<section id="HA5E24BE780CC49B3A9127BFF644D5220" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Migratory Bird Treaty Act Penalty and Enforcement Act of 2009</short-title></quote>.</text></section>
<section id="H7F2F3BAD52E2472D9C8C16F7EDD57DF3"><enum>2.</enum><header>Amendment of Migratory Bird Treaty Act</header><text display-inline="no-display-inline">Section 6 of the Migratory Bird Treaty Act (16 U.S.C. 707) is amended by redesignating subsection (d) as subsection (e), and by inserting after subsection (c) the following new subsection:</text>

<subsection id="HEE25788C89DA4BFBAF831D015E9552D0"><enum>(d)</enum>
<paragraph id="HC620994E80D24D9E8F19B59FBD235C7F" display-inline="yes-display-inline"><enum>(1)</enum><text>Except in the case of hunting and other activity allowed under section 3, whoever in violation of this Act kills or wounds a migratory bird in an aggravated manner shall, in lieu of any penalty for such violation—</text>
<subparagraph id="H1BA21153632644BDA01E5065CCD6CBC9" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">for the first violation, be fined under title 18, United States Code, imprisoned for not more than one year, or both; and</text></subparagraph>
<subparagraph id="H4E5DDDE4466648B0A697C56157CD6AB1" indent="up1"><enum>(B)</enum><text>for the second and any subsequent violation, be fined under title 18 of the United States Code, imprisoned for not more than 2 years, or both.</text></subparagraph></paragraph>
<paragraph id="HB521609107514A34B23330662384418A" indent="up1"><enum>(2) </enum><text display-inline="yes-display-inline">The authority under section 3(k) of the Fish and Wildlife Improvement Act of 1978 (16 U.S.C. 742l(k)) applies with respect to a violation described in paragraph (1).</text></paragraph>
<paragraph id="HF5E760782D164334A4A73D333B69AB09" indent="up1"><enum>(3)</enum><text>For the purposes of this subsection the term <quote>aggravated manner</quote> means deliberately and in a manner that—</text>
<subparagraph id="HD5F24E708533490AB7A9FE1BECA22CCB"><enum>(A)</enum><text>demonstrates indifference to the pain and suffering of the bird; or</text></subparagraph>
<subparagraph id="HBAEF60CB19AD48CAA6741CAA75FEA17F"><enum>(B)</enum><text display-inline="yes-display-inline">involves actions that would shock a reasonable person.</text></subparagraph></paragraph></subsection>
