<official-title>To prohibit the introduction or delivery for introduction into interstate commerce of novelty lighters, and for other purposes.</official-title>

<section id="HA7DC82308FD54A5D988A19535502BEC4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Children from Dangerous Lighters Act of 2009</short-title></quote>.</text></section>
<section id="H9C03A5F074DB40A3BB8055D681607F70"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
<paragraph id="H8E3D83E566074067905B7228F49876B8"><enum>(1)</enum><text>Lighters are inherently dangerous products containing flammable fuel.</text></paragraph>
<paragraph id="H8C3BBE2B745B4C5A819FB515F90D7D23"><enum>(2)</enum><text>If lighters are used incorrectly or used by children, dangerous and damaging consequences may result.</text></paragraph>
<paragraph id="H861C5144F8D8419982383F23189C1D18"><enum>(3)</enum><text>Novelty lighters are easily mistaken by children and adults as children’s toys or as common household items.</text></paragraph>
<paragraph id="HACC38367486C4D13A269A102CB1FDF64"><enum>(4)</enum><text>Novelty lighters have been the cause of many personal injuries to children and adults and property damage throughout the United States.</text></paragraph></section>
<section id="H5F31C13005474F5186E94DDD3FCD77B9"><enum>3.</enum><header>Novelty lighter defined</header>
<subsection id="H876BECB6E666435780C283CF20149CD4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In this Act, the term <term>novelty lighter</term> means a device typically used for the igniting or lighting of cigarettes, cigars, or pipes that has a toy-like appearance, has entertaining audio or visual effects, or resembles in any way in form or function an item that is commonly recognized as appealing, attractive, or intended for use by children of 10 years of age or younger, including such a device that takes toy-like physical forms, including toy animals, cartoon characters, cars, boats, airplanes, common household items, weapons, cell phones, batteries, food, beverages, musical instruments, and watches.</text></subsection>
<subsection id="H896DE737C7174C96B5AE510536492FE0"><enum>(b)</enum><header>Exclusion</header><text>Such term does not include standard disposable and refillable lighters that are printed or decorated with logos, labels, decals, artwork, or heat shrinkable sleeves.</text></subsection></section>
<section id="HE47173B69D614DF88776C8225AA43BD6"><enum>4.</enum><header>Ban on novelty lighters</header>
<subsection id="H5B3804F4BEDC462184F1BB6186F59375"><enum>(a)</enum><header>Banned hazardous substance</header><text>A novelty lighter shall be treated as a banned hazardous substance as defined in section 2 of the Federal Hazardous Substances Act (15 U.S.C. 1261) and the prohibitions set out in section 4 of such Act (15 U.S.C. 1263) shall apply to novelty lighters.</text></subsection>
<subsection id="HC268E3D2DED34DC7B01DEB23D37D3CF6"><enum>(b)</enum><header>Application</header><text>Subsection (a) applies to a novelty lighter—</text>
<paragraph id="H1356E2F98B3447D48891C88F16AE1884"><enum>(1)</enum><text>manufactured on or after January 1, 1980; and</text></paragraph>
<paragraph id="HC18115209EB14FFF92977D6F70147671"><enum>(2)</enum><text>that is not considered by the Consumer Product Safety Commission to be an antique or an item with significant artistic value.</text></paragraph></subsection></section>
