		<section id="H4302CC6206214F1BBD68C64F494984D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Marine Mammal Research
			 Program Act of 2009</short-title></quote>.</text>
		</section><section id="H299086BA5BBD4F9DAE26E9F8FB863238"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H9337690265334BA19CD95CD635871FAC"><enum>(1)</enum><text>populations of
			 marine mammals that occur in waters of the United States are resources of
			 substantial ecological, scientific, socioeconomic, and esthetic value;</text>
			</paragraph><paragraph id="H71C60CDD8FE147A7897DEF4F39B59407"><enum>(2)</enum><text>although progress
			 has been made toward understanding the impacts of human activities and natural
			 environmental changes on marine mammal populations, much work remains to be
			 done;</text>
			</paragraph><paragraph id="H9DB442FB0B0C44F6ABC81E6D20809F1C"><enum>(3)</enum><text>some marine mammal
			 populations are in various stages of recovery, while many others remain
			 critically endangered and their status has not improved or has declined;</text>
			</paragraph><paragraph id="H9C2C883FFFCE4286BC3B44DC67AA63AD"><enum>(4)</enum><text>there is a clear
			 need to better understand, evaluate, and mitigate the impacts on marine mammals
			 and other marine species of an array of anthropogenic activities;</text>
			</paragraph><paragraph id="HAB683D0C9D124E8D86C65D076129F120"><enum>(5)</enum><text>data gaps and
			 scientific uncertainty present resource managers with significant challenges in
			 implementing the Marine Mammal Protection Act of 1972 (16 U.S.C. 1361 et seq.)
			 the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.), and the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.);</text>
			</paragraph><paragraph id="H475F62D736EA49CDB91564A05355A88B"><enum>(6)</enum><text>funding has been
			 insufficient to support all of the research required to fully understand and
			 properly conserve and manage marine mammal populations;</text>
			</paragraph><paragraph id="H7FFAAE1F446B4515BE58111565C7FF95"><enum>(7)</enum><text>in particular, in
			 a recent report to Congress the Marine Mammal Commission recommended the
			 establishment of a research program, the initial goal of which is to improve
			 understanding of anthropogenic sound, its biologically significant effects on
			 marine mammals and marine ecosystems, and effective means for mitigating and
			 monitoring those effects;</text>
			</paragraph><paragraph id="H0891B0131D29452B913988037629D74D"><enum>(8)</enum><text>understanding
			 marine mammals through research is essential for using the oceans wisely and
			 protecting marine living resources, and the United States should maintain its
			 world leadership in marine mammal science and oceanography as one key to its
			 competitive future; and</text>
			</paragraph><paragraph id="HD631078693214402BDBEEEF3506EF348"><enum>(9)</enum><text>the Marine Mammal
			 Commission established under section 201 of the Marine Mammal Protection Act of
			 1972 (16 U.S.C. 1401) has research and management responsibilities under that
			 Act that make it the appropriate entity to administer a marine mammal research
			 program.</text>
			</paragraph></section><section id="HAB157D262E994D35B25BACEBF3F9E4A4"><enum>3.</enum><header>National Marine
			 Mammal Research Program</header>
			<subsection id="HEBAF624710F44D969DD6E7889E0783F8"><enum>(a)</enum><header>Establishment of
			 program</header><text>Title II of the Marine Mammal Protection Act of 1972 (16
			 U.S.C. 1401 et seq.) is amended—</text>
				<paragraph id="H68AD2A59356340E5B267DE16B51991E0"><enum>(1)</enum><text>by inserting after
			 the title heading the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC4714CFE2917401D003B1EE060E990C8" style="OLC">
						<subtitle id="H0A192E0CCC8F4B27B7DB6D8197CA6989"><enum>A</enum><header>General
				provisions</header>
						</subtitle><after-quoted-block>;</after-quoted-block></quoted-block>
					<continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="H914E70E112E34F9A8F9506D9EBB1B785"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9A34F7BD99BD4F749193A7C17C8734E1" style="OLC">
						<subtitle id="H5A1FDD943341409A9DC638DF60385C9B"><enum>B</enum><header>Marine Mammal
				Research</header>
							<section id="H70B9A4CB81F54A6E822159E1112809DA"><enum>221.</enum><header>National Marine
				Mammal Research Program</header>
								<subsection id="H950652F08FFF42B3987B98F7DA12EA28"><enum>(a)</enum><header>Establishment</header><text>The
				Commission shall establish a program to be known as the <quote>National Marine
				Mammal Research Program</quote>.</text>
								</subsection><subsection id="H69E0742FA6774E2481E79C8CE5058F45"><enum>(b)</enum><header>Purposes</header><text>The
				purposes of the program are as follows:</text>
									<paragraph id="H079A50E28932447BA5ADF667E767FE4F"><enum>(1)</enum><text>To undertake
				research to improve the Nation’s understanding of marine mammals, the factors,
				natural and human related, that affect and threaten the health of their
				populations and habitats, and the means of mitigating those effects to ensure
				marine mammal conservation.</text>
									</paragraph><paragraph id="H6CCEBB731040422DB662BBEDEEE20049"><enum>(2)</enum><text display-inline="yes-display-inline">To coordinate and strengthen scientific
				research efforts in support of those goals by—</text>
										<subparagraph id="H1D387C3F1CDC4A149B91A95103CE700"><enum>(A)</enum><text>identifying and
				developing partnerships among Federal agencies, academia, industry, and other
				members of the oceanographic and marine mammal scientific communities in the
				areas of data collection, research, resource management public education, and
				communication; and</text>
										</subparagraph><subparagraph id="H80B97F270CD54BC69E80AB9CDC507344"><enum>(B)</enum><text>reporting annually
				to Congress on the program.</text>
										</subparagraph></paragraph></subsection><subsection id="H87F51A8130FA436B953C6F7600A75566"><enum>(c)</enum><header>Duties</header><text>The
				Commission shall—</text>
									<paragraph id="HB29C31BB0F3541BAAB867941029C77F1"><enum>(1)</enum><text>prescribe such
				policies and procedures necessary to implement the Research Program;</text>
									</paragraph><paragraph id="H82D3F77DDFC34377A140261D57C94F18"><enum>(2)</enum><text>implement and
				support the Research Coordinating Committee, established under section
				222;</text>
									</paragraph><paragraph id="H328514CAC1294A4CAABA829F7B95E828"><enum>(3)</enum><text>supervise the
				performance of duties by the Program Office established under subsection
				(d);</text>
									</paragraph><paragraph id="H00C990A6620543C5A0562DE5FBDA1FA3"><enum>(4)</enum><text>prepare an annual
				report to Congress on research undertaken and benefits thereof; and</text>
									</paragraph><paragraph id="H54A5F268AF984C8B004DC08591E90549"><enum>(5)</enum><text>conduct periodic
				program reviews.</text>
									</paragraph></subsection><subsection id="HFE0AAF684C5D46018CEF4EEDED2DC08"><enum>(d)</enum><header>Authorities</header><text>The
				Commission shall have the authority, within the limits of available
				appropriations, to do all things necessary to carry out the provisions of this
				section, including the authority to—</text>
									<paragraph id="H98664B03695F49209564E3A8266EC456"><enum>(1)</enum><text>enter into
				contracts, make grants, or enter other arrangements as may be necessary for the
				purpose of implementing the Research Program and carrying out the
				responsibilities of the Research Coordinating Committee established under
				section 222—</text>
										<subparagraph id="H6838C95A175747C790D4356BDCBE18D4"><enum>(A)</enum><text>with any agency or
				instrumentality of the United States, with any State, territory, or possession
				or any political subdivision thereof, or with any person, firm, association,
				corporation, or educational institution;</text>
										</subparagraph><subparagraph id="H1CD40B4B5093479F81605961F35C39D9"><enum>(B)</enum><text>with or without
				reimbursement;</text>
										</subparagraph><subparagraph id="H91999DE506074EAFB102A14DF9BAC283"><enum>(C)</enum><text>without
				performance or other bonds; and</text>
										</subparagraph><subparagraph id="HE574317E7CA5435B8DF648D3D02FD8C6"><enum>(D)</enum><text>without regard to
				section 3709 of the Revised Statutes (41 U.S.C. 5);</text>
										</subparagraph></paragraph><paragraph id="H17470F0377A840C6B91EC4A9A74EEC85"><enum>(2)</enum><text>accept and use the
				services of voluntary and uncompensated personnel necessary for the conduct of
				the work of the Research Program and provide transportation and subsistence as
				authorized by section 5703 of title 5, United States Code, for persons serving
				without compensation; and</text>
									</paragraph><paragraph id="H45767D792AC64F348BB05E9791B2262"><enum>(3)</enum><text>prescribe such
				rules and regulations as it determines necessary governing the operation and
				organization of the Research Program.</text>
									</paragraph></subsection><subsection id="H83403D47E9BD4B9CB1607DAB63194F38"><enum>(e)</enum><header>National Marine
				Mammal Research Program Office</header>
									<paragraph display-inline="no-display-inline" id="HBC3C12FD198A447F95993E77324D25F"><enum>(1)</enum><header>Establishment</header><text>The
				Commission shall establish a National Marine Mammal Research Program Office for
				the Research Program. The Commission shall use competitive procedures in
				selecting an operator for the Program Office.</text>
									</paragraph><paragraph id="HA9ADC337BDCA4282AECA46001D4809D2"><enum>(2)</enum><header>Duties</header><text>The
				Commission shall assign the following duties to the Program Office:</text>
										<subparagraph id="H8FB906BC94F042C68BC8DCDE9A635E3"><enum>(A)</enum><text>Work with the
				Commission and the Research Coordinating Committee to draft the program
				announcement, identify proposal selection criteria, organize and conduct an
				independent peer review of the proposals, and recommend to the Commission and
				Research Coordinating Committee projects and funding allocations for
				implementation under the Research Program.</text>
										</subparagraph><subparagraph id="H2DBA15A8ADBA470297BFB3F600558BD"><enum>(B)</enum><text>Manage the process
				for soliciting proposals for research, including managing peer review of such
				projects, subject to oversight and approval by the Commission and the Research
				Coordinating Committee.</text>
										</subparagraph><subparagraph id="H11F3286A7400445880AC6F02FEB159DB"><enum>(C)</enum><text>Submit an annual
				report on the status of all projects and activities of the office, for review
				by the Research Coordinating Committee and final approval and release by the
				Commission.</text>
										</subparagraph><subparagraph id="HA3E82FC2DCBE42B2B5EB1045A3B11768"><enum>(D)</enum><text>Undertake any
				additional duties for the administration of the Research Program that the
				Commission or the Research Coordinating Committee considers appropriate.</text>
										</subparagraph></paragraph></subsection><subsection id="H2B13865C1C3E422481EC8C5D06928357"><enum>(f)</enum><header>Annual
				report</header><text>The Commission shall transmit to Congress an annual report
				on progress made in implementing this subtitle. The report shall contain the
				following:</text>
									<paragraph id="H72AA17191A164A5282E5976B0994DCDF"><enum>(1)</enum><text>A description of
				activities of the Research Program carried out during the preceding fiscal
				year, with a list of the members of the Research Coordinating Committee and any
				subcommittees in existence during the fiscal year.</text>
									</paragraph><paragraph id="H67DA9AF567954A2CBDDEB76BEA752894"><enum>(2)</enum><text>A general outline
				of the activities planned or conducted for the Research Program during the
				fiscal year for which the report is prepared.</text>
									</paragraph><paragraph id="HC07DC34036864DCDB88F78EA46CCEB2"><enum>(3)</enum><text>A description of
				the involvement of the Research Program with Federal interagency coordinating
				entities.</text>
									</paragraph><paragraph id="HF08F0799C96147CF9996E31835A0E8B9"><enum>(4)</enum><text>The programs,
				projects, and activities of the Research Program and the estimated expenditures
				under such programs, projects, and activities during the subsequent fiscal
				year.</text>
									</paragraph></subsection></section><section id="H40A0631BD7A24257B02C3C9BEEB6D264"><enum>222.</enum><header>National Marine
				Mammal Research Coordinating Committee</header>
								<subsection id="H1722F4B62CC84A5DB1BE0082D49B1848"><enum>(a)</enum><header>Committee</header><text>The
				President, after consultation with the Commission, shall create a National
				Marine Mammal Research Coordinating Committee.</text>
								</subsection><subsection id="H0BB3931A6E784543BF31C7DD00932036"><enum>(b)</enum><header>Membership</header>
									<paragraph display-inline="no-display-inline" id="HBE5F5DE795E94B8885E4BF83393BF062"><enum>(1)</enum><header>In
				general</header><text>The Research Coordinating Committee shall be composed of
				representatives of the following with experience relevant to the purposes of
				this subtitle:</text>
										<subparagraph id="H97C71417E7A344EDB1B4617356BF2797"><enum>(A)</enum><text>The Secretary of
				the Navy.</text>
										</subparagraph><subparagraph id="HB51A03240BC34A7C96714EFE06071EE6"><enum>(B)</enum><text>The Administrator
				of the National Oceanic and Atmospheric Administration.</text>
										</subparagraph><subparagraph id="H14D3FED1F4884BA1BB4D66C111FDD0EB"><enum>(C)</enum><text>The Director of
				the National Science Foundation.</text>
										</subparagraph><subparagraph id="H08280AF249474747B0413362AEB9D13B"><enum>(D)</enum><text>The Administrator
				of the National Aeronautics and Space Administration.</text>
										</subparagraph><subparagraph id="H6D67A963DF574A918F4C95697FB26BED"><enum>(E)</enum><text>The Administrator
				of the Environmental Protection Agency.</text>
										</subparagraph><subparagraph id="H2BDEDB98C1124AA582471614DDEB005C"><enum>(F)</enum><text>The Commandant of
				the Coast Guard.</text>
										</subparagraph><subparagraph id="H5FC46DB13D6646388E906C015EA36042"><enum>(G)</enum><text>The Director of
				the United States Fish and Wildlife Service.</text>
										</subparagraph><subparagraph id="H31DE78E747CF44579C67E860296DDAA9"><enum>(H)</enum><text>The Director of
				the United States Geological Survey.</text>
										</subparagraph><subparagraph id="H2E69B29744C345CE883C1EF66523F032"><enum>(I)</enum><text>The Director of
				the Minerals Management Service.</text>
										</subparagraph><subparagraph id="H076F304FD7E9425DB63B2D7731F4C56E"><enum>(J)</enum><text>The President of
				the National Academy of Sciences.</text>
										</subparagraph><subparagraph id="H6FC6EB65C3C34BAD884C140649C771F0"><enum>(K)</enum><text>The Director of
				the Office of Science and Technology Policy.</text>
										</subparagraph><subparagraph id="H3EB2CF2FAC4F4C8CAF0027DC544BAC16"><enum>(L)</enum><text>The Director of
				the Office of Management and Budget.</text>
										</subparagraph><subparagraph id="HF448140685B641E1B575FCA5819D497D"><enum>(M)</enum><text>The Executive
				Director of the Commission.</text>
										</subparagraph><subparagraph id="HF819B8E0D78F42B2A1B713678215F25B"><enum>(N)</enum><text>One member
				appointed by the Research Coordinating Committee from among individuals who
				will represent the views of ocean industries with expertise in marine mammal
				biology, marine ecology, oceanography, or marine policy.</text>
										</subparagraph><subparagraph id="H58FF4FEECE11477DB25B5EA5B19115F"><enum>(O)</enum><text>One member
				appointed by the Research Coordinating Committee from among individuals who
				will represent the views of State governments with expertise in marine mammal
				biology, marine ecology, oceanography, or marine policy.</text>
										</subparagraph><subparagraph id="H98C9EF0B54C949C0A8DFC33FE534D344"><enum>(P)</enum><text>One member
				appointed by the Research Coordinating Committee from among individuals who
				will represent the views of academia with expertise in marine mammal biology,
				marine ecology, oceanography, or marine policy.</text>
										</subparagraph><subparagraph id="H2EDE2FC8D7564FE18E50B5ADD062F636"><enum>(Q)</enum><text>One member
				appointed by the Research Coordinating Committee from among individuals who
				will represent the views of the marine conservation community with expertise in
				marine mammal biology, marine ecology, oceanography, or marine policy.</text>
										</subparagraph><subparagraph id="H2F10F6DCC8FF43D98DF0A2B200B58883"><enum>(R)</enum><text>One member
				appointed by the Research Coordinating Committee from among individuals who
				will represent such other views as the chairman of such committee considers
				appropriate.</text>
										</subparagraph></paragraph><paragraph id="HAC50B23E09464DB0AD1B4EBF6CD5BE1"><enum>(2)</enum><header>FACA</header><text>The
				Federal Advisory Committee Act (5 App. U.S.C.) shall not apply to the Research
				Coordinating Committee.</text>
									</paragraph><paragraph id="HA61A24AC7D1F437BB825B802B91900E8"><enum>(3)</enum><header>Limitation on
				service on Committee of Scientific Advisors on Marine Mammals</header><text>A
				member of the Research Coordinating Committee may not simultaneously serve as a
				member of the Committee of Scientific Advisors on Marine Mammals established
				under section 203.</text>
									</paragraph></subsection><subsection id="H9CEFE5AF75424F16A1A56577C0F277A4"><enum>(c)</enum><header>Chairman and
				vice chairman</header><text>The Executive Director of the Marine Mammal
				Commission shall be the chairman of the Research Coordinating Committee and the
				Administrator of the National Oceanic and Atmospheric Administration shall be
				the vice chairman of the Research Coordinating Committee. The chairman may
				create subcommittees chaired by the representative of any member agency of the
				Research Coordinating Committee to, among other tasks, receive advice, input,
				or comments from experts on the national marine mammal research plan developed
				under section 223.</text>
								</subsection><subsection id="H6ED608F235594F5B8FC7A72100862B00"><enum>(d)</enum><header>Term of
				office</header><text>The term of office of a member of the Research
				Coordinating Committee appointed under subparagraph (N), (O), (P), (Q), or (R)
				of subsection (b)(1) shall be 3 years, except that any member appointed to fill
				a vacancy occurring before the expiration of the term for which the member’s
				predecessor was appointed shall be appointed for the remainder of such
				term.</text>
								</subsection><subsection id="H4D5CC8783EBD4EBFB6636BF60715DC3B"><enum>(e)</enum><header>Responsibilities</header><text>The
				Research Coordinating Committee shall have the following
				responsibilities:</text>
									<paragraph id="HC9251D9B25F14E0AA5DCC4D7382C471"><enum>(1)</enum><text>Develop a national
				marine mammal research plan under section 223.</text>
									</paragraph><paragraph id="HCA23916247F94E6AB9A2A624E7DA86F7"><enum>(2)</enum><text>Facilitate
				cooperation among Federal agencies and departments with respect to marine
				mammal research.</text>
									</paragraph><paragraph id="HE7FF8A488D0643869D000529EF2C2B41"><enum>(3)</enum><text>Revise as
				necessary and approve the program announcement developed by the Program
				Office.</text>
									</paragraph><paragraph id="H8C41C5BBAD5B4F80AA22C7D7639DE822"><enum>(4)</enum><text>Estimate, to the
				extent practicable, Federal funding needed for marine mammal research
				activities to be conducted under the Plan.</text>
									</paragraph><paragraph id="H1E07CBC34C554B44BFC96B4B8600F3DC"><enum>(5)</enum><text>Review and revise,
				at a minimum every 3 years or as necessary the marine mammal research
				plan.</text>
									</paragraph></subsection><subsection id="H434A30A28B0C4E389C4DC6D09D9874A4"><enum>(f)</enum><header>Contract and
				grant authority</header>
									<paragraph id="H7895AD6F3C2543BE00A905C0E7B100D3"><enum>(1)</enum><header>In
				general</header><text>The Federal departments and agencies involved in the
				Research Coordinating Committee may participate in interagency financing and
				share, transfer, receive, obligate, and expend funds appropriated to any
				Federal participant on the Research Coordinating Committee for the purposes of
				carrying out any administrative or programmatic project or activity under this
				subtitle, including support for the Program Office and the Research Program.
				Funds may be transferred among such departments and agencies through an
				appropriate instrument that specifies the goods, services, or space being
				acquired from another Research Coordinating Committee member and the costs of
				the same.</text>
									</paragraph><paragraph id="H1F386AFAEC01417F8B9576B47442E622"><enum>(2)</enum><header>Volunteers and
				gifts, devises, and bequests</header><text>For the purposes of carrying out
				this subtitle the Commission may accept, solicit, and use the services of
				volunteers, and may accept, solicit, receive, hold, administer, and use gifts,
				devises, and bequests.</text>
									</paragraph></subsection><subsection id="H424A8AAE18FB4DBFB0C773CEC9285794"><enum>(g)</enum><header>National
				Research Council evaluation</header><text>The chairman of the Research
				Coordinating Committee shall seek to enter into an agreement with the National
				Research Council under which the National Research Council shall periodically
				evaluate the scientific content of the Plan and the implementation of the
				research conducted under the Research Program and provide information and
				advice obtained from United States and international sources and
				recommendations for priorities for future marine mammal research.</text>
								</subsection><subsection id="HA55DC10792E04865ABE9DE3B4210378C"><enum>(h)</enum><header>Public
				participation</header><text display-inline="yes-display-inline">The Executive
				Director of the Commission shall publish the Plan, and any revision thereof, in
				the Federal Register for a public comment period of not less than 60
				days.</text>
								</subsection></section><section id="HEC3ABE96DA7D468E8B3C9770F282FF07"><enum>223.</enum><header>National Marine
				Mammal Research Plan</header><text display-inline="no-display-inline">The
				Research Coordinating Committee shall develop within one year after the date of
				enactment of this subtitle a comprehensive 5-year national marine mammal
				research plan to—</text>
								<paragraph id="H42FE80C9323F447DB7522BC053A52033"><enum>(1)</enum><text>improve
				understanding of marine mammals, their health, and their role in the marine
				environment;</text>
								</paragraph><paragraph id="H61C8C4566C6942B58ED1593DD136FFDE"><enum>(2)</enum><text>characterize the
				impact of human-related activities on marine mammals, at the individual,
				population, and ecosystem levels;</text>
								</paragraph><paragraph id="H80AB9710A1C64850B9F632518F36322C"><enum>(3)</enum><text>evaluate existing
				conservation, mitigation, and monitoring measures;</text>
								</paragraph><paragraph id="HC711662989884FC8ADD2AE5D24C5D7EC"><enum>(4)</enum><text>develop more
				effective management measures for marine mammals; and</text>
								</paragraph><paragraph id="H8D5F99E091404A369F9D1DD03E568F"><enum>(5)</enum><text>identify critical
				research gaps and uncertainties, establish research priorities, and estimate
				the budgets needs for each of the priorities.</text>
								</paragraph></section><section display-inline="no-display-inline" id="H8D7015F7240A49D6BEB7BCA5C4519C19" section-type="subsequent-section"><enum>224.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
