			 purposes</header>
			<subsection id="H72CCEADE41EE446EA263C7733A8BACE6"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph id="H2CCC2D07278E4DA6BF2E3B8630D14015"><enum>(1)</enum><text>reductions of
			 atmospheric sulfur dioxide and nitrogen oxide from utility plants, in addition
			 to the reductions required under the Clean Air Act (42 U.S.C. 7401 et seq.),
			 are needed to reduce acid deposition and its serious adverse effects on public
			 health, natural resources, building structures, sensitive ecosystems, and
			 visibility;</text>
				</paragraph><paragraph id="H4FD4C59F36994D0681A0DA566E817804"><enum>(2)</enum><text>sulfur dioxide and
			 nitrogen oxide contribute to the development of fine particulates, suspected of
			 causing human mortality and morbidity to a significant extent;</text>
				</paragraph><paragraph id="H87E29C7A74A7459780E10015F3BBF70B"><enum>(3)</enum><text>regional nitrogen
			 oxide reductions of 75 percent in the Eastern United States, in addition to the
			 reductions required under the Clean Air Act, may be necessary to protect
			 sensitive watersheds from the effects of nitrogen deposition;</text>
				</paragraph><paragraph id="HB980BB7EA3AF4CCB8906BFDB2C6DFBE8"><enum>(4)</enum><text>since the Clean
			 Air Act Amendments of 1990 were enacted, some acidic lakes in the Adirondacks
			 in the State of New York have started to slowly show chemical recovery from
			 acid rain, demonstrating that sulfur dioxide and nitrogen oxide regulations can
			 be implemented in a cost-effective manner, but the recovery is progressing at a
			 slower rate than originally intended;</text>
				</paragraph><paragraph id="H370291010EEF42528AD34AA2678407F9"><enum>(5)</enum><text>nitrogen oxide is
			 highly mobile and can lead to ozone formation hundreds of miles from the
			 emitting source;</text>
				</paragraph><paragraph id="HB716BF53F12844F696E86E322A6A4552"><enum>(6)</enum><text>on March 10, 2005,
			 the Environmental Protection Agency (EPA) issued the Clean Air Interstate Rule
			 (CAIR) to require additional reductions in sulfur dioxide and nitrogen oxide in
			 28 Eastern States and the District of Columbia;</text>
				</paragraph><paragraph id="H29F96C956164440589BEF9987571FD86"><enum>(7)</enum><text>these reductions
			 represent approximately a 70 percent reduction in sulfur dioxide and a 60
			 percent reduction in nitrogen oxide in the affected States;</text>
				</paragraph><paragraph id="H9274A1A0D7074575BAD779246DE999CB"><enum>(8)</enum><text>on July 11, 2008,
			 the United States Court of Appeals for the District of Columbia Circuit vacated
			 CAIR and on December 23, 2008, the same court remanded the rule back to the EPA
			 without vacature;</text>
				</paragraph><paragraph id="HD2E4A567EDD4446AB149C44F14BB77AA"><enum>(9)</enum><text>fossil fuel-fired
			 electric generating units emit approximately <fraction>1/3</fraction> of the
			 total mercury emissions in the United States;</text>
				</paragraph><paragraph id="HC57484DE514E497CB2BBF86DDB89A302"><enum>(10)</enum><text>mercury is
			 considered a neurotoxin which can bioaccumulate as it moves its way up the food
			 chain and is especially harmful to young children and developing
			 fetuses;</text>
				</paragraph><paragraph id="H2F8F743DADE94D18950CA4E5D0FF1CEB"><enum>(11)</enum><text>according to the
			 EPA, there were 3,080 fish advisories for mercury in 2006; there are over 90
			 fish advisories for mercury in New York alone, with blanket warning for the
			 Adirondack and Catskill Mountains;</text>
				</paragraph><paragraph id="HB294C4CD4B4D4A4EA498F7E249ECF380"><enum>(12)</enum><text>on March 15,
			 2005, EPA issued the Clean Air Mercury Rule (CAMR), which for the first time
			 sought to regulate mercury emissions from power plants, but used a less
			 restrictive cap-and-trade approach for this very harmful substance and would
			 take a full decade to implement;</text>
				</paragraph><paragraph id="H9F59C0DC9EDF4D1A8F9D65FF14D184E0"><enum>(13)</enum><text>on February 8,
			 2008, the United States Court of Appeals for the District of Columbia Circuit
			 vacated CAMR; and</text>
				</paragraph><paragraph id="H9D0B03DD323E4A54B5104187C27F6D2C"><enum>(14)</enum><text>on February 23,
			 2009, the Supreme Court denied a request to reconsider the decision.</text>
				</paragraph></subsection><subsection id="H9CC7445C2D604DE99E0536087C49D21A"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="H4673425FE2474801B499AB9B7CD41E3F"><enum>(1)</enum><text>to recognize the
			 current scientific understanding that emissions of sulfur dioxide and nitrogen
			 oxide, and the acid deposition resulting from emissions of sulfur dioxide and
			 nitrogen oxide, present a substantial human health and environmental
			 risk;</text>
				</paragraph><paragraph id="H64D9E425799B4036B03B914EE50E41BA"><enum>(2)</enum><text>to require
			 reductions in sulfur dioxide and nitrogen oxide emissions;</text>
				</paragraph><paragraph id="H1253958627F84B6EB312FD7BD9BD303D"><enum>(3)</enum><text>to support the
			 efforts of existing acid rain and mercury monitoring programs located
			 throughout the country;</text>
				</paragraph><paragraph id="HB678E015D17F452CB234BF2A4AE10A96"><enum>(4)</enum><text>to reduce utility
			 emissions of nitrogen oxide by 75 percent from 1997 levels;</text>
				</paragraph><paragraph id="H82E5ED58D7BF41D5A17683272EBBCEC3"><enum>(5)</enum><text>to reduce utility
			 emissions of sulfur dioxide by 75 percent after the implementation of phase II
			 sulfur dioxide requirements under section 405 of the Clean Air Act (42 U.S.C.
			 7651d); and</text>
				</paragraph><paragraph id="H9440550BA06A4BDBB061AF379C5894C5"><enum>(6)</enum><text>to adopt a strict standard for mercury emissions by power plants of 0.6 pounds
			 per trillion Btu without allowing for a cap-and-trade system.</text>
				</paragraph></subsection></section><section id="H344859D4ED0A4205BFF632E7A8DB7364"><enum>3.</enum><header>Reduction of
			 sulfur dioxide and nitrogen oxide emissions from powerplants</header><text display-inline="no-display-inline">Part A of title I of the
			 <act-name parsable-cite="CAA">Clean Air Act</act-name> (42 U.S.C. 7401 et seq.)
			 is amended by adding at the end the following:</text>
			<quoted-block act-name="Clean" id="H07B407CAD5BE4A0495C57FB569FDC54F">
				<section id="HDEC68CA83A86495EA1B8FC39B2B3977F"><enum>132.</enum><header>Reduction of
				sulfur dioxide and nitrogen oxide emissions from powerplants</header>
					<subsection id="H51DFAE0C2EE64017BADAA87C190F0BD"><enum>(a)</enum><header>Emission
				reduction objectives</header><text>The emission reduction objectives of this
				section are to reduce, not later than January 1, 2012—</text>
						<paragraph id="H172C0B7AA9DF4A148647F59F0696A78D"><enum>(1)</enum><text>aggregate sulfur
				dioxide emissions from powerplants by 75 percent from the levels allowed under
				full implementation of the Phase II sulfur dioxide requirements under title IV
				(relating to acid deposition control); and</text>
						</paragraph><paragraph id="HE3F3B382FF424ABB95616EE983FF765C"><enum>(2)</enum><text>aggregate nitrogen
				oxide emissions from powerplants by 75 percent from 1997 levels.</text>
						</paragraph></subsection><subsection id="H1E1E6124526E414284B7E524F7D19810"><enum>(b)</enum><header>Agency
				action</header>
						<paragraph id="HF301994F0ACE456089115900A085644"><enum>(1)</enum><header>Regulations</header>
							<subparagraph id="H08A9CDF3E8CA42AAB540116DD8C7F754"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of
				this section, the Administrator shall promulgate regulations to achieve the
				emission reduction objectives specified in subsection (a).</text>
							</subparagraph><subparagraph id="H14ABC5D9A34D495896006BDE58ACD4D1"><enum>(B)</enum><header>Elements</header><text>The
				regulations promulgated under subparagraph (A)—</text>
								<clause id="H0EFA067B22D1412B9BA1EE1DCEFA95C"><enum>(i)</enum><text>shall achieve the
				objectives in a manner that the Administrator determines will allocate required
				emission reductions equitably, taking into account emission reductions achieved
				before the date of enactment of this section and other relevant factors;</text>
								</clause><clause id="H1265BAC79FF04EF6B521A96E44FB4406"><enum>(ii)</enum><text>may include
				market-oriented mechanisms (such as emissions trading based on generation
				performance standards, auctions, or other allocation methods);</text>
								</clause><clause id="H701DDAD9BD9E4F0785797F44DCA6D99"><enum>(iii)</enum><text>shall prevent
				localized adverse effects on public health and the environment and ensure that
				significant emission reductions are achieved in both the Eastern and Western
				regions of the United States; and</text>
								</clause><clause id="HCA112BFC137D4EDF9822C4DD00BB2E84"><enum>(iv)</enum><text>shall include,
				consistent with achieving the objectives set forth in subsection (a),
				incentives for renewable energy.</text>
								</clause></subparagraph></paragraph><paragraph id="H9EF3AD8717A647F4BB7D892C5B22D4EB"><enum>(2)</enum><header>Interagency
				coordination to minimize costs and maximize gains</header><text>To minimize the
				economic costs and maximize the economic gains of achieving the emission
				reduction objectives specified in subsection (a), the Administrator shall
				coordinate with other departments and agencies of Federal and State government
				to increase energy efficiency, to increase the use of renewable energy, and to
				implement cost saving advanced demand and supply side policies, such as those
				described in the report prepared by the Interlaboratory Working Group of the
				Department of Energy entitled <quote>Scenarios for a Clean Energy
				Future</quote>, dated November 2000.</text>
						</paragraph></subsection><subsection id="H9C253AB3FEC840B1AD8B50AC9262D24F"><enum>(c)</enum><header>Additional
				reductions</header><text>The regulations promulgated under subsection (b) may
				require additional reductions in emissions from powerplants if the
				Administrator determines that the emission levels necessary to achieve the
				emission reduction objectives specified in subsection (a) are not reasonably
				anticipated to protect public health or welfare.</text>
					</subsection><subsection id="H6DA25225870940F79D965B4086430464"><enum>(d)</enum><header>Modernization of
				outdated powerplants</header>
						<paragraph id="H07C5F38967AF4E838FFA704800A903A7"><enum>(1)</enum><header>In
				general</header><text>On the later of the date that is 30 years after a
				powerplant commenced operation or the date that is 5 years after the date of
				enactment of this section, it shall comply with—</text>
							<subparagraph id="H7B248B7E4D1341B2BEED8F996B3C545"><enum>(A)</enum><text>the most recent new
				source performance standards promulgated under section 111; and</text>
							</subparagraph><subparagraph id="HCC3BAECEB02448008423DB1CE00AF66"><enum>(B)</enum><text>the requirements
				under parts C and D that are applicable to modified sources.</text>
							</subparagraph></paragraph><paragraph id="H61412F26777F4A4D8313BB7648366BF4"><enum>(2)</enum><header>Additional
				requirements</header><text>The requirements of this subsection shall be in
				addition to the requirements of the regulations promulgated under subsection
				(b).</text>
						</paragraph></subsection><subsection id="H8548A1082CC3491493AFA978B951B011"><enum>(e)</enum><header>Other
				requirements</header><text>The requirements of this section shall be in
				addition to, and not in lieu of, any other requirement of this Act.</text>
					</subsection><subsection id="H758FD821C5324CF891BEEFB4480098B9"><enum>(f)</enum><header>Definition</header><text>In
				this section, the term <term>powerplant</term> means an electric generation
				facility with a nameplate capacity of 25 megawatts or more that uses a
				combustion device to generate electricity for
				sale.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB1FF45B5BD0248F784BA76E422827643"><enum>4.</enum><header>Mercury emission
			 reductions</header><text display-inline="no-display-inline">The Clean Air Act
			 (42 U.S.C. 7401 et seq.) is amended by adding at the end the following:</text>

				Reductions</header>

					<section id="HA7EB537F8E13430BAE8F2FA09E981C3C"><enum>701.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
						<paragraph id="HBFF41415575243C09C84840030ACDD59"><enum>(1)</enum><header>Affected
				unit</header><text>The term <quote>affected unit</quote> means a coal-fired
				electric generating facility (including a cogeneration facility) that—</text>
							<subparagraph id="H0EF6793E873045BBA307D31FFEB6687E"><enum>(A)</enum><text>has a nameplate
				capacity greater than 25 megawatts; and</text>
							</subparagraph><subparagraph id="H033BEF97960144CEB868B19C53BC504C"><enum>(B)</enum><text>generates
				electricity for sale.</text>
							</subparagraph></paragraph><paragraph id="H77733DDD218646D89BF8FA4186DAB52E"><enum>(2)</enum><header>Cogeneration
				facility</header><text>The term <quote>cogeneration facility</quote> means a
				facility that—</text>
							<subparagraph id="HDB71AE291EA24829B4B06F62799E7700"><enum>(A)</enum><text>cogenerates—</text>
								<clause id="H06784B30C3C949B6A0C4502375DCA9B"><enum>(i)</enum><text>steam; and</text>
								</clause><clause id="HFD3B410FF84E4E31A599980543994584"><enum>(ii)</enum><text>electricity;
				and</text>
								</clause></subparagraph><subparagraph id="H9B78C3003B8E4CA2AE15D9EBC98CB860"><enum>(B)</enum><text>supplies, on a net
				annual basis, to any utility power distribution system for sale—</text>
								<clause id="H3E10C494BDF047609FD5A6429C984E81"><enum>(i)</enum><text>more than
				<fraction>1/3</fraction> of the potential electric output capacity of the
				facility; and</text>
								</clause><clause id="H2CF6511260AB47D49E926F47479151AA"><enum>(ii)</enum><text>more than 25
				megawatts of electrical output of the facility.</text>
								</clause></subparagraph></paragraph></section><section id="HC7820636926744B7BBC3179164AA391"><enum>702.</enum><header>Mercury
				reduction program</header>
						<subsection id="HFB0CAAAF76EF4F0999B109B70206657B"><enum>(a)</enum><header>New unit
				requirement</header><text>Any affected unit that commences operation after
				December 31, 2010, shall be considered a new unit for the purposes of this
				section and shall not exceed the emission limit of 0.6 pounds mercury per
				trillion Btu (0.6 lb Hg/TBtu) upon commencement of operation.</text>
						</subsection><subsection id="H0EC84DFF59FC4610B950DF109C687832"><enum>(b)</enum><header>Existing unit
				requirement</header><text>Any affected unit that commences operation on or
				before December 31, 2010, shall not exceed the emission limit of 0.6 pounds
				mercury per trillion Btu by January 1, 2013.</text>
						</subsection><subsection id="H32BE95F2C39F4911A6B3D5B8E7BCA52"><enum>(c)</enum><header>Monitoring
				system</header><text>Not later than January 1, 2011, the Administrator shall
				promulgate regulations requiring operation, reporting and certification of
				continuous emissions monitoring systems (CEMS) to accurately measure the
				quantity of mercury that is emitted from each affected unit.</text>
						</subsection><subsection id="HDEA7D03A2E4648669DA5D74C386AC4B"><enum>(d)</enum><header>Excess
				emissions</header>
							<paragraph id="H7ABB1411DCD845D6888FFEF949294B79"><enum>(1)</enum><header>In
				general</header><text>The owner or operator of an affected unit that emits
				mercury in excess of the emission limitation described in subsections (b) and
				(c) shall pay an excess emissions penalty determined under paragraph
				(2).</text>
							</paragraph><paragraph id="H9418DC84674D44A4A0D056275577106D"><enum>(2)</enum><header>Determination of
				excess emissions penalty</header><text>The excess emissions penalty shall be an
				amount equal to $10,000 for each ounce of mercury emitted in excess of the
				emission limitations for mercury described in subsections (b) and (c).</text>
							</paragraph></subsection><subsection id="H275D9DDC6F5C46EE8B359E82ACB75EA"><enum>(e)</enum><header>Prevention of
				mercury re-release</header><text display-inline="yes-display-inline">Not later
				than January 1, 2011, the Administrator shall promulgate regulations to ensure
				that any mercury captured or recovered by emission controls installed at an
				affected unit is not re-released into the environment.</text>
						</subsection></section><section id="H9EA6B86CB0C343FEA9A286F81000E74D"><enum>703.</enum><header>Prohibitions</header><text display-inline="no-display-inline">It shall be unlawful—</text>
						<paragraph id="H575475D67A4844A8BED508AF230625C9"><enum>(1)</enum><text>for the owner or
				operator of any electricity generating facility—</text>
							<subparagraph id="HC2299C1BBF7741EE8720018F3016729D"><enum>(A)</enum><text>to operate the
				electricity generating facility in noncompliance with the requirements of this
				title (including any regulations implementing this title);</text>
							</subparagraph><subparagraph id="H227A706422914EDB9355B3FE1D33DBFE"><enum>(B)</enum><text>to fail to submit
				by the required date any emission allowances, or pay any penalty, for which the
				owner or operator is liable;</text>
							</subparagraph><subparagraph id="H397A0CDC9BB44A8D83EA49F9B81D05C8"><enum>(C)</enum><text>to fail to provide
				and comply with any plan to offset excess emissions; or</text>
							</subparagraph><subparagraph id="H2424383D63444A4893D82ABDD747D83"><enum>(D)</enum><text>to emit mercury in
				excess of the emission limitations established under section 702; or</text>
							</subparagraph></paragraph><paragraph id="H27DDF2902FC6427E0000838BCD93331E"><enum>(2)</enum><text>for any person to
				hold, use, or transfer any emission allowance allocated under this title except
				in accordance with regulations promulgated by the
				Administrator.</text>
						</paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HAF55B6C3CF4B4F4DA6D5C85441C3F300"><enum>5.</enum><header>Effect on other
			 law</header><text display-inline="no-display-inline">Nothing in this
			 Act—</text>
			<paragraph id="H0E247841CEF44BBABC44C1AC17EC53A4"><enum>(1)</enum><text>affects the
			 ability of a State to take State actions to further limit sulfur dioxide,
			 nitrogen oxide, or mercury; and</text>
			</paragraph><paragraph id="H63606A4309484E39A0F9E9BD10000049"><enum>(2)</enum><text>except as
			 expressly provided in this Act—</text>
				<subparagraph id="H6F02E61049DC42BCA25182F405A767F1"><enum>(A)</enum><text>modifies or
			 otherwise affects any requirement of this Act in effect on the day before the
			 date of enactment of this Act; or</text>
				</subparagraph><subparagraph id="H02D57D7B8D8E4FB28969334CEFB69202"><enum>(B)</enum><text>relieves any
			 person of the responsibility to comply with this Act.</text>
				</subparagraph></paragraph></section><section id="H9EFBA4D326B14FFE8254264046D4C5D9"><enum>6.</enum><header>Protecting
			 sensitive regional ecosystems</header>
			<subsection id="H9C2435CD6AB1436EAA08F200E4A8005B"><enum>(a)</enum><header>Report</header>
				<paragraph id="HAD3E120F5EAF48B395BAC2D7250443E2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2012, the Administrator shall submit to Congress a report
			 identifying objectives for scientifically credible environmental indicators, as
			 determined by the Administrator of the Environmental Protection Agency, that
			 are sufficient to protect and restore sensitive ecosystems of the Adirondack
			 Mountains, mid-Appalachian Mountains, Catskill Mountains, Rocky Mountains, and
			 Southern Blue Ridge Mountains and water bodies of the Great Lakes, Lake
			 Champlain, Long Island Sound, the Chesapeake Bay and other sensitive
			 ecosystems, as determined by the Administrator.</text>
				</paragraph><paragraph id="HCBE259A00E2D4FFABB89FC084E8F12DC"><enum>(2)</enum><header>Updated
			 report</header><text>Not later than December 31, 2021, the Administrator shall
			 submit to Congress a report updating the report under paragraph (1) and
			 assessing the status and trends of various environmental objectives and
			 indicators for the sensitive regional ecosystems referred to in paragraph
			 (1).</text>
				</paragraph><paragraph id="HC5F5492476A843FBB94864DF3D0000B"><enum>(3)</enum><header>Reports under the
			 national acid precipitation assessment program</header><text>The reports under
			 this subsection shall be subject to the requirements applicable to a report
			 under section 103(j)(3)(E) of the Clean Air Act (42 U.S.C.
			 7403(j)(3)(E)).</text>
				</paragraph></subsection><subsection id="H4614AB85EA214B1EA435AA94013E0065"><enum>(b)</enum><header>Regulations</header>
				<paragraph id="H59F7DCC215EA468CBFE112E142A523C2"><enum>(1)</enum><header>Determination</header><text>Not
			 later than December 31, 2019, the Administrator shall determine whether
			 emission reductions under title VII of the Clean Air Act are sufficient to
			 ensure achievement of the objectives stated in subsection (a)(1).</text>
				</paragraph><paragraph id="HF36238C345014A738912D019C39D69C1"><enum>(2)</enum><header>Promulgation</header><text>If
			 the Administrator determines under paragraph (1) that emission reductions under
			 title VII of the Clean Air Act are not sufficient to ensure achievement of the
			 objectives identified in subsection (a)(1), the Administrator shall promulgate,
			 not later than 2 years after making the finding, such regulations, including
			 modification of sulfur dioxide and nitrogen oxide allowance allocations or any
			 such measure, as the Administrator determines are necessary to protect the
			 sensitive ecosystems described in subsection (a)(1).</text>
				</paragraph></subsection></section><section id="HA64903E27E134A59927E7B49694188DD"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">In addition to
			 amounts made available under any other law, there are authorized to be
			 appropriated for each of fiscal years 2010 through 2020—</text>
			<paragraph id="HA367D67420604F2CBE00ABC639EA928D"><enum>(1)</enum><text>for operational
			 support of the National Atmospheric Deposition Program National Trends
			 Network—</text>
				<subparagraph id="HF784E880CB4C4A01AF19753400FDB999"><enum>(A)</enum><text>$2,000,000 to the
			 United States Geological Survey;</text>
				</subparagraph><subparagraph id="H791AE3EE3C0A44A998F320AEC9BC044B"><enum>(B)</enum><text>$600,000 to the
			 Environmental Protection Agency;</text>
				</subparagraph><subparagraph id="H08BB6539717E4F1291DCAB8C13221431"><enum>(C)</enum><text>$600,000 to the
			 National Park Service; and</text>
				</subparagraph><subparagraph id="HE2B077D2649E4135B9BF9BFA9A009F5"><enum>(D)</enum><text>$400,000 to the
			 Forest Service;</text>
				</subparagraph></paragraph><paragraph id="H5BE448E3FC274795BD3FCA79922781E7"><enum>(2)</enum><text>for operational
			 support of the National Atmospheric Deposition Program Mercury Deposition
			 Network—</text>
				<subparagraph id="HEF8B7AB13BEC4749ADC0788C00E34E5"><enum>(A)</enum><text>$400,000 to the
			 Environmental Protection Agency;</text>
				</subparagraph><subparagraph id="H5BE8B2D3F19547C19F1FD6C1BE41C00"><enum>(B)</enum><text>$400,000 to the
			 United States Geological Survey;</text>
				</subparagraph><subparagraph id="HF71174D6B05A4CEABCED02C68A3E2DC"><enum>(C)</enum><text>$100,000 to the
			 National Oceanic and Atmospheric Administration; and</text>
				</subparagraph><subparagraph id="HBE5290F5C62648ED84BD466086E72BF6"><enum>(D)</enum><text>$100,000 to the
			 National Park Service;</text>
				</subparagraph></paragraph><paragraph id="H3FB6E439D52C4460A690F4F553040072"><enum>(3)</enum><text>for the National
			 Atmospheric Deposition Program Atmospheric Integrated Research Monitoring
			 Network $1,500,000 to the National Oceanic and Atmospheric
			 Administration;</text>
			</paragraph><paragraph id="H96EE8150102840DEB1E0AC2C1854D08C"><enum>(4)</enum><text>for the Clean Air
			 Status and Trends Network $5,000,000 to the Environmental Protection Agency;
			 and</text>
			</paragraph><paragraph id="H34846291869146D4B0E781BBBF814815"><enum>(5)</enum><text>for the Temporally
			 Integrated Monitoring of Ecosystems and Long-Term Monitoring Program $2,500,000
			 to the Environmental Protection Agency.</text>
			</paragraph></section><section id="HEB70FA402EDD4085AF8CEFDC03CDC13B"><enum>8.</enum><header>Modernization</header>
			<subsection id="HEBD49473E10B413AB89C333C7589C01E"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">In addition to
			 amounts made available under any other law, there are authorized to be
			 appropriated—</text>
				<paragraph id="HF2CD218F978943678261BDE164350655"><enum>(1)</enum><text>for equipment and
			 site modernization of the National Atmospheric Deposition Program National
			 Trends Network $6,000,000 to the Environmental Protection Agency;</text>
				</paragraph><paragraph id="H3DBEB257C46A46159B772B00C4D59700"><enum>(2)</enum><text>for equipment and
			 site modernization and network expansion of the National Atmospheric Deposition
			 Program Mercury Deposition Network $2,000,000 to the Environmental Protection
			 Agency;</text>
				</paragraph><paragraph id="HD57607BF47CB4206933C48BD0230766C"><enum>(3)</enum><text>for equipment and
			 site modernization and network expansion of the National Atmospheric Deposition
			 Program Atmospheric Integrated Research Monitoring Network $1,000,000 to the
			 National Oceanic and Atmospheric Administration; and</text>
				</paragraph><paragraph id="HADFAD4D395B64C9F9997A0F8B700F6C3"><enum>(4)</enum><text>for equipment and
			 site modernization and network expansion of the Clean Air Status and Trends
			 Network $4,600,000 to the Environmental Protection Agency.</text>
				</paragraph></subsection><subsection id="H7C257AC90F6B4769AFACE4F2A8D14F5F"><enum>(b)</enum><header>Availability of
			 amounts</header><text>Each of the amounts appropriated under subsection (a)
			 shall remain available until expended.</text>
