		  individual taxpayers to designate a portion of income taxes to fund the
		  improvement of barriers at the United States border, and for other

		<section id="H95EF80CB545943AC9FAA04633F3F311" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Border Fence Trust Fund Act of
			 2009</short-title></quote>.</text>
		</section><section id="HAF4135F3C62F464C9FBDC07172DAF2C4"><enum>2.</enum><header>Designation of
			 income tax payments to Border Improvement Trust Fund</header>
			<subsection id="HE0219A7B48CB45858DC533E12C883F3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 chapter 61 of the Internal Revenue Code of 1986 (relating to returns and
			 records) is amended by adding at the end the following new part:</text>

					<part id="H78055FEE47DD4B788EF0A19EB75F2CE8"><enum>IX</enum><header>Designation of
				income tax payments to Border Improvement Trust Fund</header>

							<toc-entry level="section">Sec. 6097. Designation to Border
				  Improvement Trust Fund.</toc-entry>
						</toc>
						<section id="H0009D07EF4EE46B7B36EE12E3BBA003F"><enum>6097.</enum><header>Designation to
				Border Improvement Trust Fund</header>
							<subsection id="H6907311D9D064C24A0E74DAC4B64FB10"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Every individual
				(other than a nonresident alien) whose adjusted income tax liability for the
				taxable year is $5 or more may designate that $5 shall be paid over to the
				Border Improvement Trust Fund in accordance with the provisions of section
				9511. In the case of a joint return of husband and wife having an income tax
				liability of $10 or more, each spouse may designate that $10 shall be paid to
				the fund.</text>
							</subsection><subsection id="H8C3B44A1D7CA4BC584BCD241973FEE35"><enum>(b)</enum><header>Adjusted income
				tax liability</header><text>For purposes of subsection (a), the adjusted income
				tax liability of an individual for any taxable year is the amount equal to the
				excess (if any) of—</text>
								<paragraph id="HD1688A87D5F84D05889B00EEAFD8DAFF"><enum>(1)</enum><text>the income tax
				liability (as defined in section 6096(b)) of the individual for the taxable
				year, over</text>
								</paragraph><paragraph id="HBDAC16FA140B4AC3A9C7F210CEACD194"><enum>(2)</enum><text>any amount
				designated by the individual (and, in the case of a joint return, any amount
				designated by the individual’s spouse) under section 6096(a) for such taxable
				year.</text>
								</paragraph></subsection><subsection id="HD1111DD8A94F46AFAE053BB4A591D0F1"><enum>(c)</enum><header>Manner and time
				of designation</header><text>Rules similar to the rules of section 6096(c)
				shall apply for purposes of this
				section.</text>
							</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H91CABBBFD13F40E7B8992C9F8318A200"><enum>(b)</enum><header>Establishment of
			 Border Improvement Trust Fund</header><text>Subchapter A of chapter 98 of such
			 Code (relating to establishment of trust funds) is amended by adding at the end
			 the following new section:</text>

					<section id="HCDCE2D7E931F481D9C41AF5D34B92841"><enum>9511.</enum><header>Border
				Improvement Trust Fund</header>
						<subsection id="H169B79D47F3443FEB528E361EBF57D8"><enum>(a)</enum><header>Establishment of
				Border Improvement Trust Fund</header><text display-inline="yes-display-inline">There is hereby established in the Treasury
				of the United States a trust fund to be known as the <term>Border Improvement
				Trust Fund</term>, consisting of such amounts as may be appropriated or
				credited to such Trust Fund as provided in this section or section
				9602(b).</text>
						</subsection><subsection id="H69BF3F0B39CA4BB5B5F46538FA83DCCB"><enum>(b)</enum><header>Transfers to
				Trust Fund</header><text display-inline="yes-display-inline">There are hereby
				appropriated to the Border Improvement Trust Fund amounts equivalent to the
				amounts designated under section 6097 (relating to designation to Border
				Improvement Trust Fund).</text>
						</subsection><subsection id="HDE77082725114688AB655DC63F26F935"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the Border Improvement Trust
				Fund shall be available, as provided by appropriations acts, for making
				expenditures to carry out section 102 of the Illegal Immigration Reform and
				Immigrant Responsibility Act of 1996, as in effect on the date of the enactment
				of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD9BA3928FD4D47B399267BC41C817CA1"><enum>(c)</enum><header>Clerical
			 amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="H6A23E402C4394971B74E24953452EDF3"><enum>(1)</enum><text>The table of parts for
			 subchapter A of chapter 61 of such Code is amended by adding at the end the
			 following new item:</text>

			 A of chapter 98 of such Code is amended by adding at the end the following new

			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2009.</text>
