		<section id="H0757F7BFE84844E48FC00067B7DEDC63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oleoresin Capsicum Spray Pilot Program
			 Act of 2009</short-title></quote>.</text>
		</section><section id="HA7CC34A995744D188D614B805049D4D3"><enum>2.</enum><header>Oleoresin
			 Capsicum Spray Pilot Program</header>
			<subsection id="H4DA48E0237E0452785131288354E39CD"><enum>(a)</enum><header>Pilot program
			 authorized</header><text>The Director of the Federal Bureau of Prisons shall
			 conduct a pilot program to determine the effectiveness of the routine issuance
			 of Oleoresin Capsicum spray to staff.</text>
			</subsection><subsection id="HAB95618EEB0E4D51A07EE7E9D24947D2"><enum>(b)</enum><header>Scope of pilot
			 program</header><text>The Director of the Federal Bureau of Prisons shall have
			 the discretion to—</text>
				<paragraph id="H6EFD66991DF442609CD6FF91449C1782"><enum>(1)</enum><text>select the
			 specific Bureau of Prisons institution or institutions participating in the
			 pilot program;</text>
				</paragraph><paragraph id="HEC143A69E24548FDB9E8A2A2CAAE00C"><enum>(2)</enum><text>determine the
			 length (but not to exceed 2 years) of the pilot program;</text>
				</paragraph><paragraph id="H8DB449E1183D43E89FD9286FF715C849"><enum>(3)</enum><text>select the type of
			 Oleoresin Capsicum spray device utilized in the pilot program; and</text>
				</paragraph><paragraph id="HA7DAD8F6037D4914B4A8F15D7D003565"><enum>(4)</enum><text>determine which
			 Bureau of Prisons staff will be authorized to participate in the pilot
			 program.</text>
				</paragraph></subsection><subsection id="H6EF4843D06A34BB195E75D99183B5B96"><enum>(c)</enum><header>Requirements
			 subject to availability of appropriations</header><text>The requirements of
			 this section are subject to the availability of appropriations.</text>
			</subsection><subsection id="H9E70358A2C7346D0885CC3B94486E513"><enum>(d)</enum><header>GAO
			 report</header><text display-inline="yes-display-inline">The Government
			 Accountability Office shall, not later than six months after the end of the
			 pilot program, report to Congress an evaluation of the effects of the pilot
			 program and provide any research and analysis that Office determines
			 appropriate on tools to improve officer safety in Federal prisons.</text>
