<section id="H6BD438E443B94441B75BCE3C274E8919"><enum>2.</enum><header>Findings; purposes</header> 
<subsection id="H7F6E8723531D47359B72FABF8BE8FDF5"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="H19346FE0155648A392007B29050038B4"><enum>(1)</enum><text>Several species of salmon native to the rivers of the United States are highly migratory, interacting with salmon originating from Canada, Japan, Russia, and South Korea and spending portions of their life history outside of the territorial waters of the United States. Recognition of the migratory and transboundary nature of salmon species has led countries of the North Pacific to seek enhanced coordination and cooperation through multilateral and bilateral agreements.</text> </paragraph>
<paragraph id="HC0C62964891C4B3F9BE7F1E0078AF8D"><enum>(2)</enum><text>Salmon are a keystone species, sustaining more than 180 other species in freshwater and marine ecosystems. They are also an indicator of ecosystem health and potential impacts of climate change.</text> </paragraph>
<paragraph id="HECDA87A30B90467BA7E2459DD5F44020"><enum>(3)</enum><text>Salmon are a central part of the culture, economy, and environment of Western North America.</text> </paragraph>
<paragraph id="H587DDBA8319A4475B6C3D7006E81DC91"><enum>(4)</enum><text>Economic activities relating to salmon generate billions of dollars of economic activity and provide thousands of jobs.</text> </paragraph>
<paragraph id="HE78CFB44CA304D189C81C15BE4576B8E"><enum>(5)</enum><text>During the anticipated future rapid environmental change, maintaining key ecosystem processes and functions, population abundance, and genetic integrity will be vital to ensuring the health and long-term viability of salmon populations.</text> </paragraph>
<paragraph id="H442F4A6C572A469E92C0DC64A7574C"><enum>(6)</enum><text>Salmon strongholds provide critical production zones for commercial, recreational, and subsistence fisheries.</text> </paragraph>
<paragraph id="H76409C9C0E494FE6B8EED1F7BDBEE841"><enum>(7)</enum><text>Taking into consideration the frequency with which fisheries have collapsed before the enactment of this Act, use of scientific research to correctly identify and conserve core centers of abundance, productivity, and diversity is vital to sustain salmon populations and fisheries in the future.</text> </paragraph>
<paragraph id="H04E3F550B73C4C919C056ECBB8D937D"><enum>(8)</enum><text>Measures being undertaken as of the date of the enactment of this Act to recover threatened or endangered salmon stocks, such as Federal, State, and local programs to restore habitat, are vital. These measures will be complemented and enhanced by identifying and sustaining core centers of abundance, productivity, and diversity in the healthiest remaining salmon ecosystems throughout the range of salmon species.</text> </paragraph>
<paragraph id="H48B26D60A7DE439B8B3B0093D45B7477"><enum>(9)</enum><text>The effects of climate change are affecting salmon habitat at all life history stages, and future habitat conservation must consider climate change projections to safeguard natural systems under future climate conditions.</text> </paragraph>
<paragraph id="H8D4A3EDC73274DC7AD7B179F50D8C671"><enum>(10)</enum><text>Greater coordination between public and private entities can assist salmon strongholds by marshaling and focusing resources on scientifically supported, high priority conservation actions.</text> </paragraph></subsection>
<subsection id="H2713C28DD1C141CAB56FE82CAFE2C0A4"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H399CC789B43241B0B063FDF3ADA59FE"><enum>(1)</enum><text>to expand Federal support and resources for the protection and restoration of the healthiest remaining salmon strongholds in North America to sustain core centers of salmon abundance, productivity, and diversity in order to ensure the long-term viability of salmon populations—</text> 
<subparagraph id="HCC9EA5FAD9BF492D896D51AB5F96AFFD"><enum>(A)</enum><text>in the States of California, Idaho, Oregon, and Washington, by focusing resources on cooperative, incentive-based efforts to conserve the roughly 20 percent of salmon habitat that supports approximately two-thirds of salmon abundance; and</text> </subparagraph>
<subparagraph id="HB1BDF00FAEDF4402AE6BBC04ABAD83C"><enum>(B)</enum><text>in the State of Alaska, a regional stronghold that produces more than one-third of all salmon, by increasing resources available to public and private organizations working cooperatively to conserve regional core centers of salmon abundance and diversity;</text> </subparagraph></paragraph>
<paragraph id="HF288AC41D1EE4DE10028F03D3601B371"><enum>(2)</enum><text>to maintain and enhance economic benefits related to fishing or associated with healthy salmon stronghold habitats, or both, including flood protection, recreation, water quantity and quality, carbon sequestration, climate change mitigation and adaptation, and other ecosystem services; and</text> </paragraph>
<paragraph id="H629F8D623E6544E2B6E54438E203F8F3"><enum>(3)</enum><text>to complement and add to existing Federal, State, and local salmon recovery efforts by using sound science to identify and sustain core centers of salmon abundance, productivity, and diversity in the healthiest remaining salmon ecosystems throughout their range.</text> </paragraph></subsection></section>
<section id="H488F71F384F541048DC257EEA65975DB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HA37895768792467CA59333F0C7F4AC8C"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Assistant Administrator for the National Marine Fisheries Service of the National Oceanic and Atmospheric Administration.</text> </paragraph>
<paragraph id="H65FB4F3ECD4341A79FD934A1617B7791"><enum>(2)</enum><header>Board</header><text>The term <term>Board</term> means the Salmon Stronghold Partnership Board established under section 4(a)(3).</text> </paragraph>
<paragraph id="HE7D602EB50BC49CBB7DF02934BA3BA04"><enum>(3)</enum><header>Charter</header><text>The term <term>Charter</term> means the charter of the Board developed under section 4(g).</text> </paragraph>
<paragraph id="H294354BE5B9B48A89717DFC2F5D910B8"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the United States Fish and Wildlife Service.</text> </paragraph>
<paragraph id="H2E53E2DEDB3D430C8BBEE507FDA852C"><enum>(5)</enum><header>Ecosystem services</header><text>The term <term>ecosystem services</term> means an ecological benefit generated from a healthy, functioning ecosystem, including clean water, pollutant filtration, regulation of river flow, prevention of soil erosion, regulation of climate, and fish production.</text> </paragraph>
<paragraph id="H4C5A82AD27C74011BFA216815049E05C"><enum>(6)</enum><header>Program</header><text>Except as otherwise provided, the term <term>program</term> means the salmon stronghold watershed grants and technical assistance program established under section 6(a).</text> </paragraph>
<paragraph id="HFC91ADCCCE5B4484B8182C8870E2449D"><enum>(7)</enum><header>Salmon</header><text>The term <term>salmon</term> means any of the wild anadromous Oncorhynchus species that occur in the Western United States, including—</text> 
<subparagraph id="H7939E9DF619B4064ADFDE1C65E616F00"><enum>(A)</enum><text>chum salmon (Oncorhynchus keta);</text> </subparagraph>
<subparagraph id="H4103827320A744EBA78700B8AA1F44C8"><enum>(B)</enum><text>pink salmon (Oncorhynchus gorbuscha);</text> </subparagraph>
<subparagraph id="HA9CEA4DB3F234A40BC4812F0746C898"><enum>(C)</enum><text>sockeye salmon (Oncorhynchus nerka);</text> </subparagraph>
<subparagraph id="HC38D549148AF4DE4AEEA7CA725FDF261"><enum>(D)</enum><text>chinook salmon (Oncorhynchus tshawytscha);</text> </subparagraph>
<subparagraph id="HC054E4C4BE6144449C2B924100799CE8"><enum>(E)</enum><text>coho salmon (Oncorhynchus kisutch); and</text> </subparagraph>
<subparagraph id="HEDD55BFF228E4B6386F96700589F591E"><enum>(F)</enum><text>steelhead trout (Oncorhynchus mykiss).</text> </subparagraph></paragraph>
<paragraph id="H85004D00DCF34EDB9B4E8855DBB8612D"><enum>(8)</enum><header>Salmon stronghold</header><text>The term <term>salmon stronghold</term> means any area that meets biological criteria for abundance, productivity, diversity (life history and run timing), habitat quality, or other biological attributes important to sustaining viable populations of salmon throughout their range, as defined by the Board.</text> </paragraph>
<paragraph id="HCBF403D7FBA44287A6AD36FBD22CAB45"><enum>(9)</enum><header>Salmon stronghold partnership</header><text>The term <term>Salmon Stronghold Partnership</term> means the Salmon Stronghold Partnership established under section 4(a)(1).</text> </paragraph>
<paragraph id="H1483538E5F224C9BB1C9AAAB68D7333"><enum>(10)</enum><header>Secretary</header><text>Except as otherwise provided, the term <term>Secretary</term> means the Secretary of Commerce.</text> </paragraph></section>
<section id="H852A8AAF931D4F73924DE63CDEFE564F"><enum>4.</enum><header>Salmon Stronghold Partnership</header> 
<subsection id="H73ACCAF673704652B17E6D981C2D0399"><enum>(a)</enum><header>In General</header> 
<paragraph id="HEE065C53565E4628A81CB0F0C3EED53"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a Salmon Stronghold Partnership that is a cooperative, incentive-based, public-private partnership among appropriate Federal, State, tribal, and local governments, private landowners, and nongovernmental organizations working across political boundaries, government jurisdictions, and land ownerships to identify and conserve salmon strongholds.</text> </paragraph>
<paragraph id="H1399E565E11F4C090041281B11C46687"><enum>(2)</enum><header>Membership</header><text>To the extent possible, the membership of the Salmon Stronghold Partnership shall include each entity described under subsection (b).</text> </paragraph>
<paragraph id="H6EDF0CE7D3584FF3B1275C3F7DC14EC2"><enum>(3)</enum><header>Leadership</header><text>The Salmon Stronghold Partnership shall be managed by the Salmon Stronghold Partnership Board established under subsection (b).</text> </paragraph></subsection>
<subsection id="H74AB1F47F49A4A7FA5382E2E00A47343"><enum>(b)</enum><header>Salmon Stronghold Partnership Board</header> 
<paragraph id="HC83F8BFED4394072A5BF7B003F002CC3"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish the Salmon Stronghold Partnership Board for purposes of this Act.</text> </paragraph>
<paragraph id="H29318F997AEE4A929CF0AF83F1CCD1B3"><enum>(2)</enum><header>Membership</header><text>The Board shall consist of individuals with strong scientific or technical credentials and expertise, appointed as follows:</text> 
<subparagraph id="HCA9DC69E08A44FD1BAF64E6BCE3E6BC1"><enum>(A)</enum><text>One representative from each of—</text> 
<clause id="HBF0FBD3C5D2B47CD885C66229C3C3255"><enum>(i)</enum><text>the National Marine Fisheries Service, appointed by the Administrator;</text> </clause>
<clause id="HA3F2FA29CCA84A98847B020352C47C89"><enum>(ii)</enum><text>the United States Fish and Wildlife Service, appointed by the Director;</text> </clause>
<clause id="HFF9DA74930A24493A400F8A5E9C98E7F"><enum>(iii)</enum><text>the Forest Service, appointed by the Chief of the Forest Service;</text> </clause>
<clause id="HFC741AF1CC4844448ED68BAEA78B2747"><enum>(iv)</enum><text>the Environmental Protection Agency, appointed by the Administrator of such agency;</text> </clause>
<clause id="H239D90D7EFAA4F3580FDA0187D14E4C"><enum>(v)</enum><text>the Bonneville Power Administration, appointed by the Administrator of such administration;</text> </clause>
<clause id="H26DFDE522B924084B551C049AEB83B0"><enum>(vi)</enum><text>the Bureau of Land Management, appointed by the Director of such bureau; and</text> </clause>
<clause id="HA687946973C140B684DC07A281924DBA"><enum>(vii)</enum><text>the Northwest Power and Conservation Council, appointed by such council.</text> </clause></subparagraph>
<subparagraph id="HB9C7A5D28B2B4FFAACBF1275DE27E879"><enum>(B)</enum><text>One representative from the natural resources staff of the office of the Governor or of an appropriate natural resource agency of a State, appointed by the Governor of that State, from each of the States of—</text> 
<clause id="HFAE71B0F12344AA283ED1491A5D5E327"><enum>(i)</enum><text>Alaska;</text> </clause>
<clause id="H5C2381E71C6D461400356D8F005B74AB"><enum>(ii)</enum><text>California;</text> </clause>
<clause id="HF86CE1A4C65542BE84CAC645BA606FA"><enum>(iii)</enum><text>Idaho;</text> </clause>
<clause id="H6AA610BD364840A78D611B5274F91F2D"><enum>(iv)</enum><text>Oregon; and</text> </clause>
<clause id="H0BCBE3DCCBE64ABD983101897C6606FE"><enum>(v)</enum><text>Washington.</text> </clause></subparagraph>
<subparagraph id="H85F31D82514747218085792133D105A8"><enum>(C)</enum><text>Not less than 3 and not more than 5 representatives from Indian tribes or tribal commissions selected by the Board and located within the range of salmon, as appointed by such Indian tribes or tribal commissions.</text> </subparagraph>
<subparagraph id="H1456C6A5BA9A4DEE964274905CAF5557"><enum>(D)</enum><text>One representative from each of 3 nongovernmental organizations with salmon conservation and management expertise, as selected by the Board.</text> </subparagraph>
<subparagraph id="H911EB1CE27FB4302ACC7AC375BFAB4A8"><enum>(E)</enum><text>One national or regional representative from an association of counties, as selected by the Board.</text> </subparagraph>
<subparagraph id="HE2E15DD07E164F5A8BBC33AFC2461276"><enum>(F)</enum><text>Representatives of any other entities with significant resources regionally dedicated to the protection of salmon ecosystems that the Board determines are appropriate, as selected by the Board.</text> </subparagraph></paragraph>
<paragraph id="H74EB02CF48504A9CBB9FE061F451F954"><enum>(3)</enum><header>Failure to appoint</header><text>If a representative described in subparagraph (B), (C), (D), (E), or (F) of paragraph (1) is not appointed to the Board or fails to otherwise participate in the Board, the Board shall carry out its functions until the representative is appointed or joins in such participation.</text> </paragraph></subsection>
<subsection id="HD326ECB26D8C4E938076AD00EEBF14"><enum>(c)</enum><header>Meetings</header> 
<paragraph id="H8AEEC5E7F8A146D88D08A6C02FC87F"><enum>(1)</enum><header>Frequency</header><text>Not less frequently than 3 times each year, the Board shall meet to provide opportunities for input from a broader set of stakeholders.</text> </paragraph>
<paragraph id="H402F9360A35846B4BD6117BFEF76BFFB"><enum>(2)</enum><header>Notice</header><text>Prior to each meeting the Board shall give timely notice of the meeting to the public, and to each county or tribal government with jurisdiction over all or part of a salmon stronghold identified by the Board.</text> </paragraph></subsection>
<subsection id="H93AE291009284A50B3A854DC126423AE"><enum>(d)</enum><header>Board consultation</header><text>The Board shall seek expertise from fisheries experts from agencies, colleges, or universities as appropriate.</text> </subsection>
<subsection id="H4BE12DDBC5D54536B40744C0A1ED6C52"><enum>(e)</enum><header>Chairperson</header><text>The Board shall nominate and select a Chairperson from among the members of the Board.</text> </subsection>
<subsection id="H5DA17E66BE174073988C7DE3636E27F0"><enum>(f)</enum><header>Committees</header><text>The Board shall establish a standing science advisory committee to assist it in the development, collection, evaluation, and peer review of statistical, biological, economic, social, and other scientific information, and may establish additional standing or ad hoc committees as necessary.</text> </subsection>
<subsection id="H4F4AEDA018A94F849C47C623A1AB3B54"><enum>(g)</enum><header>Charter</header><text>The Board shall develop a written Charter that—</text> 
<paragraph id="HA14CF6A7424446D7846DBBBCE87753D5"><enum>(1)</enum><text>provides for the members of the Board described in subsection (b);</text> </paragraph>
<paragraph id="H212F312887FB4CAC99611332CE22365D"><enum>(2)</enum><text>may be signed by a broad range of partners, to reflect a shared understanding of the purposes, intent, and governance framework of the Salmon Stronghold Partnership; and</text> </paragraph>
<paragraph id="H2DA7763614384DD8B2B9798B357BE4EF"><enum>(3)</enum><text>includes—</text> 
<subparagraph id="H1994E7AF2ED94A03AFB902B9965D29CB"><enum>(A)</enum><text>the defining criteria for salmon strongholds;</text> </subparagraph>
<subparagraph id="H7BCE4E6B30854EA6ABAA6C5CC05352EF"><enum>(B)</enum><text>the process for identifying salmon strongholds; and</text> </subparagraph>
<subparagraph id="H12B6CE45F3EE4B95BE5D2F3D2C18122F"><enum>(C)</enum><text>the process for awarding salmon stronghold watershed grants under section 6, including—</text> 
<clause id="HB4EF222843D540A18497A51C15F5A873"><enum>(i)</enum><text>the number of years for which such grants may be awarded;</text> </clause>
<clause id="H75AA63EB13F947B7A922EF6378FABBD9"><enum>(ii)</enum><text>the process for renewing such grants;</text> </clause>
<clause id="H26C5BE1646A0424B8802D7915F20F688"><enum>(iii)</enum><text>the eligibility requirements for such grants;</text> </clause>
<clause id="id7A5DE87A27FD4265830BAAEE9C2C7E11"><enum>(iv)</enum><text>the process by which eligible projects may be individually ranked in priority for such grants according to the magnitude and extent of their positive impacts on salmon abundance, productivity or diversity, or any combination thereof, that lead to increased viability for salmon populations;</text> </clause>
<clause id="HBAE98430C63645E9A6286B32D960ACB4"><enum>(v)</enum><text>reporting requirements for projects awarded such grants; and</text> </clause>
<clause id="H0E359550D0564624980231F15FE92467"><enum>(vi)</enum><text>criteria for evaluating the success of projects awarded such grants.</text> </clause></subparagraph></paragraph></subsection>
<subsection id="H4ED3FA5155AF4856A25E63DEC5E0A13B"><enum>(h)</enum><header>Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Board.</text> </subsection></section>
<section id="H78A9971B75A646D900511FB4BAF78ED"><enum>5.</enum><header>Information and assessment</header><text display-inline="no-display-inline">The Administrator shall carry out specific information and assessment functions associated with salmon strongholds, in coordination with other regional salmon efforts, including—</text> 
<paragraph id="H84F3CF3C049746B3B6366277F00F484"><enum>(1)</enum><text>triennial assessment of status and trends in salmon strongholds;</text> </paragraph>
<paragraph id="H073D779A0165487393823EA644C773B"><enum>(2)</enum><text>geographic information system and mapping support to facilitate conservation planning;</text> </paragraph>
<paragraph id="H90FA3CAC564D4651A57421FD2C7FFDEC"><enum>(3)</enum><text>projections of climate change impacts on all habitats and life history stages of salmon;</text> </paragraph>
<paragraph id="H51BE8C3CB43341008EE0CA43B4B6435"><enum>(4)</enum><text>development and application of models and other tools to identify the salmon conservation actions projected to have the greatest positive impacts on abundance, productivity, or diversity (or any combination thereof) within salmon strongholds; and</text> </paragraph>
<paragraph id="H393EE4B7C8034638A7A732C7BD01312"><enum>(5)</enum><text>measurement of the effectiveness of Salmon Stronghold Partnership activities.</text> </paragraph></section>
<section id="H3EB28A33565B4DC5BC3FD3122EE9EE6"><enum>6.</enum><header>Salmon stronghold watershed grants and technical assistance program</header> 
<subsection id="HAF7043D82CD5438892E2434986537E2E"><enum>(a)</enum><header>In general</header><text>The Administrator, in consultation with the Director, shall establish a salmon stronghold watershed grants and technical assistance program, as described in this section.</text> </subsection>
<subsection id="H4C8B31D52976498AAB00E8C566C34549"><enum>(b)</enum><header>Purpose</header><text>The purpose of the program shall be to support salmon stronghold protection and restoration activities, including—</text> 
<paragraph id="H0860B2EE571B4DD19DC3E14B6500B400"><enum>(1)</enum><text>to fund the administration of the Salmon Stronghold Partnership in carrying out the Charter;</text> </paragraph>
<paragraph id="H72FA0203209B434BBF02A3D9026BA6B1"><enum>(2)</enum><text>to encourage cooperation among the entities represented on the Board, local authorities, and private entities to establish a network of salmon strongholds, and assist locally in specific actions that support the Salmon Stronghold Partnership;</text> </paragraph>
<paragraph id="H5715D62FFE664BAB9401299919EB3505"><enum>(3)</enum><text>to support entities represented on the Board—</text> 
<subparagraph id="H50824966BC00466DB5C42C8C7821921"><enum>(A)</enum><text>to develop strategies focusing on the salmon conservation actions projected to have—</text> 
<clause id="id2E76D567A4DE4958BFCD7273368F04AF"><enum>(i)</enum><text>the greatest positive impacts on salmon abundance, productivity, or diversity, or any combination thereof, in salmon strongholds; and</text> </clause>
<clause id="idC4B3270F69B74EEEB74D64F7133A7CC7"><enum>(ii)</enum><text>the greatest positive impacts on long-term salmon habitat and population viability in salmon strongholds; and</text> </clause></subparagraph>
<subparagraph id="H3686595826EF4C86BEDC95E5EC14215"><enum>(B)</enum><text>to provide financial assistance to the Salmon Stronghold Partnership to increase local economic opportunities and resources for actions or practices that provide long-term or permanent protection for and maintain key ecosystem services in salmon strongholds, including—</text> 
<clause id="HACA039EA0A834D1C955CB02139381E6"><enum>(i)</enum><text>payments for ecosystem services;</text> </clause>
<clause id="idB00861E294C24B25BA67587CCD44B78D"><enum>(ii)</enum><text>placement of conservation easements, including those described in 26 U.S.C. 170(h); and</text> </clause>
<clause id="H9A6E8C3BE2BE4C2500DA479CD4903D2F"><enum>(iii)</enum><text>demonstration projects designed for specific salmon strongholds;</text> </clause></subparagraph></paragraph>
<paragraph id="H4D0486968551486892991CFA92C1095D"><enum>(4)</enum><text>to maintain a forum to share best practices and approaches, employ consistent and comparable metrics, forecast and address climate impacts, and monitor, evaluate, and report regional status and trends of salmon ecosystems in coordination with related regional and State efforts;</text> </paragraph>
<paragraph id="H5306E2C06A6D481C9EF44FE7479DABE1"><enum>(5)</enum><text>to work cooperatively with existing salmon conservation programs in and across salmon strongholds to achieve the goals of the Salmon Stronghold Partnership on a regional scale;</text> </paragraph>
<paragraph id="HEE4FA6A8A7B24BD8A583AA7454481629"><enum>(6)</enum><text>to accelerate the implementation of recovery plans in salmon strongholds that have salmon populations listed as threatened or endangered under the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.);</text> </paragraph>
<paragraph id="HF7B3F7C64764414693B07184BB204621"><enum>(7)</enum><text>to develop and make information available to the public pertaining to the Salmon Stronghold Partnership; and</text> </paragraph>
<paragraph id="HF01B2D4CF26C4D6993D7DFBBE156E7F"><enum>(8)</enum><text>to conduct education outreach to the public, in coordination with other programs, to encourage increased stewardship of salmon strongholds.</text> </paragraph></subsection>
<subsection id="HBCE1262438EA411394B8C68D3438BAEF"><enum>(c)</enum><header>Administration</header> 
<paragraph id="H0EA4A7884F5A4D1EB012D3B5CDCFBFB0"><enum>(1)</enum><header>In general</header><text>Projects that will be carried out with assistance from the program shall be administered as follows:</text> 
<subparagraph id="H50FDFE533AD540AAAC7C90FA572CD6BA"><enum>(A)</enum><header>Site-based projects</header><text>A project that will be carried out with assistance from the program within 1 State shall be selected as follows:</text> 
<clause id="H7DD4759510F9451F8B9B4F389F69EA68"><enum>(i)</enum><header>State projects</header><text>If a State has a competitive grant process relating to salmon conservation in effect as of the date of enactment of this Act and has a proven record of implementing an efficient, cost-effective, and competitive grant program for salmon conservation or has a viable plan to provide accountability under the program—</text> 
<subclause id="HF6AC52EF7F0E49288BF17F44DF1E16EF"><enum>(I)</enum><text>the Administrator, in consultation with the Director, shall provide funds to the National Fish and Wildlife Foundation;</text> </subclause>
<subclause id="id14C228F5BD0A44F28CAC109288ED946D"><enum>(II)</enum><text>the National Fish and Wildlife Foundation shall, pursuant to a request by the State for funding under this section, provide program funds to the State for selected projects, as directed by the Board in accordance with paragraph (2); and</text> </subclause>
<subclause id="idF1AF1707937147A181B2A2500D102A1D"><enum>(III)</enum><text>the State shall administer projects to be carried out in such State with the assistance of the program.</text> </subclause></clause>
<clause id="H46508C921F214843BD4B4E9B9D270082"><enum>(ii)</enum><header>National fish and wildlife foundation projects</header><text>If a State does not meet the criteria described in clause (i)—</text> 
<subclause id="HD1885E0549684207AB3FD5397107B400"><enum>(I)</enum><text>the Administrator, in consultation with the Director, shall provide funds to the National Fish and Wildlife Foundation;</text> </subclause>
<subclause id="H04740B6688444DBFB51DA43C8E907600"><enum>(II)</enum><text>the National Fish and Wildlife Foundation shall administer selected projects to be carried out in such State with the assistance of the program, as directed by the Board in accordance with paragraph (2).</text> </subclause></clause></subparagraph>
<subparagraph id="H9B618D1B96AC4F6D009587A307329E45"><enum>(B)</enum><header>Multisite and programmatic initiatives</header><text>For a project that will be carried out with assistance from the program in more than 1 State or that is a programmatic initiative that affects more than 1 State—</text> 
<clause id="HD6864BDA80D54D9C9DE3A912B23B871E"><enum>(i)</enum><text>the Administrator, in consultation with the Director, shall provide funds to the National Fish and Wildlife Foundation; and</text> </clause>
<clause id="H9B0A70CE7CC74814883F99893D9B8500"><enum>(ii)</enum><text>the National Fish and Wildlife Foundation shall administer selected projects to be carried out with the assistance of the program, as directed by the Board in accordance with paragraph (2).</text> </clause></subparagraph></paragraph>
<paragraph id="H7F8466C9ECFA43DEB91339D1221928AD"><enum>(2)</enum><header>Project selection</header> 
<subparagraph id="H5090581C06DA44D79D47F6583BB82EBD"><enum>(A)</enum><header>In general</header><text>Subject to subsection (d), a project is eligible to receive assistance under the program if the project—</text> 
<clause id="H2C62431A2E0B42CD9BDC69E9A981C6B5"><enum>(i)</enum><text>contributes to the conservation of salmon;</text> </clause>
<clause id="H3553562AE11447BB8B442CAF3BB6FC2"><enum>(ii)</enum><text>meets the eligibility criteria set forth by the Board in its Charter under section 4(g);</text> </clause>
<clause id="H0485802319A54A3286B827F0F39074BC"><enum>(iii)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="H99F339144EE94139A1FF1E5506233F39"><enum>(I)</enum><text>addresses a factor limiting or threatening to limit abundance, productivity, diversity, habitat quality, or other biological attributes important to sustaining viable salmon populations within a salmon stronghold; or</text> </subclause>
<subclause id="H570AAD9ED9B543C28E948946F9ABFCA6" indent="up1"><enum>(II)</enum><text>is a programmatic action that supports the Salmon Stronghold Partnership;</text> </subclause></clause>
<clause id="H7B6C6577C22F4707AFCB3600CA5611AE"><enum>(iv)</enum><text>addresses limiting factors to healthy ecosystem processes or sustainable fisheries management;</text> </clause>
<clause id="H46FBBC6867384529821555D6F0AFCD7E"><enum>(v)</enum><text>has the potential for conservation benefits and broadly applicable results; and</text> </clause>
<clause id="H9D11C48A0FBD4D56B8CB586CF9D5FA2E"><enum>(vi)</enum><text>meets the requirements for cost sharing described in paragraph (3).</text> </clause></subparagraph>
<subparagraph id="HCA8A9D66774849F4BD8B75FEFA201927"><enum>(B)</enum><header>Prioritization</header> 
<clause id="idF7C52EB715A040D58609D585B252A6E9"><enum>(i)</enum><header>In general</header><text>The Board shall prioritize individual projects eligible for funding under the program in accordance with the process for such prioritization established in its Charter under section 4(g)—</text> 
<subclause id="idC101BB985BDE4660805A3135B516D48B"><enum>(I)</enum><text>not less often than once each fiscal year; and</text> </subclause>
<subclause id="id0E4E7A0C05F44C4F9349A64731C3DF39"><enum>(II)</enum><text>following the solicitation of projects for funding with amounts available under this Act for the fiscal year.</text> </subclause></clause>
<clause id="idAC63A5ABC0D04F849BE2A5A0CCB2837B"><enum>(ii)</enum><header>Revision</header><text>The Board shall develop or revise, or both, the criteria necessary to prioritize projects eligible for funding under the program—</text> 
<subclause id="id280D41B09F4C4D328B2CE4F79B186751"><enum>(I)</enum><text>not less often than once each fiscal year; and</text> </subclause>
<subclause id="id95D2A3B4D495404F985EAEBF7E0C4183"><enum>(II)</enum><text>prior to the prioritization of projects to be funded with amounts available under this Act for that fiscal year.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="H4B3D022954F945CBA04EA6A23776DBE8"><enum>(3)</enum><header>Cost sharing</header> 
<subparagraph id="HAE25529A3E584EA0009B45006D9288BC"><enum>(A)</enum><header>Federal share</header> 
<clause id="H4C7ED6755F43466EB209509EC24DF4E3"><enum>(i)</enum><header>Non-federal land</header><text>For any fiscal year, the Federal share of the cost of a project that receives assistance under the program and that is carried out on land that is not owned by the United States shall not exceed 50 percent of the total cost of the project.</text> </clause>
<clause id="H52AA15D4D3AB471AA8D0FD35EF6D4506"><enum>(ii)</enum><header>Federal land</header><text>For any fiscal year, the Federal share of the cost of a project that receives assistance under the program and that is carried out on land that is owned by the United States, including the acquisition of inholdings, may be up to 100 percent of the total cost of the project.</text> </clause></subparagraph>
<subparagraph id="H966F439F4E864CC0B9FCAD8E003823D1"><enum>(B)</enum><header>Non-federal share</header> 
<clause id="H9185200E97C44347B700D8D1C71E597D"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the non-Federal share of the cost of a project that receives assistance under the program may not be derived from Federal grant programs, but may include in-kind contributions.</text> </clause>
<clause id="H2BA291A08C74478284A4A6EBCBB4E00"><enum>(ii)</enum><header>Bonneville power administration</header><text>Any amounts provided by the Bonneville Power Administration directly or through a grant to another entity used to carry out a project that receives assistance under the program shall be credited toward the non-Federal share of the cost of the project.</text> </clause></subparagraph></paragraph></subsection>
<subsection id="H0A43F4FAD3F344D18D706E5307905E9F"><enum>(d)</enum><header>Administrative expenses</header><text>Of the amount available to a State or the National Fish and Wildlife Foundation under the program for each fiscal year, such State and the National Fish and Wildlife Foundation shall not expend more than 5 percent of such amount for administrative and reporting expenses necessary to carry out this section.</text> </subsection>
<subsection id="H6D5648A602CC4CEB92C5E7BC7BD5E7A6"><enum>(e)</enum><header>Reports</header> 
<paragraph id="HBCAB6FAFDA424F508CB866009BB74077"><enum>(1)</enum><header>Reports to states or NFWF</header><text>Each person who receives assistance through a State or the National Fish and Wildlife Foundation under the program for a project shall provide periodic reports to the State or the National Fish and Wildlife Foundation, as appropriate, that include the information required by the State or the National Fish and Wildlife Foundation to evaluate the progress and success of the project.</text> </paragraph>
<paragraph id="H84E9AA51F7B34E2E9581C42D25CE4221"><enum>(2)</enum><header>Reports to the administration</header><text>Not less frequently than once every three years, each State that is provided program funds under subsection (c)(1)(A)(i) and the National Fish and Wildlife Foundation shall provide reports to the Administrator that include the information required by the Administrator to evaluate the implementation of the program.</text> </paragraph></subsection></section>
<section id="H06EAF8F46B344B84B52E24ABDC9EE7AE"><enum>7.</enum><header>Interagency cooperation</header><text display-inline="no-display-inline">The head of each Federal agency or department responsible for acquiring, managing, or disposing of Federal land that is within a salmon stronghold shall, to the extent consistent with the mission of the agency or department and existing law, cooperate with the Administrator and the Director to—</text> 
<paragraph id="HFCFCD715708F4A4396D9852EC108938B"><enum>(1)</enum><text>conserve the salmon stronghold; and</text> </paragraph>
<paragraph id="HE311D82F98134AB5A8A87269535E0071"><enum>(2)</enum><text>effectively coordinate and streamline Salmon Stronghold Partnership activities and delivery of overlapping, incentive-based programs that affect the salmon stronghold.</text> </paragraph></section>
<section id="HFA5F0662FE344A55A196C84698F7CF27"><enum>8.</enum><header>International cooperation</header> 
<subsection id="H49E27241FFEF4DCEB136112D18003CCB"><enum>(a)</enum><header>Authority To cooperate</header><text>The Administrator and the Board may share status and trends data, innovative conservation strategies, conservation planning methodologies, and other information with North Pacific countries including Canada, Japan, Russia, and South Korea, and appropriate international entities, to promote salmon conservation and habitat.</text> </subsection>
<subsection id="H852BBA78B82A4FEBBC3D4C18A6C1E813"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Administrator and the Board, or entities that are members of the Board, should and are encouraged to provide information to North Pacific countries including Canada, Japan, Russia, and South Korea, and appropriate international entities, to support the development of a network of salmon strongholds across the nations of the North Pacific.</text> </subsection></section>
<section id="H825F1CDDEB23439E004700A5F6C5F883"><enum>9.</enum><header>Conditions relating to salmon stronghold conservation projects</header> 
<subsection id="H828A434E3B134EA196C77D0089D7AD7"><enum>(a)</enum><header>In general</header><text>No land or interest in land, acquired in whole or in part by the Secretary of the Interior with Federal funds made available under this Act to carry out a salmon stronghold conservation project may be transferred to a State, other public agency, or other entity unless—</text> 
<paragraph id="H512B616A77EE43ED9549E9A9F12BF808"><enum>(1)</enum><text>the Secretary of the Interior determines that the State, agency, or entity is committed to manage, in accordance with this Act and the purposes of this Act, the property being transferred; and</text> </paragraph>
<paragraph id="HD0438AE9D53D468C9C5B679B71BF001D"><enum>(2)</enum><text>the deed or other instrument of transfer contains provisions for the reversion of the title to the property to the United States if the State, agency, or entity fails to manage the property in accordance with this Act and the purposes of this Act.</text> </paragraph></subsection>
<subsection id="HF774BF4178404C25A3979B176B00232B"><enum>(b)</enum><header>Requirement</header><text>Any real property interest conveyed under this section shall be subject to such terms and conditions as will ensure, to the maximum extent practicable, that the interest will be administered in accordance with this Act and the purposes of this Act.</text> </subsection></section>
<section id="HC4BF71BB225646478FFF492563C28FDF"><enum>10.</enum><header>Administrative provisions</header> 
<subsection id="HC27F0395C165410C9D3DCBFA4C8B7E1C"><enum>(a)</enum><header>Contracts, grants, and transfers of funds</header><text>In carrying out this Act, the Secretary may—</text> 
<paragraph id="HF311F2E2AE304A569EC0EC9200421277"><enum>(1)</enum><text>consistent with a recommendation of the board and notwithstanding sections 6304 and 6305 of title 31, United States Code, and the Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note; Public Law 106–107), enter into cooperative agreements, contracts, and grants;</text> </paragraph>
<paragraph id="H1533380D0BC3470EABA139B6C44BF26"><enum>(2)</enum><text>notwithstanding any other provision of law, apply for, accept, and use grants from any person to carry out the purposes of this Act; and</text> </paragraph>
<paragraph id="HE49D491410894F53948648517E3ED15B"><enum>(3)</enum><text>make funds available to any Federal agency to be used by the agency to award financial assistance for any salmon stronghold protection, restoration, or enhancement project that the Secretary determines to be consistent with this Act.</text> </paragraph></subsection>
<subsection id="HDF3749A127F945DC89C8D9C700186588"><enum>(b)</enum><header>Donations</header> 
<paragraph id="H99ED2774F3644D48BF01EBB6120059B0"><enum>(1)</enum><header>In general</header><text>The Secretary may—</text> 
<subparagraph id="H457330B38E9C4D50BF78007BF66EA797"><enum>(A)</enum><text>enter into an agreement with any organization described in section 501(c)(3) of the Internal Revenue Code of 1986 to authorize the organization to carry out activities under this Act; and</text> </subparagraph>
<subparagraph id="H358F7364C50A4C5E00E75A5724C7BFC"><enum>(B)</enum><text>accept donations of funds or services for use in carrying out this Act.</text> </subparagraph></paragraph>
<paragraph id="HB0BD9E08B057494E891D1DD014D931E3"><enum>(2)</enum><header>Property</header><text>The Secretary of the Interior may accept donations of property for use in carrying out this Act.</text> </paragraph>
<paragraph id="HB422EC17DCF04A4B84B543CF83B1B75B"><enum>(3)</enum><header>Use of donations</header><text>Donations accepted under this section—</text> 
<subparagraph id="HC9553EED93524B6100C01E168F69794D"><enum>(A)</enum><text>shall be considered to be gifts or bequests to, or for the use of, the United States; and</text> </subparagraph>
<subparagraph id="H6D2DCA16837B4A80B5B0B56078DD2E48"><enum>(B)</enum><text>may be used directly by the Secretary (or, in the case of donated property under paragraph (2), the Secretary of the Interior) or provided to other Federal agencies or departments through interagency agreements.</text> </subparagraph></paragraph></subsection>
<subsection id="H2682BD42D9D14B20AA89A22FD07F8691"><enum>(c)</enum><header>Interagency financing</header><text>The Secretary may participate in interagency financing, including receiving appropriated funds from other agencies or departments to carry out this Act.</text> </subsection>
<subsection id="H3CCCDA4530F3445B85F17997B16C5954"><enum>(d)</enum><header>Staff</header><text>Subject to the availability of appropriations, the Administrator may hire such additional full-time employees as are necessary to carry out this Act.</text> </subsection></section>
<section id="H0B3AC63875C342F8A5C84C6133BFA600"><enum>11.</enum><header>Acquisition of real property interests</header> 
<subsection id="H2EE6554DAD9849FD9877C5E7514B10BF"><enum>(a)</enum><header>Use of real property</header><text>No project that will result in the acquisition by the Secretary or the Secretary of the Interior of any land or interest in land, in whole or in part, may receive funds under this Act unless the project is consistent with the purposes of this Act.</text> </subsection>
<subsection id="HD41C43D773CE4D3A84F2F2FA4BA10310"><enum>(b)</enum><header>Private property protection</header><text>No Federal funds made available to carry out this Act may be used to acquire any real property or any interest in any real property without the written consent of the 1 or more owners of the property or interest in property.</text> </subsection></section>
<section id="H2505425B49A34D17A090D782F5D4EA3"><enum>12.</enum><header>Limitations</header><text display-inline="no-display-inline">Nothing in this Act may be construed—</text> 
<paragraph id="H6488A91A33744A4890ED05E75C77734C"><enum>(1)</enum><text>to create a reserved water right, express or implied, in the United States for any purpose, or affect the management or priority of water rights under State law;</text> </paragraph>
<paragraph id="H901D9CC568474D5F87DD07AFCF2814A4"><enum>(2)</enum><text>to affect existing water rights under Federal or State law;</text> </paragraph>
<paragraph id="H367201D9A4A44D3CA6DBB04D5BCD9EDA"><enum>(3)</enum><text>to affect any Federal or State law in existence on the date of enactment of this Act regarding water quality or water quantity;</text> </paragraph>
<paragraph id="H40E0BDFFB3E547C8B2FA13DF3DBB5363"><enum>(4)</enum><text>to affect the authority, jurisdiction, or responsibility of any agency or department of the United States or of a State to manage, control, or regulate fish and resident wildlife under a Federal or State law or regulation;</text> </paragraph>
<paragraph id="HAE76F3D7A1EA4B58821D409BF744DD98"><enum>(5)</enum><text>to authorize the Secretary or the Secretary of the Interior to control or regulate hunting or fishing under State law;</text> </paragraph>
<paragraph id="HD4B058AC4B3547179DB8338B4DC29B7B"><enum>(6)</enum><text>to abrogate, abridge, affect, modify, supersede, or otherwise alter any right of a federally recognized Indian tribe under any applicable Federal or tribal law or regulation; or</text> </paragraph>
<paragraph id="H616C98561CBB4AE88B673747E4D67FD"><enum>(7)</enum><text>to diminish or affect the ability of the Secretary or the Secretary of the Interior to join the adjudication of rights to the use of water pursuant to subsections (a), (b), or (c) of section 208 of the Department of Justice Appropriation Act, 1953 (43 U.S.C. 666).</text> </paragraph></section>
<section id="HD70845C2100E4A7682393200E8D40400"><enum>13.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Not less frequently than once every 3 years, the Administrator, in consultation with the Director, shall submit to Congress a report describing the activities carried out under this Act, including the recommendations of the Administrator, if any, for legislation relating to the Salmon Stronghold Partnership.</text> </section>
<section id="H6DA47F67E6894165BC36DBBC298CCF00"><enum>14.</enum><header>Authorization of appropriations</header> 
<subsection id="H04B491338ED14D8D824701AFAF3DCC3"><enum>(a)</enum><header>Grants</header> 
<paragraph id="HA37A0946DAEA442D86A9B985F5F324FC"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to each of the Administrator and Director, to be distributed or administered, or both, by the National Fish and Wildlife Foundation as a fiscal agent, to provide grants under the program $15,000,000 for each of fiscal years 2009 through 2013.</text> </paragraph>
<paragraph id="HD2658F7861D14B658D44682510C38B00"><enum>(2)</enum><header>Board</header><text>The National Fish and Wildlife Foundation shall, from the amount appropriated pursuant to the authorization in paragraph (1), make available sufficient funds to the Board to carry out its duties under this Act.</text> </paragraph></subsection>
<subsection id="HEAF4474E8834457B94A8082DD71E420"><enum>(b)</enum><header>Technical assistance</header><text>For each of fiscal years 2009 through 2013, there is authorized to be appropriated to the Administrator $300,000 to provide technical assistance under the program and to carry out section 5.</text> </subsection>
<subsection id="HE88831B470A040FE9819BA4E13093F9C"><enum>(c)</enum><header>Availability of funds</header><text>Amounts appropriated pursuant to an authorization of appropriations in this section are authorized to remain available until expended.</text> </subsection></section>
