id="H4A4D95BF6B614B0B9EF8016181390154"><enum>(b)</enum><header>Effective date
			 of prohibitions</header><text>The prohibitions contained in sections 2101 and
			 2106 of the Homeland Security Act of 2002 (as added by this subtitle) shall
			 take effect on the date that is 3 years after the date of enactment of this
			 Act.</text>
					</subsection><subsection commented="no" id="H722B47EEDA10489A83347BD25787C4D4"><enum>(c)</enum><header>Effective date
			 of section 434 amendments</header><text display-inline="yes-display-inline">The
			 amendments made by section 434 of this Act shall take effect on the date that
			 is 3 years after the date of enactment of this Act.</text>
					</subsection></section><section id="HB90CEF7127A746B1B9857D9F813C12C7"><enum>436.</enum><header>Task force on
			 disqualifying crimes</header>
					<subsection commented="no" id="H340F9DA98D8C476BBFBF077D1A4EA35B"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a task force
			 to review the lists of crimes that disqualify individuals from
			 transportation-related employment under current regulations of the
			 Transportation Security Administration and assess whether such lists of crimes
			 are accurate indicators of a terrorism security risk.</text>
					</subsection><subsection id="H17529EA198EA4351B7D811A30B57F363"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The task force shall be composed of
			 representatives of appropriate industries, including labor unions representing
			 employees of such industries, Federal agencies, and other appropriate entities,
			 as determined by the Secretary.</text>
					</subsection><subsection id="H24B52B03855E47D0B759CE7539792319"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the task force shall submit to the Secretary and the
			 Committee on Homeland Security of the House of Representatives a report
			 containing the results of the review, including recommendations for a common
			 list of disqualifying crimes and the rationale for the inclusion of each crime
			 on the list.</text>
					</subsection></section></subtitle></title></legis-body>
