		<official-title>To promote secure ferry transportation and for other
		  purposes.</official-title>

		<section id="H6BFF9A438F214B5BABAB534AB617018F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>United States Ferry Systems Investment
			 Act of 2009</short-title></quote>.</text>
		</section><section id="HF554F1BC5C2C4CA89C0DE3BD19EECD1C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H2FBE132C93454F53A90886BBBCD92177"><enum>(1)</enum><text>Ferries are a
			 vital part of the United States transportation system, carrying more than
			 100,000,000 passengers annually in at least 38 States.</text>
			</paragraph><paragraph id="H7715A773E5D642EAB7E63888BE66BD01"><enum>(2)</enum><text>In many congested
			 metropolitan areas, ferries are one of the few remaining options for
			 significant transportation capacity expansion.</text>
			</paragraph><paragraph id="HB27AA44B5FD249598F30A2C48ACDCDCA"><enum>(3)</enum><text>Ferries are the
			 sole or primary transportation connection for many island and isolated
			 communities.</text>
			</paragraph><paragraph id="H62DFE0E786D24C0EA43B4B22999E8BCB"><enum>(4)</enum><text>Ferries provide a
			 critical emergency evacuation alternative for both large cities and remote
			 locations.</text>
			</paragraph><paragraph id="HA880041BFEE6457BA2328CCADA7AB4B4"><enum>(5)</enum><text>Ferries can be
			 part of an interim solution when transportation infrastructure fails, for
			 example after the terrorist attacks in New York on September 11, 2001,
			 disrupted train service and after part of the San Francisco Bay Bridge
			 collapsed in the Loma Prieta earthquake, ferries were used to provide interim
			 transportation.</text>
			</paragraph><paragraph id="HB1E5AE42BB8144F189CEDC661A650AB0"><enum>(6)</enum><text>Ferries offer a
			 relatively energy-efficient, environmentally friendly, and low-stress mode of
			 travel.</text>
			</paragraph><paragraph id="H607F395398534D32AB4152674C05C4F1"><enum>(7)</enum><text>Almost all of the
			 largest and important ferry services are publicly owned or provide
			 transportation at public terminals, are integrated with other transportation
			 modes, and are operated in a manner to serve the public interest.</text>
			</paragraph><paragraph id="HC3D67DF5C3D1450C8938158417CF311E"><enum>(8)</enum><text>According to the
			 Secretary of Transportation, almost 25 percent of United States ferries are 40
			 years or older and 5 percent of United States ferries are 60 years or
			 older.</text>
			</paragraph><paragraph id="HCF4D440748CE40A7994F7B656B047457"><enum>(9)</enum><text>Federal investment
			 in the United States ferry system is necessary because—</text>
				<subparagraph id="H14B2ED2B104A48FAB32BFD55102D5314"><enum>(A)</enum><text>of the unique and
			 important role ferries play in the United States transportation system;</text>
				</subparagraph><subparagraph id="H99B23B200F2D43AABA8BD15C185DD655"><enum>(B)</enum><text>of the large and
			 growing need for new and replacement ferry vessels and terminals; and</text>
				</subparagraph><subparagraph id="H4ED30F441C904A8FA0AD1A464805DA60"><enum>(C)</enum><text>ferries do not fit
			 neatly into other Federal mode-specific transportation programs.</text>
				</subparagraph></paragraph><paragraph id="H5B03E7D5A45248F1B1818FBE67E6BCFB"><enum>(10)</enum><text>The distribution
			 of Federal ferry funds by formula is appropriate because that method of
			 distribution would dedicate funding to the largest and most important public
			 ferry systems.</text>
			</paragraph><paragraph id="HCA80ACF5C243462282B28C20F2AD27B8"><enum>(11)</enum><text>The distribution
			 of Federal ferry funds by discretionary awards is also appropriate because that
			 method of distribution would help initiate and expand ferry services throughout
			 the United States.</text>
			</paragraph></section><section id="H586570590C4549B0844D7EA117112152"><enum>3.</enum><header>Secretary
			 defined</header><text display-inline="no-display-inline">In this Act, the term
			 <term>Secretary</term> means the Secretary of Transportation.</text>
		</section><section id="H23773B360B3047BD948C6E386C17E218"><enum>4.</enum><header>Construction of
			 ferry boats and ferry terminal facilities</header><text display-inline="no-display-inline">Section 147 of title 23, United States Code,
			 is amended by striking subsections (c), (d), and (e) and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H8109C89524C4465E955D7D55F6CBFB9B" style="OLC">
				<subsection id="HC54B44AC438B443A87B511AD7E5DFBDD"><enum>(c)</enum><header>Distribution of
				funds</header><text>The funds made available to carry out this section in each
				fiscal year shall be allocated to those ferry systems and public entities
				responsible for developing ferries as follows:</text>
					<paragraph id="H1CF06B462FDD4387A4A0D7A8E461844A"><enum>(1)</enum><text>Fifty percent of
				such funds shall be allocated at the discretion of the Secretary.</text>
					</paragraph><paragraph id="H674A072E53EE44F88ACC746E82A2EBEF"><enum>(2)</enum><text>Fifty percent of
				such funds shall be allocated in accordance with the formula set out in
				subsection (d).</text>
					</paragraph></subsection><subsection id="H0004E95D7C174377AB0AC68E75C40486"><enum>(d)</enum><header>Formula</header><text>The
				funds referred to in subsection (c)(2) shall be distributed as follows:</text>
					<paragraph id="HC00AD87D209A43A8A6BAC7D8A733CF8A"><enum>(1)</enum><text>Fifty percent
				shall be based on the total annual number of passengers carried by a ferry
				system.</text>
					</paragraph><paragraph id="H011EDD5D0F9B4840886A828FEC8370D7"><enum>(2)</enum><text>Twenty-five
				percent shall be based on the total annual number of vehicles carried by a
				ferry system.</text>
					</paragraph><paragraph id="HEEB3E295CB6B483D88D435C68EB486E8"><enum>(3)</enum><text>Twenty-five
				percent shall be based on the total route miles serviced by a ferry
				system.</text>
					</paragraph></subsection><subsection id="H56F83765814E480D9314512ED595B50D"><enum>(e)</enum><header>Funding</header>
					<paragraph id="H9B644C428DFC49AFB72BFFDA8032FBE3"><enum>(1)</enum><header>In
				general</header><text>There shall be available to the Secretary from the
				Highway Trust Fund (other than the Mass Transit Account) $200,000,000 for each
				of the fiscal years 2010, 2011, 2012, 2013, 2014, and 2015 to carry out this
				section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H19F1979446AA4A70A58DF8A7DCC7EAC2"><enum>(2)</enum><header>Period of
				availability</header><text>Notwithstanding section 118(b), funds made available
				to carry out this section shall remain available until
				expended.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H82CF497C6F024E97BCEAC90DA75A704A"><enum>5.</enum><header>Eligibility of
			 ferries for the clean fuels grant program</header><text display-inline="no-display-inline">Section 5308 of title 49, United States
			 Code, is amended—</text>
			<paragraph id="H539912ED50974272AAD0BF855A328570"><enum>(1)</enum><text>in paragraph (2)
			 of subsection (a)—</text>
				<subparagraph id="H132E447A96F34C07AC6EDACA01F93292"><enum>(A)</enum><text>in clause (i), by
			 striking the semicolon and inserting a comma and <quote>or ferries;</quote>;
			 and</text>
				</subparagraph><subparagraph id="H46ECE420179945FC83377206178D6BC5"><enum>(B)</enum><text>in clause (iii),
			 by striking the semicolon and inserting <quote>or ferries;</quote>; and</text>
				</subparagraph></paragraph><paragraph id="HE39CCF92E6A843C0A70987A301039D72"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="HA2004C1DE85944FFAD59F163FC124862"><enum>(A)</enum><text>in the heading, by
			 striking the period and inserting <quote><header-in-text level="subsection" style="USC">and ferries.</header-in-text></quote>; and</text>
				</subparagraph><subparagraph id="H13C9927A5725429A8471AA421BFBBC92"><enum>(B)</enum><text>by striking the
			 period at the end and inserting <quote>or ferries.</quote>.</text>
				</subparagraph></paragraph></section><section id="H20C781BAFA49421B90FB36E20C0E360F"><enum>6.</enum><header>Ferry Joint
			 Program Office</header>
			<subsection id="H28999CF97B11412B805F33300B2DB1FA"><enum>(a)</enum><header>Establishment
			 and purpose</header>
				<paragraph id="H0F64441347CF41089B1A392B0839DFD3"><enum>(1)</enum><header>Establishment</header><text>The
			 Secretary shall establish within the Department of Transportation a Ferry Joint
			 Program Office (in this section, referred to as the <term>Office</term>) for
			 the purposes described in paragraph (2).</text>
				</paragraph><paragraph id="H117580CE2C674C80BF0DABC7ED4CA223"><enum>(2)</enum><header>Purposes</header><text>The
			 purposes of the Office shall be—</text>
					<subparagraph id="H6336F8CDBCF04FACA344EF52B28985D5"><enum>(A)</enum><text>to coordinate
			 Federal programs affecting ferry and ferry facility construction, maintenance,
			 operations, and security; and</text>
					</subparagraph><subparagraph id="HA35F76AA26354E2792F357BD16FFDE46"><enum>(B)</enum><text>to promote
			 transportation by ferry as a component of the United States transportation
			 system.</text>
					</subparagraph></paragraph></subsection><subsection id="HF34C4B3A42A346A08DF173A7F089F763"><enum>(b)</enum><header>Functions</header><text>The
			 head of the Office shall carry out the following functions:</text>
				<paragraph id="H6314DA56840E44E5A6B28FF18DC56F3F"><enum>(1)</enum><text>Coordinating
			 programs related to ferry transportation carried out by the Department of
			 Transportation, including programs carried out by the Federal Highway
			 Administration, the Federal Transit Administration, the Maritime
			 Administration, and the Research and Innovative Technology Administration, and
			 such programs carried out by the Department of Homeland Security and other
			 Federal and State agencies, as appropriate.</text>
				</paragraph><paragraph id="HE1899AC0FE7F440DAE62C281BA13DA32"><enum>(2)</enum><text>Ensuring resource
			 accountability for programs carried out by the Secretary related to ferry
			 transportation.</text>
				</paragraph><paragraph id="HABED03A453E8495DAEC5FC580740C8E0"><enum>(3)</enum><text>Providing
			 strategic leadership for research, development, testing, and deployment of
			 technologies related to ferry transportation.</text>
				</paragraph><paragraph id="H1F442136BB574054996E24E2AB7FFFC9"><enum>(4)</enum><text>Promoting ferry
			 transportation as a means to reduce social, economic, and environmental costs
			 associated with traffic congestion.</text>
				</paragraph><paragraph id="H000B2C722C0B4ADC91CB1DBFA33AFBC9"><enum>(5)</enum><text>Developing energy
			 efficient operating models to reduce carbon emissions associated with ferry
			 transportation.</text>
				</paragraph></subsection></section><section id="H4BB90C7AB94F4D9EBBC4722325CF06BC"><enum>7.</enum><header>National ferry
			 database</header><text display-inline="no-display-inline">Subsection (e) of
			 section 1801 of the Safe, Accountable, Flexible, Efficient Transportation
			 Equity Act: A Legacy for Users (Public Law 109–59; 23 U.S.C. 129 note) is
			 amended—</text>
			<paragraph id="HDFF732C20C154E6C9CF9225142BB678D"><enum>(1)</enum><text>in paragraph (2),
			 by inserting <quote>, including any Federal, State, or local government funding
			 sources,</quote> after <quote>sources</quote>; and</text>
			</paragraph><paragraph id="H689AC5BE470C4DF99F4C56384E172805"><enum>(2)</enum><text>in paragraph
			 (4)—</text>
				<subparagraph id="H4D82A015272A4F858A1335EDDB74D4A5"><enum>(A)</enum><text>in subparagraph
			 (B), by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="HAE3B3FC373394D09A38BA08168DECF30"><enum>(B)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (D);</text>
				</subparagraph><subparagraph id="H4C31517331F647479E410A25AF6AF13F"><enum>(C)</enum><text>by inserting after
			 subparagraph (B), the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE131AD0B8D784C3CB06EBE34BF9B4590" style="OLC">
						<subparagraph id="HA4AD24C7D10C4EC79CF6AEA947CB0115"><enum>(C)</enum><text>ensure that the
				database is consistent with the national transit database maintained by the
				Federal Transit Administration</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H86AAE5B51715479FB029EBFE865043EB"><enum>(D)</enum><text>in subparagraph
			 (D), as redesignated by subparagraph (B), by striking <quote>2009</quote> and
			 inserting <quote>2015</quote>.</text>
				</subparagraph></paragraph></section><section id="H8955C12FA3B4433882B9C9F9F1BAC73F"><enum>8.</enum><header>National Ferry
			 Transportation Institute</header>
			<subsection id="HC50B9008E5C9429D988C55C90185BD05"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 award a grant to a college to establish a National Ferry Transportation
			 Institute (in this section, referred to as an <term>Institute</term>) at the
			 college.</text>
			</subsection><subsection id="H465A15A8F4E44AB6A11F563C0EEDB900"><enum>(b)</enum><header>Administration</header><text>The
			 Secretary shall award and administer the grant under subsection (a) in
			 cooperation with the heads of appropriate entities of the Department of
			 Transportation and of the appropriate State transportation department, public
			 ferry transportation authorities, private ferry operators, ferry builders,
			 ferry transportation employees, and other colleges, universities, and research
			 institutes.</text>
			</subsection><subsection id="HA605231B52AD4AB3B1C66EE66E468B9F"><enum>(c)</enum><header>Functions</header><text>The
			 Institute—</text>
				<paragraph id="H370379E112ED4B4DA1082B1B3A509A3E"><enum>(1)</enum><text>shall—</text>
					<subparagraph id="H64E96DE32DC14287B38D6298E1DE2BBD"><enum>(A)</enum><text>conduct research
			 and recommend development activities on methods of improving ferry
			 transportation programs in the United States, including methods of reducing
			 wake, providing alternative propulsion, integrating use of clean, renewable
			 fuels, and testing advanced materials for use in ferry construction;</text>
					</subparagraph><subparagraph id="HE3274B243DD24DE7A61456C5FC84ECBE"><enum>(B)</enum><text>develop and
			 conduct training programs for ferry transportation system employees, United
			 States Government employees, and other individuals, as appropriate, on
			 developments, techniques, and procedures pertaining to the construction and
			 operation of ferries;</text>
					</subparagraph><subparagraph id="HDF609EE791A847E7A56E12500E378398"><enum>(C)</enum><text>encourage and
			 assist collaborative efforts by public and private entities to preserve,
			 improve, and expand the use of ferries as a mode of transportation;</text>
					</subparagraph><subparagraph id="H6ABB8DE795B543D2911A5D58DDA303B9"><enum>(D)</enum><text>preserve, utilize,
			 and display historical information about the use of ferry transportation in the
			 United States and in foreign countries; and</text>
					</subparagraph><subparagraph id="H6929F64CB7794780B8DED075AEF40946"><enum>(E)</enum><text>develop models and
			 recommendations to enhance security on ferries and in and around ferry
			 facilities; and</text>
					</subparagraph></paragraph><paragraph id="H1290427CADCB4710907134C7F2943EA0"><enum>(2)</enum><text>may provide funds
			 from a grant under subsection (a) to a contractor or other entity to assist the
			 Institute in carrying out the functions described in subparagraphs (A) through
			 (E) of paragraph (1).</text>
				</paragraph></subsection><subsection id="H4908B20E40E74F2584558C3696C3E733"><enum>(d)</enum><header>Selection
			 criteria</header><text>The Secretary shall award the grant under subsection (a)
			 on the basis of the following criteria:</text>
				<paragraph id="H06F861F48B07496E8D054F749FA51B57"><enum>(1)</enum><text>The extent to
			 which the needs of the State in which the applicant is located are
			 representative of the importance of public and private ferries to the region’s
			 transportation system, including both regional travel and long-range travel and
			 service to isolated communities.</text>
				</paragraph><paragraph id="H8AA8B20C18564705B06ADA0F2B3D7899"><enum>(2)</enum><text>The historical
			 importance of ferry transportation to the region in which the applicant is
			 located.</text>
				</paragraph><paragraph id="H133CF3A359224F298CAC74A843B9B666"><enum>(3)</enum><text>The history and
			 diversity of such region in the maritime community, including ferry
			 construction and repair and other shipbuilding activities.</text>
				</paragraph><paragraph id="H226732DAF8024343A42D770853E9E67D"><enum>(4)</enum><text>The anticipated
			 growth of ferry transportation and the building of ferries in such
			 region.</text>
				</paragraph><paragraph id="HF9331CA0239A4863A2247936FB79F4E7"><enum>(5)</enum><text>The availability
			 of public-private collaboration in such region.</text>
				</paragraph><paragraph id="H3BFF04784B6A4F919D6F6471C623DA1B"><enum>(6)</enum><text>The demonstrated
			 research and extension resources available to the applicant to successfully
			 carry out the functions described in subsection (c).</text>
				</paragraph></subsection><subsection id="HD09AA03DA20C491DB9C60EF8637DE0D6"><enum>(e)</enum><header>Requirement for
			 non-Federal funding</header><text>A college may not be awarded the grant under
			 subsection (a) unless the college is able to provide 25 percent of the costs
			 associated with establishing, operating, and maintaining the Institute and the
			 research and development activities carried out by the Institute from
			 non-Federal sources.</text>
			</subsection><subsection id="HEF4529A1C1264659BE351FCBDCC65E89"><enum>(f)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and annually
			 thereafter, the Secretary shall submit to Congress a report on activities
			 carried out under this section, including a description of the activities
			 carried out by the Institute.</text>
			</subsection><subsection id="H181CA4F47D9A4E6E98E48C95E183B79B"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary $5,000,000 for each of fiscal years 2010, 2011, 2012, 2013, 2014, and
			 2015 to carry out this section.</text>
