		<official-title display="yes">To amend the Small Business Act to expand
		  and improve the assistance provided to Indian tribe members, Alaska Natives,
		  and Native Hawaiians, and for other purposes.</official-title>

		<section id="H109055CB7C884305A8DADB3F7E8E1511" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Native American Business Development
			 Enhancement Act of 2009</short-title></quote>.</text>
		</section><section id="H40621DC2429745F5A1B20734275924C0"><enum>2.</enum><header>Office of Native
			 American Affairs; Tribal Business Information Centers program</header>
			<subsection id="HED1ACD7622FF4763BF36D085CC8D15B4"><enum>(a)</enum><header>Associate
			 Administrator</header><text display-inline="yes-display-inline">Section 4(b)(1)
			 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/633">15 U.S.C. 633(b)(1)</external-xref>) is
			 amended—</text>
				<paragraph id="HB04994BE6F6346559553E4114D7789CF"><enum>(1)</enum><text>by striking
			 <quote>five Associate Administrators</quote> and inserting <quote>six Associate
			 Administrators</quote>; and</text>
				</paragraph><paragraph id="H6520771E7ADE4547811D26C2A58425EA"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after <quote>vested in the
			 Administration.</quote> the following: <quote>One such Associate Administrator
			 shall be the Associate Administrator for Native American Affairs, who shall
			 administer the Office of Native American Affairs established under section
			 44.</quote>.</text>
				</paragraph></subsection><subsection id="HED5E670F802F419DB092103D9E826A5D"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et
			 seq.</external-xref>) is amended—</text>
				<paragraph id="HBCA0D215597C4E5BBB9C28D54B13E373"><enum>(1)</enum><text>by redesignating
			 section 44 as section 45; and</text>
				</paragraph><paragraph id="H62198464B51B41AF8658D6EFA66F51BA"><enum>(2)</enum><text>by inserting after
			 section 43 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8B24BA964EE04FC4AB02694B6D1EC630" style="OLC">
						<section id="HD0F683E91B8848AC94BA8CC6446B9811"><enum>44.</enum><header>Office of Native
				American Affairs and Tribal Business Information Centers Program</header>
							<subsection id="HE23083A26649496294DFED19B0B412FB"><enum>(a)</enum><header>Office of Native
				American Affairs</header>
								<paragraph id="H1F73C1551DFD4DCDBE48BC369306BC5C"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Administration
				an Office of Native American Affairs (hereinafter referred to in this
				subsection as the <quote>Office</quote>).</text>
								</paragraph><paragraph id="HDDF773B6316F41F984FC151F37C5E874"><enum>(2)</enum><header>Associate
				Administrator</header><text display-inline="yes-display-inline">The Office
				shall be administered by an Associate Administrator appointed under section
				4(b)(1).</text>
								</paragraph><paragraph id="HB7D60479CC244CC2A5E77867354A9E93"><enum>(3)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Office shall have the following
				responsibilities:</text>
									<subparagraph id="H3D36EDCFE80E424EA2CC0F1C880E4B60"><enum>(A)</enum><text>Developing and
				implementing tools and strategies to increase Native American
				entrepreneurship.</text>
									</subparagraph><subparagraph id="HD1D614EBE45A462DB52E483412007336"><enum>(B)</enum><text display-inline="yes-display-inline">Expanding the access of Native American
				entrepreneurs to business training, financing, and Federal small business
				contracts.</text>
									</subparagraph><subparagraph id="H6D97D7BDCAD14FD5B54AD98FC940C580"><enum>(C)</enum><text>Expanding outreach
				to Native American communities and marketing entrepreneurial development
				services to such communities.</text>
									</subparagraph><subparagraph id="H9E119CABE00F44C4A3B81C2B08B9FE89"><enum>(D)</enum><text>Representing the
				Administration with respect to Native American economic development
				matters.</text>
									</subparagraph></paragraph><paragraph id="H2C67DE2930534C518ECE422F053354E3"><enum>(4)</enum><header>Coordination and
				oversight function</header><text>The Office shall provide oversight with
				respect to and assist the implementation of all Administration initiatives
				relating to Native American entrepreneurial development.</text>
								</paragraph><paragraph id="HBD2E787662AA44168FD5A3959D406E93"><enum>(5)</enum><header>Authorization of
				appropriations</header><text>To carry out this subsection, there is authorized
				to be appropriated to the Administrator $2,000,000 for each of fiscal years
				2010 and 2011.</text>
								</paragraph></subsection><subsection id="H91FE786EDCB5439FBF75683FE2DBDE9C"><enum>(b)</enum><header>Tribal Business
				Information Centers Program</header>
								<paragraph id="H4BD5E08042BD41C8974E069324F9C8FF"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator is authorized to operate,
				alone or in coordination with other Federal departments and agencies, a Tribal
				Business Information Centers program that provides Native American populations
				with business training and entrepreneurial development assistance.</text>
								</paragraph><paragraph id="HBFA93002FD8F4DE6A75EB80DE41046C0"><enum>(2)</enum><header>Designation of
				centers</header><text display-inline="yes-display-inline">The Administrator
				shall designate entities as centers under the Tribal Business Information
				Centers program.</text>
								</paragraph><paragraph id="HAF411D0C50874846A01CCB2D807B120C"><enum>(3)</enum><header>Administration
				support</header><text>The Administrator may contribute agency personnel and
				resources to the centers designated under paragraph (2) to carry out this
				subsection.</text>
								</paragraph><paragraph id="HA1AB00BA58CE4A388AA07375720A0FF5"><enum>(4)</enum><header>Grant
				program</header><text>The Administrator is authorized to make grants of not
				more than $300,000 to centers designated under paragraph (2) for the purpose of
				providing Native Americans the following:</text>
									<subparagraph id="H275FEC2EB4144A87A89F270933C73B27"><enum>(A)</enum><text display-inline="yes-display-inline">Business workshops.</text>
									</subparagraph><subparagraph id="H4163A10C0B494D1BA2455681A3E8DA06"><enum>(B)</enum><text>Individualized
				business counseling.</text>
									</subparagraph><subparagraph id="HACC9798EF0194125B0F7569BDD4C3DB4"><enum>(C)</enum><text>Entrepreneurial
				development training.</text>
									</subparagraph><subparagraph id="H6B23054B06024501907565E0EC09DF3D"><enum>(D)</enum><text>Access to computer
				technology and other resources to start or expand a business.</text>
									</subparagraph></paragraph><paragraph id="H6D0EB93EDAB04F558C9445E266F26279"><enum>(5)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator shall by regulation
				establish a process for designating centers under paragraph (2) and making the
				grants authorized under paragraph (4).</text>
								</paragraph><paragraph id="H11711143901B46ABA64E51BE413435EB"><enum>(6)</enum><header>Definition of
				Administrator</header><text display-inline="yes-display-inline">In this
				subsection, the term <term>Administrator</term> means the Administrator, acting
				through the Associate Administrator administering the Office of Native American
				Affairs.</text>
								</paragraph><paragraph id="H73FE242F3A0748BF82FD9F3860A6BC74"><enum>(7)</enum><header>Authorization of
				appropriations</header><text>To carry out this subsection, there is authorized
				to be appropriated to the Administrator $15,000,000 for fiscal year 2010 and
				$17,000,000 for fiscal year 2011.</text>
								</paragraph></subsection><subsection id="H32DFC87B32A04A4D89B8BC44C2710EA0"><enum>(c)</enum><header>Definition of
				Native American</header><text>The term <term>Native American</term> means an
				Indian tribe member, Alaska Native, or Native Hawaiian as such are defined in
				section 21(a)(8) of this
				Act.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H36DE0B87ACB340FC84DB4DDF9A7845D4"><enum>3.</enum><header>Small Business
			 Development Center assistance to Indian tribe members, Alaska Natives, and
			 Native Hawaiians</header>
			<subsection id="HD3558BEC40A84AD0B202B428143DF3ED"><enum>(a)</enum><header>In
			 general</header><text>Section 21(a) of the <act-name parsable-cite="SBA">Small
			 Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(a)</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block act-name="Small Business Act" id="H1EE2686F3474476994EE542B879FEBE4">
					<paragraph id="H2877F515793B49CCA3F25AF13CDC42F6"><enum>(8)</enum><header>Additional grant
				to assist Indian tribe members, Alaska Natives, and Native Hawaiians</header>
						<subparagraph id="HA4D483CCB8264575AC330CFB20DA0D1D"><enum>(A)</enum><header>In
				general</header><text>Any applicant in an eligible State that is funded by the
				Administration as a Small Business Development Center may apply for an
				additional grant to be used solely to provide services described in subsection
				(c)(3) to assist with outreach, development, and enhancement on Indian lands of
				small business startups and expansions owned by Indian tribe members, Alaska
				Natives, and Native Hawaiians.</text>
						</subparagraph><subparagraph id="HCD2A7A51212F4EF292A4E88BAAEB9881"><enum>(B)</enum><header>Eligible
				States</header><text>For purposes of subparagraph (A), an eligible State is a
				State that has a combined population of Indian tribe members, Alaska Natives,
				and Native Hawaiians that comprises at least 1 percent of the State’s total
				population, as shown by the latest available census.</text>
						</subparagraph><subparagraph id="HF7474E4AA4674B928C8AED189116C74F"><enum>(C)</enum><header>Grant
				applications</header><text>An applicant for a grant under subparagraph (A)
				shall submit to the Administration an application that is in such form as the
				Administration may require. The application shall include information regarding
				the applicant’s goals and objectives for the services to be provided using the
				grant, including—</text>
							<clause id="HF323393F84FD478CB0833EEA098D2044"><enum>(i)</enum><text>the capability of
				the applicant to provide training and services to a representative number of
				Indian tribe members, Alaska Natives, and Native Hawaiians;</text>
							</clause><clause id="H6BC9DBE572BB419FB70A391CD9E78539"><enum>(ii)</enum><text>the location of
				the Small Business Development Center site proposed by the applicant;</text>
							</clause><clause id="H9A05E406609143D986B074776C9B5CEC"><enum>(iii)</enum><text>the required
				amount of grant funding needed by the applicant to implement the program;
				and</text>
							</clause><clause id="H9748C3AA46CB4134BC58EA5F8762F329"><enum>(iv)</enum><text>the extent to
				which the applicant has consulted with local tribal councils.</text>
							</clause></subparagraph><subparagraph id="HD5B3C861C98048DDAEE20AB1310BAA3C"><enum>(D)</enum><header>Applicability of
				grant requirements</header><text>An applicant for a grant under subparagraph
				(A) shall comply with all of the requirements of this section, except that the
				matching funds requirements under paragraph (4)(A) shall not apply.</text>
						</subparagraph><subparagraph id="H74DD4D46033E4BAB97E09EB021E9279E"><enum>(E)</enum><header>Maximum amount
				of grants</header><text>No applicant may receive more than $300,000 in grants
				under this paragraph for any fiscal year.</text>
						</subparagraph><subparagraph id="HC5C45F24F69047EC915D38B25DA2A107"><enum>(F)</enum><header>Regulations</header><text>After
				providing notice and an opportunity for comment and after consulting with the
				Association recognized by the Administration pursuant to paragraph (3)(A) (but
				not later than 180 days after the date of enactment of this paragraph), the
				Administration shall issue final regulations to carry out this paragraph,
				including regulations that establish—</text>
							<clause id="H5FB91C8396D64B04B9986EBA5683FE10"><enum>(i)</enum><text>standards relating
				to educational, technical, and support services to be provided by Small
				Business Development Centers receiving assistance under this paragraph;
				and</text>
							</clause><clause id="HED3367F5933B4D67A4A33D89FD48F712"><enum>(ii)</enum><text>standards
				relating to any work plan that the Administration may require a Small Business
				Development Center receiving assistance under this paragraph to develop.</text>
							</clause></subparagraph><subparagraph id="HE618041E9E72448AB3BDF1F94267A05A"><enum>(G)</enum><header>Advice of local
				tribal organizations</header><text>A Small Business Development Center
				receiving a grant under this paragraph shall request the advice of a tribal
				organization on how best to provide assistance to Indian tribe members, Alaska
				Natives, and Native Hawaiians and where to locate satellite centers to provide
				such assistance.</text>
						</subparagraph><subparagraph id="H2BB21194EE044C99A30532CD154F1D30"><enum>(H)</enum><header>Definitions</header><text>In
				this paragraph, the following definitions apply:</text>
							<clause id="HE544CF4D789543858F4727AA4339AC83"><enum>(i)</enum><header>Indian
				lands</header><text>The term <term>Indian lands</term> has the meaning given
				the term <term>Indian country</term> in
				<external-xref legal-doc="usc" parsable-cite="usc/18/1151">section
				1151</external-xref> of title 18, United States Code, the meaning given the
				term <term>Indian reservation</term> in
				<external-xref legal-doc="regulation" parsable-cite="cfr/25/151.2">section
				151.2</external-xref> of title 25, Code of Federal Regulations (as in effect on
				the date of enactment of this paragraph), and the meaning given the term
				<term>reservation</term> in section 4 of the Indian Child Welfare Act of 1978
				(<external-xref legal-doc="usc" parsable-cite="usc/25/1903">25 U.S.C.
				1903</external-xref>).</text>
							</clause><clause id="H7F730C028D8B4B4E91169F968D4236A5"><enum>(ii)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> means any band, nation,
				or organized group or community of Indians located in the contiguous United
				States, and the Metlakatla Indian Community, whose members are recognized as
				eligible for the services provided to Indians by the Secretary of the Interior
				because of their status as Indians.</text>
							</clause><clause id="HCAB310F539F44005B4CB807A0811BA9E"><enum>(iii)</enum><header>Indian tribe
				member</header><text>The term <term>Indian tribe member</term> means a member
				of an Indian tribe (other than an Alaska Native).</text>
							</clause><clause id="HDED5391CE30947DE965D0D04A9291FB8"><enum>(iv)</enum><header>Alaska
				Native</header><text>The term <term>Alaska Native</term> has the meaning given
				the term <term>Native</term> in section 3(b) of the Alaska Native Claims
				Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43
				U.S.C. 1602(b)</external-xref>).</text>
							</clause><clause id="H15247ECA10EA47C2B2ED73C21A049981"><enum>(v)</enum><header>Native
				Hawaiian</header><text display-inline="yes-display-inline">The term
				<term>Native Hawaiian</term> means any individual who is—</text>
								<subclause id="H2839A41E94474372A199543423AFE078"><enum>(I)</enum><text>a citizen of the
				United States; and</text>
								</subclause><subclause id="H4C8C0EB713AD404A88851D5759A6E943"><enum>(II)</enum><text>a descendant of
				the aboriginal people, who prior to 1778, occupied and exercised sovereignty in
				the area that now constitutes the State of Hawaii.</text>
								</subclause></clause><clause id="H8F48F245E0EF413B950F5C428A3C7C69"><enum>(vi)</enum><header>Tribal
				organization</header><text display-inline="yes-display-inline">The term
				<term>tribal organization</term> has the meaning given that term in section
				4(l) of the Indian Self-Determination and Education Assistance Act
				(<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C.
				450b(l)</external-xref>).</text>
							</clause></subparagraph><subparagraph id="HC4D263DB41624FD6880356725511850B"><enum>(I)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this paragraph $7,000,000 for each of fiscal years 2010 and 2011.</text>
						</subparagraph><subparagraph id="H7A3F9E15154F4D46B63C7B72A59ACE73"><enum>(J)</enum><header>Funding
				limitations</header>
							<clause id="HE4E30B10A2C94439B7CC7701AAEBE619"><enum>(i)</enum><header>Nonapplicability
				of certain limitations</header><text>Funding under this paragraph shall be in
				addition to the dollar program limitations specified in paragraph (4).</text>
							</clause><clause id="H9B5D3035D013419AA19F05CC4CD82062"><enum>(ii)</enum><header>Limitation on
				use of funds</header><text>The Administration may carry out this paragraph only
				with amounts appropriated in advance specifically to carry out this
				paragraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
