		<section display-inline="no-display-inline" id="H0B3C56F9CA8B4606AA74BE8C1D84E9B4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean Up Government Act of
			 2009</short-title></quote>.</text>
		</section><section id="HE11FFE9BE0EC465A966BA4BFCCB94500"><enum>2.</enum><header>Application of
			 mail and wire fraud statutes to licences and other intangible
			 rights</header><text display-inline="no-display-inline">Sections 1341 and 1343
			 of title 18, United States Code, are each amended by striking <quote>money or
			 property</quote> and inserting <quote>money, property, or any other thing of
			 value</quote>.</text>
		</section><section id="HED90A55F58944C548D7D3DA0C7FBDCF9"><enum>3.</enum><header>Venue for Federal
			 offenses</header>
			<subsection id="HFCE1378402824E00AF8471BB74C13640"><enum>(a)</enum><header>Venue includes
			 any district in which conduct in furtherance of an offense takes
			 place</header><text display-inline="yes-display-inline">Subsection (a) of
			 section 3237 of title 18, United States Code, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HEA6A75D75DC34CC699A4F30097A69716" style="USC">
					<subsection id="HA9B9D50B941D4061AB2DD2FF00736707"><enum>(a)</enum><text>Except as
				otherwise provided by law, an offense against the United States may be inquired
				of and prosecuted in any district in which any conduct required for, or any
				conduct in furtherance of, the offense took place, or in which the offense was
				completed.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H289E085C7EEE4AB4A6C4BFC91539BB13"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HE6D023B189734360AA567C4614775D4E"><enum>(1)</enum><header>Section
			 heading</header><text>The heading for section 3237 of title 18, United States
			 Code, is amended to read as follows:</text>

			 concerning programs receiving Federal financial assistance</header><text display-inline="no-display-inline">Section 666(a) of title 18, United States
			 Code, is amended by striking <quote>ten years</quote> and inserting <quote>20
			 years</quote>.</text>
		</section><section id="HB054056336284F8BB65028DC68E32E39"><enum>5.</enum><header>Penalty for
			 section 641 violations</header><text display-inline="no-display-inline">Section
			 641 of title 18, United States Code, is amended by striking <quote>ten
			 years</quote> and inserting <quote>20 years</quote>.</text>
		</section><section id="H32856AC04C42492F9849740007748519"><enum>6.</enum><header>Bribery and
			 graft</header><text display-inline="no-display-inline">Section 201 of title 18,
			 United States Code, is amended—</text>
			<paragraph id="HD70F7C94B4D04E6095E91E617E25A0AD"><enum>(1)</enum><text>in subsection (b),
			 by striking <quote>fifteen years</quote> and inserting <quote>30 years</quote>;
			 and</text>
			</paragraph><paragraph id="H39C040C9BA7A483BB99605D252999935"><enum>(2)</enum><text>in subsection (c),
			 by striking <quote>two years</quote> and inserting <quote>five
			 years</quote>.</text>
			</paragraph></section><section id="H3CCAD08DB10649C8B2B572B8A2618014"><enum>7.</enum><header>Addition of
			 District of Columbia to theft of public money offense</header><text display-inline="no-display-inline">Section 641 of title 18, United States Code,
			 is amended by inserting <quote>the District of Columbia or</quote> before
			 <quote>the United States</quote>.</text>
		</section><section id="HE5DE66BF9A9547DC8D1B19D000FE52F3"><enum>8.</enum><header>Clarification of
			 crime of illegal gratuities</header><text display-inline="no-display-inline">Paragraphs (A) and (B) of section 201(c)(1)
			 of title 18, United States Code, are each amended by inserting <quote>the
			 official’s official position or</quote> before <quote>any official
			 act</quote>.</text>
		</section><section id="H025312BA2A3743C0B4F956F8D27D8B30"><enum>9.</enum><header>Clarification of
			 definition of <quote>official act</quote></header><text display-inline="no-display-inline">Section 201(a)(3) of title 18, United States
			 Code, is amended by striking <quote>any decision</quote> and all that follows
			 through <quote>profit</quote> and inserting <quote>any decision or action
			 within the range of official duty of a public official</quote>.</text>
		</section><section id="HC0646E907EAE4810BF6FD556007FB3CD"><enum>10.</enum><header>Amendment of the
			 sentencing guidelines relating to certain crimes</header>
			<subsection id="HAC67D3A0B8A84F30BA6B05E5BBF54C"><enum>(a)</enum><header>Directive to
			 Sentencing Commission</header><text display-inline="yes-display-inline">Pursuant to its authority under section
			 994(p) of title 28, United States Code, and in accordance with this section,
			 the United States Sentencing Commission forthwith shall review and amend its
			 guidelines and its policy statements applicable to persons convicted of an
			 offense under sections 201, 641, 666, 1962 of title 18, United States Code in
			 order to reflect the intent of Congress that such penalties be increased in
			 comparison to those currently provided by guidelines and policy
			 statements.</text>
			</subsection><subsection id="H440DA369419F411DB708D9DD3B1CEFA7"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this subsection, the
			 Commission shall—</text>
				<paragraph id="H72FEC51D086747F494EF9CF4005E0003"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect Congress’ intent that the guidelines and policy
			 statements reflect the serious nature of the offenses described in paragraph
			 (1), the growing incidence of such offenses, and the need for an effective
			 deterrent and appropriate punishment to prevent such offenses.</text>
				</paragraph><paragraph id="H6E6453D42A674BAE9C1CC04592527BF6"><enum>(2)</enum><header>Consider the
			 extent to which the guidelines may or may not appropriately account
			 for</header>
					<subparagraph id="H58D0F70F3D114B24A000D0012A8AE11"><enum>(A)</enum><text>the potential and
			 actual harm to the public and the amount of any loss resulting from the
			 offense;</text>
					</subparagraph><subparagraph id="H9F9048127FA348BBA1A3A8AAC36EF668"><enum>(B)</enum><text>the level of
			 sophistication and planning involved in the offense;</text>
					</subparagraph><subparagraph id="HF173B51A82CF4A4C8E0262E05252FC1F"><enum>(C)</enum><text>whether the
			 offense was committed for purposes of commercial advantage or private financial
			 benefit;</text>
					</subparagraph><subparagraph id="HC18222C56E644D9AACFB501443CB9704"><enum>(D)</enum><text>whether the
			 defendant acted with intent to cause either physical or property harm in
			 committing the offense;</text>
					</subparagraph><subparagraph id="H1E12D56A97624632828E95BEB72347A7"><enum>(E)</enum><text>the extent to
			 which the offense represented an abuse of trust by the offender and was
			 committed in a manner that undermined public confidence in the Federal, State
			 or local government; and</text>
					</subparagraph><subparagraph id="H6DA63698FFDB4A75B80091F9B13700F7"><enum>(F)</enum><text>whether the
			 violation was intended to or had the effect of creating a threat to public
			 health or safety, injury to any person or even death;</text>
					</subparagraph></paragraph><paragraph id="H9D0301B1F8264664964D54860054D433"><enum>(3)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
				</paragraph><paragraph id="H48F66522531D4DD1BD18457D93C6F540"><enum>(4)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="H83F49AE7AE2E4637BAB9243F00FE114B"><enum>(5)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>
				</paragraph><paragraph id="H14E499F3147B4950A3D9665400B0B484"><enum>(6)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
