		<section id="H3035FA54EFCC48228B26919C9AC84424" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Product Safety Solutions Act of
			 2009</short-title></quote>.</text>
		</section><section id="H61C67E814D604BBFA8D0F1C19CBC9E00"><enum>2.</enum><header>Prospective
			 application of lead limits and third party testing requirements</header>
			<subsection id="HBE46BA4A49A644299BC970B1C2187B4E"><enum>(a)</enum><header>Lead
			 content</header><text display-inline="yes-display-inline">Section 101 of the
			 Consumer Product Safety Improvement Act of 2008 (15 U.S.C. 1278a) is
			 amended—</text>
				<paragraph id="HBB4FB3ED249B4F5F99FC9E1C58C3F154"><enum>(1)</enum><text>by redesignating
			 subsection (b) through (g) as subsections (c) through (h), respectively;</text>
				</paragraph><paragraph id="H51AB0870CE634E5DB5DCFA2882695403"><enum>(2)</enum><text>by inserting after
			 subsection (a) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H67C922C5E5A04084B333335B34F07CF" style="OLC">
						<subsection id="HBA96E38723234B379D57F3EA7DB73470"><enum>(b)</enum><header>Application</header>
							<paragraph id="HE7EFAC4C48644EC8BAEC8C255FE26590"><enum>(1)</enum><header>600 parts per
				million</header><text>Subsection (a)(2)(A) shall apply beginning February 10,
				2009, only to any children’s product that is manufactured after such date, and
				after February 9, 2010, to any children’s product regardless of the date of
				manufacture.</text>
							</paragraph><paragraph id="H45773C7BA7FD40F785B5604D5DBB13CB"><enum>(2)</enum><header>300 parts per
				million</header><text>Subsection (a)(2)(B) shall apply beginning 2 years after
				the date of enactment of this Act only to any children’s product that is
				manufactured after such date, and beginning 3 years after the date of enactment
				of this Act, to any children’s product regardless of the date of
				manufacture.</text>
							</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H45B3DB34C5304C0DB236423D5DBBAE49"><enum>(3)</enum><text>in subsection
			 (e)(2), by striking <quote>subsection (b)</quote> and inserting
			 <quote>subsection (c)</quote>; and</text>
				</paragraph><paragraph id="HC68C278B6F8D41BE9F913D31602BA87F"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (g), by striking <quote>or
			 (b)</quote> and inserting <quote>or (c)</quote>.</text>
				</paragraph></subsection><subsection id="H7596D2C2B891426BA0483BBD1920F2FD"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) shall be treated as
			 having taken effect on August 15, 2008.</text>
			</subsection></section><section id="H933240634A63411CAFE09EF821BDD66C"><enum>3.</enum><header>Prospective
			 application of phthalates prohibition</header>
			<subsection id="H2FD8D87CFEC64FA69444D21DDDC19CAA"><enum>(a)</enum><header>Application of
			 phthalates prohibition</header><text display-inline="yes-display-inline">Section 108 of the Consumer Product Safety
			 Improvement Act of 2008 (15 U.S.C. 1257c) is amended—</text>
				<paragraph id="H70F5AF748482421EA120F4FB68D9F0C1"><enum>(1)</enum><text>by redesignated
			 subsections (c) through (e) as subsection (d) through (f), respectively;
			 and</text>
				</paragraph><paragraph id="H6232CA2E1425486F985CA03CDEA335DE"><enum>(2)</enum><text>by inserting after
			 subsection (b) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC38CD7D0DC08416C97ECC7DF6F0E8705" style="OLC">
						<subsection id="HF69D3258C6A34A749858C8371E6C737B"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">Subsections (a) and (b)(1) and any rule
				promulgated under subsection (b)(3) shall apply beginning February 10, 2009,
				only to any children’s product that is manufactured after such date, and after
				February 9, 2010, to any children’s product regardless of the date of
				manufacture.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H961BDBF5DB3C4802B15BD45349FCED77"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) shall be treated as
			 having taken effect on August 15, 2008.</text>
			</subsection></section><section id="H0F34F709B85A42D0BEDC68009B2BCEB5"><enum>4.</enum><header>Clarification of
			 testing methodologies</header>
			<subsection id="HAF44C7D3E2764CB287A0C115EADEACE1"><enum>(a)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Consumer Product Safety Commission shall promulgate
			 a rule setting forth the testing methodology or methodologies which the
			 Commission determines shall be used for purposes of determining compliance with
			 sections 101(a) and 108 of the Consumer Product Safety Improvement Act of 2008
			 (15 U.S.C. 1278a(a); 2057c).</text>
			</subsection><subsection id="H6818D5F6057C46DE9F010515ECF9A63F"><enum>(b)</enum><header>Effective date
			 for conformity certification</header><text display-inline="yes-display-inline">Section 14(a)(1) of the Consumer Product
			 Safety Act (15 U.S.C. 2063(a)(1)) is amended by striking <quote>Except as
			 provided</quote> and inserting <quote>Beginning 90 days after the issuance of a
			 rule required by section 4(a) of the Consumer Product Safety Solutions Act of
			 2009 except as provided</quote>.</text>
			</subsection><subsection id="H5F83F11EB1D74CAB8596B5E6D61717DE"><enum>(c)</enum><header>Temporary rule
			 of compliance</header><text display-inline="yes-display-inline">Beginning
			 February 10, 2009, and continuing until a rule is promulgated under subsection
			 (a), any children’s product that is tested for conformity with the requirements
			 of section 101(a) and section 108 of the Consumer Product Safety Improvement
			 Act of 2008 (15 U.S.C. 1278a(a); 2057c) and certified pursuant to section
			 14(a)(1) of the Consumer Product Safety Act (15 U.S.C. 2063(a)(1)) shall be
			 considered to be in compliance with such section if such children’s product was
			 tested in good faith and in accordance with a reasonable testing methodology
			 and the product was certified based on the results of such testing.</text>
			</subsection></section><section id="HF3CB52DC25A644D9AC9C68CB13550300"><enum>5.</enum><header>Exclusion of
			 certain materials from lead content limit</header><text display-inline="no-display-inline">Section 101(c)(1) of the Consumer Product
			 Safety Improvement Act of 2008 (15 U.S.C. 1278a(c)(1)) (as redesignated by
			 section 1) is amended—</text>
			<paragraph id="H7C8DBA7D61BB417A947C85CE301736B6"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>material will neither—</quote>
			 and inserting <quote>material—</quote></text>
			</paragraph><paragraph id="HB36C4195B7544F3B97D7937594E54CFB"><enum>(2)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="HD08D02B1F0E3470E93D624C998F1C35F"><enum>(A)</enum><text>by striking
			 <quote>result in the absorption of any lead into the human body</quote> and
			 inserting <quote>will not result in the absorption of lead into the human body
			 in excess of the amounts set forth under subsection (a)(2)</quote>;</text>
				</subparagraph><subparagraph id="HA30C47EFE675458598C400A860786717"><enum>(B)</enum><text>by inserting
			 <quote>of the age for which the product is intended</quote> after
			 <quote>child</quote>; and</text>
				</subparagraph><subparagraph id="HCE3F0921D594422F83A62AEBBA9106B8"><enum>(C)</enum><text>by striking
			 <quote>nor</quote> and inserting <quote>or</quote>; and</text>
				</subparagraph></paragraph><paragraph commented="no" id="H55D513427D294A1E8826F981F8620008"><enum>(3)</enum><text>in subparagraph
			 (B), by striking <quote>have any other</quote> and inserting <quote>will not
			 have any</quote>.</text>
			</paragraph></section><section id="H90620F75DB9F47FA8C01412D83562EBB"><enum>6.</enum><header>Waiver of third
			 party testing requirement for certain component parts</header><text display-inline="no-display-inline">Section 14(g) of the
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15
			 U.S.C. 2063(g)) is amended by adding at the end the following:</text>
			<quoted-block act-name="Consumer Product Safety Act" id="H95DA37A08276400AB762FD86424300F3" style="OLC">
				<paragraph id="HE69982B1BECD4A689F9984824D18A25B"><enum>(5)</enum><header>Special rule for
				lead content and phthalate content testing and
				certification</header><text>Subsection (a) shall not require the manufacturer
				or private labeler of a children’s product to test such product for, or certify
				it with respect to, lead content or phthalate content, as applicable,
				if—</text>
					<subparagraph id="HCF0C05BB5D9646ED8461033DC9C9F978"><enum>(A)</enum><text display-inline="yes-display-inline">each component of the product that is
				required to be tested for compliance with sections 101(a) and 108 of the
				Consumer Product Safety Improvement Act of 2008 (15 U.S.C. 1278a(a); 2057c) has
				been tested for lead content or phthalate content, as applicable, by the
				manufacturer or private labeler of the component; and</text>
					</subparagraph><subparagraph id="H056A3A650B0D4878A540092DD607ED29"><enum>(B)</enum><text>the manufacturer
				or private labeler of each such component certifies that the component does not
				contain more lead than the limit established by subsection (a)(2) and (f) of
				section 101 of the Consumer Product Safety Improvement Act of 2008 (15 U.S.C.
				1278a(a)(2) and (f)) or the applicable phthalate limit in effect under section
				108 of such Act, as
				applicable.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H346441BE13FC476083B22DD82F71719E" section-type="subsequent-section"><enum>7.</enum><header>Exemptions from
			 tracking label requirements</header><text display-inline="no-display-inline">Section 14(a)(5) of the Consumer Product
			 Safety Act (15 U.S.C. 2063(a)(5)) is amended—</text>
			<paragraph id="H2C964466B9034B8FBD105D8365C02480"><enum>(1)</enum><text>by striking
			 <quote>Effective</quote> and inserting <quote>(A)
			 <header-in-text level="paragraph" style="OLC">In
			 general</header-in-text>—Effective</quote>;</text>
			</paragraph><paragraph id="H70A3364E32CB410698760A6C2A103E80"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HD6CFD70C06414E3D846714F8B3F4F54B" style="OLC">
					<subparagraph commented="no" id="HB02CB9548293456781F4E108DDF2D437"><enum>(B)</enum><header>Commission
				exemptive authority</header><text display-inline="yes-display-inline">The
				Commission may, by rule, exempt or modify any of the requirements of this
				section for any product or product category, if the Commission determines such
				requirement to be unduly burdensome or cost prohibitive in relationship to the
				potential risk presented by such product or product category, or not practical
				due to the intended use of such product or product
				category.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB790E9730568448BB2E428F1C606E800"><enum>8.</enum><header>General
			 application and exemptive authority</header><text display-inline="no-display-inline">Section 3 of the Consumer Product Safety
			 Improvement Act of 2008 (15 U.S.C. 2051 note) is amended—</text>
			<paragraph id="H26C44522D632434CBFCC59488B5F39BF"><enum>(1)</enum><text>by striking
			 <quote>The</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general</header-in-text>.—The</quote>; and</text>
			</paragraph><paragraph id="HF6BA9C854C3C417AB8AE2D41EFBE6798"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA40EAE2D273B496CBC05048388784291" style="OLC">
					<subsection commented="no" id="H92B121E1EBE44734B3DEAB3609734D48"><enum>(b)</enum><header>Authority To
				extend or delay effective dates</header><text display-inline="yes-display-inline">The Commission may extend the application
				of the effective date of any provision of this Act or the amendments made by
				this Act with respect to any particular manufacturer, distributer, or retailer
				or class of manufacturers, distributors, or retailers if the Commission
				determines that a delay would better promote public safety and that a later
				effective date is in the public interest and publishes the reason for such a
				determination.</text>
					</subsection><subsection commented="no" id="H2369DD9D85C14302A7A69887268BAB7B"><enum>(c)</enum><header>Exemptive
				authority</header><text display-inline="yes-display-inline">The Commission may
				exempt a particular manufacturer, distributor, or retailer or class of
				manufacturers, distributors, or retailers from any provision of this Act or the
				amendments made by this Act if the Commission determines that a delay would
				better promote public safety and that such exemption is in the public interest
				and publishes the reason for such
				determination.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H34649C8793F54AB0BA2186BA9E3E06F"><enum>9.</enum><header>Compliance
			 guidance for small businesses</header>
			<subsection id="H4E167590C3474447A36C893283AC0245"><enum>(a)</enum><header>In
			 General</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Consumer Product Safety Commission shall develop and make
			 available on the Commission’s Internet website a compliance guide to assist
			 small businesses in complying with the requirements of the
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15
			 U.S.C. 2051 et seq.) and other Acts enforced by the Commission.</text>
			</subsection><subsection id="H10F8556FFE1D4A0CB6F442AE7FB9B582"><enum>(b)</enum><header>Contents</header><text>The
			 guide—</text>
				<paragraph id="H8E598D0112AB42A6811252A3AE5BFF"><enum>(1)</enum><text>shall be designed to
			 assist small businesses to determine—</text>
					<subparagraph id="H7197CCBB11ED445B952128483BCFADA3"><enum>(A)</enum><text>whether the
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (or any
			 other Act enforced by the Commission) applies to their business
			 activities;</text>
					</subparagraph><subparagraph id="H9D2DA5BEDEF24147941B81C61421956E"><enum>(B)</enum><text>whether they are
			 considered distributors, manufacturers, private labelers, or retailers under
			 such Act or Acts; and</text>
					</subparagraph><subparagraph id="H276F21D320294E33AC285DCAC22DD8A5"><enum>(C)</enum><text>which rules,
			 standards, regulations, or statutory requirements apply to their business
			 activities;</text>
					</subparagraph></paragraph><paragraph id="HEC0523D9580340C09C15A519F0F4279C"><enum>(2)</enum><text>shall provide
			 guidance on how to comply with any such applicable rule, standard, regulation,
			 or requirement, including—</text>
					<subparagraph id="H835B7CBB4DD448BCB836EDF9D81C8BDC"><enum>(A)</enum><text>what actions they
			 should take to ensure that they meet the requirements; and</text>
					</subparagraph><subparagraph id="H3E3E6B56E1214E5B8D00E5F26F3E6FA1"><enum>(B)</enum><text>how to determine
			 whether they have met the requirements; and</text>
					</subparagraph></paragraph><paragraph id="HB8F3895A26134E308B219F806332C312"><enum>(3)</enum><text>may contain such
			 additional information as the Commission considers appropriate, including
			 telephone, e-mail, and Internet contacts for compliance support and
			 information.</text>
				</paragraph></subsection></section></legis-body>
