2.In this Act:
(1)The term Bureau-funded school has the meaning given to such term in section 1141 of the Education Amendments of 1978 (25 U.S.C. 2021).
(2)The term charter school has the meaning given such term in section 5210 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7221).
(3)The term CHPS Criteria
means the green building rating program developed by the Collaborative for High Performance Schools.
(4)The term Energy Star
means the Energy Star program of the United States Department of Energy and the United States Environmental Protection Agency.
(5)The term Green Globes
means the Green Building Initiative environmental design and rating system referred to as Green Globes.
(6)The term LEED Green Building Rating System
means the United States Green Building Council Leadership in Energy and Environmental Design green building rating standard referred to as LEED Green Building Rating System.
(7)The term local educational agency—
(A)has the meaning given to that term in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801), and shall also include the Recovery School District of Louisiana and the New Orleans Public Schools; and
(B)includes any public charter school that constitutes a local educational agency under State law.
(8)The term outlying area—
(A)means the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands; and
(B)includes the freely associated states of the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.
(9)The term public school facilities
means an existing public school facility, including a public charter school facility, or another existing facility planned for adaptive reuse as such a school facility.
(10)The term State means each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico.
<enum>I</enum><header>Grants for modernization, renovation, or repair of public school facilities</header>
<section id="HE50D8A98E4E34CA9A7C82BA5722DCDA7"><enum>101.</enum><header>Purpose</header><text display-inline="no-display-inline">Grants under this title shall be for the purpose of modernizing, renovating, or repairing public school facilities, based on their need for such improvements, to be safe, healthy, high-performing, and up-to-date technologically.</text></section>
<section id="HEADF66F4E6484D89A2CF52506920C4F3"><enum>102.</enum><header>Allocation of funds</header>
<subsection id="HE42CC37CFCF645DABADDC1056824D1CA"><enum>(a)</enum><header>Reservation</header>
<paragraph id="HF3E2BF4F1FCC48699B90EB78F111A666"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From the amount appropriated to carry out this title for each fiscal year pursuant to section 311(a), the Secretary shall reserve 1 percent of such amount, consistent with the purpose described in section 101—</text>
<subparagraph id="H9CB0B52FB6FE4D97BBBAB77C84C8543E"><enum>(A)</enum><text>to provide assistance to the outlying areas; and</text></subparagraph>
<subparagraph id="H34BD8F8A3C5848859A4875DC2DC72E69"><enum>(B)</enum><text display-inline="yes-display-inline">for payments to the Secretary of the Interior to provide assistance to Bureau-funded schools.</text></subparagraph></paragraph>
<paragraph id="HE92364C79D6B4E94976E0FEF64337D8B"><enum>(2)</enum><header>Use of reserved funds</header><text display-inline="yes-display-inline">In each fiscal year, the amount reserved under paragraph (1) shall be divided between the uses described in subparagraphs (A) and (B) of such paragraph in the same proportion as the amount reserved under section 1121(a) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6331(a)) is divided between the uses described in paragraphs (1) and (2) of such section 1121(a) in such fiscal year.</text></paragraph></subsection>
<subsection id="HF5F8FE43E52D4222AEF5D8422862524E"><enum>(b)</enum><header>Allocation to States</header>
<paragraph id="H7FABD2739ACF4246B1E6DCFAA0AD13FD"><enum>(1)</enum><header>State-by-State allocation</header><text display-inline="yes-display-inline">Of the amount appropriated to carry out this title for each fiscal year pursuant to section 311(a), and not reserved under subsection (a), each State shall be allocated an amount in proportion to the amount received by all local educational agencies in the State under part A of title I of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311 et seq.) for the previous fiscal year relative to the total amount received by all local educational agencies in every State under such part for such fiscal year.</text></paragraph>
<paragraph id="HF3DFB20755BA4B618FB4D4F4C8A28CDE"><enum>(2)</enum><header>State administration</header><text display-inline="yes-display-inline">A State may reserve up to 1 percent of its allocation under paragraph (1) to carry out its responsibilities under this title, which include—</text>
<subparagraph id="HB876B5A846F1418EBFC507CC7D88A1D7"><enum>(A)</enum><text display-inline="yes-display-inline">providing technical assistance to local educational agencies;</text></subparagraph>
<subparagraph id="H8D67210019454C09BBE5321C4B2DC4EF"><enum>(B)</enum><text display-inline="yes-display-inline">developing an online, publicly searchable database that includes an inventory of public school facilities in the State, including for each, its design, condition, modernization, renovation and repair needs, usage, utilization, energy use, and carbon footprint; and</text></subparagraph>
<subparagraph id="HDAF8E43121BE4851BDE8A04CEC9779CA"><enum>(C)</enum><text display-inline="yes-display-inline">creating voluntary guidelines for high-performing school buildings, including guidelines concerning the following:</text>
<clause id="HB3A576A377E441A1B5D080B48AC2E805"><enum>(i)</enum><text>Site location, storm water management, outdoor surfaces, outdoor lighting, and transportation (location near public transit and easy access for pedestrians and bicycles).</text></clause>
<clause id="H8BBCA6CFA2744D6DA6071F9B4C505639"><enum>(ii)</enum><text>Outdoor water systems, landscaping to minimize water use, including elimination of irrigation systems for landscaping, and indoor water use reduction.</text></clause>
<clause id="H9747ED71109E405A8493BF4135E3226D"><enum>(iii)</enum><text>Energy efficiency (including minimum and superior standards, such as for heating, ventilation, and air conditioning systems), use of alternative energy sources, commissioning, and training.</text></clause>
<clause id="HD61E940D2B5A41EB9BA5334BED8F2409"><enum>(iv)</enum><text>Use of durable, sustainable materials and waste reduction.</text></clause>
<clause id="HFCE24B504EE34022B04A3FBF36BF6E98"><enum>(v)</enum><text>Indoor environmental quality, such as day lighting in classrooms, lighting quality, indoor air quality, acoustics, and thermal comfort.</text></clause>
<clause id="H60135A262F9E432E8077211745061612"><enum>(vi)</enum><text>Operations and management, such as use of energy efficient equipment, indoor environmental management plan, maintenance plan, and pest management.</text></clause></subparagraph></paragraph>
<paragraph id="H7A30A6549ABE465B802DA4597E136BFD"><enum>(3)</enum><header>Grants to local educational agencies</header>
<subparagraph id="H5926980A54ED42A5B6749A0145BD8280"><enum>(A)</enum><header>In general</header><text>From the amount allocated to a State under paragraph (1), each eligible local educational agency in the State shall receive an amount in proportion to the amount received by such local educational agency under part A of title I of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311 et seq.) for the previous fiscal year relative to the total amount received by all local educational agencies in the State under such part for such fiscal year, except that no local educational agency that received funds under title I of that Act for such fiscal year shall receive a grant of less than $5,000 in any fiscal year under this title.</text></subparagraph>
<subparagraph id="H2E637D4E5A7846D591E6B53DF1379B14"><enum>(B)</enum><header>Eligible local educational agency</header><text>For purposes of subparagraph (A), the term <quote>eligible local educational agency</quote> means a local educational agency that—</text>
<clause id="HE69F512953384861ACB87E36DB056AED"><enum>(i)</enum><text>meets the requirements of section 1112(a) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311 et seq.); and </text></clause>
<clause id="HFAC9839C1EFA4AF392A9EEE6945E2A5F"><enum>(ii)</enum><text display-inline="yes-display-inline">conducts an independent audit by a third-party entity, and is certified by the State, substantiating the overall condition of the public school facilities and the need for modernization, renovation, or repair.</text></clause></subparagraph></paragraph>
<paragraph id="HD13282CF7818452F8745F41495B1C487"><enum>(4)</enum><header>Special rule</header><text display-inline="yes-display-inline">Section 1122(c)(3) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6332(c)(3)) shall not apply to paragraph (1) or (3).</text></paragraph></subsection>
<subsection commented="no" id="HB27C5B90BCC048DA8DAB34BB901AC38C"><enum>(c)</enum><header>Special rules</header>
<paragraph commented="no" id="HC0AEC30A99AD4AD7A9BB9E5B0AEE95A0"><enum>(1)</enum><header>Distributions by Secretary</header><text display-inline="yes-display-inline">The Secretary shall make and distribute the reservations and allocations described in subsections (a) and (b) not later than 30 days after an appropriation of funds for this title is made.</text></paragraph>
<paragraph commented="no" id="H4611EF59A9F34DC098CD659A4AA100E2"><enum>(2)</enum><header>Distributions by States</header><text display-inline="yes-display-inline">A State shall make and distribute the allocations described in subsection (b)(3) within 30 days of receiving such funds from the Secretary.</text></paragraph></subsection></section>
<section id="H1B7ABA53501B477C88224D9F429A8F03"><enum>103.</enum><header>Allowable uses of funds</header><text display-inline="no-display-inline">A local educational agency receiving a grant under this title shall use the grant for modernization, renovation, or repair of public school facilities, including, where applicable, early learning facilities—</text>
<paragraph id="H4055FE1A4DAB465192D599113C3D082C"><enum>(1)</enum><text display-inline="yes-display-inline">repairing, replacing, or installing roofs, including extensive, intensive or semi-intensive green roofs, electrical wiring, plumbing systems, sewage systems, storm water runoff systems, lighting systems, or components of such systems, windows, ceilings, flooring, or doors, including security doors;</text></paragraph>
<paragraph id="H7E6C5E6F182640ADBCAEEAF2B1A8D060"><enum>(2)</enum><text display-inline="yes-display-inline">repairing, replacing, or installing heating, ventilation, air conditioning systems, or components of such systems (including insulation), including indoor air quality assessments;</text></paragraph>
<paragraph id="HDC54BD38943149FE86ACFF2A3F0D14FD"><enum>(3)</enum><text display-inline="yes-display-inline">bringing public schools into compliance with fire, health, seismic, and safety codes, including professional installation of fire/life safety alarms, including modernizations, renovations, and repairs that ensure that schools are prepared for emergencies, such as improving building infrastructure to accommodate security measures;</text></paragraph>
<paragraph id="HDD68D5E85E944C26AB406DD10B2FF2DA"><enum>(4)</enum><text>modifications necessary to make public school facilities accessible to comply with the Americans with Disabilities Act of 1990 (42 U.S.C. 12101 et seq.) and section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794);</text></paragraph>
<paragraph id="H3A29EE5142FB4C3D9BDCAB7F325A03DC"><enum>(5)</enum><text display-inline="yes-display-inline">abatement, removal, or interim controls of asbestos, polychlorinated biphenyls, mold, mildew, or lead-based hazards, including lead-based paint hazards;</text></paragraph>
<paragraph id="H7CEB4F206F6047C8B28A445E66B66754"><enum>(6)</enum><text display-inline="yes-display-inline">measures designed to reduce or eliminate human exposure to classroom noise and environmental noise pollution;</text></paragraph>
<paragraph id="H2FC71C3EA75646D19E50F557E3A0B377"><enum>(7)</enum><text display-inline="yes-display-inline">modernizations, renovations, or repairs necessary to reduce the consumption of coal, electricity, land, natural gas, oil, or water;</text></paragraph>
<paragraph id="H81C196D63FE548C799D7D7350E613E72"><enum>(8)</enum><text>upgrading or installing educational technology infrastructure to ensure that students have access to up-to-date educational technology;</text></paragraph>
<paragraph id="H08C7995B373D473DADC015CA6A5F456A"><enum>(9)</enum><text>modernization, renovation, or repair of science and engineering laboratory facilities, libraries, and career and technical education facilities, including those related to energy efficiency and renewable energy, and improvements to building infrastructure to accommodate bicycle and pedestrian access;</text></paragraph>
<paragraph id="H115294A5677B48D4AE5DCAF619ACA925"><enum>(10)</enum><text display-inline="yes-display-inline">renewable energy generation and heating systems, including solar, photovoltaic, wind, geothermal, or biomass, including wood pellet, woody biomass, waste-to-energy, and solar-thermal systems or components of such systems, and energy audits;</text></paragraph>
<paragraph id="HB6D967A210224D0AAA754A0DF1C27D3F"><enum>(11)</enum><text display-inline="yes-display-inline">other modernization, renovation, or repair of public school facilities to—</text>
<subparagraph id="HBF6AFD7961234F1797A92A977932E477"><enum>(A)</enum><text>improve teachers’ ability to teach and students’ ability to learn;</text></subparagraph>
<subparagraph id="H48B5F562BD7747C09EBCD730A5652D0F"><enum>(B)</enum><text>ensure the health and safety of students and staff;</text></subparagraph>
<subparagraph id="H75286BA2791244639EC6BEB66ACC60E8"><enum>(C)</enum><text>make them more energy efficient; or</text></subparagraph>
<subparagraph id="H072B240C9AE0460FAC03824A311317B7"><enum>(D)</enum><text>reduce class size; and</text></subparagraph></paragraph>
<paragraph id="HB162BBEE1F034600963B8574D1CA32FD"><enum>(12)</enum><text display-inline="yes-display-inline">required environmental remediation related to public school modernization, renovation, or repair described in paragraphs (1) through (11).</text></paragraph></section>
<enum>II</enum><header>Supplemental grants for Louisiana, Mississippi, and Alabama</header>
<section commented="no" id="H33EF73266EEF41B5B9AC37927EAA96D3"><enum>201.</enum><header>Purpose</header><text display-inline="no-display-inline">Grants under this title shall be for the purpose of modernizing, renovating, repairing, or constructing public school facilities, including, where applicable, early learning facilities, based on their need for such improvements, to be safe, healthy, high-performing, and up-to-date technologically.</text></section>
<section id="HCC79D660569D4BC38BE517AD4C5A5131"><enum>202.</enum><header>Allocation to local educational agencies</header>
<subsection id="H659F49CE12774967B0B9F8BCC1D7D6AC"><enum>(a)</enum><header>In general</header><text>Of the amount appropriated to carry out this title for each fiscal year pursuant to section 311(b), the Secretary shall allocate to local educational agencies in Louisiana, Mississippi, and Alabama an amount equal to the infrastructure damage inflicted on public school facilities in each such district by Hurricane Katrina or Hurricane Rita in 2005 relative to the total of such infrastructure damage so inflicted in all such districts, combined.</text></subsection>
<subsection id="HDEC7D3D69BBA48EFA244A941B792C30F"><enum>(b)</enum><header>Distribution by Secretary</header><text>The Secretary shall determine and distribute the allocations described in subsection (a) not later than 60 days after an appropriation of funds for this title is made.</text></subsection></section>
<section commented="no" id="H9E1286B4CC3545CD8B125010BE1EA3C4"><enum>203.</enum><header>Allowable uses of funds</header><text display-inline="no-display-inline">A local educational agency receiving a grant under this title shall use the grant for one or more of the activities described in section 103, except that an agency receiving a grant under this title also may use the grant for the construction of new public school facilities.</text></section>
<enum>III</enum><header>General provisions</header>
<section id="H6D9C40B1454E4B77B7CF8E006BFEB469"><enum>301.</enum><header>Impermissible uses of funds</header><text display-inline="no-display-inline">No funds received under this Act may be used for—</text>
<paragraph id="HA2AB385C9780408989736F8344DB3FCD"><enum>(1)</enum><text>payment of maintenance costs;</text></paragraph>
<paragraph id="H41FD2856E1694603BFC376CC086C663E"><enum>(2)</enum><text>stadiums or other facilities primarily used for athletic contests or exhibitions or other events for which admission is charged to the general public;</text></paragraph>
<paragraph id="HFD2B5660A33F4D9C88675A9A12A6F275"><enum>(3)</enum><text>improvement or construction of facilities the purpose of which is not the education of children, including central office administration or operations or logistical support facilities; or</text></paragraph>
<paragraph commented="no" id="HE61BF59EAAD146018169182BADFB90AC"><enum>(4)</enum><text>purchasing carbon offsets.</text></paragraph></section>
<section id="H21B041B0CD7F406EAB73C01A932E1682"><enum>302.</enum><header>Supplement, not supplant</header><text display-inline="no-display-inline">A local educational agency receiving a grant under this Act shall use such Federal funds only to supplement and not supplant the amount of funds that would, in the absence of such Federal funds, be available for modernization, renovation, repair, and construction of public school facilities.</text></section>
<section id="HF1F72CEEE9564FCB939491914FD3203F"><enum>303.</enum><header>Prohibition regarding State aid</header><text display-inline="no-display-inline">A State shall not take into consideration payments under this Act in determining the eligibility of any local educational agency in that State for State aid, or the amount of State aid, with respect to free public education of children.</text></section>
<section commented="no" id="HD5786218EFD8471F8653F16207E4A58F"><enum>304.</enum><header>Maintenance of effort</header>
<subsection commented="no" id="H824A2D334B9540BD8A5F52DA662FB8E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A local educational agency may receive a grant under this Act for any fiscal year only if either the combined fiscal effort per student or the aggregate expenditures of the agency and the State involved with respect to the provision of free public education by the agency for the preceding fiscal year was not less than 90 percent of the combined fiscal effort or aggregate expenditures for the second preceding fiscal year.</text></subsection>
<subsection commented="no" id="H1A2722FFCACA4C3693950FC7B855F64E"><enum>(b)</enum><header>Reduction in case of failure To meet maintenance of effort requirement</header>
<paragraph commented="no" id="H386793A4474B495D9D19CF435776F700"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The State educational agency shall reduce the amount of a local educational agency’s grant in any fiscal year in the exact proportion by which a local educational agency fails to meet the requirement of subsection (a) by falling below 90 percent of both the combined fiscal effort per student and aggregate expenditures (using the measure most favorable to the local agency).</text></paragraph>
<paragraph commented="no" id="H1E8FEBFF75F04F22B9093044EA12DD18"><enum>(2)</enum><header>Special rule</header><text>No such lesser amount shall be used for computing the effort required under subsection (a) for subsequent years.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD73F7C4AE9234B318D018491C85B4593"><enum>(c)</enum><header>Waiver</header><text>The Secretary shall waive the requirements of this section if the Secretary determines that a waiver would be equitable due to—</text>
<paragraph commented="no" id="H697C712EA05245189B9BB9A350AFFDE2"><enum>(1)</enum><text>exceptional or uncontrollable circumstances, such as a natural disaster; or</text></paragraph>
<paragraph commented="no" id="HD4AD55AE6B0A41BB80AC0A798FC6E13D"><enum>(2)</enum><text>a precipitous decline in the financial resources of the local educational agency.</text></paragraph></subsection></section>
<section id="H20278E14A1444760A3087D79D85478C2"><enum>305.</enum><header>Special rule on contracting</header><text display-inline="no-display-inline">Each local educational agency receiving a grant under this Act shall ensure that, if the agency carries out modernization, renovation, repair, or construction through a contract, the process for any such contract ensures the maximum number of qualified bidders, including local, small, minority, and women- and veteran-owned businesses, through full and open competition.</text></section>
<section id="H4DF8B07B85514598827A466B631A62E5"><enum>306.</enum><header>Use of American iron, steel, and manufactured goods</header>
<subsection id="HEC0DDA87F0D348F9A95D81D5CCFB24C1"><enum>(a)</enum><header>In general</header><text>None of the funds appropriated or otherwise made available by this Act may be used for a project for the modernization, renovation, repair or construction of a public school facility unless all of the iron, steel, and manufactured goods used in the project are produced in the United States.</text></subsection>
<subsection id="H0A5DACD88CDC4C17B09B9E3D4800AC92"><enum>(b)</enum><header>Exceptions</header><text>Subsection (a) shall not apply in any case or category of cases in which the Secretary finds that—</text>
<paragraph id="H1033A1373E8E4639AAA109231D341158"><enum>(1)</enum><text>applying subsection (a) would be inconsistent with the public interest;</text></paragraph>
<paragraph id="H7F8B64BD47FF4D41A8F54FEE1708C127"><enum>(2)</enum><text>iron, steel, and the relevant manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or</text></paragraph>
<paragraph id="H70167CBF9CE9415F85DC51B1F72B115F"><enum>(3)</enum><text>inclusion of iron, steel, and manufactured goods produced in the United States will increase the cost of the overall project by more than 25 percent.</text></paragraph></subsection>
<subsection id="HBAE5863AC29C492EB6DCC2A67310E09B"><enum>(c)</enum><header>Publication of justification</header><text>If the Secretary determines that it is necessary to waive the application of subsection (a) based on a finding under subsection (b), the Secretary shall publish in the Federal Register a detailed written justification of the determination.</text></subsection>
<subsection id="HD3CF6C178B6844E8BADF42F65308F5C5"><enum>(d)</enum><header>Construction</header><text>This section shall be applied in a manner consistent with United States obligations under international agreements.</text></subsection></section>
<section id="H12488CD2811A4C89ADA6B39A7522D4B5"><enum>307.</enum><header>Labor standards</header><text display-inline="no-display-inline">The grant programs under this Act are applicable programs (as that term is defined in section 400 of the General Education Provisions Act (20 U.S.C. 1221)) subject to section 439 of such Act (20 U.S.C. 1232b).</text></section>
<section id="HDB615E54933A4DA18872DA62281ECBA7"><enum>308.</enum><header>Charter schools</header><text display-inline="no-display-inline">A local educational agency receiving an allocation under this Act shall distribute an amount of that allocation to charter schools within its jurisdiction. The total amount to be distributed under the preceding sentence shall be determined based on the percentage of students eligible under part A of title I of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311 et seq.) in the schools of the agency who are enrolled in charter schools. Of such total, individual charter schools shall receive a share based on the needs of the schools, as determined by the agency in consultation with the charter school community. Funds shall be used only for allowable activities in accordance with this Act.</text></section>
<section id="HE8C6C5F0AC4745E68028DC9384B91DA6"><enum>309.</enum><header>Green schools</header>
<subsection id="H692ED04CF3E745C6974A4E0F0EC71EF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In a given fiscal year, a local educational agency shall use not less than the applicable percentage (described in subsection (b)) of funds received under this Act for public school modernization, renovation, repairs, or construction that are certified, verified, or consistent with any applicable provisions of—</text>
<paragraph id="H9E02D584BD184AD3BB0C3BA68BC781D3"><enum>(1)</enum><text display-inline="yes-display-inline">the LEED Green Building Rating System;</text></paragraph>
<paragraph id="HA0DF0AC029EE43518ACBF622A9247450"><enum>(2)</enum><text display-inline="yes-display-inline">Energy Star;</text></paragraph>
<paragraph id="H9C8F3EA658BF40FC9001126452D15D49"><enum>(3)</enum><text display-inline="yes-display-inline">the CHPS Criteria;</text></paragraph>
<paragraph id="HFEA2C4A2F7C5456C92DEB2799B0BCAF3"><enum>(4)</enum><text>Green Globes; or</text></paragraph>
<paragraph id="H4A6D50A728944629A4C8D3C92E9F8CA5"><enum>(5)</enum><text display-inline="yes-display-inline">an equivalent program adopted by the State or another jurisdiction with authority over the local educational agency, which shall include a verifiable method to demonstrate compliance with such program.</text></paragraph></subsection>
<subsection commented="no" id="HDFAE286CA6344AB7B3639627C9A275E5"><enum>(b)</enum><header>Applicable percentages</header><text>The applicable percentage described in subsection (a) is—</text>
<paragraph commented="no" id="H3789C645481E497FAB96561FA8FB9897"><enum>(1)</enum><text>in fiscal year 2010, 50 percent;</text></paragraph>
<paragraph commented="no" id="HE271E6B9C13B487582C5487403BAC8F4"><enum>(2)</enum><text>in fiscal year 2011, 60 percent;</text></paragraph>
<paragraph commented="no" id="HD833AAB1BC574376AA99F860C22985B2"><enum>(3)</enum><text>in fiscal year 2012, 70 percent;</text></paragraph>
<paragraph commented="no" id="HB384545BABD043FEAC44B032755CD601"><enum>(4)</enum><text>in fiscal year 2013, 80 percent;</text></paragraph>
<paragraph commented="no" id="H35993BAFC94F47278570BC4E21696941"><enum>(5)</enum><text>in fiscal year 2014, 90 percent; and</text></paragraph>
<paragraph id="HEB54AB24EC69456A80905D65D7F6A93F"><enum>(6)</enum><text>in fiscal year 2015, 100 percent.</text></paragraph></subsection>
<subsection id="HA476A5C6ADD749CE82F057546645BB8B"><enum>(c)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Energy and the Administrator of the Environmental Protection Agency, shall provide outreach and technical assistance to States and local educational agencies concerning the best practices in school modernization, renovation, repair, and construction, including those related to student academic achievement, student and staff health, energy efficiency, and environmental protection.</text></subsection>
</section>
<section id="H3E43C8CD1E7B4E228E481205F7EB410D"><enum>310.</enum><header>Reporting</header>
<subsection id="H1B827216856147C28649A8BE77B6612C"><enum>(a)</enum><header>Reports by local educational agencies</header><text>Local educational agencies receiving a grant under this Act shall annually compile a report describing the projects for which such funds were used, including—</text>
<paragraph id="H308CBDEFE867495B84A3338760E82000"><enum>(1)</enum><text display-inline="yes-display-inline">the number of public schools in the agency, including the number of charter schools, and for each, in the aggregate, the number of students from low-income families;</text></paragraph>
<paragraph id="HF4D96922042C4F6B9764B9985D90CD5D"><enum>(2)</enum><text display-inline="yes-display-inline">the total amount of funds received by the local educational agency under this Act and the amount of such funds expended, including the amount expended for modernization, renovation, repair, or construction of charter schools;</text></paragraph>
<paragraph id="H6BFCE60F2AC546D183DF4CF5FB18814F"><enum>(3)</enum><text>the number of public schools in the agency with a metro-centric locale code of 41, 42, or 43 as determined by the National Center for Education Statistics and the percentage of funds received by the agency under title I or title II of this Act that were used for projects at such schools;</text></paragraph>
<paragraph id="H033B8B5BECCE404F9D4CCC7C48969875"><enum>(4)</enum><text display-inline="yes-display-inline">the number of public schools in the agency that are eligible for schoolwide programs under section 1114 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6314) and the percentage of funds received by the agency under title I or title II of this Act that were used for projects at such schools;</text></paragraph>
<paragraph id="H5676B749650E47BEBFE673DC13D374A2"><enum>(5)</enum><text>for each project—</text>
<subparagraph id="HDB10788438EF4C7D90D6F6B500A5B5B5"><enum>(A)</enum><text>the cost;</text></subparagraph>
<subparagraph commented="no" id="H69500C4C5E8244CBAA6BF4B6678B730B"><enum>(B)</enum><text display-inline="yes-display-inline">the standard described in section 309(a) with which the use of the funds complied or, if the use of funds did not comply with a standard described in section 309(a), the reason such funds were not able to be used in compliance with such standards and the agency’s efforts to use such funds in an environmentally sound manner;</text></subparagraph>
<subparagraph display-inline="no-display-inline" id="H57B219094288462C9F1BE04B149B84BF"><enum>(C)</enum><text display-inline="yes-display-inline">if flooring was installed, whether—</text>
<clause id="H8131CF251A174F85A5245034906FF692"><enum>(i)</enum><text>it was low- or no-VOC (Volatile Organic Compounds) flooring;</text></clause>
<clause id="HB4F4EAA1924D47F1B423167B07941F2A"><enum>(ii)</enum><text>it was made from sustainable materials; and</text></clause>
<clause id="H7A2EA951A1704872AE8F3886F6CD3219"><enum>(iii)</enum><text>use of flooring described in clause (i) or (ii) was cost-effective; and</text></clause></subparagraph>
<subparagraph id="H1ABF6606240C4A1EB82218084F6CE4DC"><enum>(D)</enum><text>any demonstrable or expected benefits as a result of the project (such as energy savings, improved indoor environmental quality, improved climate for teaching and learning, etc.); and</text></subparagraph></paragraph>
<paragraph id="H49E3936C56834065A8ED0FF3FFEF77B3"><enum>(6)</enum><text>the total number and amount of contracts awarded, and the number and amount of contracts awarded to local, small, minority, women, and veteran-owned businesses.</text></paragraph></subsection>
<subsection commented="no" id="H7F05F59604644417A72F0B5D54480594"><enum>(b)</enum><header>Availability of reports</header><text display-inline="yes-display-inline">A local educational agency shall—</text>
<paragraph commented="no" id="HCA6525BDEC8845FCB7D0262AE1C72B6E"><enum>(1)</enum><text>submit the report described in subsection (a) to the State educational agency, which shall compile such information and report it annually to the Secretary; and</text></paragraph>
<paragraph commented="no" id="H6AD04D6D898B4CCEB48D8F0D41A72DDA"><enum>(2)</enum><text display-inline="yes-display-inline">make the report described in subsection (a) publicly available, including on the agency’s website.</text></paragraph></subsection>
<subsection id="H25AEF7B84FA94477B952218996B7D811"><enum>(c)</enum><header>Reports by Secretary</header><text display-inline="yes-display-inline">Not later than December 31 of each fiscal year, the Secretary shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate, and make available on the Department of Education’s website, a report on grants made under this Act, including the information described in subsection (b)(1), the types of modernization, renovation, repair, and construction funded, and the number of students impacted, including the number of students counted under section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6313(a)(5)).</text></subsection></section>
<section id="H9F1917AF8C624085A980BF17F54F7E7C"><enum>311.</enum><header>Authorization of appropriations</header>
<subsection id="HA44BAAAE7A8F4298AF030C27EB2D0440"><enum>(a)</enum><header>Title I</header><text display-inline="yes-display-inline">To carry out title I, there are authorized to be appropriated $6,400,000,000 for fiscal year 2010 and such sums as may be necessary for each of fiscal years 2011 through 2015.</text></subsection>
<subsection id="H9D64957B49F6482F962C5543A4D2358F"><enum>(b)</enum><header>Title II</header><text display-inline="yes-display-inline">To carry out title II, there are authorized to be appropriated $100,000,000 for each of fiscal years 2010 through 2015.</text></subsection></section>
<section commented="no" id="HB307FCC70AC6411186AAD34E52A0F2A8"><enum>312.</enum><header>Special rules</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act, none of the funds authorized by this Act may be—</text>
<paragraph commented="no" id="H84EE37C7F2CA4D3EAE40AAF7D4BF49D5"><enum>(1)</enum><text>used to employ workers in violation of section 274A of the Immigration and Nationality Act (8 U.S.C. 1324a); or</text></paragraph>
<paragraph commented="no" id="HA58506CFE4E54B55B922EBE6666797CF"><enum>(2)</enum><text>distributed to a local educational agency that does not have a policy that requires a criminal background check on all employees of the agency.</text></paragraph></section>
<section id="H20F13D2ACF6D41D684670649FB9C06EC"><enum>313.</enum><header>Youthbuild programs</header><text display-inline="no-display-inline">The Secretary of Education, in consultation with the Secretary of Labor, shall work with recipients of funds under this Act to promote appropriate opportunities for participants in a YouthBuild program (as defined in section 173A of the Workforce Investment Act of 1998 (29 U.S.C. 2918a)) to gain employment experience on modernization, renovation, repair, and construction projects funded under this Act.</text></section>
