		<official-title display="yes">To amend the American Recovery and
		  Reinvestment Act of 2009 to provide for enhanced State and local oversight of
		  activities conducted pursuant to such Act, and for other
		  purposes.</official-title>

		<section id="H3684A2D878A6420D918FA44ABEC7730E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enhanced Oversight of State and Local
			 Economic Recovery Act</short-title></quote>.</text>
		</section><section id="H23A39C30CDB745B38DF602F27D5B6F57"><enum>2.</enum><header>Requirements for
			 funding for State and local oversight under American Recovery and Reinvestment
			 Act of 2009</header>
			<subsection id="H34F52037EB734CBF8D776CD72045A722"><enum>(a)</enum><header>Federal agency
			 requirement</header><text>Section 1552 of the American Recovery and
			 Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>; 123 Stat. 297) is
			 amended—</text>
				<paragraph id="H884316E3EF284F139097C40207327754"><enum>(1)</enum><text>by inserting
			 <quote>(a) <header-in-text level="subsection" style="OLC">Federal agency
			 requirement.—</header-in-text></quote> before <quote>Federal agencies
			 receiving</quote>;</text>
				</paragraph><paragraph id="H9A0CF9AC787C476C9AFE479E5BBEF80F"><enum>(2)</enum><text>by striking
			 <quote>may,</quote> and all that follows through <quote>reasonably</quote> and
			 inserting <quote>shall, subject to guidance from the Director of the Office of
			 Management and Budget,</quote>; and</text>
				</paragraph><paragraph id="H3AB95207F42C470CB407109281044B48"><enum>(3)</enum><text>by striking
			 <quote>data collection requirements</quote> and inserting <quote>data
			 collection requirements, auditing, contract and grant planning and management,
			 and investigations of waste, fraud, and abuse</quote>.</text>
				</paragraph></subsection><subsection id="H0BEB085A413A4F9A9F1C538347C446DB"><enum>(b)</enum><header>State and local
			 government authority</header><text>Such section is further amended by adding at
			 the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H3E054D5911B64538A216BC87A94C0F33" style="OLC">
					<subsection id="H1908B53CC9144EA38D598ED0C0684A62"><enum>(b)</enum><header>State and local
				government authority</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				State and local governments receiving funds under this Act may set aside an
				amount up to 0.5 percent of such funds, in addition to any funds already
				allocated to administrative expenditures, to conduct planning and oversight to
				prevent and detect waste, fraud, and
				abuse.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5A9F679B965E4BD4911F0F5CB1015F48"><enum>(c)</enum><header>Conforming
			 amendment</header><text>The heading for section 1552 of such Act is amended to
			 read as follows:</text>

					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H00A2CF8FE78D4B2EAA277614B768D2F9"><enum>3.</enum><header>Authorization for
			 acquisition by State and local governments through Federal supply
			 schedules</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/502">Section 502</external-xref> of title
			 40, United States Code, is amended by adding at the end the following:</text>
			<quoted-block id="HE9487415B5FE4DC4A30E199B889BEB7F" style="OLC">
				<subsection id="HD7C6E7CCFE3E494BB4C40927EDE79239"><enum>(e)</enum><header>Use of supply
				schedules for economic recovery</header>
					<paragraph id="HA28444F9702A45C4822EAE1A23EECD92"><enum>(1)</enum><header>In
				general</header><text>The Administrator may provide for the use by State or
				local governments of Federal supply schedules of the General Services
				Administration for goods or services that are funded by the American Recovery
				and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>).</text>
					</paragraph><paragraph id="HE72FD4DB8B504831A1D420C74BB92EBC"><enum>(2)</enum><header>Voluntary
				use</header><text>In the case of the use by a State or local government of a
				Federal supply schedule pursuant to paragraph (1), participation by a firm that
				sells to the Federal Government through the supply schedule shall be voluntary
				with respect to a sale to the State or local government through such supply
				schedule.</text>
					</paragraph><paragraph id="H4E1EEE11B75B45FFBDAB5B76E2E09C72"><enum>(3)</enum><header>Definitions</header><text>The
				definitions in subsection (c)(3) shall apply for purposes of this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H27671F1574164C6887F81FAF57D89E95"><enum>4.</enum><header>Definition of
			 jobs created and jobs retained</header><text display-inline="no-display-inline">Section 1512(g) of the American Recovery and
			 Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>; 123 Stat. 288) is
			 amended by adding at the end <quote>The Director of the Office of Management
			 and Budget shall issue guidance to ensure accurate and consistent reporting of
			 <quote>jobs created</quote> and <quote>jobs retained</quote> as those terms are
			 used in subsection (c)(3)(D).</quote>.</text>
