<official-title>To provide certain counties with the ability to receive television broadcast signals of their choice.</official-title>

<section id="H3433D1F028904583830B110CAB403E09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Four Corners Television Access Act of 2009</short-title></quote>.</text></section> 
<section id="H085479193D904547908509C254BC37B0"><enum>2.</enum><header>Satellite carriage of certain television broadcast signals</header><text display-inline="no-display-inline">Section 119(a)(2)(C)(iv) of title 17, United States Code, is amended—</text> 
<paragraph id="HFB677A57BC54495591769F67E9509C44"><enum>(1)</enum><text>by redesignating subclauses (I) and (II) as items (aa) and (bb) and inserting <quote>(I)</quote> before <quote>(aa)</quote>; and</text></paragraph> 
<paragraph id="H847272C635CF41D5ACDC1FB74CF42949"><enum>(2)</enum><text>in item (bb), as so redesignated by paragraph (1), after <quote>Nielsen Media Research</quote> insert the following: “; or</text>

<subclause id="HF16647560B534274A5E9A705D058CCE3"><enum>(II)</enum> 
<item commented="no" display-inline="yes-display-inline" id="H14EF272D14544C73B6B6D862B5DCBE0F"><enum>(aa)</enum><text>the 2 counties are located in the 46th largest designated market area for the year 2005 according to Nielsen Media Research; and</text></item> 
<item id="H96819CB5BE9C452AB29AE3893C5354C6" indent="up1"><enum>(bb)</enum><text>the total number of television households in the 2 counties combined did not exceed 30,000 for the year 2005 according to Nielsen Media Research</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD8233C87A720414EBDA6EED30248202E"><enum>3.</enum><header>Cable carriage of certain television broadcast signal</header><text display-inline="no-display-inline">Section 341 of Communications Act of 1934 (47 U.S.C. 341) is amended by adding at the end the following:</text>

<subsection id="HB33CE7493C11487F9757C4E8B6C2E76C"><enum>(c)</enum><header>Rule of construction</header> 
<paragraph id="HE48F181208FB4A2DA709F8F34A0C03C2"><enum>(1)</enum><header>Significantly viewed</header><text>Each television broadcast station broadcasting in the designated market area of a State capital is deemed significantly viewed within the meaning of section 76.54 of title 47, Code of Federal Regulations, for purposes of the carriage and retransmission of the signals of such broadcast station by a cable system, translator, or other multichannel video programming distributor.</text></paragraph> 
<paragraph id="HFF84E5CAFCB348E5ACA1191FCE35CF7D"><enum>(2)</enum><header>Retransmission permitted</header><text>Notwithstanding the provisions of section 325(b), a cable system, translator, or other multichannel video programming distributor may retransmit the signal of any television broadcast station described in paragraph (1) within a covered county.</text></paragraph> 
<paragraph id="H94A61BA65703425CB63CAE550E7B688D"><enum>(3)</enum><header>Definition of covered county</header><text>For purposes of this subsection, a county is a covered county if—</text> 
<subparagraph id="H0560D5A3540F4802A90EC46CDB38C711"><enum>(A)</enum><text>it is 1 of 2 counties located in the 46th largest designated market area for the year 2005 according to Nielsen Media Research; and</text></subparagraph> 
<subparagraph id="H90CDCADF8F0B4DCA82FBC6DF7AC517FF"><enum>(B)</enum><text>the total number of television households in the 2 counties combined did not exceed 30,000 for the year 2005 according to Nielsen Media Research.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
