<official-title>To amend title 32, United States Code, to improve the readiness of State defense forces and to increase military coordination for homeland security between the States and the Department of Defense.</official-title>

<section display-inline="no-display-inline" id="H00C157F4B9EC4D60BCE6A36392CD6D7C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Defense Force Improvement Act</short-title></quote>.</text></section> 
<section id="HBF3EC12A1224484D8DFB4091C302DEF4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="H6923C0BAD45940C09817C2A67CA2D56"><enum>(1)</enum><text>Domestic threats to national security and the increased use of National Guard forces for out-of-State deployments greatly increase the potential for service by members of State defense forces established under section 109(c) of title 32, United States Code.</text></paragraph> 
<paragraph id="HDDDF9980D668442D8E712E0276A1D31"><enum>(2)</enum><text display-inline="yes-display-inline">The efficacy of State defense forces is impeded by lack of clarity in the Federal regulations concerning those forces, particularly in defining levels of coordination and cooperation between those forces and the Departments of Defense and Homeland Security.</text></paragraph> 
<paragraph id="H9CBB1F667A2E4E3E9BD39CD05291F6AE"><enum>(3)</enum><text display-inline="yes-display-inline">The State defense forces suffer from lack of standardized military training, arms, equipment, support, and coordination with the Departments of Defense and Homeland Security and other Federal agencies as a result of real and perceived Federal regulatory impediments.</text></paragraph></section> 
<section id="HDA6EF011760F4914A215E3CF2D07B3B1"><enum>3.</enum><header>Recognition of and support for State defense forces</header> 
<subsection id="H7CD8F86ED9A84AA1A2951800E634DD1D"><enum>(a)</enum><header>Recognition and support</header><text>Section 109 of title 32, United States Code, is amended—</text> 
<paragraph id="HF150F8E020D54717A3A341FC8A1001C"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (l) and (m), respectively; and</text></paragraph> 
<paragraph id="H7B64F33E75704580ACC69E5DC73E04DE"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsections:</text>

<subsection id="HA744AB29301F49BAA4258E136587432D"><enum>(d)</enum><header>Recognition</header><text>Congress hereby recognizes forces established under subsection (c) as an integral military component of the homeland security effort of the United States, while reaffirming that those forces remain entirely State regulated, organized, and equipped and recognizing that those forces will be used for homeland security purposes exclusively at the local level and in accordance with State law.</text></subsection> 
<subsection display-inline="no-display-inline" id="H60E8F348EB624EF0A862B4C902CF9224"><enum>(e)</enum><header>Assistance by Department of Defense</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HAA7D891A47A44722B3208EA145AED9DA"><enum>(1)</enum><text>The Secretary of Defense may coordinate homeland security efforts with, and provide assistance to, a defense force established under subsection (c) to the extent such assistance is requested by a State or by a force established under subsection (c) and subject to the provisions of this section.</text></paragraph> 
<paragraph id="H61B181D9A529483FB5842540E625F145" indent="up1"><enum>(2)</enum><text>The Secretary may not provide assistance under paragraph (1) if, in the judgment of the Secretary, such assistance would—</text> 
<subparagraph id="HEB13D039BCE24A4AB84BC0CAEE660068"><enum>(A)</enum><text>impede the ability of the Department of Defense to execute missions of the Department;</text></subparagraph> 
<subparagraph id="HD606419B4E1B485F8FD51E4DE907A360"><enum>(B)</enum><text>take resources away from warfighting units;</text></subparagraph> 
<subparagraph id="HBDAA446DA4C947638E4C8C4355AEE3B2"><enum>(C)</enum><text>incur nonreimbursed identifiable costs; or</text></subparagraph> 
<subparagraph id="H9F085EE4503442C88519BFDCD7F8C91"><enum>(D)</enum><text>consume resources in a manner inconsistent with the mission of the Department of Defense.</text></subparagraph></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H4B920F2328CB44209DF891B9E55A374"><enum>(f)</enum><header>Assistance by Department of Homeland Security</header><text>The Secretary of Homeland Security may coordinate homeland security efforts with, and provide assistance to, a defense force established under subsection (c) to the extent such assistance is requested by a State or by a force established under subsection (c) if so authorized by State law, and subject to the provisions of this section.</text></subsection> 
<subsection id="HF7AFD7C9905D43E4B2C9AC3129F5E300"><enum>(g)</enum><header>Use of Department of Defense property and equipment</header><text>The Secretary of Defense may authorize qualified personnel of a force established under subsection (c) to use and operate property, arms, equipment, and facilities of the Department of Defense as needed in the course of training activities and State active duty.</text></subsection> 
<subsection commented="no" id="H5F110892ED5745808B00CB75475F2DF0"><enum>(h)</enum><header>Transfer of excess equipment</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H0936FCDA16B04413B878CD103E27554F"><enum>(1)</enum><text>The Secretary of Defense may transfer to a State or a force established under subsection (c) any personal property of the Department of Defense that the Secretary determines is—</text> 
<subparagraph id="HA5F82222F8624EE7842028125CFC0000" indent="up1"><enum>(A)</enum><text>excess to the needs of the Department of Defense; and</text></subparagraph> 
<subparagraph id="H1FFE79CE57CB49CCA9F6C53710DAFEED" indent="up1"><enum>(B)</enum><text>suitable for use by a force established under subsection (c).</text></subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" id="H0D1F561D8C1E41A3007DF9EDDE8CDC14" indent="up1"><enum>(2)</enum><text>The Secretary of Defense may transfer personal property under this section only if—</text> 
<subparagraph id="HF457DE1400CA45D08C2FCBE5228BAFD5"><enum>(A)</enum><text>the property is drawn from existing stocks of the Department of Defense;</text></subparagraph> 
<subparagraph id="HBAB64AF9AAF94543AE66AE2817F7D45D"><enum>(B)</enum><text display-inline="yes-display-inline">the recipient force established under subsection (c) accepts the property on an as-is, where-is basis;</text></subparagraph> 
<subparagraph id="H7EE202BD91F24EDB81E8FBE4CEADD19"><enum>(C)</enum><text>the transfer is made without the expenditure of any funds available to the Department of Defense for the procurement of defense equipment; and</text></subparagraph> 
<subparagraph id="H915218AEC3CE422F9908B99813FE7D4F"><enum>(D)</enum><text>all costs incurred subsequent to the transfer of the property are borne or reimbursed by the recipient.</text></subparagraph></paragraph> 
<paragraph id="HE6FD2912319E4FDF814E8DB5EBDE3603" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Subject to paragraph (2)(D), the Secretary may transfer personal property under this section without charge to the recipient force established under subsection (c).</text></paragraph></subsection> 
<subsection id="HB315F8ED09974C97B7F48D404FE22BCE"><enum>(i)</enum><header>Federal/State training coordination</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H6ED9C5DEC42544638B603064E41ED024"><enum>(1)</enum><text display-inline="yes-display-inline">Participation by a force established under subsection (c) in a training program of the Department of Defense or Department of Homeland Security is at the discretion of the State.</text></paragraph> 
<paragraph id="H22A8ECCC34C441EBABDB7B34128F4F6F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Nothing in this section may be construed as requiring the Department of Defense or Department of Homeland Security to provide any training program to any such force.</text></paragraph> 
<paragraph id="H5580849280D24B51857067FE00863B99" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any such training program shall be conducted in accordance with an agreement between—</text> 
<subparagraph id="HE6E1D7DA59A14C3DA6DE61867317F300"><enum>(A)</enum><text>the Secretary of Defense or Secretary of Homeland Security, as the case may be; and</text></subparagraph> 
<subparagraph id="H4370557F3710464787C5CB267F22AF63"><enum>(B)</enum><text>the State or the force established under subsection (c) if so authorized by State law.</text></subparagraph></paragraph> 
<paragraph id="H1485022FF6904B9EAFBCF5D2D5822E00" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Any direct costs to the Department of Defense of providing training assistance to a force established under subsection (c) shall be reimbursed by the State. Any agreement under paragraph (3) between the Department of Defense and a State or a force established under subsection (c) for such training assistance shall provide for payment of such costs.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HB2082C1F132840C80049FC05E632A134"><enum>(j)</enum><header>Federal funding of State defense forces</header><text>Funds available to the Department of Defense may not be made available to a State defense force.</text></subsection> 
<subsection id="H85C43065194A4A8AA0D630D8C0B397B4"><enum>(k)</enum><header>Liability</header><text>Any liability for injuries or damages incurred by a member of a force established under subsection (c) while engaged in training activities or State active duty shall be the sole responsibility of the State, regardless of whether the injury or damage was incurred on United States property or involved United States equipment or whether the member was under direct supervision of United States personnel at the time of the incident.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCEB13918A8D3434CA43FF0932C649DD9"><enum>(b)</enum><header>Definition of state</header> 
<paragraph id="HA86C354376A840588CB3A678B53087B7"><enum>(1)</enum><header>Definition</header><text>Such section is further amended by adding at the end the following new subsection:</text>

<subsection id="HC23BC58C8B1041E0A535054D43653EDC"><enum>(n)</enum><header>State Defined</header><text>In this section, the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, Guam, and the Virgin Islands.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H53E704EFDC8E4E28913C7F4EEB9B386B"><enum>(2)</enum><header>Conforming amendments</header><text>Such section is further amended in subsections (a), (b), and (c) by striking <quote>a State, the Commonwealth of Puerto Rico, the District of Columbia, Guam, or the Virgin Islands</quote> each place it appears and inserting <quote>a State</quote>.</text></paragraph></subsection>
