<official-title display="yes">To amend the Iran Sanctions Act of 1996 to enhance United States diplomatic efforts with respect to Iran by expanding economic sanctions against Iran.</official-title>

<section id="H887639A0AA6440D9B85488AEACAE8EA4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Iran Refined Petroleum Sanctions Act of 2009</short-title></quote>.</text></section> 
<section id="HC7F3186238F74ADB97FADB83ADD56515"><enum>2.</enum><header>Findings; sense of Congress; statement of policy</header> 
<subsection id="HD6F9DC8DE5D14FEF9BF61EBDFCFEE151"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="HB16731C69B0542CD803E1E366E7C5249"><enum>(1)</enum><text display-inline="yes-display-inline">The illicit nuclear activities of the Government of Iran—combined with its development of unconventional weapons and ballistic missiles, and support for international terrorism—represent a serious threat to the security of the United States and U.S. allies in Europe, the Middle East, and around the world.</text></paragraph> 
<paragraph id="H70B0FEAEAEF544C28D11D79070EC50EC"><enum>(2)</enum><text>The United States and other responsible nations have a vital interest in working together to prevent the Government of Iran from acquiring a nuclear weapons capability.</text></paragraph> 
<paragraph id="HBDC6D67801CB4FB19CEB10FC019C84D1"><enum>(3)</enum><text display-inline="yes-display-inline">The International Atomic Energy Agency (IAEA) has repeatedly called attention to Iran’s unlawful nuclear activities, and, as a result, the United Nations Security Council has adopted a range of sanctions designed to encourage the Government of Iran to suspend those activities and comply with its obligations under the Treaty on the Non-Proliferation of Nuclear Weapons (commonly known as the <quote>Nuclear Non-Proliferation Treaty</quote>).</text></paragraph> 
<paragraph id="H1D167185FE314015A6D3FD86D9912C97"><enum>(4)</enum><text>As a presidential candidate, then-Senator Obama stated that additional sanctions, especially those targeting Iran’s dependence on imported refined petroleum, may help to persuade the Government of Iran to abandon its illicit nuclear activities.</text></paragraph> 
<paragraph id="HAA43EA43289A40DA9AE3EBC6EDED0119"><enum>(5)</enum><text>On October 7, 2008, then-Senator Obama stated, <quote>Iran right now imports gasoline, even though it’s an oil producer, because its oil infrastructure has broken down. If we can prevent them from importing the gasoline that they need and the refined petroleum products, that starts changing their cost-benefit analysis. That starts putting the squeeze on them.</quote>.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2D2D590291F24E6DADBDC77EA6B76C83"><enum>(6)</enum><text>On June 4, 2008, then-Senator Obama stated, <quote>We should work with Europe, Japan, and the Gulf states to find every avenue outside the U.N. to isolate the Iranian regime—from cutting off loan guarantees and expanding financial sanctions, to banning the export of refined petroleum to Iran.</quote>.</text></paragraph> 
<paragraph id="HBCFBAF027836410A9459570A1C8D3FD8"><enum>(7)</enum><text display-inline="yes-display-inline">Major European allies, including the United Kingdom, France, and Germany, have advocated that sanctions be significantly toughened should international diplomatic efforts fail to achieve verifiable suspension of Iran’s uranium enrichment program and an end to its nuclear weapons program and other illicit nuclear activities.</text></paragraph> 
<paragraph id="H8E148F35EB574EF1AE83A1E346B20F9F"><enum>(8)</enum><text>The serious and urgent nature of the threat from Iran demands that the United States work together with U.S. allies to do everything possible—diplomatically, politically, and economically—to prevent Iran from acquiring a nuclear weapons capability.</text></paragraph> 
<paragraph id="H7103C6E9A0AF4D33973544857C880991" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">The human rights situation in Iran has steadily deteriorated in 2009, as punctuated by the transparent fraud that occurred on June 12, 2009, the brutal repression and murder, arbitrary arrests, and show trials of peaceful dissidents, and ongoing suppression of freedom of expression.</text></paragraph> 
<paragraph id="HAF9E66F28D0E4557A8091E0029F7E9E6"><enum>(10)</enum><text display-inline="yes-display-inline">The Iranian regime has been unresponsive to, and at times contemptuous of, the Obama Administration’s unprecedented and serious efforts at engagement, revealing that Tehran is not interested in a diplomatic resolution, as made clear, for example, by the following:</text> 
<subparagraph id="H6108D57443A44916961DE8D2B44D806F"><enum>(A)</enum><text>Iran’s apparent rejection of the Tehran Research Reactor plan, generously offered by the United States and its partners, of potentially great benefit to the Iranian people, and endorsed by Iran’s own negotiators in October, 2009.</text></subparagraph> 
<subparagraph id="H4F0A0B2BE79D4CF099515046C122A6D9"><enum>(B)</enum><text>Iran’s ongoing clandestine nuclear weapons program, as evidenced by its work on the secret uranium enrichment facility at Qom, its subsequent refusal to cooperate fully with IAEA inspectors, and its announcement that it would build 10 new uranium enrichment facilities.</text></subparagraph> 
<subparagraph id="H9EE550EC0263486D82A82FEC6FB4D7D8"><enum>(C)</enum><text>Iran’s ongoing arms exports and support to terrorists in direct contravention of Unite Nations Security Council resolutions.</text></subparagraph> 
<subparagraph id="HE7DAE47A01E8406189E200FCEF3A1190"><enum>(D)</enum><text>Iran’s absurd claims that the West, and specifically the United States, have fomented the waves of anti-regime protests that followed the June 12, 2009, election in Iran.</text></subparagraph> 
<subparagraph id="H281AA82DF87E4D289AE7752CFBA9E6EF"><enum>(E)</enum><text>Iran’s July 31, 2009, arrest of three young Americans on spying charges. </text></subparagraph></paragraph></subsection> 
<subsection id="HB2783659B57947D5A3E42962477EC19F"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of the Congress that—</text> 
<paragraph id="H6797B940370444A38F26293573609D8E"><enum>(1)</enum><text display-inline="yes-display-inline">international diplomatic efforts to address Iran’s illicit nuclear efforts, unconventional and ballistic missile development programs, and support for international terrorism are more likely to be effective if the President is empowered with the explicit authority to impose additional sanctions on the Government of Iran;</text></paragraph> 
<paragraph id="H7E7FB7F3D21447DB9EF075374097FB7C"><enum>(2)</enum><text>the concerns of the United States regarding Iran are strictly the result of the actions of the Government of Iran; </text></paragraph> 
<paragraph id="H7D89B009E64545C29B7AF742BA5FD417"><enum>(3)</enum><text display-inline="yes-display-inline">the revelation in September 2009 that Iran is developing a secret uranium enrichment site on an Islamic Revolutionary Guard Corps base near Qom, which appears to have no civilian application, highlights the urgency for Iran to fully disclose the full nature of its nuclear program, including any other secret locations, and provide the International Atomic Energy Agency (IAEA) unfettered access to its facilities pursuant to Iran’s legal obligations under the Treaty on the Non-Proliferation of Nuclear Weapons and Iran’s Safeguards Agreement with the IAEA;</text></paragraph> 
<paragraph id="H0BD1F3EA5D17472B84C12544D332A941"><enum>(4)</enum><text display-inline="yes-display-inline">because of its involvement in Iran’s nuclear program and other destabilizing activities, the President should impose sanctions, including the full range of sanctions otherwise applicable to Iran, on any individual or entity that is an agent, alias, front, instrumentality, representative, official, or affiliate of the Islamic Revolutionary Guard Corps or is an individual serving as a representative of the Islamic Revolutionary Guard Corps, or on any person that has conducted any commercial transaction or financial transaction with such entities;</text></paragraph> 
<paragraph id="H6F5108E56ED749B1BF743CAA75D3B550"><enum>(5)</enum><text display-inline="yes-display-inline">Government to Government agreements with Iran to provide the regime with refined petroleum products, such as the September 2009 agreement under which the Government of Venezuela committed to provide 20,000 barrels of gasoline per day to Iran, undermine efforts to pressure Iran to suspend its nuclear weapons program and cease all enrichment activities; and</text></paragraph> 
<paragraph id="H74F99286083B487A8B53085A290C5C3B"><enum>(6)</enum><text>the people of the United States—</text> 
<subparagraph id="H10A3F92FFB834326BB75DC32AC77BC98"><enum>(A)</enum><text>have feelings of friendship for the people of Iran; and</text></subparagraph> 
<subparagraph id="H82742BE9F408497B915E696D8A5F0A21"><enum>(B)</enum><text>hold the people of Iran, their culture, and their ancient and rich history in the highest esteem.</text></subparagraph></paragraph></subsection> 
<subsection id="HCE92BE593AFD47AD8498C5BEA9AA670B"><enum>(c)</enum><header>Statement of policy</header><text>It shall be the policy of the United States—</text> 
<paragraph id="H1E784DB3AB6B4BCA91AA566624C97916"><enum>(1)</enum><text display-inline="yes-display-inline">to prevent Iran from achieving the capability to make nuclear weapons, including by supporting international diplomatic efforts to halt Iran’s uranium enrichment program;</text></paragraph> 
<paragraph id="H3AB13812554D43BBBB022CFE17C0FC30"><enum>(2)</enum><text>to fully implement and enforce the Iran Sanctions Act of 1996 as a means of encouraging foreign governments to—</text> 
<subparagraph id="H6E9783D638CF4072BEA2941FF3B6D408"><enum>(A)</enum><text>direct state-owned entities to cease all investment in, and support of, Iran’s energy sector and all exports of refined petroleum products to Iran; and</text></subparagraph> 
<subparagraph id="H341114F5ADC14DDC8746F8BCF2744EFC"><enum>(B)</enum><text>require private entities based in their territories to cease all investment in, and support of, Iran’s energy sector and all exports of refined petroleum products to Iran;</text></subparagraph></paragraph> 
<paragraph id="H4190F47EF1014B4C8ACC7D6B0616FD22"><enum>(3)</enum><text>to impose sanctions on—</text> 
<subparagraph id="H8DCCF104DFC04C8798500ACB17FD26E5"><enum>(A)</enum><text>the Central Bank of Iran, and any other financial institution in Iran that is engaged in proliferation activities or support of terrorist groups, and</text></subparagraph> 
<subparagraph id="HD89505E95E8D45CDB77B1F47EB454A7A"><enum>(B)</enum><text display-inline="yes-display-inline">any other financial institution that conducts financial transactions with the Central Bank of Iran or with another financial institution described in subparagraph (A), </text></subparagraph><continuation-text continuation-text-level="paragraph">including through the use of Executive Orders 13224, 13382, and 13438 and United Nations Security Council Resolutions 1737, 1747, 1803, and 1835; </continuation-text></paragraph> 
<paragraph id="HAC8326C8B8D64F6BACDF6C16BA9EA044" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">to persuade the allies of the United States and other countries to take appropriate measures to deny access to the international financial system by Iranian banks and financial institutions involved in proliferation activities or support of terrorist groups; </text></paragraph> 
<paragraph id="H06EA9B6C0DE24E0BBEE9D6D93EF4A3D4" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">to support all Iranian citizens who embrace the values of freedom, human rights, civil liberties, and the rule of law; and</text></paragraph> 
<paragraph id="H291B7B88C6A9409A8A03E5FD1D5AA764"><enum>(6)</enum><text display-inline="yes-display-inline">for the Secretary of State to make every effort to assist United States citizens held hostage in Iran at any time during the period beginning on November 4, 1979 and ending on January 20, 1981, and their survivors in matters of compensation related to such citizens’ detention.</text></paragraph></subsection></section> 
<section id="H76DDF92E34DF414D8347650824469A91"><enum>3.</enum><header>Amendments to the Iran Sanctions Act of 1996</header> 
<subsection id="HF27E628BE6924FE6B8B7EF9692330AF5"><enum>(a)</enum><header>Expansion of sanctions</header><text>Section 5(a) of the Iran Sanctions Act of 1996 (50 U.S.C. 1701 note) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H4D4A46932C1849D286DFA69D22B818CA" style="OLC"> 
<subsection id="HCA153F827AA1487DA439C30EA104E855"><enum>(a)</enum><header>Sanctions with respect to the development of petroleum resources of Iran and exportation of refined petroleum to Iran</header> 
<paragraph id="H95D0F4A7491F463FAFDE1C15DE70A73D"><enum>(1)</enum><header>Development of petroleum resources of Iran</header> 
<subparagraph id="HF28E4BF4BC7C4D6B95D91653369FAE1A"><enum>(A)</enum><header>Investment</header><text display-inline="yes-display-inline">Except as provided in subsection (f), the President shall impose 2 or more of the sanctions described in paragraphs (1) through (6) of section 6(a) if the President determines that a person has knowingly, on or after the date of the enactment of this Act, made an investment of $20,000,000 or more (or any combination of investments of at least $5,000,000 each, which in the aggregate equals or exceeds $20,000,000 in any 12-month period), that directly and significantly contributed to the enhancement of Iran’s ability to develop petroleum resources of Iran. </text></subparagraph> 
<subparagraph id="H293F0AF195C94E919A461E2F64524CC7"><enum>(B)</enum><header>Production of refined petroleum products</header><text display-inline="yes-display-inline">Except as provided in subsection (f), the President shall impose the sanctions described in section 6(b) if the President determines that a person knowingly <short-title>sells, leases, or provides to Iran any goods, services, technology, information, or support, or enters into a contract to sell, lease, or provide to Iran any goods, services, technology, information, or support, that would allow Iran to maintain or expand its domestic production of refined petroleum products, including any assistance in the construction, modernization, or repair of refineries that make refined petroleum products, if—</short-title></text> 
<clause id="HD550C5AA12C3415DB6768D2857DA5166"><enum>(i)</enum><text display-inline="yes-display-inline">the value of the goods, services, technology, information, or support provided in such sale, lease, or provision, or to be provided in such contract, exceeds $200,000; or</text></clause> 
<clause id="H6EEEA58B091A4709B1FC326A605E6EC2"><enum>(ii)</enum><text display-inline="yes-display-inline">the value of the goods, services, technology, information, or support provided in any combination of such sales, leases, or provision in any 12-month period, or to be provided under contracts entered into in any 12-month period, exceeds $500,000.</text></clause></subparagraph></paragraph> 
<paragraph id="H68CA875E04284199A076C24BFACEA9C3"><enum>(2)</enum><header>Exportation of refined petroleum products to Iran</header> 
<subparagraph id="HACE643A053DB4026AC3A94FE923F7B71"><enum>(A)</enum><header>In general</header><text>Except as provided in subsection (f), the President shall impose the sanctions described in section 6(b) if the President determines that a person knowingly provides Iran with refined petroleum products or knowingly engages in any of the activities described in subparagraph (B), if—</text> 
<clause id="HC09514748EDF400B9596ACB7DDDF5AAA"><enum>(i)</enum><text display-inline="yes-display-inline">the value of such products or of the goods, services, technology, information, or support provided or to be provided in connection with such activity exceeds $200,000; or</text></clause> 
<clause id="H8BBFAA1C3BEA436EA8F26B3784349A94"><enum>(ii)</enum><text display-inline="yes-display-inline">the value of such products, or of the goods, services, technology, information, or support, provided or to be provided in connection with any combination of providing such products or such activities, in any 12-month period exceeds $500,000.</text></clause></subparagraph> 
<subparagraph id="H9E8176475A334631A3DF460F3E8C3176"><enum>(B)</enum><header>Activities described</header><text>The activities referred to in subparagraph (A) are the following:</text> 
<clause id="H34BCB17B19924AB5AE23A3258BF8E212"><enum>(i)</enum><text display-inline="yes-display-inline">Providing ships, vehicles, or other means of transportation to deliver refined petroleum products to Iran, or providing services relating to the shipping or other transportation of refined petroleum products to Iran.</text></clause> 
<clause id="HD3213952D8B7463F9C11B9C4F9E32198"><enum>(ii)</enum><text>Underwriting or otherwise providing insurance or reinsurance for an activity described in clause (i).</text></clause> 
<clause id="H9996DE778CF54187AE8783DACD95FDE3"><enum>(iii)</enum><text display-inline="yes-display-inline">Financing or brokering an activity described in clause (i).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4E8676A00FE74ACEAB31E1C9095A8D98"><enum>(b)</enum><header>Description of sanctions</header><text>Section 6 of such Act is amended—</text> 
<paragraph id="H462B2E9B39A64957B51C126A76A11EFB"><enum>(1)</enum><text>by striking <quote>The sanctions to be imposed on a sanctioned person under section 5 are as follows:</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H7B79114E53FA4D4C8D4426FC46C47BA5" style="OLC"> 
<subsection id="H166276E215234F59A5E472654C15D545"><enum>(a)</enum><header>In general</header><text>The sanctions to be imposed on a sanctioned person under subsections (a)(1)(A) and (b)(1) of section 5 are as follows:</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H0FBCDDB4674D4CBFB9274AE1B89C5BC7"><enum>(2)</enum><text>in paragraph (4), by striking <quote>section 5</quote> each place it appears and inserting <quote>subsections (a)(1)(A) and (b) of section 5</quote>; and </text></paragraph> 
<paragraph id="H9B9223132DC64B9787411B1E2C5D3448"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H36E5984FDE40422E8FAF638ADBFB1260" style="OLC"> 
<subsection id="HB6F8CEFFD29E43F9A6E739A175F73BD3"><enum>(b)</enum><header>Additional mandatory sanctions</header><text>The sanctions to be imposed on a sanctioned person under paragraphs (1)(B) and (2) of section 5(a) are as follows:</text> 
<paragraph id="H6D2EB30323514ABA986856A71135F94C"><enum>(1)</enum><header>Foreign exchange</header><text>The President shall prohibit any transactions in foreign exchange by the sanctioned person.</text></paragraph> 
<paragraph id="HA61B01523EE6498A9FF84C5CFDB9876B"><enum>(2)</enum><header>Banking transactions</header><text>The President shall prohibit any transfers of credit or payments between, by, through, or to any financial institution, to the extent that such transfers or payments involve any interest of the sanctioned person.</text></paragraph> 
<paragraph id="H3309B2BDDB104DCAAE9FDAD22C2F353B"><enum>(3)</enum><header>Property transactions</header><text>The President shall prohibit any acquisition, holding, withholding, use, transfer, withdrawal, transportation, importation, or exportation of, dealing in, or exercising any right, power, or privilege with respect to, or transactions involving, any property in which the sanctioned person has any interest by any person, or with respect to any property, subject to the jurisdiction of the United States.</text></paragraph></subsection> 
<subsection id="H3220E4CE958E431DBF58E2350C94CA19"><enum>(c)</enum><header>Additional measure relating to refined petroleum products</header> 
<paragraph id="H92D1FB05BF91455C8D55449781C6FCC0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each executive agency shall ensure that each contract with a person entered into by such executive agency for the procurement of goods or services, or agreement for the use of Federal funds as part of a grant, loan, or loan guarantee to a person, includes a clause that requires the person to certify to the contracting officer or other appropriate official of such agency that the person does not conduct any activity described in paragraph (1)(B) or (2) of section 5(a).</text></paragraph> 
<paragraph id="HC08B190AC6034301BDDC8B9C39945AA6" commented="no"><enum>(2)</enum><header>Exclusion</header><text>Paragraph (1) shall not apply to a loan or other program under title IV of the Higher Education Act of 1965 (20 U.S.C. 1070 et seq.), or to any payment of educational assistance by the Secretary of Veterans Affairs under title 38, United States Code.</text></paragraph> 
<paragraph id="H0D35EA098BDC48318E7DCFF8060B6B42"><enum>(3)</enum><header>Remedies</header> 
<subparagraph id="HF940DB9B8F0448A5B282BD5A74EF92D7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the head of the executive agency determines that such person has submitted a false certification under paragraph (1) after the date on which the Federal Acquisition Regulation is revised to implement the requirements of this subsection, the head of an executive agency may terminate a contract, or agreement described in paragraph (1), with such person or debar or suspend such person from eligibility for Federal contracts or such agreements for a period not to exceed 3 years. Any such debarment or suspension shall be subject to the procedures that apply to debarment and suspension under the Federal Acquisition Regulation under subpart 9.4 of part 9 of title 48, Code of Federal Regulations. </text></subparagraph> 
<subparagraph id="H5A33072AA9264286BFC4381ABC13D84C"><enum>(B)</enum><header>Inclusion on list of parties excluded from federal procurement and nonprocurement programs</header><text>The Administrator of General Services shall include on the List of Parties Excluded from Federal Procurement and Nonprocurement Programs maintained by the Administrator under part 9 of the Federal Acquisition Regulation issued under section 25 of the Office of Federal Procurement Policy Act (41 U.S.C. 421) each person that is debarred, suspended, proposed for debarment, or declared ineligible by the head of an executive agency on the basis of a determination of a false certification under subparagraph (A).</text></subparagraph> 
<subparagraph id="H21BFA58751BE4AB9A8227EBE9EC49CB1"><enum>(C)</enum><header>Rule of construction</header><text>This subsection shall not be construed to limit the use of other remedies available to the head of an executive agency or any other official of the Federal Government on the basis of a determination of a false certification under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="H478BAAA6BBB34EF2AF6525FBE975C2BD"><enum>(4)</enum><header>Implementation Through the Federal Acquisition Regulation</header><text>Not later than 120 days after the date of the enactment of the Iran Refined Petroleum Sanctions Act of 2009, the Federal Acquisition Regulation issued pursuant to section 25 of the Office of Federal Procurement Policy Act (41 U.S.C. 421) shall be revised to provide for the implementation of the requirements of this subsection.</text></paragraph> 
<paragraph id="HC4F3D083C8194F9A91553FF2F035DC80" commented="no"><enum>(5)</enum><header>Clarification regarding certain products</header><text>Section 5(f)(2) applies with respect to the imposition of remedies under paragraph (3) to the same extent as such section applies with respect to sanctions under subsection (a) or (b) of section 5.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCA5A9601D6F641D991D4650A8C8A4F5A"><enum>(c)</enum><header>Additional Mandatory Sanctions Relating to Transfer of Nuclear Technology</header><text>Section 5(b) of the Iran Sanctions Act of 1996 is amended—</text> 
<paragraph id="HE979023409C44345ABFCDA742424AF5F"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and moving such paragraphs 2 ems to the right;</text></paragraph>

<subparagraph id="H9B13BC2F27A644548119D2496EC2CD20"><enum>(A)</enum><header>Restriction</header><text display-inline="yes-display-inline">In any case in which a person is subject to sanctions under paragraph (1) because of an activity described in such paragraph that relates to the acquisition or development of nuclear weapons or related technology or of missiles or other advanced conventional weapons that are capable of delivering a nuclear weapon, then notwithstanding any other provision of law, the following measures shall apply with respect to the country that has jurisdiction over such person, unless the President determines and notifies the appropriate congressional committees that the government of such country has taken, or is taking, effective actions to penalize such person and to prevent a reoccurrence of such activity in the future:</text> 
<clause id="H687244D71CBB4556AB3C243C36B24213"><enum>(i)</enum><text display-inline="yes-display-inline">No agreement for cooperation between the United States and the government of such country may be submitted to the President or to Congress pursuant to section 123 of the Atomic Energy Act of 1954 (42 U.S.C. 2153), or may enter into force.</text></clause> 
<clause id="H0CF0768BD8474160B36A44F9417403C4"><enum>(ii)</enum><text display-inline="yes-display-inline">No license may be issued for the export, and no approval may be given for the transfer or retransfer, directly or indirectly, to such country of any nuclear material, facilities, components, or other goods, services, or technology that would be subject to an agreement to cooperation.</text></clause></subparagraph> 
<subparagraph id="H1161213F6AC7410FAFE1D5A83ED2C3A7"><enum>(B)</enum><header>Construction</header><text display-inline="yes-display-inline">The restrictions in subparagraph (A) shall apply in addition to all other applicable procedures, requirements, and restrictions contained in the Atomic Energy Act of 1954 and other laws.</text></subparagraph> 
<subparagraph id="HC5D563E6508143F8A1DA49BB6E28764F"><enum>(C)</enum><header>Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>agreement for cooperation</quote> has the meaning given that term in section 11 b. of the Atomic Energy Act of 1954 (42 U.S.C. 2014(b)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA079BD20EDE34C1D8A60CE150316A5AE"><enum>(d)</enum><header>Strengthening of waiver authority and sanctions implementation</header> 
<paragraph id="H09337694556F44999CD450FEC0DD4FF3"><enum>(1)</enum><header>Investigations</header><text>Section 4(f) of the Iran Sanctions Act of 1996 (50 U.S.C. 1701 note) is amended—</text> 
<subparagraph id="H31F2C5F9D200430B8544F8D3FD991FCE"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="H51506DF50909478BACD2434A8966CDB1"><enum>(i)</enum><text>by striking <quote>should initiate</quote> and inserting <quote>shall immediately initiate</quote>;</text></clause> 
<clause id="HCD72203A287749E3BB1F995974E5ACF3"><enum>(ii)</enum><text>by inserting <quote>or 5(b)</quote> after <quote>section 5(a)</quote>; and</text></clause> 
<clause id="H911824FA2C26427BA95C91E2F6B48CCB"><enum>(iii)</enum><text>by striking <quote>as described in such section</quote> and inserting <quote>as described in section 5(a)(1) or other activity described in section 5(a)(2) or 5(b) (as the case may be)</quote>; and</text></clause></subparagraph> 
<subparagraph id="H708E560AC77C45058CD9697718EF08BC"><enum>(B)</enum><text>in paragraph (2), by striking <quote>should determine, pursuant to section 5(a), if a person has engaged in investment activity in Iran as described in such section</quote> and inserting <quote>shall determine, pursuant to section 5(a) or (b) (as the case may be), if a person has engaged in investment activity in Iran as described in section 5(a)(1) or other activity described in section 5(a)(2) or 5(b) (as the case may be)</quote>.</text></subparagraph></paragraph> 
<paragraph id="HCC58093B74744469B082B18183B42862"><enum>(2)</enum><header>General Waiver Authority</header><text>Section 9(c) of the Iran Sanctions Act of 1996 (50 U.S.C. 1701 note) is amended—</text> 
<subparagraph id="H8CE069056F0F42139FCE20ECB04544E3"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="H1DC2AFD9A8EF4E398A21D168E583B7F3"><enum>(i)</enum><text>by inserting after <quote>on a person described in section 5(c),</quote> the following: <quote>or on a country described in section 5(b)(2)(A) (if the President certifies to the appropriate congressional committees that the President is unable to make the determination described in such section 5(b)(2)(A) with respect to the government of that country),</quote>; and </text></clause> 
<clause id="HE415A6734AEB41D3ADBE7528D3AABE42"><enum>(ii)</enum><text>by striking <quote>important to the national interest of the United States</quote> and inserting <quote>vital to the national security interest of the United States</quote>; and</text></clause></subparagraph> 
<subparagraph id="H7C97D7505BF04E8F912B73437D3B8E48"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text> 
<clause id="HD97297D6C6164FB58846B275B64ED364"><enum>(i)</enum><text>in subparagraphs (A), (B), and (D), by striking <quote>or (b)</quote> each place it appears and inserting <quote>or (b)(1)</quote>; and </text></clause> 
<clause id="HBC019E5201B043CB9578DE06354F8650"><enum>(ii)</enum><text>by amending subparagraph (C) to read as follows:</text>

<subparagraph id="HB0EE5D7E473E4CBDA7E18E981328ACA4"><enum>(C)</enum><text display-inline="yes-display-inline">an estimate of the significance of the provision of the items described in paragraph (1) or (2) of section 5(a) or section 5(b)(1) to Iran’s ability to develop its petroleum resources, to maintain or expand its domestic production of refined petroleum products, to import refined petroleum products, or to develop its weapons of mass destruction or other military capabilities (as the case may be); and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection> 
<subsection id="HD4A36182187B46FEA5D364F79D37A078"><enum>(e)</enum><header>Reports on United States efforts To curtail certain business and other transactions relating to Iran</header><text>Section 10 of such Act is amended—</text> 
<paragraph id="H09D101C0A11D42EC93E81886FFC93699"><enum>(1)</enum><text>in subsection (a), by amending paragraph (4) to read as follows:</text> 
<quoted-block style="OLC" id="H5A8D3B8630434D89AA91C490A4B5B09B" display-inline="no-display-inline"> 
<paragraph id="H9AC84DDFAAFA408F8A1086948F2F5DFC"><enum>(4)</enum><text display-inline="yes-display-inline">Iran’s use in the Middle East, the Western Hemisphere, Africa, and other regions, of Iranian diplomats and representatives of other government and military or quasi-governmental institutions or proxies of Iran, including, but not limited to, Hezbollah, to promote acts of international terrorism or to develop or sustain Iran’s nuclear, chemical, biological, and missile weapons programs.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5380CC56C8DD4822943152A136926304"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB39ED7CA000546D886665AF00C524C3E" style="OLC"> 
<subsection id="H2E479CE962C54719BE8896C5A8A5E123"><enum>(d)</enum><header>Reports on certain business and other transactions relating to Iran</header> 
<paragraph id="HD7C5EC84CFBB4C56A959280A90E69D07"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Iran Refined Petroleum Sanctions Act of 2009</short-title>, and every 6 months thereafter, the President shall submit a report to the appropriate congressional committees regarding any person who has—</text> 
<subparagraph id="H571E3774E6AC46D3A9B4A11BC32B7999"><enum>(A)</enum><text display-inline="yes-display-inline">provided Iran with refined petroleum products;</text></subparagraph> 
<subparagraph id="H36411DAC773340DA8A7FF0AD92028424"><enum>(B)</enum><text display-inline="yes-display-inline">sold, leased, or provided to Iran any goods, services, or technology that would allow Iran to maintain or expand its domestic production of refined petroleum products; or</text></subparagraph> 
<subparagraph id="HC91F5C2091B64CCCA8FBFBA11E930E07"><enum>(C)</enum><text>engaged in any activity described in section 5(a)(2)(B).</text></subparagraph></paragraph> 
<paragraph id="H6BE8F8289F5742D192924B163524A12B"><enum>(2)</enum><header>Description</header><text display-inline="yes-display-inline">For each activity set forth in subparagraphs (A) through (C) of paragraph (1), the President shall provide a complete and detailed description of such activity, including—</text> 
<subparagraph id="H2AA19F6A65AD4B1F930DC33F41E29C0A"><enum>(A)</enum><text>the date or dates of such activity;</text></subparagraph> 
<subparagraph id="HF9B7F09070BC45428A2FE9BBD626EEE4"><enum>(B)</enum><text>the name of any persons who participated or invested in or facilitated such activity;</text></subparagraph> 
<subparagraph id="H767CC778F1D4476EBCD6954B73ED3950"><enum>(C)</enum><text>the United States domiciliary of the persons referred to in subparagraph (B);</text></subparagraph> 
<subparagraph id="HEFDC00FC86524B45BA25D7446D7942D1"><enum>(D)</enum><text>any Federal Government contracts to which the persons referred to in subparagraph (B) are parties; and</text></subparagraph> 
<subparagraph id="H19F11C365D4D45D48C55E5B73E464689"><enum>(E)</enum><text>the steps taken by the United States to respond to such activity.</text></subparagraph></paragraph> 
<paragraph id="HA191D98B58494C89BBFB66E0405A9D74"><enum>(3)</enum><header>Additional information</header><text display-inline="yes-display-inline">The report required by this subsection shall also include a list of—</text> 
<subparagraph id="H40E56C03346F470FA1AD713CAF297F31"><enum>(A)</enum><text>any person that the President determines is an agent, alias, front, instrumentality, representative, official, or affiliate of the Islamic Revolutionary Guard Corps or is an individual serving as a representative of the Islamic Revolutionary Guard Corps; </text></subparagraph> 
<subparagraph id="H8670246FFCC243D69D622BAB0E1241A5"><enum>(B)</enum><text>any person that the President determines has knowingly provided material support to the Islamic Revolutionary Guard Corps or an agent, alias, front, instrumentality, representative, official, or affiliate of the Islamic Revolutionary Guard Corps; and</text></subparagraph> 
<subparagraph id="HFA4C71FB6B8348128B8024656C3E6A66"><enum>(C)</enum><text>any person who has conducted any commercial transaction or financial transaction with the Islamic Revolutionary Guards Corps or an agent, alias, front, instrumentality, representative, official, or affiliate of the Islamic Revolutionary Guard Corps.</text></subparagraph></paragraph> 
<paragraph id="H28B0E81319B24C1E8BCC8E5F292FC267"><enum>(4)</enum><header>Form of reports; publication</header><text display-inline="yes-display-inline">The reports required under this subsection shall be—</text> 
<subparagraph id="H9731EDCD390C4190814756FCCCE21CB1"><enum>(A)</enum><text display-inline="yes-display-inline">submitted in unclassified form, but may contain a classified annex; and</text></subparagraph> 
<subparagraph id="HB8139E52BBB74ABF844FAE8F0DB0DC4C"><enum>(B)</enum><text display-inline="yes-display-inline">published in the Federal Register.</text></subparagraph></paragraph></subsection> 
<subsection id="H875DAEDEF0144108AC3B40BF2097AF64"><enum>(e)</enum><header>Reports on global trade relating to Iran</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of the <short-title>Iran Refined Petroleum Sanctions Act of 2009</short-title> and annually thereafter, the President shall submit to the appropriate congressional committees a report, with respect to the immediately preceding 12-month period, on the dollar value amount of trade, including in the energy sector, between Iran and each country maintaining membership in the Group of Twenty Finance Ministers and Central Bank Governors. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H429CD7A4764B43C4A1AE7AF702D86B74"><enum>(f)</enum><header>Clarification and expansion of definitions</header><text>Section 14 of such Act is amended—</text> 
<paragraph id="H30A2852F9AF84869ADCCD75F211DB55C"><enum>(1)</enum><text>in paragraph (13)(B)—</text> 
<subparagraph id="HA240A110CBA04160A3B866578A2C25A1"><enum>(A)</enum><text>by inserting <quote>financial institution, insurer, underwriter, guarantor, any other business organization, including any foreign subsidiary, parent, or affiliate of such a business organization,</quote> after <quote>trust,</quote>; and</text></subparagraph> 
<subparagraph id="H95F034F6D45D4291B622067ACA4F8DA2"><enum>(B)</enum><text>by inserting <quote>, such as an export credit agency</quote> before the semicolon at the end;</text></subparagraph></paragraph> 
<paragraph id="H0B3FC55479814FEFB93DC79BD15C1431"><enum>(2)</enum><text>by redesignating paragraphs (15) and (16) as paragraphs (17) and (18), respectively; and</text></paragraph> 
<paragraph id="H81077A4E746647E885068A32C7902536"><enum>(3)</enum><text>by striking paragraph (14) and inserting the following:</text>

<subparagraph id="H428435E2BF03478B91C34BAE4E919CF5" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">having actual knowledge; or</text></subparagraph> 
<subparagraph id="H73F7D6D90DB147949C9CA9257173494D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">having the constructive knowledge deemed to be possessed by a reasonable individual who acts under similar circumstances.</text></subparagraph></paragraph> 
<paragraph id="HBB8FDDDA03064FE9B7B1874044DB424F"><enum>(15)</enum><header>Petroleum resources</header><text display-inline="yes-display-inline">The term <quote>petroleum resources</quote> includes petroleum, oil or liquefied natural gas, oil or liquefied natural gas tankers, and products used to construct or maintain pipelines used to transport oil or compressed or liquefied natural gas.</text></paragraph> 
<paragraph id="H1A3C728C043246C99A0BF7C8A056C8B1"><enum>(16)</enum><header>Refined petroleum products</header><text display-inline="yes-display-inline">The term <quote>refined petroleum products</quote> means gasoline, kerosene, diesel fuel, residual fuel oil, and distillates and other goods classified in headings 2709 and 2710 of the Harmonized Tariff Schedule of the United States.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5CC2009FC2B94E4486BA560C05BC6EC7" display-inline="no-display-inline"><enum>(g)</enum><header>Termination of certain provisions</header><text display-inline="yes-display-inline">Section 8 of the Iran Sanctions Act of 1996 is amended—</text> 
<paragraph id="H845A6A09FFEF41C5AB40418651231E15"><enum>(1)</enum><text>by striking <quote>The requirement under section 5(a)</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">Sanctions relating to investment.</header-in-text>—The requirement under section 5(a)(1)(A) </quote>;</text></paragraph> 
<paragraph id="H5FF28DF9F20F4B70B87F2A2A67826C54" commented="no"><enum>(2)</enum><text>by striking <quote>with respect to Iran</quote>; and </text></paragraph> 
<paragraph id="H36A2DE758A5D429D9846353C33F88BD9"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="HC257A7920EEE43649125546E4F1F6581"><enum>(b)</enum><header>Refined petroleum products</header><text display-inline="yes-display-inline">The requirements under paragraphs (1)(B) and (2) of section 5(a) and section 6(b) to impose sanctions shall no longer have force or effect if the President determines and certifies to the appropriate congressional committees that Iran—</text> 
<paragraph id="HF375BE14C914468881286A62C6EA31B7"><enum>(1)</enum><text>has ceased its efforts to design, develop, manufacture, or acquire a nuclear explosive device or related materials and technology; and </text></paragraph> 
<paragraph id="HA74365FA88D64F7D83AF956D855CF7F8"><enum>(2)</enum><text>has ceased nuclear-related activities, including uranium enrichment, that would facilitate the efforts described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H74C7CEBA02E6458AB06892D98633851B"><enum>(h)</enum><header>Extension of Act</header><text display-inline="yes-display-inline">Section 13(b) of the Iran Sanctions Act of 1996 is amended by striking <quote>2011</quote> and inserting <quote>2016</quote>.</text></subsection> 
<subsection id="H96EF928AD0764B1894BD38C2942DBD57"><enum>(i)</enum><header>Technical amendments</header> 
<paragraph id="HB5CE585513AA4722ABB89B9122BFF5ED"><enum>(1)</enum><header>Multilateral regime</header><text>Section 4 of such Act is amended—</text> 
<subparagraph id="H4EE1884905634D13BDA896E8EC3CA7DE"><enum>(A)</enum><text>in subsection (b)(2), by striking <quote>(in addition to that provided in subsection (d))</quote>; and</text></subparagraph>

<subparagraph id="H0D7F91D927414894B726C25F5EF5B8D4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Section 9(a) of such Act is amended by striking <quote>or 5(b)</quote> each place it appears and inserting <quote>or 5(b)(1)</quote>. </text></subparagraph></paragraph></subsection></section> 
<section id="H065751093A464692B3B380F02D172741" commented="no"><enum>4.</enum><header>Effective date; rule of construction</header> 
<subsection id="H0A153D5005874295817D3DC35F46F65F" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header>In general</header><text>The amendments made by this Act shall take effect upon the expiration of the 60-day period beginning on the date of the enactment of this Act, except that—</text> 
<paragraph id="HE8DD7293A9DD431A971AE89EC9451F59" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">paragraphs (1) and (2) of section 5(a), section 5(b)(2), and section 6(b), of the Iran Sanctions Act of 1996, as amended by this Act, shall apply to conduct engaged in on or after October 28, 2009, notwithstanding section 5(f)(3) of the Iran Sanctions Act of 1996; and</text></paragraph> 
<paragraph id="HDC61369DF02B48DE99C79AA079AF8497" commented="no"><enum>(2)</enum><text>the amendments made by subsection (d) of section 3 of this Act shall apply with respect to conduct engaged in before, on, or after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H72D7998D7C4A47AA91A64371C689E630" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Rule of construction</header> 
<paragraph id="H37D1C17DFC39485A8BAF2F7C45811B2A" commented="no"><enum>(1)</enum><header>Existing sanctions not affected</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) of section 3 of this Act shall not be construed to affect the requirements of section 5(a) of the Iran Sanctions Act of 1996 as in effect before the date of the enactment of this Act, and such requirements continue to apply, on and after such date of enactment, to conduct engaged in before October 28, 2009.</text></paragraph> 
<paragraph id="H8D6D2D03DAB34C00A193928A621BAF17" commented="no"><enum>(2)</enum><header>Waiver authority</header><text>The amendments made by subsection (d) of section 3 of this Act shall not be construed to affect any exercise of the authority under section 4(f) or section 9(c) of the Iran Sanctions Act of 1996 as in effect on the day before the date of the enactment of this Act.</text></paragraph></subsection></section>
