		<official-title display="yes">To authorize the Secretary of the Interior,
		  through the United States Fish and Wildlife Service, to conduct a Joint Venture
		  Program to protect, restore, enhance, and manage migratory bird populations,
		  their habitats, and the ecosystems they rely on, through voluntary actions on
		  public and private lands, and for other purposes.</official-title>

		<section id="H88F6F42199BD4B0AB427BAD233563850" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Joint Ventures for Bird Habitat
			 Conservation Act of 2009</short-title></quote>.</text>
		</section><section id="HBD95C2507EEA415FA3FE784DA808F7F7"><enum>2.</enum><header>Findings and
			 purpose</header>
			<subsection id="HDB52A8625CAD479B93EEEB98371C3873"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="HE0B858DDDE254B05B0F3FD09C421500"><enum>(1)</enum><text display-inline="yes-display-inline">migratory birds are of great ecological and
			 economic value to the Nation, contributing to biological diversity, advancing
			 the well-being of human communities through pollination, seed dispersal, and
			 other ecosystem services, and bringing tremendous enjoyment to the tens of
			 millions of Americans who study, watch, feed, or hunt these birds;</text>
				</paragraph><paragraph id="H31064EFA50A34476B0ECD444F03CF7D6"><enum>(2)</enum><text display-inline="yes-display-inline">sustainable populations of migratory birds
			 depend on the conservation, protection, restoration, and enhancement of
			 terrestrial, wetland, marine, and other aquatic habitats throughout their
			 ranges in the United States, as well as the rest of North America, the
			 Caribbean, and Central and South America;</text>
				</paragraph><paragraph id="H1B8072BBAC794264B4BEA456B3C051B"><enum>(3)</enum><text>birds are good
			 indicators of environmental health and provide early warning of the impacts of
			 environmental change, helping to yield the most out of every dollar invested in
			 conservation;</text>
				</paragraph><paragraph id="HD07B1D729C0E403AA0BC00E0B2A7359"><enum>(4)</enum><text>human and
			 environmental stressors are causing the decline of populations of many
			 migratory bird species, many of them once common, and climate change will
			 exacerbate the impacts of these stressors on migratory bird populations;</text>
				</paragraph><paragraph id="HE0C11773BF774C389D75A48872DCB87E"><enum>(5)</enum><text display-inline="yes-display-inline">the coordination of Federal, State, tribal,
			 and local government natural resource conservation efforts and the formation of
			 partnerships that include a diversity of nongovernmental conservation
			 organizations, private landowners, and other relevant stakeholders is necessary
			 to accomplish the conservation of migratory bird populations, their habitats,
			 and the ecosystem functions they rely on;</text>
				</paragraph><paragraph id="HD8621BCF652B4E168D1436A8D11886A4"><enum>(6)</enum><text display-inline="yes-display-inline">hunters, through their purchase of Federal
			 migratory bird hunting stamps and State hunting licenses, have long supported
			 the conservation of migratory birds and their habitats in the United States
			 through the various State and Federal programs that are supported by the fees
			 charged for such purchases;</text>
				</paragraph><paragraph id="HE358D815CE99446CB1A261AD3C4F3C40"><enum>(7)</enum><text>the Department of
			 the Interior, through the United States Fish and Wildlife Service, is
			 authorized under a number of broad statutes to undertake many activities with
			 partners to conserve natural resources, including migratory birds and their
			 habitat;</text>
				</paragraph><paragraph id="H636D2E6FF7044672A8A6E95E8857CD84"><enum>(8)</enum><text>through these
			 authorities, the Service has created and supported a number of joint ventures
			 with diverse partners to help protect, manage, enhance, and restore migratory
			 bird habitat throughout much of the United States and to conserve migratory
			 bird species;</text>
				</paragraph><paragraph id="HCEA71F1B188C47D582A4DFA0A51DFC1"><enum>(9)</enum><text>the North American
			 Waterfowl Management Plan, adopted by the United States and Canada in 1986,
			 with Mexico joining as a signatory in 1994, was the first truly landscape-level
			 approach to conserving migratory game birds and the wetland habitats on which
			 they depend, and became the foundation for the voluntary formation of Joint
			 Ventures;</text>
				</paragraph><paragraph id="HBF84626F8D4341A3AC38B469EE4255C"><enum>(10)</enum><text display-inline="yes-display-inline">since the adoption of the North American
			 Waterfowl Management Plan, joint ventures have expanded their application to
			 all native birds and other wildlife species that depend on wetlands and
			 associated upland habitats, resulting in significant conservation benefits over
			 the last 20 years;</text>
				</paragraph><paragraph id="H9C9C1CBBCFA149E2A290C00790B680EE"><enum>(11)</enum><text>States possess
			 broad trustee and management authority over fish and wildlife resources within
			 their borders, and have utilized their authorities to undertake conservation
			 programs to conserve resident and migratory birds and their habitats;</text>
				</paragraph><paragraph id="H19FC84EE0BD14ECDA97D6E1500810822"><enum>(12)</enum><text>consistent with
			 applicable Federal and State laws, the Federal Government and the States each
			 have management responsibilities affecting fish and wildlife resources, and
			 should work cooperatively in fulfilling these responsibilities;</text>
				</paragraph><paragraph id="H87B3E53D83A64500833E00FCB3FF086"><enum>(13)</enum><text>other domestic and
			 international conservation projects authorized under the Neotropical Migratory
			 Bird Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6101">16 U.S.C. 6101 et seq.</external-xref>) and the
			 North American Wetlands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4401">16 U.S.C. 4401 et seq.</external-xref>), and
			 additional bird conservation projects authorized under other Federal
			 authorities, can expand and increase the effectiveness of the joint ventures in
			 protecting and enhancing migratory bird habitats throughout the different
			 ranges of species native to the United States; and</text>
				</paragraph><paragraph id="H0FCD5385941242BDAA307EEA495CE6D4"><enum>(14)</enum><text>the voluntary
			 partnerships fostered by these joint ventures have served as innovative models
			 for cooperative and effective landscape conservation, with far-reaching
			 benefits to other fish and wildlife populations, and similar joint ventures
			 should be authorized specifically to reinforce the importance and multiple
			 benefits of these models to encourage adaptive resource management and the
			 implementation of flexible conservation strategies in the 21st century.</text>
				</paragraph></subsection><subsection id="HF3B34EEBD1D645A691C9AB25BBD75516"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to establish a
			 program administered by the Director, in coordination with other Federal
			 agencies with management authority over fish and wildlife resources and the
			 States, to develop, implement, and support innovative, voluntary, cooperative,
			 and effective conservation strategies and conservation actions to—</text>
				<paragraph id="H85DCAA1D3558434386A8B43523534EF"><enum>(1)</enum><text>promote, primarily,
			 sustainable populations of migratory birds, and, secondarily, the fish and
			 wildlife species associated with their habitats;</text>
				</paragraph><paragraph id="H94602318460540B7BD1BC004F65ABC6"><enum>(2)</enum><text>encourage
			 stakeholder and government partnerships consistent with the goals of
			 protecting, improving, and restoring habitat;</text>
				</paragraph><paragraph id="HD55DFB535BA942A08B65ADA1CE77BA"><enum>(3)</enum><text>establish,
			 implement, and improve science-based migratory bird conservation plans and
			 promote and facilitate broader landscape-level conservation of fish and
			 wildlife habitat; and</text>
				</paragraph><paragraph id="H5E8C964445AF4A0DB6DED8C9A4608CAE"><enum>(4)</enum><text>coordinate related
			 conservation activities of the Service and other Federal agencies to maximize
			 the efficient and effective use of funds appropriated or otherwise made
			 available to support projects and activities to enhance bird populations and
			 other populations of fish and wildlife and their habitats.</text>
				</paragraph></subsection></section><section id="HDB07B9D95B314E068289F6C7F554B259"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H48E37871DBAE4248B888F5CCEBEF37E6"><enum>(1)</enum><header>Conservation
			 action</header><text>The term <quote>conservation action</quote> means
			 activities that—</text>
				<subparagraph id="H78BF4359696A45A1865857EC74542DBD"><enum>(A)</enum><text display-inline="yes-display-inline">support the protection, restoration,
			 adaptive management, conservation, or enhancement of migratory bird
			 populations, their terrestrial, wetland, marine, or other habitats, and other
			 wildlife species supported by those habitats, including—</text>
					<clause id="H8F96563EEB1F4C24B17F00E4CEC5D47B"><enum>(i)</enum><text>biological and
			 geospatial planning;</text>
					</clause><clause id="H537DAEDF9F4248059DD1E303B2168700"><enum>(ii)</enum><text>landscape and
			 conservation design;</text>
					</clause><clause id="HCDA0F7774D1E4C81A3314FC1EC13BFC3"><enum>(iii)</enum><text>habitat
			 protection, enhancement, and restoration;</text>
					</clause><clause id="H46E21C08840B436F83B1EBC6E314E81"><enum>(iv)</enum><text>monitoring and
			 tracking;</text>
					</clause><clause id="H3B7B9974DFCF49218CD45F53A43B87B7"><enum>(v)</enum><text>applied research;
			 and</text>
					</clause><clause id="H33BA2192AC6242AB854DDDC537C21527"><enum>(vi)</enum><text>public outreach
			 and education;</text>
					</clause></subparagraph><subparagraph id="HBE67EB40023643C280FE00F28D060459"><enum>(B)</enum><text>are conducted on
			 lands or waters that—</text>
					<clause id="H7CA248B2994E4DDDB7ECEAB267AA03BD"><enum>(i)</enum><text>are
			 administered for the long-term conservation of such lands or waters and the
			 migratory birds thereon, including the marine environment; or</text>
					</clause><clause id="HD58BC13756854A6CA704CDB0379131AE"><enum>(ii)</enum><text>are
			 not primarily held or managed for conservation but provide habitat value for
			 migratory birds; and</text>
					</clause></subparagraph><subparagraph id="H93CEB9B28BAE45A993BF2B2E7C1F83CC"><enum>(C)</enum><text>incorporate
			 adaptive management and science-based monitoring, where applicable, to improve
			 outcomes and ensure efficient and effective use of Federal funds.</text>
				</subparagraph></paragraph><paragraph id="H6BBC45429BC64EBB9B903D00F97ED7C5"><enum>(2)</enum><header>Director</header><text>The
			 term <quote>Director</quote> means the Director of the United States Fish and
			 Wildlife Service.</text>
			</paragraph><paragraph id="HEFBEE65406044F75919C898DEA61354C"><enum>(3)</enum><header>Implementation
			 Plan</header><text>The term <quote>Implementation Plan</quote> means an
			 Implementation Plan approved by the Director under section 5.</text>
			</paragraph><paragraph id="H538E9321DC1A4E6D9078C05574381E3F"><enum>(4)</enum><header>Indian
			 tribe</header><text>The term <quote>Indian tribe</quote> has the meaning given
			 that term in section 4 of the Indian Self-Determination and Education
			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25
			 U.S.C. 450b</external-xref>).</text>
			</paragraph><paragraph id="H0C895EB2FEEE4C988236EC2C66B2B847"><enum>(5)</enum><header>Joint
			 venture</header><text>The term <quote>Joint Venture</quote> means a
			 self-directed, voluntary partnership, established and conducted in accordance
			 with section 5.</text>
			</paragraph><paragraph id="H6144D1FA516F462A9CB815116EEF89C5"><enum>(6)</enum><header>Management
			 board</header><text>The term <quote>Management Board</quote> means a Joint
			 Venture Management Board established in accordance with section 5.</text>
			</paragraph><paragraph id="H85FCEE3B49C64DD9A1000055B89D195C"><enum>(7)</enum><header>Migratory
			 birds</header><text>The term <quote>migratory birds</quote> means those species
			 included in the list of migratory birds that appears in
			 <external-xref legal-doc="regulation" parsable-cite="cfr/50/10.13">section
			 10.13</external-xref> of title 50, Code of Federal Regulations, under the
			 authority of the Migratory Bird Treaty Act.</text>
			</paragraph><paragraph id="H729D9135349A48D9A4E0F1272C7400F1"><enum>(8)</enum><header>Program</header><text>The
			 term <quote>Program</quote> means the Joint Ventures Program conducted in
			 accordance with this Act.</text>
			</paragraph><paragraph id="HF67E1830918D479FAFD347606B7DE6AC"><enum>(9)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H9F8926BF4CA7435F86DEA1CFDBC4BC00"><enum>(10)</enum><header>Service</header><text>The
			 term <quote>Service</quote> means the United States Fish and Wildlife
			 Service.</text>
			</paragraph><paragraph id="H4334C6E32A4A4247B89B5739E9CD34AE"><enum>(11)</enum><header>State</header><text>The
			 term <quote>State</quote> means—</text>
				<subparagraph id="H83435123BC004F80BABA97582CB25E44"><enum>(A)</enum><text>any State of the
			 United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam,
			 the Virgin Islands, American Samoa, and the Commonwealth of the Northern
			 Mariana Islands; and</text>
				</subparagraph><subparagraph id="H3BE7B1B64EDA42A6BD631575EE1F3764"><enum>(B)</enum><text>one or more
			 agencies of a State government responsible under State law for managing fish or
			 wildlife resources.</text>
				</subparagraph></paragraph></section><section id="H56AC2A85CA604376948E4745FC22F71"><enum>4.</enum><header>Joint Ventures
			 Program</header>
			<subsection id="H9269325A4AAE46D0B6865B006B863614"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall conduct, through the United States
			 Fish and Wildlife Service, a Joint Ventures Program administered by the
			 Director. The Director, through the Program, shall develop an administrative
			 framework for the approval and establishment and implementation of Joint
			 Ventures, that—</text>
				<paragraph id="HC51BAD6B84D447C900C59DFA8BDFA700"><enum>(1)</enum><text>provides financial
			 and technical assistance to support regional migratory bird conservation
			 partnerships;</text>
				</paragraph><paragraph id="HDE4904A6B3E449E2B0D48C8E7DF4FD91"><enum>(2)</enum><text>develops and
			 implements plans to protect and enhance migratory bird populations throughout
			 their range, that are focused on regional landscapes and habitats that support
			 those populations;</text>
				</paragraph><paragraph id="H5E48CC34CE704D838DEDC9F0FD858F7D"><enum>(3)</enum><text>complements and
			 supports activities by the Secretary and the Director to fulfill obligations
			 under—</text>
					<subparagraph id="HB606377049FD4EDE86A6EDF071ED15A9"><enum>(A)</enum><text>the Migratory Bird
			 Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/701">16 U.S.C.
			 701 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="HB330AFE8E01C4E5B9564D4A4109756F5"><enum>(B)</enum><text>the Migratory Bird
			 Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/715">16
			 U.S.C. 715 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="H61EFE61C40E64E569D794905E304C5C"><enum>(C)</enum><text display-inline="yes-display-inline">the Neotropical Migratory Bird Conservation
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6101">16 U.S.C. 6101
			 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="H7AC6F1C55A3F4A7EBCD377C5B1D95CC"><enum>(D)</enum><text>the North American
			 Wetlands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4401">16 U.S.C. 4401 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="HBA2CF297882B41B880991894B05336A1"><enum>(E)</enum><text>the Fish and
			 Wildlife Conservation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/16/2901">16 U.S.C. 2901 et
			 seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="H9A0439DD127D425B8573710891FA179B"><enum>(F)</enum><text display-inline="yes-display-inline">the Partners for Fish and Wildlife Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/3771">16 U.S.C. 3771 et
			 seq.</external-xref>); and</text>
					</subparagraph></paragraph><paragraph id="HD846B046C806496CBAED68204DF692D6"><enum>(4)</enum><text>support the goals
			 and objectives of—</text>
					<subparagraph id="HAC70F55F120946B698F5605800843EB1"><enum>(A)</enum><text>the North American
			 Waterfowl Management Plan;</text>
					</subparagraph><subparagraph id="H921C5C0D7FD64FC89700017DCB00D479"><enum>(B)</enum><text>the United States
			 Shorebird Conservation Plan;</text>
					</subparagraph><subparagraph id="H231F9BFFFA634153A0157F4DD4E7EE04"><enum>(C)</enum><text>the North American
			 Waterbird Conservation Plan;</text>
					</subparagraph><subparagraph id="H66118D848A84475EA4F9B2D385D8AD06"><enum>(D)</enum><text>the Partners in
			 Flight North American Landbird Conservation Plan; and</text>
					</subparagraph><subparagraph id="H2BB5F06790294DCCB9E7A51400925DFE"><enum>(E)</enum><text display-inline="yes-display-inline">other treaties, conventions, agreements, or
			 strategies entered into by the United States and implemented by the Secretary
			 that promote the conservation of migratory bird populations and their
			 habitats.</text>
					</subparagraph></paragraph></subsection><subsection id="HEF0CE32F55784498BAEA418B5DE38CBB"><enum>(b)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Within 180 days after the date of enactment
			 of this Act the Secretary, through the Director, shall publish in the Federal
			 Register guidelines for the implementation of this Act, including regarding
			 requirements for approval of proposed Joint Ventures and administration,
			 oversight, coordination among, and evaluation of approved Joint
			 Ventures.</text>
			</subsection><subsection id="H264D8DED5F204236AFF245E17FEFA6B8"><enum>(c)</enum><header>Coordination
			 with states</header><text>In the administration of the program authorized under
			 this section, the Director shall coordinate and cooperate with the States to
			 fulfill the purposes of this Act.</text>
			</subsection></section><section id="H0076C23A1CC04C9CB6E6E7DECFABCF49"><enum>5.</enum><header>Joint Venture
			 establishment and administration</header>
			<subsection id="H238E3B98A7B44905008580D271EFFF04"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="HD1128A387C8D4E21BA4BD6FB43700B9"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director, through
			 the Program, may enter into an agreement with eligible partners described in
			 paragraph (2) to establish a Joint Venture to fulfill one or more of the
			 purposes set forth in paragraphs (1) through (3) of section 2(b).</text>
				</paragraph><paragraph id="HC0F33723167D45BE8D9B2016D2317732"><enum>(2)</enum><header>Eligible
			 partners</header><text>The eligible partners referred to in paragraph (1) are
			 the following:</text>
					<subparagraph id="H52EFA6552B4846A18F78DD42F4A3EBDC"><enum>(A)</enum><text display-inline="yes-display-inline">Federal and State agencies with
			 jurisdiction over migratory bird resources, their habitats, or that implement
			 program activities that affect migratory bird habitats or the ecosystems they
			 rely on.</text>
					</subparagraph><subparagraph id="H69591A286C304E08915F3CD0C2003848"><enum>(B)</enum><text display-inline="yes-display-inline">Affected regional, local, and tribal
			 governments, private landowners, land managers, and other private
			 stakeholders.</text>
					</subparagraph><subparagraph id="H037BB17D0BA84150AA68CBFC98666BF0"><enum>(C)</enum><text>Nongovernmental
			 organizations with expertise in bird conservation or fish and wildlife
			 conservation or natural resource and landscape management generally.</text>
					</subparagraph><subparagraph id="HC58FAE28A09447E68B9B00BAB158C6D"><enum>(D)</enum><text>Other relevant
			 stakeholders.</text>
					</subparagraph></paragraph></subsection><subsection id="H796BDD6EA4E64F3E992549B3CAD2B543"><enum>(b)</enum><header>Management
			 board</header>
				<paragraph id="H1F1AF2FEB36E45AB836953348CD7155D"><enum>(1)</enum><header>In
			 general</header><text>An agreement under this section for a Joint Venture shall
			 establish a Management Board in accordance with this subsection.</text>
				</paragraph><paragraph id="HB4138AFB2C7C4ADAAFCAD002814DB9B"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The Management Board shall include a
			 diversity of members representing stakeholder interests from the appropriate
			 geographic region, including, as appropriate, representatives from the Service
			 and other Federal agencies that have management authority over fish and
			 wildlife resources on public lands or in the marine environment, or that
			 implement programs that affect migratory bird habitats, and representatives
			 from the States, and may include—</text>
					<subparagraph id="H5A96D1D3F6AC472CADFB18082EE49711"><enum>(A)</enum><text>regional
			 governments and Indian tribes;</text>
					</subparagraph><subparagraph id="HA20006FFE1554A0F96B251AC99645C11"><enum>(B)</enum><text>academia or the
			 scientific community;</text>
					</subparagraph><subparagraph id="H91EF1CB460C94E9EB7CDA37E65AB5DD"><enum>(C)</enum><text>nongovernmental
			 landowners or land managers;</text>
					</subparagraph><subparagraph id="HFF311DFA39EA4321A064F63FA5008277"><enum>(D)</enum><text>nonprofit
			 conservation or other relevant organizations with expertise in migratory bird
			 conservation, or in fish and wildlife conservation generally; and</text>
					</subparagraph><subparagraph id="H37AFCFC370B648F1B99B91001F82B949"><enum>(E)</enum><text display-inline="yes-display-inline">private organizations with a dedicated
			 interest in conserving migratory birds and their habitats.</text>
					</subparagraph></paragraph><paragraph id="H9CFF48A9356242B19742DAF060631246"><enum>(3)</enum><header>Functions and
			 Responsibilities</header>
					<subparagraph id="H811DAF19289E4F398367913262A4E900"><enum>(A)</enum><header>Organization and
			 operations plan</header><text display-inline="yes-display-inline">A Management
			 Board, in accordance with the guidelines published by the Director under
			 section 4 and in coordination with the Director, shall develop, publish, and
			 comply with a plan that specifies the organizational structure of the Joint
			 Venture and prescribes its operational practices and procedures.</text>
					</subparagraph><subparagraph id="HA87353DB1D624A7CA5F386FA894845D8"><enum>(B)</enum><header>Administration</header><text>Subject
			 to applicable Federal and State law, the Management Board shall manage the
			 personnel and operations of the Joint Venture, including—</text>
						<clause id="H2C10904064DF459385366EE6272C72E6"><enum>(i)</enum><text display-inline="yes-display-inline">by appointing a coordinator for the Joint
			 Venture in consultation with the Director, to manage the daily and long-term
			 operations of the Joint Venture;</text>
						</clause><clause id="HB1958B63AE7A41DE82F400EA53EE9B9F"><enum>(ii)</enum><text>approval of other
			 full- or part-time administrative and technical non-Federal employees as the
			 Management Board determines necessary to perform the functions of the Joint
			 Venture, meet objectives specified in the Implementation Plan, and fulfill the
			 purpose of this Act; and</text>
						</clause><clause id="H7F40D90E40254C8EA34F7D31A543F356"><enum>(iii)</enum><text>establishment of
			 committees, steering groups, focus groups, geographic or taxonomic groups, or
			 other organizational entities to assist in implementing the relevant
			 Implementation Plan.</text>
						</clause></subparagraph></paragraph><paragraph id="H48932BF36FCA4F1291DB5D154ED3D265"><enum>(4)</enum><header>Use of Service
			 and Federal agency employees</header><text>Subject to the availability of
			 appropriations and upon the request from a Management Board, and after
			 consultation with and approval of the Director, the head of any Federal agency
			 may detail to the Management Board, on a reimbursable or nonreimbursable basis,
			 any agency personnel to assist the Joint Venture in performing its functions
			 under this Act.</text>
				</paragraph></subsection><subsection id="H99FDE515EB7E412B91653B7D311599FD"><enum>(c)</enum><header>Implementation
			 plan</header>
				<paragraph id="HFF9999CEE2FD4929A507FC835751D21"><enum>(1)</enum><header>Submission of
			 plan to Director</header><text display-inline="yes-display-inline">Before the
			 Director enters into an agreement to establish a Joint Venture under subsection
			 (a), the Management Board for the Joint Venture shall submit to the Director a
			 proposed Implementation Plan that shall contain, at a minimum, the following
			 elements:</text>
					<subparagraph id="H42EB0335ECBE4FC2B7F1FCA9BEA008A2"><enum>(A)</enum><text>A strategic
			 framework for migratory bird conservation that includes biological planning;
			 conservation design; habitat restoration, protection, and enhancement; applied
			 research; and monitoring and evaluation activities.</text>
					</subparagraph><subparagraph id="HCA94319FDCD04545BEF4D64E6C89CCA5"><enum>(B)</enum><text>Provisions for
			 effective communication among member participants within the Joint
			 Venture.</text>
					</subparagraph><subparagraph id="HEB4401A6880A422889D5C65FE3199A3"><enum>(C)</enum><text>A long-term
			 strategy to conduct public outreach and education regarding the purposes and
			 activities of the Joint Venture and activities to regularly communicate to the
			 general public information generated by the Joint Venture.</text>
					</subparagraph><subparagraph id="HAA5EE9DFA16445E4B436B7AB5C6EFD91"><enum>(D)</enum><text display-inline="yes-display-inline">Coordination with laws and conservation
			 plans referred to in section 4(a)(3) and (4) that are relevant to migratory
			 birds, and other relevant regional, national, or international initiatives
			 identified by the Director to conserve migratory birds, their habitats,
			 ecological functions, and associated populations of fish and wildlife.</text>
					</subparagraph><subparagraph id="H8DBF4BD02BE64F2C95E1B413FAD08BD1"><enum>(E)</enum><text display-inline="yes-display-inline">An organizational plan that—</text>
						<clause id="HE73FDA78D1DB481C8DA3B59532EA3390"><enum>(i)</enum><text>identifies the
			 initial membership of the Management Board and establishes procedures for
			 updating the membership of the Management Board as appropriate;</text>
						</clause><clause id="HF362DAFB82C94D859DDA3FE58CE701A5"><enum>(ii)</enum><text>describes the
			 organizational structure of the Joint Venture, including proposed committees
			 and subcommittees, and procedures for revising and updating the structure, as
			 necessary; and</text>
						</clause><clause id="H66968A83156548BABCDB8D2C2D75709C"><enum>(iii)</enum><text>provides a
			 strategy to increase stakeholder participation or membership in the Joint
			 Venture.</text>
						</clause></subparagraph><subparagraph id="H449AC912D656456DAE37C062B71D629"><enum>(F)</enum><text>Procedures to
			 coordinate the development, implementation, oversight, monitoring, tracking,
			 and reporting of conservation actions approved by the Management Board and an
			 evaluation process to determine overall effectiveness of activities undertaken
			 by the Joint Venture.</text>
					</subparagraph><subparagraph id="H8D775643C0914B78AAA5E53071E65E44"><enum>(G)</enum><text>A strategy to
			 encourage the contribution of non-Federal financial resources, donations, gifts
			 and in-kind contributions to support the objectives of the Joint Venture and
			 fulfillment of the Implementation Plan.</text>
					</subparagraph></paragraph><paragraph id="HA3FAE5575AA942DDB1BD4398024BBDD1"><enum>(2)</enum><header>Review</header><text display-inline="yes-display-inline">The Director shall—</text>
					<subparagraph id="H402932B8B1F340D6B5FA3DE040A0FE0"><enum>(A)</enum><text>coordinate the
			 review of a proposed Implementation Plan submitted under this section;
			 and</text>
					</subparagraph><subparagraph id="H967EB8CA22EC468BB37042634B1FF4A6"><enum>(B)</enum><text>ensure that such
			 plan is circulated for review for a period not to exceed 90 days, to—</text>
						<clause id="HAED469657CD942589D45CFA69E172700"><enum>(i)</enum><text>bureaus within the
			 Service and other appropriate bureaus or agencies within the Department of the
			 Interior;</text>
						</clause><clause id="HC8DAC3FF488D445897E3009DF3FAEE02"><enum>(ii)</enum><text>appropriate
			 regional migratory bird Flyway Councils;</text>
						</clause><clause id="H0EC0081F46C24DB9940002E44DD7001C"><enum>(iii)</enum><text>national and
			 international boards that oversee bird conservation initiatives under the plans
			 specified in section 4(a)(4);</text>
						</clause><clause id="H15B822DA52B6450800A958D8D008EF4"><enum>(iv)</enum><text>relevant State
			 agencies, regional governmental entities, and Indian tribes;</text>
						</clause><clause id="HBC2F8A6AB52E467AB2D17557A06D14D2"><enum>(v)</enum><text>nongovernmental
			 conservation organizations, academic institutions, or other stakeholders
			 engaged in existing Joint Ventures that have knowledge or expertise of the
			 geographic or ecological scope of the Joint Venture; and</text>
						</clause><clause id="H797707D6D16C4756B569AE005E2611AF"><enum>(vi)</enum><text>other relevant
			 stakeholders considered necessary by the Director to ensure a comprehensive
			 review of the proposed Implementation Plan.</text>
						</clause></subparagraph></paragraph><paragraph id="HD0E4B9171A954AFC963CDEF710006FAC"><enum>(3)</enum><header>Approval</header><text>The
			 Director shall approve an Implementation Plan submitted by the Management Board
			 for a Joint Venture if the Director finds that—</text>
					<subparagraph id="HB84F7C6BE8B5421B841B00874B04EACB"><enum>(A)</enum><text display-inline="yes-display-inline">the plan provides for implementation of
			 conservation actions to conserve waterfowl and other native migratory birds and
			 their habitats and ecosystems either—</text>
						<clause id="HF1057B744D1A4677A7D7EE83110326C0"><enum>(i)</enum><text>in a
			 specific geographic area of the United States; or</text>
						</clause><clause id="H113896502A3540AAA154B15C8F31B58B"><enum>(ii)</enum><text>across the range
			 of a specific species or similar group of like species;</text>
						</clause></subparagraph><subparagraph id="HC8980D852E894625ABD4313C33567BDA"><enum>(B)</enum><text>the members of the
			 Joint Venture—</text>
						<clause id="H603A9D96CFE34421AD357D07792E0048"><enum>(i)</enum><text>accept the
			 responsibility for implementation of national or international bird
			 conservation plans in the region of the United States to which the plan
			 applies; and</text>
						</clause><clause id="HEFF5BB6B879C45D68FE55B3F00C07CA6"><enum>(ii)</enum><text>have demonstrated
			 to the satisfaction of the Director the capacity to implement conservation
			 actions identified in the plan, including (I) the design, funding, monitoring,
			 and tracking of conservation projects that advance the objectives of the Joint
			 Venture; and (II) reporting and conduct of public outreach regarding such
			 projects; and</text>
						</clause></subparagraph><subparagraph id="HC17CED85078343F3AAC5FB4C6FB23565"><enum>(C)</enum><text display-inline="yes-display-inline">the plan maximizes, to the extent
			 practicable, coordination with other relevant and active conservation plans or
			 programs within the geographic scope of the Joint Venture to conserve, protect,
			 recover, or restore migratory bird habitats and other fish and wildlife habitat
			 within the operating region of the Joint Venture.</text>
					</subparagraph></paragraph></subsection></section><section id="H7FA380600B8E4ABFB4114D552100A67"><enum>6.</enum><header>Grants and other
			 assistance</header>
			<subsection id="HF74482F145F94609AEA577E76DC0219"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), and subject to the
			 availability of appropriations, the Director may award grants of financial
			 assistance to implement a Joint Venture through—</text>
				<paragraph id="H27CEAC8529224142B2F1C4100B7B14F"><enum>(1)</enum><text>support of the
			 activities of the Management Board of the Joint Venture and to pay for
			 necessary administrative costs and services, personnel, and meetings, travel,
			 and other business activities; and</text>
				</paragraph><paragraph id="HB640F903F7B74BCE993B5D92C2B5102B"><enum>(2)</enum><text>support for
			 specific conservation actions and other activities necessary to carry out the
			 Implementation Plan.</text>
				</paragraph></subsection><subsection id="HD85E539A6443431881961DF0259D77B0"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">A Joint Venture is not eligible for
			 assistance or support authorized in this section unless the Joint Venture is
			 operating under an Implementation Plan approved by the Director under section
			 5.</text>
			</subsection><subsection id="H6A1EC67D7F6B48368E7D343B70F87900"><enum>(c)</enum><header>Conservation
			 action grant criteria</header><text display-inline="yes-display-inline">The
			 Secretary, through the Director, within 180 days after date of enactment of
			 this Act and after consultation with representatives from Management Boards and
			 equivalent entities of joint ventures referred to in section 8, shall publish
			 guidelines for determining funding allocations among joint ventures and
			 priorities for funding among conservation action proposals to meet the purpose
			 of this Act and respective Implementation Plans.</text>
			</subsection><subsection id="H681AD828972143D9AEA0292FE5260398"><enum>(d)</enum><header>Matching
			 requirements</header><text>If a Management Board determines that two or more
			 proposed conservation actions are of equal value toward fulfillment of the
			 relevant Implementation Plan, priority shall be given to the action or actions
			 for which there exist non-Federal matching contributions that are equal to or
			 exceed the amount of Federal funds available for such action or actions.</text>
			</subsection><subsection id="H3490020B53434C22A1DF4BB6F4811B9B"><enum>(e)</enum><header>Technical
			 assistance</header><text>The Secretary, through the Director, may provide
			 technical and administrative assistance for implementation of Joint Ventures
			 and the expenditure of financial assistance under this subsection.</text>
			</subsection><subsection id="HC37B83D77A2F4FE393AB48FB3B36B094"><enum>(f)</enum><header>Acceptance and
			 use of donations</header><text>The Secretary, through the Director, may accept
			 and use donations of funds, gifts, and in-kind contributions to provide
			 assistance under this section.</text>
			</subsection></section><section id="HCFFD07C2B8944850BF46AD67AA0052C9"><enum>7.</enum><header>Reporting
			 requirements</header>
			<subsection id="H6E77C74ADF48447CA25B1573CA342254"><enum>(a)</enum><header>Annual reports
			 by management boards</header>
				<paragraph id="HCC0FA52F62F342869DA02EF8D6006251"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary, acting
			 through the Director, shall—</text>
					<subparagraph id="H57D315CA5A734690A96E1C7F4946626E"><enum>(A)</enum><text>require each
			 Management Board to submit annual reports for all approved Joint Ventures of
			 the Management Board; and</text>
					</subparagraph><subparagraph id="H25E4B73BE38C44C500E5927F9B17F076"><enum>(B)</enum><text>publish within 180
			 days after the date of enactment of this Act guidelines to implement this
			 subsection.</text>
					</subparagraph></paragraph><paragraph id="H5DA4AD3C66A0494CBB223E1240BEE246"><enum>(2)</enum><header>Contents</header><text>Each
			 annual report shall include—</text>
					<subparagraph id="H2967E01962F64E0497523208E3EBA792"><enum>(A)</enum><text display-inline="yes-display-inline">a description and justification of all
			 conservation actions approved and implemented by the Management Board during
			 the period covered by the report;</text>
					</subparagraph><subparagraph id="H257693B4603F480A9DBCE0235832C830"><enum>(B)</enum><text display-inline="yes-display-inline">when appropriate based upon the goals and
			 objectives of an Implementation Plan, an estimate of the total number of acres
			 of migratory bird habitat either restored, protected, or enhanced as a result
			 of such conservation actions;</text>
					</subparagraph><subparagraph id="HFC1362759A7347E79235610630AA4680"><enum>(C)</enum><text>the amounts and
			 sources of Federal and non-Federal funding for such conservation
			 actions;</text>
					</subparagraph><subparagraph id="H166DCB0917234D7482438FDA721E8198"><enum>(D)</enum><text>the amounts and
			 sources of funds expended for administrative and other expenses of the Joint
			 Venture of the Management Board, including all donations, gifts, and in-kind
			 contributions provided for the Joint Venture;</text>
					</subparagraph><subparagraph id="H4E772940E023432F9B8486AD4271FBE0"><enum>(E)</enum><text>the status of
			 progress made in achieving the strategic framework of the Implementation Plan
			 of such Joint Venture and fulfillment of the purpose of this Act; and</text>
					</subparagraph><subparagraph id="HC5D5A14A1E834C13B17E422D25DF755E"><enum>(F)</enum><text>other elements
			 considered necessary by the Director to insure transparency and accountability
			 by Management Boards in the implementation of its responsibilities under this
			 Act.</text>
					</subparagraph></paragraph></subsection><subsection id="HFB71D4C26A63457B008D828C07F6882F"><enum>(b)</enum><header>Joint Venture
			 Program <enum-in-header>5</enum-in-header>-Year reviews</header>
				<paragraph id="H46ADAB34C31848A1949837CF408BD820"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, acting through the Director, shall at 5
			 years after the date of enactment of this Act and at 5-year intervals
			 thereafter, complete an objective and comprehensive review and evaluation of
			 the Program.</text>
				</paragraph><paragraph id="HF9DFD9DF1E174653B5093167005E1E4C"><enum>(2)</enum><header>Review
			 contents</header><text>Each review under this subsection shall include—</text>
					<subparagraph id="HE443D092AEF84EB3866910032C591D13"><enum>(A)</enum><text>an evaluation of
			 the effectiveness of the Program in meeting the purpose of this Act specified
			 in section 2(b);</text>
					</subparagraph><subparagraph id="HEBBE038120F34C3D006007015D7C70BA"><enum>(B)</enum><text>an evaluation of
			 all approved Implementation Plans, especially the effectiveness of existing
			 conservation strategies, priorities, and methods to meet the objectives of such
			 plans and fulfill the purpose of this Act; and</text>
					</subparagraph><subparagraph id="HC45B949C64EF4861A6D712C5C0F35978"><enum>(C)</enum><text>recommendations to
			 revise the Program or to amend or otherwise revise Implementation Plans to
			 ensure that activities undertaken pursuant to this Act address the effects of
			 climate change on migratory bird populations and their habitats, and fish and
			 wildlife habitats, in general.</text>
					</subparagraph></paragraph><paragraph id="H356A911274774352BBF4B7AD03E33974"><enum>(3)</enum><header>Consultation</header><text>The
			 Secretary, acting through the Director, in the implementation of this
			 subsection—</text>
					<subparagraph id="HAA1E1151C0684D9AABE3D11212D06ED5"><enum>(A)</enum><text>shall consult with
			 other appropriate Federal agencies with responsibility for the conservation or
			 management of fish and wildlife habitat and appropriate State agencies;
			 and</text>
					</subparagraph><subparagraph id="H6B70689242B6451C9C995F26231B75E7"><enum>(B)</enum><text display-inline="yes-display-inline">may consult with appropriate, Indian
			 tribes, Flyway Councils, or regional conservation organizations, public and
			 private landowners, members of academia and the scientific community, and other
			 nonprofit conservation or private stakeholders.</text>
					</subparagraph></paragraph><paragraph id="HA32582E0C7164E4C8F9CD7F7A231EBED"><enum>(4)</enum><header>Public
			 comment</header><text>The Secretary, through the Director, shall provide for
			 adequate opportunities for general public review and comment of the Program as
			 part of the 5-year evaluations conducted pursuant to this subsection.</text>
				</paragraph></subsection></section><section id="HE639F618468F49BFB0E0BF584BE75EB"><enum>8.</enum><header>Treatment of
			 existing joint ventures</header><text display-inline="no-display-inline">For
			 purposes of this Act, the Director—</text>
			<paragraph id="H8E4EE2F6A5CB40E5B3D2F33C038C97E1"><enum>(1)</enum><text>shall treat as a
			 Joint Venture any joint venture recognized by the Director before the date of
			 the enactment of this Act in accordance with the United States Fish and
			 Wildlife Services manual (721FW6); and</text>
			</paragraph><paragraph id="H27C9B79A35EC4EF4A70091276228BD2C"><enum>(2)</enum><text>shall treat as an
			 Implementation Plan an implementation plan adopted by the management board for
			 such joint venture.</text>
			</paragraph></section><section id="HDBB36DB54DC94831B9485C5E80DA5C13"><enum>9.</enum><header>Relationship to
			 other authorities</header>
			<subsection id="H5496D4D22C8344CCBC5E96C5E705979F"><enum>(a)</enum><header>Authorities,
			 etc. of Secretary</header><text>Nothing in this Act affects authorities,
			 responsibilities, obligations, or powers of the Secretary under any other
			 Act.</text>
			</subsection><subsection id="H13BAE862528C47128332B3F7C5397FD7"><enum>(b)</enum><header>State
			 Authority</header><text>Nothing in this Act preempts any provision or
			 enforcement of a State statute or regulation relating to the management of fish
			 and wildlife resources within such State.</text>
			</subsection></section><section id="H47DE356E47214888ABD07F5730912609"><enum>10.</enum><header>Federal Advisory
			 Committee Act</header><text display-inline="no-display-inline">The Federal
			 Advisory Committee Act (5 U.S.C. App.) shall not apply to any boards,
			 committees, or other groups established under this Act.</text>
