<section commented="no" display-inline="no-display-inline" id="H1B689506C03E48F096A3C63B89B58B31" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HF703B6668D844D48A82FAB86D02D3980"><enum>(1)</enum><text display-inline="yes-display-inline">The illicit nuclear activities of the Government of Iran, combined with its development of unconventional weapons and ballistic missiles and its support for international terrorism, represent a threat to the security of the United States, its strong ally Israel, and other allies of the United States around the world.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H454DF4B71D5C487BB63FCE2630A369AD"><enum>(2)</enum><text display-inline="yes-display-inline">The United States and other responsible countries have a vital interest in working together to prevent the Government of Iran from acquiring a nuclear weapons capability.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8C24C147C00742E9AD4BA489BA29EE65"><enum>(3)</enum><text display-inline="yes-display-inline">The International Atomic Energy Agency has repeatedly called attention to Iran's illicit nuclear activities and, as a result, the United Nations Security Council has adopted a range of sanctions designed to encourage the Government of Iran to suspend those activities and comply with its obligations under the Treaty on the Non-Proliferation of Nuclear Weapons, done at Washington, London, and Moscow July 1, 1968, and entered into force March 5, 1970 (commonly known as the <quote>Nuclear Non-Proliferation Treaty</quote>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6EC822BE43664F9582250CB407E01AA9"><enum>(4)</enum><text display-inline="yes-display-inline">The serious and urgent nature of the threat from Iran demands that the United States work together with its allies to do everything possible—diplomatically, politically, and economically—to prevent Iran from acquiring a nuclear weapons capability.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1DE2C462939B4B4690547630D5426928"><enum>(5)</enum><text display-inline="yes-display-inline">The United States and its major European allies, including the United Kingdom, France, and Germany, have advocated that sanctions be strengthened should international diplomatic efforts fail to achieve verifiable suspension of Iran's uranium enrichment program and an end to its nuclear weapons program and other illicit nuclear activities.</text></paragraph>
<paragraph id="H95C9EFAC03D947A589C52DA491EC862A"><enum>(6)</enum><text>The Government of Iran continues to engage in serious, systematic, and ongoing violations of human rights, including suppression of freedom of expression and religious freedom, illegitimately prolonged detention, torture, and executions. Such violations have increased in the aftermath of the fraudulent presidential election in Iran on June 12, 2009.</text></paragraph>
<paragraph id="HC116D36F49CB4A6CAA57551D57FE6EB4"><enum>(7)</enum><text>The Government of Iran has been unresponsive to President Obama's unprecedented and serious efforts at engagement, revealing that the Government of Iran is not interested in a diplomatic resolution, as made clear, for example, by the following:</text>
<subparagraph id="HD094C4DA6EAC4FB3B60BF6BD7FF532A0"><enum>(A)</enum><text>Iran's apparent rejection of the Tehran Research Reactor plan, generously offered by the United States and its partners, of potentially great benefit to the people of Iran, and endorsed by Iran's own negotiators in October 2009.</text></subparagraph>
<subparagraph id="H7DEF634769DC4B76B36FA33FD6B3B89F"><enum>(B)</enum><text>Iran's ongoing clandestine nuclear program, as evidenced by its work on the secret uranium enrichment facility at Qom, its subsequent refusal to cooperate fully with inspectors from the International Atomic Energy Agency, and its announcement that it would build 10 new uranium enrichment facilities.</text></subparagraph>
<subparagraph id="HFE68CF6C48214868BA79DC12E3B98631"><enum>(C)</enum><text>Iran’s official notification to the International Atomic Energy Agency that it would enrich uranium to the 20 percent level, followed soon thereafter by its providing to that Agency a laboratory result showing that Iran had indeed enriched some uranium to 19.8 percent.</text></subparagraph>
<subparagraph id="H76FF522F8973490F984C959A6C9DDCBE"><enum>(D)</enum><text>A February 18, 2010, report by the International Atomic Energy Agency expressing <quote>concerns about the possible existence in Iran of past or current undisclosed activities related to the development of a nuclear payload for a missile. These alleged activities consist of a number of projects and sub-projects, covering nuclear and missile related aspects, run by military-related organizations.</quote>.</text></subparagraph>
<subparagraph id="HE117BBBBAA434F6D85C92FA12867CCE1"><enum>(E)</enum><text>A May 31, 2010, report by the International Atomic Energy Agency expressing continuing strong concerns about Iran’s lack of cooperation with the Agency’s verification efforts and Iran's ongoing enrichment activities, which are contrary to the longstanding demands of the Agency and the United Nations Security Council.</text></subparagraph>
<subparagraph id="HD99DD23CA409439E8AFA2ED50F0FA4FE"><enum>(F)</enum><text>Iran’s announcement in April 2010 that it had developed a new, faster generation of centrifuges for enriching uranium.</text></subparagraph>
<subparagraph id="H6B79AF58EAF24389AEA58386296C7C65"><enum>(G)</enum><text>Iran's ongoing arms exports to, and support for, terrorists in direct contravention of United Nations Security Council resolutions.</text></subparagraph>
<subparagraph id="H48040619855745229F1216CDD85A288F"><enum>(H)</enum><text>Iran's July 31, 2009, arrest of 3 young citizens of the United States on spying charges.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDD7ACAA6E564402CA3D6661E92023322"><enum>(8)</enum><text display-inline="yes-display-inline">There is an increasing interest by State governments, local governments, educational institutions, and private institutions, business firms, and other investors to disassociate themselves from companies that conduct business activities in the energy sector of Iran, since such business activities may directly or indirectly support the efforts of the Government of Iran to achieve a nuclear weapons capability.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H692131A797F5458CA18B110781DC81F4"><enum>(9)</enum><text display-inline="yes-display-inline">Black market proliferation networks continue to flourish in the Middle East, allowing countries like Iran to gain access to sensitive dual-use technologies.</text></paragraph>
<paragraph id="H43A04F8A9DE148B6AAB0FB39D78F3C77"><enum>(10)</enum><text>Economic sanctions imposed pursuant to the provisions of this Act, the Iran Sanctions Act of 1996, as amended by this Act, and the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), and other authorities available to the United States to impose economic sanctions to prevent Iran from developing nuclear weapons, are necessary to protect the essential security interests of the United States.</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="HB044AFFB7F614D5CB096BAACA181F7B0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Sense of Congress regarding the need to impose additional sanctions with respect to Iran</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H99D7E6E6F2904516B577DF4D68AA2424"><enum>(1)</enum><text display-inline="yes-display-inline">international diplomatic efforts to address Iran's illicit nuclear efforts and support for international terrorism are more likely to be effective if strong additional sanctions are imposed on the Government of Iran;</text></paragraph>
<paragraph id="HC981CE67C2A04B6AAB9B170D9E11A4AE"><enum>(2)</enum><text>the concerns of the United States regarding Iran are strictly the result of the actions of the Government of Iran;</text></paragraph>
<paragraph id="HA4444C087AD64D94AC0804AA8DC3965A"><enum>(3)</enum><text>the revelation in September 2009 that Iran is developing a secret uranium enrichment site on a base of Iran's Revolutionary Guard Corps near Qom, which appears to have no civilian application, highlights the urgency that Iran—</text>
<subparagraph id="HE7187F200AB044078297A7FA5CD88712"><enum>(A)</enum><text>disclose the full nature of its nuclear program, including any other secret locations; and</text></subparagraph>
<subparagraph id="H0DF6FA6282F2483D82B6E41F586490B0"><enum>(B)</enum><text>provide the International Atomic Energy Agency unfettered access to its facilities pursuant to Iran's legal obligations under the Treaty on the Non-Proliferation of Nuclear Weapons, done at Washington, London, and Moscow July 1, 1968, and entered into force March 5, 1970 (commonly known as the <quote>Nuclear Non-Proliferation Treaty</quote>) and Iran's safeguards agreement with the International Atomic Energy Agency;</text></subparagraph></paragraph>
<paragraph id="H777CEE87549147D78AB613F93951FCE5"><enum>(4)</enum><text>because of the involvement of Iran's Revolutionary Guard Corps in Iran's nuclear program, international terrorism, and domestic human rights abuses, the President should impose the full range of applicable sanctions on—</text>
<subparagraph id="H6ACBB012C207495FBC086F2BDF5B4D62"><enum>(A)</enum><text>any individual or entity that is an agent, alias, front, instrumentality, representative, official, or affiliate of Iran's Revolutionary Guard Corps; and</text></subparagraph>
<subparagraph id="H34D869F70941477EB4FE0BEA01B90136"><enum>(B)</enum><text>any individual or entity that has conducted any commercial transaction or financial transaction with an individual or entity described in subparagraph (A);</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H26F462C7CBA644488660ED04A138F058"><enum>(5)</enum><text display-inline="yes-display-inline">additional measures should be adopted by the United States to prevent the diversion of sensitive dual-use technologies to Iran;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD968875D19BA447594A3C5FED1D62334"><enum>(6)</enum><text display-inline="yes-display-inline">the President should—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H3498CA67B00D49C48846EF4645F97C83"><enum>(A)</enum><text display-inline="yes-display-inline">continue to urge the Government of Iran to respect the internationally recognized human rights and religious freedoms of its citizens;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H82965FAB17904B0A81D90DA625CCF3AA"><enum>(B)</enum><text display-inline="yes-display-inline">identify the officials of the Government of Iran and other individuals who are responsible for continuing and severe violations of human rights and religious freedom in Iran; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H66DE181326D145B381566B8C3B4C148D"><enum>(C)</enum><text display-inline="yes-display-inline">take appropriate measures to respond to such violations, including by—</text>
<clause commented="no" display-inline="no-display-inline" id="H7F375E41CEF347EDBC3735CF4092F175"><enum>(i)</enum><text display-inline="yes-display-inline">prohibiting officials and other individuals the President identifies as being responsible for such violations from entry into the United States; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H4DDAF2DB1B0446F1B6745CF2E7865EFD"><enum>(ii)</enum><text display-inline="yes-display-inline">freezing the assets of the officials and other individuals described in clause (i);</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0B62365EC88440CA93978AC60B5A2F9A"><enum>(7)</enum><text display-inline="yes-display-inline">additional funding should be provided to the Secretary of State to document, collect, and disseminate information about human rights abuses in Iran, including serious abuses that have taken place since the presidential election in Iran on June 12, 2009;</text></paragraph>
<paragraph id="H485928CCC3AC4E89B5A33ECBF7E3F7A1"><enum>(8)</enum><text>with respect to nongovernmental organizations based in the United States—</text>
<subparagraph id="H69858E4BCDB04F2B97E211850FD9E34C"><enum>(A)</enum><text>many of such organizations are essential to promoting human rights and humanitarian goals around the world;</text></subparagraph>
<subparagraph id="HA26267464F0A48C6BF873F41DDB835C9"><enum>(B)</enum><text>it is in the national interest of the United States to allow responsible nongovernmental organizations based in the United States to establish and carry out operations in Iran to promote civil society and foster humanitarian goodwill among the people of Iran; and</text></subparagraph>
<subparagraph id="H5C48BDE9A0D54D6792A43CDA71A8211D"><enum>(C)</enum><text>the United States should ensure that the organizations described in subparagraph (B) are not unnecessarily hindered from working in Iran to provide humanitarian, human rights, and people-to-people assistance, as appropriate, to the people of Iran;</text></subparagraph></paragraph>
<paragraph id="HD4969A2FB1D84A3C9A742AE606C74403"><enum>(9)</enum><text>the United States should not issue a license pursuant to an agreement for cooperation (as defined in section 11 b. of the Atomic Energy Act of 1954 (42 U.S.C. 2014(b))) for the export of nuclear material, facilities, components, or other goods, services, or technology that are or would be subject to such an agreement to a country that is providing similar nuclear material, facilities, components, or other goods, services, or technology to another country that is not in full compliance with its obligations under the Nuclear Non-Proliferation Treaty, including its obligations under the safeguards agreement between that country and the International Atomic Energy Agency, unless the President determines that the provision of such similar nuclear material, facilities, components, or other goods, services, or technology to such other country does not undermine the nonproliferation policies and objectives of the United States; and</text></paragraph>
<paragraph id="HEB304A1389AD4C57872927F471DF9E95"><enum>(10)</enum><text>the people of the United States—</text>
<subparagraph id="HA5FA487C54C54A1787612BDF7B9A724D"><enum>(A)</enum><text>have feelings of friendship for the people of Iran;</text></subparagraph>
<subparagraph id="H25EEDEA25AFB4BBB83D979ADFEDFA1CE"><enum>(B)</enum><text>regret that developments in recent decades have created impediments to that friendship; and</text></subparagraph>
<subparagraph id="HFB27A2C13E6947349C88165B52AE2A9E"><enum>(C)</enum><text>hold the people of Iran, their culture, and their ancient and rich history in the highest esteem.</text></subparagraph></paragraph></section>

<paragraph commented="no" display-inline="no-display-inline" id="HA02E07CBBE4F4ED881F22B0EE52995AC"><enum>(1)</enum><header display-inline="yes-display-inline">Agricultural commodity</header><text display-inline="yes-display-inline">The term <term>agricultural commodity</term> has the meaning given that term in section 102 of the Agricultural Trade Act of 1978 (7 U.S.C. 5602).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7634C6BB5E944874BF4C3A538DC9B144"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> has the meaning given that term in section 14 of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note), as amended by section 102 of this Act.</text></paragraph>

<section commented="no" display-inline="no-display-inline" id="H1EFDFB8CCB9548CABDAAE42D5D0C5528" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Expansion of sanctions under the Iran Sanctions Act of 1996</header>
<subsection commented="no" display-inline="no-display-inline" id="HCA5B73CA31E248E4A21BFE3D6B3702DF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5 of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H1802F1F1FFD64165871DBCDECBE7ADB2"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H80794E0E3AD84665B9276DF08BA0CBE7"><enum>(a)</enum><header display-inline="yes-display-inline">Sanctions with respect to the development of petroleum resources of Iran, production of refined petroleum products in Iran, and exportation of refined petroleum products to Iran</header>
<paragraph commented="no" display-inline="no-display-inline" id="H8B2AA2B297DA4767BC455777D902909A"><enum>(1)</enum><header display-inline="yes-display-inline">Development of petroleum resources of Iran</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H8A3373E1F0384A6297D84689C863FCC4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (f), the President shall impose 3 or more of the sanctions described in section 6(a) with respect to a person if the President determines that the person knowingly, on or after the date of the enactment of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>—</text>
<clause commented="no" display-inline="no-display-inline" id="HE298F19B5CE04569922D47AB6BA4F67A"><enum>(i)</enum><text display-inline="yes-display-inline">makes an investment described in subparagraph (B) of $20,000,000 or more; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H3D36E400F77F41D8A76BB90230269898"><enum>(ii)</enum><text display-inline="yes-display-inline">makes a combination of investments described in subparagraph (B) in a 12-month period if each such investment is of at least $5,000,000 and such investments equal or exceed $20,000,000 in the aggregate.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB6CB48ECA395408D948D8706FA28BCE5"><enum>(B)</enum><header display-inline="yes-display-inline">Investment described</header><text display-inline="yes-display-inline">An investment described in this subparagraph is an investment that directly and significantly contributes to the enhancement of Iran’s ability to develop petroleum resources.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5C053BD3DAB642B686DD9FA9E1E8F7FF"><enum>(2)</enum><header display-inline="yes-display-inline">Production of refined petroleum products</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HE378CABAE5144B9E82FBB3BC08382C52"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (f), the President shall impose 3 or more of the sanctions described in section 6(a) with respect to a person if the President determines that the person knowingly, on or after the date of the enactment of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>, sells, leases, or provides to Iran goods, services, technology, information, or support described in subparagraph (B)—</text>
<clause commented="no" display-inline="no-display-inline" id="H20784B1E7B314B4DA123517A8813290A"><enum>(i)</enum><text display-inline="yes-display-inline">any of which has a fair market value of $1,000,000 or more; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H916146D7DC1A4FFB9823328D66657A51"><enum>(ii)</enum><text display-inline="yes-display-inline">that, during a 12-month period, have an aggregate fair market value of $5,000,000 or more.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF308B15162FB402AAC8C7C7F898F5A87"><enum>(B)</enum><header display-inline="yes-display-inline">Goods, services, technology, information, or support described</header><text display-inline="yes-display-inline">Goods, services, technology, information, or support described in this subparagraph are goods, services, technology, information, or support that could directly and significantly facilitate the maintenance or expansion of Iran's domestic production of refined petroleum products, including any direct and significant assistance with respect to the construction, modernization, or repair of petroleum refineries.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC8F1F5E064A2485096DA7F2C155C8338"><enum>(3)</enum><header display-inline="yes-display-inline">Exportation of refined petroleum products to Iran</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H44F49CEE24B4485CA45D55D9878588BB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (f), the President shall impose 3 or more of the sanctions described in section 6(a) with respect to a person if the President determines that the person knowingly, on or after the date of the enactment of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>—</text>
<clause commented="no" display-inline="no-display-inline" id="H7C930CA3DC9F4A2C974D0C79E126293D"><enum>(i)</enum><text display-inline="yes-display-inline">sells or provides to Iran refined petroleum products—</text>
<subclause commented="no" display-inline="no-display-inline" id="H44F6220AAD364C22A29A709938D5FEE7"><enum>(I)</enum><text display-inline="yes-display-inline">that have a fair market value of $1,000,000 or more; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HE1921644D09F4D5A9CDF57F4462A8007"><enum>(II)</enum><text display-inline="yes-display-inline">that, during a 12-month period, have an aggregate fair market value of $5,000,000 or more; or</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H4E7B6C0E76B041DAA81C418DF3513731"><enum>(ii)</enum><text display-inline="yes-display-inline">sells, leases, or provides to Iran goods, services, technology, information, or support described in subparagraph (B)—</text>
<subclause commented="no" display-inline="no-display-inline" id="H02CAFC9FA7EF4C2BB75FEC55DAC4417D"><enum>(I)</enum><text display-inline="yes-display-inline">any of which has a fair market value of $1,000,000 or more; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HFB030D8D9CA04051A8262CAE31AA2942"><enum>(II)</enum><text display-inline="yes-display-inline">that, during a 12-month period, have an aggregate fair market value of $5,000,000 or more.</text></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3927EE50D0014676821D55D566D3ADAE"><enum>(B)</enum><header display-inline="yes-display-inline">Goods, services, technology, information, or support described</header><text display-inline="yes-display-inline">Goods, services, technology, information, or support described in this subparagraph are goods, services, technology, information, or support that could directly and significantly contribute to the enhancement of Iran’s ability to import refined petroleum products, including—</text>
<clause commented="no" display-inline="no-display-inline" id="H10809911C2964A389D43903F5C75A3EC"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (C), underwriting or entering into a contract to provide insurance or reinsurance for the sale, lease, or provision of such goods, services, technology, information, or support;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H1393F48A760949C69E983344808E1A44"><enum>(ii)</enum><text display-inline="yes-display-inline">financing or brokering such sale, lease, or provision; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA5D1CC9F941A4F78813AFB5653609CA1"><enum>(iii)</enum><text display-inline="yes-display-inline">providing ships or shipping services to deliver refined petroleum products to Iran.</text></clause></subparagraph>
<subparagraph commented="no" id="HC5EED4F4439F44AF9F20E09EF4367F1A"><enum>(C)</enum><header>Exception for underwriters and insurance providers exercising due diligence</header><text display-inline="yes-display-inline">The President may not impose sanctions under this paragraph with respect to a person that provides underwriting services or insurance or reinsurance if the President determines that the person has exercised due diligence in establishing and enforcing official policies, procedures, and controls to ensure that the person does not underwrite or enter into a contract to provide insurance or reinsurance for the sale, lease, or provision of goods, services, technology, information, or support described in subparagraph (B).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8ECFD17F46874DC48DBAE4C0A9DFAD71"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H00C032B03A934D968F640C40E58FACF0"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and moving such subparagraphs, as so redesignated, 2 ems to the right;</text></subparagraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H0B0303FA30D04D318487B6B0F940D44A"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H500872D9218B4D1595CDFABDDA97C982" style="OLC">
<paragraph commented="no" display-inline="no-display-inline" id="H3627839CDECE4380AC033DB7B18D956E"><enum>(2)</enum><header display-inline="yes-display-inline">Additional mandatory sanctions relating to transfer of nuclear technology</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H9F44931471CF49BDB0E4658BA905E655"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraphs (B) and (C), in any case in which a person is subject to sanctions under paragraph (1) because of an activity described in that paragraph that relates to the acquisition or development of nuclear weapons or related technology or of missiles or advanced conventional weapons that are designed or modified to deliver a nuclear weapon, no license may be issued for the export, and no approval may be given for the transfer or retransfer, directly or indirectly, to the country the government of which has primary jurisdiction over the person, of any nuclear material, facilities, components, or other goods, services, or technology that are or would be subject to an agreement for cooperation between the United States and that government.</text></subparagraph>
<subparagraph id="HC614A11457BE475B97123DA810C5797A"><enum>(B)</enum><header>Exception</header><text>The sanctions described in subparagraph (A) shall not apply with respect to a country the government of which has primary jurisdiction over a person that engages in an activity described in that subparagraph if the President determines and notifies the appropriate congressional committees that the government of the country—</text>
<clause id="HC6694FF331EB42EC99A315DE4509DFB7"><enum>(i)</enum><text>does not know or have reason to know about the activity; or</text></clause>
<clause id="H6C39664A1CFA4528BB97D341A8777E74"><enum>(ii)</enum><text>has taken, or is taking, all reasonable steps necessary to prevent a recurrence of the activity and to penalize the person for the activity.</text></clause></subparagraph>
<subparagraph id="H1B4E4FD1C0E442599868B144F1FA8CD9"><enum>(C)</enum><header>Individual approval</header><text>Notwithstanding subparagraph (A), the President may, on a case-by-case basis, approve the issuance of a license for the export, or approve the transfer or retransfer, of any nuclear material, facilities, components, or other goods, services, or technology that are or would be subject to an agreement for cooperation, to a person in a country to which subparagraph (A) applies (other than a person that is subject to the sanctions under paragraph (1)) if the President—</text>
<clause id="H56473CFD0DEB48B381F4CE24BCB6D3A6"><enum>(i)</enum><text>determines that such approval is vital to the national security interests of the United States; and</text></clause>
<clause id="H259978FDFA274EA0A27F15C1A1AEF17C"><enum>(ii)</enum><text>not later than 15 days before issuing such license or approving such transfer or retransfer, submits to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate the justification for approving such license, transfer, or retransfer.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H53C70DB74FA541FAAA85E3BCC7997982"><enum>(D)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">The restrictions in subparagraph (A) shall apply in addition to all other applicable procedures, requirements, and restrictions contained in the Atomic Energy Act of 1954 and other related laws.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0AF5D6100DB846F995EC91D523EFB0AC"><enum>(E)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>agreement for cooperation</quote> has the meaning given that term in section 11 b. of the Atomic Energy Act of 1954 (42 U.S.C. 2014(b)).</text></subparagraph>
<subparagraph id="HD26896E251104C2196F00925A07C469B"><enum>(F)</enum><header>Applicability</header><text display-inline="yes-display-inline">The sanctions under subparagraph (A) shall apply only in a case in which a person is subject to sanctions under paragraph (1) because of an activity described in that paragraph in which the person engages on or after the date of the enactment of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>

<paragraph commented="no" display-inline="no-display-inline" id="H79830CDD0A0E49519C9BF45729322BD3"><enum>(7)</enum><header display-inline="yes-display-inline">Banking transactions</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations as the President may prescribe, prohibit any transfers of credit or payments between financial institutions or by, through, or to any financial institution, to the extent that such transfers or payments are subject to the jurisdiction of the United States and involve any interest of the sanctioned person.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H082AA4E9FD43477C99C040A0A6FD45BC"><enum>(8)</enum><header display-inline="yes-display-inline">Property transactions</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations as the President may prescribe, prohibit any person from—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HA41DC4F8E75C4288870BAB9CFCFD8235"><enum>(A)</enum><text display-inline="yes-display-inline">acquiring, holding, withholding, using, transferring, withdrawing, transporting, importing, or exporting any property that is subject to the jurisdiction of the United States and with respect to which the sanctioned person has any interest;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H81FF598088CC48ED9F9FF9F4D93964A4"><enum>(B)</enum><text display-inline="yes-display-inline">dealing in or exercising any right, power, or privilege with respect to such property; or</text></subparagraph>

<subsection commented="no" id="H2F297CA12DA84C83B2DB816DF6A54D90"><enum>(b)</enum><header>Additional measure relating to Government contracts</header>
<paragraph commented="no" id="HCCAED47E6BD546BC9E854D1F119652A4"><enum>(1)</enum><header>Modification of federal acquisition regulation</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>, the Federal Acquisition Regulation issued pursuant to section 25 of the Office of Federal Procurement Policy Act (41 U.S.C. 421) shall be revised to require a certification from each person that is a prospective contractor that the person, and any person owned or controlled by the person, does not engage in any activity for which sanctions may be imposed under section 5.</text></paragraph>
<paragraph commented="no" id="H09A4191E7B87498D818448B4F312E98D"><enum>(2)</enum><header>Remedies</header>
<subparagraph commented="no" id="HB4F194B835934798A681659F2EBE756B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the head of an executive agency determines that a person has submitted a false certification under paragraph (1) on or after the date on which the revision of the Federal Acquisition Regulation required by this subsection becomes effective, the head of that executive agency shall terminate a contract with such person or debar or suspend such person from eligibility for Federal contracts for a period of not more than 3 years. Any such debarment or suspension shall be subject to the procedures that apply to debarment and suspension under the Federal Acquisition Regulation under subpart 9.4 of part 9 of title 48, Code of Federal Regulations.</text></subparagraph>
<subparagraph commented="no" id="HED598414163C44BB8406261CE31F304A"><enum>(B)</enum><header>Inclusion on list of parties excluded from federal procurement and nonprocurement programs</header><text>The Administrator of General Services shall include on the List of Parties Excluded from Federal Procurement and Nonprocurement Programs maintained by the Administrator under part 9 of the Federal Acquisition Regulation issued pursuant to section 25 of the Office of Federal Procurement Policy Act (41 U.S.C. 421) each person that is debarred, suspended, or proposed for debarment or suspension by the head of an executive agency on the basis of a determination of a false certification under subparagraph (A).</text></subparagraph></paragraph>
<paragraph commented="no" id="HF2C5EF9900234E9280EC3AF96C5F0763"><enum>(3)</enum><header>Clarification regarding certain products</header><text display-inline="yes-display-inline">The remedies set forth in paragraph (2) shall not apply with respect to the procurement of eligible products, as defined in section 308(4) of the Trade Agreements Act of 1974 (19 U.S.C. 2518(4)), of any foreign country or instrumentality designated under section 301(b) of that Act (19 U.S.C. 2511(b)).</text></paragraph>
<paragraph commented="no" id="H2B27CF196451456E842A8AB4610B6A06"><enum>(4)</enum><header>Rule of construction</header><text>This subsection shall not be construed to limit the use of other remedies available to the head of an executive agency or any other official of the Federal Government on the basis of a determination of a false certification under paragraph (1).</text></paragraph>
<paragraph commented="no" id="HC30C935BA48741C0B4A99ACE5BF74F8A"><enum>(5)</enum><header>Waivers</header><text display-inline="yes-display-inline">The President may on a case-by-case basis waive the requirement that a person make a certification under paragraph (1) if the President determines and certifies in writing to the appropriate congressional committees, the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives, that it is in the national interest of the United States to do so.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H74DA4ABC93B34497971E5A9C41A4B43A"><enum>(6)</enum><header>Executive agency defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>executive agency</quote> has the meaning given that term in section 4 of the Office of Federal Procurement Policy Act (41 U.S.C. 403).</text></paragraph>
<paragraph id="H99E20BACE9174C05B14582C941947F17"><enum>(7)</enum><header>Applicability</header><text>The revisions to the Federal Acquisition Regulation required under paragraph (1) shall apply with respect to contracts for which solicitations are issued on or after the date that is 90 days after the date of the enactment of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H73B1FD87C8EB4CBBB0A084A9DBBFBBE7"><enum>(c)</enum><header display-inline="yes-display-inline">Presidential waiver</header><text display-inline="yes-display-inline">Section 9 of such Act is amended—</text>

<subclause commented="no" display-inline="no-display-inline" id="H95C9496D605844B7B560438F29797B75"><enum>(I)</enum><text display-inline="yes-display-inline">chemical, biological, or nuclear weapons or related technologies; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H07E59A0FFC4047A8B314FDD2EC26BA0A"><enum>(II)</enum><text display-inline="yes-display-inline">destabilizing numbers and types of advanced conventional weapons; and</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection commented="no" id="H98D457461BC041DD890003C7BB965C6E"><enum>(d)</enum><header>Reports on global trade relating to Iran</header><text>Section 10 of such Act is amended by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H5F46E7B4CFA941C1A847DBCDADB1A357"><enum>(d)</enum><header display-inline="yes-display-inline">Reports on global trade relating to Iran</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>, and annually thereafter, the President shall submit to the appropriate congressional committees a report, with respect to the most recent 12-month period for which data are available, on the dollar value amount of trade, including in the energy sector, between Iran and each country maintaining membership in the Group of 20 Finance Ministers and Central Bank Governors.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" id="H7B3C3D1915984504A76C716FA5727B94"><enum>(e)</enum><header>Extension of Iran Sanctions Act of 1996</header><text>Section 13(b) of such Act is amended by striking <quote>December 31, 2011</quote> and inserting <quote>December 31, 2016</quote>.</text></subsection>

<clause commented="no" id="HF58D196303084AE3B6498AA38319936D"><enum>(i)</enum><text>certifies to the appropriate congressional committees that—</text>
<subclause commented="no" id="H252271665A334BBFB4C50A8947F23A2B"><enum>(I)</enum><text>the government with primary jurisdiction over the person is closely cooperating with the United States in multilateral efforts to prevent Iran from—</text>
<item commented="no" id="HFF836DC9D4AB4ED090365D4EB635955B"><enum>(aa)</enum><text>acquiring or developing chemical, biological, or nuclear weapons or related technologies; or</text></item>
<item commented="no" id="H0FF46094A0484F3CB4767FA8060086EC"><enum>(bb)</enum><text>acquiring or developing destabilizing numbers and types of advanced conventional weapons; and</text></item></subclause>
<subclause commented="no" id="HF22FDD6E76AB4F03BB0B140F89FE5160"><enum>(II)</enum><text>such a waiver is vital to the national security interests of the United States; and</text></subclause></clause>
<clause commented="no" id="HC0061B8FE073454B8A93BE6AB36F8341"><enum>(ii)</enum><text>submits to the appropriate congressional committees a report identifying—</text>
<subclause commented="no" id="H03B3A98FDCA441679AE93E64A8FE1AD9"><enum>(I)</enum><text display-inline="yes-display-inline">the person with respect to which the President waives the application of sanctions; and</text></subclause>
<subclause commented="no" id="H8B14EF7D72B6427788F92239FFADD932"><enum>(II)</enum><text display-inline="yes-display-inline">the actions taken by the government described in clause (i)(I) to cooperate in multilateral efforts described in that clause.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph commented="no" id="HC2EDFC8AAC4142F39020C1E37CB91764"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="HB7402F39017B4892BD6A43AFF7AEB3DC" style="OLC">
<paragraph commented="no" id="H77672F6860974C74BA2F36FA7B129165"><enum>(2)</enum><header>Subsequent renewal of waiver</header><text>At the conclusion of the period of a waiver under subparagraph (A) or (B) of paragraph (1), the President may renew the waiver—</text>
<subparagraph commented="no" id="H09E6ED42029349828F9D63FB1B968EE5"><enum>(A)</enum><text>if the President determines, in accordance with subparagraph (A) or (B) of that paragraph (as the case may be), that the waiver is appropriate; and</text></subparagraph>
<subparagraph commented="no" id="H2341F7A4BFC84BB59FD4ACA292736CBA"><enum>(B)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H449800E5F98441969A3EDE05A078763D"><enum>(i)</enum><text>in the case of a waiver under subparagraph (A) of paragraph (1), for subsequent periods of not more than six months each; and</text></clause>
<clause commented="no" id="HB666D8E9BF534B4387E61A09A00E19D4" indent="up1"><enum>(ii)</enum><text>in the case of a waiver under subparagraph (B) of paragraph (1), for subsequent periods of not more than 12 months each.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H0568C01528A94817B09FACC5C419159A"><enum>(B)</enum><text>in paragraph (2)—</text>
<clause commented="no" display-inline="no-display-inline" id="HA68C60642B234D2F872138F41D5A8B25"><enum>(i)</enum><text>by striking <quote>should determine</quote> and inserting <quote>shall (unless paragraph (3) applies) determine</quote>; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H1F73E1DB9DE946AF8EBC7A753CD0A9D7"><enum>(ii)</enum><text>by striking <quote>investment activity in Iran as</quote> and inserting <quote>an activity</quote>; and</text></clause></subparagraph>
<subparagraph id="HF9C1415C759743038095BEE64D63EFD6"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph commented="no" id="HF03F17D2CCA542108FB1DCCC23243B6B"><enum>(3)</enum><header>Special rule</header><text display-inline="yes-display-inline">The President need not initiate an investigation, and may terminate an investigation, under this subsection if the President certifies in writing to the appropriate congressional committees that—</text>
<subparagraph commented="no" id="H83BF8802882843CE8F7D2A78EF376603"><enum>(A)</enum><text>the person whose activity was the basis for the investigation is no longer engaging in the activity or has taken significant verifiable steps toward stopping the activity; and</text></subparagraph>
<subparagraph commented="no" id="H99388B35C0E54776AD1E141C7E06BEB5"><enum>(B)</enum><text>the President has received reliable assurances that the person will not knowingly engage in an activity described in section 5(a) in the future.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H89CF4266A9C74F7CB01BE1D54EB5EC39"><enum>(h)</enum><header>Effective date</header>
<paragraph commented="no" display-inline="no-display-inline" id="HBDDC27EA0B0D4CC5B4D8415305EDAD30"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBED7BBA3663E45D8BFF58776757237D1"><enum>(A)</enum><text>take effect on the date of the enactment of this Act; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1D7DEA63687044E8B45CC105DEDD3D1D"><enum>(B)</enum><text>except as provided in this subsection or section 6(b)(7) of the Iran Sanctions Act of 1996, as amended by subsection (b) of this section, apply with respect to an investment or activity described in subsection (a) or (b) of section 5 of the Iran Sanctions Act of 1996, as amended by this section, that is commenced on or after such date of enactment.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6CA7AC4980FE452AB5761511E3F8FA1E"><enum>(2)</enum><header>Applicability to ongoing investments prohibited under prior law</header><text>A person that makes an investment described in section 5(a) of the Iran Sanctions Act of 1996, as in effect on the day before the date of the enactment of this Act, that is commenced before such date of enactment and continues on or after such date of enactment, shall, except as provided in paragraph (4), be subject to the provisions of the Iran Sanctions Act of 1996, as in effect on the day before such date of enactment.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD885E822F5B2430B884CEF09CA5FF1C2"><enum>(3)</enum><header>Applicability to ongoing activities relating to chemical, biological, or nuclear weapons or related technologies</header><text>A person that, before the date of the enactment of this Act, commenced an activity described in section 5(b) of the Iran Sanctions Act of 1996, as in effect on the day before such date of enactment, and continues the activity on or after such date of enactment, shall be subject to the provisions of the Iran Sanctions Act of 1996, as amended by this Act.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3992382F39F647D490B8BFF3CEA71997"><enum>(4)</enum><header>Applicability of mandatory investigations to investments</header><text>The amendments made by subsection (g)(5) of this section shall apply on and after the date of the enactment of this Act—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H5DB4DEC9114A44F99705052DA2AC18C3"><enum>(A)</enum><text>with respect to an investment described in section 5(a)(1) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section, that is commenced on or after such date of enactment; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H21458D44421F4C8BB928797BAC81477F"><enum>(B)</enum><text>with respect to an investment described in section 5(a) of the Iran Sanctions Act of 1996, as in effect on the day before the date of the enactment of this Act, that is commenced before such date of enactment and continues on or after such date of enactment.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDDA5B0AA39A541ED84695FF3256DA3C0"><enum>(5)</enum><header>Applicability of mandatory investigations to activities relating to petroleum</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H95952A756C9C4DAD90CEB435ED0173C7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the amendments made by subsection (g)(5) of this section shall apply on and after the date that is 1 year after the date of the enactment of this Act with respect to an activity described in paragraph (2) or (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section, that is commenced on or after the date that is 1 year after the date of the enactment of this Act or the date on which the President fails to submit a certification that is required under subparagraph (B) (whichever is applicable).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCF8564395AD84A2BB484B6FEC9BCCDDA"><enum>(B)</enum><header>Special rule for delay of effective date</header>
<clause commented="no" display-inline="no-display-inline" id="H1964513AC66D4B0EA6EB7190450D4828"><enum>(i)</enum><header>Reporting requirement</header><text>Not later than 30 days before the date that is 1 year after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report describing—</text>
<subclause commented="no" display-inline="no-display-inline" id="H0F7784E17D77495C9C31522F558893DE"><enum>(I)</enum><text>the diplomatic and other efforts of the President—</text>
<item commented="no" display-inline="no-display-inline" id="H40CE443BEB644332B5E270D60EF89D7A"><enum>(aa)</enum><text>to dissuade foreign persons from engaging in activities described in paragraph (2) or (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section; and</text></item>
<item commented="no" display-inline="no-display-inline" id="H4C0984BBECBA443595025B46294DF31A"><enum>(bb)</enum><text>to encourage other governments to dissuade persons over which those governments have jurisdiction from engaging in such activities;</text></item></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HAAB0C83B33AF4ECDB3712FB3A4AD09D5"><enum>(II)</enum><text>the successes and failures of the efforts described in subclause (I); and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HFFB23E30E8C944FE8074CCA63A76C6A0"><enum>(III)</enum><text>each investigation under section 4(e) of the Iran Sanctions Act of 1996, as amended by subsection (g)(5) of this section and as in effect pursuant to subparagraph (C) of this paragraph, or any other review of an activity described in paragraph (2) or (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section, that is initiated or ongoing during the period beginning on the date of the enactment of this Act and ending on the date on which the President is required to submit the report.</text></subclause></clause>
<clause commented="no" id="H18527C39AECA47B7B1EF930463097701"><enum>(ii)</enum><header>Certification</header><text>If the President submits to the appropriate congressional committees, with the report required by clause (i), a certification that there was a substantial reduction in activities described in paragraphs (2) and (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section, during the period described in clause (i)(III), the effective date provided for in subparagraph (A) shall be delayed for a 180-day period beginning after the date provided for in that subparagraph.</text></clause>
<clause commented="no" id="H47305B8264F147FEA8E53A3C83883ECA"><enum>(iii)</enum><header>Subsequent reports and delays</header><text>The effective date provided for in subparagraph (A) shall be delayed for additional 180-day periods occurring after the end of the 180-day period provided for under clause (ii), if, not later than 30 days before the 180-day period preceding such additional 180-day period expires, the President submits to the appropriate congressional committees—</text>
<subclause commented="no" id="HF16F061298BB47C69C4139FE04A5A953"><enum>(I)</enum><text>a report containing the matters required in the report under clause (i) for the period beginning on the date on which the preceding report was required to be submitted under clause (i) or this clause (as the case may be) and ending on the date on which the President is required to submit the most recent report under this clause; and</text></subclause>
<subclause commented="no" id="HD54A856F9C28494FBDCE8047879161E0"><enum>(II)</enum><text>a certification that, during the period described in subclause (I), there was (as compared to the period for which the preceding report was submitted under this subparagraph) a progressive reduction in activities described in paragraphs (2) and (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section.</text></subclause></clause>
<clause commented="no" id="H895CB02C70114BD5A8078CAB0210BE91"><enum>(iv)</enum><header>Consequence of failure to certify</header><text>If the President does not make a certification at a time required by this subparagraph—</text>
<subclause commented="no" id="HC3495BD5320549CA82638543CCD9CFAC"><enum>(I)</enum><text>the amendments made by subsection (g)(5) of this section shall apply on and after the date on which the certification was required to be submitted by this subparagraph, with respect to an activity described in paragraph (2) or (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section, that—</text>
<item commented="no" id="HFEE48E568D5D4F7D851837891674AEFD"><enum>(aa)</enum><text>is referenced in the most recent report required to be submitted under this subparagraph; or</text></item>
<item commented="no" id="HD3364D801D6E48FF9BB2319FB2AA0927"><enum>(bb)</enum><text>is commenced on or after the date on which such most recent report is required to be submitted; and</text></item></subclause>
<subclause commented="no" id="HDD62689677D344208E7CCFB8A9FE750D"><enum>(II)</enum><text>not later than 45 days after the date on which the certification was required to be submitted by this subparagraph, the President shall make a determination under paragraph (2) or (3) of section 5(a) of the Iran Sanctions Act of 1996 (as the case may be), as amended by subsection (a) of this section, with respect to relevant activities described in subclause (I)(aa).</text></subclause></clause></subparagraph>
<subparagraph commented="no" id="HE19B4A86235F4D7EB368633CC0EA9E12"><enum>(C)</enum><header>Applicability of permissive investigations</header><text>During the 1-year period beginning on the date of the enactment of this Act and during any 180-day period during which the effective date provided for in subparagraph (A) is delayed pursuant to subparagraph (B), section 4(e) of the Iran Sanctions Act of 1996, as amended by subsection (g)(5) of this section, shall be applied, with respect to an activity described in paragraph (2) or (3) of section 5(a) of the Iran Sanctions Act of 1996, as amended by subsection (a) of this section, by substituting <quote>should</quote> for <quote>shall</quote> each place it appears.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0ECCA7D36C5043C09AF21045E208C553"><enum>(6)</enum><header display-inline="yes-display-inline">Waiver authority</header><text display-inline="yes-display-inline">The amendments made by subsection (c) shall not be construed to affect any exercise of the authority under section 9(c) of the Iran Sanctions Act of 1996, as in effect on the day before the date of the enactment of this Act.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H18A3F5D1166B43DB8E68C8CC58D3FDA6" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Economic sanctions relating to Iran</header>
<subsection commented="no" display-inline="no-display-inline" id="HA83FEF59698C48BEBAE683C3617F385F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 101 of the Iran Freedom Support Act (Public Law 109–293; 120 Stat. 1344), and in addition to any other sanction in effect, beginning on the date that is 90 days after the date of the enactment of this Act, the economic sanctions described in subsection (b) shall apply with respect to Iran.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA06235632DA4495B8D4CB5FB97808980"><enum>(b)</enum><header display-inline="yes-display-inline">Sanctions</header><text display-inline="yes-display-inline">The sanctions described in this subsection are the following:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HD3A197DE92FC4E3B87E697F28A159918"><enum>(1)</enum><header display-inline="yes-display-inline">Prohibition on imports</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H4F598D3DCA564EA3AB00792B920110D5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), no good or service of Iranian origin may be imported directly or indirectly into the United States.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H58233169E2584AD49739128552171B59"><enum>(B)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">The exceptions provided for in section 203(b) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)), including the exception for information and informational materials, shall apply to the prohibition in subparagraph (A) of this paragraph to the same extent that such exceptions apply to the authority provided under section 203(a) of that Act.<added-phrase reported-display-style="italic"></added-phrase></text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4BC0929646F547E8A2B378E4F7074680"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition on exports</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H105677627FD54889B459433393AC924B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), no good, service, or technology of United States origin may be exported to Iran from the United States or by a United States person, wherever located.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE9D791108E7B478EA601B5829873E029"><enum>(B)</enum><header display-inline="yes-display-inline">Exceptions</header>
<clause commented="no" display-inline="no-display-inline" id="HED56D47B3EBD44F281FC93F728A99D19"><enum>(i)</enum><header display-inline="yes-display-inline">Personal communications; articles to relieve human suffering; information and informational materials; transactions incident to travel</header><text display-inline="yes-display-inline">The exceptions provided for in section 203(b) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)), including the exception for information and informational materials, shall apply to the prohibition in subparagraph (A) of this paragraph to the same extent that such exceptions apply to the authority provided under section 203(a) of that Act.<added-phrase reported-display-style="italic"></added-phrase></text></clause>
<clause commented="no" display-inline="no-display-inline" id="H880C1B4C72EA49CD8525B76A62DE4862"><enum>(ii)</enum><header>Food; medicine; humanitarian assistance</header><text>The prohibition in subparagraph (A) shall not apply to the exportation of—</text>
<subclause id="H7591F3767DD646EDBD4F888EEC50E4D3"><enum>(I)</enum><text>agricultural commodities, food, medicine, or medical devices; or</text></subclause>
<subclause id="HCC67D7B6FA10456B934C1D3E07401D79"><enum>(II)</enum><text>articles exported to Iran to provide humanitarian assistance to the people of Iran.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H1C470AA5AA014990AF079E79A060DD7C"><enum>(iii)</enum><header>Internet communications</header><text>The prohibition in subparagraph (A) shall not apply to the exportation of—</text>
<subclause commented="no" display-inline="no-display-inline" id="H828564DD64AA4F59A7D0898E94A19B29"><enum>(I)</enum><text>services incident to the exchange of personal communications over the Internet or software necessary to enable such services, as provided for in section 560.540 of title 31, Code of Federal Regulations (or any corresponding similar regulation or ruling);</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H4330F67C1DE04D96B731265C5324D26B"><enum>(II)</enum><text>hardware necessary to enable such services; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H284F8113308E450EBB5E986A24AA5C6E"><enum>(III)</enum><text>hardware, software, or technology necessary for access to the Internet.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H113B0CD18B3A45908D5E1E6924AAD905"><enum>(iv)</enum><header> Goods, services, or technologies necessary to ensure the safe operation of commercial aircraft</header><text display-inline="yes-display-inline">The prohibition in subparagraph (A) shall not apply to the exportation of goods, services, or technologies necessary to ensure the safe operation of commercial aircraft produced in the United States or commercial aircraft into which aircraft components produced in the United States are incorporated, if the exportation of such goods, services, or technologies is approved by the Secretary of the Treasury, in consultation with the Secretary of Commerce, pursuant to regulations issued by the Secretary of the Treasury regarding the exportation of such goods, services, or technologies, if appropriate.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H385C6842BD7A48EF8077AE2BCF8C806B"><enum>(v)</enum><header>Goods, services, or technologies exported to support international organizations</header><text display-inline="yes-display-inline">The prohibition in subparagraph (A) shall not apply to the exportation of goods, services, or technologies that—</text>
<subclause commented="no" display-inline="no-display-inline" id="H4FE29F4619DC465DACDA85140C25A62E"><enum>(I)</enum><text display-inline="yes-display-inline">are provided to the International Atomic Energy Agency and are necessary to support activities of that Agency in Iran; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H5F5968FB79D44D56ABE280C4540170C7"><enum>(II)</enum><text display-inline="yes-display-inline">are necessary to support activities, including the activities of nongovernmental organizations, relating to promoting democracy in Iran.</text></subclause></clause>
<clause id="H55A2D8DB8091468C87AFBAE5FF9C6C6E"><enum>(vi)</enum><header>Exports in the national interest</header><text>The prohibition in subparagraph (A) shall not apply to the exportation of goods, services, or technologies if the President determines the exportation of such goods, services, or technologies to be in the national interest of the United States.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7C3D596485C643859339EBADE4C790D3"><enum>(3)</enum><header display-inline="yes-display-inline">Freezing assets</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HBEBC944279C6499685002E88F87643D6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">At such time as the President determines that a person in Iran, including an Iranian diplomat or representative of another government or military or quasi-governmental institution of Iran (including Iran's Revolutionary Guard Corps and its affiliates), satisfies the criteria for designation with respect to the imposition of sanctions under the authority of the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), the President shall take such action as may be necessary to freeze, as soon as possible—</text>
<clause commented="no" display-inline="no-display-inline" id="H82D3E9BECAC84055A13E003FE76318FB"><enum>(i)</enum><text display-inline="yes-display-inline">the funds and other assets belonging to that person; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H44C9F037A3A84A629551313EC9110868"><enum>(ii)</enum><text display-inline="yes-display-inline">any funds or other assets that person transfers, on or after the date on which the President determines the person satisfies such criteria, to any family member or associate acting for or on behalf of the person.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H96A2E12F33974C6F8228C7D2C4E1E548"><enum>(B)</enum><header>Reports to the Office of Foreign Assets Control</header><text display-inline="yes-display-inline">The action described in subparagraph (A) includes requiring any United States financial institution that holds funds or assets of a person described in that subparagraph or funds or assets that person transfers to a family member or associate described in that subparagraph to report promptly to the Office of Foreign Assets Control information regarding such funds and assets.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H93466DECCEA94879BDECB3258B0800F5"><enum>(C)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text display-inline="yes-display-inline">Not later than 14 days after a decision is made to freeze the funds or assets of any person under subparagraph (A), the President shall report the name of the person to the appropriate congressional committees. Such a report may contain a classified annex.</text></subparagraph>
<subparagraph id="H474FE36B70CA45D88030F8D6ED6C5CF7"><enum>(D)</enum><header>Termination</header><text>The President shall release assets or funds frozen under subparagraph (A) if the person to which the assets or funds belong or the person that transfers the assets or funds as described in subparagraph (A)(ii) (as the case may be) no longer satisfies the criteria for designation with respect to the imposition of sanctions under the authority of the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC730FB82A6264756A05EF4E88999A65E"><enum>(E)</enum><header>United States financial institution defined</header><text>In this paragraph, the term <term>United States financial institution</term> means a financial institution (as defined in section 14 of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note)) that is a United States person.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="HAD7F4E73C8684D209EB3677C7350BD9B"><enum>(c)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (50 U.S.C. 1705) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of this section or regulations prescribed under this section to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act.</text></subsection>
<subsection commented="no" id="H112B8960D3684F07A225D0A1068C768C"><enum>(d)</enum><header>Regulatory authority</header>
<paragraph commented="no" id="H336CD9612ED3409FB83855734BF80F86"><enum>(1)</enum><header>In general</header><text>The President shall prescribe regulations to carry out this section, which may include regulatory exceptions to the sanctions described in subsection (b).</text></paragraph>
<paragraph commented="no" id="H4496E425DA9B4B57A74074FA9FCB7381"><enum>(2)</enum><header>Applicability of certain regulations</header><text>No exception to the prohibition under subsection (b)(1) may be made for the commercial importation of an Iranian origin good described in section 560.534(a) of title 31, Code of Federal Regulations (as in effect on the day before the date of the enactment of this Act), unless the President—</text>
<subparagraph commented="no" id="HF20B5910FD5948559E299849F4CC57F1"><enum>(A)</enum><text>prescribes a regulation providing for such an exception on or after the date of the enactment of this Act; and</text></subparagraph>
<subparagraph commented="no" id="HF2F184D0A911474AA6F3D5EF801C0147"><enum>(B)</enum><text>submits to the appropriate congressional committees—</text>
<clause commented="no" id="H4B0B17EF8C1D4A6684459CA98CAFDB50"><enum>(i)</enum><text>a certification in writing that the exception is in the national interest of the United States; and</text></clause>
<clause commented="no" id="HA2001DB32FD6461A89BAB742FA6E0433"><enum>(ii)</enum><text>a report describing the reasons for the exception.</text></clause></subparagraph></paragraph></subsection></section>
<section commented="no" id="HF8EDD216085445A4B28029253CDFE1B3"><enum>104.</enum><header>Mandatory sanctions with respect to financial institutions that engage in certain transactions</header>
<subsection commented="no" id="H57AFA23E3DD348A98419BED047097FD7"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text>
<paragraph commented="no" id="H41ADFC82C790446C85B23C5C37900B58"><enum>(1)</enum><text>The Financial Action Task Force is an intergovernmental body whose purpose is to develop and promote national and international policies to combat money laundering and terrorist financing.</text></paragraph>
<paragraph commented="no" id="H627161AFE9434C738C0D40F98CB3FAC8"><enum>(2)</enum><text>Thirty-three countries, plus the European Commission and the Cooperation Council for the Arab States of the Gulf, belong to the Financial Action Task Force. The member countries of the Financial Action Task Force include the United States, Canada, most countries in western Europe, Russia, the People's Republic of China, Japan, South Korea, Argentina, and Brazil.</text></paragraph>
<paragraph commented="no" id="H242AAC61764B4164A8CC8BA8A9E009B6"><enum>(3)</enum><text>In 2008 the Financial Action Task Force extended its mandate to include addressing <quote>new and emerging threats such as proliferation financing</quote>, meaning the financing of the proliferation of weapons of mass destruction, and published <quote>guidance papers</quote> for members to assist them in implementing various United Nations Security Council resolutions dealing with weapons of mass destruction, including United Nations Security Council Resolutions 1737 (2006) and 1803 (2008), which deal specifically with proliferation by Iran.</text></paragraph>
<paragraph commented="no" id="H2894DF8D89924C00A6D2707B9C2922FA"><enum>(4)</enum><text>The Financial Action Task Force has repeatedly called on members—</text>
<subparagraph commented="no" id="H3E47D0C4D3194A019EC1623866A8FE2B"><enum>(A)</enum><text>to advise financial institutions in their jurisdictions to give special attention to business relationships and transactions with Iran, including Iranian companies and financial institutions;</text></subparagraph>
<subparagraph commented="no" id="H40BE06182ADA45A3BA375030B82F6DA7"><enum>(B)</enum><text>to apply effective countermeasures to protect their financial sectors from risks relating to money laundering and financing of terrorism that emanate from Iran;</text></subparagraph>
<subparagraph commented="no" id="HC986DCFC694F4661A2A3A778D7B170B3"><enum>(C)</enum><text>to protect against correspondent relationships being used by Iran and Iranian companies and financial institutions to bypass or evade countermeasures and risk-mitigation practices; and</text></subparagraph>
<subparagraph commented="no" id="H7695FB7C70D54605A7108B0997C27E61"><enum>(D)</enum><text>to take into account risks relating to money laundering and financing of terrorism when considering requests by Iranian financial institutions to open branches and subsidiaries in their jurisdictions.</text></subparagraph></paragraph>
<paragraph commented="no" id="H504112303DD84097BB770ED99818F9E5"><enum>(5)</enum><text>At a February 2010 meeting of the Financial Action Task Force, the Task Force called on members to apply countermeasures <quote>to protect the international financial system from the ongoing and substantial money laundering and terrorist financing (ML/TF) risks</quote> emanating from Iran.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HDCD96819C8E9446D9C4148E5A5FE7819"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress regarding the imposition of sanctions on the Central Bank of Iran</header><text display-inline="yes-display-inline">Congress—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H8436FFE359B84729B37AF979098DCF90"><enum>(1)</enum><text display-inline="yes-display-inline">acknowledges the efforts of the United Nations Security Council to impose limitations on transactions involving Iranian financial institutions, including the Central Bank of Iran; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB05DF315A1E84E008C5CB3D460872265"><enum>(2)</enum><text display-inline="yes-display-inline">urges the President, in the strongest terms, to consider immediately using the authority of the President to impose sanctions on the Central Bank of Iran and any other Iranian financial institution engaged in proliferation activities or support of terrorist groups.</text></paragraph></subsection>
<subsection commented="no" id="H671E25FF1F6A44B4833B6F0D2AFA9199"><enum>(c)</enum><header>Prohibitions and conditions with respect to certain accounts held by foreign financial institutions</header>
<paragraph commented="no" id="H78D1D58F201142B7A5C6AD60849F0A4F"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of the Treasury shall prescribe regulations to prohibit, or impose strict conditions on, the opening or maintaining in the United States of a correspondent account or a payable-through account by a foreign financial institution that the Secretary finds knowingly engages in an activity described in paragraph (2).</text></paragraph>
<paragraph commented="no" id="H3B37C8D9184149C899DDC9E29FEF8580"><enum>(2)</enum><header>Activities described</header><text>A foreign financial institution engages in an activity described in this paragraph if the foreign financial institution—</text>
<subparagraph commented="no" id="H8953E31A07B9464F9B5172DE6397F893"><enum>(A)</enum><text>facilitates the efforts of the Government of Iran (including efforts of Iran's Revolutionary Guard Corps or any of its agents or affiliates)—</text>
<clause commented="no" id="H6DE1C40D71AA4F1DAF2A7765C2DB20D4"><enum>(i)</enum><text>to acquire or develop weapons of mass destruction or delivery systems for weapons of mass destruction; or</text></clause>
<clause commented="no" id="HEAD2C4ED42064E818EC6D672B130C298"><enum>(ii)</enum><text>to provide support for organizations designated as foreign terrorist organizations under section 219(a) of the Immigration and Nationality Act (8 U.S.C. 1189(a)) or support for acts of international terrorism (as defined in section 14 of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note));</text></clause></subparagraph>
<subparagraph commented="no" id="HE63026E7881041DCBB10388DD0795D5D"><enum>(B)</enum><text>facilitates the activities of a person subject to financial sanctions pursuant to United Nations Security Council Resolution 1737 (2006), 1747 (2007), 1803 (2008), or 1929 (2010), or any other resolution that is agreed to by the Security Council and imposes sanctions with respect to Iran;</text></subparagraph>
<subparagraph commented="no" id="H6F44372771A44B7CA5B73C51960A2F06"><enum>(C)</enum><text>engages in money laundering to carry out an activity described in subparagraph (A) or (B);</text></subparagraph>
<subparagraph commented="no" id="HBC27B16CB67A47E4ADAC0F782500FB7A"><enum>(D)</enum><text>facilitates efforts by the Central Bank of Iran or any other Iranian financial institution to carry out an activity described in subparagraph (A) or (B); or</text></subparagraph>
<subparagraph commented="no" id="H8797A516505B431DB08F7B93F8897521"><enum>(E)</enum><text>facilitates a significant transaction or transactions or provides significant financial services for—</text>
<clause commented="no" id="HD7CF12CC091D4090903AD88BE6153F5D"><enum>(i)</enum><text>Iran's Revolutionary Guard Corps or any of its agents or affiliates whose property or interests in property are blocked pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.); or</text></clause>
<clause commented="no" id="H38C3D2FACA5941A1BA0460BF18E3F69B"><enum>(ii)</enum><text>a financial institution whose property or interests in property are blocked pursuant to that Act in connection with—</text>
<subclause commented="no" id="HCCE6AA45349D4F99B0A9502CAF2011F0"><enum>(I)</enum><text>Iran's proliferation of weapons of mass destruction or delivery systems for weapons of mass destruction; or</text></subclause>
<subclause commented="no" id="HC58742D758E849589658C6FEA3ACFEC5"><enum>(II)</enum><text>Iran's support for international terrorism.</text></subclause></clause></subparagraph></paragraph>
<paragraph commented="no" id="HCD9A3EDB2BE346DCA203DBC74FD26000"><enum>(3)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (50 U.S.C. 1705) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed under paragraph (1) of this subsection to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act.</text></paragraph></subsection>
<subsection commented="no" id="HE196651B24824F3B9257C28A860C197C"><enum>(d)</enum><header>Penalties for domestic financial institutions for actions of persons owned or controlled by such financial institutions</header>
<paragraph commented="no" id="H7D9591E6686D44C09638E96D44097BDB"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of the Treasury shall prescribe regulations to prohibit any person owned or controlled by a domestic financial institution from knowingly engaging in a transaction or transactions with or benefitting Iran’s Revolutionary Guard Corps or any of its agents or affiliates whose property or interests in property are blocked pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.).</text></paragraph>
<paragraph commented="no" id="HBD5335239753400C958D2003BC1EBC26"><enum>(2)</enum><header>Penalties</header><text>The penalties provided for in section 206(b) of the International Emergency Economic Powers Act (50 U.S.C. 1705(b)) shall apply to a domestic financial institution to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act if—</text>
<subparagraph id="HF935C5FD9690489696DA6AB11F6C3DDC"><enum>(A)</enum><text>a person owned or controlled by the domestic financial institution violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed under paragraph (1) of this subsection; and</text></subparagraph>
<subparagraph id="H7A09F0B23D394F98BFF4CCCCEE4425E1"><enum>(B)</enum><text>the domestic financial institution knew or should have known that the person violated, attempted to violate, conspired to violate, or caused a violation of such regulations.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="HFBBFC449E821461CB39E119BF6496C0A"><enum>(e)</enum><header>Requirements for financial institutions maintaining accounts for foreign financial institutions</header>
<paragraph commented="no" id="H416AD6827D824657A29E8D68C7F482F3"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall prescribe regulations to require a domestic financial institution maintaining a correspondent account or payable-through account in the United States for a foreign financial institution to do one or more of the following:</text>
<subparagraph commented="no" id="H4C7E2FFBB1DB46D6BC49E88CCFDB4D93"><enum>(A)</enum><text>Perform an audit of activities described in subsection (c)(2) that may be carried out by the foreign financial institution.</text></subparagraph>
<subparagraph commented="no" id="H2F2D09A7BC12428CB242D81D1E351B13"><enum>(B)</enum><text>Report to the Department of the Treasury with respect to transactions or other financial services provided with respect to any such activity.</text></subparagraph>
<subparagraph commented="no" id="H819305229A33403AA2294042BADE37E3"><enum>(C)</enum><text>Certify, to the best of the knowledge of the domestic financial institution, that the foreign financial institution is not knowingly engaging in any such activity.</text></subparagraph>
<subparagraph commented="no" id="HF66308ED56FF47B19BA43F6E0C710E71"><enum>(D)</enum><text>Establish due diligence policies, procedures, and controls, such as the due diligence policies, procedures, and controls described in section 5318(i) of title 31, United States Code, reasonably designed to detect whether the Secretary of the Treasury has found the foreign financial institution to knowingly engage in any such activity.</text></subparagraph></paragraph>
<paragraph commented="no" id="H63C01793686D4F28ABB6F3AA22E74188"><enum>(2)</enum><header>Penalties</header><text>The penalties provided for in sections 5321(a) and 5322 of title 31, United States Code, shall apply to a person that violates a regulation prescribed under paragraph (1) of this subsection, in the same manner and to the same extent as such penalties would apply to any person that is otherwise subject to such section 5321(a) or 5322.</text></paragraph></subsection>
<subsection commented="no" id="HBDE3843103BF40938F9689E2545122BE"><enum>(f)</enum><header>Waiver</header><text>The Secretary of the Treasury may waive the application of a prohibition or condition imposed with respect to a foreign financial institution pursuant to subsection (c) or the imposition of a penalty under subsection (d) with respect to a domestic financial institution on and after the date that is 30 days after the Secretary—</text>
<paragraph commented="no" id="H70005C85CE9747299880C9C41A96221B"><enum>(1)</enum><text>determines that such a waiver is necessary to the national interest of the United States; and</text></paragraph>
<paragraph commented="no" id="HB71BBF4A08D042C2B3FF721100AC76D6"><enum>(2)</enum><text>submits to the appropriate congressional committees a report describing the reasons for the determination.</text></paragraph></subsection>
<subsection commented="no" id="H6AAF70DA46E64D63A3225983B4E5ADDD"><enum>(g)</enum><header>Procedures for judicial review of classified information</header>
<paragraph commented="no" id="HEE9A7802180746B7B00432E1E441F0A2"><enum>(1)</enum><header>In general</header><text>If a finding under subsection (c)(1), a prohibition, condition, or penalty imposed as a result of any such finding, or a penalty imposed under subsection (d), is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the Secretary of the Treasury may submit such information to the court ex parte and in camera.</text></paragraph>
<paragraph commented="no" id="H3B7267157B8B41F49B695947CEDC27C6"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under subsection (c)(1), any prohibition, condition, or penalty imposed as a result of any such finding, or any penalty imposed under subsection (d).</text></paragraph></subsection>
<subsection commented="no" id="H7F020FCE6F69403C8ECE8F76EEF1B2FE"><enum>(h)</enum><header>Consultations in implementation of regulations</header><text>In implementing this section and the regulations prescribed under this section, the Secretary of the Treasury—</text>
<paragraph commented="no" id="H000C822E4C1946E9B88901FAE44B667C"><enum>(1)</enum><text>shall consult with the Secretary of State; and</text></paragraph>
<paragraph commented="no" id="H774BD3254B59490A8E94DA561D53F3BE"><enum>(2)</enum><text>may, in the sole discretion of the Secretary of the Treasury, consult with such other agencies and departments and such other interested parties as the Secretary considers appropriate.</text></paragraph></subsection>
<subsection commented="no" id="H546595E26BE947DBB391D6DF0CA628BA"><enum>(i)</enum><header>Definitions</header>
<paragraph commented="no" id="H1A64DA1B78784A2CA3B8BCAF38D9B69E"><enum>(1)</enum><header>In general</header><text>In this section:</text>
<subparagraph commented="no" id="HE60D0D5454774ED18038B8D246B53B2A"><enum>(A)</enum><header>Account; correspondent account; payable-through account</header><text>The terms <term>account</term>, <term>correspondent account</term>, and <term>payable-through account</term> have the meanings given those terms in section 5318A of title 31, United States Code.</text></subparagraph>
<subparagraph commented="no" id="H49E9BDE233C6454E8CA13BDD1C179304"><enum>(B)</enum><header>Agent</header><text>The term <term>agent</term> includes an entity established by a person for purposes of conducting transactions on behalf of the person in order to conceal the identity of the person.</text></subparagraph>
<subparagraph commented="no" id="HB865FFDAE7EE4E80A521A8F973DD733D"><enum>(C)</enum><header>Financial institution</header><text>The term <term>financial institution</term> means a financial institution specified in subparagraph (A), (B), (C), (D), (E), (F), (G), (H), (I), (J), (M), or (Y) of section 5312(a)(2) of title 31, United States Code.</text></subparagraph>
<subparagraph commented="no" id="HF41A70B6E7DA499F81A632407A4EF77D"><enum>(D)</enum><header>Foreign financial institution; domestic financial institution</header><text>The terms <term>foreign financial institution</term> and <term>domestic financial institution</term> shall have the meanings of those terms as determined by the Secretary of the Treasury.</text></subparagraph>
<subparagraph commented="no" id="H38C4FA1369A44D40ACBA5071217A4473"><enum>(E)</enum><header>Money laundering</header><text display-inline="yes-display-inline">The term <term>money laundering</term> means the movement of illicit cash or cash equivalent proceeds into, out of, or through a country, or into, out of, or through a financial institution.</text></subparagraph></paragraph>
<paragraph commented="no" id="H5434F4620EF74C23BF06B1A61C9B41CD"><enum>(2)</enum><header>Other definitions</header><text>The Secretary of the Treasury may further define the terms used in this section in the regulations prescribed under this section.</text></paragraph></subsection></section>
<section id="H7D75F18B42D04E9E9A369E6B60F0331F"><enum>105.</enum><header>Imposition of sanctions on certain persons who are responsible for or complicit in human rights abuses committed against citizens of Iran or their family members after the June 12, 2009, elections in Iran</header>
<subsection id="H118E434FDC7A4AB6AA0AF553B513D4E1"><enum>(a)</enum><header>In general</header><text>The President shall impose sanctions described in subsection (c) with respect to each person on the list required by subsection (b).</text></subsection>
<subsection id="HB3261869E9FE430D98F83CC50C197984"><enum>(b)</enum><header>List of persons who are responsible for or complicit in certain human rights abuses</header>
<paragraph id="HFF14F414AC9B4B2AB21FB77C0C29B893"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a list of persons who are officials of the Government of Iran or persons acting on behalf of that Government (including members of paramilitary organizations such as Ansar-e-Hezbollah and Basij-e Mostaz'afin), that the President determines, based on credible evidence, are responsible for or complicit in, or responsible for ordering, controlling, or otherwise directing, the commission of serious human rights abuses against citizens of Iran or their family members on or after June 12, 2009, regardless of whether such abuses occurred in Iran.</text></paragraph>
<paragraph id="HA3E6186AECB74217AB328708F9A814F4"><enum>(2)</enum><header>Updates of list</header><text>The President shall submit to the appropriate congressional committees an updated list under paragraph (1)—</text>
<subparagraph id="H0B5E659AE7F1437D85C8F5E0904367EB"><enum>(A)</enum><text>not later than 270 days after the date of the enactment of this Act and every 180 days thereafter; and</text></subparagraph>
<subparagraph id="HB4F37BE9B5DC4FB493926D6A1A8B9F0D"><enum>(B)</enum><text>as new information becomes available.</text></subparagraph></paragraph>
<paragraph id="HB4D28627F99341FDA4A057D2582AEAA3"><enum>(3)</enum><header>Form of report; public availability</header>
<subparagraph id="H0202A937189B43009E0E9AC7527C78EB"><enum>(A)</enum><header>Form</header><text>The list required by paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text></subparagraph>
<subparagraph id="H0F9A3721CC434AC796A571DC728E07DF"><enum>(B)</enum><header>Public availability</header><text>The unclassified portion of the list required by paragraph (1) shall be made available to the public and posted on the websites of the Department of the Treasury and the Department of State.</text></subparagraph></paragraph>
<paragraph id="H3B8E8901EF3241EB9C3AF7EC22875544"><enum>(4)</enum><header>Consideration of data from other countries and nongovernmental organizations</header><text>In preparing the list required by paragraph (1), the President shall consider credible data already obtained by other countries and nongovernmental organizations, including organizations in Iran, that monitor the human rights abuses of the Government of Iran.</text></paragraph></subsection>
<subsection id="H5EAC46B7653441D8BAE568CD9479B789"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are ineligibility for a visa to enter the United States and sanctions pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), including blocking of property and restrictions or prohibitions on financial transactions and the exportation and importation of property, subject to such regulations as the President may prescribe, including regulatory exceptions to permit the United States to comply with the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed June 26, 1947, and entered into force November 21, 1947, and other applicable international obligations.</text></subsection>
<subsection id="HF92F07F96BB047959A76F1BE0318A73D"><enum>(d)</enum><header>Termination of sanctions</header><text>The provisions of this section shall terminate on the date on which the President determines and certifies to the appropriate congressional committees that the Government of Iran has—</text>
<paragraph id="H9A6575E9AE2D4ABCB4B418DFFB2437B5"><enum>(1)</enum><text>unconditionally released all political prisoners, including the citizens of Iran detained in the aftermath of the June 12, 2009, presidential election in Iran;</text></paragraph>
<paragraph id="HE6B121AD26E940F080C65CEA192669DD"><enum>(2)</enum><text>ceased its practices of violence, unlawful detention, torture, and abuse of citizens of Iran while engaging in peaceful political activity;</text></paragraph>
<paragraph id="HB2FD95439BB4497B9EE3630084996730"><enum>(3)</enum><text>conducted a transparent investigation into the killings, arrests, and abuse of peaceful political activists that occurred in the aftermath of the June 12, 2009, presidential election in Iran and prosecuted the individuals responsible for such killings, arrests, and abuse; and</text></paragraph>
<paragraph id="H95B748D3972F4B18B56530853DA027DD"><enum>(4)</enum><text>made public commitments to, and is making demonstrable progress toward—</text>
<subparagraph id="H8D79F38A44AD46FCBA2521793CF9E99A"><enum>(A)</enum><text>establishing an independent judiciary; and</text></subparagraph>
<subparagraph id="H68DF8834A793472BB842FBF7E815E782"><enum>(B)</enum><text>respecting the human rights and basic freedoms recognized in the Universal Declaration of Human Rights.</text></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H0DB99E66E44D468DB7C47517F3C8079C" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Prohibition on procurement contracts with persons that export sensitive technology to Iran</header>
<subsection commented="no" display-inline="no-display-inline" id="H8A9273BFF08F4752BCB00FB0E17E94EF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), and pursuant to such regulations as the President may prescribe, the head of an executive agency may not enter into or renew a contract, on or after the date that is 90 days after the date of the enactment of this Act, for the procurement of goods or services with a person that exports sensitive technology to Iran.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD3F59D360E2A47E7AC333CEE74CE30CF"><enum>(b)</enum><header>Authorization to exempt certain products</header><text>The President is authorized to exempt from the prohibition under subsection (a) only eligible products, as defined in section 308(4) of the Trade Agreements Act of 1979 (19 U.S.C. 2518(4)), of any foreign country or instrumentality designated under section 301(b) of that Act (19 U.S.C. 2511(b)).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA63D1157745E47238B65AB7BB2E504D0"><enum>(c)</enum><header display-inline="yes-display-inline">Sensitive technology defined</header>
<paragraph commented="no" display-inline="no-display-inline" id="HAF6A0D4F423E4D4D9C990CD23DDBABF3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>sensitive technology</term> means hardware, software, telecommunications equipment, or any other technology, that the President determines is to be used specifically—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H7238F6813FC545BCAC01CB741DDB358D"><enum>(A)</enum><text display-inline="yes-display-inline">to restrict the free flow of unbiased information in Iran; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H40F74822B0A445BDAF46930763C1D0A9"><enum>(B)</enum><text display-inline="yes-display-inline">to disrupt, monitor, or otherwise restrict speech of the people of Iran.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H95FE0FDDEA3742629E52881A5BCFE32F"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The term <term>sensitive technology</term> does not include information or informational materials the exportation of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).</text></paragraph></subsection>
<subsection id="H90F4B0BE93244984B4F6A0205E0B0C89"><enum>(d)</enum><header>Government Accountability Office report on effect of procurement prohibition</header><text>Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees, the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives, a report assessing the extent to which executive agencies would have entered into or renewed contracts for the procurement of goods or services with persons that export sensitive technology to Iran if the prohibition under subsection (a) were not in effect.</text></subsection></section>
<section commented="no" id="H3318606D13694A668EF455B87CBC0E6D"><enum>107.</enum><header>Harmonization of criminal penalties for violations of sanctions</header>
<subsection commented="no" id="H7443F517400F4177B5CED7989608E9E7"><enum>(a)</enum><header>In general</header>
<paragraph commented="no" id="HA272A27F9514496C8DDE94D8255DA985"><enum>(1)</enum><header>Violations of United Nations Security Council resolutions imposing sanctions</header><text>Section 5(b) of the United Nations Participation Act of 1945 (22 U.S.C. 287c(b)) is amended—</text>
<subparagraph commented="no" id="H9749928D5C6C4889A8F35D5D5D92FE9D"><enum>(A)</enum><text>by striking <quote>find not more than $10,000</quote> and inserting <quote>fined not more than $1,000,000</quote>; and</text></subparagraph>
<subparagraph commented="no" id="H1DA37698E3DC46E899903BD3F5BD10F4"><enum>(B)</enum><text>by striking <quote>ten years</quote> and all that follows and inserting <quote>20 years, or both.</quote>.</text></subparagraph></paragraph>
<paragraph commented="no" id="H62F7D7A5554041D1AEC1740792CBDBD3"><enum>(2)</enum><header>Violations of controls on exports and imports of defense articles and defense services</header><text>Section 38(c) of the Arms Export Control Act (22 U.S.C. 2778(c)) is amended by striking <quote>ten years</quote> and inserting <quote>20 years</quote>.</text></paragraph>

<section commented="no" id="HBD34ED98FACF464E96D89339A27B2D36"><enum>108.</enum><header>Authority to implement United Nations Security Council resolutions imposing sanctions with respect to Iran</header><text display-inline="no-display-inline">In addition to any other authority of the President with respect to implementing resolutions of the United Nations Security Council, the President may prescribe such regulations as may be necessary to implement a resolution that is agreed to by the United Nations Security Council and imposes sanctions with respect to Iran.</text></section>
<section commented="no" display-inline="no-display-inline" id="HC5ABBB226FCB4080A9507A88A4A62ACE" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Increased capacity for efforts to combat unlawful or terrorist financing</header>
<subsection commented="no" display-inline="no-display-inline" id="HE06C065942B042049C221E15E2F20054"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
<paragraph commented="no" display-inline="no-display-inline" id="H74E08523756B41D28BCA0F27DB6B4B0D"><enum>(1)</enum><text display-inline="yes-display-inline">The work of the Office of Terrorism and Financial Intelligence of the Department of the Treasury, which includes the Office of Foreign Assets Control and the Financial Crimes Enforcement Network, is critical to ensuring that the international financial system is not used for purposes of supporting terrorism and developing weapons of mass destruction.</text></paragraph>
<paragraph id="H6DB55A4FE1A64D28AA21FB5DF18E0EB1"><enum>(2)</enum><text>The Secretary of the Treasury has designated, including most recently on June 16, 2010, various Iranian individuals and banking, military, energy, and shipping entities as proliferators of weapons of mass destruction pursuant to Executive Order 13382 (50 U.S.C. 1701 note), thereby blocking transactions subject to the jurisdiction of the United States by those individuals and entities and their supporters.</text></paragraph>
<paragraph id="H7A158DEB7499419BA161D88E9818F863"><enum>(3)</enum><text>The Secretary of the Treasury has also identified an array of entities in the insurance, petroleum, and petrochemicals industries that the Secretary has determined to be owned or controlled by the Government of Iran and added those entities to the list contained in Appendix A to part 560 of title 31, Code of Federal Regulations (commonly known as the <quote>Iranian Transactions Regulations</quote>), thereby prohibiting transactions between United States persons and those entities.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H4B04D71C0C5342AB90A2C752B431700B"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of appropriations for Office of Terrorism and Financial Intelligence</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary of the Treasury for the Office of Terrorism and Financial Intelligence—</text>

<section id="H1001D7361A1E4ECFB0CE44DB2DBBAFE9" section-type="subsequent-section"><enum>110.</enum><header>Reports on investments in the energy sector of Iran</header>
<subsection id="H8F40D00C6F6B49DE8D48C2AA9DD0584E"><enum>(a)</enum><header>Initial report</header>
<paragraph id="HA4AD5707B00B453BA42E9760275B3657"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report—</text>
<subparagraph id="HAF4F9D2E3A0F40CBA0370E2C9415F5A1"><enum>(A)</enum><text display-inline="yes-display-inline">on investments in the energy sector of Iran that were made during the period described in paragraph (2); and</text></subparagraph>
<subparagraph id="H50EEB5CEC59440A6BA00279967DC2211"><enum>(B)</enum><text>that contains—</text>
<clause id="H929766C7ADC9492DB02163AA62F007D3"><enum>(i)</enum><text>an estimate of the volume of energy-related resources (other than refined petroleum), including ethanol, that Iran imported during the period described in paragraph (2); and</text></clause>
<clause id="HE4FB9672DFC34A9AA631B55443F5377B"><enum>(ii)</enum><text>a list of all significant known energy-related joint ventures, investments, and partnerships located outside Iran that involve Iranian entities in partnership with entities from other countries, including an identification of the entities from other countries; and</text></clause>
<clause id="H3CC285E8DE7D474F86F9B4A9110A4A0D"><enum>(iii)</enum><text>an estimate of—</text>
<subclause id="H5DD4A46973FA43CFB94CD3BE60F258E0"><enum>(I)</enum><text>the total value of each such joint venture, investment, and partnership; and</text></subclause>
<subclause id="HB57D6B6085A345C59A47BA7AC05DF2C7"><enum>(II)</enum><text>the percentage of each such joint venture, investment, and partnership owned by an Iranian entity.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="HF5525BB4688840B98B6BBD63D2784F9D"><enum>(2)</enum><header>Period described</header><text>The period described in this paragraph is the period beginning on January 1, 2006, and ending on the date that is 60 days after the date of the enactment of this Act.</text></paragraph></subsection>
<subsection id="H55D15AE8D6914000AE1E01B18DCE4574"><enum>(b)</enum><header>Updated reports</header><text>Not later than 180 days after submitting the report required by subsection (a), and every 180 days thereafter, the President shall submit to the appropriate congressional committees a report containing the matters required in the report under subsection (a)(1) for the 180-day period beginning on the date that is 30 days before the date on which the preceding report was required to be submitted by this section.</text></subsection></section>
<section id="HA5295E4D5FF347C28BBE89771921151C"><enum>111.</enum><header>Reports on certain activities of foreign export credit agencies and of the Export-Import Bank of the United States</header>
<subsection commented="no" id="H43AF22340D0D42BA888D3DBD8BE9B4B0"><enum>(a)</enum><header>Report on certain activities of export credit agencies of foreign countries</header>
<paragraph commented="no" id="H79B577933F7F47ECA907DA54AC703186"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report on any activity of an export credit agency of a foreign country that is an activity comparable to an activity described in subsection (a) or (b) of section 5 of the Iran Sanctions Act of 1996, as amended by section 102 of this Act.</text></paragraph>
<paragraph id="HEA2A56B5FA20441EBC99EA789092C22E"><enum>(2)</enum><header>Updates</header><text>The President shall update the report required by paragraph (1) as new information becomes available with respect to the activities of export credit agencies of foreign countries.</text></paragraph></subsection>
<subsection commented="no" id="HADE0467BCD5746D8B87F2638030BCF71"><enum>(b)</enum><header>Report on certain financing by the Export-Import Bank of the United States</header><text display-inline="yes-display-inline">Not later than 30 days (or, in extraordinary circumstances, not later than 15 days) before the Export-Import Bank of the United States approves cofinancing (including loans, guarantees, other credits, insurance, and reinsurance) in which an export credit agency of a foreign country identified in the report required by subsection (a) will participate, the President shall submit to the appropriate congressional committees a report identifying—</text>
<paragraph commented="no" id="HFCEFD4689AF14A78B4B281DD463EC6D8"><enum>(1)</enum><text display-inline="yes-display-inline">the export credit agency of the foreign country; and</text></paragraph>
<paragraph commented="no" id="H9B8D1CF2A945485CA610B03344E1E18E"><enum>(2)</enum><text>the beneficiaries of the financing.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HB2D2FEE07F8E4BFC9D12B72B8612C5EE" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Sense of Congress regarding Iran’s Revolutionary Guard Corps and its affiliates</header><text display-inline="no-display-inline">It is the sense of Congress that the United States should—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HB673EFE6CBCD4C0FA87D8BC94E2591E4"><enum>(1)</enum><text display-inline="yes-display-inline">persistently target Iran’s Revolutionary Guard Corps and its affiliates with economic sanctions for its support for terrorism, its role in proliferation, and its oppressive activities against the people of Iran;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD50C1F1AED4B45A48239E10CB7326B77"><enum>(2)</enum><text display-inline="yes-display-inline">identify, as soon as possible—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HFE792BB061384B3F83497CBC7595A3C4"><enum>(A)</enum><text display-inline="yes-display-inline">any foreign individual or entity that is an agent, alias, front, instrumentality, official, or affiliate of Iran’s Revolutionary Guard Corps;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H110032F777B842FBB8D014E0EA3543CB"><enum>(B)</enum><text display-inline="yes-display-inline">any individual or entity that—</text>
<clause commented="no" display-inline="no-display-inline" id="HE953A3418C434D7BACA540FA8CF81B52"><enum>(i)</enum><text display-inline="yes-display-inline">has provided material support to any individual or entity described in subparagraph (A); or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H6633628308254D16B38B2B9047223F69"><enum>(ii)</enum><text display-inline="yes-display-inline">has conducted any financial or commercial transaction with any such individual or entity; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6BEFDE531D3E4EE3937D988CE8A7FD2E"><enum>(C)</enum><text display-inline="yes-display-inline">any foreign government that—</text>
<clause commented="no" display-inline="no-display-inline" id="H51F47343DEF84C769E91C830AD0F5481"><enum>(i)</enum><text display-inline="yes-display-inline">provides material support to any such individual or entity; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HCD4048708D7041F98F0A40A0AD4EAA60"><enum>(ii)</enum><text display-inline="yes-display-inline">conducts any commercial transaction or financial transaction with any such individual or entity; and</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3E07C2010CCC4D7EA415C7762F0CCBA1"><enum>(3)</enum><text display-inline="yes-display-inline">immediately impose sanctions, including travel restrictions, sanctions authorized pursuant to this Act or the Iran Sanctions Act of 1996, as amended by section 102 of this Act, and the full range of sanctions available to the President under the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), on the individuals, entities, and governments described in paragraph (2).</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="HDC57B93422C94AC6B8177D47E438B586" section-type="subsequent-section"><enum>113.</enum><header display-inline="yes-display-inline">Sense of Congress regarding Iran and Hezbollah</header><text display-inline="no-display-inline">It is the sense of Congress that the United States should—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HD37DAC0D7D9E4E9F801B8170FC46F8D2"><enum>(1)</enum><text display-inline="yes-display-inline">continue to counter support received by Hezbollah from the Government of Iran and other foreign governments in response to Hezbollah's terrorist activities and the threat Hezbollah poses to Israel, the democratic sovereignty of Lebanon, and the national security interests of the United States;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H62DE6A0196DE45F7A289F21C8D845D53"><enum>(2)</enum><text display-inline="yes-display-inline">impose the full range of sanctions available to the President under the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) on Hezbollah, affiliates and supporters of Hezbollah designated for the imposition of sanctions under that Act, and persons providing Hezbollah with commercial, financial, or other services;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H018DD59DE3724C44900AA645283FB87D"><enum>(3)</enum><text display-inline="yes-display-inline">urge the European Union, individual countries in Europe, and other countries to classify Hezbollah as a terrorist organization to facilitate the disruption of Hezbollah's operations; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC88E8104F5C04A66ACDE212CE1295096"><enum>(4)</enum><text display-inline="yes-display-inline">renew international efforts to disarm Hezbollah and disband its militias in Lebanon, as called for by United Nations Security Council Resolutions 1559 (2004) and 1701 (2006).</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H1FD9555449D147C994B211F4D2DB73AC" section-type="subsequent-section"><enum>114.</enum><header display-inline="yes-display-inline">Sense of Congress regarding the imposition of multilateral sanctions with respect to Iran</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HECEB1EE10FF1426EA730B49C4211605E"><enum>(1)</enum><text display-inline="yes-display-inline">in general, effective multilateral sanctions are preferable to unilateral sanctions in order to achieve desired results from countries such as Iran; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H193BA15D29214E2CA778AAEBF6C6C0C1"><enum>(2)</enum><text display-inline="yes-display-inline">the President should continue to work with allies of the United States to impose such sanctions as may be necessary to prevent the Government of Iran from acquiring a nuclear weapons capability.</text></paragraph></section>
<section id="H21E98C4D3CF84BD2849CC993F281BFB9"><enum>115.</enum><header>Report on providing compensation for victims of international terrorism</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report on equitable methods for providing compensation on a comprehensive basis to victims of acts of international terrorism who are citizens or residents of the United States or nationals of the United States (as defined in section 101(a) of the Immigration and Nationality Act (8 U.S.C. 1101(a)).</text></section></title>

<section commented="no" display-inline="no-display-inline" id="HE3A11F6BBC974C399A1F3B7313C127CA" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph commented="no" display-inline="no-display-inline" id="H2AD0CD754B894C6A82642A126253124A"><enum>(1)</enum><header display-inline="yes-display-inline">Energy sector of Iran</header><text display-inline="yes-display-inline">The term <term>energy sector of Iran</term> refers to activities to develop petroleum or natural gas resources or nuclear power in Iran.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4A293198C47842CEB29BA31EFD993D89"><enum>(2)</enum><header display-inline="yes-display-inline">Financial institution</header><text display-inline="yes-display-inline">The term <term>financial institution</term> has the meaning given that term in section 14 of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note).</text></paragraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H0532C4E1DB9E46788AB7929132FC46D9"><enum>(A)</enum><text display-inline="yes-display-inline">any State and any agency or instrumentality thereof;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3AE0E9C989D9414DA43483EAE281F563"><enum>(B)</enum><text display-inline="yes-display-inline">any local government within a State, and any agency or instrumentality thereof;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBBDB8637DD8C4E92BFABDC76F865F6A7"><enum>(C)</enum><text display-inline="yes-display-inline">any other governmental instrumentality of a State or locality; and</text></subparagraph>

<section commented="no" display-inline="no-display-inline" id="HD59865C438374DB1BA43649C9F3DA4BE" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Authority of State and local governments to divest from certain companies that invest in Iran</header>
<subsection commented="no" display-inline="no-display-inline" id="H75EF47EAD4064BC0943E5E2CBCC4DCC2"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the United States should support the decision of any State or local government that for moral, prudential, or reputational reasons divests from, or prohibits the investment of assets of the State or local government in, a person that engages in investment activities in the energy sector of Iran, as long as Iran is subject to economic sanctions imposed by the United States.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HB3BD47E3F00741288FC05CEA1B83D726"><enum>(b)</enum><header display-inline="yes-display-inline">Authority to divest</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a State or local government may adopt and enforce measures that meet the requirements of subsection (d) to divest the assets of the State or local government from, or prohibit investment of the assets of the State or local government in, any person that the State or local government determines, using credible information available to the public, engages in investment activities in Iran described in subsection (c).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD249EF8E5AE94BC3AF73471EAFBA9ABD"><enum>(c)</enum><header display-inline="yes-display-inline">Investment activities described</header><text display-inline="yes-display-inline">A person engages in investment activities in Iran described in this subsection if the person—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H2BF1B415520141C1B8D3745AADFEF1AE"><enum>(1)</enum><text display-inline="yes-display-inline">has an investment of $20,000,000 or more in the energy sector of Iran, including in a person that provides oil or liquified natural gas tankers, or products used to construct or maintain pipelines used to transport oil or liquified natural gas, for the energy sector of Iran; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCA0B40D00FF4481D985CAF7E9C3934B2"><enum>(2)</enum><text display-inline="yes-display-inline">is a financial institution that extends $20,000,000 or more in credit to another person, for 45 days or more, if that person will use the credit for investment in the energy sector of Iran.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF5D9A7BA61C64744B766D4A6855720DD"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Any measure taken by a State or local government under subsection (b) shall meet the following requirements:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HE1947359534F4E5F9A2C6F11C2D28089"><enum>(1)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">The State or local government shall provide written notice to each person to which a measure is to be applied.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB08A7E6E9D65417986227710A808533B"><enum>(2)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">The measure shall apply to a person not earlier than the date that is 90 days after the date on which written notice is provided to the person under paragraph (1).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBF7C969FC8F74A7EAB62B80D0F69B832"><enum>(3)</enum><header display-inline="yes-display-inline">Opportunity for hearing</header><text display-inline="yes-display-inline">The State or local government shall provide an opportunity to comment in writing to each person to which a measure is to be applied. If the person demonstrates to the State or local government that the person does not engage in investment activities in Iran described in subsection (c), the measure shall not apply to the person.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H754617B5C8C84A3E8CA73EAE4EE25D32"><enum>(4)</enum><header display-inline="yes-display-inline">Sense of Congress on avoiding erroneous targeting</header><text display-inline="yes-display-inline">It is the sense of Congress that a State or local government should not adopt a measure under subsection (b) with respect to a person unless the State or local government has made every effort to avoid erroneously targeting the person and has verified that the person engages in investment activities in Iran described in subsection (c).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7AEA3AB4C1CC448D8AE3B0771666398F"><enum>(e)</enum><header display-inline="yes-display-inline">Notice to Department of Justice</header><text display-inline="yes-display-inline">Not later than 30 days after adopting a measure pursuant to subsection (b), a State or local government shall submit written notice to the Attorney General describing the measure.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE7994CDA79CC45F8A02349BDE40F575F"><enum>(f)</enum><header display-inline="yes-display-inline">Nonpreemption</header><text display-inline="yes-display-inline">A measure of a State or local government authorized under subsection (b) or (i) is not preempted by any Federal law or regulation.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD34610F9CB1F488695D101B402038DD9"><enum>(g)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HEF52FB7179444D47AE6C7D60FF76FA34"><enum>(1)</enum><header display-inline="yes-display-inline">Assets</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H53754B47D9234A4596F0FDFF7EE55530"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>assets</term> refers to public monies and includes any pension, retirement, annuity, or endowment fund, or similar instrument, that is controlled by a State or local government.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDDA67F0C416A4B6297DDAA441BA584AC"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The term <term>assets</term> does not include employee benefit plans covered by title I of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1001 et seq.).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H634B111365CE442B8452877020A70612"><enum>(2)</enum><header display-inline="yes-display-inline">Investment</header><text display-inline="yes-display-inline">The <term>investment</term> includes—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H71E6D8BFBB4A49888E8C482A0285EB73"><enum>(A)</enum><text display-inline="yes-display-inline">a commitment or contribution of funds or property;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE7D00701C0194DBE8C8DB75CF9188308"><enum>(B)</enum><text display-inline="yes-display-inline">a loan or other extension of credit; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H89DBD3917DDF4AF6BEE65AD6D74CF14B"><enum>(C)</enum><text display-inline="yes-display-inline">the entry into or renewal of a contract for goods or services.</text></subparagraph></paragraph></subsection>
<subsection id="H4A0392DAF88740DEACFB3271E9DD501F"><enum>(h)</enum><header>Effective date</header>
<paragraph id="H2C74C43840C74E509291855C4AFF1BD5"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) or subsection (i), this section applies to measures adopted by a State or local government before, on, or after the date of the enactment of this Act.</text></paragraph>
<paragraph id="HEA93127DD3CB4269856684BDFBDB1F30"><enum>(2)</enum><header>Notice requirements</header><text>Except as provided in subsection (i), subsections (d) and (e) apply to measures adopted by a State or local government on or after the date of the enactment of this Act.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HAF3CA3415EEE48A6BEDA5A259D4956AC"><enum>(i)</enum><header>Authorization for prior enacted measures</header>
<paragraph commented="no" display-inline="no-display-inline" id="HB9EF1C7303104897B8FCB6117ACAA5BD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section or any other provision of law, a State or local government may enforce a measure (without regard to the requirements of subsection (d), except as provided in paragraph (2)) adopted by the State or local government before the date of the enactment of this Act that provides for the divestment of assets of the State or local government from, or prohibits the investment of the assets of the State or local government in, any person that the State or local government determines, using credible information available to the public, engages in investment activities in Iran (determined without regard to subsection (c)) or other business activities in Iran that are identified in the measure.</text></paragraph>
<paragraph commented="no" id="H21AE5A6EE4524017BCB33CE70E62453F"><enum>(2)</enum><header>Application of notice requirements</header><text>A measure described in paragraph (1) shall be subject to the requirements of paragraphs (1) and (2) and the first sentence of paragraph (3) of subsection (d) on and after the date that is 2 years after the date of the enactment of this Act.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H79A875ECF62B450D8D2A72E4DD11DCFC" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Safe harbor for changes of investment policies by asset managers</header>
<subsection commented="no" display-inline="no-display-inline" id="H74131B6EE5144FF485C52923ED16FE01"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 13(c)(1) of the Investment Company Act of 1940 (15 U.S.C. 80a–13(c)(1)) is amended to read as follows:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H563ABFE304A449FC8435417D791AB07F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of Federal or State law, no person may bring any civil, criminal, or administrative action against any registered investment company, or any employee, officer, director, or investment adviser thereof, based solely upon the investment company divesting from, or avoiding investing in, securities issued by persons that the investment company determines, using credible information available to the public—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H4D3E6A2412F3493BB65773F74B03D32B"><enum>(A)</enum><text display-inline="yes-display-inline">conduct or have direct investments in business operations in Sudan described in section 3(d) of the Sudan Accountability and Divestment Act of 2007 (50 U.S.C. 1701 note); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H05047765746549ED8784B3303233C92E"><enum>(B)</enum><text display-inline="yes-display-inline">engage in investment activities in Iran described in section 202(c) of the <short-title>Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010</short-title>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H3C8F80ECE71542BF81737E58488BA2F1"><enum>(b)</enum><header display-inline="yes-display-inline">SEC regulations</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Securities and Exchange Commission shall issue any revisions the Commission determines to be necessary to the regulations requiring disclosure by each registered investment company that divests itself of securities in accordance with section 13(c) of the Investment Company Act of 1940 to include divestments of securities in accordance with paragraph (1)(B) of such section, as added by subsection (a) of this section.</text></subsection></section>
<section id="H090D04A244624D169CB15F8774697CCD"><enum>204.</enum><header>Sense of Congress regarding certain ERISA plan investments</header><text display-inline="no-display-inline">It is the sense of Congress that a fiduciary of an employee benefit plan, as defined in section 3(3) of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1002(3)), may divest plan assets from, or avoid investing plan assets in, any person the fiduciary determines engages in investment activities in Iran described in section 202(c) of this Act, without breaching the responsibilities, obligations, or duties imposed upon the fiduciary by subparagraph (A) or (B) of section 404(a)(1) of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1104(a)(1)), if—</text>
<paragraph id="HA5209D416611498586C8868FE0E744F7"><enum>(1)</enum><text>the fiduciary makes such determination using credible information that is available to the public; and</text></paragraph>
<paragraph id="H45DDC807ACB04EC0B6EF0152EF6C6A5C"><enum>(2)</enum><text>the fiduciary prudently determines that the result of such divestment or avoidance of investment would not be expected to provide the employee benefit plan with—</text>
<subparagraph id="H3FAD8B0DDEB24716B563658139D2160E"><enum>(A)</enum><text>a lower rate of return than alternative investments with commensurate degrees of risk; or</text></subparagraph>
<subparagraph id="H2A4625B03F524D448E49A39891EF96FC"><enum>(B)</enum><text>a higher degree of risk than alternative investments with commensurate rates of return.</text></subparagraph></paragraph></section>
<section id="H1E5DB2627B304A28883B94206CD027BB"><enum>205.</enum><header>Technical corrections to Sudan Accountability and Divestment Act of 2007</header>
<subsection id="HB3AB342D4D764E20AAB496FF5A89AA33"><enum>(a)</enum><header>ERISA plan investments</header><text display-inline="yes-display-inline">Section 5 of the Sudan Accountability and Divestment Act of 2007 (Public Law 110–174; 50 U.S.C. 1701 note) is amended—</text>
<paragraph id="H37D5AA17B62C4C1C8640FDECE1DD9E66"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>section 404 of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1104)</quote> and inserting <quote>subparagraph (A) or (B) of section 404(a)(1) of the Employee Retirement Income Security Act of 1974 (29 U.S.C. 1104(a)(1))</quote>; and</text></paragraph>
<paragraph id="H3FFD4DA962954D33AE0B37F254C89550"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text>

<section commented="no" display-inline="no-display-inline" id="H750DB9A48B0C404E9CC36E67AE888C85" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HDAA804A31F144926BEB834D86A659A77"><enum>(1)</enum><header display-inline="yes-display-inline">Allow</header><text>The term <term>allow</term>, with respect to the diversion through a country of goods, services, or technologies, means the government of the country knows or has reason to know that the territory of the country is being used for such diversion.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD46E4512AE084C4290DE51E0B6A800E0"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text>

<paragraph commented="no" id="HBAE11D63C36C4189963E5F064843ADE4"><enum>(5)</enum><header>End-user</header><text>The term <term>end-user</term>, with respect to a good, service, or technology, means the person that receives and ultimately uses the good, service, or technology.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5364E3614AE243DC81D10F466B8EBF67"><enum>(6)</enum><header display-inline="yes-display-inline">Export Administration Regulations</header><text display-inline="yes-display-inline">The term <term>Export Administration Regulations</term> means subchapter C of chapter VII of title 15, Code of Federal Regulations (or any corresponding similar regulation or ruling).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDFB48C7C2731403D8A755DF57F3C9E49"><enum>(7)</enum><header display-inline="yes-display-inline">Government</header><text display-inline="yes-display-inline">The term <term>government</term> includes any agency or instrumentality of a government.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBBFE82E91BCF45D3957DF92EF56D8F75"><enum>(8)</enum><header>Intermediary</header><text>The term <term>intermediary</term> means a person that receives a good, service, or technology while the good, service, or technology is in transit to the end-user of the good, service, or technology.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE0D72F0C163E47829B4DCEE3AE359836"><enum>(9)</enum><header>International Traffic in Arms Regulations</header><text>The term <term>International Traffic in Arms Regulations</term> means subchapter M of chapter I of title 22, Code of Federal Regulations (or any corresponding similar regulation or ruling).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4261C358DB7B45BB9815DD6BA2C6A7F7"><enum>(10)</enum><header display-inline="yes-display-inline">Iran</header><text display-inline="yes-display-inline">The term <term>Iran</term> includes the Government of Iran and any agency or instrumentality of Iran.</text></paragraph>
<paragraph id="H248B3E6345514B02AB6B0A20C047CA3F"><enum>(11)</enum><header>Iranian end-user</header><text>The term <term>Iranian end-user</term> means an end-user that is the Government of Iran or a person in, or an agency or instrumentality of, Iran.</text></paragraph>
<paragraph commented="no" id="HFF44AF9845884655BBCA1AB2C073F417"><enum>(12)</enum><header>Iranian intermediary</header><text>The term <term>Iranian intermediary</term> means an intermediary that is the Government of Iran or a person in, or an agency or instrumentality of, Iran.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7DF2E33E2AAC463D954CC81050068976"><enum>(13)</enum><header display-inline="yes-display-inline">State sponsor of terrorism</header><text display-inline="yes-display-inline">The term <term>state sponsor of terrorism</term> means any country the government of which the Secretary of State has determined has repeatedly provided support for acts of international terrorism pursuant to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H4058AF1DCC69499E9536316F27CA2371"><enum>(A)</enum><text display-inline="yes-display-inline">section 6(j)(1)(A) of the Export Administration Act of 1979 (50 U.S.C. App. 2405(j)(1)(A)) (or any successor thereto);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB0F4785B4D4A401BBECCF10EC2DECB6D"><enum>(B)</enum><text display-inline="yes-display-inline">section 40(d) of the Arms Export Control Act (22 U.S.C. 2780(d)); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HABCDD5B361554421861747FFE1B7D94F"><enum>(C)</enum><text display-inline="yes-display-inline">section 620A(a) of the Foreign Assistance Act of 1961 (22 U.S.C. 2371(a)).</text></subparagraph></paragraph>
<paragraph commented="no" id="HF1BDB2F19F7846668ED20509E3B7A853"><enum>(14)</enum><header>United States Munitions List</header><text>The term <term>United States Munitions List</term> means the list maintained pursuant to part 121 of the International Traffic in Arms Regulations (or any corresponding similar regulation or ruling).</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H377EFE0C97ED4B1FA078411F6FB3A590" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Identification of countries of concern with respect to the diversion of certain goods, services, and technologies to or through Iran</header>
<subsection commented="no" display-inline="no-display-inline" id="H078B9E2646F74D0C9FB54409357D95DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the President, the Secretary of Defense, the Secretary of Commerce, the Secretary of State, the Secretary of the Treasury, and the appropriate congressional committees a report that identifies each country the government of which the Director believes, based on all information available to the Director, is allowing the diversion through the country of goods, services, or technologies described in subsection (b) to Iranian end-users or Iranian intermediaries.</text></subsection>
<subsection id="H9080AFE2E8F84AB2B88F7883B084FE26"><enum>(b)</enum><header>Goods, services, and technologies described</header><text>Goods, services, or technologies described in this subsection are goods, services, or technologies—</text>
<paragraph id="H730E1DE4BD3B4761A43921EDE1F2057D"><enum>(1)</enum><text>that—</text>
<subparagraph id="H10F5C682AD7347398554A6B2A59B2FAB"><enum>(A)</enum><text>originated in the United States;</text></subparagraph>
<subparagraph id="H3A9FA4E4B6864CFFBD18C38A026703A6"><enum>(B)</enum><text>would make a material contribution to Iran’s—</text>
<clause id="H59A1FD29CD8A47C381F5242E8F848768"><enum>(i)</enum><text>development of nuclear, chemical, or biological weapons;</text></clause>
<clause id="H65B192E6E51148F2A7CDE1E618351DA0"><enum>(ii)</enum><text>ballistic missile or advanced conventional weapons capabilities; or</text></clause>
<clause id="HA617B9F0772F4CBFB94B35AA808A9F4A"><enum>(iii)</enum><text>support for international terrorism; and</text></clause></subparagraph>
<subparagraph id="H776647B78F4F47478700DA6D1B66CAC3"><enum>(C)</enum><text>are—</text>
<clause id="H1D1F935B31764951A4E89E16AD1564F8"><enum>(i)</enum><text>items on the Commerce Control List or services related to those items; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H41046466501E4D46980AD065D1C9A2B8"><enum>(ii)</enum><text display-inline="yes-display-inline">defense articles or defense services on the United States Munitions List; or</text></clause></subparagraph></paragraph>
<paragraph id="H15A3C2D714534AC9A3442729DA8F12AD"><enum>(2)</enum><text>that are prohibited for export to Iran under a resolution of the United Nations Security Council.</text></paragraph></subsection>
<subsection id="H9A68E4BA65DA4BEA9FB0F959C8647527"><enum>(c)</enum><header>Updates</header><text>The Director of National Intelligence shall update the report required by subsection (a)—</text>
<paragraph id="H323E94150FE44738B9F2625BEBAFC106"><enum>(1)</enum><text>as new information becomes available; and</text></paragraph>
<paragraph id="H234EB7FDAB4F4135A3F44C93BD4C48DA"><enum>(2)</enum><text>not less frequently than annually.</text></paragraph></subsection>

<section commented="no" display-inline="no-display-inline" id="H21A743403CF74F039A84EB810E1196E7" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Destinations of Diversion Concern</header>
<subsection commented="no" display-inline="no-display-inline" id="H7B174FD9DD09481CAC429790D78B60F8"><enum>(a)</enum><header display-inline="yes-display-inline">Designation</header>
<paragraph commented="no" display-inline="no-display-inline" id="H0CC06C96CBA5452A8F7CADB59D11FB53"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall designate a country as a Destination of Diversion Concern if the President determines that the government of the country allows substantial diversion of goods, services, or technologies described in section 302(b) through the country to Iranian end-users or Iranian intermediaries.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE962D0A4D75941F5BD91D5205549F884"><enum>(2)</enum><header>Determination of substantial</header><text>For purposes of paragraph (1), the President shall determine whether the government of a country allows substantial diversion of goods, services, or technologies described in section 302(b) through the country to Iranian end-users or Iranian intermediaries based on criteria that include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H6E0CB6911EA5476FBCC9E0D7F5AF22FB"><enum>(A)</enum><text display-inline="yes-display-inline">the volume of such goods, services, and technologies that are diverted through the country to such end-users or intermediaries;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC72CB12F1207402CBE2CBD781A4595EA"><enum>(B)</enum><text display-inline="yes-display-inline">the inadequacy of the export controls of the country;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC9A4AB5387614521911CA93504422265"><enum>(C)</enum><text display-inline="yes-display-inline">the unwillingness or demonstrated inability of the government of the country to control the diversion of such goods, services, and technologies to such end-users or intermediaries; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF8DB81DEA8ED48F186FA72C1191C7A93"><enum>(D)</enum><text display-inline="yes-display-inline">the unwillingness or inability of the government of the country to cooperate with the United States in efforts to interdict the diversion of such goods, services, or technologies to such end-users or intermediaries.</text></subparagraph></paragraph></subsection>
<subsection id="H02AA88F198C34D3FA8E662218F9F44BA"><enum>(b)</enum><header>Report on designation</header><text>Upon designating a country as a Destination of Diversion Concern under subsection (a), the President shall submit to the appropriate congressional committees a report—</text>
<paragraph id="HD0B2E33453414263BAA0DEE781459F24"><enum>(1)</enum><text>notifying those committees of the designation of the country; and</text></paragraph>
<paragraph id="H59BD23E2349642DE97638CA9BF65E79E"><enum>(2)</enum><text>containing a list of the goods, services, and technologies described in section 302(b) that the President determines are diverted through the country to Iranian end-users or Iranian intermediaries.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HBF74E91E464F4D23B01572F0A9ABD574"><enum>(c)</enum><header display-inline="yes-display-inline">Licensing requirement</header><text display-inline="yes-display-inline">Not later than 45 days after submitting a report required by subsection (b) with respect to a country designated as a Destination of Diversion Concern under subsection (a), the President shall require a license under the Export Administration Regulations or the International Traffic in Arms Regulations (whichever is applicable) to export to that country a good, service, or technology on the list required under subsection (b)(2), with the presumption that any application for such a license will be denied.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H9888EC79EFB44486AF7DDBB8D768395A"><enum>(d)</enum><header>Delay of imposition of licensing requirement</header>
<paragraph commented="no" display-inline="no-display-inline" id="HC8E2584E750A4C608C91956F9CDB7B15"><enum>(1)</enum><header>In general</header><text>The President may delay the imposition of the licensing requirement under subsection (c) with respect to a country designated as a Destination of Diversion Concern under subsection (a) for a 12-month period if the President—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H2FA4B19E47D44400ABF6F6C2A878680F"><enum>(A)</enum><text>determines that the government of the country is taking steps—</text>
<clause commented="no" display-inline="no-display-inline" id="HBEBF6F223EA64E4094F179536644B1D2"><enum>(i)</enum><text>to institute an export control system or strengthen the export control system of the country;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HDF5C37CB7AEF47DEB9752D8AF393291C"><enum>(ii)</enum><text>to interdict the diversion of goods, services, or technologies described in section 302(b) through the country to Iranian end-users or Iranian intermediaries; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H385BD84BC7B34B93B9542BB7572DC70F"><enum>(iii)</enum><text>to comply with and enforce United Nations Security Council Resolutions 1696 (2006), 1737 (2006), 1747 (2007), 1803 (2008), and 1929 (2010), and any other resolution that is agreed to by the Security Council and imposes sanctions with respect to Iran;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H30DCD16DCB924D758D429EE21690C913"><enum>(B)</enum><text>determines that it is appropriate to carry out government-to-government activities to strengthen the export control system of the country; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2807DD2432BC4DC4BDC07D3D8FEA026C"><enum>(C)</enum><text>submits to the appropriate congressional committees a report describing the steps specified in subparagraph (A) being taken by the government of the country.</text></subparagraph></paragraph>
<paragraph id="H3DDB1FF3BFBA40B2A05568387C28F637"><enum>(2)</enum><header>Additional 12-month periods</header><text>The President may delay the imposition of the licensing requirement under subsection (c) with respect to a country designated as a Destination of Diversion Concern under subsection (a) for additional 12-month periods after the 12-month period referred to in paragraph (1) if the President, for each such 12-month period—</text>
<subparagraph id="H4E583A721336438AA7CFE6F80429AEE5"><enum>(A)</enum><text>makes the determinations described in subparagraphs (A) and (B) of paragraph (1) with respect to the country; and</text></subparagraph>
<subparagraph id="H9D70889D553B4CE3BCDAAC0AF28D0AEA"><enum>(B)</enum><text>submits to the appropriate congressional committees an updated version of the report required by subparagraph (C) of paragraph (1).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDF2123C41AA9400CA8F13999A9B9E711"><enum>(3)</enum><header display-inline="yes-display-inline">Strengthening export control systems</header><text display-inline="yes-display-inline">If the President determines under paragraph (1)(B) that is it appropriate to carry out government-to-government activities to strengthen the export control system of a country designated as a Destination of Diversion Concern under subsection (a), the United States shall initiate government-to-government activities that may include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HFEB07E3B717D475B8A63E631CE5C2053"><enum>(A)</enum><text display-inline="yes-display-inline">cooperation by agencies and departments of the United States with counterpart agencies and departments in the country—</text>
<clause commented="no" display-inline="no-display-inline" id="H1153DEE1BACB4705B9599F4EDF9A5EBE"><enum>(i)</enum><text display-inline="yes-display-inline">to develop or strengthen the export control system of the country;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HCC7CB065A2FC42BCB0B3F27B9FA654C5"><enum>(ii)</enum><text display-inline="yes-display-inline">to strengthen cooperation among agencies of the country and with the United States and facilitate enforcement of the export control system of the country; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H0401A707C187424A8B8B2D867C5DACB4"><enum>(iii)</enum><text display-inline="yes-display-inline">to promote information and data exchanges among agencies of the country and with the United States;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HFE694037EDDA47C1B8D5EAADD85E2C67"><enum>(B)</enum><text display-inline="yes-display-inline">training officials of the country to strengthen the export control systems of the country—</text>
<clause commented="no" display-inline="no-display-inline" id="H0E4A23F2F0324EA88DCF28E029104E65"><enum>(i)</enum><text display-inline="yes-display-inline">to facilitate legitimate trade in goods, services, and technologies; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HC04B817718B14A0EBEEDD47E60EAF1A6"><enum>(ii)</enum><text display-inline="yes-display-inline">to prevent terrorists and state sponsors of terrorism, including Iran, from obtaining nuclear, biological, and chemical weapons, defense technologies, components for improvised explosive devices, and other defense articles; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H66E22079132D4A6494A10B3B0976D900"><enum>(C)</enum><text>encouraging the government of the country to participate in the Proliferation Security Initiative, such as by entering into a ship boarding agreement pursuant to the Initiative.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H68AF4A41F6C94D7CA4C4A756B7F59D74"><enum>(e)</enum><header display-inline="yes-display-inline">Termination of designation</header><text display-inline="yes-display-inline">The designation of a country as a Destination of Diversion Concern under subsection (a) shall terminate on the date on which the President determines, and certifies to the appropriate congressional committees, that the country has adequately strengthened the export control system of the country to prevent the diversion of goods, services, and technologies described in section 302(b) to Iranian end-users or Iranian intermediaries.</text></subsection>
<subsection id="H423DDBF3F0C3494E8AD59C9E85355435"><enum>(f)</enum><header>Form of reports</header><text>A report required by subsection (b) or (d) may be submitted in classified form.</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HD5F6819CA6DC42D7B9DD641E38BF2B96" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Report on expanding diversion concern system to address the diversion of United States origin goods, services, and technologies to certain countries other than Iran</header>
<subsection commented="no" display-inline="no-display-inline" id="H56E1D6B1327149B4A643F0BE429A4A7F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H88601B6F651349E180FE3ABEAB80A3FA"><enum>(1)</enum><text display-inline="yes-display-inline">identifies any country that the President determines is allowing the diversion, in violation of United States law, of items on the Commerce Control List or services related to those items, or defense articles or defense services on the United States Munitions List, that originated in the United States to another country if such other country—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HA37C51AF457A48AFB6E645DB3C5DCDF2"><enum>(A)</enum><text display-inline="yes-display-inline">is seeking to obtain nuclear, biological, or chemical weapons, or ballistic missiles; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3CF8201909FF405AB2C2934713640DD8"><enum>(B)</enum><text display-inline="yes-display-inline">provides support for acts of international terrorism; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4EE5250AB862432197A2EA38F8D7105C"><enum>(2)</enum><text display-inline="yes-display-inline">assesses the feasability and advisability of expanding the system established under section 303 for designating countries as Destinations of Diversion Concern to include countries identified under paragraph (1).</text></paragraph></subsection>
<subsection id="HDFE5AEFAB88F404C8C9020B986E5B473"><enum>(b)</enum><header>Form</header><text>The report required by subsection (a) may be submitted in classified form.</text></subsection></section>
<section id="H6E89F25D699B4E69B76821D3FC1B9FEC"><enum>305.</enum><header>Enforcement authority</header><text display-inline="no-display-inline">The Secretary of Commerce may designate any employee of the Office of Export Enforcement of the Department of Commerce to conduct activities specified in clauses (i), (ii), and (iii) of section 12(a)(3)(B) of the Export Administration Act of 1979 (50 U.S.C. App. 2411(a)(3)(B)) when the employee is carrying out activities to enforce—</text>
<paragraph id="H7BC95D1BCA184E66B2B12B4AD050D1F6"><enum>(1)</enum><text>the provisions of the Export Administration Act of 1979 (50 U.S.C. App. 2401 et seq.) (as in effect pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.));</text></paragraph>
<paragraph id="H64A74D5EDD4843BF9C4B6A27FDE32B6C"><enum>(2)</enum><text display-inline="yes-display-inline">the provisions of this title, or any other provision of law relating to export controls, with respect to which the Secretary of Commerce has enforcement responsibility; or</text></paragraph>
<paragraph id="H3FE4C23890F742A6862C7E2060C18B71"><enum>(3)</enum><text>any license, order, or regulation issued under—</text>
<subparagraph id="HCB4D8F8B55B14EB6AC8A0DD45FE8A8A8"><enum>(A)</enum><text>the Export Administration Act of 1979 (50 U.S.C. App. 2401 et seq.) (as in effect pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.)); or</text></subparagraph>
<subparagraph id="H50DB087D8D6D4CC785CA49D2A1208B84"><enum>(B)</enum><text>a provision of law referred to in paragraph (2).</text></subparagraph></paragraph></section></title>
<title commented="no" id="HEF3FF2A9BA6D45A0983335936AF38B8E" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">General provisions</header>
<section commented="no" display-inline="no-display-inline" id="HA4B3902ECBBF4377BE148A127ED41501" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">General provisions</header>
<subsection commented="no" display-inline="no-display-inline" id="HED747F411FD54CF89601C9CBD2B7E295"><enum>(a)</enum><header>Sunset</header><text display-inline="yes-display-inline">The provisions of this Act (other than sections 105 and 305 and the amendments made by sections 102, 107, 109, and 205) shall terminate, and section 13(c)(1)(B) of the Investment Company Act of 1940, as added by section 203(a), shall cease to be effective, on the date that is 30 days after the date on which the President certifies to Congress that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H4E995362FE4F44F79569F7BBE1C337C4"><enum>(1)</enum><text display-inline="yes-display-inline">the Government of Iran has ceased providing support for acts of international terrorism and no longer satisfies the requirements for designation as a state sponsor of terrorism (as defined in section 301) under—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H2D8E923DB13F42C58C30DA417A32B1B5"><enum>(A)</enum><text display-inline="yes-display-inline">section 6(j)(1)(A) of the Export Administration Act of 1979 (50 U.S.C. App. 2405(j)(1)(A)) (or any successor thereto);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1E5DF8178210457D935DB3A18595328E"><enum>(B)</enum><text display-inline="yes-display-inline">section 40(d) of the Arms Export Control Act (22 U.S.C. 2780(d)); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCE5D1000B56A4782BFC7E6EEFC8EE467"><enum>(C)</enum><text display-inline="yes-display-inline">section 620A(a) of the Foreign Assistance Act of 1961 (22 U.S.C. 2371(a)); and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H93D022FBAA3C499C9EA1124FE9A642DE"><enum>(2)</enum><text display-inline="yes-display-inline">Iran has ceased the pursuit, acquisition, and development of nuclear, biological, and chemical weapons and ballistic missiles and ballistic missile launch technology.</text></paragraph></subsection>
<subsection id="HD2B951F2DAE24E1C81A1D1212AC5CF50"><enum>(b)</enum><header>Presidential waivers</header>
<paragraph id="H1B6F7DC471454F5B8478A34E6FACA340"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive the application of sanctions under section 103(b), the requirement to impose or maintain sanctions with respect to a person under section 105(a), the requirement to include a person on the list required by section 105(b), the application of the prohibition under section 106(a), or the imposition of the licensing requirement under section 303(c) with respect to a country designated as a Destination of Diversion Concern under section 303(a), if the President determines that such a waiver is in the national interest of the United States.</text></paragraph>
<paragraph id="H5A140614951F4DD79D994D523ECADEB8"><enum>(2)</enum><header>Reports</header>
<subparagraph id="HAFF6F4A7C92B49B0B5BBD5D22EFB27C2"><enum>(A)</enum><header>In general</header><text>If the President waives the application of a provision pursuant to paragraph (1), the President shall submit to the appropriate congressional committees a report describing the reasons for the waiver.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA965170E76CD42B88DB6EBD570641D5C"><enum>(B)</enum><header>Special rule for report on waiving imposition of licensing requirement under section 303<enum-in-header>(c)</enum-in-header></header><text>In any case in which the President waives, pursuant to paragraph (1), the imposition of the licensing requirement under section 303(c) with respect to a country designated as a Destination of Diversion Concern under section 303(a), the President shall include in the report required by subparagraph (A) of this paragraph an assessment of whether the government of the country is taking the steps described in subparagraph (A) of section 303(d)(1).</text></subparagraph></paragraph></subsection>
<subsection id="H997F1383EA4345E48842F3D08F8DCE60"><enum>(c)</enum><header>Authorizations of appropriations</header>
<paragraph id="HA49DD7E58E35472481AF4BED97C58F84"><enum>(1)</enum><header>Authorization of appropriations for the Department of State and the Department of the Treasury</header><text>There are authorized to be appropriated to the Secretary of State and to the Secretary of the Treasury such sums as may be necessary to implement the provisions of, and amendments made by, titles I and III of this Act.</text></paragraph>
<paragraph id="H57107BD6E41742E39F06DC6E2ED0B8F6"><enum>(2)</enum><header>Authorization of appropriations for the Department of Commerce</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary of Commerce such sums as may be necessary to carry out title III.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HCC328AB71C6144738198D7939C02EAB5" section-type="subsequent-section"><enum>402.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, jointly submitted for printing in the Congressional Record by the Chairmen of the House and Senate Budget Committees, provided that such statement has been submitted prior to the vote on passage in the House acting first on this conference report or amendment between the Houses.</text></section></title>
