<enum>I</enum><header>RESEARCH ON POSTPARTUM CONDITIONS</header> <section id="HF2D9582981AF46DAA08EB1F99F8E7C3B"><enum>101.</enum><header>Expansion and intensification of activities</header> <subsection id="H9FB833E0BDEF4308ACDEDE273222E5B"><enum>(a)</enum><header>Continuation of activities</header><text>The Secretary is encouraged to continue activities on postpartum conditions.</text></subsection> <subsection id="H6B75C15C63FF488785A5FAA34E160606"><enum>(b)</enum><header>Programs for Postpartum Conditions</header><text>In carrying out subsection (a), the Secretary is encouraged to continue research to expand the understanding of the causes of, and treatments for, postpartum conditions. Activities under such subsection shall include conducting and supporting the following:</text> <paragraph id="H0434DB0A4AEC4AD993AF28C97F009EA8"><enum>(1)</enum><text>Basic research concerning the etiology and causes of the conditions.</text></paragraph> <paragraph id="HDD64520F5F5B4AFEB0BF2D5445BD3500"><enum>(2)</enum><text>Epidemiological studies to address the frequency and natural history of the conditions and the differences among racial and ethnic groups with respect to the conditions.</text></paragraph> <paragraph id="HE27BEAEACBC644EBA692378E6B686099"><enum>(3)</enum><text>The development of improved screening and diagnostic techniques.</text></paragraph> <paragraph id="H29F3F8B486D54942A8BB46F22D854F72"><enum>(4)</enum><text>Clinical research for the development and evaluation of new treatments.</text></paragraph> <paragraph id="H4F9FE0D667B44BB48D49C4136EF664BA"><enum>(5)</enum><text>Information and education programs for health care professionals and the public, which may include a coordinated national campaign to increase the awareness and knowledge of postpartum conditions. Activities under such a national campaign may—</text> <subparagraph id="H59BE578ECB564A7D831F4D0093DD6C46"><enum>(A)</enum><text>include public service announcements through television, radio, and other means; and</text></subparagraph> <subparagraph id="HFE75821207C542E28DE00E6808BA342"><enum>(B)</enum><text>focus on—</text> <clause id="H8FA496D2CC5549AF97EDB8FE937B6312"><enum>(i)</enum><text>raising awareness about screening;</text></clause> <clause id="H1456D50EBC964DDEAA6B4BCA4E022292"><enum>(ii)</enum><text display-inline="yes-display-inline">educating new mothers and their families about postpartum conditions to promote earlier diagnosis and treatment; and</text></clause> <clause id="HB0E15380E2114EE1893445ACC4DB21BC"><enum>(iii)</enum><text display-inline="yes-display-inline">ensuring that such education includes complete information concerning postpartum conditions, including its symptoms, methods of coping with the illness, and treatment resources.</text></clause></subparagraph></paragraph></subsection></section> <section id="H1B26B58691D14450A6D07312A37C7599"><enum>102.</enum><header>Sense of Congress regarding longitudinal study of relative mental health consequences for women of resolving a pregnancy</header> <subsection id="H84B75D4199F040E5BFD718FC139F1100"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Director of the National Institute of Mental Health may conduct a nationally representative longitudinal study (during the period of fiscal years 2009 through 2018) of the relative mental health consequences for women of resolving a pregnancy (intended and unintended) in various ways, including carrying the pregnancy to term and parenting the child, carrying the pregnancy to term and placing the child for adoption, miscarriage, and having an abortion. This study may assess the incidence, timing, magnitude, and duration of the immediate and long-term mental health consequences (positive or negative) of these pregnancy outcomes.</text></subsection> <subsection id="H8E70E9FEFE074060968D14428D7025E4"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Beginning not later than 3 years after the date of the enactment of this Act, and periodically thereafter for the duration of the study, such Director may prepare and submit to the Congress reports on the findings of the study.</text></subsection></section>

Short title

This Act may be cited as the

Melanie Blocker Stokes Mom's Opportunity to Access Health, Education, Research, and Support for Postpartum Depression Act

or the

Melanie Blocker Stokes MOTHERS Act

Definitions

For purposes of this Act— (1)the term postpartum condition means postpartum depression or postpartum psychosis; and (2)the term Secretary means the Secretary of Health and Human Services.

This study may assess the incidence, timing, magnitude, and duration of the immediate and long-term mental health consequences (positive or negative) of these pregnancy outcomes.</text></subsection> <subsection id="H8E70E9FEFE074060968D14428D7025E4"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Beginning not later than 3 years after the date of the enactment of this Act, and periodically thereafter for the duration of the study, such Director may prepare and submit to the Congress reports on the findings of the study.</text></subsection></section> <enum>II</enum><header>DELIVERY OF SERVICES REGARDING POSTPARTUM CONDITIONS</header> <section id="H718E1612ABE64D9286C746EF00E690E"><enum>201.</enum><header>Establishment of grant program</header><text display-inline="no-display-inline">Subpart I of part D of title III of the Public Health Service Act (42 U.S.C. 254b et seq.) is amended by inserting after section 330G the following:</text> <quoted-block style="OLC" id="H38B4B88936A645D3B872C6F36D7C08C1" display-inline="no-display-inline"> <section id="H52CE679A9C994AECA2472DD4D5F400DC"><enum>330G–1.</enum><header>Services to individuals with a postpartum condition and their families</header> <subsection id="H898C3DD0142D4897954FEC00B561B322"><enum>(a)</enum><header>In General</header><text>The Secretary may make grants to eligible entities for projects for the establishment, operation, and coordination of effective and cost-efficient systems for the delivery of essential services to individuals with a postpartum condition and their families.</text></subsection> <subsection id="HBE813E611D76462E9CBC55334EF6E69B"><enum>(b)</enum><header>Certain activities</header><text>To the extent practicable and appropriate, the Secretary shall ensure that projects funded under subsection (a) provide education and services with respect to the diagnosis and management of postpartum conditions. The Secretary may allow such projects to include the following:</text> <paragraph id="H8E9A675F1A284DDD941E58CBF7013FC6"><enum>(1)</enum><text>Delivering or enhancing outpatient and home-based health and support services, including case management and comprehensive treatment services for individuals with or at risk for postpartum conditions, and delivering or enhancing support services for their families.</text></paragraph> <paragraph id="HFF2D14EF84D14497A430BB44AB45A5B9"><enum>(2)</enum><text>Delivering or enhancing inpatient care management services that ensure the well-being of the mother and family and the future development of the infant.</text></paragraph> <paragraph id="H3A6889416DD3419B9FD87B4F00F13B62"><enum>(3)</enum><text>Improving the quality, availability, and organization of health care and support services (including transportation services, attendant care, homemaker services, day or respite care, and providing counseling on financial assistance and insurance) for individuals with a postpartum condition and support services for their families.</text></paragraph> <paragraph id="H36E82400E9B8437DA831DB949ED24C"><enum>(4)</enum><text display-inline="yes-display-inline">Providing education to new mothers and, as appropriate, their families about postpartum conditions to promote earlier diagnosis and treatment. Such education may include—</text> <subparagraph id="H817076BE13EC495A820030093CFD49D"><enum>(A)</enum><text>providing complete information on postpartum conditions, symptoms, methods of coping with the illness, and treatment resources; and</text></subparagraph> <subparagraph id="H71E1722A9FC3409C00D242A5D17E010"><enum>(B)</enum><text>in the case of a grantee that is a State, hospital, or birthing facility—</text> <clause id="HC3C4A2423DCF49C19961BD5519523800"><enum>(i)</enum><text>providing education to new mothers and fathers, and other family members as appropriate, concerning postpartum conditions before new mothers leave the health facility; and</text></clause> <clause id="H760EC9B7B78047AE8C77584B7ECFE47E"><enum>(ii)</enum><text>ensuring that training programs regarding such education are carried out at the health facility.</text></clause></subparagraph></paragraph></subsection> <subsection id="H2667C9A9BE164EC9AE6E7821EB3E1BD0"><enum>(c)</enum><header>Integration with other programs</header><text>To the extent practicable and appropriate, the Secretary may integrate the grant program under this section with other grant programs carried out by the Secretary, including the program under section 330.</text></subsection> <subsection id="H51C958FE76E64958B2E7DD90ACD713F8"><enum>(d)</enum><header>Certain requirements</header><text>A grant may be made under this section only if the applicant involved makes the following agreements:</text> <paragraph id="H8633145556624E1CBE8114BDD154AC3D"><enum>(1)</enum><text>Not more than 5 percent of the grant will be used for administration, accounting, reporting, and program oversight functions.</text></paragraph> <paragraph id="H45954BA93E1647409056D3C2E0552156"><enum>(2)</enum><text>The grant will be used to supplement and not supplant funds from other sources related to the treatment of postpartum conditions.</text></paragraph> <paragraph id="H212B6602B2F34C4B88E71E549994DBA0"><enum>(3)</enum><text>The applicant will abide by any limitations deemed appropriate by the Secretary on any charges to individuals receiving services pursuant to the grant. As deemed appropriate by the Secretary, such limitations on charges may vary based on the financial circumstances of the individual receiving services.</text></paragraph> <paragraph id="H6054C77AEBB041428E3EBF4B43096F44"><enum>(4)</enum><text>The grant will not be expended to make payment for services authorized under subsection (a) to the extent that payment has been made, or can reasonably be expected to be made, with respect to such services—</text> <subparagraph id="H945EF18505D947748915406EE50046FF"><enum>(A)</enum><text>under any State compensation program, under an insurance policy, or under any Federal or State health benefits program; or</text></subparagraph> <subparagraph id="HA1A5C39BB8724EF200AF8895F2D07FCA"><enum>(B)</enum><text>by an entity that provides health services on a prepaid basis.</text></subparagraph></paragraph> <paragraph id="HED12ABAE6F07495399191614218C96A7"><enum>(5)</enum><text>The applicant will, at each site at which the applicant provides services funded under subsection (a), post a conspicuous notice informing individuals who receive the services of any Federal policies that apply to the applicant with respect to the imposition of charges on such individuals.</text></paragraph> <paragraph id="H64A937FE148E4A819B045FC56778B613"><enum>(6)</enum><text>For each grant period, the applicant will submit to the Secretary a report that describes how grant funds were used during such period.</text></paragraph></subsection> <subsection id="H98A7990BBDED499CA4FB241B58C31963"><enum>(e)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to entities seeking a grant under this section in order to assist such entities in complying with the requirements of this section.</text></subsection> <subsection id="H9434CE5A42604D8E9996EA97FEB951CA"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H43C4167B9E204485BF01A72E3FF3DF37"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>eligible entity</quote> means a public or nonprofit private entity, which may include a State or local government; a public or nonprofit private recipient of a grant under section 330H (relating to the Healthy Start Initiative), public-private partnership, hospital, community-based organization, hospice, ambulatory care facility, community health center, migrant health center, public housing primary care center, or homeless health center; or any other appropriate public or nonprofit private entity. </text></paragraph> <paragraph id="HC0C03C3F9E554BBD8FDA52F4F7149DC4"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>postpartum condition</term> means postpartum depression or postpartum psychosis.</text></paragraph></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></section> <enum>III</enum><header>GENERAL PROVISIONS</header> <section id="H985B5AA01AD74A26ACB3E5C7B3211CC"><enum>301.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">To carry out this Act and the amendment made by section 201, there are authorized to be appropriated, in addition to such other sums as may be available for such purpose—</text> <paragraph id="H7CE5D17AFDB44E6781F4A9F6F26CA61"><enum>(1)</enum><text>$3,000,000 for fiscal year 2010; and</text></paragraph> <paragraph id="H768E92E1F1A7432F9CB43909174F4569"><enum>(2)</enum><text>such sums as may be necessary for fiscal years 2011 and 2012.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H1280AF1D2DAA4A5790CECF0013552351" section-type="subsequent-section"><enum>302.</enum><header>Report by the Secretary</header> <subsection id="H3CF0E104CA634EF580E8C396CD046F83"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall conduct a study on the benefits of screening for postpartum conditions.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HE887CB559A3E4F1D89C859B3AC4BF444"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary shall complete the study required by subsection (a) and submit a report to the Congress on the results of such study.</text></subsection></section> <section id="H3B0E5DEF5BAF4D6DBA543CD5F1A2C861"><enum>303.</enum><header>Limitation</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act or the amendment made by section 201, the Secretary may not utilize amounts made available under this Act or such amendment to carry out activities or programs that are duplicative of activities or programs that are already being carried out through the Department of Health and Human Services.</text></section>
