		<section id="H469A59DA78914FA98AAC4DC247506EEE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Immigration Fraud Prevention Act of
			 2009</short-title></quote>.</text>
		</section><section id="H8690CCAC9A7C4828AF8507BC295EA52D"><enum>2.</enum><header>Schemes to
			 defraud aliens</header>
			<subsection id="H0B141807185042D6A145A3436B75B6B3"><enum>(a)</enum><header>Amendments to
			 title 18</header>
				<paragraph id="H98B60C8461C54C59820BFB52F522E38D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 47 of title
			 18, United States Code, is amended by adding at the end the following new
			 section:</text>
					<quoted-block display-inline="no-display-inline" id="H183452556F51467795C3CD44AE99FC65" style="USC">
						<section id="H93771B5FA2DD453E82773D2DD357B66D"><enum>1041.</enum><header>Schemes to
				defraud aliens</header>
							<subsection id="H558F7C9F4869427495CFD4D44E6CEC20"><enum>(a)</enum><header>In
				general</header><text>Any person who willfully and knowingly executes a scheme
				or artifice, in connection with any matter that is authorized by or arises
				under Federal immigration laws or any matter the offender willfully and
				knowingly claims or represents is authorized by or arises under Federal
				immigration laws, to—</text>
								<paragraph id="H5A5473EA98534ACF83724D9CDD2EA0D5"><enum>(1)</enum><text>defraud any
				person; or</text>
								</paragraph><paragraph id="HE32B3985D9A6444BA01AD83E18BD754D"><enum>(2)</enum><text>obtain or receive
				money or anything else of value from any person by means of false or fraudulent
				pretenses, representations, promises,</text>
								</paragraph><continuation-text continuation-text-level="subsection">shall be
				fined under this title, imprisoned not more than 5 years, or both.</continuation-text></subsection><subsection id="HCBB058802E37400A8C738A1AA6E7F17D"><enum>(b)</enum><header>Misrepresentation</header><text>Any
				person who willfully, knowingly, and falsely represents that such person is an
				attorney or an accredited representative (as that term is defined in section
				1292.1 of title 8, Code of Federal Regulations or any successor regulation to
				such section) in any matter arising under Federal immigration laws shall be
				fined under this title, imprisoned not more than 5 years, or
				both.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCAE2AA657F9D4455BD7F1615A9647135"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 47 of title 18, United States Code, is amended by adding
			 after the item related to section 1040 the following:</text>

						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7FE3D44ABD244AC39DEA569B7FA08695"><enum>(b)</enum><header>Investigation of
			 schemes To defraud aliens</header><text>The Attorney General and the Secretary
			 of Homeland Security shall use the Executive Office of Immigration Review to
			 detect and investigate individuals who are in violation of section 1041 of
			 title 18, United States Code, as added by subsection (a)(1).</text>
			</subsection></section><section id="HCFC98FC1C2084CEDB4C0155C90BEEAF2"><enum>3.</enum><header>Notice and
			 outreach</header>
			<subsection id="H5935DB79370F4C489EFDE3D324D8CB25"><enum>(a)</enum><header>Notice to aliens
			 in immigration proceedings</header>
				<paragraph id="H4B1AD9F85B714074A29C79AAD89F959A"><enum>(1)</enum><header>In
			 general</header><text>Subparagraph (E) of section 239(a)(1) of the Immigration
			 and Nationality Act (8 U.S.C. 1229(a)(1)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HA6425B5062A84159B0BF00BC11B80846" style="OLC">
						<subparagraph id="H0F87AB332C344CE3A0C6DB57429D6037"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H93128502C9D94DA3B60CB60705C4372E"><enum>(i)</enum><text>The alien may be
				represented by counsel and the alien will be provided—</text>
								<subclause id="HA7A8D450A70E4520BF2B2CFF0E63B6BF" indent="up1"><enum>(I)</enum><text>a period of time to secure counsel under
				subsection (b)(1); and</text>
								</subclause><subclause id="H22A010E17ED841FCB8F7AE92B61E7E18" indent="up1"><enum>(II)</enum><text>a current list of counsel prepared under
				subsection (b)(2).</text>
								</subclause></clause><clause id="H12E187D0927146EA8C4AAA1CA1123D05" indent="up1"><enum>(ii)</enum><text>A description of who may represent
				the alien in the proceedings, including a notice that immigration consultants,
				visa consultants, and other unauthorized individuals may not provide that
				representation.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6D1AFF83626B4358B9E3698FC2651930"><enum>(2)</enum><header>List of
			 disciplined practitioners</header><text>Subsection (b) of section 239 of the
			 Immigration and Nationality Act (8 U.S.C. 1229) is amended—</text>
					<subparagraph id="HB9D6493A097046099321908A137BED9A"><enum>(A)</enum><text>by redesignating
			 paragraph (3) as paragraph (6); and</text>
					</subparagraph><subparagraph id="HF7DB6297F0B8422FBB5D75B397C05F01"><enum>(B)</enum><text>by inserting after
			 paragraph (2) the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H5A468578997A4BD78A85B47A9D9248E6" style="OLC">
							<paragraph id="H2FFB8CB9B8594A9CB8C8D706E6E3FAAE"><enum>(3)</enum><header>List of
				disciplined practitioners</header><text>The Attorney General shall provide for
				lists (updated no less often than quarterly) of persons who are prohibited for
				providing representation in immigration proceedings.</text>
							</paragraph><paragraph id="H8703F56734144F3081B7427C69C8B1F0"><enum>(4)</enum><header>Foreign language
				materials</header><text>The materials required to be provided to an alien under
				this subsection shall be provided in appropriate languages, including English
				and Spanish.</text>
							</paragraph><paragraph id="HE999CA7B3E744C87AB009D1A0F185553"><enum>(5)</enum><header>Oral
				notification</header><text>At the earliest possible opportunity, an immigration
				judge shall orally advise an alien in a removal proceeding of the information
				described in paragraphs (2) and
				(3).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H800D7728199F4764AD79BA0CA407F688"><enum>(b)</enum><header>Outreach to
			 immigrant communities</header>
				<paragraph id="HE4F42927975C4524A6D9A96A761BA3CE"><enum>(1)</enum><header>Authority To
			 conduct</header><text>The Attorney General, through the Director of the
			 Executive Office for Immigration Review, and the Secretary of Homeland Security
			 shall carry out a program to educate aliens regarding who may provide legal
			 services and representation to aliens in immigration proceedings through
			 cost-effective outreach to immigrant communities.</text>
				</paragraph><paragraph id="H214FC26E033A4ECC998BA4A45E6A89D1"><enum>(2)</enum><header>Purpose</header><text>The
			 purpose of the program authorized under paragraph (1) is to prevent aliens from
			 being subjected to fraud by immigration consultants, visa consultants, and
			 other individuals who are not authorized to provide legal services or
			 representation to aliens.</text>
				</paragraph><paragraph id="HE4A6ED8E0A8A44B798DC6E029C6AB629"><enum>(3)</enum><header>Availability</header><text>The
			 Attorney General and the Secretary of Homeland Security shall make information
			 regarding fraud by immigration consultants, visa consultants, and other
			 individuals who are not authorized to provide legal services or representation
			 to aliens available—</text>
					<subparagraph id="HE52C67B78704436DB76191F33A3B059D"><enum>(A)</enum><text>at appropriate
			 offices that provide services or information to aliens; and</text>
					</subparagraph><subparagraph id="H20CF005BF1C34E5C9D656C697F82DB84"><enum>(B)</enum><text>through Internet
			 websites that are—</text>
						<clause id="HBBDE862881BE4BC9B04C5F6FE503558D"><enum>(i)</enum><text>maintained by the
			 Attorney General or the Secretary; and</text>
						</clause><clause id="H760EADB4335944CAAFA29D7CF8D58384"><enum>(ii)</enum><text>intended to
			 provide information regarding immigration matters to aliens.</text>
						</clause></subparagraph></paragraph><paragraph id="H27299154FD2042D88C10395CC380E2D4"><enum>(4)</enum><header>Foreign language
			 materials</header><text>Any educational materials used to carry out the program
			 authorized under paragraph (1) shall be made available to immigrant communities
			 in appropriate languages, including English and Spanish.</text>
				</paragraph></subsection></section></legis-body>
