		<section id="HD95DC1471BCF49889A8C25F6D8B855DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Business Reorganization and Job Preservation Act of
			 2009</short-title></quote>.</text>
		</section><section id="H3DE901C92E29435E8C5AC050D1366166"><enum>2.</enum><header>Amendments to
			 title 11 of the United States Code</header><text display-inline="no-display-inline">Title 11 of the United States Code is
			 amended—</text>
			<paragraph id="H41EAD134CB34430794BE4AAE5A225990"><enum>(1)</enum><text>by amending
			 section 365(d)(4) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H6AF6A893910F42EA870975EAD72C0C00" style="OLC">
					<paragraph id="H2BF3F0E591D140CE9A7498441E785D4C" indent="up1"><enum>(4)</enum><text>Notwithstanding paragraphs (1) and
				(2), in a case under any chapter of this title, if the trustee does not assume
				or reject an unexpired lease of nonresidential real property under which the
				debtor is the lessee within 60 days after the date of the order for relief, or
				within such additional time as the court, for cause, within such 60-day period,
				fixes, then such lease is deemed rejected, and the trustee shall immediately
				surrender such nonresidential real property to the
				lessor.</text>
					</paragraph><after-quoted-block>,</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HD81BABF74BC5470F94357E7241674B60"><enum>(2)</enum><text>in section
			 366—</text>
				<subparagraph id="H4E814D7A58AF45069AFF7C622A6C5217"><enum>(A)</enum><text>in subsection (a)
			 by striking <quote>subsections (b) and (c)</quote> and inserting
			 <quote>subsection (b)</quote>, and</text>
				</subparagraph><subparagraph id="H6C2C7CEDB0B54EAC8C37344C95E46BC3"><enum>(B)</enum><text>by striking
			 subsection (c),</text>
				</subparagraph></paragraph><paragraph id="H4215B07F7B2649EB9FB34A700E57FAE2"><enum>(3)</enum><text>in section
			 503(b)—</text>
				<subparagraph id="H23EC74CD7F564EE4BB0205E80132D0B1"><enum>(A)</enum><text>in paragraph (7)
			 by adding <quote>and</quote> at the end,</text>
				</subparagraph><subparagraph id="HF109C4F3B3E8441AA925389551909569"><enum>(B)</enum><text>in paragraph (8)
			 by striking <quote>; and</quote> and inserting a period, and</text>
				</subparagraph><subparagraph id="H95F867B967F34A13BA33B638C708935C"><enum>(C)</enum><text>by striking
			 paragraph (9).</text>
				</subparagraph></paragraph><paragraph id="HC90D06BBA005450F894AF560A518A918"><enum>(4)</enum><text>by amending
			 section 546(c) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HB46154C9989B4763AD2EAD9871E407A2" style="OLC">
					<subsection id="H8E04B6E7537C48459E8965005C859F85"><enum>(c)</enum><text>Except as provided
				in subsection (d) of this section, the rights and powers of a trustee under
				sections 544(a), 545, 547, and 549 of this title are subject to any statutory
				or common-law right of a seller of goods that has sold goods to the debtor, in
				the ordinary course of such seller’s business, to reclaim such goods if the
				debtor has received such goods while insolvent, but—</text>
						<paragraph id="H153672779ED44A68962FE844951E3721"><enum>(1)</enum><text>such a seller may
				not reclaim any such goods unless such seller demands in writing reclamation of
				such goods—</text>
							<subparagraph id="H63DD37CA0D62415AB74102BA63AD655F"><enum>(A)</enum><text>before 10 days
				after receipt of such goods by the debtor; or</text>
							</subparagraph><subparagraph id="HC243885F281541DF9ADFC0498A89AA0A"><enum>(B)</enum><text>if such 10-day
				period expires after the commencement of the case, before 20 days after receipt
				of such goods by the debtor; and</text>
							</subparagraph></paragraph><paragraph id="H043D9A336ACB44E9959CC11042FC7E92"><enum>(2)</enum><text>the court may deny
				reclamation to a seller with such a right of reclamation that has made such a
				demand only if the court—</text>
							<subparagraph id="HC77792CA8C1A45B7A1AB4E3EE73AC499"><enum>(A)</enum><text>grants the claim
				of such a seller priority as a claim of a kind specified in section 503(b) of
				this title; or</text>
							</subparagraph><subparagraph id="H4DE29FA163CA4D7DB47EB9727256B43A"><enum>(B)</enum><text>secures such claim
				by a
				lien.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H03E0EE66265F4E69A34161F7E2AB9E70"><enum>3.</enum><header>Effective date;
			 application of amendments</header>
			<subsection id="H3DB43213931244C1B3ABA1D455DFDC1B"><enum>(a)</enum><header>Effective
			 date</header><text>Except as provided in subsection (b), this Act and the
			 amendments made by this Act shall take effect on the date of the enactment of
			 this Act.</text>
			</subsection><subsection id="H9DAFD3A91E854F659EEF853C026E62A9"><enum>(b)</enum><header>Application of
			 amendments</header><text>The amendments made by this Act shall apply only with
			 respect to cases commenced under title 11 of the United States Code on or after
			 the date of the enactment of this Act.</text>
