<official-title>To secure smuggling routes on the U.S.-Mexico border, better prevent the smuggling of narcotics and weapons across the border, and for other purposes.</official-title>

<section id="HF0C9C8ED8A4D468C8D319C3213169FAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Sovereignty and Protection Act</short-title></quote>.</text></section> 
<section id="H8EAE450D135847BB990A99EDFF794CDF" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Two-layered reinforced fencing along the southwest border</header> 
<subsection id="H99DBD7DC28034CC0B4B691D5447FDA52"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (Public Law 104–208; 8 U.S.C. 1103 note) is amended by amending subparagraph (A) of subsection (b)(1) to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H1CBFCB7150904A02971C3585BDFC04A1"> 
<subparagraph id="H713B58B4C4B4469994794675ED88C39F"><enum>(A)</enum><header>Two-layered reinforced fencing</header> 
<clause id="H6FA0946A818D4830AC9D51907043495F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Secretary of Homeland Security shall construct two layers of reinforced fencing along not fewer than 350 miles of the southwest border where such fencing would be most practical and effective and provide for the installation of related security infrastructure to gain operational control of the southwest border.</text></clause> 
<clause id="HC1EDCCD9A1D845E887AD4F82CD445438"><enum>(ii)</enum><header>Border Patrol access road</header><text>The two-layered reinforced fencing required under clause (i) shall be separated by a Border Patrol access road.</text></clause> 
<clause id="HCB61A8CE090B48B699F37F8D11D3399B"><enum>(iii)</enum><header>Construction deadline</header><text display-inline="yes-display-inline">The Secretary shall ensure the completion of the construction of such two-layered reinforced fencing (including the installation of such related security infrastructure) required under clause (i) and the construction of the Border Patrol access road required under clause (ii) by not later than the date that is one year after the date of the enactment of this subparagraph.</text></clause> 
<clause id="H8BA6692FCDE44B95B5B5235E6E8D2E87"><enum>(iv)</enum><header>Prohibition on preexisting fencing to satisfy mileage requirement</header><text>In carrying out clause (i), the Secretary may not consider fencing along the southwest border in existence on April 1, 2009, for purposes of satisfying the mileage requirement under such clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1F0347F49AAC4AF69F3C4898588998CF"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out the amendment made by subsection (a).</text></subsection></section> 
<section id="HC16D1B436F91471794CD415ED80C0EF3"><enum>3.</enum><header>Department of Homeland Security authority with regard to drug offenses</header><text display-inline="no-display-inline"> The Department of Homeland Security shall have full authority, concurrent with that of the Department of Justice, to investigate any criminal violation of the Controlled Substances Act or the Controlled Substances Import and Export Act.</text></section> 
<section id="HC778CF5BA2194DE780FAC941DC110CC6"><enum>4.</enum><header>Mandatory minimum sentence for firearms smuggling</header> 
<subsection id="HD08D3780984C4C0291B81567A05C686E"><enum>(a)</enum><header>Smuggling into the United States</header><text display-inline="yes-display-inline">Section 924 of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3C396D3280F34649AF28B4EA8198FFA3" display-inline="no-display-inline"> 
<subsection id="H67D103D4843142F9ADA81BBF3F5EED8F"><enum>(q)</enum><text display-inline="yes-display-inline">Whoever, in relation to a crime of violence (as defined in subsection (c)(3)) or a drug trafficking crime (as defined in subsection (c)(2)), smuggles or fraudulently or knowingly imports or brings into the United States a firearm, or attempts to do so, contrary to any law or regulation of the United States shall be fined under this title, imprisoned not less than 15 years, or both.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H963BCE564A0142EF9CAE88FC3FEFF18D"><enum>(b)</enum><header>Smuggling out of the United States</header><text>Section 554(a) of title 18, United States Code, is amended by inserting <quote>, but if the merchandise, article, or object is a firearm (as defined in section 921) and the conduct described in this subsection occurs in relation to a crime of violence (as defined in section 924(c)(3)) or a drug trafficking crime (as defined in section 924(c)(2)), the term of imprisonment for the offense shall be not less than 15 years</quote> after <quote>or both</quote>.</text></subsection></section> 
<section id="H3CDC54C677EC456A82D5E6A4A033C6AB" display-inline="no-display-inline"><enum>5.</enum><header>Eligibility requirements for State Criminal Alien Assistance Program (SCAAP) funding</header><text display-inline="no-display-inline">Section 241(i) of the Immigration and Nationality Act (8 U.S.C. 1231(i)) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H08631D4639E64B08909730FBAC2C7A53" display-inline="no-display-inline"> 
<paragraph id="H0669F86F038A4D449DFE747941D8FB52"><enum>(7)</enum><text>A State (or a political subdivision of a State) shall not be eligible to enter into a contractual arrangement under paragraph (1) if the State (or political subdivision)—</text> 
<subparagraph id="H32FF8E0BA3A545169A651F6F1F10199B"><enum>(A)</enum><text display-inline="yes-display-inline">has in effect any law, policy, or procedure in contravention of subsection (a) or (b) of section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1373); or </text></subparagraph> 
<subparagraph id="H5EA802748D1D438588C9A2249278D09E"><enum>(B)</enum><text>prohibits State or local law enforcement officials from gathering information regarding the citizenship or immigration status, lawful or unlawful, of any individual.</text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H0E86DE733F234C4A00A229DBAADDACD1"><enum>6.</enum><header>Expedited removal of inadmissible arriving aliens</header><text display-inline="no-display-inline">Section 235(b)(1)(A) of the Immigration and Nationality Act (8 U.S.C. 1225(b)(1)(A)) is amended by striking clauses (i) through (iii) and inserting the following:</text> 
<quoted-block id="H8275BCBB056548DBA17B9F428754C981" style="OLC"> 
<clause id="H8D452CA927DF4D968DAFF97B90257FE2"><enum>(i)</enum><header>In general</header><text>If an immigration officer determines that an alien (other than an alien described in subparagraph (F)) who is arriving in the United States, or who has not been admitted or paroled into the United States and has not been physically present in the United States continuously for the 3-year period immediately prior to the date of the determination of inadmissibility under this paragraph, is inadmissible under section 212(a)(6)(C) or 212(a)(7), the officer shall order the alien removed from the United States without further hearing or review, unless—</text> 
<subclause id="HB2ACA7687B07481C819E6D7C75F6E1A7"><enum>(I)</enum><text>the alien has been charged with a crime; or</text></subclause> 
<subclause id="H66B0209525AA4EC88195EEF11600B15B"><enum>(II)</enum><text>the alien indicates an intention to apply for asylum under section 208 or a fear of persecution and the officer determines that the alien has been physically present in the United States for less than 1 year.</text></subclause></clause> 
<clause id="HDBAE6CCCF22C4FC7A4248300BB527C6E"><enum>(ii)</enum><header>Claims for asylum</header><text>If an immigration officer determines that an alien (other than an alien described in subparagraph (F)) who is arriving in the United States, or who has not been admitted or paroled into the United States and has not been physically present in the United States continuously for the 3-year period immediately prior to the date of the determination of inadmissibility under this paragraph, is inadmissible under section 212(a)(6)(C) or 212(a)(7), and the alien indicates either an intention to apply for asylum under section 208 or a fear of persecution, the officer shall refer the alien for an interview by an asylum officer under subparagraph (B) if the officer determines that the alien has been physically present in the United States for less than 1 year.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H022B3E9F32A343C6822128B04132CBBB"><enum>7.</enum><header>Expedited removal of criminal aliens</header> 
<subsection id="HDA8206FD1F1D4E16AFC14E2B1FA9A17B"><enum>(a)</enum><header>In General</header><text>Section 238 of the Immigration and Nationality Act (8 U.S.C. 1228) is amended—</text> 
<paragraph id="H8EEEC9F098C64CC89E35E46BF049FAF"><enum>(1)</enum><text>by amending the section heading to read as follows: <quote><header-in-text level="section" style="OLC">expedited removal of criminal aliens</header-in-text></quote>;</text></paragraph> 
<paragraph id="H0B88695BEF3F42FB9782DC9C9F307FA0"><enum>(2)</enum><text>in subsection (a), by amending the subsection heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Expedited removal from correctional facilities</header-in-text></quote>;</text></paragraph> 
<paragraph id="HFC08F083A6474BC68812952171048FFE"><enum>(3)</enum><text>in subsection (b), by amending the subsection heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Removal of criminal aliens</header-in-text></quote>;</text></paragraph> 
<paragraph id="H31401133D5CE4076A1CAA7EB325F7B27"><enum>(4)</enum><text>in subsection (b), by striking paragraphs (1) and (2) and inserting the following:</text>

<paragraph id="H4FE4636C067B49ED96F78D7D254142C4"><enum>(1)</enum><header>In general</header><text>The Secretary may, in the case of an alien described in paragraph (2), determine the deportability of such alien and issue an order of removal pursuant to the procedures set forth in this subsection or section 240.</text></paragraph> 
<paragraph id="HD08819D1CF694147A2D23B2CB28B3423"><enum>(2)</enum><header>Aliens described</header><text>An alien is described in this paragraph if the alien, whether or not admitted into the United States, was convicted of any criminal offense described in subparagraph (A)(iii), (C), or (D) of section 237(a)(2).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H53B3F7E1D43A46E6B4B06EA4C274275"><enum>(5)</enum><text>in the first subsection (c) (relating to presumption of deportability), by striking <quote>convicted of an aggravated felony</quote> and inserting <quote>described in paragraph (b)(2)</quote>;</text></paragraph> 
<paragraph id="H278D0B8CAD4F42D48E7480B3A5A1DA5"><enum>(6)</enum><text>by redesignating the second subsection (c) (relating to judicial removal) as subsection (d); and</text></paragraph> 
<paragraph id="HE396775AB7C14EBCBDF07958BD2850AF"><enum>(7)</enum><text>in subsection (d)(5) (as so redesignated), by striking <quote>, who is deportable under this Act,</quote>.</text></paragraph></subsection> 
<subsection id="HF524D00507C441EF8FC996CF749D6680"><enum>(b)</enum><header>Limit on Injunctive Relief</header><text>Section 242(f)(2) of such Act (8 U.S.C. 1252(f)(2)) is amended by inserting <quote>or stay, whether temporarily or otherwise,</quote> after <quote>enjoin</quote>.</text></subsection></section> 
<section id="HBBFBB5C2E1EC43B4A6577BB5E9F2DF0" display-inline="no-display-inline"><enum>8.</enum><header>Mandatory employment authorization verification</header> 
<subsection id="H643F1DF324D24EC0AB99A01D00FDA2B5"><enum>(a)</enum><header>Making basic pilot program permanent</header><text display-inline="yes-display-inline">Section 401(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1324a note) is amended by adding before the period at the end of the last sentence the following <quote>, except that the basic pilot program described in section 403(a) shall be a permanent program</quote>.</text> </subsection> 
<subsection id="H449DC5ABE53C4CED9CF73FBD6D423E28"><enum>(b)</enum><header>Mandatory use of E-verify system</header> 
<paragraph id="H3C1E6E6FB46C402B9BC5046F981ECA00"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), every person or other entity that hires one or more individuals for employment in the United States shall verify through the E-Verify program, established as the basic pilot program by section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of Public Law 104–208; 8 U.S.C. 1324a note), that each such individual is authorized to work in the United States. The Secretary of Homeland Security shall ensure that verification by means of a toll-free telephone line is an available option in complying with the preceding sentence.</text> </paragraph> 
<paragraph id="HFDA54D9F87A14B99909C16B597F6116E"><enum>(2)</enum><header>Select entities required to use e-verify program immediately</header><text>The following entities must satisfy the requirement in paragraph (1) by not later than one year after the date of the enactment of this Act:</text> 
<subparagraph id="H88670882943F4657A900BDABF355233E"><enum>(A)</enum><header>Federal agencies</header><text>Each department and agency of the Federal Government.</text> </subparagraph> 
<subparagraph id="HB02916F0EBC9452CBD5F5B53ED69A34E"><enum>(B)</enum><header>Federal contractors</header><text>A contractor that—</text> 
<clause id="H763BAB582A6245289EE6F0BBC4996DE5"><enum>(i)</enum><text>has entered into a contract with the Federal Government to which section 2(b)(1) of the Service Contract Act of 1965 (41 U.S.C. 351(b)(1)) applies, and any subcontractor under such contract; or</text> </clause> 
<clause id="HF102161847314A77B4920036B3F81588"><enum>(ii)</enum><text>has entered into a contract exempted from the application of such Act by section 6 of such Act (41 U.S.C. 356), and any subcontractor under such contract; and</text> </clause></subparagraph> 
<subparagraph id="H6BD2004C44E04942BF517493A9C9004B"><enum>(C)</enum><header>Large employers</header><text display-inline="yes-display-inline">An employer that employs more than 250 individuals in the United States.</text> </subparagraph></paragraph> 
<paragraph id="H91579FB9B1ED4EF98202D68D9BA9435E"><enum>(3)</enum><header>Phasing-in for other employers</header> 
<subparagraph id="H3DB60C4AE489492ABB6445CDE92D2415"><enum>(A)</enum><header>2 years for employers of 100 or more</header><text>Entities that employ 100 or more individuals in the United States must satisfy the requirement in paragraph (1) by not later than two years after the date of the enactment of this Act.</text> </subparagraph> 
<subparagraph id="H86C77F9C31B948CD8E8532BD64D99B3D"><enum>(B)</enum><header>3 years for employers with 30 or more employees</header><text>All entities that employ 30 or more individuals in the United States must satisfy the requirement in paragraph (1) by not later than three years after the date of the enactment of this Act.</text> </subparagraph> 
<subparagraph id="H4F41B83061DB47EB8B4D8363076DA1D6"><enum>(C)</enum><header>4 years for all employers</header><text>All entities that employ one or more individuals in the United States must satisfy the requirement in paragraph (1) by not later than four years after the date of the enactment of this Act.</text> </subparagraph></paragraph> 
<paragraph id="HCB3C317BAC8B429283A2AF6E012FD7D"><enum>(4)</enum><header>Verifying employment authorization of current employees</header><text>Every person or other entity that employs one or more persons in the United States shall verify through the E-Verify program by not later than four years after the date of the enactment of this Act that each employee is authorized to work in the United States.</text> </paragraph> 
<paragraph id="H1A09DBA59CC44DAF85F027F9A7C952F"><enum>(5)</enum><header>Defense</header><text>An employer who has complied with the requirements in paragraphs (1) and (4) shall not be liable for hiring an unauthorized alien, if—</text> 
<subparagraph id="HEE74501B8D8F4721A3B2300712279E27"><enum>(A)</enum><text>such hiring occurred due to an error in the E-Verify program that was unknown to the employer at the time of such hiring; and</text> </subparagraph> 
<subparagraph id="H3F189F3C068449BAB73777EBA4B480B"><enum>(B)</enum><text>the employer terminates the employment of the alien upon being informed of the error.</text> </subparagraph></paragraph> 
<paragraph id="HC5471A7169AD433AAEFAD668BE5DBF62"><enum>(6)</enum><header>Sanctions for noncompliance</header><text>The failure of an employer to comply with the requirements in paragraphs (1) or (4) shall—</text> 
<subparagraph id="HDC8443D92CEF4C3CA77BFB6B2F2F762C"><enum>(A)</enum><text>be treated as a violation of section 274A(a)(1)(B) with respect to each offense; and</text> </subparagraph> 
<subparagraph id="H1BB8EDACEAC6417D99F4638F86F46108"><enum>(B)</enum><text>create a rebuttable presumption that the employer has violated section 274A(a)(1)(A).</text> </subparagraph></paragraph> 
<paragraph id="H4C2DD8C515524A6F9ED75DA599E220C5"><enum>(7)</enum><header>Voluntary participation of employers not immediately subject to requirement</header><text>Nothing in this subsection shall be construed as preventing a person or other entity that is not immediately subject to the requirement of paragraph (1) pursuant to paragraph (2) or (3) from voluntarily using the E-Verify program to verify the employment authorization of new hires or current employees.</text> </paragraph> 
<paragraph id="H13FC95243C07418E00B3D20078D3B3AF"><enum>(8)</enum><header>State interference</header><text display-inline="yes-display-inline">No State may prohibit a person or other entity from using the E-verify program to verify the employment authorization of new hires or current employees.</text></paragraph></subsection></section>
