		<section display-inline="no-display-inline" id="H7D51F44A2FF94C76A919651C4678DE59" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Quit Smoking for Life Act of
			 2009</short-title></quote>.</text>
		</section><section id="HECA55777885B458398D7B1FCD0AECCA6"><enum>2.</enum><header>Coverage of
			 counseling for cessation of tobacco use under the Medicare program</header>
			<subsection id="H4072457B504E4282A9B6794476DAD4B3"><enum>(a)</enum><header>Coverage</header><text>Section
			 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (42 U.S.C. 1395x(s)(2)) is amended—</text>
				<paragraph id="H48B8AD2C35B5400D8B8B485C8943A4C2"><enum>(1)</enum><text>in subparagraph
			 (DD), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HB7ADC587099F4F0FA9C21C12A802EB01"><enum>(2)</enum><text>in subparagraph
			 (EE), by adding <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="H86868A1C02454F20977E12BEF7845E1E"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block id="H35CF63CFC9F341E2AE737709E9C600D1" style="OLC">
						<subparagraph id="HF7FCF699B21641338413BE00E8075430" indent="up1"><enum>(FF)</enum><text>counseling for cessation of tobacco
				use (as defined in section
				1861(hhh));</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFD920EB9440743C69F4C13E6D3F61F3"><enum>(b)</enum><header>Services
			 described</header><text>Section 1861 of such Act (42 U.S.C. 1395x) is further
			 amended by adding at the end the following new subsection:</text>
				<quoted-block id="HDB1153C8E20444B5AC1BB27DA53715BB" style="traditional">
					<subsection id="H4F616C2155654FDA8D6BABA914BF92E5"><enum>(hhh)</enum><header>Counseling for
				cessation of tobacco use</header><paragraph commented="no" display-inline="yes-display-inline" id="H0705363D8FAC4E67A4466FA8CC89656"><enum>(1)</enum><text>Subject to paragraph (2),
				the term <term>counseling for cessation of tobacco use</term> means diagnostic,
				therapy, and counseling services for cessation of tobacco use, for individuals
				who use tobacco products or are being treated for tobacco use,
				furnished—</text>
							<subparagraph id="HED0C7E8CE1B44F4FB76F8054B01ED385" indent="up1"><enum>(A)</enum><text>by or under the supervision of a
				physician; or</text>
							</subparagraph><subparagraph id="HFBF898F4139F4AE7AF1EF9B61B67E84C" indent="up1"><enum>(B)</enum><text>by any other health care professional
				who—</text>
								<clause id="HDB0876F09D8140F5A7AD5B14E5C42F24"><enum>(i)</enum><text>is legally authorized to furnish
				such services under State law (or the State regulatory mechanism provided by
				State law) of the State in which the services are furnished; and</text>
								</clause><clause id="H99956B0EDB72440C82C909B006007DBB"><enum>(ii)</enum><text>is authorized to receive payment
				for other services under this title or is designated by the Secretary for this
				purpose.</text>
								</clause></subparagraph></paragraph><paragraph id="H941F717EBA324994009377E85DE02B54" indent="up1"><enum>(2)</enum><text>Such term is limited to—</text>
							<subparagraph id="HF7E2F9A7E07C4AB3817B12DC80627817"><enum>(A)</enum><text display-inline="yes-display-inline">services that are included in the most
				current clinical practice guidelines on treating tobacco use and dependence
				issued by the Public Health Service; and</text>
							</subparagraph><subparagraph id="H04128F87E53549AF882E87F700685766"><enum>(B)</enum><text>such other services that the Secretary
				recognizes to be
				effective.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA2EDA6E00A524FF9B737004803C2CCC3"><enum>(c)</enum><header>Payment;
			 elimination of deductible</header>
				<paragraph id="HF37B7DC6B1B84DB7A16036F84042496C"><enum>(1)</enum><header>Payment</header><text>Section
			 1833(a)(1) of such Act (42 U.S.C. 1395l(a)(1)) is amended—</text>
					<subparagraph id="H7D1B3015AC65422FBB73A882D775ACB9"><enum>(A)</enum><text>by striking
			 <quote>and</quote> before <quote>(W)</quote>; and</text>
					</subparagraph><subparagraph id="H0E3398BCD0754106BEDED6241854E7AD"><enum>(B)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (X) with respect to
			 counseling for cessation of tobacco use (as defined in section 1861(hhh)), the
			 amount paid shall be 80 percent of the lesser of the actual charge for the
			 service or the amount determined by a fee schedule established by the Secretary
			 for purposes of this clause</quote>.</text>
					</subparagraph></paragraph><paragraph id="HCE7E102EDBE74A209EE915522B47C26E"><enum>(2)</enum><header>Elimination of
			 deductible</header><text>The first sentence of section 1833(b) of such Act (42
			 U.S.C. 1395l(b)) is amended—</text>
					<subparagraph id="H13F84DB1FE22410E885CC19390E017E"><enum>(A)</enum><text>by striking
			 <quote>and</quote> before <quote>(9)</quote>; and</text>
					</subparagraph><subparagraph id="H48C2BACADB9B46149F24CAC475A6375E"><enum>(B)</enum><text>by inserting
			 before the period the following: <quote>, and (10) such deductible shall not
			 apply with respect to counseling for cessation of tobacco use (as defined in
			 section 1861(hhh))</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H71D84C578912467EAB210035B1047108"><enum>(d)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1 of the first calendar year that begins at least
			 6 months after the date of the enactment of this Act.</text>
			</subsection></section><section id="HAA30407A634E478E83092D78DD9E7BDD"><enum>3.</enum><header>Coverage of
			 tobacco cessation pharmacotherapy under the Medicare program</header>
			<subsection id="HA22ABEB5C1B24B3CBDA070E751D51C00"><enum>(a)</enum><header>Inclusion of
			 tobacco cessation agents as covered drugs</header><text display-inline="yes-display-inline">Section 1860D–2(e)(1) of the Social
			 Security Act (42 U.S.C. 1395w–102(e)(1)) is amended—</text>
				<paragraph id="HFDFE8D3028074CEB8C68FD954C05359F"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote> after the semicolon at the end;</text>
				</paragraph><paragraph id="H7422E25C6759454BBE4B31AAC8BB025B"><enum>(2)</enum><text>in subparagraph
			 (B), by striking the comma at the end and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H34B7F57FA30E470393754FD958700AB"><enum>(3)</enum><text>by
			 inserting after subparagraph (B) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HD4AE02C511EF446596B2913E974821DB" style="OLC">
						<subparagraph id="H8BA83DF7F6E4407EAA09AD7200008FF5"><enum>(C)</enum><text display-inline="yes-display-inline">any agent approved by the Food and Drug
				Administration for purposes of promoting, and when used to promote, tobacco use
				cessation that may be dispensed without a prescription (commonly referred to as
				an <quote>over-the-counter</quote> drug), but only if such an agent is
				prescribed by a physician (or other person authorized to prescribe under State
				law),</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0D320E52B0CD45B0A7E03C63E56DB400"><enum>(b)</enum><header>Establishment of
			 categories and classes consisting of tobacco cessation
			 agents</header><text>Section 1860D–4(b)(3)(C) of the Social Security Act (42
			 U.S.C. 1395w–104(b)(3)(C)) is amended by adding at the end the following new
			 clause:</text>
				<quoted-block display-inline="no-display-inline" id="HA9D0404A5FEC4ED8B61472EDDE0122E7" style="OLC">
					<clause id="H06057F8C64DA41BE8CD332C72048715"><enum>(iv)</enum><header>Categories and
				classes of tobacco cessation agents</header><text display-inline="yes-display-inline">There shall be a therapeutic category or
				class of covered part D drugs consisting of agents approved by the Food and
				Drug Administration for cessation of tobacco use. Such category or class shall
				include tobacco cessation agents described in subparagraphs (A) and (C) of
				section
				1860D–2(e)(1).</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HECCB4862209B465CBB851104EE24628"><enum>4.</enum><header>Coverage of
			 counseling and medication for cessation of tobacco use under the Medicaid
			 program</header>
			<subsection id="H68404DEBC4AA4BB7885BB7A1A046206C"><enum>(a)</enum><header>Dropping
			 exception from medicaid prescription drug coverage for tobacco use cessation
			 medications</header>
				<paragraph id="HC2832A0169FC40AB97C897069E00ADD0"><enum>(1)</enum><header>In
			 general</header><text>Section 1927(d)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1396r–8(d)(2)) is
			 amended—</text>
					<subparagraph id="HE10EE2DBD83944B482351E794F97753E"><enum>(A)</enum><text>by striking
			 subparagraph (E);</text>
					</subparagraph><subparagraph id="H414F234CD0484798BCDDF87468ECEA4"><enum>(B)</enum><text>by redesignating
			 subparagraph (F) through (K) as subparagraphs (E) through (J), respectively;
			 and</text>
					</subparagraph><subparagraph id="H01D26FF7169E42E38E7C1D42A1002C19"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (F), as so redesignated, by
			 inserting before the period at the end the following: <quote>, other than
			 agents approved by the Food and Drug Administration for purposes of promoting,
			 and when used to promote, tobacco use cessation (regardless, for purposes of
			 this title only, of whether such agents may be dispensed only upon prescription
			 or may be dispensed without a prescription (commonly referred to as an
			 <quote>over-the-counter</quote> drug), but only if such an agent is prescribed
			 by a physician (or other person authorized to prescribe under State
			 law))</quote>.</text>
					</subparagraph></paragraph><paragraph id="H267C6DB661534F5385BE31A2BF001C15"><enum>(2)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section
			 1860D–2(e)(2)(A) of the Social Security Act (42 U.S.C. 1395w–102(e)(2)(A)) is
			 amended by striking <quote>, other than subparagraph (E) of such section
			 (relating to smoking cessation agents),</quote>.</text>
				</paragraph></subsection><subsection id="H7D18A5C4F80541D4867BA5B3B5389C9E"><enum>(b)</enum><header>Requiring
			 coverage of tobacco use cessation counseling</header><text>Section 1905(a)(4)
			 of such Act (42 U.S.C. 1396d(a)(4)) is amended—</text>
				<paragraph id="HDD49E9F06F9144B4B4BBD6B200181510"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(C)</quote>; and</text>
				</paragraph><paragraph id="H8F12415FFE7A4B1885EDFF6093B9D25"><enum>(2)</enum><text>by
			 adding at the end the following: <quote>, and (D) counseling for cessation of
			 tobacco use (as defined in section 1861(hhh));</quote>.</text>
				</paragraph></subsection><subsection id="H1965D15C58464F45909D3ED5B322747D"><enum>(c)</enum><header>Treatment of
			 tobacco cessation services and medications as services related to
			 pregnancy</header><text display-inline="yes-display-inline">Section 1905 of
			 such Act is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H20BA01F6388447D4992CF9CFF3F8AEE8" style="OLC">
					<subsection id="HEFC1892290D54BBB8F8CE16BE2EDD754"><enum>(y)</enum><text display-inline="yes-display-inline">Services described in subsection (a)(4)(D)
				shall be treated as services related to pregnancy with respect to women during
				pregnancy (and during the 60-day period beginning on the last day of the
				pregnancy).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4C4CA125A448496290D59718BD42D8ED"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to items and
			 services furnished on or after January 1 of the first calendar year that begins
			 at least 6 months after the date of the enactment of this Act.</text>
			</subsection></section><section id="H2265997BA1944CCBAB9B8111006339B3"><enum>5.</enum><header>Promoting
			 cessation of tobacco use under the maternal and child health program</header>
			<subsection id="H13FDB7281BFB4617B411DF1E97901933"><enum>(a)</enum><header>Quality Maternal
			 and Child Health Services includes tobacco use cessation counseling and
			 medications</header><text>Section 501 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 701) is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block act-name="Social Security Act" id="H9314846CA6EE46FC85944C8988E3C56D" style="OLC">
					<subsection id="H2B23E820BAAF4A81A6F04CBF8DE1BC9"><enum>(d)</enum><text display-inline="yes-display-inline">For purposes of this title, counseling for
				cessation of tobacco use (as defined in section 1861(hhh)), drugs and
				biologicals used to promote tobacco use cessation (regardless of whether such
				drugs or biologicals may be dispensed only upon prescription or may be
				dispensed without a prescription (commonly referred to as an
				<quote>over-the-counter</quote> drug), but only if such a drug or biological is
				prescribed by a physician (or other person authorized to prescribe under State
				law)), and the inclusion of antitobacco messages in health promotion counseling
				shall be considered to be part of quality maternal and child health
				services.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD36C61D35E2540CAB68C1F8F3D5CFA98"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect on
			 the date of the enactment of this Act.</text>
