		  grants for certain streetcar projects, and for other purposes.</official-title>

		<section id="H32D93CA68ED04D5BA9F9E3F8F0CECEEF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fast Starts Act of 2009</short-title></quote>.</text>
		</section><section id="H8460CE3222484768A632C1471645CBB7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H1F84D1EB394A4894955DF37E08F52FD3"><enum>(1)</enum><text display-inline="yes-display-inline">Communities around the United States have
			 expended time and resources to utilize the Small Starts program under section
			 5309(e) of title 49, United States Code, for streetcar projects.</text>
			</paragraph><paragraph id="HF8942F5BB54E45D5A927AF820582FA72"><enum>(2)</enum><text display-inline="yes-display-inline">A delay in authorizing grants under the
			 Small Starts program has created a backlog of streetcar projects requiring
			 attention outside of that program.</text>
			</paragraph><paragraph id="H53F9A460EE704DAA98E603278D0221A2"><enum>(3)</enum><text>Streetcar projects
			 create jobs during both their construction and operation throughout the
			 corridor in which the projects are developed.</text>
			</paragraph></section><section id="H3096E129D00640C9971DDB736B661CA8"><enum>3.</enum><header>Grants for
			 certain streetcar projects</header>
			<subsection id="HB284A75583B546CCA03235E3B665BBFD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation is authorized to make grants to States and local governmental
			 authorities to assist the financing of streetcar projects in accordance with
			 this section.</text>
			</subsection><subsection id="H6E8242C91122406991F85DE14E9CBE23"><enum>(b)</enum><header>Eligible
			 projects</header><text>To be eligible for a grant under subsection (a), the
			 State or local governmental authority applying for a grant shall submit to the
			 Secretary, not later than March 1, 2010, an application certifying that the
			 streetcar project to be assisted by such grant—</text>
				<paragraph id="HD67D832A82A14C10A44768FD2B075BAE"><enum>(1)</enum><text>is supported by an
			 acceptable degree of local financial commitment;</text>
				</paragraph><paragraph id="HE006841CD384416B8454FF666D659D36"><enum>(2)</enum><text>has met the
			 environmental requirements necessary to begin construction; and</text>
				</paragraph><paragraph id="HBA5E7DD1B3A94F9381F2376660E3AA2B"><enum>(3)</enum><text>is a project with
			 respect to which construction can begin not later than March 1, 2012.</text>
				</paragraph></subsection><subsection id="H2BE27C3F52854CAD8B388F7D4FD49D29"><enum>(c)</enum><header>Selection
			 criteria</header>
				<paragraph id="H697A5A1D3325432496AF26451F35F9C0"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may make a grant under subsection (a) with
			 respect to a streetcar project only if the Secretary finds that the project
			 is—</text>
					<subparagraph id="H45E9AB0686944949884AE298B02B4265"><enum>(A)</enum><text>based on the
			 results of planning and alternatives analysis;</text>
					</subparagraph><subparagraph id="HCCDA08CA7400454AA61427C7A16DCBC7"><enum>(B)</enum><text>justified based on
			 a review of its effect on local economic development, land use, travel
			 patterns, and greenhouse gas reduction potential; and</text>
					</subparagraph><subparagraph id="H1EDF5D3A99E74F1BB30FEC37F120575D"><enum>(C)</enum><text>supported by an
			 acceptable degree of local financial commitment.</text>
					</subparagraph></paragraph><paragraph id="H06A55473D196412CAC7800455C9DD07A"><enum>(2)</enum><header>Planning and
			 alternatives</header><text display-inline="yes-display-inline">In evaluating a
			 project under paragraph (1)(A), the Secretary shall analyze and consider the
			 results of planning and alternatives analysis for the project. For purposes of
			 this paragraph, the Secretary shall compare the project to a no build analysis
			 to consider project outcomes.</text>
				</paragraph><paragraph id="HE90B774CD24A46A898AF9F5FF6BB500A"><enum>(3)</enum><header>Project
			 justification</header><text display-inline="yes-display-inline">For purposes of
			 making the finding under paragraph (1)(B), the Secretary shall
			 determine—</text>
					<subparagraph id="HB924FD02974541E798C12FC9662BD566"><enum>(A)</enum><text>the degree to
			 which the project will have a positive effect on local economic
			 development;</text>
					</subparagraph><subparagraph id="H00A630E882DB48D3B7F6201D43127728"><enum>(B)</enum><text display-inline="yes-display-inline">the reduction in per capita auto travel
			 demand that will result from the completed project, including related
			 development, travel pattern, and land use changes; and</text>
					</subparagraph><subparagraph id="H24F422B0673E40098F6CF1A114E2FFD3"><enum>(C)</enum><text>the reduction in
			 per capita greenhouse gas emissions that will result from the completed
			 project, including related development, travel pattern, and land use
			 changes.</text>
					</subparagraph></paragraph><paragraph id="H44D6682D6A074815BDE300B7AD826A4F"><enum>(4)</enum><header>Local financial
			 commitment</header><text>For purposes of paragraph (1)(C), the Secretary shall
			 require that each proposed local source of capital and operating financing is
			 stable, reliable, and available within the timetable of the project.</text>
				</paragraph></subsection><subsection id="H204E369CAED14F9B9B0A948B76719D8F"><enum>(d)</enum><header>Amount
			 limitation</header><text>With respect to a streetcar project for which a grant
			 is made under subsection (a), the sum of the amounts of grants made under
			 subsection (a) to assist such project may not exceed $60,000,000.</text>
			</subsection><subsection id="H778D9169F52A472ABB7582FD29990EF4"><enum>(e)</enum><header>Relationship to
			 other funding</header><text display-inline="yes-display-inline">A streetcar
			 project for which a grant is made under subsection (a) is not prohibited from
			 receiving assistance under any other Federal program.</text>
			</subsection><subsection id="H60B775A9ECF34A54A906C4844B8A75DD"><enum>(f)</enum><header>Federal
			 share</header><text>The Federal share of the cost of a streetcar project, or
			 portion of a streetcar project, for which a grant is made under subsection (a)
			 shall be 100 percent.</text>
			</subsection><subsection id="HCB8A67C47CF346AF952D56205FA0B0B1"><enum>(g)</enum><header>Streetcar
			 project defined</header><text>In this section, the term <term>streetcar
			 project</term> means a new fixed guideway capital project that is electricity
			 and rail based.</text>
			</subsection><subsection id="H9108951C4D2542498CE6BFAF7030ABBC"><enum>(h)</enum><header>Other
			 definitions</header><text>In this section, the definitions contained in
			 sections 5302 and 5309 of title 49, United States Code, apply.</text>
			</subsection><subsection id="H5891BEC839224ED69E52DD04AD87D0E7"><enum>(i)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $400,000,000 for fiscal year 2010.</text>
			</subsection><subsection id="H8E9F7445A2C240559D0F2014507ECFB4"><enum>(j)</enum><header>Availability of
			 amounts</header><text>Amounts made available to carry out this section shall
			 remain available until expended.</text>
