		<section id="HEE89DD23368148E7B246C93A7BE40024" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improving Communication with Consumers
			 During Food Recall Act of 2009</short-title></quote>.</text>
		</section><section id="HA327EC850486466287C639BE316A6A02"><enum>2.</enum><header>Using consumer
			 information maintained by retailers to improve recalls of food</header>
			<subsection id="HD23FD9751ECD4176A85446439D91C4DE"><enum>(a)</enum><header>Prohibited
			 act</header><text display-inline="yes-display-inline">Section 301 of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 331) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H526DAF2541E64B4B8011346C0651AFF5" style="OLC">
					<subsection id="HD1FAE4746CCB44A28824420A2558010D"><enum>(oo)</enum><text display-inline="yes-display-inline">The failure to comply with an order issued
				under section 418 (regarding recalls of
				food).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB802C91E9F2144BDB3FE4DB5FAC3E3F0"><enum>(b)</enum><header>Recall
			 notices</header><text display-inline="yes-display-inline">Chapter IV of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 341 et seq.) is amended by
			 adding at the end the following:</text>

					<section id="HE6DEE3B74088418C8C2FD80F507794A6"><enum>418.</enum><header>Using consumer
				information maintained by retailers to improve recalls of food</header>
						<subsection id="H5C5D23F1B6854530B3B6883FA9BE3E6E"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section applies in the case of any
				recall, whether voluntary or mandatory, of food that is adulterated or
				misbranded in a manner that, if consumed, may result in illness or
				injury.</text>
						</subsection><subsection id="HF7BD232B1F85401D81CD01D8AB3102FA"><enum>(b)</enum><header>Recall
				notice</header>
							<paragraph id="H1CDA7D13315145AA8C68C161B33D6B39"><enum>(1)</enum><header>Retailer
				requirements</header><text display-inline="yes-display-inline">To facilitate a
				recall described in subsection (a), the Secretary may by order require any
				retailer of the food—</text>
								<subparagraph id="H80FA3238D8E042A3986A7454243059C1"><enum>(A)</enum><text>to inform the
				Secretary regarding whether the retailer has a system in place capable of
				identifying the persons who purchased the food; and</text>
								</subparagraph><subparagraph id="HE368F3B6CBE44719B7486E4C3AC0B2EF"><enum>(B)</enum><text>to issue a recall
				notice to those persons if the retailer does have such a system in
				place.</text>
								</subparagraph></paragraph><paragraph id="HC10733F29A414AD29B58A63BB44554D6"><enum>(2)</enum><header>Issuance of
				notice</header><text>A recall notice issued under paragraph (1) shall—</text>
								<subparagraph id="H292F6C3C80064407A9DC8E68A46360D0"><enum>(A)</enum><text>be made in such
				manner (which may include the use of telephone calls or electronic mail) and
				contain such information as the Secretary may require; and</text>
								</subparagraph><subparagraph id="HC787872940974E4BBF96D0E4CEF6996B"><enum>(B)</enum><text>be issued
				by—</text>
									<clause id="H3DF883463EB24770A58673D9A59A5593"><enum>(i)</enum><text>the retailer;
				or</text>
									</clause><clause id="H899E7F64454747B0B78A37BFB6F63DD5"><enum>(ii)</enum><text>a
				third party selected by the retailer.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H9CD9A0A71CF74FE2A6CD174B941FD5C1"><enum>(c)</enum><header>Reimbursement</header><text>If
				the Secretary requires a retailer to issue a recall notice for food under
				subsection (b), the Secretary shall—</text>
							<paragraph id="HD5AB793DDFC34DF5A3219942545359AB"><enum>(1)</enum><text>identify the
				manufacturers, importers, distributors, or other persons that most likely
				caused the adulteration or misbranding of the food; and</text>
							</paragraph><paragraph id="H947C6EFA3EAA4685B7FB01B81D2F47D4"><enum>(2)</enum><text>by order require
				such persons to reimburse the retailer for any costs incurred to comply with an
				order issued under subsection (b).</text>
							</paragraph></subsection><subsection id="H5125730E9D6F4AB1B70424E1880AC381"><enum>(d)</enum><header>Rule of
				construction</header><text>This section shall not be construed to authorize the
				Secretary to require any retailer—</text>
							<paragraph id="H9A4148022373498285350B3461DFD092"><enum>(1)</enum><text>to establish or
				maintain a system described in subsection (b)(1)(A); or</text>
							</paragraph><paragraph id="HB4F0753F679C4BE7935CC21BCA646740"><enum>(2)</enum><text>to provide any
				information on the retailer’s customers, inventory, or sales to the
				manufacturer, importer, or distributor of the recalled food or to any person
				required under subsection (c) to pay
				reimbursement.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
