		<official-title>To amend the Federal Election Campaign Act of 1971 to
		  prohibit an authorized committee of a candidate who is a Member of Congress
		  from accepting contributions from any entity for which the candidate sought a
		  Congressional earmark.</official-title>

		<section id="H28D44D4E7CD84992A369A288A341A0EC" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean Law for Earmark Accountability
			 Reform Act</short-title></quote> or the <quote><short-title>CLEAR Act</short-title></quote>.</text>
		</section><section id="HD969F09007854E5787405D81C7AB4D47"><enum>2.</enum><header>Prohibiting
			 Candidates from Accepting Contributions From Entities for Which Candidates Seek
			 Congressional Earmarks</header>
			<subsection id="HECB12DD191AF4A90837DA25FEC03B87F"><enum>(a)</enum><header>Prohibiting
			 Acceptance of Contributions</header><text display-inline="yes-display-inline">Section 315 of the Federal Election
			 Campaign Act of 1971 (2 U.S.C. 441a) is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC5EC1B21FBAD455CAF62F6BFA64ABD36" style="OLC">
					<subsection id="H32FC58D924064AB39D30592F7B17FD00"><enum>(k)</enum><header>Prohibiting
				Acceptance of Contributions From Entities for Which Candidates Seek
				Congressional Earmarks</header>
						<paragraph id="H5CAD1060F1B84C8B95395135DBD3A13D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">An authorized
				committee of a candidate for election for Federal office who is a Member of
				Congress (including a Delegate or Resident Commissioner to the Congress) may
				not accept any contribution—</text>
							<subparagraph id="H95461C631D894917B02207443A6D6577"><enum>(A)</enum><text>from any entity
				for which the Member sought a Congressional earmark during the election cycle,
				or from any senior executive of such an entity or any person who is registered
				as a lobbyist under the Lobbying Disclosure Act of 1995 (2 U.S.C. 1601 et seq.)
				for whom the entity was a client for purposes of such Act; or</text>
							</subparagraph><subparagraph id="H7E5ADBC71E874AD791776753770B13A6"><enum>(B)</enum><text>if the Member
				sought a Congressional earmark for a corporation during the election cycle,
				from a separate segregated fund established and administered by the corporation
				or labor organization under section 316(b)(2)(C).</text>
							</subparagraph></paragraph><paragraph id="H6A3E73227EC74916A77E571C98B003F8"><enum>(2)</enum><header>Congressional
				earmark defined</header><text>In this subsection, the term <term>Congressional
				earmark</term> means a provision or report language which—</text>
							<subparagraph id="H939B6D597A724246AEC7FBBAB84B6785"><enum>(A)</enum><text>is included in a
				bill or joint resolution, a committee report to accompany a bill or joint
				resolution, or a conference report to accompany a bill or joint resolution
				(including a joint explanatory statement prepared by the managers of the
				conference) primarily at the request of a Member of Congress; and</text>
							</subparagraph><subparagraph id="HA5920B33C477492ABCFA3E1F7D8316D0"><enum>(B)</enum><text>provides,
				authorizes, or recommends a specific amount of discretionary budget authority,
				credit authority, or other spending authority for a contract, loan, loan
				guarantee, grant, loan authority, or other expenditure with or to an entity,
				other than through a statutory or administrative formula-driven or competitive
				award process.</text>
							</subparagraph></paragraph><paragraph id="H7BD20801ABB646AD992FD20450B9654D"><enum>(3)</enum><header>Election cycle
				defined</header><text>In this subsection, the term <term>election cycle</term>
				has the meaning given such term in section 301(25), without regard to the
				second sentence of such section.</text>
						</paragraph><paragraph id="HDA34F1E765DB46A0AD4A3FD7BB601DE8"><enum>(4)</enum><header>Senior executive
				defined</header><text>In this subsection, the term <term>senior
				executive</term> means, with respect to an entity, the President, Chief
				Executive Officer, Chief Operating Officer, or Chief Financial Officer of the
				entity.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA191ABFBA2524043AA83618BA5E28E4C"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by subsection (a) shall apply with
			 respect to contributions made on or after the date of the enactment of this
			 Act.</text>
