		<section id="H51C3AFDFF79C4558A1D41E358D2C29EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Post Office Modernization Act of
			 2009</short-title></quote>.</text>
		</section><section id="H9A6229131D7F4A288D6100975FBEB8D0"><enum>2.</enum><header>Water and
			 sanitation requirements</header>
			<subsection id="H1FA784C7588A4791B06302A4FAF40011"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 4 of title
			 39, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H3B2B2B18F18741C9BF4B66081B368428" style="USC">
					<section id="HDDB4E6F32A114B04B7AF7651E5535E87"><enum>417.</enum><header>Water and
				sanitation requirements</header><text display-inline="no-display-inline">The
				Postal Service shall ensure that every post office has access to running water
				and to bathroom facilities connected to either a sewer system or a septic
				tank.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBE0F68FBCA4246B3B53900370041D0F1"><enum>(b)</enum><header>Non-conforming
			 post offices</header><text display-inline="yes-display-inline">Not later than
			 30 days after the date of the enactment of this Act, the United States Postal
			 Service shall begin upgrades to ensure compliance with the requirements of
			 section 417 of title 39, United States Code (as added by subsection
			 (a)).</text>
			</subsection><subsection id="H4B661954DF8A49DAAF47D26319569133"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 4 of title 39, United
			 States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="H257481EEE8EB40F4A43888D03E3B70DB"><enum>3.</enum><header>Lack of
			 facilities not to be considered</header><text display-inline="no-display-inline">Section 404(d)(2)(B) of title 39, United
			 States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H162E244B17F340468E1545E4C18C2D73" style="OLC">
				<subparagraph id="HA843D04A7CB642BFB5B990E5C497FDA8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">may not consider—</text>
					<clause id="HC7D84B0019614288BC9DD24CF1F633E5"><enum>(i)</enum><text>compliance with any provision of
				the Occupational Safety and Health Act of 1970 (29 U.S.C. 651 et seq.);
				or</text>
					</clause><clause id="HB649D33925974E45A53E6DBDFC06D2CD"><enum>(ii)</enum><text>whether the requirements of
				section 417 are met in connection with the post
				office.</text>
