<section id="H531FBA9FB6B549128713F2580D1492DC"><enum>2.</enum><header>Strategic planning amendments</header><text display-inline="no-display-inline">Chapter 3 of title 5, United States Code, is amended by striking section 306 and inserting the following:</text>

<section id="H0CDDA3B8AF20498DB865F424E9D8E02C"><enum>306.</enum><header>Agency strategic plans</header>
<subsection id="HA2A98532F54F476EAE5AD0C7E9CFD70D"><enum>(a)</enum><text display-inline="yes-display-inline">Not later than the first Monday in February of any year following the year in which the term of the President commences under section 101 of title 3, the head of each agency shall make available on the public website of the agency a strategic plan and notify the President and Congress of its availability. Such plan shall contain—</text>
<paragraph id="H83F438B872CD44758DDF75206BCEE025"><enum>(1)</enum><text>a comprehensive mission statement covering the major functions and operations of the agency;</text></paragraph>
<paragraph id="H03844814E19A47FCA916CA2CB52123C8"><enum>(2)</enum><text>general goals and objectives, including outcome-oriented goals, for the major functions and operations of the agency;</text></paragraph>
<paragraph id="H08D06BA0BDAF4EA69D2A3ABE88480E57"><enum>(3)</enum><text>a description of how any goals and objectives contribute to the Federal Government priority goals required by section 1120(a) of title 31;</text></paragraph>
<paragraph id="H27437E3E5D8543A5AED0C6F9D5F1CE09"><enum>(4)</enum><text>a description of how the goals and objectives are to be achieved, including—</text>
<subparagraph id="H42E5FD0148F14BC989FEB058E123DBD0"><enum>(A)</enum><text>a description of the operational processes, skills and technology, and the human, capital, information, and other resources required to achieve those goals and objectives; and</text></subparagraph>
<subparagraph id="H071B88B9674E4E699DD04E945EFC7BD8"><enum>(B)</enum><text>a description of how the agency is working with other agencies to achieve its goals and objectives as well as relevant Federal Government priority goals;</text></subparagraph></paragraph>
<paragraph id="H3A19910909DA43D69146F5E8044DB07A"><enum>(5)</enum><text>a description of how the goals and objectives incorporate views and suggestions obtained through congressional consultations required under subsection (d);</text></paragraph>
<paragraph id="H5DC68F6D610B44AF8D36B7E96A10AE03"><enum>(6)</enum><text>a description of how the performance goals provided in the plan required by section 1115(a) of title 31, including the agency priority goals required by section 1120(b) of title 31, if applicable, contribute to the general goals and objectives in the strategic plan;</text></paragraph>
<paragraph id="H38FC9754DCA64062AA801C65D95DCC2F"><enum>(7)</enum><text>an identification of those key factors external to the agency and beyond its control that could significantly affect the achievement of the general goals and objectives; and</text></paragraph>
<paragraph id="H337CFDDAB12E471C94EBD59498D1D8AD"><enum>(8)</enum><text>a description of the program evaluations used in establishing or revising general goals and objectives, with a schedule for future program evaluations to be conducted.</text></paragraph></subsection>
<subsection id="H5F3DD0D289A24AE4BD5851C7286CE2F7"><enum>(b)</enum><text>The strategic plan shall cover a period of not less than 4 years following the fiscal year in which the plan is submitted. As needed, the head of the agency may make adjustments to the strategic plan to reflect significant changes in the environment in which the agency is operating, with appropriate notification of Congress.</text></subsection>
<subsection id="HF072CC20278941458CAEB240A5317B9D"><enum>(c)</enum><text>The performance plan required by section 1115(b) of title 31 shall be consistent with the agency’s strategic plan. A performance plan may not be submitted for a fiscal year not covered by a current strategic plan under this section.</text></subsection>
<subsection id="HD5F1EF03B6BA465EBEDE5DE3A00D9297"><enum>(d)</enum><text>When developing or making adjustments to a strategic plan, the agency shall consult periodically with the Congress, including majority and minority views from the appropriate authorizing, appropriations, and oversight committees, and shall solicit and consider the views and suggestions of those entities potentially affected by or interested in such a plan. The agency shall consult with the appropriate committees of Congress at least once every 2 years.</text></subsection>
<subsection id="H58473569647B41CFABB9C2F07E226F63"><enum>(e)</enum><text>The functions and activities of this section shall be considered to be inherently governmental functions. The drafting of strategic plans under this section shall be performed only by Federal employees.</text></subsection>
<subsection id="H98D29E24F4F8452CA4EB43098D0DCDE8"><enum>(f)</enum><text>For purposes of this section the term <term>agency</term> means an Executive agency defined under section 105, but does not include the Central Intelligence Agency, the Government Accountability Office, the United States Postal Service, and the Postal Regulatory Commission.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H1DE073FDB15F46BA9FC7EE564AACCFEA"><enum>3.</enum><header>Performance planning amendments</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by striking section 1115 and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H7FEB3F1410DE409895763C72348CF0F5" style="USC">
<section id="HF9268AB291D3469D89CF7A26D964937D"><enum>1115.</enum><header>Federal Government and agency performance plans</header>
<subsection id="HD2A2A491706140C49DC3A2E9D3142B9C"><enum>(a)</enum><header>Federal Government performance plans</header><text>In carrying out the provisions of section 1105(a)(28), the Director of the Office of Management and Budget shall coordinate with agencies to develop the Federal Government performance plan. In addition to the submission of such plan with each budget of the United States Government, the Director of the Office of Management and Budget shall ensure that all information required by this subsection is concurrently made available on the website provided under section 1122 and updated periodically, but no less than annually. The Federal Government performance plan shall—</text>
<paragraph id="H3372851C65614726BE82A8BD3B75AB30"><enum>(1)</enum><text>establish Federal Government performance goals to define the level of performance to be achieved during the year in which the plan is submitted and the next fiscal year for each of the Federal Government priority goals required under section 1120(a) of this title;</text></paragraph>
<paragraph id="HFEBF27EFB86E45B289F9422B37D88D1B"><enum>(2)</enum><text>identify the agencies, organizations, program activities, regulations, tax expenditures, policies, and other activities contributing to each Federal Government performance goal during the current fiscal year;</text></paragraph>
<paragraph id="HA77DA172F04F4C8B85D19AA47E7E4F18"><enum>(3)</enum><text>for each Federal Government performance goal, identify a lead Government official who shall be responsible for coordinating the efforts to achieve the goal;</text></paragraph>
<paragraph id="HCB509A7E58CF4AD698EB20CB80EA676C"><enum>(4)</enum><text>establish common Federal Government performance indicators with quarterly targets to be used in measuring or assessing—</text>
<subparagraph id="HBDC07FCEE7B049AFADD3E337BB8A7CAC"><enum>(A)</enum><text>overall progress toward each Federal Government performance goal; and</text></subparagraph>
<subparagraph id="HF0012F443016453A9E521EBC6867A173"><enum>(B)</enum><text>the individual contribution of each agency, organization, program activity, regulation, tax expenditure, policy, and other activity identified under paragraph (2);</text></subparagraph></paragraph>
<paragraph id="H949289EC05624DBA9346C9B82735B4A6"><enum>(5)</enum><text>establish clearly defined quarterly milestones; and</text></paragraph>
<paragraph id="HAE71B66F605E47F7A008B96FA95DE33A"><enum>(6)</enum><text>identify major management challenges that are Governmentwide or crosscutting in nature and describe plans to address such challenges, including relevant performance goals, performance indicators, and milestones.</text></paragraph></subsection>
<subsection id="H03F03775346E4F8392F75A09B19EC8E2"><enum>(b)</enum><header>Agency performance plans</header><text>Not later than the first Monday in February of each year, the head of each agency shall make available on a public website of the agency, and notify the President and the Congress of its availability, a performance plan covering each program activity set forth in the budget of such agency. Such plan shall—</text>
<paragraph id="H71F20CBA49954A5E9920BE2478F09072"><enum>(1)</enum><text>establish performance goals to define the level of performance to be achieved during the year in which the plan is submitted and the next fiscal year;</text></paragraph>
<paragraph id="HCD38EDC57BDB47A5975D4774FFFACCE6"><enum>(2)</enum><text>express such goals in an objective, quantifiable, and measurable form unless authorized to be in an alternative form under subsection (c);</text></paragraph>
<paragraph id="H8CEEF68E1D514028B8CB170FD2C682A1"><enum>(3)</enum><text>describe how the performance goals contribute to—</text>
<subparagraph id="H05B322855B3449A99BE7620AC7CD06A5"><enum>(A)</enum><text>the general goals and objectives established in the agency’s strategic plan required by section 306(a)(2) of title 5; and</text></subparagraph>
<subparagraph id="HD3BB52043AFD4A94AA1CE3C1D31E877A"><enum>(B)</enum><text>any of the Federal Government performance goals established in the Federal Government performance plan required by subsection (a)(1);</text></subparagraph></paragraph>
<paragraph id="HF21DA42268014E1197492190ACA788F3"><enum>(4)</enum><text>identify among the performance goals those which are designated as agency priority goals as required by section 1120(b) of this title, if applicable;</text></paragraph>
<paragraph id="HE0A6E71E75C94CC2AC72C41BD3700007"><enum>(5)</enum><text>provide a description of how the performance goals are to be achieved, including—</text>
<subparagraph id="HB65CA2AA82094FBBBBAA608332D81D1C"><enum>(A)</enum><text>the operation processes, training, skills and technology, and the human, capital, information, and other resources and strategies required to meet those performance goals;</text></subparagraph>
<subparagraph id="H0482C8A4C6054DBAB335111B693619B3"><enum>(B)</enum><text>clearly defined milestones;</text></subparagraph>
<subparagraph id="H2E9ED34617F6476FA324DC1766CC88E7"><enum>(C)</enum><text>an identification of the organizations, program activities, regulations, policies, and other activities that contribute to each performance goal, both within and external to the agency;</text></subparagraph>
<subparagraph id="H801A37DEC77A4CD39A0DA58341102EE8"><enum>(D)</enum><text>a description of how the agency is working with other agencies to achieve its performance goals as well as relevant Federal Government performance goals; and</text></subparagraph>
<subparagraph id="H61FD3C50AF494252941CAF23D05ADB92"><enum>(E)</enum><text>an identification of the agency officials responsible for the achievement of each performance goal, who shall be known as goal leaders;</text></subparagraph></paragraph>
<paragraph id="HE4872B01074B40F8B511CD85164D3022"><enum>(6)</enum><text>establish a balanced set of performance indicators to be used in measuring or assessing progress toward each performance goal, including, as appropriate, customer service, efficiency, output, and outcome indicators;</text></paragraph>
<paragraph id="HF37340D4F10840EB9400B7FAEB30CE5C"><enum>(7)</enum><text>provide a basis for comparing actual program results with the established performance goals;</text></paragraph>
<paragraph id="HE00C9C24ADC24DE3A850305318211C56"><enum>(8)</enum><text>a description of how the agency will ensure the accuracy and reliability of the data used to measure progress towards its performance goals, including an identification of—</text>
<subparagraph id="HFB6CCCEB8B5148B28801CDC0D485A391"><enum>(A)</enum><text>the means to be used to verify and validate measured values;</text></subparagraph>
<subparagraph id="HA5E13926D95E4EB3897BFBC4FA36E550"><enum>(B)</enum><text>the sources for the data;</text></subparagraph>
<subparagraph id="H7C4730F76EC142B4970FB08EA2C51A43"><enum>(C)</enum><text>the level of accuracy required for the intended use of the data;</text></subparagraph>
<subparagraph id="H74D74A89E59E4C0190568FB2DEAA6177"><enum>(D)</enum><text>any limitations to the data at the required level of accuracy; and</text></subparagraph>
<subparagraph id="H0857C6CBD8394514A876895A11946618"><enum>(E)</enum><text>how the agency will compensate for such limitations if needed to reach the required level of accuracy;</text></subparagraph></paragraph>
<paragraph id="H2AA3CE0E46B44E66B8B6D9B97E4F5197"><enum>(9)</enum><text>describe major management challenges the agency faces and identify—</text>
<subparagraph id="HD862F1F691C246DFBE45603809886F73"><enum>(A)</enum><text>planned actions to address such challenges;</text></subparagraph>
<subparagraph id="HE068FDCDFA3944C58C5212E8B8258145"><enum>(B)</enum><text>performance goals, performance indicators, and milestones to measure progress toward resolving such challenges; and</text></subparagraph>
<subparagraph id="H3294E87DA17046C48174EAA17B68A1B1"><enum>(C)</enum><text>the agency official responsible for resolving such challenges; and</text></subparagraph></paragraph>
<paragraph id="H1537B8DBD3C44F52AED13F2AF6CFB5BF"><enum>(10)</enum><text>identify low-priority program activities based on an analysis of their contribution to the mission and goals of the agency and include an evidence-based justification for designating a program activity as low priority.</text></paragraph></subsection>
<subsection id="HED539B091B8E4DAD876D17C03D705C9D"><enum>(c)</enum><header>Alternative form</header><text>If an agency, in consultation with the Director of the Office of Management and Budget, determines that it is not feasible to express the performance goals for a particular program activity in an objective, quantifiable, and measurable form, the Director of the Office of Management and Budget may authorize an alternative form. Such alternative form shall—</text>
<paragraph id="H20E2569463CB4EC3BC76157F21CFD2B3"><enum>(1)</enum><text>include separate descriptive statements of—</text>
<subparagraph id="HD1051BABEA8A41279F866780CE32F194"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="HA9AB1E9720574115A571A71B63794D50"><enum>(i)</enum><text>a minimally effective program; and</text></clause>
<clause id="HF604F867A03C44FCB1243334B358ABE3" indent="up1"><enum>(ii)</enum><text>a successful program; or</text></clause></subparagraph>
<subparagraph id="HC3EF19B431ED4F6587C42877CA75B933"><enum>(B)</enum><text>such alternative as authorized by the Director of the Office of Management and Budget, with sufficient precision and in such terms that would allow for an accurate, independent determination of whether the program activity’s performance meets the criteria of the description; or</text></subparagraph></paragraph>
<paragraph id="H86218A5FA2D145ABBFCD54E814553A2E"><enum>(2)</enum><text>state why it is infeasible or impractical to express a performance goal in any form for the program activity.</text></paragraph></subsection>
<subsection id="HA81648EFB38F41F3B1DAFE7088F894DD"><enum>(d)</enum><header>Treatment of program activities</header><text>For the purpose of complying with this section, an agency may aggregate, disaggregate, or consolidate program activities, except that any aggregation or consolidation may not omit or minimize the significance of any program activity constituting a major function or operation for the agency.</text></subsection>
<subsection id="H4C3EB63C9E194C36AB6B93F1930C6E65"><enum>(e)</enum><header>Appendix</header><text>An agency may submit with an annual performance plan an appendix covering any portion of the plan that—</text>
<paragraph id="HB18F9C0DF8FA446BB716A0D8F8ACBB76"><enum>(1)</enum><text>is specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign policy; and</text></paragraph>
<paragraph id="H7E9F524875E3402EA48FF31BEA8655FE"><enum>(2)</enum><text>is properly classified pursuant to such Executive order.</text></paragraph></subsection>
<subsection id="H76D09F4DC956491CB86C56E121C2234A"><enum>(f)</enum><header>Inherently governmental functions</header><text>The functions and activities of this section shall be considered to be inherently governmental functions. The drafting of performance plans under this section shall be performed only by Federal employees.</text></subsection>
<subsection id="H2A85FA5592CC4EA49E6721EDBD7AF0B2"><enum>(g)</enum><header>Chief Human Capital Officers</header><text>With respect to each agency with a Chief Human Capital Officer, the Chief Human Capital Officer shall prepare that portion of the annual performance plan described under subsection (b)(5)(A).</text></subsection>
<subsection id="HB33683EB873146C99B3AC2C0EC65A3B6"><enum>(h)</enum><header>Definitions</header><text>For purposes of this section and sections 1116 through 1125, and sections 9703 and 9704, the term—</text>
<paragraph id="H8AA21D16763A4553B1A52DB5FE5749B3"><enum>(1)</enum><text><term>agency</term> has the same meaning as such term is defined under section 306(f) of title 5;</text></paragraph>
<paragraph id="H58D811772AA94C3D88B0EA474D0F630A"><enum>(2)</enum><text><term>crosscutting</term> means across organizational (such as agency) boundaries;</text></paragraph>
<paragraph id="H5D0A08F739324728AF927A4E211D3FBF"><enum>(3)</enum><text><term>customer service measure</term> means an assessment of service delivery to a customer, client, citizen, or other recipient, which can include an assessment of quality, timeliness, and satisfaction among other factors;</text></paragraph>
<paragraph id="HA1BDEE1A36654C169A337447C0CE9584"><enum>(4)</enum><text><term>efficiency measure</term> means a ratio of a program activity’s inputs (such as costs or hours worked by employees) to its outputs (amount of products or services delivered) or outcomes (the desired results of a program);</text></paragraph>
<paragraph id="H2B8E372864B44DC487FF3978C41FC270"><enum>(5)</enum><text><term>major management challenge</term> means programs or management functions, within or across agencies, that have greater vulnerability to waste, fraud, abuse, and mismanagement (such as issues identified by the Government Accountability Office as high risk or issues identified by an Inspector General) where a failure to perform well could seriously affect the ability of an agency or the Government to achieve its mission or goals;</text></paragraph>
<paragraph id="HC7F2CDE1E1E64B1B9618CB74593BACEE"><enum>(6)</enum><text><term>milestone</term> means a scheduled event signifying the completion of a major deliverable or a set of related deliverables or a phase of work;</text></paragraph>
<paragraph id="H8F79F868DE8E4D90B9AC6AE669033820"><enum>(7)</enum><text><term>outcome measure</term> means an assessment of the results of a program activity compared to its intended purpose;</text></paragraph>
<paragraph id="HC487D520E13C478D8639E52667973BAA"><enum>(8)</enum><text><term>output measure</term> means the tabulation, calculation, or recording of activity or effort that can be expressed in a quantitative or qualitative manner;</text></paragraph>
<paragraph id="H38AB9A7E92FB405EAA9E44A068AF09B2"><enum>(9)</enum><text><term>performance goal</term> means a target level of performance expressed as a tangible, measurable objective, against which actual achievement can be compared, including a goal expressed as a quantitative standard, value, or rate;</text></paragraph>
<paragraph id="H92A89EC9CC8540B4949A885A57844CC6"><enum>(10)</enum><text><term>performance indicator</term> means a particular value or characteristic used to measure output or outcome;</text></paragraph>
<paragraph id="H75B62D1E198D4D14839B7FA96D61DA4A"><enum>(11)</enum><text><term>program activity</term> means a specific activity or project as listed in the program and financing schedules of the annual budget of the United States Government; and</text></paragraph>
<paragraph id="H15813559C55E40B896769260A034918B"><enum>(12)</enum><text><term>program evaluation</term> means an assessment, through objective measurement and systematic analysis, of the manner and extent to which Federal programs achieve intended objectives.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H5CEE128C586A4A4EAD4CCFA0509E130C"><enum>4.</enum><header>Performance reporting amendments</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by striking section 1116 and inserting the following:</text>

<section id="HA9763B4B3DCF4879A36CD8C03BF40BC1"><enum>1116.</enum><header>Agency performance reporting</header>
<subsection id="HC2C59139E1D8442B98E3E2D8F0F9FB34"><enum>(a)</enum><text>The head of each agency shall make available on a public website of the agency and to the Office of Management and Budget an update on agency performance.</text></subsection>
<subsection id="H5E0B1118A4204AF8BA75EF22C7229DB5"><enum>(b)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="HC3F295ADC7D34EA4A942EA1F7D1FE329"><enum>(1)</enum><text>Each update shall compare actual performance achieved with the performance goals established in the agency performance plan under section 1115(b) and shall occur no less than 150 days after the end of each fiscal year, with more frequent updates of actual performance on indicators that provide data of significant value to the Government, Congress, or program partners at a reasonable level of administrative burden.</text></paragraph>
<paragraph id="H510FD05D36B1431A92A157CE5DFE3E27" indent="up1"><enum>(2)</enum><text>If performance goals are specified in an alternative form under section 1115(c), the results shall be described in relation to such specifications, including whether the performance failed to meet the criteria of a minimally effective or successful program.</text></paragraph></subsection>
<subsection id="H0ADBCB6AC3494EA7B8DCBCEFD337B80C"><enum>(c)</enum><text>Each update shall—</text>
<paragraph id="H3007131B08F64DD8AECC02ECA1BAE15D"><enum>(1)</enum><text>review the success of achieving the performance goals and include actual results for the 5 preceding fiscal years;</text></paragraph>
<paragraph id="HFEAC0D4E3F454C28BFDF7F7A8C907A61"><enum>(2)</enum><text>evaluate the performance plan for the current fiscal year relative to the performance achieved toward the performance goals during the period covered by the update;</text></paragraph>
<paragraph id="H47FB21BB8A5443A98693D80F161AAF65"><enum>(3)</enum><text>explain and describe where a performance goal has not been met (including when a program activity’s performance is determined not to have met the criteria of a successful program activity under section 1115(c)(1)(A)(ii) or a corresponding level of achievement if another alternative form is used)—</text>
<subparagraph id="H7000454915DA47A0BF68A7BC7B809E35"><enum>(A)</enum><text>why the goal was not met;</text></subparagraph>
<subparagraph id="HA958667DED9C484BBE22FC28AADBAAEC"><enum>(B)</enum><text>those plans and schedules for achieving the established performance goal; and</text></subparagraph>
<subparagraph id="HF1745D6DB17140959DD59F7248DBD717"><enum>(C)</enum><text>if the performance goal is impractical or infeasible, why that is the case and what action is recommended;</text></subparagraph></paragraph>
<paragraph id="H2EAF813425FF4D779826270026F53508"><enum>(4)</enum><text>describe the use and assess the effectiveness in achieving performance goals of any waiver under section 9703 of this title;</text></paragraph>
<paragraph id="H44DA8A55EFFE4F34BCBF24B2E40501B7"><enum>(5)</enum><text>include a review of the performance goals and evaluation of the performance plan relative to the agency’s strategic human capital management;</text></paragraph>
<paragraph id="H36536D3ACC424BC28E2FF8D08E4BD755"><enum>(6)</enum><text>describe how the agency ensures the accuracy and reliability of the data used to measure progress towards its performance goals, including an identification of—</text>
<subparagraph id="HD404CF4823F148559DE4047F13C10737"><enum>(A)</enum><text>the means used to verify and validate measured values;</text></subparagraph>
<subparagraph id="H0BABE988E6E34F2287B0E7D467C95CD4"><enum>(B)</enum><text>the sources for the data;</text></subparagraph>
<subparagraph id="H86BE28CF822D4E92BE2FCE280C0D84AC"><enum>(C)</enum><text>the level of accuracy required for the intended use of the data;</text></subparagraph>
<subparagraph id="HA30EFF717B6E4CB3B31F9B8665D9DE80"><enum>(D)</enum><text>any limitations to the data at the required level of accuracy; and</text></subparagraph>
<subparagraph id="H1291A14031F84E27B599F945F2C0F9A4"><enum>(E)</enum><text>how the agency has compensated for such limitations if needed to reach the required level of accuracy; and</text></subparagraph></paragraph>
<paragraph id="H449F3EF44307422D8E2F2B1827548124"><enum>(7)</enum><text>include the summary findings of those program evaluations completed during the period covered by the update.</text></paragraph></subsection>
<subsection id="HA306AE96EA0E42589309280B5DAE7808"><enum>(d)</enum><text>If an agency performance update includes any program activity or information that is specifically authorized under criteria established by an Executive Order to be kept secret in the interest of national defense or foreign policy and is properly classified pursuant to such Executive Order, the head of the agency shall make such information available in the classified appendix provided under section 1115(e).</text></subsection>
<subsection id="H3D37E426C68E466FA71F41552AE3083C"><enum>(e)</enum><text>The functions and activities of this section shall be considered to be inherently governmental functions. The drafting of agency performance updates under this section shall be performed only by Federal employees.</text></subsection>
<subsection id="H47E5511EFD6147B29E40F57B601453F2"><enum>(f)</enum><text>Each fiscal year, the Office of Management and Budget shall determine whether the agency programs or activities meet performance goals and objectives outlined in the agency performance plans and submit a report on unmet goals to—</text>
<paragraph id="H7D4D09B17995418EB72F581FACCCCDA0"><enum>(1)</enum><text>the head of the agency;</text></paragraph>
<paragraph id="HAA118AA1BCDF4A79B097173EA7AFE1B2"><enum>(2)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></paragraph>
<paragraph id="HF5FE385B45FB4158A950FC73248D6557"><enum>(3)</enum><text>the Committee on Oversight and Governmental Reform of the House of Representatives; and</text></paragraph>
<paragraph id="H33D47B01BD584251A05F85E2B8F62FB5"><enum>(4)</enum><text>the Government Accountability Office.</text></paragraph></subsection>
<subsection id="HB5CCD41F8F8A47858B202B78377BCCEF"><enum>(g)</enum><text>If an agency’s programs or activities have not met performance goals as determined by the Office of Management and Budget for 1 fiscal year, the head of the agency shall submit a performance improvement plan to the Office of Management and Budget to increase program effectiveness for each unmet goal with measurable milestones. The agency shall designate a senior official who shall oversee the performance improvement strategies for each unmet goal.</text></subsection>
<subsection id="HDB76AECC79CA4815832CD57FCD7E4ED0"><enum>(h)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="H258A3296E0AC4D1D863AE3A5AB1386CA"><enum>(1)</enum><text>If the Office of Management and Budget determines that agency programs or activities have unmet performance goals for 2 consecutive fiscal years, the head of the agency shall—</text>
<subparagraph id="H2F4ADB26DF884261AD6085CDD59E72EC" indent="up1"><enum>(A)</enum><text>submit to Congress a description of the actions the Administration will take to improve performance, including proposed statutory changes or planned executive actions; and</text></subparagraph>
<subparagraph id="H8E296DF401824B30A1D1BD9156B6D407" indent="up1"><enum>(B)</enum><text>describe any additional funding the agency will obligate to achieve the goal, if such an action is determined appropriate in consultation with the Director of the Office of Management and Budget, for an amount determined appropriate by the Director.</text></subparagraph></paragraph>
<paragraph id="H1990CBC5CED84691891D2C47FEF84176" indent="up1"><enum>(2)</enum><text>In providing additional funding described under paragraph (1)(B), the head of the agency shall use any reprogramming or transfer authority available to the agency. If after exercising such authority additional funding is necessary to achieve the level determined appropriate by the Director of the Office of Management and Budget, the head of the agency shall submit a request to Congress for additional reprogramming or transfer authority.</text></paragraph></subsection>
<subsection id="H1BB61E4C45584910B688E4D5A7250939"><enum>(i)</enum><text>If an agency’s programs or activities have not met performance goals as determined by the Office of Management and Budget for 3 consecutive fiscal years, the Director of the Office of Management and Budget shall submit recommendations to Congress on actions to improve performance not later than 60 days after that determination, including—</text>
<paragraph id="HF25E62EF2F6D4A03B74B76B95F989C25"><enum>(1)</enum><text>reauthorization proposals for each program or activity that has not met performance goals;</text></paragraph>
<paragraph id="HF3B02C507903468DA640D102468A992F"><enum>(2)</enum><text>proposed statutory changes necessary for the program activities to achieve the proposed level of performance on each performance goal; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H95704030D008466DBD48D1FC0675FBF0"><enum>(3)</enum><text>planned executive actions or identification of the program for termination or reduction in the President’s budget.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H357D7AD3039B410CB840C83C221A90B9"><enum>5.</enum><header>Federal Government and agency priority goals</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by adding after section 1119 the following:</text>
<quoted-block display-inline="no-display-inline" id="HDA5C80F776904BB69BEFBBABB7CB5AED" style="USC">
<section id="H1C46DCE344AA4F4A843C4D9D21393513"><enum>1120.</enum><header>Federal Government and agency priority goals</header>
<subsection id="H828A6134B22E4B6F9C0C64EA6C926097"><enum>(a)</enum><header>Federal government priority goals</header>
<paragraph id="H5D750FD14287426C90742CDBE3D0BAB9"><enum>(1)</enum><text>The Director of the Office of Management and Budget shall coordinate with agencies to develop priority goals to improve the performance and management of the Federal Government. Such Federal Government priority goals shall include—</text>
<subparagraph id="HD2E663B8C11C473AA0001215E607045D"><enum>(A)</enum><text>outcome-oriented goals covering a limited number of crosscutting policy areas; and</text></subparagraph>
<subparagraph id="H2E24A62E452F49A38889A628DCE9B504"><enum>(B)</enum><text>goals for management improvements needed across the Federal Government, including—</text>
<clause id="H33E85B5A0DFF4872824B6C0ABCEF2E9F"><enum>(i)</enum><text>financial management;</text></clause>
<clause id="HC7A47AF29FE3408C9488A7AD29E3E564"><enum>(ii)</enum><text>human capital management;</text></clause>
<clause id="HCDE85B41222E4F5B81B7F0B047707C87"><enum>(iii)</enum><text>information technology management;</text></clause>
<clause id="HFB5B4BDDB5B3424DA3F33861BF668140"><enum>(iv)</enum><text>procurement and acquisition management; and</text></clause>
<clause id="HF9A7D082767A464DACD2D2829BCAF4EA"><enum>(v)</enum><text>real property management;</text></clause></subparagraph></paragraph>
<paragraph id="HA9B8497BBCDB4FDC85C8446144C9B62D"><enum>(2)</enum><text>The Federal Government priority goals shall be long-term in nature. At a minimum, the Federal Government priority goals shall be updated or revised every 4 years and made publicly available concurrently with the submission of the budget of the United States Government made in the first full fiscal year following any year in which the term of the President commences under section 101 of title 3. As needed, the Director of the Office of Management and Budget may make adjustments to the Federal Government priority goals to reflect significant changes in the environment in which the Federal Government is operating, with appropriate notification of Congress.</text></paragraph>
<paragraph id="H324AE45ED11E4E57AD4CCE5211D797BE"><enum>(3)</enum><text>When developing or making adjustments to Federal Government priority goals, the Director of the Office of Management and Budget shall consult periodically with the Congress, including obtaining majority and minority views from—</text>
<subparagraph id="HB39E000D1C39415F99701D589A2F2675"><enum>(A)</enum><text>the Committees on Appropriations of the Senate and the House of Representatives;</text></subparagraph>
<subparagraph id="H4829E6D9345C42619B5964F72322A77F"><enum>(B)</enum><text>the Committees on the Budget of the Senate and the House of Representatives;</text></subparagraph>
<subparagraph id="H54ADFB5A998E4632A8E0AC06BB8D579D"><enum>(C)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph>
<subparagraph id="HD8BB89F60ACC4B50B85FA174FBB1F88E"><enum>(D)</enum><text>the Committee on Oversight and Government Reform of the House of Representatives;</text></subparagraph>
<subparagraph id="HCC56CC852C5247D0B0AF5D37FB4A2613"><enum>(E)</enum><text>the Committee on Finance of the Senate;</text></subparagraph>
<subparagraph id="HA87089855DEB4B02B18B851FB9F27FA8"><enum>(F)</enum><text>the Committee on Ways and Means of the House of Representatives; and</text></subparagraph>
<subparagraph id="H1CB445548C7A4016AE0355646077DB46"><enum>(G)</enum><text>any other committees as determined appropriate;</text></subparagraph></paragraph>
<paragraph id="H8884453EB10D4ECE9EC4132C90533DF3"><enum>(4)</enum><text>The Director of the Office of Management and Budget shall consult with the appropriate committees of Congress at least once every 2 years.</text></paragraph>
<paragraph id="H0F291BA7D4E64D3AB3BCF481F0E7E58E"><enum>(5)</enum><text>The Director of the Office of Management and Budget shall make information about the Federal Government priority goals available on the website described under section 1122 of this title.</text></paragraph>
<paragraph id="HD7307F5F3CAC4159BF67152A565C16C6"><enum>(6)</enum><text>The Federal Government performance plan required under section 1115(a) of this title shall be consistent with the Federal Government priority goals.</text></paragraph></subsection>
<subsection id="H6056E94DDDDB40BF9A0090C42B85BDB3"><enum>(b)</enum><header>Agency priority goals</header>
<paragraph id="H5F36F4A633F840F4AC62988093D7EC43"><enum>(1)</enum><text>Every 2 years, the head of each agency listed in section 901(b) of this title, or as otherwise determined by the Director of the Office of Management and Budget, shall identify agency priority goals from among the performance goals of the agency. The Director of the Office of Management and Budget shall determine the total number of agency priority goals across the Government, and the number to be developed by each agency. The agency priority goals shall—</text>
<subparagraph id="H104B944DDB12441EB49BB56B5FC2E6BD"><enum>(A)</enum><text>reflect the highest priorities of the agency, as determined by the head of the agency and informed by the Federal Government priority goals provided under subsection (a) and the consultations with Congress and other interested parties required by section 306(d) of title 5;</text></subparagraph>
<subparagraph id="HDF01A8332E814F75B852D1B2081FB57E"><enum>(B)</enum><text>have ambitious targets that can be achieved within a 2-year period;</text></subparagraph>
<subparagraph id="HF3FB8483C87C4C4C998EE6DA88117E90"><enum>(C)</enum><text>have a clearly identified agency official, known as a goal leader, who is responsible for the achievement of each agency priority goal;</text></subparagraph>
<subparagraph id="HBA2830F4B85E43B786F92C757F4CAA38"><enum>(D)</enum><text>have interim quarterly targets for performance indicators if more frequent updates of actual performance provides data of significant value to the Government, Congress, or program partners at a reasonable level of administrative burden; and</text></subparagraph>
<subparagraph id="H643ACC75ED444F5AB698C5E757CDDE65"><enum>(E)</enum><text>have clearly defined quarterly milestones.</text></subparagraph></paragraph>
<paragraph id="H59F8AB82284248FA9298EB943946B2DD"><enum>(2)</enum><text>If an agency priority goal includes any program activity or information that is specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign policy and is properly classified pursuant to such Executive order, the head of the agency shall make such information available in the classified appendix provided under section 1115(e).</text></paragraph></subsection>
<subsection id="H68F8E64D4F4E43FEA03F73CEB647DA8B"><enum>(c)</enum><text>The functions and activities of this section shall be considered to be inherently governmental functions. <section id="H62941F02901142DD94271ECCAF9DD487"><enum>6.</enum><header>Quarterly priority progress reviews and use of performance information</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by adding after section 1120 (as added by section 5 of this Act) the following:</text>

<section id="HE9A7393C30F741EF9B5F7FACE88A8EB0"><enum>1121.</enum><header>Quarterly priority progress reviews and use of performance information</header>
<subsection id="H091D67DBA02E4BBE9C85251E162CA3BA"><enum>(a)</enum><header>Use of performance information To achieve Federal government priority goals</header><text>Not less than quarterly, the Director of the Office of Management and Budget, with the support of the Performance Improvement Council, shall—</text>
<paragraph id="H27DDAA217DC24175988679955537D4A3"><enum>(1)</enum><text>for each Federal Government priority goal required by section 1120(a) of this title, review with the appropriate lead Government official the progress achieved during the most recent quarter, overall trend data, and the likelihood of meeting the planned level of performance;</text></paragraph>
<paragraph id="H6E018672F4D54020818D67EB40CE1604"><enum>(2)</enum><text>include in such reviews officials from the agencies, organizations, and program activities that contribute to the accomplishment of each Federal Government priority goal;</text></paragraph>
<paragraph id="H22193E746BB84D43A2E716AB558A2FC1"><enum>(3)</enum><text>assess whether agencies, organizations, program activities, regulations, tax expenditures, policies, and other activities are contributing as planned to each Federal Government priority goal;</text></paragraph>
<paragraph id="H7387434AD96F4A32B7C4D6178ADA1CC8"><enum>(4)</enum><text>categorize the Federal Government priority goals by risk of not achieving the planned level of performance; and</text></paragraph>
<paragraph id="H882015FDA0C849799539649297D7165A"><enum>(5)</enum><text>for the Federal Government priority goals at greatest risk of not meeting the planned level of performance, identify prospects and strategies for performance improvement, including any needed changes to agencies, organizations, program activities, regulations, tax expenditures, policies or other activities.</text></paragraph></subsection>
<subsection id="HC8718BA049684823BE81B3BB67A54988"><enum>(b)</enum><header>Agency use of performance information To achieve agency priority goals</header><text>Not less than quarterly, at each agency required to develop agency priority goals required by section 1120(b) of this title, the head of the agency and Chief Operating Officer, with the support of the agency Performance Improvement Officer, shall—</text>
<paragraph id="H0E5E80A54D844CFA9D3A6B4364C87B28"><enum>(1)</enum><text>for each agency priority goal, review with the appropriate goal leader the progress achieved during the most recent quarter, overall trend data, and the likelihood of meeting the planned level of performance;</text></paragraph>
<paragraph id="H4278F55B25824ED68F8C7CBE3CD7ACB0"><enum>(2)</enum><text>coordinate with relevant personnel within and outside the agency who contribute to the accomplishment of each agency priority goal;</text></paragraph>
<paragraph id="HD0AD91ED5C1A44B8B80185FEB370BBBC"><enum>(3)</enum><text>assess whether relevant organizations, program activities, regulations, policies, and other activities are contributing as planned to the agency priority goals;</text></paragraph>
<paragraph id="HC9D4CC08E0DA4E108BCFA3DF66E5B2D8"><enum>(4)</enum><text>categorize agency priority goals by risk of not achieving the planned level of performance; and</text></paragraph>
<paragraph id="HB253A9EBB5524F04BA686439F5F4E584"><enum>(5)</enum><text>for agency priority goals at greatest risk of not meeting the planned level of performance, identify prospects and strategies for performance improvement, including any needed changes to agency program activities, regulations, policies, or other activities.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HEB686E8DE4894C77AFCC48065C5708C8"><enum>7.</enum><header>Transparency of Federal government programs, priority goals, and results</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by adding after section 1121 (as added by section 6 of this Act) the following:</text>

<section id="HB6611B11B1CA45DCB9152896D2AEEFAE"><enum>1122.</enum><header>Transparency of programs, priority goals, and results</header>
<subsection id="H7DCB9D0FC9C1453C82C7B2A39F0657F9"><enum>(a)</enum><header>Transparency of agency programs</header>
<paragraph id="H401AF74CB2DD47AEB9E620A7C5A7388A"><enum>(1)</enum><header>In general</header><text>Not later than October 1, 2012, the Office of Management and Budget shall—</text>
<subparagraph id="HC7F4F490A3944F0AA7983D6CD3F819D4"><enum>(A)</enum><text>ensure the effective operation of a single website;</text></subparagraph>
<subparagraph id="H932F2AC2FD2C43B990AB6D83120FC575"><enum>(B)</enum><text>at a minimum, update the website on a quarterly basis; and</text></subparagraph>
<subparagraph id="HA6F40B07283C48D2B023BD051BADD296"><enum>(C)</enum><text>include on the website information about each program identified by the agencies.</text></subparagraph></paragraph>
<paragraph id="H6A25E26AC25C4591B753E227BFA92ED4"><enum>(2)</enum><header>Information</header><text>Information for each program described under paragraph (1) shall include—</text>
<subparagraph id="H216F6DA25BFF42FEA3B667EC37287FB8"><enum>(A)</enum><text>an identification of how the agency defines the term <quote>program</quote>, consistent with guidance provided by the Director of the Office of Management and Budget, including the program activities that are aggregated, disaggregated, or consolidated to be considered a program by the agency;</text></subparagraph>
<subparagraph id="H35DDF2A2FE7148F79A7B391304BEA0FE"><enum>(B)</enum><text>a description of the purposes of the program and the contribution of the program to the mission and goals of the agency; and</text></subparagraph>
<subparagraph id="H031F058D8E1C4D0E8860C4DEC57A414C"><enum>(C)</enum><text>an identification of funding for the current fiscal year and previous 2 fiscal years.</text></subparagraph></paragraph></subsection>
<subsection id="HE9587ED9C7D5450E8D89F26587371BF0"><enum>(b)</enum><header>Transparency of agency priority goals and results</header><text>The head of each agency required to develop agency priority goals shall make information about each agency priority goal available to the Office of Management and Budget for publication on the website, with the exception of any information covered by section 1120(b)(2) of this title. In addition to an identification of each agency priority goal, the website shall also consolidate information about each agency priority goal, including—</text>
<paragraph id="H054E9452AF904270AC9EC08D04E04D60"><enum>(1)</enum><text>a description of how the agency incorporated any views and suggestions obtained through congressional consultations about the agency priority goal;</text></paragraph>
<paragraph id="H6FB85A863AE34BF1BEF2878D1FEFB1C8"><enum>(2)</enum><text>an identification of key factors external to the agency and beyond its control that could significantly affect the achievement of the agency priority goal;</text></paragraph>
<paragraph id="H631506F98B1E44EC8E77FC0CF9ADC374"><enum>(3)</enum><text>a description of how each agency priority goal will be achieved, including—</text>
<subparagraph id="H557124AA50EE4553A2C5668CDA0BB60A"><enum>(A)</enum><text>the strategies and resources required to meet the priority goal;</text></subparagraph>
<subparagraph id="H6797E0E6B3D04204B4558E658F2ECE01"><enum>(B)</enum><text>clearly defined milestones;</text></subparagraph>
<subparagraph id="H89B8371EA690483ABD6572411488A817"><enum>(C)</enum><text>the organizations, program activities, regulations, policies, and other activities that contribute to each goal, both within and external to the agency;</text></subparagraph>
<subparagraph id="HB9489012BFAE49E487C112EE51C1BA37"><enum>(D)</enum><text>how the agency is working with other agencies to achieve the goal; and</text></subparagraph>
<subparagraph id="HD76516A558AE436591AB19638757F066"><enum>(E)</enum><text>an identification of the agency official responsible for achieving the priority goal;</text></subparagraph></paragraph>
<paragraph id="H6DBABFEFA069416A9CACE1F5DFCAA1D8"><enum>(4)</enum><text>the performance indicators to be used in measuring or assessing progress;</text></paragraph>
<paragraph id="HC09A59FA87E142AD8049A341A173514C"><enum>(5)</enum><text>a description of how the agency ensures the accuracy and reliability of the data used to measure progress towards the priority goal, including an identification of—</text>
<subparagraph id="H9EC93F0CA5434012A955AB752F138C42"><enum>(A)</enum><text>the means used to verify and validate measured values;</text></subparagraph>
<subparagraph id="H279B84435DED44DEBECC047B50247180"><enum>(B)</enum><text>the sources for the data;</text></subparagraph>
<subparagraph id="HDF7CB63DB60142328E443A64FCD48616"><enum>(C)</enum><text>the level of accuracy required for the intended use of the data;</text></subparagraph>
<subparagraph id="H5691D17C939E4EF69761622DBE6C6655"><enum>(D)</enum><text>any limitations to the data at the required level of accuracy; and</text></subparagraph>
<subparagraph id="H57EB8C24C823470C937D39775E4E0A80"><enum>(E)</enum><text>how the agency has compensated for such limitations if needed to reach the required level of accuracy;</text></subparagraph></paragraph>
<paragraph id="H71DDD146ABBE4FE5AD97AC8E912E92FE"><enum>(6)</enum><text>the results achieved during the most recent quarter and overall trend data compared to the planned level of performance;</text></paragraph>
<paragraph id="H4F62BF2240694FA69D10A386A611E6C5"><enum>(7)</enum><text>an assessment of whether relevant organizations, program activities, regulations, policies, and other activities are contributing as planned;</text></paragraph>
<paragraph id="H5F018C626F0843DBA79CE6077C0CC430"><enum>(8)</enum><text>an identification of the agency priority goals at risk of not achieving the planned level of performance; and</text></paragraph>
<paragraph id="HCD67637EF8AB44779BA23C777A44F342"><enum>(9)</enum><text>any prospects or strategies for performance improvement.</text></paragraph></subsection>
<subsection id="H7F42A29F41184D66A20F613713CAFF59"><enum>(c)</enum><header>Transparency of Federal government priority goals and results</header><text>The Director of the Office of Management and Budget shall also make available on the website—</text>
<paragraph id="H5C2E8EE69CAA45258FDFE29C58BE053E"><enum>(1)</enum><text>a brief description of each of the Federal Government priority goals required by section 1120(a) of this title;</text></paragraph>
<paragraph id="HDE7B455715F04A1BAFF3D4D0A0FEE93C"><enum>(2)</enum><text>a description of how the Federal Government priority goals incorporate views and suggestions obtained through congressional consultations;</text></paragraph>
<paragraph id="H9CB60D35393B4DED9CEF9EA0BF757CB1"><enum>(3)</enum><text>the Federal Government performance goals and performance indicators associated with each Federal Government priority goal as required by section 1115(a) of this title;</text></paragraph>
<paragraph id="HED9983E5E59E45B09E9DCED7398E88BA"><enum>(4)</enum><text>an identification of the lead Government official for each Federal Government performance goal;</text></paragraph>
<paragraph id="H4BA2AAAD39854474AFE1EC660B054BF2"><enum>(5)</enum><text>the results achieved during the most recent quarter and overall trend data compared to the planned level of performance;</text></paragraph>
<paragraph id="HA8C5171995424D6AAC8053553D24D183"><enum>(6)</enum><text>an identification of the agencies, organizations, program activities, regulations, tax expenditures, policies, and other activities that contribute to each Federal Government priority goal;</text></paragraph>
<paragraph id="H5BD6A9FF79BB4A5CA113E3ACCF8ED794"><enum>(7)</enum><text>an assessment of whether relevant agencies, organizations, program activities, regulations, tax expenditures, policies, and other activities are contributing as planned;</text></paragraph>
<paragraph id="H7B595CE4C06941E68FC3750EE1A73BA8"><enum>(8)</enum><text>an identification of the Federal Government priority goals at risk of not achieving the planned level of performance; and</text></paragraph>
<paragraph id="HC458DF198D4C4727AAFA4DB58F5232D2"><enum>(9)</enum><text>any prospects or strategies for performance improvement.</text></paragraph></subsection>
<subsection id="H180B7D1578E54A4D873143F5CBB188D1"><enum>(d)</enum><header>Information on website</header><text>The information made available on the website under this section shall be readily accessible and easily found on the Internet by the public and members and committees of Congress. Such information shall also be presented in a searchable, machine-readable format. The Director of the Office of Management and Budget shall issue guidance to ensure that such information is provided in a way that presents a coherent picture of all Federal programs, and the performance of the Federal Government as well as individual agencies.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H1A03E6B2BB284B9499CA983029F7C0A8"><enum>8.</enum><header>Agency Chief Operating Officers</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by adding after section 1122 (as added by section 7 of this Act) the following:</text>
<quoted-block display-inline="no-display-inline" id="HCC0F940A55F14672954670A7F86303EC" style="USC">
<section id="HBD95D6B9A59149AE9DCF2B1544950278"><enum>1123.</enum><header>Chief Operating Officers</header>
<subsection id="HEC1E0FC726A141DFBFECD5D3749948AA"><enum>(a)</enum><header>Establishment</header><text>At each agency, the deputy head of agency, or equivalent, shall be the Chief Operating Officer of the agency.</text></subsection>
<subsection id="H0CDAFFE414BA4D5F8C56A0C1038B13AA"><enum>(b)</enum><header>Function</header><text>Each Chief Operating Officer shall be responsible for improving the management and performance of the agency, and shall—</text>
<paragraph id="H4F0B6494639D488DB979C0E686C37761"><enum>(1)</enum><text>provide overall organization management to improve agency performance and achieve the mission and goals of the agency through the use of strategic and performance planning, measurement, analysis, regular assessment of progress, and use of performance information to improve the results achieved;</text></paragraph>
<paragraph id="HC3EA377FEDB644F6BE5D5107DF1A56DD"><enum>(2)</enum><text>advise and assist the head of agency in carrying out the requirements of sections 1115 through 1122 of this title and section 306 of title 5;</text></paragraph>
<paragraph id="HC054C111CCD54CE0B52C4508D56A7A14"><enum>(3)</enum><text>oversee agency-specific efforts to improve management functions within the agency and across Government; and</text></paragraph>
<paragraph id="H26F1566D27B04E3092D63B320911D99D"><enum>(4)</enum><text>coordinate and collaborate with relevant personnel within and external to the agency who have a significant role in contributing to and achieving the mission and goals of the agency, such as the Chief Financial Officer, Chief Human Capital Officer, Chief Acquisition Officer/Senior Procurement Executive, Chief Information Officer, and other line of business chiefs at the agency.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HA6C86E05D33C4A8892BBB6E3C6511E98"><enum>9.</enum><header>Agency Performance Improvement Officers and the Performance Improvement Council</header><text display-inline="no-display-inline">Chapter 11 of title 31, United States Code, is amended by adding after section 1123 (as added by section 8 of this Act) the following:</text>

<section id="H355751C2720F491D847F20A77DFF102D"><enum>1124.</enum><header>Performance Improvement Officers and the Performance Improvement Council</header>
<subsection id="HD7F879C3575649359D7F2E83196279AA"><enum>(a)</enum><header>Performance improvement officers</header>
<paragraph id="HD5E9312A0C364151AB31086E2ACF8D03"><enum>(1)</enum><header>Establishment</header><text>At each agency, the head of the agency, in consultation with the agency Chief Operating Officer, shall designate a senior executive of the agency as the agency Performance Improvement Officer.</text></paragraph>
<paragraph id="HBF5CBB8220024386BCD6796923BBA11B"><enum>(2)</enum><header>Function</header><text>Each Performance Improvement Officer shall report directly to the Chief Operating Officer. Subject to the direction of the Chief Operating Officer, each Performance Improvement Officer shall—</text>
<subparagraph id="H03E2600E7BD14CA0967AE5CC4D092C1D"><enum>(A)</enum><text>advise and assist the head of the agency and the Chief Operating Officer to ensure that the mission and goals of the agency are achieved through strategic and performance planning, measurement, analysis, regular assessment of progress, and use of performance information to improve the results achieved;</text></subparagraph>
<subparagraph id="H3300F198CF3E437E819AAAF9F5FC6D86"><enum>(B)</enum><text>advise the head of the agency and the Chief Operating Officer on the selection of agency goals, including opportunities to collaborate with other agencies on common goals;</text></subparagraph>
<subparagraph id="HF9DA4D381D624756B6AF55653425CCD1"><enum>(C)</enum><text>assist the head of the agency and the Chief Operating Officer in overseeing the implementation of the agency strategic planning, performance planning, and reporting requirements provided under sections 1115 through 1122 of this title and sections 306 of title 5, including the contributions of the agency to the Federal Government priority goals;</text></subparagraph>
<subparagraph id="H2D6FE3CE1F764F7495664A48E6F0ADEB"><enum>(D)</enum><text>support the head of agency and the Chief Operating Officer in the conduct of regular reviews of agency performance, including at least quarterly reviews of progress achieved toward agency priority goals, if applicable;</text></subparagraph>
<subparagraph id="HC9D9ACB21E3848BFB0A0D2D9FF7A92BB"><enum>(E)</enum><text>assist the head of the agency and the Chief Operating Officer in the development and use within the agency of performance measures in personnel performance appraisals, and, as appropriate, other agency personnel and planning processes and assessments; and</text></subparagraph>
<subparagraph id="HCF58B84A2D0F407DBCD6D80D3B1AF63C"><enum>(F)</enum><text>ensure that agency progress toward the achievement of all goals is communicated to leaders, managers, and employees in the agency and Congress, and made available on a public website of the agency.</text></subparagraph></paragraph></subsection>
<subsection id="H7B089C33565540B08640084EB8CF8E58"><enum>(b)</enum><header>Performance improvement council</header>
<paragraph id="H01AC4E011A9E45D5A3440213C7CB0767"><enum>(1)</enum><header>Establishment</header><text>There is established a Performance Improvement Council, consisting of—</text>
<subparagraph id="H0AB920B158984138A0707290C817F5AD"><enum>(A)</enum><text>the Deputy Director for Management of the Office of Management and Budget, who shall act as chairperson of the Council;</text></subparagraph>
<subparagraph id="HF3F33C38A444479CBF2927843406575E"><enum>(B)</enum><text>the Performance Improvement Officer from each agency defined in section 901(b) of this title;</text></subparagraph>
<subparagraph id="H4C2E3011502C41F9AFDF1A8E6BF6765A"><enum>(C)</enum><text>other Performance Improvement Officers as determined appropriate by the chairperson; and</text></subparagraph>
<subparagraph id="HB2DB0F490243433FAC8BF7CC78A75713"><enum>(D)</enum><text>other individuals as determined appropriate by the chairperson.</text></subparagraph></paragraph>
<paragraph id="H9F649945C0CB461ABB4C0AAA9ADE171A"><enum>(2)</enum><header>Function</header><text>The Performance Improvement Council shall—</text>
<subparagraph id="HB4E49E27D64C4E1FBF551D311E528EA5"><enum>(A)</enum><text>be convened by the chairperson or the designee of the chairperson, who shall preside at the meetings of the Performance Improvement Council, determine its agenda, direct its work, and establish and direct subgroups of the Performance Improvement Council, as appropriate, to deal with particular subject matters;</text></subparagraph>
<subparagraph id="H0CFF0F1B69BE4AEA8C2387607E2E9B61"><enum>(B)</enum><text>assist the Director of the Office of Management and Budget to improve the performance of the Federal Government and achieve the Federal Government priority goals;</text></subparagraph>
<subparagraph id="H7DFE75897842426EA7EBEC9EEC12DC45"><enum>(C)</enum><text>assist the Director of the Office of Management and Budget in implementing the planning, reporting, and use of performance information requirements related to the Federal Government priority goals provided under sections 1115, 1120, 1121, and 1122 of this title;</text></subparagraph>
<subparagraph id="H9BC85823860E42639405AE6EB5A9BC96"><enum>(D)</enum><text>work to resolve specific Governmentwide or crosscutting performance issues, as necessary;</text></subparagraph>
<subparagraph id="H9297427761E24C06AB645C8B09C47AD1"><enum>(E)</enum><text>facilitate the exchange among agencies of practices that have led to performance improvements within specific programs, agencies, or across agencies;</text></subparagraph>
<subparagraph id="HC7BA644CD9614FBBAD2E51D0BC7ABE95"><enum>(F)</enum><text>coordinate with other interagency management councils;</text></subparagraph>
<subparagraph id="HF7D5B9D30D5B4A9CB637B07AB1932FFB"><enum>(G)</enum><text>seek advice and information as appropriate from nonmember agencies, particularly smaller agencies;</text></subparagraph>
<subparagraph id="HCC78DC185BDF4805AECFB8633E66C5CC"><enum>(H)</enum><text>consider the performance improvement experiences of corporations, nonprofit organizations, foreign, State, and local governments, Government employees, public sector unions, and customers of Government services;</text></subparagraph>
<subparagraph id="H2F1AF48488BB443386A8B1B38911685E"><enum>(I)</enum><text>receive such assistance, information and advice from agencies as the Council may request, which agencies shall provide to the extent permitted by law; and</text></subparagraph>
<subparagraph id="HFF5D14BBED2F470DB20926B0D1B215F4"><enum>(J)</enum><text>develop and submit to the Director of the Office of Management and Budget, or when appropriate to the President through the Director of the Office of Management and Budget, at times and in such formats as the chairperson may specify, recommendations to streamline and improve performance management policies and requirements.</text></subparagraph></paragraph>
<paragraph id="H03A7EF54F4DD4853894B0154390DC87A"><enum>(3)</enum><header>Support</header>
<subparagraph id="H31049A5DF275434DB2F7323E6F64D2D1"><enum>(A)</enum><header>In general</header><text>The Administrator of General Services shall provide administrative and other support for the Council to implement this section.</text></subparagraph>
<subparagraph id="HF10D3E8254274538850F6652F3F6E728"><enum>(B)</enum><header>Personnel</header><text>The heads of agencies with Performance Improvement Officers serving on the Council shall, as appropriate and to the extent permitted by law, provide at the request of the chairperson of the Performance Improvement Council up to 2 personnel authorizations to serve at the direction of the chairperson.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H5A6C32E04CEA4BE1A896D552CE846BAC"><enum>10.</enum><header>Format of performance plans and reports</header>
<subsection id="HA1ADE8852C4847C7AFC06588E5EB0F42"><enum>(a)</enum><header>Searchable, machine-readable plans and reports</header><text>For fiscal year 2012 and each fiscal year thereafter, each agency required to produce strategic plans, performance plans, and performance updates in accordance with the amendments made by this Act shall—</text>
<paragraph id="H2B9F169CE1E745E9BFA49A82234DE292"><enum>(1)</enum><text>not incur expenses for the printing of strategic plans, performance plans, and performance reports for release external to the agency, except when providing such documents to the Congress;</text></paragraph>
<paragraph id="H60C6BE75161D4DCFAAC13272E2D3CAB6"><enum>(2)</enum><text>produce such plans and reports in searchable, machine-readable formats; and</text></paragraph>
<paragraph id="HEC13D08C18EE405C9B4DA3D152BF5BAE"><enum>(3)</enum><text>make such plans and reports available on the website described under section 1122 of title 31, United States Code.</text></paragraph></subsection>
<subsection id="H3F1DFA461EE646E59FD73B6763B38D60"><enum>(b)</enum><header>Web-based performance planning and reporting</header>
<paragraph id="H5B07670692234AC0986DF36A0729B5A2"><enum>(1)</enum><header>In general</header><text>Not later than June 1, 2012, the Director of the Office of Management and Budget shall issue guidance to agencies to provide concise and timely performance information for publication on the website described under section 1122 of title 31, United States Code, including, at a minimum, all requirements of sections 1115 and 1116 of title 31, United States Code, except for section 1115(e).</text></paragraph>
<paragraph id="H9EC0C8485F09429EBC1DD76C8BDD6989"><enum>(2)</enum><header>High-priority goals</header><text>For agencies required to develop agency priority goals under section 1120(b) of title 31, United States Code, the performance information required under this section shall be merged with the existing information required under section 1122 of title 31, United States Code.</text></paragraph>
<paragraph id="H435F3B2D1FD1401F945B0A4F68600A49"><enum>(3)</enum><header>Considerations</header><text>In developing guidance under this subsection, the Director of the Office of Management and Budget shall take into consideration the experiences of agencies in making consolidated performance planning and reporting information available on the website as required under section 1122 of title 31, United States Code.</text></paragraph></subsection></section>
<section id="HA9B299EC34FA4B9BB253AEA88DD47919"><enum>11.</enum><header>Reducing duplicative and outdated agency reporting</header>
<subsection id="H1B0A75F4A11E46199871D67EBAAC8D9C"><enum>(a)</enum><header>Budget contents</header><text>Section 1105(a) of title 31, United States Code, is amended—</text>
<paragraph id="HBF8AF59C8D404B5494C020CF363D27C6"><enum>(1)</enum><text>by redesignating second paragraph (33) as paragraph (35); and</text></paragraph>
<paragraph id="HBB50C594BB484E7B8E31ACA57CB97A45"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H6D43EDA253F9452BA0FD2027B91531D6" style="OLC">
<paragraph id="HF012B22EF9CF42BD8FDF29C23001D948"><enum>(37)</enum><text>the list of plans and reports, as provided for under section 1125, that agencies identified for elimination or consolidation because the plans and reports are determined outdated or duplicative of other required plans and reports.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H0F8B3C018FA84CB48E7AA31BEF906CAA"><enum>(b)</enum><header>Elimination of unnecessary agency reporting</header><text>Chapter 11 of title 31, United States Code, is further amended by adding after section 1124 (as added by section 9 of this Act) the following:</text>

<section id="H455F50153EAC4DAF9163B1E34E0D1343"><enum>1125.</enum><header>Elimination of unnecessary agency reporting</header>
<subsection id="HFA243E530ED5468997340AFF54BEA88E"><enum>(a)</enum><header>Agency identification of unnecessary reports</header><text>Annually, based on guidance provided by the Director of the Office of Management and Budget, the Chief Operating Officer at each agency shall—</text>
<paragraph id="H7F4CEE0C2F3B4EBCBAC458940701DEA3"><enum>(1)</enum><text>compile a list that identifies all plans and reports the agency produces for Congress, in accordance with statutory requirements or as directed in congressional reports;</text></paragraph>
<paragraph id="H3DFDC19529E24B2D95AA5E0B4322FDAB"><enum>(2)</enum><text>analyze the list compiled under paragraph (1), identify which plans and reports are outdated or duplicative of other required plans and reports, and refine the list to include only the plans and reports identified to be outdated or duplicative;</text></paragraph>
<paragraph id="H5BEC48D2632F428EAB470E501214BD0D"><enum>(3)</enum><text>consult with the congressional committees that receive the plans and reports identified under paragraph (2) to determine whether those plans and reports are no longer useful to the committees and could be eliminated or consolidated with other plans and reports; and</text></paragraph>
<paragraph id="HA092B59ACAFB4D34B25863792EF8664A"><enum>(4)</enum><text>provide a total count of plans and reports compiled under paragraph (1) and the list of outdated and duplicative reports identified under paragraph (2) to the Director of the Office of Management and Budget.</text></paragraph></subsection>
<subsection id="H9052F9D2CE0343839E8E3D923996551E"><enum>(b)</enum><header>Plans and reports</header>
<paragraph id="H319EE6BE829A477D850CC88EBAC3BEF6"><enum>(1)</enum><header>First year</header><text>During the first year of implementation of this section, the list of plans and reports identified by each agency as outdated or duplicative shall be not less than 10 percent of all plans and reports identified under subsection (a)(1).</text></paragraph>
<paragraph id="H5C95DBC47F6944E99AF766242CF6ED66"><enum>(2)</enum><header>Subsequent years</header><text>In each year following the first year described under paragraph (1), the Director of the Office of Management and Budget shall determine the minimum percent of plans and reports to be identified as outdated or duplicative on each list of plans and reports.</text></paragraph></subsection>
<subsection id="H60E4B02A4A674FD1B485150C89667717"><enum>(c)</enum><header>Request for elimination of unnecessary reports</header><text>In addition to including the list of plans and reports determined to be outdated or duplicative by each agency in the budget of the United States Government, as provided by section 1105(a)(37), the Director of the Office of Management and Budget may concurrently submit to Congress legislation to eliminate or consolidate such plans and reports.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H061EAC616BE04AA68295A6C4B5C07434"><enum>12.</enum><header>Performance management skills and competencies</header>
<subsection id="H60013EEB702A49268CFA0C5DE0A21D0D"><enum>(a)</enum><header>Performance management skills and competencies</header><text>Not later than 1 year after the date of enactment of this Act, the Director of the Office of Personnel Management, in consultation with the Performance Improvement Council, shall identify the key skills and competencies needed by Federal Government personnel for developing goals, evaluating programs, and analyzing and using performance information for the purpose of improving Government efficiency and effectiveness.</text></subsection>
<subsection id="HD8E01AF4E09545839135B46A5983751F"><enum>(b)</enum><header>Position classifications</header><text>Not later than 2 years after the date of enactment of this Act, based on the identifications under subsection (a), the Director of the Office of Personnel Management shall incorporate, as appropriate, such key skills and competencies into relevant position classifications.</text></subsection>
<subsection id="H537EF8720FDB43A9AC301FFB8EA2A84B"><enum>(c)</enum><header>Incorporation into existing agency training</header><text>Not later than 2 years after the enactment of this Act, the Director of the Office of Personnel Management shall work with each agency, as defined under section 306(f) of title 5, United States Code, to incorporate the key skills identified under subsection (a) into training for relevant employees at each agency.</text></subsection></section>

<paragraph id="H60B87DCB5970438F9EA04EA8DE252D49"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Management and Budget shall coordinate with agencies to develop interim Federal Government priority goals and submit interim Federal Government performance plans consistent with the requirements of this Act beginning with the submission of the fiscal year 2013 Budget of the United States Government.</text></paragraph>
<paragraph id="HACC2FA01B55840089448A862151DC102"><enum>(2)</enum><header>Requirements</header><text>Each agency shall—</text>
<subparagraph id="H9D4F4E96078C41CDBE5E3F5F6BD74746"><enum>(A)</enum><text>not later than February 6, 2012, make adjustments to its strategic plan to make the plan consistent with the requirements of this Act;</text></subparagraph>
<subparagraph id="H468CEBF2E5854871B30AAD16F9BF71C8"><enum>(B)</enum><text>prepare and submit performance plans consistent with the requirements of this Act, including the identification of agency priority goals, beginning with the performance plan for fiscal year 2013; and</text></subparagraph>
<subparagraph id="H6C47C47F01EB4A54A173C7509D08FC25"><enum>(C)</enum><text>make performance reporting updates consistent with the requirements of this Act beginning in fiscal year 2012.</text></subparagraph></paragraph>
<paragraph id="H37A0668EC8074ED6B7D83E1819EAD737"><enum>(3)</enum><header>Quarterly reviews</header><text>The quarterly priority progress reviews required under this Act shall begin—</text>
<subparagraph id="H82978C71E7B3401D84CA7F9BA35D5AFF"><enum>(A)</enum><text>with the first full quarter beginning on or after the date of enactment of this Act for agencies based on the agency priority goals contained in the Analytical Perspectives volume of the Fiscal Year 2011 Budget of the United States Government; and</text></subparagraph>
<subparagraph id="HA82D96DFF1C0475883C2AF1DA85EBFAB"><enum>(B)</enum><text>with the quarter ending June 30, 2012 for the interim Federal Government priority goals.</text></subparagraph></paragraph></subsection>
<subsection id="HA390B944828544979119FC7088E5B377"><enum>(b)</enum><header>Guidance</header><text>The Director of the Office of Management and Budget shall prepare guidance for agencies in carrying out the interim planning and reporting activities required under subsection (a), in addition to other guidance as required for implementation of this Act.</text></subsection></section>
<section id="HD0B4D19D0D2A481CB53885B06FB35EF0"><enum>15.</enum><header>Congressional oversight and legislation</header>
<subsection id="H9BECAE8923E246D49ED5F6C81EDCF336"><enum>(a)</enum><header>In general</header><text>Nothing in this Act shall be construed as limiting the ability of Congress to establish, amend, suspend, or annul a goal of the Federal Government or an agency.</text></subsection>
<subsection id="HDF2EA8E964F947F788258D681563D028"><enum>(b)</enum><header>GAO Reviews</header>
<paragraph id="HAFE4E6250100412AA60755B5451F24B5"><enum>(1)</enum><header>Interim planning and reporting evaluation</header><text>Not later than June 30, 2013, the Comptroller General shall submit a report to Congress that includes—</text>
<subparagraph id="H2DB934FAB6834068B3C0B29AEF80BBD0"><enum>(A)</enum><text>an evaluation of the implementation of the interim planning and reporting activities conducted under section 14 of this Act; and</text></subparagraph>
<subparagraph id="H051ECF43537B4B7384E45B9629B28989"><enum>(B)</enum><text>any recommendations for improving implementation of this Act as determined appropriate.</text></subparagraph></paragraph>
<paragraph id="HAC94121F1FB543649E4D537249891C80"><enum>(2)</enum><header>Implementation evaluations</header>
<subparagraph id="HAE3905774A4F46BDB3346D673BEF43F3"><enum>(A)</enum><header>In general</header><text>The Comptroller General shall evaluate the implementation of this Act subsequent to the interim planning and reporting activities evaluated in the report submitted to Congress under paragraph (1).</text></subparagraph>
<subparagraph id="H98F6EC2F589447BD8BD4C54AF3EFFB6C"><enum>(B)</enum><header>Agency implementation</header>
<clause id="H28D69C91F0F94309A7CF07F00A7F65C5"><enum>(i)</enum><header>Evaluations</header><text>The Comptroller General shall evaluate how implementation of this Act is affecting performance management at the agencies described in section 901(b) of title 31, United States Code, including whether performance management is being used by those agencies to improve the efficiency and effectiveness of agency programs.</text></clause>
<clause id="H423E327F4D5A4CDDA68C101BB2E21632"><enum>(ii)</enum><header>Reports</header><text>The Comptroller General shall submit to Congress—</text>
<subclause id="H591DBC95FF514D89B37203B7A9D20066"><enum>(I)</enum><text>an initial report on the evaluation under clause (i), not later than September 30, 2015; and</text></subclause>
<subclause id="H0CDBE23028CD4582B9E8764CC70AF014"><enum>(II)</enum><text>a subsequent report on the evaluation under clause (i), not later than September 30, 2017.</text></subclause></clause></subparagraph>
<subparagraph id="HA3E8747DC4FD47E1A2A486A67BE6CDAC"><enum>(C)</enum><header>Federal government planning and reporting implementation</header>
<clause id="H950ABDD5230B478696C04B48588560E7"><enum>(i)</enum><header>Evaluations</header><text>The Comptroller General shall evaluate the implementation of the Federal Government priority goals, Federal Government performance plans and related reporting required by this Act.</text></clause>
<clause id="HA46C021F28EC49AD913A842378516353"><enum>(ii)</enum><header>Reports</header><text>The Comptroller General shall submit to Congress—</text>
<subclause id="HB586C62066B24A639E8F5E67E59E843E"><enum>(I)</enum><text>an initial report on the evaluation under clause (i), not later than September 30, 2015; and</text></subclause>
<subclause id="H08485E86066B4052A2ECB0C2E88217F5"><enum>(II)</enum><text>subsequent reports on the evaluation under clause (i), not later than September 30, 2017 and every 4 years thereafter.</text></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA299634FA9974AC0945BD3AD30C9D97A"><enum>(D)</enum><header>Recommendations</header><text>The Comptroller General shall include in the reports required by subparagraphs (B) and (C) any recommendations for improving implementation of this Act and for streamlining the planning and reporting requirements of the Government Performance and Results Act of 1993.</text></subparagraph></paragraph></subsection></section>
