		<official-title display="yes">To amend title 38, United States Code, to
		  provide for employment and reemployment rights for certain individuals ordered
		  to full-time National Guard duty.</official-title>

		<section display-inline="no-display-inline" id="H0F0DC7BC089D449587841B015ACD9BD6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Guard Employment Protection
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H28E86EDC0031450C84D4F3341A380C82"><enum>2.</enum><header>Reemployment
			 rights following certain National Guard duty</header>
			<subsection id="HCF67C98E81C2405183372E6FC2390BB0"><enum>(a)</enum><header>Reemployment
			 rights</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/4312">Section 4312(c)(4)</external-xref>
			 of title 38, United States Code, is amended—</text>
				<paragraph id="HAF41700BB011446F9C38FD24AF502D02"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (D);</text>
				</paragraph><paragraph id="HF098B68A278545E6875793AC631CCF8A"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (E) and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="HD6E18B43494E4327AD8814B87258E1E8"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block id="H976251B732894653AB8FB56BFF7480B5" style="OLC">
						<subparagraph id="H69C2D64EC3E64F5F854CA11FCE39255D"><enum>(F)</enum><text>ordered to
				full-time National Guard duty under the provisions of
				<external-xref legal-doc="usc" parsable-cite="usc/32/502">section
				502(f)</external-xref> of title 32 when the period of duty is expressly
				designated in writing by the Secretary of Defense as covered by this
				subparagraph.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H95FE2A496FBD466786E9BC55A793B2BF"><enum>(b)</enum><header>Effective
			 date</header><text>Subparagraph (F) of
			 <external-xref legal-doc="usc" parsable-cite="usc/38/4312">section
			 4312(c)(4)</external-xref> of title 38, United States Code, as added by
			 subsection (a), shall apply with respect to an individual ordered to full-time
			 National Guard duty under
			 <external-xref legal-doc="usc" parsable-cite="usc/32/502">section
			 502(f)</external-xref> of title 32, United States Code, on or after September
			 11, 2001, and shall entitle such individual to rights and benefits under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38 of
			 such Code on or after that date.</text>
