		<official-title>To amend titles XI and XVIII of the Social Security Act
		  to provide increased civil and criminal penalties for acts involving fraud and
		  abuse under the Medicare Program and to increase the amount of the surety bond
		  required for suppliers of durable medical equipment.</official-title>

		<section id="H4768C81F02BE489F8D00B0CFA18C7EF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Fraud Prevention Act of
			 2009</short-title></quote>.</text>
		</section><section id="HDEB880D4C00C475B95BD978B01378C16"><enum>2.</enum><header>Increased civil
			 money penalties and criminal fines for medicare fraud and abuse</header>
			<subsection id="HE032A5DBDEA44992A46D58FC2D0B82F"><enum>(a)</enum><header>Increased Civil
			 Money Penalties</header><text>Section 1128A of the Social Security Act (42
			 U.S.C. 1320a–7a) is amended—</text>
				<paragraph id="HC633D823A9A443408FE96F00AF004FC"><enum>(1)</enum><text>in
			 subsection (a), in the flush matter following paragraph (7)—</text>
					<subparagraph id="HA31D9703F1384094AEDA9017F085EDFA"><enum>(A)</enum><text>by striking
			 <quote>$10,000</quote> each place it appears and inserting
			 <quote>$20,000</quote>;</text>
					</subparagraph><subparagraph id="H8EC75951B1C0414DA9FEC9DE41767C86"><enum>(B)</enum><text>by striking
			 <quote>$15,000</quote> and inserting <quote>$30,000</quote>; and</text>
					</subparagraph><subparagraph id="H1EB5BD23C32848FEAF4514449D74F61C"><enum>(C)</enum><text>by striking
			 <quote>$50,000</quote> and inserting <quote>$100,000</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H0D72F219F62B4654BB746D8F238B2EC1"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H4F88AA5E4972420F8DFD8EBCEDF2B992"><enum>(A)</enum><text>in paragraph (1),
			 in the flush matter following subparagraph (B), by striking
			 <quote>$2,000</quote> and inserting <quote>$4,000</quote>;</text>

					</subparagraph></paragraph></subsection><subsection id="H3C3DDE59145F423DAB137ED2FBAFA43E"><enum>(b)</enum><header>Increased
			 Criminal Fines</header><text>Section 1128B of the Social Security Act (42
			 U.S.C. 1320a–7b) is amended—</text>
				<paragraph id="HE5446D6A411A433AADF418004B2F7EF5"><enum>(1)</enum><text>in subsection (a),
			 in the flush matter following paragraph (6)—</text>
					<subparagraph id="H0865688B4A704DB284A059982C09B5B2"><enum>(A)</enum><text>by striking
			 <quote>$25,000</quote> and inserting <quote>$100,000</quote>; and</text>
					</subparagraph><subparagraph id="HAE05D5342B7941A59E2BF6216BE66F84"><enum>(B)</enum><text>by striking
			 <quote>$10,000</quote> and inserting <quote>$20,000</quote>;</text>
					</subparagraph></paragraph><paragraph id="HC4A6FD4DFFF34B7393A80442949B1F6B"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H66F21C8278BC4CFF0090BD4360166DE"><enum>(A)</enum><text>in paragraph (1),

			 <quote>$25,000</quote> and inserting <quote>$100,000</quote>; and</text>

			 <quote>$25,000</quote> and inserting <quote>$100,000</quote>; and</text>
				</paragraph><paragraph id="H0138D9C3F93F429BBD931985923E00C9"><enum>(5)</enum><text>in subsection (e),
			 by striking <quote>$2,000</quote> and inserting <quote>$4,000</quote>.</text>
				</paragraph></subsection><subsection id="H789117B43FBD4FD28E3B9C72E67C229D"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to civil
			 money penalties and fines imposed for actions taken on or after the date of
			 enactment of this Act.</text>
			</subsection></section><section id="H2C667F365C2E47E99B53453CD600BB61"><enum>3.</enum><header>Increased
			 sentences for felonies involving medicare fraud and abuse</header>
			<subsection id="H01B2943C2AF245998D1F50527E3D3B96"><enum>(a)</enum><header>False Statements
			 and Representations</header><text>Section 1128B(a) of the Social Security Act
			 (42 U.S.C. 1320a–7b(a)) is amended, in clause (i) of the flush matter following
			 paragraph (6), by striking <quote>not more than 5 years</quote> and inserting
			 <quote>not more than 10 years</quote>.</text>
			</subsection><subsection id="HD22A7015647144DC9811B800E931D756"><enum>(b)</enum><header>Anti-Kickback</header><text>Section
			 1128B(b) of the Social Security Act (42 U.S.C. 1320a–7b(b)) is amended—</text>
				<paragraph id="HA42E95AE5144430897C64BCA803FE4AF"><enum>(1)</enum><text>in paragraph (1),
			 in the flush matter following subparagraph (B), by striking <quote>not more
			 than 5 years</quote> and inserting <quote>not more than 10 years</quote>;
			 and</text>
				</paragraph><paragraph id="H724508309DA04C0EB786CA2CB223E8A4"><enum>(2)</enum><text>in paragraph (2),
			 in the flush matter following subparagraph (B), by striking <quote>not more
			 than 5 years</quote> and inserting <quote>not more than 10
			 years</quote>.</text>
				</paragraph></subsection><subsection id="H11C5C7F7BB1C4BF487A04DD638EDB9C"><enum>(c)</enum><header>False Statement
			 or Representation With Respect to Conditions or Operations of
			 Facilities</header><text>Section 1128B(c) of the Social Security Act (42 U.S.C.
			 1320a–7b(c)) is amended by striking <quote>not more than 5 years</quote> and
			 inserting <quote>not more than 10 years</quote>.</text>
			</subsection><subsection id="H715A11C9EECF479BA476DDA1B4BA1065"><enum>(d)</enum><header>Excess
			 Charges</header><text>Section 1128B(d) of the Social Security Act (42 U.S.C.
			 1320a–7b(d)) is amended, in the second flush matter following subparagraph (B),
			 by striking <quote>not more than 5 years</quote> and inserting <quote>not more
			 than 10 years</quote>.</text>
			</subsection><subsection id="H5DFCCC4604814CA8ABEB329C5678A9B7"><enum>(e)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to criminal
			 penalties imposed for actions taken on or after the date of enactment of this
			 Act.</text>
			</subsection></section><section id="H2AC990A447F94BCCB15C6FC170DF00C"><enum>4.</enum><header>Increased surety
			 bond requirement for suppliers of dme</header>
			<subsection id="HE6D444E1ECE34C1B8FFCE78DD0FCD6C4"><enum>(a)</enum><header>In
			 General</header><text>Section 1834(a)(16)(B) of the Social Security Act (42
			 U.S.C. 1395m(a)(16)(B)) is amended by striking <quote>$50,000</quote> and
			 inserting <quote>$500,000</quote>.</text>
			</subsection><subsection id="HEEC62DF8B848453CAD4655EB1DA60088"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by this section shall apply to the
			 issuance (or renewal) of a provider number for a supplier of durable medical
			 equipment on or after the date of enactment of this Act.</text>
