		<section display-inline="no-display-inline" id="H3A2F15656B48447E905880E1C2B0A4C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Paramedic Intercept Services
			 Coverage Act of 2009</short-title></quote>.</text>
		</section><section id="HB0350F19B5374BD091307F6BA9D05931"><enum>2.</enum><header>Expanded coverage
			 of paramedic intercept services under the medicare program</header>
			<subsection id="H80D74C0AF0544B6CAC8744B310BE26A6"><enum>(a)</enum><header>In
			 general</header><text>Section 4531(c) of the <act-name parsable-cite="BBA97">Balanced Budget Act of 1997</act-name> (111 Stat. 452; 42
			 U.S.C. 1395x note) is amended to read as follows:</text>

					<subsection id="HA6ED1852563849A298A8F68BC13F39B"><enum>(c)</enum><header>Payment for
				paramedic intercept service providers</header>
						<paragraph id="HB5E77A1651684F4290F8E1AB799DB817"><enum>(1)</enum><header>In
				general</header><text>In promulgating regulations to carry out section
				1861(s)(7) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
				(42 U.S.C. 1395x(s)(7)) with respect to the coverage of ambulance services, the
				Secretary of Health and Human Services shall include coverage of advanced life
				support intercept services (in this subsection referred to as <quote>ALS
				intercept services</quote>).</text>
						</paragraph><paragraph id="H9406009F16FF4ECE9E4604D91C008CBD"><enum>(2)</enum><header>Conditions of
				coverage</header><text>For the purposes of this subsection, ALS intercept
				services consist of a qualified paramedic providing ALS level services in
				connection with the transport of a patient by an ambulance qualified to provide
				only a basic life support level of services if the following conditions are
				met:</text>
							<subparagraph id="H245A1F4BBFB742ADB55E3711BD688773"><enum>(A)</enum><text>The entity
				providing the ambulance transportation is a public, non-profit, or volunteer
				organization which—</text>
								<clause id="HF9FE9EC3D984402BAAB8B8D3DA55E606"><enum>(i)</enum><text>is
				certified as qualified to provide ambulance services under title XVIII of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>; and</text>
								</clause><clause id="H10AA44C906AB411B931DB2FD5E5C2D97"><enum>(ii)</enum><text>provides only
				basic life support services at the time of the intercept.</text>
								</clause></subparagraph><subparagraph id="HE69F5854A7E34A54A623E4603597CAD8"><enum>(B)</enum><text>The paramedic
				providing such services is not employed or compensated by the entity providing
				the ambulance transportation and the entity employing or compensating such
				paramedic is not related to the entity providing the ambulance
				transportation.</text>
							</subparagraph><subparagraph id="H8B2300B0534F4CEDA53DA777C658D132"><enum>(C)</enum><text>The ALS intercept
				services are requested by the entity providing the ambulance transportation or
				are dispatched to coordinate with such entity and such services are medically
				necessary based on the medical condition for which they are dispatched.</text>
							</subparagraph><subparagraph id="HC4F889E3EF164749A8B54EA93B632F56"><enum>(D)</enum><text>The entity that is
				employing or compensating that paramedic—</text>
								<clause id="H4649F8E5DD834734B253FCADA7DA1CF4"><enum>(i)</enum><text>is
				certified as qualified to provide such services under such title; and</text>
								</clause><clause id="H84D526DFCCCD4C2991FE8C7F2C3C88FF"><enum>(ii)</enum><text>bills all
				individuals (or their insurers) who receive ALS intercept services from the
				entity, regardless of whether such individuals are beneficiaries under such
				title.</text>
								</clause></subparagraph><subparagraph id="H9A515BB5EF494C25A345B1CEDF479E28"><enum>(E)</enum><text>The paramedic
				providing the intercept services accompanies and provides an ALS assessment or
				ALS intervention to the patient during the
				transport.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H01615B2307D94A8EA394F6B1D8D7B23"><enum>(b)</enum><header>Payments not
			 counted in computing ambulance fee schedule amounts</header><text>The Secretary
			 of Health and Human Services shall not take into account any payments made
			 pursuant to the amendment made by subsection (a) in determining payment amounts
			 under the ambulance fee schedule under section 1834(l) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395m(l)), or the aggregate amount of payments under such section, for any
			 year.</text>
			</subsection><subsection id="H4E0652A231704C44931FA27885352E66"><enum>(c)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply with
			 respect to ambulance services provided on or after January 1, 2010.</text>
